MINUTES OF THE WYLIE CITY COUNCIL May 23, 1995 CALL TO ORDER Mayor Jim Swartz called the meeting to order with the following Councilmembers present: Reta Allen, Cleo Adams, Joel Scott J.C. Worley, and Steve Wright. John Mondy was absent. CONSENT AGENDA (1) Minutes of May 9 and May 16, 1995 (2) Agreement with Southwest Consultants for Administration of the Community Development Block Grant for Sewer System Improvements Allen made a motion to approve the Consent Agenda. Wright seconded the motion. The motion was voted on and passed unanimously. PUBLIC HEARING AND ORDINANCE 95-12 AUTHORIZING AMENDING THE ZONING FROM "I" INDUSTRIAL TO "R" RETAIL AT INDUSTRIAL COURT AND BIRMINGHAM - CORNERSTONE PRIVATE SCHOOL Melissa Abbott addressed the City Council to discuss the proposed business and need for retail zoning. She responded to questions of Council regarding flow of traffic, adjacent industrial uses, and potential future uses of surrounding property. As there was no one else wishing to address this issue, the public hearing was closed. Allen made a motion to approve the ordinance amending the zoning to "R" Retail. Adams seconded the motion. The motion was voted on and passed unanimously. ORDINANCE 95-12 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE ZONING CLASSIFICATION OF LOT 13 OF RAILROAD INDUSTRIAL PARK AND ACREAGE IN ABSTRACT 820, TRACT 32, IN THE CITY 0 WYLIE, COLLIN COUNTY, TEXAS, GENERALLY LOCATED AT 120 SOUTH BIRMINGHAM FROM "I" INDUSTRIAL TO "R" RETAIL; AMENDING THE COMPREHENSIVE ZONING ORDINANCE (ORDINANCE 85- 23A); AMENDING THE ZONING DISTRICT MAP (ORDINANCE 95-23A); REPEALING AL CONFLICTING ORDINANCES, CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE PUBLIC HEARING, PRELIMINARY PLAT AND ORDINANCE 95-13 AMENDING ZONING FROM "SF-3" TO "PD" PLANNED DEVELOPMENT ON WESTGATE PHASE II The developer, Jim Meara, explained that the proposed Planned Development would provide the same development requirements for Westgate Phase II that Council approved for Westgate Phase I. Council discussed the drainage culvert and the City Manger stated his preference for a concrete culvert. Adams made a motion to approve the preliminary plat and ordinance authorizing the Planned Development zoning subject to the provisions Minutes of May 23, 1995 Page 1 of concrete drainage culverts. Scott seconded the motion. The motion was voted on and passed unanimously. ORDINANCE 95-13 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE ZONING CLASSIFICATION FOR THE PROPERTY DESCRIBED HEREIN IN THE CITY OF WYLIE, COLLIN COUNTY, TEXAS, GENERALLY LOCATED ALONG AND TO THE EAST F WESTGATE WAY IN THE AREA OF ITS INTERSECTION WITH BURCHSHIRE LANE AND SOUTH OF ANDERSONVILLE LANE FROM SINGLE FAMILY 3 "SF-3" TO PLANNED DEVELOPMENT "PD"; AMENDING THE COMPREHENSIVE ZONING ORDINANCE BY AMENDING DISTRICT MAP(ORDINANCE 91-12, ORDINANCE 91-13), ORDINANCE 84-4, AND REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE;AND PROVIDING FOR AN EFFECTIVE DATE CONTRACT WITH BFI FOR REFUSE COLLECTION AND RECYCLING Randi Smith, Municipal Marketing Manager for BFI, discussed customer service questions brought up by Councilmembers at the last meeting. She stated that BFI would agree to quarterly performance reviews with the City Staff and annual reviews with the City Council. Council adjourned briefly to observe a demonstration by BFI of a truck used to empty polycarts. Upon reconvening, Smith stated that the City would be divided into four sectors with each sector assigned a designated collection day Monday through Friday. She stated that recyclable materials would be collected once per week as was done presently. Wright made a motion to award the contract for refuse collection and recycling to BFI providing once per week trash pick-up using polycarts and once per week pickup of recyclable materials under the rate structure proposed and becoming effective September 1, 1995. Worley seconded the motion. The motion was voted on and passed unanimously. ORDINANCE 95-14 AUTHORIZING AMENDMENTS TO THE 1994-1995 OPERATING BUDGET Norwood briefly outlined the proposed amendments to the 1994-1995 annual operating budget and answered questions of Council. Adams made a motion to approve the ordinance. Wright seconded the motion The motion was voted on and passed unanimously. ORDINANCE 95-14 AN ORDINANCE OF THE CITY OF WYLIE,TEXAS,AMENDING THE BUDGET FOR THE FISCAL YEAR 1995 BEGINNING OCTOBER 1, 1994 AND ENDING SEPTEMBER 30, 1995, BY AMENDING ORDINANCE 94-41, REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE;AND PROVIDING FOR AN EFFECTIVE DATE RESOLUTION 95-21 ADOPTING INVESTMENT POLICY Norwood and Director of Finance Brady Snellgrove discussed the proposed investment policy which established objectives, authority and guidelines for investment of municipal funds. Wright made a motion to approve the resolution. Adams seconded the motion The motion was voted on and passed unanimously. Minutes of May 23, 1995 Page 2 STAFF REPORTS Norwood told Council that the curb and gutter replacement program had begun, that speed limit enforcement had begun in the area of Community park although only warnings were being issued for a brief grace period, that the new building official Mike Phillips had officially begun working for the City of Wylie and that the water tower bid could be expected on the June 27th agenda.
