03-24-1998 (City Council) Minutes MINUTES Wylie City Council Meeting March 24, 1998 CALL TO ORDER Mayor Jim Swartz called the City Council Meeting to order, March 24, 1998 at 7:00 p.m. with the following Councilmembers present: Wanda Sparks, J.C. Worley, Lavern Ramsey, Cleo Adams and Reta Allen. Councilman Scott was absent. Staff members present were: Mike Collins, City Manager; Mindy Manson, Assistant to the City Manager; Brady Snellgrove, Finance Director; Tobin Maples, Planning Director and Barbara Salinas, City Secretary. INVOCATION Deacon Warner Washington of St Anthony's Catholic Church was present and gave the invocation. PROCLAMATION Mayor Swartz presented Mr. Bill Nelson representing Keep Wylie Beautiful the Proclamation declaring the Week of April 4, 1998 as "Clean Up and Green Up Week" in the City of Wylie. ELECTION OF MAYOR PRO TEM Councilwoman Reta Allen made a motion to nominate J.C. Worley as Mayor Pro Tem. Councilwoman Sparks seconded the motion. A vote was taken and the motion passed unanimously. ACTION AGENDA - PUBLIC HEARING Consider and Act Upon a Request from R. Richard Parker to Rezone 39.018 Acres from A (Agricultural) to SF-3 (Single Family Residential), Amending the Comprehensive Zoning Ordinance. The Tract is Situated in the W.D. Penney Survey, Abstract No 696, in the City of Wylie, Collin County, Texas. The Tract is Located at the Southwest Corner of Parker Road and FM2514. City Manager Mike Collins stated that staff had a brief presentation before the Public Hearing was opened. Mr. Tobin Maples addressed this item. Mr. Maples gave a description of the zoning currently surrounding the 39.018 acres. Mr. Maples stated that thirty-nine property owners within 200 feet of the property were notified and that staff received two responses in favor of the zone change and three who were opposed to the zone change. Mr. Maples stated that this represented 2.5% of the opposition within 200 feet of the property. Mr. Maples stated that the Comprehensive Plan did recommend Single Family uses and that the Planning and Zoning Commission held a Public Hearing and voted 4-2 to favorably recommend the case. Mr. Maples offered to address any questions from Council. Wylie City Council Minutes March 24,1998 Page 1 ACTION AGENDA - PUBLIC HEARING -continued With no questions from Council, the Mayor then asked that anyone who would like to speak against the zone change request to come forward. He asked that remarks be limited to five minutes and to state name and address for the record. Ms. Joann Collins - 407 Kamber Lane. Ms. Collins stated that she was notified by mail only today of the zone change request. She stated that she felt the request was not acceptable. She stated that her reasons for moving to Wylie were because of its small town appeal and that in the six months since her residence, she has seen too much growth. Ms. Christy Hartley-404 Vicki Lane. Ms. Hartley stated that she has been a resident of Wylie for six months. She stated that the city currently has 1,500 residential lots to develop and questioned the need to rezone the Agriculture zoning for more housing. She also stated her concerns are that the SF-3 zoning is close to Pointe North which is SF-2 and has larger homes. She stated that her preference would be to rezone to SF-2. Ms. Denise Mays - 508 Kamber Lane. Ms. Mays stated that she is opposed to the SF-3 zoning because it may effect the value of her home, which is in an SF-2 neighborhood. Ms. Mays is also a resident of Pointe North. Craig Carson - 510 Kamber Lane. Mr. Carson stated that he realized that the parcel cannot stay Agricultural, however, SF-3 is not acceptable and Pointe North is SF-2. Mr. Carson asked W w if Council's neighborhood would like to see homes with a minimum square footage that of SF-3 homes. Mr. Carson stated that he moved to Wylie from Garland because of too many people and traffic. He stated that this development could overload our school district. In closing he stated that the SF-3 zoning was unacceptable next to SF-2 zoning. Mike Bond -416 Kamber Drive. Mr. Bond expressed his concern over the SF-3 next to an SF- 2 neighborhood with regard to property values. He asked if the city had seen a plan for development, to which the Mayor responded that they had not because this hearing was to consider zoning only. Mr. Bond also expressed concern regarding the impact the development would have on our exiting roads and sewer system. He asked that Council consider an SF-2 zoning. The Mayor asked if there was anyone else who wished to voice their opposition to the requested zone change. With no response, he then asked those in favor of the zone change to come forward limiting their remarks to five minutes and stating their name and address for the record. Mr. Richard Parker, owner/applicant for the zone change request. Mr. Parker stated that the request complies with the Master Plan and is coming to Council with support of staff and the Planning Department and that he still had to go through the platting phase. Mr. Parker stated that this property was involuntary annexed seven or eight years ago and that it is zoned Agricultural because of the involuntary annexation. He stated that his intent is not to diminish but enhance the value of the property. With no response, the Mayor then closed the Public Hearing. Councilman Adams made a motion to approve the request from R. Richard Parker to rezone 39.018 acres from A (Agricultural) to SF-3 (Single Family Residential), amending the Comprehensive Zoning Ordinance, said tract situated in the W.D. Penney Survey, Abstract No 696, in the City of Wylie, Collin County, Texas, located at the Southwest corner of Parker Road and FM2514. Mayor Pro Tern Worley seconded the motion. A vote was taken and the motion passed unanimously. STAFF REPORTS Mayor Swartz asked the status of Westgate Way and referenced a letter from COG. City Manager Mike Collins stated that a situation has been created by an increase in traffic in the Westgate area. Mr. Collins stated that in 1997 there were four reported accidents, one was speed related. In 1998 there were two reported accidents, one was speed related. Mr. Collins stated that in four days, 430 cars were surveyed to determine their rate of speed. Of those 430 cars 4.8%were exceeding the speed limit by 10 MPH or more. Mr. Collins stated that the area has been enforced by the Wylie Police Department for speed control and this will continue. He further stated that there are steps that can be taken to enforce speed limits such as signage and options for placement of stop signs that will continue to allow Westgate to operate as a collector while maintaining the protection of our children. The Mayor asked how many of those who live in the area were part of those ticketed. City Manager Mike Collins stated that an overwhelming majority of those ticketed were residents. Councilwoman Allen asked if we could post Children at Play signs to which City Manager Mike Collins responded that we could identify an appropriate location and post. Mr. Collins stated that in the letter from COG, a community to the west of Wylie has been successful in controlling a similar situation but did not specify how and that city staff would be contacting this community for advice of successful methods to address this problem. The Mayor asked Ms. Manson for an update of the Community Center repairs. Ms. Manson stated that she needs to coordinate a date with Mayor Pro Tem Worley to adjust the back door so that access may be made from the outside, thereby allowing repairs to the entrance. Ms. Manson stated that once this is accomplished the contractor may be contacted to come and complete the work. Mayor Pro Tern Worley stated that he would schedule a time this week with Ms. Manson. The Mayor asked Ms. Manson for status regarding space at the new park. Ms. Manson stated that the Wylie Independent School Board did meet last week and she attended their meeting. She stated that the issue was back on their agenda and there was some discussion with regard to concerns with parking and traffic flow, however the Board was supportive and positive and it was approved with a 6-1 vote. Wylie City Council Minutes March 24,1998 Page 3 STAFF REPORTS -continued Mr. Maples gave Council an update on Planning Issues. He stated that at a February Worksession specific Planning and Zoning issues were identified and a time line of immediate actions was included in Councils Worksession materials. Mr. Maples stated that this time line was a proposed time line and that he would look to Council for guidance. Mr. Maples mentioned a recent article that appeared in the Dallas Morning News regarding a community experiencing growing pains similar to Wylie; the community was Flower Mound. Mr. Maples stated that the article gave some interesting ideas and concepts as to how they addressed public participation and offered to provide Council with copies if they so desired. Mr. Maples stated that he had the opportunity to attend with Mayor Pro Tem Worley, a Benefit Cost Analysis presentation. He stated that they received good information and that staff is in the process of taking that information and applying to Wylie. The Mayor then announced that this evenings Worksession would involve discussion of SF development and that the public was invited to attend. CITIZENS PARTICIPATION Mayor Swartz asked that anyone who wished to address Council to come forward and state their name and address for the record. Kenna Johnson - 503 Rustic Place. Ms. Johnson stated that she had concerns regarding Westgate traffic, specifically semi-trucks. She stated that she was nearly hit by a semi-truck recently and questioned why they are allowed in the neighborhood. Her suggestion was to install speed humps to slow traffic. The Mayor agreed that semi-trucks should not be in the area and that they have designated truck routes however speed bumps do present a liability. City Manager Mike Collins stated that signage and enforcement may help the situation as an alternative to speed humps. Mike Bond -416 Kamber Lane. Mr. Bond had comments regarding the American Citizens with Disability Act. He stated that the City complies with ramped curb access to sidewalks, however why does the city continue to allow developers and contractors to install street lamps in the middle of their sidewalks. What can Council do to consider and find out what to do to correct. The Mayor agreed that it was an excellent idea and thanked Mr. Bond. With no further citizen participation, a motion was made by Councilwoman Reta Allen and Seconded by Councilman Ramsey to adjourn in to Worksession. Wylie City Council Minutes March 24,1998 Page 4 WORKSESSION Mr. Tobin Maples gave a summary of the proposed schedule for planning and zoning issues and ordinance amendments. Some of the concerns regarding this process were consulting costs and time frame for completion. Mr. Maples stated that the process could take up to three years, but estimated one year to eighteen months. City Manager Mike Collins stated that consultant costs could be estimated between $50,000 and $60,000. He further stated that the direction staff required from Council, if the proposal is acceptable, is to proceed with the development of the Request for Proposal. Mr. Collins stated that the process is a lengthy process and further discussion needs to take place before a new Comprehensive Plan is adopted consistent with how we currently apply existing policies and procedures. It was agreed that staff should initiate the proposed schedule as presented by Mr. Maples.
