07-08-1997 (City Council) Minutes Minutes of the Wylie City Council July 8, 1997 Prior to the Call to Order a presentation of the Library Automation System was held at 6:30 p.m. CALL TO ORDER Mayor Jim Swartz called the City Council Meeting to order, July 8, 1997 at 7:00 p.m. with the following Councilmembers present: Wanda Sparks, Cleo Adams, Joel Scott, Reta Allen, John Mondy and J. C. Worley. Staff members present were: Mike Collins, City Manager, Mindy Manson, Assistant to the City Manager, Susan Shuler, City Secretary, Mike Phillips, Director of Community Development, Brady Snellgrove, Finance Director, Jack Jones, Superintendent of Public Works, and Jim Jenks, Consulting Engineer with the Hogan Corporation. PRESENTATION Liesa Knapp, Director of the Wylie Teen Center (a part of the Boys & Girls Club of Collin County) and Aaron Moore, Wylie Teen of the Year gave a brief presentation thanking the City and Council for their continued support of the Teen Center. OATHS OF OFFICE Shuler administered the Oath of Office to the newly appointed board members. ACTION ITEMS Final Acceptance of the Construction of Westgate Way Paving and Drainage Improvements and the Expansion of the 20-inch Water Transmission Main from FM 544 to the NORTEX Ground Storage Tank and Authorization for Final Payment to East Texas Construction Company, Inc. in the Amount of $30,153.82 and Accept the Project as Complete Jenks with the Hogan Corporation, stated that a delay in final payment/acceptance was due to a disagreement between the contractor and engineer over the final earthwork quantity calculations. He said that all quantity issues have been resolved and he recommends acceptance of the project and authorization for final payment contingent on a few items on the punch list that need to be cleaned up. Adams made the motion to accept the project and authorize final payment to East Texas Construction in the amount of $30,153.82. Scott seconded the motion. Public Hearing and Consider Approval for a Zone Change from "MF" Multi Family to "SF-3" Single Family District for the Property Located at 105 South Third Street Described as Lot 13 and the South 17' of Lot 14, Block 22 of the Railroad Addition Phillips explained that Gorin Juri had requested a zone change for the property at 105 South Third Street. He stated that he plans to replat the lots into a single lot, so that a single family dwelling could be constructed. Mondy made the motion to approve the zone change from MF to SF-3. Worley seconded the motion. The motion was voted on and passed unanimously. ORDINANCE 97-12 AMENDING THE ZONING CLASSIFICATION OF LOT 13,AND THE SOUTH 1 T OF LOT 14,BLOCK 22 IN THE RAILROAD ADDITION,IN THE CITY OF WYLIE, COLLIN COUNTY,TEXAS, GENERALLY LOCATED AT 105 SOUTH THIRD STREET,FROM "M" MULTI-FAMILY TO "SF-3"SINGLE FAMILY-3;AMENDING THE COMPREHENSIVE ZONING ORDINANCE(ORDINANCE 85-23A);AMENDING THE ZONING DISTRICT MAP (ORDINANCE 91-12, ORDINANCE 91-13); AND REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE STAFF REPORTS Collins stated that Wayne Morman, Code Enforcement Officer and Building Inspector is leaving the City of Wylie for other employment. He said applications are now being accepted for the position. He also stated that an offer had been made to hire a new planner. Collins said that at the COG meeting for scoring on our request for the sewer and water grant, the City of Wylie was ranked 3 out of about 63 applicants. Collins stated that Z&S Construction (the contractor on the TCDP Projects) had filed for bankruptcy but the judge denied the request. He said Z&S has defaulted on the contract and the bonding company has decided to challenge some components of the contract and our lawyers are now involved. He also said that staff has been instructed to pour affected citizen's sidewalks and driveways on 1st and 2nd Streets. Collins said that a specific date cannot be nailed down for completion until the attorneys have settled the dispute. - Manson stated that the gazebo at the Olde City Park has been completed and there will be a park dedication ceremony during July Jubilee. CITIZEN PARTICIPATION There was no citizen participation.
