11-13-2000 (City Council) Minutes MINUTES Wylie City Council Monday, November 13, 2000 Wylie Municipal Complex— Council Chambers 2000 State Highway 78 North Council Present:Mayor John Mondy, Councilman Joel Scott, Councilwoman Reta Allen, Councilman Eric Hogue, Councilman Merrill Young,Councilman J.C. Worley and Councilman Chris Trout. Staff Present: Anthony Johnson, City Manager; Mindy Manson, Assistant City Manager; Brady Sneligrove, Finance Director; Chris Hoisted, City Engineer; Claude Thompson, Senior Planner and Barbara Salinas, City Secretary. Reverend Ray Richie, First Baptist Church, was present to offer the Invocation and Councilman Eric Hogue was asked to lead the Pledge of Allegiance. The Mayor recognized the following Star Students for their exemplification of the Character Trait"Respect"as part of the Wylie Independent School District's Character Education Program. Aaron Dallas Canaday, son of Len and Mary Canaday, second grader from Akin Elementary; Cameron Rice, son of Terry and Drew Rice, fourth grader from Birmingham Elementary; Allison Cleere, daughter of Kenneth and Denise Cleere, Kindergarten class of Dodd Elementary and Andrew Dahir, son of Tracy and Russell Dahir, fifth grader from the Wylie Intermediate School. Unable to attend but still recognized were Ethan Prater, son of Frank and Dorothea Prater,third grader from Hartman Elementary and Whitney Rowell, daughter of Barbara and Ronnie Rowell, seventh grader from the Wylie Junior High. Capital Improvement Projects Update—Chris Hoisted,City Engineer Mr. Chris Hoisted, City Engineer provided Council with an update on the status of bond projects. Mr. Hoisted provided detailed information on projects completed and those remaining. There was some discussion regarding specific projects and the prioritization of future projects. At Council's request, Mr. Hoisted concluded with the following bid letting schedule for TxDot Projects. Bid letting for project involving FM544/FM1378/SH78 is May of 2001; Bid letting for project involving SH78/FM544 and Eubanks is June of 2001 and bid letting for project involving FM1378/FM544 and Brown is February 2002, adding that this is a County Bond Project that will require a city match. Mr. Hoisted father explained that bid letting consists of advertising for bids only and that construction could start within two months after. There was no participation from those in attendance. A. Approval of the Minutes from the regular meeting of October 10 and October 24,2000. A motion was made by Councilman Trout to remove the approval of the October 10,2000 minutes from the table. Minutes of November 13, 2000 Wylie City Council Page 1 Councilwoman Allen made a motion to approve the minutes from the October 10 and October 24, 2000 regular meetings,with the correction to page 2 , last paragraph with regard to the reference to "Mr. Johnson", rather than "Mr. Jackson". A Resolution of the City of Wylie authorizing intervention in Railroad Commission Gas Utilities Division Docket No. 9173 and coordination with other Cities to advocate maximum refunds of gas cost overcharges. Mr. Brady Snellgrove, Finance Director, addressed this item. Mr. Snellgrove explained that the intent of the Resolution is to authorize intervention in coordination with other cities as a follow up on cost recovery to customers. The overcharge stems from a complaint filed by Lone Star against its supplier, PG&E that dates back to January of 1994. Mr. Snellgrove explained that there is no assessment associated with this action. Councilman Worley made a motion to approve the Resolution authorizing intervention in Railroad Commission Gas Utilities Division Docket No. 9173 and coordination with other Cities to advocate maximum refunds of gas cost overcharges. Councilman Trout seconded the motion. A vote was taken and the motion passed, 7-0. 2. Consider and Act upon a Final Plat for the First Baptist Church Addition, proposed by Brockette, Davis & Drake, Inc., for the First Baptist Church of Wylie, for the property generally located within the southwest corner of Marble and Second Streets, between Ballard Avenue and Second Street, and being all of a certain 5.0 acre tract situated in the James Truett Survey, Abstract No. 920,City of Wylie,Collin County,Texas. Mr. Clause Thompson, Senior Planner, addressed this item. Mr. Thompson provided Council with a brief background on the Final Plat. He stated that at the October 17 regular meeting of the Planning & Zoning Commission,the Commission voted favorably to recommend this case. Representative from the Engineering firm of Brockette, Davis and Drake, 4144 North Central Expressway and Brother Al Draper, First Baptist Church of Wylie, were present for any questions or concerns by Council Councilman Worley made a motion to approve the Final Plat for the First Baptist Church Addition, proposed by Brockette,Davis&Drake, Inc.,for the First Baptist Church of Wylie, for the property generally located within the southwest corner of Marble and Second Streets, between Ballard Avenue and Second Street, and being all of a certain 5.0 acre tract situated in the James Truett Survey, Abstract No. 920, City of Wylie, Collin County, Texas. Councilwoman Allen seconded the motion. A vote was taken and the motion passed, 7-0. 3. Consider and Act upon a Final Plat for the Sage Creek, Phase HI Addition, proposed by Tipton Engineering, Inc., for Ashton Custer, LLC for the property generally located east of McCreary Road, south of McMillen Road and to the east of Sage Creek, Phases I and II, and being all of a certain 24.476 acre tract situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County,Texas. Councilman Worley abstained from any discussion and vote on Item No. 3 and completed the proper affidavit for Conflict of Interest. Mr. Claude Thompson addressed this item providing a brief background of the request. Mr. Thompson stated that at the October 17, 2000 Planning&Zoning Commission meeting, the Commission voted to favorably recommend this case. Consider and act upon a Preliminary Plat for the Greenway Addition, proposed by Pate Engineers for Greenway Investment Company, for the property generally located at southeast corner of FM 544 and Westgate Way,and being all of a certain 27.49 acre tract out of the E.C.Davidson Survey, Abstract No. 267,City of Wylie,Collin County,Texas. Mr. Claude Thompson addressed this item providing a brief background of the request. He stated that at the October 17, 2000 Planning and Zoning Commission meeting, the Commission voted 4-1 to favorably recommend this case. Council questioned the concerns of the Planning and Zoning Commission, with regard to the 4-1 vote. Mr. Thompson stated that the major concern was for off-site drainage and where excess would drain/pool. He explained that this is still being engineered as the site is developed, however, it was the major concern. The applicant, Jay Marsh of Pate Engineering,was present to address any concerns of Council. Councilman Worley made a motion to approve the Preliminary Plat for the Greenway Addition, proposed by Pate Engineers for Greenway Investment Company, for the property generally located at southeast corner of FM 544 and Westgate Way, and being all of a certain 27.49 acre tract out of the E.C. Davidson Survey, Abstract No. 267, City of Wylie, Collin County, Texas. Councilman Hogue seconded the motion. A vote was taken and the motion passed, 7-0. 5. Hold a public hearing to consider and act upon approval of a Replat for Railroad Addition, 1st Revision, proposed by Jackson and Associates Land Surveyors, Inc., for the property generally located at the southwest corner of Masters Avenue and Fifth Street,and being all of a certain 1.496 acre tract, situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County,Texas. Councilwoman Allen abstained from any discussion and vote on Item No. 5 and completed the proper affidavit for Conflict of Interest. Claude Thompson provided Council with a brief explanation of the request and public hearing requirements. The Mayor then opened the public hearing and asked that anyone wishing to speak either in favor or opposition of the request to come forward and state their name and address for the record, limiting their comments to three minutes. With no response the Mayor then closed the public hearing. Claude Thompson provided Council a brief background on the request. He stated that at the October 17 regular meeting of the Planning and Zoning Commission the Commission recommended approval of the replat. The Mayor then opened the public hearing and asked that anyone wishing to speak either in favor or opposition of the request to come forward and state their name and address for the record, limiting their comments to three minutes. With no response the Mayor then closed the public hearing. Minutes of November 13, 2000 Wylie City Council Page 3 Councilman Hogue made a motion to approve the Replat for Stone Grove, Phase I, proposed by Jackson and Associates Land Surveyors, Inc., for the property generally located 503 and 505 Stonehedge Drive, and being all of Lots 1 and 2 of Block B of the Stone Grove, Phase I Addition, situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Councilman Scott seconded the motion. A vote was taken and the motion was approved, 7-0. 7. Hold the first of two Public Hearings for the Annexation of 10.9 acres of land and being part of the Francisco De La Pena Survey, Abstract 688, and being a re-survey of all of a 22.039 acre tract as conveyed to Gary P. Williford and wife, described by deed dated September 14, 1961, recorded in Volume 587,Page 253 of the Deed Records of Collin County; save and except a 11.055 acre tract of land conveyed to David Walden by deed recorded in Volume 1845,Page 813 of the Deed Records of Collin County; located on the west side of Kreymer Lane and including 1053 S.Kreymer Lane. Ms. Mindy Manson, Assistant City Manager addressed this item providing Council with a brief explanation of the required process for Annexation, stating the same for items 7,8,and 9. The Mayor then opened the public hearing and asked that anyone wishing to speak either in favor or opposition of the request to come forward and state their name and address for the record, limiting their comments to three minutes. With no response the Mayor then closed the public hearing. 8. Hold the first of two Public Hearings for the Annexation of 5.7 acres of land and being part of the Francisco De La Pena Survey, Abstract 688; located on the west side of Kreymer Lane and including 1033 S.Kreymer Lane. Ms. Mindy Manson, Assistant City Manager addressed this item providing Council with a brief explanation of the required process for Annexation. The Mayor then opened the public hearing and asked that anyone wishing to speak either in favor or opposition of the request to come forward and state their name and address for the record, limiting their comments to three minutes. With no response the Mayor then closed the public hearing. 9. Hold the first of two Public Hearings for the Annexation of 54.5 acres of land and being part of the Francisco De La Pena Survey, Abstract 688; generally located on the east side of S. Kreymer Lane and including 1036 S.Kreymer Lane. Ms. Mindy Manson, Assistant City Manager addressed this item providing Council with a brief explanation of the required process for Annexation. The Mayor then opened the public hearing and asked that anyone wishing to speak either in favor or opposition of the request to come forward and state their name and address for the record, limiting their comments to three minutes.
