05-01-2001 (City Council) Minutes MINUTES WYLIE CITY COUNCIL WORK SESSION Tuesday, May 1, 2001 6:00 p.m. Wylie Municipal Complex—Council Conference Room 2000 State Highway 78 North Council Present: Mayor John Mondy, Councilman Joel Scott, Councilwoman Reta Allen, Councilman Merrill Young,and Councilman J.C. Worley. Councilman Eric Hogue and Councilman Chris Trout were absent. Staff Present: Anthony Johnson, City Manager; Mindy Manson, Assistant City Manager; Brady Snellgrove, Finance Director; Chris Hoisted, City Engineer; Claude Thompson, Planner; Mary Nichols, Public Information Office;Richard Abernathy, City Attorney and Barbara Salinas,City Secretary. Also in attendance were the following members of the Planning and Zoning Commission. Carter Porter, Michael George,Mike Phillips and Steve Ahrens. (Commission Regular Meeting Posted to include Worksession) ................. Discussion on Development Standards. Alley Waivers Mr. Anthony Johnson, City Manager opened the worksession with a discussion on the current procedures for granting alley waivers. Currently alley waivers are approved through the platting process. There was discussion with regard to the benefits of alleys citing drainage issues and convenience for garbage collection and public utilities and the current and future process for alley waivers,as requested by developers. City Attorney, Richard Abernathy was present to clarify and interpret the intent of the Ordinance that addresses alley waivers. It was determined that cost may have been a consideration for requiring a waiver for alleyways. Current process is acceptable;however, determination for waivers should be looked at on an individual basis. Mr. Abernathy stated that the Ordinance does not address how the waiver is to be executed,but reasons for denial must be articulate and specific as to why and considered individually. Mr. Claude Thompson,Planner, advised Council of three pending agenda items that the Commission and Council will need to address with regard to alley waivers. He suggested that approval of all alley waivers should be reflected within the official minutes. There was some discussion with the Planning and Zoning Commissioners present with regard to procedure. It was clarified that if the Commission denied a waiver,the Council would need a three-fourths majority vote in order to overturn the Commission's denial. Council also expressed concerns regarding maintenance of alleys and budgetary concerns, determining that maintenance would be a balance with streets as well as priority. City Manager, Anthony Johnson concluded the discussion by stating that staff will work on and provide a process to the Council. Impact Fees Mr. Johnson stated that the city has recently upgraded it's impact fees and staff needs direction as to how to apply fees to property purchased based on old fees. Mr. Abernathy referred to the vested rights statute,and that old fees should apply. Park Master Plan Mr. Johnson asked for direction from Council with regard to the selection process for the firm that will assist with the development of the new Park Master Plan. He recommended that the Council select the consultant and asked what role the Council would like for the Parks Board will have in the process. Minutes of May 1,2001 Wylie City Council Page 1 Mr. Johnson stated that if a time line were not critical, it would be favorable to incorporate the Park Board who could make recommendation to the Council. It was suggested that representatives from Council (2) and representatives from the Parks Board(2)could narrow the firms from the four received to two firms to recommend to Council for presentations and final decision. It was recommended that presentations could be expected to come before Council on the May 22, 2001 meeting. Drainage Issues There was some discussion on drainage issues. Mr. Johnson stated that drainage issues have improved, and cited several factors. He stated that the City holds developers to high standards and having a City Engineer on staff has been instrumental in addressing this issue.
