09-11-1997 (City Council) Minutes Minutes of the Special Called Wylie City Council Meeting September 11 , 1997 CALL TO ORDER Mayor Jim Swartz called the Special Called City Council Meeting to order, September 11, 1997 at 7:00 p.m. with the following Councilmembers present: Wanda Sparks, Cleo Adams, Joel Scott, Reta Allen and J. C. Worley. John Mondy was absent. Staff members present were: Mike Collins, City Manager, Mindy Manson, Assistant to the City Manager and Richard Abernathy, City Attorney. EXECUTIVE SESSION Executive Session was held under Sections 551.071 Consultation with Attorney, 551.072 Deliberations about Real Property, 551.075 Conference with Employees to Receive Information and Question Employees Regarding Pending Litigation, City of Parker v. City of Wylie, Cause No. 219.458.96, District Court of Collin County, Texas 219 Judicial District RECONVENED INTO OPEN MEETING ACTION ITEMS Settling the Above Referenced Lawsuit with the City of Parker, and Authorizing the Mayor to Execute All Necessary Documents Relating Thereto and Entering a Settlement Agreement with City of Parker Scott made the motion to approve the resolution authorizing the Mayor to execute all necessary documents and enter into a settlement agreement with the City of Parker. Worley seconded the motion. The motion was voted on and passed unanimously. RESOLUTION NO. 97-11 OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS APPROVING A SETTLEMENT AGREEMENT BETWEEN THE CITY OF PARKER, TEXAS AND THE CITY OF WYLIE, TEXAS PERTAINING TO PENDING LAWSUITS ENTITLED CITY OF PARKER, TEXAS V. CITY OF MURPHY, TEXAS, ET AL., CAUSE NO. 219-00405- 96, AND THE STATE OF TEXAS ON THE RELATION OF THE CITY OF PARKER, TEXAS V. THE CITY OF WYLIE, TEXAS, CAUSE NO. 199-121-97; AUTHORIZING THE MAYOR OR HIS DESIGNEE TO EXECUTE THE SETTLEMENT AGREEMENT AND ANY AND ALL DOCUMENTS IN CONNECTION THEREWITH; AUTHORIZING THE CITY'S ATTORNEYS TO EXECUTE ANY AND ALL PLEADINGS NECESSARY TO EFFECTUATE THE SETTLEMENT; PROVIDING AN EFFECTIVE DATE. Minutes of the Wylie City Council, September 11, 1997, Page 1 Adopting an Ordinance Disannexing a Portion of the Land Contained in Ordinance 96-16 Abernathy stated that he would meet with Judge Roach and Judge Henderson. Abernathy also read the ordinance caption. Scott made the motion to approve the ordinance disannexing a 97.8314 acre tract of land. Worley seconded the motion. The motion was voted on and passed unanimously. ORDINANCE NO. 97-15 OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, DISANNEXING A 97.8314 ACRE TRACT OF LAND, MORE OR LESS, SITUATED IN THE L. M. MARSHALL SURVEY, ABSTRACT NO. 594, AND THE WM. A. PATTERSON SURVEY, ABSTRACT NO. 716, OF THE LAND RECORDS OF COLLIN COUNTY, TEXAS WITH SUCH LAND BEING A PORTION OF LAND ANNEXED UNDER THE CITY OF WYLIE'S ORDINANCE NO. 96-16; RELEASING ALL OF THE CITY OF WYLIE, TEXAS' EXTRATERRITORIAL JURISDICTION RIGHTS, TITLE, INTEREST AND CLAIMS TO A 93.8814 ACRE TRACT OF LAND, MORE OR LESS, SITUATED IN THE L. M. MARSHALL SURVEY, ABSTRACT NO. 594, AND THE WM. PATTERSON SURVEY, ABSTRACT NO. 716, OF THE LAND RECORDS OF COLLIN COUNTY, TEXAS WITH SUCH LAND BEING A PORTION OF THE LAND ANNEXED UNDER THE CITY OF WYLIE'S ORDINANCE NO. 96-16; DESCRIBING THE TRACT OF LAND TO BE DISANNEXED AND THE TRACT OF LAND TO BE RELEASED FROM THE EXTRATERRITORIAL JURISDICTION; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE.
