September 27, 1994
CALL TO ORDER
Mayor Jim Swartz called the meeting to order with the following Councilmembers
present: Bobby Jennings, Reta Allen, John Mondy, Steve Wright, Ortie Messenger, and Cleo
Adams.
PRESENTATION OF BADGE TO SERGEANT MIKE ATKISON
Chief of Police Dave Brungardt presented newly appointed patrol sergeant Mike Atkison
with his sergeant's badge and noted among Sergeant Atkison's many contributions to the Wylie
Police Department was the newly established intoxilizer program.
CONSENT AGENDA
Council considered approval of the Consent Agenda which consisted of the following :
(a) minutes of August 23 and September 13, 1994
(b) Resolution No. 94-24 establishing the week of October 9th as Fire Prevention
Week
(c) Resolution No. 94-23 establishing the week of October 2nd as National 4-H Week
(d) Ordinance 94-43 Adopting the 1994 Uniform Plumbing Code
Allen made a motion to approve the Consent Agenda with a spelling correction in the minutes.
Wright seconded the motion. Upon reading of the Ordinance Caption, the motion was voted and
passed unanimously, City Manager Steve Norwood discussed Fire Prevention Week activities and
Mayor Swartz presented the 4-H Club of Wylie with 4-H Week Certificates.
ORDINANCE 94-44 ABANDONING DOG DROP LANE
Norwood explained that this property had been conveyed to the North Texas Municipal
Water District (NTMWD) but never officially abandoned. Allen made a motion to approve the
ordinance abandoning Dog Drop Lane. Adams seconded the motion. Upon the reading of the
ordinance caption, the motion was passed unanimously.

FAVOR FOR THE CITY; REPEALING ALL CONFLICTING ORDINANCES
CONTAINING A SEVERABILITY CLAUSE;AND PROVIDING FOR AN EFFECTIVE

PUBLIC HEARING AND ORDINANCE 94-45 ENACTING A ZONE CHANGE FROM
"R" RESIDENTIAL TO "B-1" BUSINESS DISTRICT AT 101 W. BUTLER
Norwood explained that the applicant Reginald Warren proposed to develop a Quick Lube and
Oil Center on the property. He explained that while the applicant had requested "B-2", staff was
recommending "B-1", a more restrictive category that would still permit the use proposed.
Mr. Warren answered questions of Council regarding environmental safeguards and disposal of
fluids. Wright made a motion to approve the ordinance, Adams seconded the motion. The
motion, upon the reading of the ordinance caption, passed unanimously.

REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY
CLAUSE;AND PROVIDING FOR AN EFFECTIVE DATE
PUBLIC HEARING AND ORDINANCE 94-46 ENACTING A ZONE CHANGE FROM
"B-2" BUSINESS DISTRICT TO "I" INDUSTRIAL ON LOTS A AND 10, BLOCK 34,
RAILROAD ADDITION
C.C. Womack addressed the Council on behalf of the Industrial Development Corporation of
Wylie, Inc., the applicant Mr. Womack explained that the zone change was needed to give
uniform zoning to a 47 acres tract of land targeted for development as an industrial park.
Messenger made a motion to approve the ordinance. Mondy seconded the motion. Upon the
reading of the caption, the motion was voted on and passed unanimously.

THE NORTH HALF OF TRACT 12 OF D.STRICKLAND SURVEY,ABSTRACT NO.841,IN THE CITY
OF WYLIE,COLLIN COUNTY,TEXAS,GENERALLY LOCATED WEST OF SANDEN BOULEVARD
AND SOUTH OF CR-297,FROM"B-2" BUSINESS TO "I" INDUSTRIAL;AMENDING THE
COMPREHENSIVE ZONING ORDINANCE;AMENDING THE ZONING DISTRICT MAP(ORDINANCE
91-12,ORDINANCE 91-13);AND REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A
SEVERABILITY CLAUSE;AND PROVIDING FOR AN EFFECTIVE DATE
ORDINANCE 94-47 RELATING TO RATES, CHARGES, AND FEES OF TCI CABLE
Norwood explained that the ordinance would accept the analysis of First Southwest Company
who was contracted by the City to determine the reasonableness of TCI's schedule of rates.
Adams made a motion to approve the ordinance Mondy seconded the motion. The motion was
voted on, upon the reading of the caption, and passed unanimously.
AN ORDINANCE OF THE CITY OF WYLIE,TEXAS,MAKING CERTAIN FINDINGS
AND WITH REGARD TO THE CHARGES AND FEES OF TCI CABLEVISION;AND
ISSUING ORDERS IN ACCORDANCE WITH SUCH FINDINGS AND CONCLUSIONS
PURSUANT TO THE CABLE CONSUMER PROTECTION AND COMPETITION ACT
OF 1992,REPEALING ALL CONFLICTING ORDINANCES;CONTAINING A
SEVERABILITY CLAUSE;AND PROVIDING FOR AN EFFECTIVE DATE
AWARD OF BID FOR GENERAL LIABILITY INSURANCE
Norwood explained that staff had received four proposals for annual coverage as follows:
Texas Municipal League 22,429.00
Reliance Insurance 25,272.00
Union standard Insurance 37,840.00
American States Insurance 39,219.00
He recommended award to TML. Julie Klink was present, representing TML, to answer
questions of Council. Wright made a motion to award the contract to TML. Jennings seconded
the motion. The motion was voted on and passed unanimously.
STAFF REPORTS
City Manager Steve Norwood noted for Council that the First Street project was nearing
completion and introduced the new chief accountant. He also reminded Council in light of a
recent playground accident in another city that the City of Wylie inspects playground equipment
regulary for structural integrity. He also noted that approximately 150 building permits had been
issued in the current fiscal year for single family homes.
CITIZEN PARTICIPATION
Randy Swaney, 212 W. Marble, asked Council to take action against his landlord who is
not assisting in cleanup of his property. Council explained that the property owner had been
issued citiations and that the issue was pending in municipal court.
Charles Taylor, 211 W. Marble, complained that Council was not informed of each code
enforcement action taken against citizens in Wylie.
EMERGENCY OPERATIONS CENTER TOUR
Council adjourned briefly into a worksession to tour a temporary EOC that staff had
designed to be activated in the event of an emergency. Fire Chief Shan English outlined the
purpose of the EOC and explained the general operations.
EXECUTIVE SESSION
Council adjourned into Executive Session at 8:40 p.m. under Section 551.074 of the
Government Code to consider appointment of a City Attorney and appointment to the Library
Board.
APPOINTMENT OF ABERNATHY, ROEDER, ROBERTSON & JOPLIN AS CITY
ATTORNEY FIRM
Upon reconveing into regular session at 10:15 p.m., Jennings made a motion to appoint
the firm of Abernathy, Roeder, Robertson & Joplin as consulting City Attorneys to the City of
Wylie. Wright seconded the motion. The motion was voted on and passed with all in favor
except Mondy and Adams who were opposed.
APPOINTMENT OF SHIRLY BURNETT TO LIBRARY BOARD
Allen made a motion to appoint Shirley Burnett to the Library Board. Adams seocnded
the motion. THe motion was voted on and passed unanimously.
ADJOURNMENT
Remaining worksession items were not addressed due to the late hour and the meeting
was adjournemd.
