04-13-1993 (City Council) Minutes MINUTES OF THE WYLIE CITY COUNCIL April 13, 1993 CALL TO ORDER Mayor John W. Akin called the meeting to order with the following 5 Councilmembers present: Jim Swartz, Reta Allen, Ortie Messenger, and Bud Naish. Jay Davis and Steve Wright were absent. RESOLUTION DECLARING NATIONAL LIBRARY WEEK APRIL 18TH THROUGH APRIL 24TH 10 Naish made a motion to approve the resolution. Swartz seconded the motion. The motion was voted on and passed unanimously. PUBLIC HEARINGS ON ORDINANCE AMENDING COMPREHENSIVE ZONING 15 ORDINANCE Mayor Akin opened public hearings on each of the following proposed amendments to the Wylie Code and Comprehensive Zoning Ordinance: (1) Sign regulations (2) Sexually Oriented Businesses (3) Private Club Requirements (4) Outside Storage (5) Masonry Requirements 25 (6) Zoning and Platting Requirements As there was no one present wishing to address any of the aforementioned proposed amendments, each public hearing was closed. 30 ORDINANCE NO. 93-22 AMENDING COMPREHENSIVE ZONING ORDINANCE Council discussed the proposed changes and Norwood recommended that no changes be made to the platting requirements until after the comprehensive plan was adopted. Naish made a motion to table the portion of the ordinance dealing with 35 private clubs and to approve the remainder of the ordinance. Swartz seconded the motion. Upon the reading of the ordinance caption, the motion was voted on and passed unanimously. AN ORDINANCE OF THE CITY OF WYLIE, TEXAS,AMENDING CHAPTER 12 OF THE 40 WYLIE CITY CODE BY MAKING CERTAIN CHANGES TO THE EXISTING ZONING ORDINANCE, AS CODIFIED IN SECTION 1 OF CHAPTER 12, BY ADDING A SECTION REGULATING OPEN STORAGE, BY ADDITION OF A SECTION RELATING TO CONSTRUCTION STANDARDS FOR EXTERIOR WALLS, BY DELETING THE EXISTING SECTION ON SIGNS AND REPLACING IT WITH A REVISED SIGN SECTION, BY 45 ADDITION OF SEXUALLY ORIENTED BUSINESS AS A SPECIFIC USE IN INDUSTRIAL DISTRICTS,AND BY CHANGING CERTAIN DEFINITIONS THEREIN CONTAINED; REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A PENALTY CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE 50 ORDINANCE 93-21 ESTABLISHING REVISED SPEED LIMITS ON BROWN AND BALLAD STREETS Mayor Akin read the ordinance caption. Swartz made a motion to approve the 55 ordinance. Allen seconded the motion. The motion was voted on and passed unanimously. AN ORDINANCE OF THE CITY OF WYLIE, TEXAS,AMENDING THE MAXIMUM PRIMA FACIE SPEED UM ITS ON THAT PORTION OF BROWN STREET LYING BETWEEN 60 BALLARD STREET AND SH 78; AND FURTHER AMENDING THE MAXIMUM PRIMA FACIE SPEED LIMITS ON THAT PORTION OF NORTH BALLARD STREET LYING BETWEEN BROWN STREET AND THE DART RAILROAD TRACKS; REPEALING ALL CONFLICTING ORDINANCES; CONTAINING PENALTY CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE 65 ORDINANCE NO. 93-19 ESTABLISHING REQUIREMENTS FOR THE CLEAN-UP am% OF HAZARDOUS MATERIALS SPILLS • 70 Mayor Akin read the ordinance caption. Messenger made a motion to approve the ordinance. Wright seconded the motion. The motion was voted on and passed unanimously. 75 AN ORDINANCE OF THE CITY OF WYLIE,TEXAS,AMENDING THE UNIFORM FIRE CODE OF 1991,AS HERETOFORE ADOPTED BY ORDINANCE 92-3,BY FURTHER DEFINING AND PROVIDING FOR PROCEDURES AND REPAYMENT ALL CONFLICTING PORTIONS OF OTHER ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE 80 AGREEMENT WITH COLLIN COUNTY COMMUNITY SUPERVISION AND CORRECTIONS DEPARTMENT REGARDING INMATE WORK PROGRAM Naish made a motion to approve the agreement. Allen seconded the motion. 85 The motion was voted on and passed unanimously. REFUND FOR OVERPAYMENT OF TAXES Swartz made a motion to refund taxes to Stewart Title North Texas, Inc. in the 90 amount of $5,346.54 due to overpayment. Wright seconded the motion. The motion was voted on and passed unanimously. 2 117 DESIGNATION OF TED TRIMBLE AS CITY HEALTH OFFICER Swartz made a motion to appoint Ted Trimble as City Health Officer for a 95 period of two years. Naish seconded the motion. City Attorney Steve Deiter noted that at a later date, the Council may want to enter into a contractual agreement with the health officer. The motion was voted on and passed unanimously. STAFF REPORTS 100 City Manager Steve Norwood discussed the unusually high sales tax returns being reported, the status of the Clean Up and Green Up program and Student Government Day. 105 CITIZEN PARTICIPATION Roger Smith, 106 N. Carriage House way, requested Council to replace flashing signs at crosswalks for school zones around Birmingham Elementary with more modern signs that flash on both sides. 110 David Davis, 929 Allen Road, advised Council of his intent to request disannexation on a future agenda.
