CALL TO ORDER
Mayor Jim Swartz called the City Council Meeting to order December 9, 1997 at
6:30 p.m. with the following Councilmembers present: John Mondy, Wanda Sparks, Cleo
Adams, Joel Scott, J. C. Worley and Reta Allen. Staff members present were: Mike
Collins, City Manager, Mindy Manson, Assistant to the City Manager, Susan Shuler, City
Secretary, Brady Snellgrove, Finance Director, Jack Jones, Supt. of Public Works, Mike
Phillips, Building Official and Greg MacLean, Consulting Engineer, The Hogan
Corporation.
CONSENT AGENDA
1) Approval of Minutes from the November 11 Council Meeting
2) Final acceptance of the construction of McCreary Road paving and drainage
improvements from the railroad tracks North of FM 544 to South Fork Mobile
Home Park, and authorize final payment to XIT Paving and Construction,
Inc. in the amount of$27,944.62
3) Final acceptance of the construction of the 1997 extended alley
reconstruction (alley between Briarwood and Dogwood) and authorize
change order no. 1 and final payment to Allied Builders in the amount of
$18,570.10
Scott made the motion to approve the consent agenda items. Adams seconded the
motion. The motion was voted on and passed unanimously.
ACTION ITEMS
Approval of an Ordinance Abandoning the R-O-W on North First Street Between
Marble and Oak
Phillips gave an overview of the request from First Baptist Church to abandon the
portion of First Street between Marble and Oak Streets. He said the church plans on using
the abandoned right of way for future expansion of their facilities. He stated the ROW
contains no utilities other than a 1 1/2 inch water line that runs north from Marble Street.
Phillips said that staff conducted traffic counts for a week on the portion of First Street
under construction. He also said that the services of Fuller Appraisals conducted an
appraisal of the property and established its fair market value. He said that the cost of the
appraisal was paid for by the church. Phillips said the fair market value of the property
was established at eighty cents a square foot for the 24,514.7 square feet (70 ft. x 350.21

ft.) of the ROW. He said the fair market value of the ROW would be $19,600.00.
Adams made the motion to abandon the right of way at First Street between Marble
and Oak Streets. Worley seconded the motion. The motion was voted and pass
unanimously.
ORDINANCE NO. 97-24 ABANDONING A PORTION OF STREET; PROVIDING THAT SUCH
ABANDONMENT SHALL BE THE INTEREST IN WHICH THE CITY MAY LEGALLY AND
LAWFULLY ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM
DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF COLLIN COUNTY,TEXAS AND
PROVIDING AN EFFECTIVE DATE
Approval of a Resolution Appointing Members to a Citizens Charter Committee
Collins explained that the City Council would appoint fourteen members to serve on
a Citizens Charter Committee. He said the role of the committee will be to discuss and
consider specific amendments to the City Charter. The Mayor asked each Council
member to appoint two members to the committee. Each Council member made their
recommendation as follows:

Second Public Hearing for the Disannexation of 15.61 acres out of the Richard
Newman Survey, Abstract No. 660, Collin County, Texas and being part of 195.939
acre tract
Mayor Swartz opened the public hearing. With no discussion, the public hearing
was closed. Shuler stated that the Service Plan was available for review in the City
Secretary's office.
Second Public Hearing for the Annexation of 22.52 acres out of the Richard Newman
Survey, Abstract No. 660, Collin County, Texas and being part of 411.15 acre tract

was closed. Shuler stated that the Service Plan was available for review in the City

STAFF REPORTS
Collins stated that December 15th will be the last day for applications for the Police
Chief.
MacLean stated that they were laying roadway on Cottonbelt and expected it to be
opened by December 25th. He also stated that part of Kreymer was opened and the rest
was expected to be opened by December 25th. He also stated that delays on the
intersection of FM 1378/FM 544 where due to supplies from GTE and construction should
begin in February.
Mayor Swartz thanked everyone who was involved in the Tree Lighting Program.
Sam Satterwhite, with the Wylie Economic Development Corporation stated that an
agreement had been made with Best Technologies Inc. and they should start construction
within 10 days.
CITIZEN PARTICIPATION
Henry Garland - He stated that he was there to speak on the appraisal for the R-O-W
abandonment. He said the original appraisal was estimated on the fact that it was $56,000
which was a blunder by the appraiser. He said the appraisal stated that the property had
no value. He also said that the appraisal in his opinion was too high. He does not think
it is fair that the church is being charged way too much. He believes 80 cents a square
foot is too much.
Kenna Johnson, 503 Rustic Oaks - She asked if it would be possible to close the
crossing by the 1st Baptist Chruch. She said she also hopes the grade crossing issues
will be dealt with soon.
Nicki Allen, 100 Rush Creek - She said that there was an accident involving a train on
Murphy Road. She said the train clipped a school bus. She also stated that in another
accident Kansas City Southern train hit a tractor at an unprotected crossing. She said that
Norfolk is now using the Kansas City Southern rail lines. She also said she that it
concerns her to leave the rail crossings unprotected.
" " Jerri Smith, 106 Carriagehouse Way - She said that she was out of town when the
statement to respect the vote on the railroad issue was read. She wanted to thank the
Council for the consideration and concern about the railroad decision. She also wanted
to thank the Council, Mayor and City Manager and she hoped that as a town they will

always think of the people who live in this town. She wished everyone a peaceful new
year.
WORKSESSION
Street Impact Fees
Richard Abernathy, City Attorney stated that it is the only method you can charge
a developer to pay you money for streets. He said that cities can impose fees and go
through the process to create impact fees. He also stated that there were steps to follow.
He said that an advisory committee is selected which can be made up of planning and
zoning members with one being from the real estate community. He said land use
assumptions need to be established, a capital improvement plan is developed and an
ordinance is approved. Abernathy said that how much you put into the Capital
Improvement Plan will determine the driving force.
Council directed staff to look into this further.
Ambulance Contract Proposal
Fire Chief Shan English stated that AMR has given the city notice that they will pull
out of the city in 90 days. Tony Myers with East Texas Ambulance reviewed their
programs. He said they are a not for profit corporation, they have a uniform rate for
charges, and that they have a membership program. He stated they will have two
ambulances in town and that if more were needed in an emergency that there would be
a mutual aid agreement to back up. He said they would like to start training fire personnel
as paramedics as soon as possible. He stated that East Texas Ambulance would do
whatever it takes to meet the response time. Chief English said that they will back up if
needed. Allen asked if they collected on Medicare Part A and at the end of 98 will they
come back to Council and ask for a subsidy? Myers said that they collect 60% on
Medicare.
EXECUTIVE SESSION
Held executive session under Section 551.072 Deliberations about Real Property
concerning the Wastewater Plant.

WORKSESSION
Wylie Economic Development Corporation and Chamber of Commerce Executive
Director Position
Collins stated that a group of individuals met with a group from Terrell. He said that

they meet each week to discuss issues that concern the city. He said that Executive
Director is for both the Chamber and the Economic Development. He said that what they
created was the Economic Development contracting with the Chamber to have a common
focus. He also stated that what the Wylie EDC and Chamber would propose would be to
have a common director but would each board would meet independently. He said that
the Chamber would pay for their administrative cost for the increase. He also said that
details were still being worked out.

As there was no further business to come before Council for consideration, the
meeting was adjourned.
