02-24-1997 (City Council) Minutes Minutes of the Wylie City Council February 24,1997 CALL TO ORDER Mayor Jim Swartz called the City Council Meeting to order, February 24, 1997 at 7:00 p.m. with the following Councilmembers present: John Mondy, Reta Allen, Wanda Sparks, J. C. Worley and Cleo Adams. Joel Scott was absent. The following staff members were present: Kelley Shaw, City Planner, Mike Phillips, Director of Community Development, Brady Snellgrove, Finance Director, Greg MacLean, Consulting Engineer, Mindy Manson, Assistant to the City Manager, Susan Shuler, City Secretary and Mike Collins, City Manager. PROCLAMATION Public School Week - March 3 - 5, 1997 Mayor Swartz read a proclamation declaring the week of March 3-5, 1997 as Public School Week and presented the proclamation to Betty Stephens with Wylie Independent School District. He had each of the students representing each WISD school introduce themselves. Stephens had the students present the Council members and staff, ribbons, stickers and coupons for free lunch at any school during the week. CONSENT AGENDA 1) Consider approval of minutes for February 11, 1997 2) Consider approval of an ordinance amending the Wylie Code of Ordinances, Chapter 1, General Provisions, Section 17 adopting records control schedules in compliance with minimum requirements on record retention. 3) Consider final acceptance of the construction of a new 750,000 gallon elevated tank and provide authorization for final payment to Landmark Structures, Inc. in the amount of $76,680.00 and accept the project as complete. Mondy made the motion to accept the consent agenda. Allen seconded the motion. The motion was voted on and approved unanimously. City Council Minutes,February 24, 1997,Page 1 ACTION ITEMS Public Hearing and Recommendation of a Request from Herzog Development Corp. For Approval of Proposed Woodbridge Development District Conceptual Plan Shaw stated that at the February 11, 1997 Council Meeting, Mondy had ask for a written confirmation on the effects this project would have on the school district. He stated that Council had been presented with a letter from the school district stating the impact on the school system and the needs for the school district. He also stated that specific development standards have been put in place that will insure quality in the development of the residential areas of the project. Mayor Swartz opened the public hearing with the following responses: Choya Tapp, Sachse Road - He stated that he was adjacent to the development and he wanted to know what type of barriers would be used. He stated that he has bulls and a large stock tank and was concerned about children coming into his property. Don Herzog, with Herzog Development stated that he could stipulate a solid fence be constructed along the property line with a minimum of six feet. He said all of the residences along that area would be front entry houses. He also said it would be the responsibility of the homeowner to keep the fence line maintained. June Nance, 224 Meadowlark - She has concern about the high density 5,500 sq. ft. lots. She would not like to see the small lots. Mondy asked what the recourse the Council would have to change any of the development. Shaw replied by saying that tonight Council was approving the Conceptual Plan. He said that if the developer does not complete the development within two years then the Council can step in. He also stated that once the Conceptual Plan is submitted, Herzog has six months to submit the development plans. Shaw also stated that the minimum house size on the 5,500 sq. ft. lot would be 1,200 sq. ft. Worley made the motion to approve the Conceptual Plan and Mondy seconded the motion. The motion was voted on and passed unanimously. STAFF REPORTS Worley stated that there were sewer and water problems in the Wylie Ranch Estates East. He stated that Collins and MacLean met with about 40 homeowners in the neighborhood. He said at the meeting the MacLean explained to them the reason behind City Council Minutes,February 24,1997, Page 2 their problems. Collins stated that a second meeting has been scheduled for March 27, 1997. He also stated that as part of the Kreymer Lane construction, that a bid may also be taken for the sewer as well as drainage. Mayor wanted to know if the drainage problem on Jackson had been taken care of and would like the City Manager to proceed with correcting the problem. Snellgrove stated that the privatization of the meter reading services has passed the 90 day probation period and that now the company will be held to a standard of 2 errors per 1,000 and for every mistake they pay $2.00 for each mistake. Mondy stated that the Community Park had a valley where a car almost got stuff. Manson stated that due to the weather the construction phase has not been able to start the construction of the parking lot. She stated that improvements would be made to the shoulder of the roadway. ADJOURNMENT As there was no further business to come before Council for consideration, the meeting was adjourned.
