MINUTES
JUNE 28, 1988
The Wylie City Council met in regular session on Tuesday,
June 28 , 1988 at 7 :00 P.M. in the Council Chambers of the
Municipal Complex . A quorum was present and notice of the
meeting had been posted in the time and manner required by
law. Those present were Mayor Chuck Trimble, Mayor Pro Tem
John Akin, Council Members Ortie Messenger, Marvin Blakey,
Bud Naish, and Chris DiTota, City Manager John Pitstick,
City Secretary Carolyn Jones, Finance Director James
Johnson, Assist . Engineer Ron Homeyer, Chief of Police Royce
Abbott, and Public Works Superintendent Don White.
Councilman Swartz was out of town.
Mayor Trimble called the meeting to order and Councilman
Messenger gave the invocation.
APPROVAL OF MINUTES: The minutes being submitted were for
the June 14th and June 16th meetings. There being no
corrections or additions , a motion was made by Mayor Pro Tem
Akin to approve as submitted . Seconded by Councilman Naish.
The vote was as follows : Mayor Trimble - in favor , Mayor
Pro Tem Akin - in favor, Councilman DiTota - in favor,
Councilman Messenger - in favor, Councilman Blakey - in
favor, and Councilman Naish - in favor. This motion carried
with all in favor.
APPOINTMENT OF BOARD MEMBERS WHOSE TERMS EXPIRE IN JULY,
1988 : There were two members needed for the Park and
Recreation Board . Motion was made by Councilman Naish to
re-appoint Ron Ferguson and to appoint Bill Emsoff .
Seconded by Mayor Pro Tem Akin. There was one member needed
for the Planning and Zoning Commission. Motion was made by
Councilman DiTota to re-appoint Brian Chaney. Seconded by
Councilman Messenger . Two members needed for the
Construction Trade Board. A motion was made to appoint
Kevin Altimier . Seconded by Mayor Pro Tem Akin. Mayor
Trimble called for a vote on all the above motions. The
vote was as follows : Mayor Trimble - in favor , Mayor Pro
Tem Akin - in favor, Councilman DiTota - in favor,
Councilman Messenger - in favor, Councilman Blakey - in
favor, and Councilman Naish - in favor . These motions
carried with all in favor .
APPROVAL OF AGREEMENT FOR MUTUAL FIRE AID WITH THE CITY OF
FAIRVIEW: This is the same type of agreement the City has
with Plano, Murphy, St. Paul , Sachse and other surrounding
cities . Motion was made by Councilman DiTota to approve the
Mutual Fire Aid Agreement with the City of Fairview.
Seconded by Councilman Messenger . The vote was as follows :
Mayor Trimble - in favor , Mayor Pro Tem Akin - in favor,
Councilman DiTota - in favor, Councilman Messenger - in
favor, Councilman Blakey - in favor , and Councilman Naish -
in favor . This motion carried with all in favor .
APPROVAL OF RE-DESIGNATING LUNCH ROOM IN ORDER TO PROVIDE
FOR SMOKING AREA FOR EMPLOYEES: Staff is suggesting the
room adjacent to the Council Chambers and moving the air
purifier from the lunch room to this room. Councilman
Ditota wanted to know the cost of moving the air purifier
instead of purchasing another one. City Manager John
Pitstick said the cost of a new one is approximately $2 ,000 .
and to move the one we have is approximately $220 .00 . Mayor
Pro Tem Akin wanted to know if there was any other cost
involved in re-designating the lunch room. City Manager
John Pitstick said no, the room originally designated as the
lunch room is included in the area that has been closed off
for future growth. The air purifier is the only thing to
move. Motion was made by Councilman DiTota to approve the
re-designating the lunch room in order to provide for a
smoking area for employees. Seconded by Councilman
Messenger . The vote was as follows : Mayor Trimble - in
favor, Mayor Pro Tem Akin - in favor, Councilman DiTota - in
favor, Councilman Blakey - in favor, and Councilman Naish -
in favor . This motion carried with all in favor .
AUTHORIZATION FOR CITY MANAGER TO SIGN LEASE AGREEMENT WITH
THE U. S. GOVERNMENT CENSUS BUREAU: Councilman Naish said
that according to the letter in the packet, the Census
Bureau made an offer prior to the last Council meeting
stating they would pay for the utilities. City Manager John
Pitstick said the letter was brought to him after the last
meeting . City Manager John Pitstick also stated that staff
had talked about $80 .00 per month would cover the utilities
for the area in question (which is the area Lifeline is
using right now) . Motion was made by Councilman Naish to
grant authorization to the City Manager to sign lease
agreement with the U. S. Government Census Bureau. Seconded
by Councilman DiTota. The vote was as follows : Mayor
Trimble - in favor, Mayor Pro Tem Akin - in favor ,
Councilman DiTota - in favor, Councilman Blakey - in favor,
and Councilman Naish - in favor . This motion carried with
all in favor .
APPROVAL OF REQUEST FROM CORP OF ENGINEERS FOR HUNTING AREA
IN THE WOODED AREA ADJACENT TO THE DAM: This area is within
the City Limits of Wylie. Mayor Trimble stated this is due
to the City Ordinance not allowing discharge of fire arms
within the City limits. City Manager John Pitstick said it
will be used in the future for trails and parks , but at the
present time we do not use it . The question came up of who
would be responsible if some one was shot . City Manager
John Pitstick said the Corp. of Engineers . City Manager
John Pitstick said he had checked with the city attorney and
he did not have a problem with this. Mayor Trimble said to
table this item until we had a letter from the attorney
stating who would be responsible in case of a shooting .
APPOINTMENT OF HEALTH OFFICER FOR THE CITY OF WYLIE: Staff
recommends Dr. Ted Trimble . Motion was made by Mayor Pro
Tem Akin to appoint Dr. Ted Trimble as Health Officer for
the City of Wylie. Seconded by Councilman DiTota. The vote
was as follows : Mayor Trimble - in favor, Mayor Pro Tem
Akin - in favor , Councilman DiTota - in favor , Councilman
Messenger - in favor, Councilman Blakey - in favor, and
Councilman Naish - in favor. This motion carried with all
in favor .
DISCUSSION AND APPROVAL OF CHAMBER OF COMMERCE PARADE : City
Manager John Pitstick said there is a letter in your packet
from the Chamber as of this afternoon, there is one change
in this letter. They are requesting to use the area around
the old Police Station for the carnival . City Manager John
Pitstick said there was some concerns about the parade, as
they are requesting to cross Highway 78 . Councilman
Messenger said he spoke with Mr. Joe Wakefield and he will
have six people who have worked the Cottonbowl parade and
after speaking with him, I feel they can handle it . Elaine
Mayes of the Wylie News said that this has been done in the
past and the Chamber would like to include the whole City.
Motion was made by Mayor Pro Tem Akin to approve the parade
route and the carnival location. Seconded by Councilman
Messenger . The vote was as follows : Mayor Trimble - in
favor, Mayor Pro Tem Akin - in favor, Councilman DiTota - in
favor, Councilman Messenger - in favor , Councilman Blakey -
in favor, and Councilman Naish - in favor . This motion
carried with all in favor .
PRESENTATION FROM COLLIN COUNTY HUMAN SOCIETY REGARDING
COUNTY WIDE ANIMAL CONTROL: Jenifer Golden of the Collin
County Human Society stated that this project was started
several months ago. They are trying to pull the County
together and utilize animal control through out the County.
Ms. Golden gave a presentation on other cities budgets
versus what they would pay to Collin County in this joint
animal control project. It was stated by Ms. Golden that
there would be one animal control officer for each area, the
Wylie area consisted of Wylie, Farmersville, Josephine,
Lavon, Nevada, Royse City, St. Paul and Sachse. If Wylie so
chooses to join in this project, you would have an officer
on the streets eight (8) a day for the area your City is in.
After hours is handled as you handle it now. Councilman
Naish wanted to know how many days before euthanatizing the
animals . Ms. Golden said we have no time frame, after the
holding time, it may be three (3 ) days or one Year depending
on how crowded the shelter is. Mayor Pro Tem Akin wanted to
know how much success the City has on adoption of our
animals . Mr . White said if we pick up animals and they are
not claimed in seven (7 ) days , it goes up for adoption
provided we have room, after seven (7) days , we take the
animal to Garland. Before they can reclaim the animal , it
has to have shots, city tag, and fees have to be paid. Mr .
White said we have been very successful . Councilman Blakey
wanted to know the response time to answering a call . Mr .
Kenneth Payne, Animal Control Officer for Wylie, said it
depends on what is going on at the time the call comes in .
Ms. Golden also spoke on a program to spay/neuter animals.
Councilman Naish wanted to know how they were allowed to
spay/neuter. Ms . Golden said they have a contract the
people have to sign giving us permission to.
City Manager John Pitstick said from staffs stand point, we
are currently spending $38 ,000 , receive approximately $5 ,800
on tags and fees. Collin County is going to charge us
$22 ,000 per year, good point is responsibility and liability
would be theirs . Concern staff has is the level of service
we would be getting, our shelter is not in the best of
shape. Collin County would purchase our truck, yet we may
get more problems from citizens on they way this is being
handled . This would be governed by a private board. It
looks good on paper , but I have concern on the level of
service we would be getting. Our area is a large area and I
do not know what kind of response time could be given.
Councilman Naish said in Wylie we have one person, but if he
has this larger area, he maybe in Farmersville when we have
an emergency here. Councilman DiTota wanted to know how
many hours are spent in the shelter . Mr . Kenneth Payne said
two to three hours a day.
Councilman Naish said in case of vacation or he is out sick,
what happens . Mr . White said he has a person in public
works that is trained for backup.
Mayor Pro Tem Akin said if this started next week, we would
be covering all the other cities, what would happen to us .
Councilman Naish wanted to know if Ms . Golden ' s employee was
out, what would she do. Ms . Golden said we have other
employees .
Mayor Pro Tem Akin wanted to know what we collected on fees.
Mr . White said for city tags - $3 .00 , for impoundment
$20 .00 , for adoption $10 .00 . Mr . Payne is currently working
on a spay/neuter program to bring to Council for approval .
City Manager John Pitstick said that Collin County would be
more progressive in enforcing tags and in the news media.
Councilman Messenger wanted to know what would happen to Mr .

Payne. City Manager John Pitstick said he would be offered
a position with us or an offer to go to Collin County. City
Manager John Pitstick said we would save $10 ,000 but what
are we getting in service.
Councilman Messenger wanted to know how much we are talking
about in contributing a preagreed upon fee for the
construction of a central shelter facility at a later date.
Ms. Golden said at this point , we do not know.
Mayor Trimble thanked Ms. Golden for coming out and that
this would be discussed at a later date in a work shop.
Mayor Trimble called for a 10 minute recess .
PUBLIC HEARING ON THE ASSESSMENT OF PROPERTY IN CONNECTION
WITH THE 1988 STREET RECONSTRUCTION PROGRAM - BIRMINGHAM &
STONE STREETS: City Manager John Pitstick stated that some
of you are here for Callie Ct . and Ballard St. , but it will
come in the next couple of meetings . We have done the
assessment on Birmingham and Stone. City Council passed an
ordinance to assess one third to property owners on the
reconstruction of streets . The enhancement to property has
come in less than the assessment except on four properties .
The City will only get back 31% of the cost of the
reconstruction on Birmingham and Stone . Single Family and
Commercial properties will be appraised different. Staff is
recommending we charge the lesser of the two (enhancement or
assessment) . There is a payout plan, you can pay within
thirty days after completion, or you can pay on a one (1 )
year, two (2 ) year , or three (3 ) year time frame and it can
be added to your water bills.
Councilman Naish wanted to know if the citizens have been
told what the difference of black top and concrete was . Mr .
Ron Homeyer said over the hold project we would have saved
$40,000 . Mayor Pro Tem Akin wanted to know when the people
were notified . City Manager John Pitstick said 15 days ago
letters went out with assessment or enhancement figures on
them. Mr. James Johnson said appraiser cost is $10 ,000 . Mr .
Homeyer said the engineering cost was $15,000 on Birmingham
and $10 ,000 on Stone.
Mayor Trimble opened the public hearing and requested each
person wishing to address the Council to come to the front
and to state their name and address for the record.
Mr . Mac Boles - Rt . 2, Box 79C, Nevada - owner of the
property at 409 Birmingham. Why are we being charged for
the street? Where are taxes going? City Manager John
Pitstick said we had several public hearings on if we should
or should not do the streets. Council decided to borrow
$600 ,000 for Streets and to assess the property owners one
third of the cost. Enhancement to property is $3 ,000 . this
would increase the value of your house after the street is
put in. Mr. Boles said this is the first time he had heard
of a City charging the people for a road . Councilman Blakey
wanted to know if this has not been a city ordinance for
some time. Mayor Pro Tem Akin said since about 1964 the
Council decided on the one third policy. Mayor Trimble said
that taxes were not for the construction of streets . Mr .
Boles said we do not want the road to be reconstructed. Why
rebuild when trucks are the ones tearing the streets up.
Councilman Naish said the City had a survey and a large
number of the citizens wanted the streets fixed and to do it
right. Get the seed money and start the street program and
each year add to it . Councilman DiTota said the reason
these two streets are being done is due to the staff reports
on the ones that needed major repairs . Mr . Boles wanted to
know the way we can be billed . City Manager John Pitstick
said you can take up to three years to pay if you so chose,
with 8% interest . Mr . Boles wanted to know why there was

interest . Councilman Naish said that the City borrowed the
money and we are having to pay interest . Mr . Boles wanted
to know if the estimate was based on $28 .00 per square foot.
Mr. Homeyer said no contract price from the bids that came
in. Mr . Boles said were the assessments based on front
footage. Mr . Homeyer said yes . City Manager John Pitstick
said the one third cost of the street is $4 ,600 and the
enhancement is $3 ,000 , you would only pay $3 ,000 . Mr . Boles
said one property owner house is the same as mine and yet he
is paying a lot less than I have to pay. Mayor Pro Tem Akin
said th3ere was an independent appraiser that did these
appraisals. Mr. Boles wanted to know if this area is
planned to be commercial . Mr. Faires said residential with
small area for commercial .
Mrs . Nell Turner, I am speaking for my parents, Mr. & Mrs .
Cecil Bardin, who are on social security and reside at 507
S. Birmingham and receive $600 .00 a month. Their payments
will be $93 .00 per month, is there any way people like this
can be helped. City Manager John Pitstick said there is a
three year payout and at the end of this time if it is not
paid there will be a lien on the property. Mayor Trimble
said we did make an allowance when we did the taxes . We
gave a large discount . Mr. Bardin wanted to know what we
went by. Mayor Trimble said the width of the front . Mr.
Bardin said your letter says 106 ft . and my abstract says 75
feet . Mr . Bardin also wanted to know who gives the City the
authority to take a lien on property. Mayor Trimble said it
is a State Law. Mr . Bardin said if you didn' t know how you
were going to pay the money back, why did you borrow it . I
could not go to the bank to borrow and tell them I did not
know how I was going to pay it back, they would not let me
borrow the money. I think everyone one of you made a fool
of yourselves. Mrs . Turner said when we pay for this will
this be the last time. Mayor Pro Tem Akin said in the past
we have gone door to door to inform the people. Mrs . Turner
stated when the school did their work and the school buses
are what has torn up this street. Mayor Trimble said the
school is paying for their part it is $41 ,685.20 . Mrs .
Turner said you borrowed $600 ,000 . for this, what is the
rest going for. City Manager John Pitstick said the street
reconstruction cost is $451 ,000 . , new water lines on
Birmingham is costing $107 ,000 . and the balance for
engineering cost and several small projects. We are only
collecting 31% and the difference will come from tax money.
The water line that is being put in on Birmingham is not
being charged back to the property owners . Mrs. Turner said
the appraisal on their house has never been over $5 ,000 . and
suddenly it has jumped to $16 ,000.00 , after this is fixed,
then the appraisal will jump up again. City Manager John
Pitstick that the appraisals are done by Central Appraisal
District, and he does not doubt that it has gone up. Mrs .
Turner also wanted to know the difference in the rate that
people are paying, from $6 .00 to $7 .00 that is also because
of the 60/40 and 30/70 . City Manager John Pitstick said
some of that but the majority of that is the actual
enhancement is to the property. The appraisal report shows
if we build this type of street, then this is what it would
add to the value of the house. Mrs . Turner said the main
concern is to give senior citizens a break.
Mrs. Pinkie Bardin owners the property at the corner of
Birmingham and Citizen, stated she was on disability Social
Security and you have borrowed the money and are paying it
back out of taxes. Then we are paying twice.
Mr . Steve Ahrens of 409 N. Gaston said if this is increasing
the property value by 14%, it will increase the tax dollars
also . City Manager John Pitstick said it may or may not,
this is an independent appraiser and Central Appraisal will
do the work for tax purposes. Mr . Ahrens said it is double
indemnity. They pay now and in two years their appraisal
goes up and they pay again. Councilman Messenger said when
you buy a house it has concrete streets and sidewalks and
the builder gets that cost when he sells . They theory is to
do it right and concrete will last 20 years . The survey that
went out, came back with 80% of the people saying we had bad
streets and that was the number one priority. Councilman
DiTota said staff came in with asphalt that would last 10 to
15 years and City was paying for a loan for 20 years , so
Council ask staff to get a 20 year life street. Councilman
Naish said the concrete street has less maintenance, I live
on the west side of town and may drive down Birmingham twice
a year and yet I will be paying for part of this street with
my taxes . We need to start somewhere. Mayor Pro Tem Akin
said that Councilman Messenger made a good point, all the
subdivision now pay for concrete streets and they will be
participating in these streets also . We feel like everyone
will use all the streets . City Manager John Pitstick said
eventually we are going to do all the streets and everyone
will be assessed . Mayor Pro Tem Akin said this $600,00 is
seed money, it means that you use seed money and keep going ,
but we are tying up 70% of our seed money into one project
and a lot of this is going to go into a long payout and we
are not going to be able to keep doing streets .
Mr . Ahrens said are we going to budget more money for
streets . City Manager John Pitstick said yes , and we want
to do more streets and maintenance program on the streets .
Councilman DiTota said I am hearing that everyone thinks all
citizens should be paying but the Council did not feel we
were ready for a full bond program. City Manager John
Pitstick said he is saying to get a five to ten million
dollar bond package and let it be paid for through taxes .
Mayor Pro Tem Akin said we have all paid for these streets,
I live on an asphalt street and we have been patching and
re-patching patches for a long time and it is costing the
tax payers a lot of money. I admire this step but I cannot
support it because of other things.
Rev. Jim Laudell of the First Assembly of God Church, stated
that he wished there were other means of taking care of the
street reconstruction . The school takes the majority of the
road and most of the traffic is from the school not
residents . Rev. Laudell wanted to know if it would be
better for their church to hire their own appraiser and see
what they come back with. City Manager John Pitstick said
if they wanted to they could. Rev. Laudell stated they were
for any improvements in Wylie. To look at these costs in
this time, I would wish for a five year payout instead of a
three year payout . When would this be effective. City
Manager John Pitstick said thirty (30) days after
completion. City Manager John Pitstick said he could check
with the Attorney, but he thought State law sets the three
year payout with 8% interest. Councilman DiTota wanted to
know if the property owners could get a home improvement
loan from the bank with a longer payout . Councilman
Messenger said with a higher interest rate. Mayor Pro Tem
Akin said the City has worked with the bank in the past .
Councilman Messenger said the majority of the Council wants
to work with the people and we are not trying to do
something to shove it down their throats . We are trying to
do for the benefit of everybody, Senior citizens with fixed
income is really valid, I wish our City Attorney was here
tonight . Councilman Naish said we want an active
participation because this is the seed money. Rev. Laudell
said he appreciated knowing that the Council wanted the
property owners to come and give their opinion. I would
appreciate it if you would table this until the attorney is
available.
Mrs . Marge Feivor of 315 Callie Court, our newspaper has
said Callie Court would be on this agenda . We have been
working for years trying to get our road done. I have sit

here listening to people not wanting this road, we have
begged for our road to be done, from Gus Pappas, Mr .
Johnson, to Mr . Pitstick to have our road done. How can
you justify putting in roads where people do not want a road
and we want one and can not get it put in. Mrs . Feivor
said that there were articles in the newspaper that stated
Callie Court would be done as soon as annexation was
obtained. We have been willing to pay our portion of the
road and yet our road is not done. I also have a list of
priority streets - number one on the list is Callie Court .
I have very little time to spend and yet we have spend hours
and hours in meetings to get our road done. How are you
going to do roads for people who do not want and can not
afford to have them done and you have a prime candidate here
who has begged for a road. Thank you.
Mrs . Jackie Faulkner of 900 S. Birmingham, I am financially
unable to pay for this street. I can not do it even over
three years . The speed limit on Birmingham is 30 MPH and no
one goes 30 MPH. If we fix this street how fast will they
drive. I have called the City about this. People drive to
fast and I have been here for nine years and nothing has
been done. City Manager John Pitstick said we have sent the
police out , if Council wishes to instruct me, we will set up
speed traps for this area.
There being no other comments or questions, Mayor Trimble
closed the public hearing.
RESOLUTION ON THE LEVYING OF ASSESSMENT AGAINST ABUTTING
OWNERS OF PROPERTY FOR TH 1988 STREET RECONSTRUCTION PROGRAM
- BIRMINGHAM & STONE: City Manager John Pitstick said that
staff would recommend approving the Resolution and to table
the Ordinance. The Resolution says we will assess the
property owners, the ordinance is the final assessment. We
have to sign the contract for the street reconstruction.
Councilman Messenger wanted to know if we would have time to
give longer payouts. City Manager John Pitstick said yes,
that is in the Ordinance. If we approve the Resolution than
I can sign the contract and begin the construction and come
back with the Ordinance later. Councilman Blakey voiced
concern about the senior citizens . Councilman Naish said he
came to all the public hearings and the people at that time
were in favor of doing these streets. Mayor Pro Tem Akin
said he thinks the problem was we did not give the actual
dollar amount . City Manager John Pitstick said before the
two public hearing staff mailed out two notices plus we
mailed out notices for this public hearing with the amounts .
Motion was made by Councilman DiTota to approve the
Resolution and table the ordinance. Seconded by Councilman
Blakey. The vote was as follows : Mayor Trimble - in favor,
Mayor Pro Tem Akin - against, Councilman DiTota - in favor ,
Councilman Messenger - in favor , Councilman Blakey - in
favor, and Councilman Naish - against. This motion carried
with four (4 ) in favor and two (2 ) against .
APPROVAL OF RESOLUTION REGARDING TAX EXEMPT MUNICIPAL BONDS:
This resolution has been brought before Council at the
request of the State Treasurer, Ann Richards. Motion was

AUTHORIZATION FOR CITY MANAGER TO ENTER INTO A LEASE
AGREEMENT WITH LIFE LINE AMBULANCE FOR THE LEASE OF THE OLD
POLICE STATION: Mayor Pro Tem Akin wanted to know if this
included just the building . City Manager John Pitstick said
yes, no property. Mayor Pro Tem Akin wanted to know if we
are still selling water from this location. City Manager
John Pitstick said no , we are currently using a fire hydrant
behind the new police station. Motion was made by Mayor Pro
Tem Akin to give authorization to the City Manager to enter
into a lease agreement with Life Line Ambulance for the
lease of the old police station. Seconded by Councilman
Messenger . The vote was as follows : Mayor Trimble - in
favor, Mayor Pro Tem Akin - in favor, Councilman DiTota - in
favor, Councilman Messenger - in favor , Councilman Blakey -
in favor , and Councilman Naish - in favor. This motion

APPROVAL OF RESOLUTION AUTHORIZING NORTH TEXAS MUNICIPAL
WATER DISTRICT TO BEGIN ENGINEERING SERVICES AND
CONSTRUCTION OF WASTEWATER COLLECTION SYSTEM IMPROVEMENTS:
Mayor Pro Tem Akin in regards to the connection for Sanden
Inc. , where does this start and end. City Manager John
Pitstick said the initial point of construction would run
from the corner of Sanden under the railroad and Highway 78 ,
but would eventually go to Steel Road . This has to be done
to meet the Texas Water Commission Enforcement Order.
Motion was made by Mayor Pro Tem Akin to approve the
resolution authorizing North Texas Municipal Water District
to begin engineering services and construction of Wastewater
Collection System improvements. Seconded by Councilman
DiTota. The vote was as follows : Mayor Trimble - in favor,
Mayor Pro Tem Akin - in favor , Councilman DiTota - in favor ,
Councilman Messenger - in favor , Councilman Blakey - in
favor , and Councilman Naish - in favor. This motion carried

APPROVAL OF ACCESS EASEMENT FROM MR. MEL DELANEY: This
easement gives access to the gradient monitoring point for
the City of Wylie landfill . This off site well is a
requirement of the Attorney General of Texas . Motion was
made by Mayor Pro Tem Akin to approve the access easement
from Mr . Mel DeLaney. Seconded by Councilman Messenger.

APPROVAL OF TEMPORARY BUILDING FOR SALES OFFICE ON FM 544
BETWEEN THE BLOCKS OF 703 ND 903 FOR SALE OF LANDSCAPING
MATERIALS : City Manager John Pitstick said our ordinances
does not allow for a temporary use for this type of
business . Mr . Cummings is asking for a six (6) month
temporary sales office. Councilman DiTota wanted to know
about the abandoned vehicles on the lot would they be moved.
Councilman DiTota also said that a question came up before
about equipment sitting around. Mayor Pro Tem Akin said the
concern is to keep the lot clean and dressed up. Mr .
Cummings said he has moved all the vehicles to the back.
Mr. Cummings also said the office is 50 feet from the
Highway. Mayor Pro Tem Akin said six months and the you
will move it off . Councilman DiTota said one side was used
for selling trees but if we are going to have sand and
gravel , cross ties, that is my concern. Councilman DiTota
wanted to know if he has a plan that shows where everything
would be. Mr. Cummings said he can move it back as far off
the road as Council wants . Councilman DiTota wanted to know
what it was zoned. Mr . Faires said Industrial . Councilman
Naish wanted to know in his lease agreement was there a
clause to restore the property back like it was . Mr .
Cummings said yes and that a six (6) month lease is all the
owner would give me. Councilman DiTota wanted it in the
record that the vehicles must be set to the back of the area
and not on FM 544 . Motion was made by Mayor Pro Tem Akin to
grant the temporary sales office for six months and that the
vehicles must be set back off FM 544 . Seconded by
Councilman Naish. The vote was as follows : Mayor Trimble -
in favor, Mayor Pro Tem Akin - in favor, Councilman DiTota -
in favor , Councilman Messenger - in favor , Councilman Blakey
- in favor , and Councilman Naish - in favor . This motion

PRESENTATION OF PROPOSED MASTER THOROUGHFARE PLAN: City
Manager John Pitstick stated that this is the proposed
Master Thoroughfare Plan and has been done in house. The
Planning and Zoning Commission has reviewed this and would
like to have a work shop within thirty days with Council and
finalize this plan. Then it would come back for adoption by
ordinance. This plan will show collector streets as well as
thoroughfares. When this has been completed , developers and
builder coming in could then see what our plans are and
where they major streets are. There will be a loop around
the City which will connect Spring Creek Blvd. , Sanden Blvd,
and Alanis. Three big sections of this loop will be built
soon. There is also plans to make Ballard and Jackson one
way streets, Ballard going North and Jackson going South,
and will need to look at closing some of the railroad
crossings. Talking about 100 feet to 150 feet for right-
of-way for thoroughfares. Try to do some of the major
changes at the time the improvements are being done to Hwy.
78 . The Master Thoroughfare Plan sets up the Master Land
Use Plan, it will take about one to one and a half years to
complete both. Mayor Pro Tem Akin said we are long over due
to work with the Planning and Zoning Commission. Councilman
DiTota wanted to know the comments on the one way streets
downtown. City Manager John Pitstick said it has not been
made public yet. It will be and also will have public
hearings on this with all people involved encouraged to come
to the hearings . City Manager John Pitstick thanked Ron
Homeyer and his staff for the work they have done on this
map.
POLICY FOR USE OF COUNCIL CHAMBERS FOR OUTSIDE MEETING
GROUPS: City Manager John Pitstick said this is brought
forward because we are getting request for use of the
Chambers . We have the Community Room that we rent out, the
Women' s League is meeting in the Council Chambers once a
month and the Jaycees are wanting to meet here. The concern
we have here is our board meetings take a lot of nights and
if Council wants special meetings we need the Chambers open.
Councilman Messenger said if it is for the Community, we
should not charge such as the Women' s League. City Manager
John Pitstick said we could set up the Community Room and
not charge for non profit organizations. Mayor Trimble
said we should charge everyone, I am only talking about a
small amount for utilities. City Manager John Pitstick said
staff needs some guide lines for us to follow. Other
concern is we book up meetings for this room, then we do not
have any open nights for work shops . City Manager John
Pitstick said staff would work up rental rates for
electrical and cleaning only.
City Manager John Pitstick said we have a presentation on a
portable boring machine. We are having concrete streets and
we will need to make bores under them, this will be needed.
Mr. Don White said that at the present time there are two
streets that need bores under them and it is going to cost
around $6 ,000 . This machine is approximately $2 ,000 .00 .
Mr . Carlton gave a slide presentation to Council on this
machine.
CITIZEN PARTICIPATION: Mayor Trimble invited anyone wishing
to speak to come forward and state their name and address
for the records. Mayor Trimble also requested that they
keep their comments to two minutes.
Mr. Jim Feivor of 315 Callie Court , what has happened to
Callie Court - the people on our street are ready to go.
City Manager John Pitstick said we want a full blown street .
When the bids come in for Birmingham and Stone, it took most
of the $600 ,000 . We do have perimeter street fees from two
developers for Ballard and we are going to do Ballard and
Callie soon. These two streets will be done faster and
before these other two are finished . Mr . Feivor said he
agrees with the thinking, but what is the time frame. City
Manager John Pitstick said within the next few Council
meetings. The appraisal report should be in next week and
we will have the public hearings. Mr . Feivor said he was
under the impression that Kreymer Lane would be wider . Mr.
Homeyer said in the future Kreymer would be widen. Mr .
Feivor said that there are two house going up right where
the street is to be.
Mr . Mac Boles, when will we be advised of how the the
ordinance for assessment will be. City Manager John
Pitstick said on July 12th the ordinance will be on the
agenda. Mr. Boles wanted to know what the amount of money
would be on the cost of the road . City Manager John
Pitstick said we are signing the contract tomorrow. Mr.
Boles said if we took your specs and got bids it would not
matter . City Manager John Pitstick said the City has
already accepted bids on the streets. There were 6 bidders
on this job.
Mr . Steve Ahrens stated in regards to the Animal Control ,
keep in mind where you will have to go to get your tags .
City Manager John Pitstick said eventually you may have to
go to mcKinney to get the tags.
COUNCIL DISCUSSION: Mayor Trimble said he received a letter
from the Wylie Cemetery Board, they have gone out for bids
to reconstruct the roads within the cemetery. Bidders have
told them if they could have the City Bomag over the streets
it will lower the cost of reconstruction. The City has used
these roads a lot to get in and out of a lift station.
Mayor Pro Tem Akin said this Board was kind enough to let us
use the road . City Manager John Pitstick said if all we
have is labor and equipment - no materials then I would have
no problem. Mr. White said it would be a one day job.
Mayor Trimble said the State Ditch Cleaning Committee is in
town and there was a question of cleaning out Stone and
Briarwood. Mr . White said we had a trade out, use our dump
truck and they would clean up the ditch on Stone. The
property owner said no - do not bother the grass . So the
State backed off. City Manger John Pitstick said we need to
do this job, have the State reschedule this and I will
contact the property owners .
Mayor Pro Tem Akin wanted to know the success of the YMCA
program. City Manager John Pitstick said we have 25 kids.
There is a reception from 9 to 11 on Thursday for senior
citizens . They are also having a swimming program and have
had a lot of participation.
Mayor Pro Tem Akin wanted to know if we changed color
schemes on our police equipment . City Manager John Pitstick
said yes, we went to Blue for a trial period. This is for
introducing 911. Mayor Pro Tem Akin said he feels it should
be brought before Council before you change, there was
Council action to establish the logo.
Mayor Pro Tem Akin said we were still taking water out on
Hooper Road and using the fire equipment to do this. City
Manager John Pitstick said yes, we have an agreement with
North Texas and it appears that with the back flow we will
have to put in, it will be cheaper to extend our 2" line,
Ron is still working with Mr . Rich on this. Mayor Pro Tem
Akin said he thought we were through doing that until he was
told the City was still using that piece of equipment. We

just spent $4 ,000 or $5 ,000 to fix the equipment and I hate
to see equipment used this way. Do we have any other
equipment to use. Mr. White said not in sanitary condition.
Mr . White also stated that the only people that drive that
equipment is personnel from the fire department.
Mayor Pro Tem Akin said on the telephone cost , he would like
to see what the air time cost is and the long distance cost
is.
Mayor Pro Tem Akin wanted to know about the RR crossings on
Brown, they are coming down for trains to pass, but they
will not go back up. Mr . White said yes, they keep
breaking, we call the RR to come out and fix them, but it
doesn' t last .
Mayor Pro Tem Akin said the RR took up part of the track
between Brown and Marble and have left some cross ties , are
we charging them for mowing . Also need to get that RR
crossing moved over on McCreary Road, this has been to long
and no action.
Councilman DiTota wanted to know if North Texas Municipal
Water District has notified the City of any water problems.
City Manager John Pitstick said no.
Councilman Messenger status of complaints on BFI . City
Manager John Pitstick said we met with Mr . Appel an the
performance standards is what BFI is wanting to stay with .
They want to work the problems out . Councilman Messenger
asked Mr. Appel about a person who put out a lawn sprader
and he was at the meeting where you said they would pick it
up. Mr. Appel said what ever is in the contract we will do,
and the contract states the number of pounds and size of
commercial , and special pick ups . Councilman Messenger said
where does this fertilizer sprader fit in. Mr . Appel said
we can pick up what is in the performance standards.
Councilman Messenger said the citizen called BFI and he was
told it was unusual and he would be charged for it. He also
said he had had no calls from the City Manager or BFI . City
Manager John Pitstick said he called BFI and I thought they
would call him. Councilman Naish said some P/R work would
help, where a couple a times a year you would have a clean
up. I said some people have water heaters and Mr. Appel you
said if any two men can pick up the item, then it will be
picked up. Councilman Naish said when I approached the
use of flat bed to pick up over town, I thought you would
work with us. Mr . Appel said what we do for your City
clean up is to only charge what it cost to dump the
containers. I can not give you a yes or no answer , but I
will take it to operations for an answer.
Councilman Messenger said he heard from Mr . Harold Holigan
from Southfork Mobile Home Park and said he wanted the City
to take over the water and sewer lines. City Manager John
Pitstick said we are looking at this , this is a big problem
and some issues have to be solved .
Councilman Messenger said what information has come in from
other cities on a community swimming pool . City Manager
John Pitstick said he will have it soon. Councilman
Messenger said two weeks we should have something going by
now.
Councilman Naish said we discussed Hwy 78 during the work
shop to lower the speed limit from Wyndham Estates through
town. City Manager John Pitstick said we are looking at the
whole city and are bringing it back to Council . We are also
getting information on driving on the shoulder .
Councilman Naish said in the work shop we were interested in
starting a working program instead of assessing fines .

Councilman Naish said that in January I understood we had
$89 ,000 for Safety equipment or pay off the loan. Maybe use
it to purchase some fire equipment . I went to the fire
meeting and they showed me their car and their boats . None
of which I would want to buy. Mr. Johnson said the problem
is there is no call date on the loan and she is wanting the
interest instead of a pay off .
Councilman Naish wanted to know what we had heard from the
Plano Crisis Center. City Manager John Pitstick said it
will be on the budget but they have not contacted us since
we were there. Councilman Naish said their number will be
on the page where the police and fire numbers are in the
phone books , and a local number as soon as it can get done.

LIBRARY BOARD MEETING
MINUTES
JUNE 13, 1988
The Wylie Library Board met in regular session on Monday,
June 13 , 1988 at 6: 30 P .M. in the Rita and Truett Smith
Library. A quorum was present and notice of the meeting had
been posted in the time and manner required by law. Those
present were Chairman Robert Fultz , Board Members Pat
Zimmerman, Betty Stephens, Rita Smith, Carol Barry, Mary Jo
Smith and Judy Lippe, City Manager John Pitstick, Librarian
Kay Daniel .
Chairman Fultz called the meeting to order.
The minutes for April llth and May 9th meetings were
approved .
DISCUSSION OF VOLUNTEER PROGRAM: Librarian Kay Daniel
suggested there be a call list of volunteers to help out
when the ones scheduled to work do not show up. There is a
problem of having volunteers show up every day and on
Tuesday nights.
Betty Stephens wanted to know if there could be more
publicity on the hours for Tuesday night and also news items
about the story hour . A suggestion was made to put a note
in the water bills for more volunteers and the library
hours .
City Manager John Pitstick had some encouraging news about
the Meadows Foundation on the grant we have applied for .
City Manager John Pitstick also asked the Board what
qualifications they wanted in a director . One of the
qualifications was must hold a MLS degree. There was
several names brought up that could fill the position during
the summer months . City Manager John Pitstick also stated
that the Meadows Foundation had suggested a Challenge Grant,
they would match dollar for dollar what we could raise and
also to approach other foundations for help.

Chairman Fultz suggested the Board have other fund raisers .
An ice cream freeze off was suggested, possibly donate spare
pennies to the library with the theme of "Cents makes
Sense" . The Library Board also encouraged a book sale and
continued work on the annual Christmas page.
Chairman Fultz also called another meeting for Monday, June
27th to discuss the Meadows outcome and the fund raisers .

7-8-88 STREET ASSESSMENT ORDINANCE
The street assessment ordinance has been brought back to
City Council for final approval . After discussion with the
City Attorney, he informs us that we have a few options
available to us . Since we have approached the street
assessment program strictly on an enhancement versus an
assessment rate, he recommends that no senior citizen or any
group or individual be given any special consideration which
could leave us open to prejudicial treatment . With that in
mind, we have two basic options. We can extend the payment
period to up to five (5) years and we can waive the simple
interest that is allowed by law.
If we choose one or both of these options we must make it
available to all affected property owners.
Since the street reconstruction program is primarily based
on receiving assessments in order to allow us to continue
with an ongoing street program, staff would recommend that
we keep the three year maximum payout schedule.
Staff has no problems with waiving the interest payment
since it might lead to confusion in the payment schedule and
would not benefit the city with very many funds anyway.
By passing this ordinance you will be levying actual
assessments on abutting property owners for street
improvements. Each property owner would receive a payment
certificate with the first installment due 30 days after
completion and acceptance of the street improvements and
liens will be filed on each property. As each property
retires the assessment, the city will execute a release of
lien on that property. Actual legal enforcement can be
applied as soon as any property owner is late on payments,
however from a practical standpoint I would not recommend
legal action until the full three year payout schedule has
passed.

examined , approved , and adopted by it, all as
required by applicable law; and,
WHEREAS, in compliance with the law, the Engineering
Department for the City of Wylie and the Tax
Assessor/Collector for the City of Wylie, prepared
statements or lists showing the names of property
owners upon said street, the description of their
property, the total cost of said improvements , the
cost thereof per square foot and cost to each
property owner, along with an appriasal report
from the firm of Land and Associates, Professional
Real Estate Appraisers and Consultants , McKinney,
Texas , for and on behalf of the City of Wylie,
Texas prepared statements or lists showing the
names of property owners upon said street, the
description of their property, estimated value
before improvement and estimated value after
improvements and estimated enhancement or damaged
to the property; said statements possessing all
other requisites required by law; and,

WHEREAS, thereafter the said statements were filed with the
City Council and by them examined and approved and
said Council determining the necessity of making
an assessment for part of the cost of said
pavement against property owners and their
property, and fixing a time and providing for a
hearing to such property owners, all in accordance
with the terms of applicable law, at which hearing
said owners were to be heard as to the benefits of
the said improvements to their property, as to any
error or invalidity in said proceedings, or to any
matter or thing connected with the said
improvements; and,
WHEREAS, the City Council did , by quorum vote, set June 28 ,
1988 as the date for the public hearing on said
improvements; and,
WHEREAS, in accordance with the terms of the law, and as
directed by the City Council of the City of Wylie,
Texas, the City Secretary, for and on behalf of
the City of Wylie, Texas, gave notice to the
property owners on said street of said hearing , by
advertisement inserted three (3) times in the
Wylie News , the official newspaper of the City of
Wylie, the first such publication being at least
twenty-one (21 ) days before the date of the
hearing; and did give additional written notice of
the hearing by depositing in the United States
mail , at least fourteen (14) days before the date
of the hearing , written notice of such hearing,
postage prepaid, in an envelope addressed to the
owners of the respective properties abutting said
street, as the names of such owners were shown on
the then current tax rolls of the City of Wylie
and at the addresses so shown; provided, however ,
that any failure of the property owners to receive
said notices shall not invalidate these
proceedings; and
WHEREAS, said hearing was held at the time and place as
advertised, on Tuesday, the 28th day of June, 1988
at 7 : 00 P. M. in the Council Chambers of the
Municipal Complex at 2000 Highway 78 North, Wylie ,
Texas, which hearing was then closed; and,
WHEREAS, at said hearing, all desiring to contest the said
assessments, correct the same, or in any manner be
heard concerning the benefits thereof , or in any
related matter , were heard, and errors and all
matters of error or mistake or inequalities or
other matters requiring rectification which were
called to the attention of the Council were
rectified and corrected;

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1 That the action of the City Council closing the
hearing and overruling the protests where no
change or revision was made by the City Council ,
at the public hearing on the 28th day of June,
1988 , in these proceedings is hereby ratified and
confirmed by this ordinance. That the City
Council , form the evidence, finds that the
assessments herein levied should be made and
levied against the respective parcels of property
abutting upon the streets herein above mentioned
and against the owners thereof ; that such
assessments and charges are right and proper , and
are substantially in proportion to the benefits to
the respective parcels of property by means of the
improvement in the unit or district for which such
assessments are levied, and establish substantial
justice, equality, and uniformity between the
respective owners of the respective properties and
between all parties concerned, considering the
benefits received and burdens imposed. The
Council further finds that in each case, the
abutting property assessed is specially benefited
in enhanced value to the said properties by means
of the said improvements in the unit or district
upon which the particular property abuts, and for
which assessment is levied and charge made, in a
sum in excess of the said assessment and charge
made against the same by this ordinance. The
Council further finds that the apportionment of
the cost of the improvements is in accordance with
the law in force in this City and that the
proceedings of the City heretofore had, with
reference to said improvements, are in all
respects valid and regular .
SECTION 2 There shall be and is hereby levied and assessed
against the parcels of property herein above
mentioned , and against the real and true owners
thereof (whether such owners be correctly named
herein or not) , the sums of money below mentioned
and itemized shown opposite the description of the
respective parcels of property, and the several
amounts assessed against the same, and the owners
thereof , as far as such owners are known, being as
shown in the attached Exhibits "A" and "B" .
SECTION 3 Where more than one person, firm or corporation
owns as interest in any property above described,
each said person, firm or corporation shall be
personally liable only for its , his or her pro
rata of the total assessment against such property
in proportion as its , his or her respective
interest bears to the total ownership of such
property, and its , his or her respective interest
in such property may be released from the
assessment lien upon payment of such proportionate
sum.

SECTION 4 The several sums as mentioned in the attached
Exhibit "A" , Exhibit "B" and assessed against the
said parcels of property and the owners thereof ,
and interest thereon at the rate of eight percent
(8%) simple interest, together with reasonable
attorney' s fees and costs of collection, if
incurred , are hereby declared to be and are made a
lien upon the respective parcels of property
against which the same are assessed , and a
personal liability and charge against the real and
true owners of such property, whether such owners
be named herein or not, and the said liens shall
be and constitute the first enforceable lien and
claim against the property on which such
assessments are levied, and shall be a first and
paramount lien thereon, superior to all other
liens and claims except State, County, School
District and City ad valorem taxes .
The sums are so assessed against the abutting
property and the owners thereof , may be, at the
owners option, paid in full within ninety (90 )
days with no interest accrued, within a twelve
(12) month period, at eight percent (8%) interest
simple interest; within twenty-four (24) months at
eight per cent (8%) interest simple interest or
within thirty-six (36) months at eight percent
(8%) interest simple interest, with interest
accruing from the date of completion of the
improvements . In the case of the owner opting for
the installment plan, the first payment will be
due within thirty (30) days of the completion and
acceptance of the improvements of any particular
unit or district . Any owner shall have the right
to pay the entire assessment , or any installment
thereof , before maturity, by payment of principal
and accrued interest , and further provided that if
default shall be made in the payment of any
installment of principal or interest promptly as
the same matures, then the entire amount of the
assessment upon which such default is made shall ,
at the option of the said City of Wylie, or its
assigns , be and become immediately due and
payable, and shall be collectible, together
with reasonable attorney' s fees and costs of
collection, if incurred .
SECTION 5 That if default be made in the payment of any of
the said sums hereby assessed against said
property owners and their property, collection
thereof shall be enforced either by suit in any
court having jurisdiction or by lien foreclosure.

SECTION 6 That for the purpose of evidencing the several
sums payable by said property owners and the time
and terms of payment, and to aid in the
enforcement thereof , assignable certificates may
be issued by the City of Wylie upon completion and
acceptance of the said work of improvement , which
shall be executed by the Mayor , signing the same
or by his facsimile signature impressed thereon,
attested by the City Secretary, under the impress
of the corporate seal, and shall be payable to the
City of Wylie, or its assigns, which certificate
shall declare the said amounts and the time and
terms of payment thereof , and the said rate of
interest payable thereof , and shall contain the
name of the owner and the description of his
property by Lot or Block Number of front feet
thereof , or such description as may otherwise
identify the same by reference to any other fact ,
and if said property shall be owned by an estate,
then the description thereof as so owned shall be
sufficient.
And the said certificates shall further provide
that if default shall be made in the payment of
any installment of principal or interest thereon,
when due, then at the option of the said City of
Wylie being the owner and holder thereof , the
whole of the said assessment shall at once become
due and payable and shall be collectible with
reasonable attorney' s fees and costs if incurred .
And the said certificates shall further set forth
and evidence the said personal liability of the
owner and the lien upon his premises, and shall
provide that if default shall be made in the
payment thereof , the same may be enforced as above
provided.
And the said certificates shall further recite
that the proceedings with reference to making said
improvements have been regularly held in
compliance with the terms of the applicable law,
and that all pre-requisites to the fixing of the
lien and claims of personal liability evidenced by
such certificates have been performed , which
recitals shall be prima facie evidence of the
facts so recited and no further proof thereof
shall be required.
That the said certificates shall also provide the
amounts payable thereunder shall be paid to the
Director of Finance of the City of Wylie, who
shall credit said payments upon the said
certificates, and shall immediately deposit the
amounts so collected in a special fund, which is
hereby designated as STREET RECONSTRUCTION FUND
and which payments shall be by the Director of
Finance paid to the said City of Wylie or other
holder of the said certificates, on presentation
hereof to him.
And the said certificates shall further provide
that the City of Wylie shall exercise all legal
power , when requested so to do by the holder of
said certificate, to aid in the collection
thereof ; but the City of Wylie shall in nowise be
liable to the holder of said certificates in any
manner for payment of the amount evidenced by the
said certificates or for any costs or expense in
the premises, or for any failure of the said City
Council or any of its officers in connection
therewith.

Full power to make and levy assessments, and to
correct mistakes, errors, invalidities or
irregularities, either in the assessments or in
the certificates issued in evidence thereof , is in
accordance with the law enforce in this City,
vested in the City.
SECTION 7 All assessments levied are a person liability and
charged against the real and true owners of the
premises described , notwithstanding such owners
may not be named, or may be incorrectly named.
SECTION 8 The assessments herein levied are made and levied
under and by virtue of the terms , powers and
provisions of an Act passed at the First Called
Session of the Fortieth Legislature of the state
of Texas, known as Chapter 106 of the Acts of said
Session, with amendments , thereto, now shown as
Article 1105B of Vernon' s Texas Civil Statutes,
which said law has been adopted as an alternative
method for the construction of street improvements
in the City of Wylie, Texas .
SECTION 9 The assessments so levied are for the improvements
in the particular unit or district upon which the
property described abuts, and the assessments for
the improvements in one unit or district are in
nowise related to or connected with the
improvements in any other unit or district, and in
making assessments and in holding said hearing ,
the amounts assessed for improvements in one unit
or district have been in nowise affected by any
fact in anywise connected with the improvements or
the assessments therefore in any other unit or
district .
SECTION 10 That the City Manager , or his designee, is hereby
authorized to execute releases of any paving
assessment liens herein levied and assessed
against the parcels of property and owners
thereof , if same are fully paid, such releases to
be approved as to form by the City Attorney and
attested by the City Secretary.
SECTION 11 If any article, paragraph or subdivision, clause
or provision of this ordinance shall be adjudged
invalid or held unconstitutional , the same shall
not affect the validity of this ordinance as a
whole or any part or provision thereof , other than
the part so decided to be invalid or
unconstitutional .
SECTION 12 This ordinance shall take effect immediately form
and after its adoption as the law in such cases
provides .

July 6, 1988 STATE HIGHWAY 78 SPEED ZONE ORDINANCE
The State Department of Highways and Public Transportation
(SDH&PT) conducted a survey of the speed limits for State
Highway 78 in April , 1985 at the request of the then City
Manager Gus Pappas. The survey indicated the need to reduce
the speed limit in front of the Wylie Community Hospital
from 45 mph to 40 mph. A new draft ordinance was then
prepared and, according to the SDH&PT, was sent to the City
of Wylie for adoption. The ordinance was not presented to
the City Council for adoption and therefore the SDH&PT has
not been able to close their file on the traffic survey.
The SDH&PT requested me to locate the proposed ordinance and
secure its passage by the City Council . I was unable to
locate the ordinance, nor was I able to locate anyone who
knew anything about the ordinance. Therefore, I requested
that I be sent another copy of the ordinance for passage,
which I am forwarding at this time.
Upon review of the said ordinance, I find it to be in order ;
therefore, I recommend it be approved as presented.

AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF
SECTION 169(b) OF ARTICLE 6701 d, VERNON'S TEXAS
CIVIL STATUTES, UPON STATE HIGHWAY NO.
78 OR PARTS THEREOF, WITHIN THE IN-
CORPORATE LIMITS OF THE CITY OF WYLIE
AS SET OUT IN THIS ORDINANCE; AND PROVIDING A
PENALTY OF A FINE NOT TO EXCEED $200,00 FOR THE
VIOLATION OF THIS ORDINANCE.
WHEREAS, Section 169(b) of Article 6701 d, Vernon's Texas Civil
Statutes , provides that whenever the governing body of the City shall determine
upon the basis of an engineering and traffic investigation that any prima facie
speed therein set forth is greater or less than is reasonable or safe under the
conditions found to exist at any intersection or other place or upon any part of
a street or highway within the City, taking into consideration the width and con-
dition of the pavement and other circumstances on such portion of said street or
highway, as well as the usual traffic thereon, said governing body may determine
and declare a reasonable and safe prima facie speed limit thereat or thereon by
the passage of an ordinance, which shall be effective when appropriate signs
giving notice thereof are erected at such intersection or other place or part of
the street or highway; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE , TEXAS:
SECTION 1.
Upon the basis of an engineering and traffic investigation hereto-
fore made as authorized by the provisions of Section 169(b) of Article 6701 d,
Vernon's Texas Civil Statutes, the following prima facie speed limits hereafter
indicated for vehicles are hereby determined and declared to be reasonable and safe;
and such speed limits are hereby fixed at the rate of speed indicated for vehicles
traveling upon the named streets and highways, or parts thereof, described as
follows:
A. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE , TEXAS:
1, That from and after the date of the passage of this speed
speed zone ordinance, no motor vehicle shall be operated
along and upon State Highway No. 78 within the
corporate limits of the City of Wylie in ex-
cess of the speeds now set forth in the following limits:

(a.) Beginning at said point (Station 352+34) being at the South City
Limits of Wylie thence continuing along S.H. 78 in a Northerly
direction for a distance of 1.790 MILES, approximately,. . . a max-
imum speed of 55 MILES PER HOUR;
(b. ) Thence continuing along S.H. 78 in a Northerly direction for a
distance of 1.233 MILES, approximately,. . . a maximum speed of
40 MILES PER HOUR AND
* SCHOOL SPEED LIMIT OF 25 MILES PER HOUR WHEN SO SIGNED!
S.H. 78 NORTHBOUND AND S.H. 78 SOUTHBOUND
25 mph - From Station 484+00 to Station 494+00 a distance of 1,000 feet
(c, ) Thence continuing along S.H. 78 in a Northerly direction for a
distance of 01300 MILE, approximately,. .. a maximum speed of 45 MILES
PER HOUR;
(d. ) Thence continuing along S.H. 78 in a Northerly direction for a
distance of 3.417 MILES, approximately, said point (Station 708+25)
being the North City Limits of Wylie, a maximum speed of 55 MILES PER HOUR.
SECTION 2.
The Mayor of Wylie is hereby authorized
to cause to be erected, appropiate signs indicating such speed zones.
SECTION 3,
Any person violating any of the provisions of this ordin-
ance shall be deemed guilty of a misdemeanor and upon conviction thereof
shall be fined in any sum not to exceed Two Hundred Dollars ($200.00).

July 6, 1988 Easement - B. C. Wood Estate
The City of Wylie secured a temporary Sanitary Sewer Lift
Station Easement in July, 1986 for the construction of the
temporary Sanitary Sewer System which currently serves
Southfork Mobile Home Park. We will renew this easement for
the second time with these documents presented to you at
this time. I recommend that we accept this easement as
presented in order to continue to serve Southfork Mobile
Home Park' s sewer needs. As we make our improvements to our
Sanitary Sewer Collection System as included in the TWC
Enforcement Order we will be able to eliminate this Lift
Station; thereby, stopping the need to continue the renewal
of this easement after the expiration of this instrument .

KNOW ALL MEN BY THESE PRESENT THAT B.C. Wood Estate,
hereafter termed GRANTOR, whether one or several , of the
County of Collin, State of Texas, for and in consideration
of the su■ of three hundred dollars and no cents ($300. 00) ,
and other good and valuable consideration to GRANTOR in hand
paid by the City of Wylie, the receipt and sufficiency of

paid to GRANTOR by the City of Wylie;
(7. ) Property shall be returned to natural grade upon
completion of sanitary sewer line removal ;
(8. ) Travel across the GRANTOR' S property shall be only
during times of emergency, not for daily
maintenance;

BEING a 20 foot wide temporary easement in the 37.03 acre
tract conveyed to B. C. Wood , of which 33. 70 acres is
situated in the Moses Sparks Survey, Abstract No. 849 and
3. 33 acres is situated in the G. W. Gunnell Survey, Abstract
No. 351 of Collin County, Texas as recorded in Volume 332,

Moussa/Switzer Addition

The Moussa/Switzer Addition is presented for final approval
of the Final Plat and acceptance of the dedication of the
water and sewer lines installed to service this addition.
This plat was approved for construction on December 9, 1986 ,
with the construction of the utilities being completed
shortly thereafter . The plat was never filed , nor the
improvements accepted before this time because the
contractor refused to post a maintenance bond and the
developer did not pay all of the fees. The developer has
paid the remaining fee (Perimeter Street Fees) and I
recommend that the maintenance bond be waived due to the
excellent performance of said utilities for 18 months .
Therefore, I recommend that this plat be approved as
presented .

7-8-88 HUNTING AREA AT LAKE LAVON
The Corps of Engineers has realized that the City of Wylie
has annexed a portion of their allowed hunting area in the
wooded area adjacent to the dam. They are requesting that
this area still be allowed for hunting. This would be a
special exception to our current ordinance since we allow no
discharge of firearms within the City.
We have talked with our attorneys and the Corps of
Engineers . According to the Corps they do have some
squirrel and rabbit hunting in the area but only allow
shotguns . This is not a populated area and normally very
few problems arise. To allow continued hunting we would
have to amend our current ordinance to allow hunting in
Corps of Engineer designated areas within the City Limits.
The Corps has stated that they will conform with city
regulations if the city chooses to disallow hunting . The
only real problem that exist is the relationship of the
hunting area to Hwy. 78 .
Our Attorneys and a representative with the Corps of
Engineers will be available Tuesday night .

It has come to my attention that one of our designated
public hunting areas lies within your city limits and that
discharging a firearm is prohibited within the city limits. The
area to which I am referring lies just south of the Lavon Dam
and north of State Highway 78. I have enclosed a hunting map
which indicates where we allow public hunting on the Government
property surrounding Lake Lavon. I have circled the area of
discussion in red.
On behalf of the legitimate sportsmen who have utilized this
area for many years, I request that the City Council consider
amending the City Ordinance which prohibits discharging of
firearms, to exclude designated public hunting areas on
Government lands surrounding Lake Lavon.
I would be pleased to meet with you or the City Council to
provide additional information and to answer any pertinent
questions if it would be helpful .

1988 to conduct appraisal reports for the purpose of

and Callie Ct. have been successfully completed and reviewed
by staff . Recommendation is for approval of payment for

7-8-88 BID FOR MOTOR GRADER
In March of this year the Council authorized the issuance of
$400,000 . Public Property Contractual Obligations, Series
1988 to refund the Bomag equipment debt and pay it off , as
well as, purchase a sewer pump truck. Additional , monies
were set aside in these obligations to purchase a used motor
grader and a new back hoe. Council previously gave
permission to seek bids on the backhoe. Tonight, staff is
seeking authorization to solicit bids for a used motor
grader. Presently, the one the City utilizes is rented . It
would be cheaper in the long run to buy one than continually
have to rent one to solve our public works needs. Rental
can run from $1,000 to several thousand per month. The
Galion the City presently rents is a $2 ,000 . per month item.
It is rented only for the months used, which has been a lot
in the past month or two. The rental agreement expires on
July 31, 1988 . A good piece of equipment of this nature,
given the construction bill and economy, could probably be
purchased in the $30,000 . to $40 ,000 . range. Several motor
graders are available locally and will probably be bid.
Council originally budgeted $35,000 . for this acquisition.

REMARKS: Mrs. Virginia C. Head currently holds the Public Property
(Safety) Certicates-1986 that were issued in the amount of $135,000. The
certificates have a five-year period of maturity. Mrs. Head is not inclined
favorably to surrender the cerificates for pay-off without them being replaced
by a like tax-exempt investment. There would be a small penalty for paying off
the certificates early if surrendered-which they won't. This budget year 87-88
is the second year of the repayment of the dehr(7. 57) This budget year's
debt service is $31,850.00. The certificates are designated and limited to
public safety equipment(fire.. Police. ambulance)_ The current balance of the
Public Safety Fund (including investments) is $89,260. Schedule A (attached)

The two ambulances (used) and the financing costs have been expended.
Council would have to take official action to change the schedule to
purchase another piece of public safety equipment(i.e. fire equipment,
fire boat etc.). You may want to consider holding off on the purchase
of the new ambulance on Schedule A until staff feels more confident of
Lifeline's long-term tenture as we may need to (hopefully not) get
back in the ambulance business. Substituting an ambulance for an
annual subsidy or in lieu of can be done but is not in strict compliance
of the contract certificates Additional discussion advised if Council chooses
to do the annual subsidy this way so as to avoid any possible contract
violations.

REMARKS : A request for a traffic survey on State Highway 78
from Brown St. north to the Wylie City Limit was forwarded
to the State Department of Highways and Public
Transportation ( SDH&PT) by the City of Wylie Engineering
Department on April 8, 1988. The traffic survey was
completed the week of June 27 thru July 1 by the SDH&PT.
The results of the survey show 85% of the traffic traveling
on SH 78 thru the requested zone was at a speed of 54 mph or
greater , thereby substantiating and validating the present
55 mph speed zone. The SDH&PT will not expand their survey
to include all of SH 78 within the City of Wylie at this
time because the current survey indicated that there is
little chance that any of the other speed zones would
require any changes at this time. The SDH&PT also indicated
that State law supersedes all city ordinances in regards to
State roadways within the corporate limits of cities. The
responsibility for installing and maintaining signs also
fall under the SDH&PT' s jurisdiction, thereby making it
impossible for a city to set speed limits on State roadways
at a lower level than the SDH&PT survey indicates.
While talking about SH 78, the SDH&PT indicated that they
are investigating the right turn using the shoulder at the
intersection of SH 78 and FM 544. They will determine if
there is a way to mark the shoulders as right turn lanes and
then post "No Driving on Shoulder" signs back from the turn
lanes. If they are unable to mark the right turn lanes,
then they will post the "No Driving on Shoulder" signs
around the intersection. This will be accomplished sometime
in the near future but they were unable to give a specific
date when it can be done. Once this has been done then we
can resume the enforcement of the State Law which prohibits
the passing on the shoulder, even if you are turning
right.

RE: Speed Zoning in Wylie
Dear Mr. Arnold:
I am in receipt of the traffic survey and ordinance which
was completed in 1985 for State Highway 78. 1 do not have
any problem with the contents of the study and ordinance at
this time for the area in front of the Wylie Community
Hospital , but I would like to request an additional traffic
survey on State Highway 78 from Brown Street north to the
City Limits. I hope that this survey will show a need to
reduce the speed limit from the present 55 mph to 45mph
along the portion of roadway from Eubanks Lane to Kreymer
Lane (CR 389 to CR 432) .

The above referenced intersection. through my observations
has begun to display hazardous and inefficient traffic flow
characteristics. The traffic flow in the northeast
direction of SH 78 is being stagnated by the vehicles which

I would greatly appreciate any changes or improvements in
the signalization of the intersection which would help
improve the efficiency of the traffic flow and reduction of
the hazardous traffic movements. I feel that a left turn
lane needs to be added to SH 78 in both directions through
this intersection along_ with the necessary signalization
changes. I also would recommend that a protected left turn
signal be added to the east bound flow on FM 544.

I have observed. If there any interim solutions to
alleviate the traffic congestion at the intersection. the
City of wylie is wholly in favor of this implementation.

Dear Mr. Homeyer:
Reference is made to your letter dated August 31, 1987, concerning traffic
conditions on S.H. 78 at the intersection of S.H. 78 and F.M. 544.
We are developing a preliminary design schematic for capacity improvements to
S.H. 78 which includes the City of Wylie. The capacity improvements to S.H. 78
are authorized through the Department's "10-Year Project Development Plan (PDP)".
This District's current authority within the City of Wylie is to develop a design
schematic to convert the current 2-lane undivided roadway to a 4-lane divided
highway.
The capacity improvements to S.H. 78 authorized by the Department's PDP is
included in the "4-Year Letting Schedule (for September 1987 through August
1991)". The 4-Year Letting Schedule is approved for acquisition of right-of-
way and construction. The projected letting date is 1989.
At this time we do not have available a program of work in which your proposed
improvements could be financed. However, we will investigate the signal phasing
and timing and make any adjustments which will improve traffic flaw and safety.
We would have no objection to the City of Wylie making the improvements you pro-
posed at no cost to the State. If the city desires to pursue this work, please
furnish us with proposed plans for review and approval.
