Special Called Meeting
September 29, 1997
CALL TO ORDER
Mayor Jim Swartz called the Special Called City Council Meeting to order,
September 29, 1997 at 6:30 p.m. with the following Councilmembers present: Wanda
Sparks, Cleo Adams, Joel Scott and Reta Allen, J. C. Worley and John Mondy. Staff
members present were: Mike Collins, City Manager and Susan Shuler, City Secretary.
EXECUTIVE SESSION
Held Executive Session under Sections 551.071 Consultation with Attorney Subsection
1(a) Contemplated Litigation and/or Subsection 2 on a Matter in Which the Duty of the Attorney
to the Governmental Body Under the Texas Disciplinary Rules of Professional Conduct of the
State Bar of Texas Clearly Conflicts with this Chapter; 551.072 Deliberations about Real Property;
and 551.075 Conference With Employees To Receive Information and Question Employees
Regarding Property Relating to the Animal Shelter and City Service Center.
RECONVENED INTO OPEN MEETING
There was no action taken as a result of the Executive Session.
STAFF REPORTS
Collins stated that the traffic engineer would be brought before Council to discuss
the cuing of the lights at the Intersection of FM 1378 (Country Club) and FM 544.
CITIZEN PARTICIPATION
- Kenna Johnson, 503 Rustic Place - She thanked Mayor Swartz for contacting her
about the comprehensive plan. She wanted to know if the City has ever talked to TxDOT
about closing grade crossings. She presented a brochure she had obtained from the
Chamber of Commerce office to eliminate grade crossings. She stated that the CCRG had
been keeping in touch with Shreveport, Louisiana to see what they have done to close
grade crossings. Ms. Johnson said she would like to meet with the Mayor and Council on
the comprehensive plan.
Henry Garland, Skyview (outside the city limits) - He stated that he lives out of
the city but pays taxes on a business in town. He said that the citizens have spoken on
the vote of KCS. He said all citizens must look at this project if the City Council rejects

this, can KCS condemn the property and continue on? He wanted to know what
constitutes the rail corridor? He also said that the Mayor and Council could say no but
they may not have a choice. KCS may go ahead with the project.
Wilnell Emory, (outside of the city limits) - She stated that she ran a half page
ad in the neighborhood paper to not support the railroad. She said if the railroad goes in,
her and her husband are retired and they can leave.
Marvin Fuller, 355 Donna Dr. - He said he wanted to thank the City Council for all
they have done on the KCS issues and also he thanked the City Manager and Staff. He
stated that he was one who weighed the facts in a different matter but he does not want
the City to be split into and he does respect the majority of the voters. He said the last
think he wants to see is an uncontrolled manifest yard than a manifest yard with no
benefits. He again thanked everyone for all the time and effort they had put into this issue.
Joe Baker, 114 Carriagehouse - He stated he would like to withdraw his protest
against the canvass of election. He stated he was wrong about the election votes and that
the numbers read by the City Secretary were correct. He stated that he feels KCS would
not have spent $13,000 on the election if they could just take the property.
ADJOURNMENT
As there was no further business to come before Council for consideration, the
meeting was adjourned.
