MINUTES
JANUARY 9 , 1985
7 : 00 P . M.
The Wylie City Council met in regular session on Tuesday ,
January 9 , 1985 at 7 : 00 P . M. in the Council Chambers at
City Hall . Mayor Pro Tem Hughs presided . A. quorum was
present and notice of the meeting had been posted for the
time and in the manner required by law. Those present were
Mayor Pro Tem Don Hughes , Councilmeibers William Martin ,
Cleo Adams , Percy Simmons , Joe Fulgham , City Manager Gus
Pappas , City Secretary Carolyn Jones , Public Works Director
Bill Windham, Code Enforcement Officer Roy Faires , Chief
Abbott , Barron Cook , Scott Dorsey and Elayne Mayes from the
Wylie News , Fred Ouellette , Larry Jackson , City Attorney .
Mayor John Akin was out of town .
Mayor Pro Tem Hughes called the meeting to order and
Councilman Adams gave the invocation .
APPROVAL OF MINUTES : Motion was made by Councilman Fulgham
to approve minutes as submitted . Seconded by Councilman
Adams , all in favor .
APPROVAL OF ORDINANCE FINDING THE CITY OF WYLIE HAS MORE
THAN 5000 INHABITANTS : Motion was made by Councilman Adams
and seconded by Councilman Simmons to approve and sign the
above ordinance . All in favor .
City Manager Gus Pappas said there has been a lot of
discussion about the Home Rule Charter and the City ' s ETJ
under Texas Law. The above action just approved and passed
has given the City of Wylie the one ( 1 ) mile ETJ. The Home
Rule Charter does not have to pass in order to be at the one
( 1 ) mile ETJ .
AWARD BID FOR BACKHOE : The City of Wylie received only one
bid for a backhoe . This bid came from Mahanay
International , Inc . for a 1981 Internatinal Model 280 Series
A Loader-backhoe tractor . All standard factory equipment ,
24" R_ 30" buckets , new 18 . 4-28 10 ply tires on rear , digmor
model 438-4 4 ' hydraulic extendible dipperstick , 90 day
parts and labor warranty on engine , transmission , torque
converter , rear axle , and hydraulic pumps . Total bid price
of $20 , 500 . Motion was made by Councilman Simmons to accept
bid from Mahanay International , Inc . for the sum of $20 , 500 .
Seconded by Councilman Fulgham , all in favor .
FINAL PLAT FOR ROCKY TOP DEVELOPMENT : This item was put on
the Council agenda prior to going through Planning and
Zoning Commission . Therefore , this item will have to be

tabled . Motion was made by Councilman Simmons to table the
final plat for Rocky Top . Seconded by Councilman Martin .
All in favor .
APPROVAL OF FINAL PLAT FOR CANTERBURY HILL : Canterbury Hill
is an addition being developed in the county but inside the
City of Wylie ' s ETJ . This development is located east of
Wylie on Beaver Creek Road . City staff reports that Beaver
Creek Read was not wide enough and the developer did agree
to change the width of this road . Also , there is a utility
easement which has been made a part of this plat and will
always be an open area . There is a 6" water line in this
plat but the ordinance of the City of Wylie states this
water line should be an 8" line for the right kind of fire
protection . The developer has not shown alleys on the plat
and the City ' s sub division ordinance does call for alleys .
Staff does feel that the alleys are not necessary since
these lots are 1 acre or more . Staff does feel there needs
to be a sewer system put into this development instead of
septic tanks . The City staff has requested the developer to
put in sewer lines that will flow by gravity into a holding
tank until such time a lift station is in this area .
Planning and Zoning made a motion to reject this plat until
it complied with the sub division ordinance . The vote was 4
in favor of resection and 2 abstained . Staff recommends
this plat be rejected until it complies with the sub "~"
division ordinance .
Barron Cook said if the only problem with this plat is the
septic tank system , he will be more than glad to put in a
sewer system as explained above . Mr . Cook said his
engineers has come up with a plat for 20 lots which will
bring in additional funds for the cost of this sewer line ,
but he is not sure he wants to go to 20 lots . This is in an
area where there are only one acre or more lots and he does
not want to get away from this size lots . Barron Cook said
this suL division is two ( 2) miles away from a concrete
street and does not feel he should have to put in concrete
streets . This is an improvement that is very costly and Mr .
Cook does not for see the extra funds for such expense .
Mr . Paul :i1y , attorney for Mr . Barron Cook , said this was an
unusal situation . These people developed Beaver Creek which
has approximately 50 lots and now they want to developement
an area just north of Beaver Creek , and did not understand
this property was in the ETJ of Wylie . The developer has
spent a lot of time in this area and does not feel they can
come up the standards of the City codes . This would bring
the lots to a cost of over $40, 000 . plus the cost of
building a home on the lots . The estimated cost of sewer
lines is $71 , 500 , this is for 20 lots , an estimated cost for
the concrete street is $119 , 185 . The developer does not see
why this one section has to be concrete when prior to this
sub division will be black top and just south of the sub

division it will again be black top roads . Mr . Phy does not
feel that the City ' s sub division ordinance addresses the
fact of 1 acre country lots for a sub division . Mr . Phy
said he agreed that it would take an amendment to the sub
division ordinance in order for this plat to be approved .
City Manager Gus Pappas asked Mr . Phy if this developer
wanted the City to exempt sub division of 17 acres or less
from having to comply with the sub division ordinance . Mr .
Phy said he would not tell the city what to do but he would
like to see an amendment to the sub division ordinance for
this type of country developments .
Councilman Simmons wanted to know what improvements the
developer would make . This developer will bring in a 6"
water line from the now existing 6" water line and tie it
into a 2" water line , which will loop the system. Will add
fire hydrants and put in a holding tank plus sewer lines .
Councilman Fulgham wanted to know if the council would annex
this property if it was not in compliance with the City ' s
sub division ordinance . Councilman Martin said that is why
the sub division ordinance was written to help with the
future growth and planning of the City of Wylie .
Motion was made by Councilman Simmons to deny approval of
this final plat because it does not comply with the sub
division ordinance for the city . Seconded by Councilman
Martin , all in favor .
AMENDMENTS TO MOBILE HOME PARK ORDINANCE : City Manager Gus
Pappas said there should be some discussion about certain
sections of this ordinance . First section is the annual
permit fee section 2 . 05 . Staff recommends for your
consideration a fee of $20 . 00 per lot , instead cf the 150 .
per lot . Next section is density requirements . The density
in existing ordinance is greater than the lot si:e of he SF
1 lots in the new zoning ordinance . SF 3 is 6 . 05 units per
acre . Staff recommends 7 . 5 density with a lot size of 50 ' X
110 ' . Fencing requirements should read a solid fe; ee
instead of brick . The operator of the park must keep the
fence in good order . Section 7 . 02 B internal street_: will
be required to provide the city a public safety acc, ss . If
the mobile home operator provides two ( 2) off street parking
places then the streets can he 27 ' . Section 7 . 03 concerning
concrete slab under each mobile home . The tie down may be
required to be in concrete but it is not necessary for a
slab to be under the entire home . All mobile home parks
should be connected to the public water and sewer system of
the City , and there must be sidewalks throughout the park .
Staff will have an amended ordinance for council discussion
and approval ,at the next council meeting .
APPROVAL OF BILLS PAID AND ACCOUNTS PAYABLE : Motion was
made by Councilman Simmons to approve all bills paid and
accounts payable as submitted . Seconded by Councilman
Adams , all in favor .
DEPARTMENTAL REPORTS : All departmental reports were
accepted as submitted .
Motion was made by Councilman Martin to convene into
executive session under authority of Article 6252-17 of
Vernon ' s Annotated Civil Statutes Section 2 paragraph "j"
public safety . Seconded by Councilman Fulgham, all in
favor .
Motion was made by Councilman Simmons to reconvene into open
session . Seconded by Councilman Martin , all in favor .
There being no decision from the executive session , motion
was made by Councilman Simmons to adjourn , seconded by
Councilman Fulgham. All in favor .
