A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor Chuck Trimble, Mayor Pro Tem Sandra Donovan, Council Members Cal Westerhof , Marvin Blakey, Chris DiTota and John Akin, City Manager John Pitstick, City Secretary Carolyn Jones, Finance Director James Johnson, Public Works Superintendent Don White, Assist. Engineer Ron Homeyer, Mr . Frank Medanich and Mr. David Medanich from First Southwest Investments. Councilman Crane arrived late for the meeting. Mayor Trimble called the meeting to order and Mayor Pro Tem Donovan gave the invocation. PRESENTATION BY JOHN MORGAN FOR USE OF COMMUNITY PARK FOR CIRCUS EVENT: Mr . Morgan stated that the circus was one of the major money making projects that WSA has each year . WSA was turned down by Century Business Park as it was just sold. The school also turned us down. Councilman Akin asked Mr . Morgan if he had said the school had turned him down. Mr . Morgan said yes. Councilman Akin said he was not for having our park grounds torn up, if it rains there will be a big problem. Mayor Pro Tem Donovan wanted to know if Mr . Morgan had checked with Barron Cook. Mayor Pro Tem Donovan stated she did not want our park grounds torn up either, and that there would be more of a chance for vandalism in the park area and the Library. Mayor Trimble asked how the lease read , and have you talked with Oaks Center . Mr . Morgan said the Oaks Center did not think there was enough grassy area for the tent. Councilman Akin stated that the circus use to use the lot just behind the fruit stand on Highway 78. City Manager John Pitstick said the park road is not made for heavy equipment or trucks . Mayor Pro Tem Donovan wanted to know if there was a problem with the fund-raiser for WSA as there was with the fire department . City Manager John Pitstick said no. Councilman Akin stated he would like to see the circus in the triangle on the highway and if they went to the park some money put in escrow to protect against the damage. Councilman Blakey asked Mr . Morgan if he was comfortable with the circus crew, if the City held WSA responsible for damages. Councilman Akin asked Mr . Morgan if the money received would go back into the park. Mr . Morgan said yes . COMMUNITY PARK FOR CIRCUS EVENT ON MARCH 14 & 15: Motion was made by Councilman Westerhof to table this item until the March 8th meeting and for Mr . Morgan to check on the other properties. Seconded by Mayor Pro Tem Donovan. The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Donovan - in favor, Councilman Akin - in favor, if Councilman Westerhof - in favor, Councilman DiTota - in favor, and Councilman Blakey - in favor. This motion carried with all in favor . Mayor Trimble recessed the business meeting and convened Council into a work session on the proposed priority street program, refinancing of equipment and financial proposals for landfill , street program and sewage collection system. City Manager John Pitstick stated that the original equipment purchased was for $350 ,029 . and this was for six (6) pieces of equipment. City Attorney Rob Dillard has told staff that there is no way to get out of the lease purchase. City has paid on this for 32 months and there is a buy out figure of $274,133 .29 if done by April 1 , 1988 . City Manager John Pitstick also stated that there was a clause in the agreement that will not allow you to get out without buying out the contract. By buying it out now, you can save $11 ,000 . in interest . Finance Director James Johnson said the cleanest way to get title is to buy it out and then if you want, sell it at market value. City Manager John Pitstick said the following is information on equipment for the street department : Dump Truck - necessary to keep - this piece of equipment is used daily Bomag - if the City has a street program, it is a must to keep the bomag. This machine will do all the base work that is necessary. Bomag roller - not the best piece of equipment for the use we need in the City. The City needs a pneumatic roller . The City can rent/lease a pneumatic roller for three or four months for approximately $2 ,000 . per month. Crack Sealer - the seal material needed for this crack sealer has to be heated to 450 degrees and staff does not have the right type of protective clothing for operating this machine. City does need to utilize a crack sealer in order to have a preventive maintenance program. Staff wants to keep this crack sealer, but use a different type of material . Distributor Truck - this piece of equipment could be sold if the City contracts out the overlay (topping) of the streets. Street Sweeper - high maintenance item with a lot of down time. Staff does not have the people to operate this at this time, and does not recommend a sweeping program at this time. Later if we have the staff, a street sweeping program could be done, but at the same time, staff does not oppose to putting this in the auction with a minimum bid. City Manager John Pitstick went over what would be needed in the way of equipment for a good street program: Pneumatic roller - rent/lease for three or four months Motor Grader - buy used - approximately $40,000 . Backhoe - to purchase a new one approximate cost $40 ,000 . Labor - need to hire three (3) part time employees during summer months when City is doing street work, estimated cost of $12 ,000 . Sewer Pump Truck - purchase of this equipment is necessary City Manager John Pitstick went over the proposed priority street list that Council has set up a few months ago. Staff would like to try for the first four streets this spring and summer . These streets are Callie Court including a cul-de- sac, Birmingham Street (from Hwy. 78 to S. Ballard) , East Stone (from Birmingham to Ballard) , and Brown Street (from Ballard St . to Hwy. 78) , and South Ballard Street (from Stone Rd. to City Limits) . City Manager John Pitstick then went over the equipment notes and certificates of obligation. There would be five equipment notes, buy out of Bomag lease purchase, a motor grader , a backhoe and a sewer pump truck with a total cost of $392 ,133 . There would also be a twenty (20) year certificate of obligation which includes the street program, assessment , labor and lease of pneumatic roller, replacement of utility lines , landfill , priority sewer design and phase one of the sewer lines which totals $1 ,243 ,690. The equipment notes and certificates of obligation would have 80% charged to General Fund and 20% charged to Utility Fund for debt service. City Manager John Pitstick stated that if Council wanted a major street program, staff had to move forward. If the above is done it would affect the tax rate as follows : 1987/88 1988/90 1989/90 0 & M .41 8% .4428 .4428 Debit .09 growth .1481 .1653 .50 .5909 .6081 Water 6 . 50 6 .50 6 .50 Sewer 7 .00 8 .50 10 .84 Councilman DiTota wanted to know why not go for a full bond program. City Manager John Pitstick said because the City could not afford it right now. Councilman DiTota said on the equipment, can staff contract out the manpower to run the machines. Mr . Johnson said we are, by hiring the three part time people. Mr . Frank Medanich was asked about the debt service for the City. Mr . Medanich said the debt service on the tax rate is very low for Wylie. The City of Plano debt service is 30% of the total tax roll and has been as high as 50% . The City of Denton is the same. Mayor Trimble set up public hearings on March 22nd and April 12th for informing the public of the street program. There being no other business or discussion, a motion was made to adjourn with all in favor . Chuck Trimble, Mayor ATTEST : Carolyn Jones, City Secretary CITY COUNCIL MEETING MINUTES APRIL 26, 1988 The Wylie City Council met in regular session on Tuesday, April 26 , 1988 at 7 :00 P .M. in the Council Chambers of the Wylie Municipal Complex . A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor Chuck Trimble, Mayor Pro Tem Sandra Donovan, Council Members Calvin Westerhof, Marvin Blakey, John Akin, Kent Crane and Chris DiTota , City Manager John Pitstick, City Secretary Carolyn Jones, Assist . Engineer Ron Homeyer . Mayor Trimble called the meeting to order and Mayor Pro Tem Donovan gave the invocation. Mayor Trimble recognized Mr . Bart Peddicord, and thanked him for being coordinator for "Clean Up Wylie" week. Mr . Peddicord came forward and thanked the Wylie First United Methodist Youth group and Pat Zimmerman and Mary Warkentine for coming and cleaning up that day and for the work that Council did. Mr. Peddicord gave the Council an award for being represented and helping with clean up. Mr . Peddicord also thanked John Pitstick and Carolyn Jones for coming and working on that day. APPROVAL OF MINUTES: The minutes submitted were for the April 12th meeting . Councilman Akin wanted the minutes corrected to reflect his statement as follows : in Mr . Delaney' s statement Councilman Akin said that the perimeter street fees had been paid for the Thrisk Property and for Southplace Subdivision and this money would go toward the reconstruction of S. Ballard. Also that some of the property along S. Ballard is outside the City limits and there would be no reimbursement . Motion was made by Councilman Crane to approve the April 12th minutes with the correction Councilman Akin made. Seconded by Councilman DiTota. The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Donovan - in favor , Councilman Akin - in favor, Councilman Westerhof - in favor, Councilman DiTota - in favor, Councilman Crane - in favor, and Councilman Blakey - in favor . This motion carried with all in favor . APPROVAL OF AN ORDINANCE AMENDING ORDINANCE NO. 84-12 - FEE ORDINANCE - ADJUSTING THE CHARGES FOR COPIES: This amendment is presented in order to establish fees for copies of open records for the public as set up by the State Purchasing and Central Service Commission. Motion was made by Councilman Westerhof to approve the amendment to Ordinance No. 84-12 - Fee Ordinance adjusting the charges for copies. Seconded by Councilman Blakey. The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Donovan - in favor, Councilman Akin - in favor , Councilman Westerhof - in favor , Councilman DiTota - in favor, Councilman Crane - in favor, and Councilman Blakey - in favor . This motion carried with all in favor . APPROVAL OF PRELIMINARY PLAT FOR TWIN LAKES SUBDIVISION: This property is commonly known as the Thrisk Property and is located on S. Ballard adjacent to the Southside Fire Station. Mr . Ron Homeyer, Assist. Engineer, said the developer is going to dedicate land instead of paying the park fees. Councilman Akin wanted to know if Alanis is coming through where the thoroughfare plans show it . Mr. Homeyer said yes. City Manager John Pitstick said we are not completely happy about the access to the park in the first phase, but in the second phase this will be taken care of . Mr . Tobin, representative for Thrisk Properties , said there is not much market for Retail at this time, but we plan to keep this area clean until such time the market picks up for retail lots, then we will sell or build on it. Councilman Akin wanted to know if Alanis lined up with the existing street. Mr. Homeyer said yes. Councilman Crane wanted to know if all the park land was in the flood plain. Mr . Homeyer said 2 .7 acres are in the flood plain. City Manager John Pitstick said the park will be addressed more in the second phase. Mr . Bart Peddicord, from Planning and Zoning, stated as it stands now, it is walking area into the park. Mr . Homeyer said there will be a lift station and staff will not bring this back for final acceptance until the lift station is in and working. Councilman Blakey wanted to know if the 14" water line was assessable to this development and I don' t believe the City owns this line at this time. Also would the developer be responsible for funding part of this 14" water line. Mayor Trimble said the line did not belong to us yet. Councilman Akin said it is where the line is plugged. Mayor Trimble said we did not have the dedication on this line yet. City Manager John Pitstick said we do not know exactly what is going to happen. By accepting this 14" line we will be waving or crediting some of the impact fees off that 14" line. In this case since that 14" line is already in there, they can die into it for off site water . Councilman Crane said he thought we had a pro rata ordinance. Councilman Blakey said that was what he was talking about . Councilman Crane said we have to cover the expense of the credit on the impact fees, I agree with Councilman Blakey that this should be looked into. City Manager John Pitstick asked Mr . Homeyer if we applied this in this case. Mr . Homeyer said if it is applied , it would be on frontage basis and I guess we could apply it to recover some of our cost. I would have to look into it . City Manager John Pitstick said we would check into that prior to bringing it back for final acceptance. Councilman Crane wanted to know if we shouldn' t check into this and give the developer an answer prior to approving the plat . City Manager John Pitstick said the plans are okay and we can check into this, if the line is dedicated to us, then we will go ahead and do the pro rata. Councilman Crane said the next item on the agenda is to approve the construction plans and I rather not until we can tell the developer what our position is. City Manager John Pitstick said to be honest, he did not know that this would apply to that line. Councilman Crane said the intent of that ordinance was to collect when we were out money for a line. Mayor Trimble said that is what he has been talking about , that the City did not put the line in . Councilman Blakey said he had no problem with this, he just wanted the developer to be aware of it . City Manager John Pitstick said if Council feels comfortable with it, then you could on the final plat put a stipulation on it that the intent of the Council is to apply the pro rata if it is applicable in this case. Councilman Crane said this is an old ordinance and has not been enforced like it should have been, I feel we need to check on it . City Manager John Pitstick said, first, we do not have the line, it is there but not our . Mr . Homeyer said he did not know of any written agreement between the City of Wylie and Lake Ray Hubbard Mobile Home Park for reimbursement or pro rata for the line. Motion was made by Councilman Blakey to approve the preliminary plat for Twin Lakes Subdivision. Seconded by Councilman DiTota. The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Donovan - in favor , Councilman Akin - in favor, Councilman Westerhof - in favor, Councilman DiTota - in favor, Councilman Crane - in favor , and Councilman Blakey - in favor . This motion carried with all in favor . APPROVAL OF FINAL PLAT FOR CONSTRUCTION ONLY FOR TWIN LAKES SUBDIVISION: This property is commonly known as Thrisk Property and is located on S. Ballard adjacent to the Southside Fire Station. Councilman Crane wanted to know if we have the plans for the lift station and off site sewer lines . Mr. Homeyer said we have plans for the sewer line, but no plans for the lift station. This will not come back for final acceptance until the lift station is in and working . Councilman Akin made a motion to approve the final plat for construction only. Seconded by Councilman Westerhof . The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Donovan - in favor, Councilman Akin - in favor, Councilman Westerhof - in favor, Councilman DiTota - in favor , Councilman Crane - in favor , and Councilman Blakey - in. This motion carried with all in favor. APPROVAL OF LEASE AGREEMENT BETWEEN THE CITY OF WYLIE AND LIFELINE AMBULANCE: City Manager John Pitstick said this is only a lease agreement for the 759 square feet of space being used by Lifeline. The contract will remain the same as before. They have to respond within eight (8) minutes to any emergency in the City Limits. There was a long discussion with all parties and it was decided to take the dispatching out of the contract . When a call comes in on 9- 1-1 , the dispatched will be able to stay on the line until the ambulance reaches the scene, but at the time dispatch receives the call , the dispatcher will automatically hit the button to transfer to Lifeline. Councilman Crane wanted to know who pays for connecting this switch for Lifeline. City Manager John Pitstick said it is already in the 9-1-1 system. It was built into the system from the first . Lifeline just has to provide their on dispatcher. Councilman Akin wanted to know what the change was from the original contract . City Manager John Pitstick said there was no change in the contract, they did not add the dispatching service. Councilman Akin said are we not giving them additional space. City Manager John Pitstick said no. Motion was made by Mayor Pro Tem Donovan to approve the lease agreement between the City of Wylie and Lifeline Ambulance. Seconded by Councilman DiTota. The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Donovan - in favor , Councilman Akin - in favor , Councilman Westerhof - in favor, Councilman DiTota - in favor, Councilman Crane - in favor , and Councilman Blakey - in favor . This motion carried with all in favor . APPROVAL OF THE BOUNDARY AGREEMENT BETWEEN THE CITY OF WYLIE AND THE CITY OF LUCAS: Motion was made by Mayor Pro Tem Donovan to approve the boundary agreement between the City of Wylie and the City of Lucas . Seconded by Councilman Blakey. Councilman Akin said that I hope that any of this land does not cover some that has been swapped back and forth a couple of three times, because State Law, the third time, it has to go back to the original City. Mayor Trimble said this has never gone back and forth. It is clearing up a boundary line and mainly has to do with ETJ. The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Donovan - in favor, Councilman Akin - in favor, Councilman Westerhof - in favor, Councilman DiTota - in favor, Councilman Crane - in favor, and Councilman Blakey - in favor. This motion carried with all in favor . CITIZEN PARTICIPATION: Mayor Trimble opened the meeting up to any one wishing to address the Council . When you come forward, please state your name and address for the record and keep your comments to within two (2 ) minutes. Mr . William Vick, 680 Jock Lane, stated he was out over the week end and was approached by a citizens on First Street. This citizen said there is a house that has 17 dogs living there, and the people are using the house as a kennel and selling the animals for a profit . Mayor Trimble asked Mr . Vick if he has reported this to Animal Control . Mr . Vick said he did and ask that Mrs. Lawrence call and make a formal complaint with Animal Control also . She has done this, but nothing has been done. Animal Control has given the lady five days to take care of the problem. Also talked to a another lady and she said that Mr . Faires said she could not go outside the City for an electrician. City Manager John Pitstick said he can live outside the City, but has to be licensed with the City. Councilman DiTota said we do have a reciprocal agreements with other cities now. COUNCIL DISCUSSION: Mayor Pro Tem Donovan wanted to know if some kind of letter could be sent to WSA about the trash bins in the park. In our work session with them, it was said that they would keep the trash picked up. Also the signs are not up when the fields are closed because of rain. Also the letter on the Zoning Board of Adjustments, we need to look at this Board. City Manger John Pitstick said we have had two scheduled meetings and no quorum. City Manager John Pitstick he will say this in defense of the Board, they do not meet on a regular basis. Councilman DiTota said it was also noted that Mr . Gary Ludwig is moving and we will be getting a letter of resignation from him. Councilman Akin said if his memory was right , the Ordinance requires five members and five alternates, isn' t that right. City Manager John Pitstick said he was not for sure. City Secretary Carolyn Jones said five members and two alternates . Councilman Akin said he was reading this from the Zoning Ordinance, the Mayor appoints them and the Council endorses them. Councilman Akin said in the past what we have been doing is trying to take care of some friends and we are getting people who are not reliable and I think that is bad . We have to make sure these people want to serve and will be available for meetings and forget about friendships. City Manager John Pitstick pointed out the letter to NTMWD requesting a tap for Mr. Riches property. NTMWD will bring this to their board this month. City Manager John Pitstick said he listened to the tape on the meeting with Shiloh Baptist Church. Mr . Homeyer went out and did the engineering on this job, which was to be done by us in order to help the church out . The meeting ended with them saying they had a contractor to do the job for $6 ,000 and the Council said to do it . Now there is no one to do it for this amount of money and Shiloh is requesting the City to pay the additional amount of $5 ,900 . This will come back to Council in May, but staff will not recommend this. Councilman Akin asked what the tape said . City Manager John Pitstick said that the City would design the plans and do all shop drawings and they were to go out and get bids. If the bids come in high then they had the option to go to septic system if they wanted to. Councilman Akin said what he wanted to know is, did the Council make any commitment from the Council table. City Manager John Pitstick said no sir . Councilman Crane said in discussing that with you today, you reminded me that that was a work shop and no vote was taken, I still believe that the City should participate with Shiloh when the time comes. City Manager John Pitstick said as soon as we know what our bids are on the drainage and utilities are we will bring this back and let Council reprioritize their list. Mayor Pro Tem Donovan said she agrees with Councilman Crane there might not have been a formal vote taken, but the feeling that was left from this Council to those people was that if you can get it for $6 ,000 . , then go for it but if you can ' t then we would help due to the cost difference we had given out. City Manager John Pitstick said the tape said if you can' t, then go to septic system and this was said by two people on the Council . Councilman Blakey wanted to know how much was taken in at the Auction. City Manager John Pitstick said $18 ,000 . Councilman DiTota said at the last meeting he brought up to Mr. Faires directly about the weedy lots. As of this date, we have not seen any letters that are going out, are there letters going out . City Manager John Pitstick said there were letters going out and he would see that Council got a list of where the letters have been sent. Some of the property owners live out of town and we are not getting any response from them, but the one that live in town are responding. Councilman DiTota said if it is a property that is occupied , can we cut the grass and then put a lien against the property. City Manager John Pitstick said we can, I do not know if we have the forces to be able to do that . Councilman Akin said I think you will find some bells and whistles in the Zoning Ordinance, some guide lines that tells you what to do on these situations. Mayor Trimble said he has had several calls on some property, but when they are under bankruptcy, it becomes a little harder to work with in placing a lien on property. Councilman Akin I mentioned about the Zoning Board of Adjustments, Section 31 in the Zoning Ordinance tells you about the Zoning Board, shall consist of five members and four alternates each to be appointed by the Mayor and confirmed by the Council , each to be appointed for two year terms . Councilman Akin also wanted to know if there was any progress on the Railroad crossing at McCreary Road. Mr . Homeyer said he has written to the Railroad , but has had no response. Councilman Akin said this is to go through to Parker Road and it is very important. Also what is the status of Spring Creek Blvd. , east of the Cabinet Shop there is a lot of surveyors out there and people are getting a little nervous. I think someone from the County needs to let these people know what is going on out there. Councilman Akin also wanted to look at the addresses in Point North, Gaston Street is very confusing with the way it is numbered and with 9-1-1 System it needs to be checked out. Councilman Akin also said on the Private Club Ordinance, it was taken before Planning and Zoning and this is a section for Special Use. Surely they are aware of the Ordinance that we have that everything goes to a public hearing, I was shocked when I read in the paper where someone was trying to get a permit . City Manger John Pitstick said he was right, but the State has taken away most of the controls from the City, use to be the Police Chief would be notified. The only control we would have now is if they receive less than 75% of their gross sales from food, then we would have some say in it. Staff will be bring some changes forward that will put our ordinance back in order since the State has made their changes. Councilman Akin said he would like to have that, since he was a member of the group that went to Austin and worked with the Commissioners to get things changed. Mayor Pro Tem Donovan said she has one questions in support of what Carolyn said, I looked in the Charter and it states five members and two alternates. Mayor Trimble said what Councilman Akin was talking about is the old ordinance before the charter was adopted . Councilman Akin said what he was getting at is that we should go back to that so we would have plenty of people on it. Mayor Trimble said might be, but we would have to have a special charter amended election. City Secretary said there was an election school in McKinney on Thursday at 2:00 P .M. for candidates and election judges and clerks if anyone was interested in going . M. in the Council Chambers of the Municipal Complex. A Quorum was present and notice of the meeting had been posted in the manner and time required by law. Those present were Briar► Chaney, Chairman►, Board Members Bob Skipwith, Marty Stovall, Bart Peddicord and Cecelia Woods, Secretary, Robin► Belz, code Enforcement Officer, Roy Faires, City Manager, John► Pitstick, Engineer, Ron Horneyer. R. P. Miller an►d Ber► Scholz were absent. Chairman Chaney Called the meeting to order. APPROVAL OF MINUTES: The minutes submitted for approval were for the April 18, 1988 meeting. Chairman Chaney asked if there were any corrections to be made. Mrs. Wood stated that the next to the last paragraph, next to the last sentence, it was recommended to the Council that it be repealed not appealed. Mr. Peddicord stated the sentence ahead of that if the word ordinance was taken out the sentence would make more sense. The last paragraph the first sentence Mr. Peddicord stated that "the" should be added to the sentence where Mr. Chaney stated that on the first two plates he was concerned about the easements an►d exactly how they were going to effect the builder. Then Mr. Peddicord stated that Mr. Faires responded with an answer that "the easements had beer► clarified". Mr. Chaney stated that before the next sentence there was a question► by he ar►d Cecelia that "there was concern about the Park being ir► the flood plane", ar►d then go on with the rest of the paragraph. A motion was made by Mr. Peddicord that the minutes be accepted as corrected. Seconded by Mr. Stovall. The Motion carried with all in favor. CONDUCT PUBLIC HEARING ON REQUEST FOR SPECIAL USE PERMIT FOR FIRST BAPTIST CHURCH FOR PORTABLE BUILDING: Chairman Chaney asked staff before opening the public hearing if there were any mail-outs on this subject and if there had been ar►y replies from concerned citizens. Mr. Pitstick stated we had received nothing back from ar►y concerned citizens at this time that he was aware of. Mr. Chaney asked if there was an►y additional comments to made from the staff. Mr. Pitstick stated the only problem that staff had would be if the request would only be two years and after that require them to come back after that time. Mr. Skipwith asked if it made any difference to staff or board whether it was used for storage or educational purposes because he was under the understanding that it was going to be used for storage. Mr. /6° Pitstick replied that the staff would lean against the use for storage purposes. Mr. Chaney replied that there should be stipulations put on it that it be used for educational purposes only. Mrs. Wood stated that it has been the churches history through the years that they have maintained upkeep on most other dealings and agreements made with them. Mr. Pitstick said his concern was someone else wanting to come in and place a portable building at another location and using it for other purposes and the staff didn' t want to see this happen. Mr. Skipwith being a member of the church said that there should be stipulations that if they wanted to use it for anything other than educational or worship purposes only and if they wanted to use it for other purposes they needed to come back to the commission. Mr. Stovall questioned that what if someone else wanted to do this also. Mr. Pitstick replied that he felt that if it was just kept with churches and schools for expansions that there should not be any problems. After discussion with the staff and Board Chairman Chaney asked if there was anyone to speak for or against this item. There was no citizen response. Mr. Chaney then closed public hearing. CONSIDER APPROVAL OF RECOMMENDATION TO CITY COUNCIL FOR SPECIAL USE PERMIT FOR FIRST BAPTIST CHURCH: Mr. Chaney asked if there was any discussion on this item and if not to make a motion. Mr. Skipwith made a motion recommending approval to Council with the specifications to use for educational and worship purposes only, and only for a two year period. Seconded by Mr. Peddicord. The motion passed with all in favor. CONSIDER APPROVAL OF RECOMMENDATION TO COUNCIL FOR A RE- PLATE OF TRACT 5 OF BUTLER ESTATES: Mr. Pitstick stated that the items were not common plates and were located outside our City but are in our E. T. J. and we require plating in our E. T. J. outside our city. Mr. Pitstick also stated that it may be a while before it is brought into our City. Staff stipulation that we have on this subject is that if it is ever brought into the City it is recommended that part of the motion be the road be brought up to standards before accepted within the City. Mr. Chaney asked if there was any more to be discussed on the item, there was none. He sought a motion to be made. Mr. Peddicord made a motion to recommend to Council of the re-plate of Tract 5 Butler Estates with the stipulations of not accepting roads because they do not meet existing city standards required. Seconded by Mr. Stovall. The motion passed with all ir► favor. CONSIDER APPROVAL OF RECOMMENDATION TO CITY COUNCIL FOR PRELIMINARY PLAT OF CANTERBURY HILLS: In general discussion The staff stated that the biggest issues are the subdivisions in our E. T. J. and this particular plat may not be brought into the City for some time and is in our E. T. J. and we feel we need to set some general guide lines down. Mr. Skipwith asked if the City had any control on what can be put on the lots. Mr. Pitstick replies that their is no zoning control and that at this time plating is our only way to control it. The subject of water supply was brought up. The staff stated that Eastfork Water Supply was supplying water to that area. There is a 6" line which meets Eastfork standards and it is able to handle the existing lots. Under the City' s current subdivision regulations we require an 8" line and if the lots were ever brought into the City, the City would then require them at that time to be connected with our water lines. The sewer is at least a half a mile from City sewer lines and the staff feels that this is too far away at this time to tie in for the amount of lots we are discussing. Staff requests that if they stay within at least 1 acre lots septic tanks be accepted. But if it ever carve into the City and it was within reasonable distance to a sewer line at that time the City would require that they hook up to the sewer lines. Staff suggested that for these reasons being at this time the water and the sewer be waived as long as they were 1 acre lots and not close enough to tie in with our sewer lines. The particular road we are discussing is a collectors road. Staff stated the road at this time is maintained by the County staff is recommending that some improvement be made on the road and be set at, at least 27' minimum requirements with curbs and gutters and that the street will last at least 20 years, due to the fact that when it is brought into the city we don' t have to maintain it for some time. Mr. Chaney had a concern on where to draw the line as far enforcing our street ordinances. He stated he did not want to regress back to asphalt streets. We have a lot of asphalt roads now that need many repairs and he felt if it was concrete it would have a longer life span. Mr. Pedd i cord agreed. Mr. Pitstick stated that any street can last long if it is built right, staff was just wanting something that they would not have to have immediate maintenance on. Mr. Cook the developer spoke and had an argument on tearing up a road that was perfectly fine at this t irne and he felt that it was a waste of money and time. He stated it was money spent unnecessarily. Mrs. Wood stated that due to the fact of the traffic on the road it needed to be widened, if it has a 20 year life span and at this time it is 14 years old it only has a life span of 6 years left. Mr. Cook' s argument was that it was maintained by the county at this time and there is no definite time when it will be corning into the City why make me tear it up, when you just previously on the issue before this one "-appi^oved it. Mrs. Wood replied that, that was a completely different situation. Mr. Chaney questioned Mr. Cook as to -wtietfier fie was tied to lots. Mr. Cook stated that it has been taken to North Texas for septic tank purposes. Mr. Chaney—stated to Mr. Cook in the future when the sewer was available he could go with smaller lots so he felt Mr. Cook was asking the City to ignore the ordinances. Mr. Cook replied no not at all. I just feel the Ordinances ought to be different outside of the City than inside. Mr. Stovall asked if it was possible to leave it as existing with an escrow account to help pay for the road later when it is in the City . He stated that if the road is a good road he would like to preserve it, but would like to see some protection for the City. Mr. Cook was not opposed to this. Most of the Board members are in favor of seeing the road built now due to the fact it would cost builder the same amount of money. Mr. Tom Fritzcall at 400 E. Gaston spoke as citizen in Wylie that has experience with both concrete and asphalt and in his experience with asphalt there is constant maintenance with asphalt. He does agree that a concrete road will last 20 years maintenance free only if it is built right. Asphalt will last 20 years only with ongoing maintenance. He stated that in his opinion if your going to buy a large home with a large lot your not going to want to drive down a road that has all kinds of pot holes in it to tear your yard up. He stated that concrete would be best as far as the City was concerned. After some discussion Mr. Chaney asked if there were anymore questions and if not that a motion be made. Mr. Chaney made a motion to recommend to Council with the stipulations that the Eastfork Water Supply be allowed to enforce their standards. That since these are 1 acre minimum lots that they not have to lay sewer lines and allow them to use septic tanks. That the draw used for drainage be straighten by Engineers. That the existing road be widened to 27' with curbs and gutters with an asphalt street, and that the 37' road be waived. Seconded by Mrs. Wood. The motion passed with 4 in favor and 1 abstention by Mr. Skipwith. GENERAL DISCUSSION: In the general discussion Mr. Chaney suggested that they set up a meeting with City Council to discuss some of the items talked about in meetings. He stated that there was going to be new members on the Council and that they needed to meet them. Mr. Chaney suggested doing it on an odd Monday sometime. Mr. Stovall mentioned that there was a street with a bad dip in it on Douglas and when people drive down the road most of the time they bottom out due to this, and was wondering if we could do anything about it. He asked if someone could look at records and see when street was inspected for approval. Mr. Pitstick replied that in 1986 was when standards were updated. Mr. Stovall asked that we look at the records that show there was needed repairs at that time. Mrs. Wood asked if there was anything that could be dor►e about the electricity company coming out and putting in T- Poles and r►ot covering the holes up. Mr. Pitstick replied that they should be doing that and staff would check it out. He stated that it should be grated back. Mr. Peddicord stated he notice a number of pockets that are not in the City Limits that need to be cleaned up, and wanted to know what we could do about it or what car► we start to annex to be able to clean it up. Mr. Pitstick replied that Council is working on filling those doughnut holes right now. Mr. Chaney stated that, that would be a good item to discuss at the meeting with Council. Mrs. Wood asked if anytime anyone in our E. T. J. was developing something did they have to come to us. Mr. Faires stated that we could file a violation or► them if they don' t. Mr. Pitstick also replied stating if we see development we car► quest ion it ar►d have them bring it to Council. Mr. Skipwith asked about running a mechanics business in a residential area. Mr. Faires replied that you would have to prove it ar►d it is very hard to do. There being no other business a motion was made with all in favor. Dear Colleague: When, a few months ago, citizens observing a man about to shoot a Dallas Police Office, John Chase, yelled "kill him, kill him"and the officer was slain we all were appalled. That is why May 15th, Police Memorial Day is so important and why we are writing to urge you to participate in your community, county and state. You might ask yourself if our nation is sick?And I think you would agree with me that we are! That in fact law enforcement officers are the thin blue line that stands between those infected with crime and anti-social behavior and those who are dependent on us to protect them at a high cost. Our very lives. - About every three days a law enforcement officer is killed in the United States. I know as we have been keeping tally for almost thirty years. In what is a very difficult task as president of the only memorial to all law enforcement officers here at the American Police Hall of Fame,we also know that nearly 60,000 officers will be seriously injured. Shot, stabbed, hit, run down, that is nearly 10% of the total full time officers of all federal, state, county and local police agencies! You may well have been a victim yourself or have known an officer who has the stitches and wounds on his body. Of this war we are fighting. The war on crime. I'm asking you to help us commorate Police Memorial Day on May 15th which is on a Sunday this year. It could be as simple as placing a black tape on your badge or star and placing the national colors at half mast or a more elaborate program. We have enclosed a booklet on police and citizen awards that could be used and that is available. I want to suggest that you contact the Churches in your community and ask them to use Sunday, May 15th as a day to honor the police in their sermons. We can use a lot of prayers. You can also help by writing a letter to local community newspapers and get local media to cover memorial services. If you want a list of the officers killed nationwide in 1987 we will be happy to send you a list by name, department, date of death and how they died. "The final roll call." We think(and we would like your opinion)that part of our police problems is related to violence on television. The way police officers are depicted. It is impossible to prove like a fingerprint or blood stain, but, we have a "gut feeling" that shows like Crime Story makes us all look terrible. That violence against police results, Why else might a crowd urge on the shooting of a police officer instead of trying to aid him in a struggle with a vagrant? If you agree you might send the card we have enclosed to NBC and let them know your feelings. The fact of the matter is that by the time a typical kid grows up and has watched television he or she will witness countless killings(estimated 80,000), the general view of cops on TV is dumb, or evil, or corrupt, or all three. That the only person that can solve a case is "Magnum PI." You job is made tougher by a lot of factors. Not enough manpower. Not enough money to modernize your cars, radios and what we have is a"glorification of drugs and drug money." So we must remind our community that we are flesh and blood. On our day off we mow the lawn. That when we are hit we bleed. We die. That is why we ask you to do your share for Police Week and Police Memorial Day. We have been involved in this program for twenty-eight years! We all serve as volunteers. None of us are paid as officers or directors. We ask you to send money for postage or to subscribe to the quarterly newsletter that lists every officer killed in the line of duty and then send an annual report. It is with the promise that every cent goes to the educational purpose. You will find enclosed an invitation to become a subscriber to our quarterly report and the annual Hall of Fame Book. We list the name, age, date and department of every officer in America who is killed. For training officers it will give you an edge on trends and we hope, save lives. For the families of the officers killed it will mean to many that you care because we urge all of our readers to send condolence cards to these bereaved families. Not many people know that we maintain contact with every family member as long as they live. Spouse, children, mother, father, sisters and brothers. On your behalf we write on the anni- versary of their deaths so that someone always remembers. We also remind every law enforce- ment agency of the officer they lost. So they don't forget as well. Now the rest is up to you. If you lost a friend in a war on crime would you want the memory to fade?I don't think so. Box 428 Wylie, Texas 75098 Dear Mayor Trimble: The 70th Legislature, in House Bill No. 1652, enacted certain amendments to the Texas Alcoholic Beverage Code, including the enactment of a new section, Section 109.57, providing that a regulation of a city may not impose stricter standards on premises or businesses required to have license or permit under the Alcoholic Beverage Code than are imposed on similar premises or businesses that are not required to have such a license or permit. The Act does not affect the validity of an ordinance enacted prior to June 11, 1987, with regard to a specific tract of land on which such a business is located. However, it does prohibit the imposition of a regulation on such a business unless that business derives 75% or more of its gross revenue from the on-premise sale of alcoholic beverages, or unless it is a massage parlor, nude modeling studio, or other sexually oriented business. To the City of Wylie, this means that any existing private club premises in the city which were zoned for that business prior to June 11, 1987, must still comply with the provisions of that particular amendment to the Comprehensive Zoning Ordinance. On the other hand, future cases will be restricted by this Act unless such premises are within the categories listed above. I note that Section 16 of the city's zoning ordinance permits a private club serving alcoholic beverages in a retail district by a specific use permit granted in accordance with Section 22. I reviewed Section 22 and observed that it permits the council to impose conditions in the granting of a specific use permit that would not be imposed on other types of retail uses which are permitted as a matter of right. Section 22 does not appear to contain any specific regulations as to private clubs serving alcoholic beverages. It is my recommendation that this matter be referred to the Planning and Zoning Commission to call a public hearing to consider amending the Comprehensive Zoning Ordinance to permit a private club serving alcoholic beverages as a matter of right in a retail district unless the private club is the location of a massage parlor, nude modeling studio or other sexually oriented business or it is an establishment that will derive 75% or more of its gross revenue from the on-premise sale of alcoholic beverages. Similarly, the requirement for a specific use permit for such a private club should be applicable to only those same types of premises. 07 8 Mayor Chuck Trimble Page 2 January 21, 1988 One question that bothers me reading this statute is the determination in advance that an establishment will derive 75% or more of its gross revenue from the on-premise sale of alcoholic beverages. My present best guess is that there will not be any such premises in the city because of the fact that such a business could probably not survive economically. However, it is a possibility and should be provided for in the zoning ordinance as outlined in this letter. Please let me know if you have any questions on this subject at this time. This is a lot split making two (2) lots of five (5) acres and four (4 ) acres respectively. Located outside the City Limits and in our ETJ brings into effect our subdivision ordinance requirements for streets, water, and sewer. Normally these stipulations would require a minimum of 27 ' concrete curb and gutter street, and a minimum of an 8" water and sewer line. Since this replat is a large acreage and is not a reasonable distance from existing sewer, the applicant can utilize septic tanks with City Council approval . Since this area is in the East Fork Water District the applicant must meet the East Fork Standards and not the City of Wylie standards. Currently this replat has no frontage to a city or county road but utilizes a 40 ' private easement and rock road . The street improvements issue is a policy decision that should be made by Council . Since this plat is outside the City and not contiguous with City streets, staff and Planning and Zoning were concerned that a minimum of a 27 ' curb and gutter street be built to last for a minimum of 20 years, thus giving the developer an option on asphalt or concrete. Under our subdivision requirements, if this was currently in the City the developer would be required to build a 37 ' concrete curb and gutter street. Their request for a change in rates is based on the contract that references Federal cost/labor indices (a standard practice) and a landfill cost factor that either increases or decreases. For the preceding year, test year, ending March 31, 1988, these indices all increased-thus the BFI request. The attached list includes a series of correspondence with BFI Waste Systems about this request. Exhibit I - City letter to BFI Waste Systems requesting 7.9% rate increase though contract indices call for a 10.56%-City requests that BFI permanently waive the 2.66% difference in rate request. ( Exhibit I is a reponse to Exhibit III -rate request) . Exhibit II- Letter to Rob Dillard, City Attorney, from city staff about latest rate request and the 7.9% requested versus the 10.56% that the contract indices state is required.(This is also a reponse to Exhibit III) . Exhibit III - BFI Waste Syatems formal rate request of May 2, 1988, rate request is less than authorized contract amount by referenced indices; request is for 7.9%-10.56% authorized. Exhibit IV- April 21, 1988 rate request from BFI Waste Systems requesting 5.8% rate increase-due to incorrect indices being cited. (See Exhibit V) . Exhibit V - Original city staff response to April 21, 1988 BFI rate request(Exhibit IV) . Letter explains the proper CPI indices that are part of the contract that BFI did not cite correctly. Net Shortage <15,426> Part of this shortfall can be traced that when the City contracted with BFI, we lowered our operational margin overhead (revenue share city receives) from $1.14 per residential unit to-$1.00 each month. Likewise reductions were included in the commerical hand-collect accounts. We also correctly moved the franchise fees collected from the contractor to the General Fund (fees paid for use of streets and alleys, also called a gross receipts tax/fee) . This revenue is projected to be in the $21,000 range for this fiscal year. Previously, this revenue went back into the Sanitation Operating (Enterprise) Fund and an overhead allocation was made (See Exhibit VII) . The last time the Sanitation Enterprise Fund was in a positive position of net income was at the period ending 9/30/86 and that amount was only $966.00. That was in light of an audit of Moore Industrial Disposal's records (the contractor then) which revealed that they had lost approximately $50,000 the preceding test year. With the existing rates, the city charges $1.00 per residential customer for overhead operations, i.e. wholesale rate(rate BFI charges city per residential customer is $6.40 per month, our charge is $7.40. This was supposed to cover our costs of handling the billing for them on residential & commerical (hand collect) customers and a few of the shared dumpsters. BFI bills and collects for the majority of the dumpsters. This overhead covers personnel, mailing, supplies and billing expenses. One employee is funded here by this process. Given the existing overhead, the $1.00 pass-thru is not adequate. That is, since BFI is submitting a request for a rate increase for all classes of customers for the City of Wylie of 7.9% but the indices referenced in the contract between the City and BFI call for a large increase, there is a potential problem. That problem is that the two CPI indices in the contract call for an 8.66% increase and you landfill costs indicate a 1.9%, thereby, totaling 10.56%. The City requests that BFI by written letter hereby waive the difference between the 7.9% and 10.56% or 2.66 % for this rate request and any subsequent rate requests, that is , once waived the 2.66 % cannot be used in the future. Additionally, I would request that a more detailed explanation . be given of the landfill increase , specifically how you were able to arrive at the 1.9% that you seek to pass on to Wylie customers. The problem, as we discussed, is that BFI is requesting less than the indices referenced in the conract. The total indices that are referenced in the contract (including the landfill) indicate an approximate increase of 10.56% (CPI-W 2.89%, CPI-Gasoline 5.77% and Landfill-1.9%) . However, as we discussed, BFI is only requesting 7.9% increase overall on all classes. Ostensibly, this 7.9% figure was used to avoid any Council consideration of Section 13.02 (C) of the contract, which allows the Council to consider termination of the agreement if the increase exceeds 8% in fees for any twelve month period. I am requesting by letter that BFI permanently waive the difference between the requested 7.9% figure and the 10.56% that the indices of the contract dictate. I suspect that this item will be on the Council's agenda for discussion at the May 10th meeting and as popular as rate increases are, there may be questions about BFI's methodology and choices the Council may consider. Box 14 Allen, Texas 75002 Re: Rate Proposal Letter Request-April 21, 1988 Dear Mr. Appel: I have examined your most recent rate request letter on behalf of BFI Waste Systems for a change in rates for all classes of customers (residential,commerical hand collection, dumpster and so forth) for the City of Wylie, Texas. However, after contacting the Dallas office of the Bureau of Labor Statistics and the information given to me by phone, I find your latest proposal' and BLS data do not reconcile. It appears that you utilized different statistical data. I have requested that copies of the statistical that they quoted be provided to the city in printed form. As I read the contract between the City and BFI, Section 13.02 specifically outlines the methods for calculating rate adjustments on an annual basis beginning with the second year of the contract. This section states that " as of the last month of the first year of the contract and every twelve (12) months (on the rate modification date) , the fees shall be increased or decreased for the ensuing twelve (12) month period in a percentage amount equal to the net percentage change of the Consumer Price Index for Urban Wage Earners and Clerical Workers (All Items) plus the percentage change for the Consumer Price Index for Urban Wage Earners and Clerical Workers (Category)-Gasoline." These particular indices are published bi- monthly by the U. S. Department of Labor, Bureau of Labor Statistics. Other CPI indices are published monthly and it appears that you have used one of these. The percentage changes: simply stated by the contract provisions dictate that BFI Waste, Systems will increase or decrease the rates annually by an amount equal to the percentage changes in the CPI-W from February 1987 to February 1988. Box 428 Wylie, Texas 75098 Re: Wylie/Lucas ETJ Agreement Dear Carolyn: The city charter of the City of Wylie provides that territory may be disannexed from the city in any manner provided by state law. In connection with this agreement, it appears that the City of Wylie is to disannex the territory annexed by Ordinances No. 86-42, 86-43, and 86-44, and that it is to disannex a portion of the territory annexed by Ordinances No. 86-12 and 86-45. Section 43.142 of the Texas Local Government Code provides that a home rule municipality may disannex an area according to rules provided by the charter and not inconsistent with the procedural rules of the code. However, there do not appear to be any procedural rules set out in the code for disannexation by a home rule city in these circumstances. Since a home rule city normally has all legislative powers except those denied it by the Constitution or restricted by or which would be in conflict with state statutes, it is my opinion that the city may accomplish the aims of this agreement by simply enacting a disannexation ordinance describing the areas of the city to be disannexed. If you will have the City Engineer furnish me with the correct legal descriptions, I will be happy to prepare a proper disannexation ordinance for you. No notice or public hearing is required, although it is a general practice to record such an ordinance in the deed records of the county, to furnish the Texas Department of Community Affairs with a certified copy, and to submit the ordinance to the Justice Department for clearance under the Voting Rights Act. The total cost of this line is eligible for reimbursement from individuals or developers who wish to connect to this line. Therefore, you will have to reimburse the City of Wylie for your share of the cost of the line as you connect your system to it. The amount of your share of the cost has been determined by taking the total cost of the water line across the front of the Twin Lakes Subdivision and dividing it by two. The reason for charging you half of the cost of the line across the frontage of your subdivision is that the property on the west side of Ballard will some day develop, requiring water service, and the City will recoup the remaining half of the cost of the line at such time. Approximately 80 L. F. of the concrete rip-rap has broken and fallen into the channel , jeopardizing the integrity of the roadway. We have contacted the Collin County Staff to determine what the design criteria for the channel was, and who was responsible for the repair. The County has advised us that the design of the channel was recommended by the County Staff and prepared by Cummings & Pewitt, Inc. This project was not handled well and the finished product has not withstood the test of time. You and your construction firm should have insured that the concrete lining on this channel was constructed properly and accordance with the plans. The City does not feel that it should make the citizens of Wylie bear the cost of the repair. Please contact us regarding the repair of the said channel at the earliest possible date. Box 428 Wylie, Texas 75098 RE: Request for Individual Water Service Dear John: The NTMWD Board of Directors in a Regular Meeting on April 28, 1988, authorized the Executive Director to allow a connection for the City of Wylie to serve an individual single family resi- dence immediately across Hooper Road from the entrance to the NTMWD Maxwell Creek Landfill . Based on the City 's request the NTMWD would provide service under the following conditions: 1. That a meter be set on NTMWD property prior to crossing the road and that the City of Wylie be responsible for all cost involved in tapping the line, meter installation and service to one property owner with the full understanding that this service would not be extended to any other property owners or customers. 2. That the property owner and/or the City would install a standard air gap connection with storage and pump for the residence in accordance with the Retail Water Service Policy of the NTMWD. This would then conform to the Health Department regulations and provide more dependable service to the property owner. 3. The NTMWD would bill the City of Wylie for the usage through the meter as an addition to the Steel Delivery Point . The City of Wylie, therefore, would be responsible for billing the individual for water service in accordance with their standard policy and rates. 4. The NTMWD would not accept any responsibility or liability for service to the individual property owner, and the City of Wylie by signing this letter through the City Manager, will be acknowledging and accepting the responsibility to the property owner and for any problems with the tap, connec- tion and service. The lift station system which serves the Southfork Mobile Home Park experienced a power outage on February 28, 1988 as reported to the District 4 Office in Duncanville by my letter dated February 29, 1988. The stipulated penalty for this by-pass as set forth in Provision N of the Texas Water Commission Enforcement Order is $100. 00. Texas 75116 RE: Lift Station By-Pass Dear Mr. John : On Sunday, February 28, 1988. the three lift stations which comprise the South Fork Mobile Park temporary lift station system stop functioning due to a power osLtage. Farmer' s Electric Cooperative restored the power as soon as possible, which was three (3) hours later. The City of Wylie was unable to pull together a contingency operation during this power interruption because of the shortness of the by-pass and the difficulty with gathering the necessary personnel on a weekend. I estimate the volume of the by-pass to be between approximately 5, 000 and 10,000 gallons of wastewater ( the average flow rate for a three hour time period is 25, 000 gallons) because of the available storage in the gravity system within the mobile home park.
