03-26-1985 (City Council) Minutes CITY COUNCIL MEETING MINUTES MARCH 26, 1985 7 :00 P. M. The Wylie City Council met in regular session on Tuesday , March 26 , 1985 at 7 : 00 P . M. in the Council Chambers at City Hall . Mayor Akin presided . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were Mayor John W. Akin , Mayor Pro Tem Don Hughes , Councilmen Percy Simmons , Randall Gaston , Cleo Adams , William Martin , and Joe Fulgham, City Manager Gus Pappas , City Secretary Carolyn Jones , Code Enforcement Officer Roy Faires , Public Works Director Bill Windham , Elayne Mayes , Scott Dorsey , John Seeley , Bob Vincent , Fred Ouellette , Bill Lowe of Lone Star Gas , Gary Roddy and other citizens . Mayor ,'' '.in called the meeting to order and Councilman Martin gave the invocation . APPROVAL OF MINUTES : There being no corrections or additions to the minutes , Mayor Pro Tem Hughes made a motion to approve as submitted . Seconded by Councilman Simmons .The vote as was follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman ...••• Gaston - in favor , Councilman Fulgham - no vote - Councilman Adams - in favor , and Councilman Martin - in favor . This notion carried with all in favor . APPROVAL OF PROCLAMATION DECLARING MARCH 30 , 1985 AS ST. JUDE CHILDREN ' S RESEARCH HOSPITAL DAY : Motion was made by Councilman Martin to approve and sign the proclamation for St . Jude Children ' s Research Hospital Day . Seconded by Councilman Adams . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . APPROVAL OF ANNEXATION ORDINANCE FOR 21 . 0541 ACRES OUT OF L . K . PEGUES SURVEY , ABSTRACT 703 , AND I . & G. N . RY . CO . SURVEY , ABSTRACT NO . 1060 : Tkis property is located east of the intersection of FM 544 ane Hooper Road . Motion was made by Councilman Martin to approve and sign the annexation ordinance for the above mentioned property . Seconded by Councilman Adams . SURVEY , ABSTRACT 1061 : This property is located east of the intersection of FM 544 and Hooper Road . The petitioner has requested Industrial Zoning for this 21 . C541 acres . Planning and Zoning is recommending to the Council that B-2 zoning be placed on the property fronting FM 544 , about 200- 400- ft . deep . This will allow for outside sales and storage but does not allow for manufacturing . Mayor Akin opened the public hearing , there be not questions or opposition , the public hearing was closed . APPROVAL OF THE ZONING ORDINANCE FCR 21 . 0541 ACRES OUT OF THE L . K . PEGUES SURVEY , ABSTRACT 703 AND I . & G . N . RY . CO . SURVEY , ABSTRACT 1061 . The zoning for this propel-ley is Industrial and 3-2 for the frontage of FM 544 and 200-400 ft . deep . Motion was made by Councilman Fulgham , seconded by Mayor Pro Tem Hughes . Motion was made by Councilman Gaston to approve and sign the annexation ordinance . Seconded by Mayor Pro Tem Hughes . The vote was as follows : Mayor Akin - in favor , mayor Pro Tem Hughes - in favor , Councilman Simmons -- in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . PUBLIC HARING ON ZONING 33 . 3358 ACRES OUT OF THE WILLIAM SACHSE SURVEY , ABSTRACT 335 : This property is located south of and adjacent to Steel Industrial Park and the petitioner has requested Industrial Zoning . Mayor Akin opened the public hearing , there being no questions or opposition , the public hearing was closed . APPROVAL AND SIGNING OF THE ZONING ORDINANCE FOR 33 . 885 ACRES OUT OF THE WILLIAM SACHSE SURVEY , ABSTRACT 335 : This property is being zoned Industrial as requested . Motion was made by Mayor Pro Tem Hughes to approve and sign the zoning ordinance on the above property . Seconded by Councilman Martin . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Fulgham. - in favor , Councilman Gaston - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . FINAL PUELIC HEARING ON THE ANNEXATION OF 7 . 50 ACRES OUT OF THE WILLIAM SACHSE SURVEY , ABSTRACT 835 . This property is located on Hooper Road , south of FM 544 . This property is owned by Duane and Alice Helmberger . Mayor Akin opened the public hearing , there being no questions or opposition , the public hearing was closed . FINAL FOR CONSTRUCTION PLAT FOR 544 INDUSTRIAL PARK : There was some discussion on the cul-de-sac , but this seems to be the only turn around for fire trucks . Century Trucking is next to this and there is no reason to make a street that goes through Century Trucking . Motion was made by Councilman Simmons to approve the final plat for construction . Seconded by Mayor Pro Tem Hughes . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . ,PPROVAL OF PRELIMINARY PLAT FOR CENTURY BUSINESS PARK : This property is located on south State Highway 78 , just south of Gary Roddy Real Estate office . On this plat Alanis Lane is shown from Highway 78 to Martinez and will continue on sometimes in the future to S . Ballard St . Motion was mode by Councilman Adams to approve the preliminary plat . Seconded by Councilman Martin . The vote was as follows : .... Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - abstain , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor and Councilman Martin - in favor . This motion carried with cix (6) in favor and one abstention . APPROVAL OF PRELIMINARY PLAT FOR SOUTHPLACE ESTATES : This property is located on S . Ballard Street across from Westwind Meadows . Planning and Zoning recommends this plat with a few stipulations ; namely that Aspen Dr . be located directly across from Stoneybrook to facilitate access ; a walkway be installed by the developer between lots 20 & 21 and lots 10 and 11 for school children . These recommend- ations were approved by a vote of 5-0 by the Planning and Zoning Commission . Motion was made by Mayor Pro Tem Hughes to approve the preliminary plat for Soathplace with two stipulations ; 1 . Aspen Dr . be located directly across from Stoneybrook and 2 . a walkway be installed between lots 20 and 21 and lots 10 & 11 . Seconded by Councilman Simmons . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carriea with all in favor . ACCEPTANCE OF 1 . 0401 ACRES OCT 02 THE AARON WEST SURVEY , ABSTRACT 979 FOR A UASTEWACER LIFT STATION FROM G . S . oo RICHARDS : This property is the tract of land south of Stone Road where it intercets Rush Creek and is the now preferred location for the Rush Creek Lift Station . Motion was made by Mayor Pro Ten Hughes to accept 1 . 0401 acres from G . S . Richards for a wastewater lift station . Seconded by Councilman Martin . The vote was as follows : Mayor Akin - in favor , Mayor Pro Ten Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . AUTHORIZATION TO GO OUT FOR BiDS PUMPS ArTD EQUIPMENT FOR GROUND STORAGE TANKS : It is necessary that we have the council ' s ap roval to open the invitations to bid on pumps and special fittings which are necessary to complete the installation of our ground storage facilities at Steel Industrial and Nortex . Motion was made by Councilman Simmons to grant authorization to go out for bids for pumps and equipment for ground storage tanks . Seconded by Mayor Pro Tem Hughes . The vote was as follows : Mayor Akin! - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . AUTHORIZATION TO GO OUT FOR BIDS FOR •EQUiPMEN T AND FURNISHINGS FOR NEW LIBRARY : It is necessary that -le have the council ' s approval to receive bids for the shelving and furniture for the new library . Motion was made by Councilman Fulgham , seconded by Councilman Adams . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem riughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . AUTHORIZATION TO GO OUT FOR BIDS FOR LIFT STATION TANKS : It is necessary for the staff to have the council ' s approval to receive bids for the tanks for at least the Rush Creek Lift Station and the Muddy Creek Lift Station . Motion was made by Councilman Martin , seconded by Councilman Adams . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . AUTNORINATION FOR POSITION CF INSPECTOR FOR 1 Sz 2 FAMILY DUS CLINGS AND SANITATION : The increas e in building activity has caused concern among staff anc Council members about our ability to keep up with the ever increasing work load requirement for inspections . Motion was made by Councilman Gaston , seconded by Councilman Martin . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Ac'aris - in favor , and Councilman MerLin - in favor . This motion carried with all in favor . CONSIDER REQUEST TO STATE HIGHWAY DEPT . ON SPEED LIMIT ON HIGHWAY 78 : This request is to lower the speed limit on State Highway 78 from Wylie Butane to Muddy Creek from 55 mph to 40 mph . Motion was made by Councilman Fulgham to instruct staff to request this speed limit change on State Highway 78 . Seconded by Councilman Adams . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , gad Councilman Martin - in favor . This motion carried with all in favor . CONSIDER REQUEST TO STATE HIGHWAY DEPT . FOR TURN LANE ON STATE hIGHWAY 78 : This request is for turn lanes from Highway 78 onto FM 544 (Kirby St . ) . Motion was made by Councilman Adams to instruct staff to request turn lanes on State Highway 78 and FM 544 (Kirby) . Seconded by Councilman Martin . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . CITIZEN PARTICIPATION : Mr . Fred Ouellette of Woodhollow Drive said the traffic behind his house which is on Akin Lane has become a race track for kids on motor bikes , and also a lot of speeding cars at night . City Manager Gus Pappas wanted to know if Mr . Ouellette has contacted the police station about his . Mr . Ouellette replied no . City Manager asked Mr . Ouellette to call the police station and report the racing the next time it happened , since the police are aware of this and are trying to watch this area . GENERAL COUNCIL DISCUSSION : Councilman Martin wanted to know if there was anything that could be done to get the area around the post office cleaned up . The building plus the outside area was in very poor condition for the type building and usage it receives . Also , there are no post office boxes available to the new residents moving into Wylie . Mayor Pro Tem Hughes wanted to know if there was any way there could be four ( 4) lanes of traffic from Wylie Butane through Wylie . Also when the crew is out patchig streets , there is a large hole on Second Street and Highway 78 . There is also two rent houses on Second Street and Highway 78 that need to be checked cut . There appears to be more than one family living in these two houses . City Manager Gus Pappas reported on The Meadows , the staff received additional core samples , one of the main streets feeding off Stone Road (approximately 90 ft . ) has to be corrected . This means taking up the street and repouring it . Cement contractor has been given these instructions , but wants to come before the council before he takes up this street and repours . Also , the foundation for the water tank at Steel Industrial Park has been poured . The crew is working on the erection of the tank at Nortex site . Mayor Akin wanted to know how many was going to the Collin County Public Officials meeting on Thursday . There were twelve ( 12) who said they would go . The Chamber dinner is Wednesday , and wanted to remind the council of Motion was made by Councilman Martin to convene into executive session under the authority of Article 6252-17 of V . A . C . S . , section 2 paragraph "f" , real estate . Seconded by Mayor Pro Tem Hughes . All in favor . Mayor Akin reconvened the meeting into open session , there being no decisions from the executive session Mayor called for a motion to adjourn .
