01-04-2010 (Construction Code) Minutes Construction Code Board CITY OF WYLIE Minutes Construction Code Board Monday, January 4, 2010- 7:00 pm Wylie Municipal Complex- Council Chambers 2000 Highway 78 North CALL TO ORDER Announce the presence of a Quorum. Building Official, Mike McAnnally called the meeting to order at 7:09 p.m. with the following Construction Code Board Members present: Allen Morris, Zachary Herrera, Brian Parten, Brian Huddleston, Billy McClendon, Sunil Verma. Staff present were: Building Official, Mike McAnnally; Code Enforcement Officer, Pat Mitchell; Code Enforcement Officer (Board Secretary), Wendy Young. In the absence of the Chairman, Mr. Ronald Hauck, and Vice-Chairman, Mr. Bryan Rogers, an appointed acting Chai rman will need to be voted on. Brian Huddleston made a motion to nominate Allen Morris, seconded by Billy McClendon. A vote was taken and a motion was passed 6-0. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Construction Code Board regarding an item that is not listed on the Agenda. Residents must provide their name and address. Construction Code Board requests that comments be limited to three(3)minutes. In addition, Construction Code Board is not allowed to converse, deliberate or take action on any matter presented during citizen participation. There were no citizens present to address the Construction Code Board during Citizens' Comments. PRESENTATION & DISCUSSION Update and discussion regarding the houses that the Code Enforcement Department has recently demolished under the Dangerous Building Ordinance#2008-49. Minutes—June 25, 2009 Construction Code Board Pagel BUSINESS ITEMS 1. Consider, and act upon, approving the Minutes from the August 27, 2009 Construction Code Board meeting. Board Action A nomination was made by Brian Huddleston to approve the minutes as submitted. Board member Brian Parten seconded the motion. A vote was taken and a motion passed 6-0. 2. Consider, and act upon, request of a Sign Appeal Hearing from Dr. Thota & Susan Disterlhorst seeking an appeal to sign permit denial through variance to allow offsite signange by lease agreement with Brookshire's (not currently allowed by Ordinance #2009- 21). The approval of variance will allow reconstruction of one of two existing Brookshire's signs on Hwy 78 for joint usage of Brookshire's and Founders Plaza Nursing Rehab located at 721 S Hwy 78 behind Brookshire's at 701 S Hwy 78. Board/Staff Discussion Building Official, Mike McAnnally stated that he spoke with the applicant and had withdrawn the action. 3. Consider, and act upon,the demolition of the house located at 206 S 3rd St,which has been determined by Code Enforcement to be a Dangerous Structure. The owner, Joyce Roland Myers has voluntarily signed a Dangerous Structure Waiver and Release form. The house and accessory structures will be demolished and a lien will be placed on the property with Collin County. Board Action Board Member Brian Huddleston made a motion to declare that 206 S 3`d St, to be a Dangerous Building Ordinance #2008-49 and to approve the demolition. Board Member Billy McClendon seconded the motion. A vote was taken and passed 6-0. 4. Consider, and act upon, the approval of the Emergency Secure at 604 Andersonville as per Ordinance 2008-49 Sec. 22.211(n)(1). Staff Discussion Code Enforcement received a complaint that this house had no garage door, it had been completely removed. The owner/residents vacated the property and left the front door unlocked. PD cleared the house and Code Enforcement boarded up on September 14, 2009 and posted. Board Action Board Member Billy McClendon made a motion to find that the structure at 604 Andersonville constitutes a dangerous structure under Chapter 22 of the Wylie Code of Ordinances and that the Building Official's securing of the structure was necessary to prevent the immediate danger to health, life, or safety caused by the structure. Consider, and act upon, the approval of the Emergency Secure at 719 Kerwin Ct as per Ordinance 2008-49 Sec. 22.211(n)(1). Staff Discussion Code Enforcement received a complaint on September 10, 2009 that a vacant house was having parties and the back door was kicked in. Upon arriving, we saw that the gate was open and the access door on the side of the house had been kicked in. The Police Department was called to clear the house so that an inside inspection could be made. The house had been vandalized. The house was boarded up on September 15, 2009 and posted. Upon serving a routine inspection on October 1, 2009 to check on the house, the board on the access door had been taken off and the door was again kicked in. Again, the house was vandalized even more the second time; several windows broken, graffiti on the walls, walls knocked down. The house had to be re-secured a second time. Board Action Board Member Brian Huddleston made a motion to find that the structure at 719 Kerwin Ct constitutes a dangerous structure under Chapter 22 of the Wylie Code of Ordinances and that the Building Official's securing of the structure was necessary to prevent the immediate danger to health, life, or safety caused by the structure. Seconded by Sunil Verma. A vote was taken and passed 6-0. 6. Consider, and act upon, the approval of the Emergency Secure at 1406 Abbeville as per Ordinance 2008-49 Sec. 22.211(n)(1). Staff Discussion Code Enforcement received a complaint on October 6, 2009 that a presumably vacant house had a broken window and the door was left wide open. Upon arriving, PD was called to clear the house before an inspection was made inside the house. The house was boarded up and posted on October 16, 2009. Board Action Board Member Brian Huddleston made a motion to find that the structure at 1406 Abbeville constitutes a dangerous structure under Chapter 22 of the Wylie Code of Ordinances and that the Building Official's securing of the structure was necessary to prevent the immediate danger to health, life, or safety caused by the structure. Seconded by Brian Parten. A vote was taken and passed 6-0. 7. Consider, and act upon, approval of the Emergency Secure at 1217 Destiny Ct as per Ordinance 2008-49 Sec. 22.211 (n)(1). Staff Discussion Code Enforcement received a call from the Police Department on September 25, 2009. They had been on a call at this house and stated the residents had vacated the property and left the garage door open with furniture and belongings in the garage. Also, the front door was temporarily closed and locked by PD. The Police Department was called a to clear the house before an inspection was made inside the house. The owner took immediate control of the property and paid all fees to secure the house in full. Board Action Board Member Billy McClendon made a motion to find that the structure at 1217 Destiny Ct constitutes a dangerous structure under Chapter 22 of the Wylie Code of Ordinances and that the Building Official's securing of the structure was necessary to prevent the immediate danger to health, life, or safety caused by the structure. Seconded by Brian Parten. A vote was taken and passed 6-0. 8. Consider, and act upon, the approval of the Emergency Secure at 505 Sheffield as per Ordinance 2008-49 Sec. 22.211 (n)(1). Staff Discussion Code Enforcement received a complaint on August 11, 2009 that they saw children coming in and out of this house. Upon arriving, we noticed the back door was open. Police Department was called to clear the house before an inside inspection was made. The house appeared to be vacant. The house was boarded up and posted on August 14, 2009. Board Action Board Member Brian Huddleston made a motion to find that the structure at 505 Sheffield constitutes a dangerous structure under Chapter 22 of the Wylie Code of Ordinances and that the Building Official's securing of the structure was necessary to prevent the immediate danger to health, life, or safety caused by the structure. Seconded by Billy McClendon. A vote was taken and passed 6-0. 9. Consider, and act upon, the approval of the Emergency Secure at 1105 Surrey Circle as per Ordinance 2008-49 Sec. 22.211 (n)(1). Staff Discussion Code Enforcement received a complaint on October 21, 2009 that the fence was completely down beside the driveway and there was very high grass at this residence. Upon arriving, we confirmed the fence had fallen over and t he back door was open. Pol ice Department was called to clear the house before an inside inspection was made. The house appeared to be vacant. The house was boarded up and posted on October 23, 2009. Board Action Board Member Billy McClendon made a motion to find that the structure at 1105 Surrey Cir constitutes a dangerous structure under Chapter 22 of the Wylie Code of Ordinances and that the Building Official's securing of the structure was necessary to prevent the immediate danger to health, life, or safety caused by the structure. Seconded by Brian Parten. A vote was taken and passed 6-0.
