11-07-1989 (City Council) Minutes 481 CITY COUNCIL MEETING MINUTES NOVEMBER 7, 1989 The City of Wylie City Council met in a called meeting on Tuesday, November 7 , 1989 in the Council Conference Room at the Municipal Complex . A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor Chuck Trimble, Mayor Pro Tem Bud Naish, Council Members Steve Wright, Ortie Messenger, Pat Stemple, and John Akin, City Manager Charles Norwood, City Secretary Carolyn Jones, Code Enforcement Officer Roy Faires. Councilman Swartz was absent. Mayor Trimble called the meeting to order and Councilman Akin gave the invocation. APPROVAL OF AN ORDINANCE AMENDING ORDINANCE NO. 88-28 , REGARDING 16" CENTERS: Mr. Faires stated the amendment to Ordinance NO. 88-28 says the building codes specifies ceiling joists to have 16" centers, this amendment is request that the wording in Section 3 (d) read as follows : "All wood ceiling joists shall have a minimum nominal dimension of 2 inches by 6 inches (unless part of an Engineer Truss) and they shall have a maximum spacing of 16 inches on centers" . Mr . Faires stated he had not doubt that other cities are doing this, an it is an improvement to their existing code. Motion was made by Councilman Akin to approve the amendment to Ordinance No. 88-28 . Councilwoman Stemple wanted to know what the reason was for 16" centers. Mr . Faires stated for more nailing room for sheet rock. Mr . Kevin St. John state that a ceiling joist is the board that holds up the ceiling. Wylie is the only city that has ceiling joists on 16" centers. Spec says it is allowable for 24" centers for nailing sheet rock. Councilman Akin said that staff has worked with the other cities and I feel our code department has researched this and we should go along with their recommendation. Councilwoman Stemple said her concern is to not make it so hard that the builders will not build in Wylie. Mr . St . John said his business is here in Wylie and he lives here but he cannot do business here because of this ordinance. 482 Councilman Wright said Mr. St. John contacted a number of builders in Richardson and they would not build in any city that has 16" centers instead of 24" centers . Councilman Messenger asked Mr . Faires in your opinion is it acceptable to make the rule on 24" VS 16" centers. Mr . Faires said minimum code requirements are 24" centers. The city has 16" centers which is better than minimum. It is whatever the Council wants to do , you are getting a stronger house on 16" centers than on 24" centers . Mayor Trimble said there is a motion on the table, but did council want to give staff instructions on what to do about gathering more information prior to taking action. Councilman Akin' s motion to approve amendment to Ordinance No. 88-28 was seconded by Councilman Wright. The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Naish - abstained, Councilman Akin - in favor , Councilman Wright - in favor, Councilman Messenger - in favor, and Councilwoman Stemple - abstained. This motion carried with four in favor and two abstained . Mayor Trimble said he would like to see if we could get some more information on this . City Manager Charles Norwood said Mr. Kevin St . John has asked that this be placed on another �* agenda in a couple of weeks. Councilman Messenger stated that the city needed an independent person to be here with an opinion. PRESENTATION FROM THE CHAMBER OF COMMERCE RELATIVE TO FUNDING FOR ECONOMIC DEVELOPMENT: Mr . Randy Arp, Chairman of the Economic Development Committee, stated that the recently formed Chamber Economic Development Committee is intended to be a resource for our community and a supporter of our city. Recently there has been new Economic Development Legislation identified that could be advantageous to our community. This provides an opportunity for individual cities who meet certain qualifications, and Wylie meets these qualifications, to take to the voters of the city an opportunity to increase their sales tax for Economic Development . The Chamber and the Economic Development Committee is asking the Council to consider calling an election for this purpose. This resource is defined in Senate Bill 971 . The Economic Development Committee can utilize up to 10% of the proceeds for community promotions. This bill allows the governing body to set up an Industrial Development Corporation, appoint five directors to serve at the pleasure of the Council . It is recommended by this committee that the election be held at the earliest possible date in January. Mayor Trimble thanked Mr . Arp for coming and that Council would move forward on this. 483 PROPOSED PERSONNEL POLICY SECTION 1 THRU 4 : Under Section 1 - 1 , Director of Personnel need to change "he" to "he/she" each time it is written. Under Section 3-3 Termination of Employment after the first and second paragraph' s add "with City Manager ' s approval" to the end of each paragraph. The third paragraph would have "at the City Manager ' s discretion. Under Section 4-3 A: Pay Increases - add attendance in the list of considerations for merit increase.
