CALL TO ORDER
Mayor Jim Swartz called the City Council Meeting to order, May 27, 1997 at 7:00
p.m. with the following Councilmembers present: Cleo Adams, John Mondy, J. C. Worley
and Wanda Sparks. Joel Scott and Reta Allen was absent. Planning and Zoning members
present were: Richard Eckman, Bart Peddicord, Cecilia Wood and Stuart Allison. Staff
members present were: Mike Collins, City Manager, Mindy Manson, Assistant to the City
Manager, Susan Shuler, City Secretary, Brady Snellgrove, Finance Director, Mike Phillips,
Community Development and Greg MacLean, Consulting Engineer with the Hogan
Corporation.
CONSENT AGENDA
1) Consider approval of minutes for May 27, 1997
2) Consider approval of a final plat for the Stoneridge Farms Phase I Subdivision,
submitted by Goff Homes located at the Junction of Stone Road and FM 544 South
of Quail Hollow Subdivision and more specifically described as being a 77.036 acre
tract of land situated in the Allen Atterberry Survey, Abstract No. 23
3) Consider approval of final payment to Anchor Companies for the Rita and Truett
Smith Library Renovation Project
Item 2 was pulled from the Consent Agenda.
Adams made the motion to approve Items 1 and 3 on the Consent Agenda. Sparks
seconded the motion. The motion was voted on and approved unanimously.
ACTION ITEMS
Consider approval of a final plat for the Stoneridge Farms Phase I Subdivision,
submitted by Goff Homes located at the Junction of Stone Road and FM 544 South
of Quail Hollow Subdivision and more specifically described as being a 77.036 acre
tract of land situated in the Allen Atterberry Survey, Abstract No. 23
Neal Heckel, a representative of Goff Homes, was in attendance for any questions
from City Council. Sparks asked if no gas connections meant that gas grills would not be
allowed. Heckel stated that gas would not be in the houses but that gas grills would be

allowed.
Worley asked if the houses were going to be 100% brick as stated. Heckel stated
that Goff Homes intended to be the sole builder and they intend to have their houses 100%
brick as well as any storage building. Worley also asked about the fencing. He said with
the requirement at 5', what will happen if someone wants to put a pool in. Heckel stated
that it had just been pointed out to him before the meeting started and that they would
address this issue and meet the criteria for safety standards. Mondy asked about satellite
dishes being prohibited. Heckel said that the dish will not be able to be in view of the
public.
Cecilia Wood, member of Planning & Zoning stated that it is a given that anyone
coming before Planning &Zoning and Council would abide by the ordinances and building
codes, therefore they do not address those issues unless it some variance being
requested.
Heckel stated to avoid a delay that he will put in writing a generic statement that the
deed restrictions will fall in the state regulations and if more restrictive than the deed
restriction will stand.
Mondy made the motion to approve the final plat. Worley seconded the motion.
The motion was voted on and passed unanimously.
CITIZEN PARTICIPATION
Mayor Swartz stated that before the worksession begins their were some citizens who
would like to speak and due to the length of the worksessions, citizen participation was
being moved before the worksession.
Barbara Mannewitz, 5609 Indian Hills, Garland, Texas 75044 - She stated she
owns property on Marshall Lane and lives in Garland. She said that they were annexed
against their will and were concerned about the road, and she is very concerned about the
condemnation of her property to extend a road. She said she likes this city and is most
concerned about her property. She stated that they would not try to block it if they knew
what type of road was going to be installed. She also stated that their was not a map
included but they understand that the road stops at the property that was decided on by
the court. She said that they complained last year about the high weeds growing in the
road and asked for it to be mowed. She stated they were told it is the property owner's
responsibility.
Tom Mannewitz, 2821 W. FM 544 - He stated that Mr. Housewright could not
attend so he was asked to speak for him. He said if you are wanting to put a road in to
give Mr. Easterling access then the road that runs east and west from Southfork is much
closer than coming off FM 544 and he said 6/10 of a mile of property will be needed to
come from 544. He said he is a little suspicious of the City of Wylie's willingness to talk
to them. He said that a sewer line was put in illegally many years ago and has now been

abandoned. He stated that when he asked for proof that he signed any documents, they
could not be furnished. He said they do not receive any services and they were told that
garbage trucks cannot even get through on this road. He also stated we would like to know
who is going to pay for the road.
JOINT WORKSESSION WITH PLANNING &ZONING COMMISSION
Proposed KCS Railroad Development
Worley stated that he thought the Thursday meetings need to stop. He said the
same people keep coming and that the Council needs to hear what Kansas City Southern
has to say.
Eckman stated that if the railroad wants to be a good citizen and gain some support
they need to start fixing their railroad crossings and start doing some positive things
around the city. Woods stated that the City needs back and white proof that the railroad
will do what they say they will do.
Swartz stated that these meetings are opened meetings and the perception that
people have is that this is a done deal. He said that the City needs to have a "wish list"
to present to KCS before it is decided what to do.
Development Standards Within the ETJ
Collins stated that staff did not do their homework concerning the issue that came
before P&Z from a developer in the ETJ wanting to put in septic tanks. He stated that staff
was not prepared to address the septic tank issue to see if it made a difference. He said
what was presented to P&Z was done so at a land study phase and if new information is
learned their decision could be denied before the final plan is granted.
MacLean explained how the new generation septic system works. He said the
TNRCC recommends this as an alternate method but only in areas where it is impossible
to have hook ups available. He stated that it is a sprinkler system that comes on
periodically and usually becomes a swamp because the water keeps coming. He
commented that if not properly maintained it can be a big problem. He said that the Texas
Local Government Code gives you the right to regulate in your ETJ and this also falls
under the subdivision regulations. He stated that if they are within a proximity of the new
wastewater treatment plant, they may be required to hook up to the sewer system.
Woods stated that the main problem is that P&Z made a decision based on what
they had and she does not want to see a board make a decision and then change their
mind.
Certificates of Convenience and Necessity (CCN) Within the City Limits

_ Collins gave an overview of the jurisdictions of the CCN's. MacLean discussed
briefly the procedure in achieving dual certification. He said that dual certification allows
you to have other water corporation customers to hook on to the city water lines.
STAFF REPORTS
Shuler stated that board and commission applications had been received and that
interviews would take place on Monday, June 9 and Tuesday, June 10, 1997.
ADJOURNMENT
As there was no further business to come before Council for consideration, the
meeting was adjourned.
