04-08-1997 (City Council) Minutes Minutes of the Wylie City Council April 8, 1997 CALL TO ORDER Mayor Jim Swartz called the Special Called City Council Meeting to order, April 8, 1997 at 7:00 p.m. with the following Councilmembers present: Wanda Sparks, Cleo Adams, Joel Scott, Reta Allen, John Mondy and J. C. Worley. Staff members present were: Mike Collins, City Manager, Mindy Manson, Assistant to the City Manager, Susan Shuler, City Secretary, Mike Phillips, Director of Community Development, Brady Snellgrove, Finance Director, Kelley Shaw, City Planner and Richard Abernathy, City Attorney. PROCLAMATIONS Mayor Swartz read a proclamation designating April 21, 1997 as "Grand Opening for the Library" and designating the third week in April as "National Library Week". He presented the proclamations to members of the Library Board, Mary Conley, Shirley Burnett and youth member, Christina Crimmins. Mayor Swartz read a proclamation designating April 6-12, 1997 as "Boys and Girls Club Week in Wylie". He presented the proclamation to Leisa Knapp, Director of the Wylie Teen Club and teen members of the club. CONSENT AGENDA 1) Consider Approval of Minutes for March 25, 1997 2) Consider Amending Section 18-1 of the Wylie Code of Ordinances to Reflect Correct and Enforceable Definitions of "At Large", "Livestock", "Owner", "Public Nuisance" and "Wild Animal" Mondy asked that Item 2 be pulled from the Consent Agenda. Adams made the motion to approve the Consent Agenda Items with the correction to the minutes reflecting that Adams seconded the motion under Item #7, Clean Up/Green Up. Scott seconded the motion. The motion was voted on and approved unanimously. Minutes of the Wylie City Council,April 8 1997, Page 1 ACTION ITEMS Amending Section 18-1 of the Wylie Code of Ordinances to Reflect Correct and Enforceable Definitions for Animal Control Mondy stated that there was a concern that we are changing the types of animals that are allowed in the City. Phillips stated that the intent of this ordinance was to merely change the definitions to clearly define the types of animals that were to be controlled. Mondy made the motion that staff evaluate and come back to Council with a recommendation. Worley seconded the motion. The motion was voted on and passed unanimously. Approval of a Preliminary Plat Submitted by Goff Homes for a 73 Acre 65 Lot Residential Development Designated as Stoneridge Farms Shaw gave an overview of the Preliminary Plat submitted by Goff Homes. He stated that this proposed development meets the criteria set forth by the Comprehensive Land Use Plan in regards to the location and type of residential development. He also stated that the general layout meets development standards and they have worked very hard to meet all of the requirements that staff has asked of them. Shaw stated that P&Z approved the plat 7-0. He said Goff Homes had requested a variance for no sidewalks and then changed the request to sidewalks only on one side. He said that request was denied. Sparks stated that there was a concern about the drainage in that area. She asked if the ditch would be able to handle the drainage. Shaw stated that Greg MacLean from the Hogan Corporation stated that he was satisfied with the drainage calculations. Mondy was concerned with the impact that this addition would have on the elementary school. Mondy requested that before they come back before Council that the school district be notified and ask them what impact this addition would have on the school. Worley stated it was nice that large lots were being proposed. Worley made the motion to approve the preliminary plat by Goff Homes. Allen seconded the motion. The motion was voted on and passed unanimously. Public Hearing and Approval of Ordinance No. 97-8 Establishing Multi-Family Residential Regulation Standards Ordinance No. 97-8 of the City of Wylie,Texas, Establishing Multi-Family Residential District Development Standards; Stating a Purpose; Providing Development Standards; Providing a Penalty Clause; Amending the Comprehensive Zoning Ordinance (Ordinance No. 85-23A); Repealing All Conflicting Ordinances; Containing A Severability Clause; and Providing For An Effective Date Shaw gave an overview of the Multi-Family Residential District Regulations. He stated that P&Z and Council met in September 1996 and recognized that the demand for Minutes of the Wylie City Council,April 8 1997, Page 2 multi-family housing alternatives will create the opportunity for the market to produce multi- family development. He stated that P&Z had a concern of allowing three story apartments and that one acre per unit was too small. He said that P&Z voted 5-2 to approved the ordinance. Mondy asked who the voted against the ordinance. Shaw stated that Cecilia Wood and Stuart Allison voted against the ordinance mainly because of the concern for the height requirement and lot size. Mayor Swartz opened the public hearing for those to speak in favor of the ordinance. With no one speaking in favor, the public hearing was closed for those in favor. Mayor Swartz opened the public hearing for those to speak against the ordinance. Bill Downs, 601 Parker Road - He opposes the ordinance. He wanted to know what type of screening would be allowed and if anyone could tell him what type of screening was at the Rustic Oak Apartments and at Southfork Mobile Home Park. Shaw stated that the screening allows for wood or masonry and it is at the discretion of the Building Official. With no other comments from the public, the public hearing was closed to those opposed. Scott asked that in the future if this ordinance would allow any type of Senior Citizen Assisted Living Apartments to be built if the requirement was to be 15% of the DU. Shaw stated that there could be a special use permit. Manson stated that in those types of development they are good candidates for a planned development. Worley made the motion to approve the ordinance establishing Multi-Family Residential District Regulations. Adams seconded the motion. The motion was voted on and passed unanimously. STAFF REPORTS Collins stated that the Development Standards had been an eight month process that demonstrated how the Council and an Advisory Committee can work together. He also stated that this would be Kelley Shaw's last Council meeting and that he would be going to work for the Town of Flower Mound. Mondy asked about the railroad crossing at Ballard and Highway 78. Manson stated that the railroad advised that funding had been approved for reconstruction of the crossing at Ballard. Collins stated that the final inspection of the railroad crossing, the traffic signs, road conditions on Westgate Way had been made. He also stated that weather permitting, striping will be completed and the roadway should be opened in about one week. Minutes of the Wylie City Council,April 8 1997, Page 3 CITIZEN PARTICIPATION Pat Easterling - She stated that she was annexed 11 years ago and she does not want to be disannexed. She also stated that she needs help from the City to be able to have access to her property. She said that if there were any kind of an emergency such as fire or needing a police officer that the entrance to property is blocked. She wants the Council to look at all the facts. She said she would have no alternative but to seek legal advice. Easterling also stated that she has spent $8,000 to make a road. She said Mr. Mannowitz will let Mr. Housewright have access but not the Easterlings. She said her husband is under Court Order not to speak to Council without going to jail. ADJOURNMENT As there was no further business to come before Council for consideration, the meeting was adjourned.
