SECTION 4 The City of Wylie shall have a lien on all taxable property located in the City of Wylie to secure the payment of taxes, penalty interest, and all costs of collection, assessed, and levied hereby. SECTION 5 Taxes are payable in Wylie, Texas at the Office of the Tax-Assessor Collector , Finance Department , Municipal Complex . The City shall have available all the rights and remedies provided by law for the enforcement of the collection of taxes levied under this ordinance. SECTION 6 That the tax roll presented to the City Council , together with any supplements thereto, be and same are hereby accepted . (See attachment A - effective Rate for 1988 - Item 15 ) SECTION 7 In the event any provision of this Ordinance shall be held unconstitutional and invalid by a court of competent jurisdiction, the same shall not affect the remaining provisions thereof . SECTION 8 All Ordinances and part thereof in conflict with any of the provisions of this Ordinance are hereby expressively repealed . AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR BEGINNING OCTOBER 1 , 1988, AND ENDING SEPTEMBER 30, 1989 , IN ACCORDANCE WITH THE CHARTER OF THE CITY OF WYLIE, APPROPRIATING THE VARIOUS AMOUNTS THEREOF, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR A PUBLIC HEARING; PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND FOR AN EFFECTIVE DATE THEREOF: WHEREAS, the City Manager of the City of Wylie has submitted to the City Council a proposed budget of the revenues of said City and the expenditures/expenses of conducting the affairs thereof and providing a financial plan for 1988-89 and which said proposed budget has been complied from detailed information obtained from the several departments, divisions, and offices of the City; and, WHEREAS, the City Council has received said City Manager' s proposed budget , a copy of which proposed budget and all supporting schedules have been filed with the City Secretary of the City of Wylie. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1 That the proposed budget of the revenue of the City of Wylie and the Expenses of conducting the affairs thereof , providing a complete financial plan for the ensuing fiscal year beginning October 1 , 1988 and ending September 30 , 1989 , as submitted to the City Council by the City Manager of said City, be and the same is in all things adopted and approved as the budget of all current expenditures/expenses as well as fixed charges against said City for the fiscal year beginning October 1 , 1988 and ending September 30 , 1989 . SECTION 2 That the sum of $2 ,057 ,000 . is hereby appropriated out of the General Fund for the payment of operation expenditures and capital outlay of the City Government as established in the approved Budget Document. SECTION 3 That the sum of $408 ,000 . is hereby appropriated out of the General Obligation Debt Service (I & S) Fund for the purpose of paying the principal and interest due on General Obligation Bonds and capital lease purchases as they mature and creating a sinking fund therefor . SECTION 4 That the sum of $1 ,305 ,000 . is hereby appropriated out of the water and sewer revenues for the purpose of paying operating expenses and capital outlay for the operation thereof as established in the approved Budget Document . SECTION 5 That the sum of $475,000 . is hereby appropriated out of the Water and Sewer Revenue Debt Fund (I & S) for the purpose of paying interest and principal requirements on water and sewer revenue bonds. 3 SECTION 6 That the sum of $275 ,000 . is hereby appropriated out of the Sanitation Operating Fund for the purpose of paying operating expenses and capital outlay for the operation thereof as established in the approved Budget Document. SECTION 7 That the sum of $45,000 . is hereby appropriated out of the Utility Impact Fund for operating expenses and other purposes as established in the approved Budget Document. SECTION 8 That the sum of $540 ,000 . is appropriated out of remaining 1988 Certificates of Obligation Bond Fund for capital improvements related to the 1988 Street Improvement Projects (Street Reconstruction Fund) and Landfill Improvements (Landfill Fund) . SECTION 9 That the sum of $40 ,000 . is hereby appropriated out of the Utility Lift Station Fund for the purposes of paying operating expenses and other purposes as established in the approved Budget Document. SECTION 10 That the sum of $30 ,000 . is hereby appropriated out of the available funds from the Public Safety Equipment Fund for purchase of one Fire Support Vehicle, one Fire Rescue Boat and new Hydraulic Air Bag Rescue System. SECTION 11 That specific authority is hereby given to the City Manager to transfer appropriations budgeted from one account classification or activity to another within any individual department or activity; and, to transfer appropriations from designated appropriations to any individual department or activity as provided in the City Charter . SECTION 12 That ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 13 That this ordinance shall be and remain in full force and effect from and after its final passage and publication as here in provided . SECTION 14 That a public meeting beheld before the City Council as a Committee as a whole, on September 27 , 1988 , and that due notice of said public hearing was published one time in a newspaper having general circulation in the City of Wylie; this ordinance shall be published in a newspaper having general circulation in the City of Wylie. The following monthly water rates shall apply to all customers within the corporate limits of the City of Wylie, Texas. Monthly minimum charge (first 1,000 gallons of $ 6.50 metered water consumption) Volume charge for all consumption exceeding 1,000 gallons per month (per 1,000 gallons) : 1,001 to 2,000 gallons 1.82 Over 2,000 gallons 2.40 Sewage Collection and Treatment Rates a. The following monthly sewage collection and treatment rates shall apply to all residential customers of the City of Wylie, Texas with a maximum charge of $ 23.80 per month. Monthly minimum charge (first 1,000 gallons of $ 7.00 metered water consumption) Volume charge for all consumption exceeding 1,000 1.20 gallons per month (per 1,000 gallons) b. A $ 14.00 minimum monthly sewage collection and treat- ment charge for non-residential customers shall be in accordance with the above schedule, but with no maxi- mum. Any industrial waste surcharge shall be in addition to the above schedule and in accordance with the details of the Industrial Waste Ordinance. c. Sewer Fee - A sewer fee of $ 13.00 shall be charged for each apartment unit, multiple family unit or occupied mobile home space and special areas such as washaterias, swimming pools, etc. where the apartment, multiple family development or mobile home park is on a master meter with the City of Wylie. A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor Chuck Trimble (arrived late) , Council Members Ortie Messenger , Jim Swartz , Bud Naish, Chris DiTota and Marvin Blakey, City Manager John Pitstick, City Secretary Carolyn Jones, Assist . City Engineer Ron Homeyer , Code Enforcement Officer Roy Faires, Public Works Superintendent Don White, Mr. Harold Holigan from Southfork Mobile Home Park. Councilman DiTota called the meeting to order as Mayor Trimble called that he would be late. Councilman Naish gave the invocation. PRELIMINARY AND FINAL PLATS FOR WYLIE SHOPPING VILLAGE: City Manager John Pitstick said that Brookshire did not know there was a meeting tonight nor did they know they were on the agenda . They would like to be here to talk with Council when this plat is presented. Mr . Dwight Scott, owner of this property, has called and requested the preliminary and final plat be pulled from the agenda. PRESENTATION ON THE ACCEPTANCE OF THE WATER AND SEWER LINES AT SOUTHFORK MOBILE HOME PARK: City Manager John Pitstick said this is a special meeting to let Mr. Holigan present his request to Council on water/sewer lines in the Southfork Mobile Home Park to be dedicated to the City. There have been several meetings between staff and Mr. Holigan. There was a written agreement and each of you have received a copy of this agreement . In this agreement under "EXTENSION OF LINES. Southfork agrees to pay for the extension of the City' s water and sewer lines ("the Facilities") from their current location near the Property to the Property and such Facilities will have sufficient capacity to serve the property for the uses and density stated herein and any intervening property; " and under "WATER AND SEWER SERVICE the City agrees to provide to the property water and sewer service as needed to serve up to 750 mobile homes which are planned for a mobile home park to be developed by Southfork on the property. Provided, however, nothing herein shall obligate the City to construct the interior water and sewer lines needed in order to distribute the water to each mobile home and structure within the mobile home park on the Property or any lines related to the disposal of the wastewater as part of a sewer collection system lines for the waste disposal system and water distribution lines on the property shall be constructed in accordance with Texas Department of Health rules and regulations , as well as any and all other rules and regulations as set by the City" . Councilman Naish stated that the city collected impact and lift station district fees, why is it not like a subdivision . City Manager John Pitstick said it is a one lot subdivision, the plat that is filed with the County for mobile home parks has only one lot on it . Mr. Holigan made the comment that he could turn on a fire hydrant and run water all day at no cost to him. City Manager John Pitstick said that is why staff prefers a master meter . Mr. Holigan said there was an easement for water and sewer . City Manager John Pitstick said the easement was not dedicated to the City. Mr . Holigan said the lines are his 8 but the water is the City' s . Mr . Holigan also stated that he has to pay for re-engineering of the water and sewer lines because the City wanted them different in order to maintain them. The attorneys , newspaper and myself (Mr . Holigan) feels this is clean about the water and sewer lines. Mayor Trimble asked why the City was taking over this responsibility. Mr . Holigan said the City came to him, he did not come to the City, he said he already had a permit from the State to put in a sewer treatment plant . Mr . Holigan said when the water was turned on, it only came part way to the park and we had to get gasoline pumps to run the water up to the park. Councilman DiTota wanted to know why he did not come to the City Council before now. I see no where that it says the City owns the lines. City Manager John Pitstick said the agreement came about because this park had already started construction. In this ten (10) foot easement there is water, sewer and electrical lines . Staff would have to ask for a fifteen (15) foot easement if we accept the water lines . Councilman Blakey wanted to know who inspected the lines. Mr . Don White, Public Works Superintendent, said he inspected some of the lines, but some of the lines were already in the ground. Mr . White said he had just started with the City, the lines that were being installed after I arrived, some were inspected, there was a conflict between the city staff and some days I was told to inspect and some days I was told to stay away. The quality of work was very good. Mr . I . W. Santry, City Engineer at the time, told me not to go because he did not approve these specifications. Mr . Bill Windham, Public Works Director at the time, would tell me to go and inspect . City Manager John Pitstick said he had no complaint about the way the lines were put in, my problem is the easement needs to be wider . Mr. Holigan said our meeting a year ago was with James Johnson, Don White and Bill from Southfork and myself . It was our understanding that the City would take over the lines. Mr. Homeyer called later and said the City would not accept these lines. City Manager John Pitstick said the problem is a plat has never been filed . Mr. Holigan wants to file a plat and dedicate the easements and lines for the City to maintain. Councilman DiTota asked if the water line breaks and caves in the street, couldn' t the City be liable for damages . Mayor Trimble said if it is negligence on the City' s part we would be liable. City Manager John Pitstick said if there is a leak and we have to tear up the street, we have to repair the street . Councilman DiTota wanted to know if the City accepted the lines in Glenn Knoll Mobile Home Park or the other parks . City Manager John Pitstick said no, we do not own any of the lines in the other mobile home parks . Mayor Trimble asked Mr . Holigan why the City wanted to annex him. Mr . Holigan said to keep a wastewater treatment plant from dumping into Muddy Creek and flowing through your City. When the Texas Water Commission said that we had the permit to build the plant, Gus Pappas offered water and sewer to our area if we would annex into the City of Wylie. Mr . Holigan said we did not come back to the City Council because we felt the City would do what they said they would do. Councilman Swartz said, Mr. Holigan you said there was a meeting a year ago where Mr . Don White was present and they agreed to accept the lines. Councilman DiTota wanted to know who said they would accept the lines . Mr . Don White said that James Johnson, Ron Homeyer and Bill from Southfork and Don were present at the meeting. Mr . White said he inspected part of the lines but was not sold on accepting the lines. I can not deny the fact that the lines were installed properly. Councilman Swartz said some where down the line the City has responsibility. Councilman DiTota said that the park was built and completed prior to being annexed. Councilman Naish said that he talked with Mayor Pro Tem John Akin and one thing that was brought to his attention was that when the City was low on money, Roy and James went to Mr . Holigan and asked him to pay for the last 100 lots in advance. Mayor Trimble said he should have paid for all the lots at one time. Mr . Holigan said he was willing to take whatever vote the Council takes. Councilman Blakey wanted to know what happens when Finholt comes in and wants us to take their lines . Mayor Trimble said the same thing because we made them put in the lines in accordance with our specs . Mayor Trimble said we need to have Mayor Pro Tem Akin present. Mr. Holigan said he had a meeting with Elaine and Linda from the Wylie News and they are in agreement with Southfork. Mayor Trimble said to call another meeting when Mayor Pro Tem Akin was back and when Mr . Holigan could be present. There being no other discussions, a motion was made to adjourn with all in favor. A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor Chuck Trimble, Council Members Orite Messenger , Bud Naish, Jim Swartz, and Marvin Blakey, City Manager John Pitstick, City Secretary Carolyn Jones , Finance Director James Johnson, Public Works Superintendent Don White and Assist. Engineer Ron Homeyer . Mayor Pro Tem John Akin and Councilman Chris DiTota were absent. Mayor Trimble called the meeting to order and Carolyn Jones gave the invocation. DISCUSSION OF PROPOSED 88/89 GENERAL FUND BUDGET: Councilman Messenger wanted to look at moving the monies for striping the police cars to producing the news letter . Also wanted to look at three positions, Garage, Warehouse and Purchasing Agent , and to keep at least a minimum in the Council Reserve. James Johnson stated the Warehouseman is in charge of all inventory in the warehouse, of checking in and out merchandise and equipment. This person also goes for parts for the public works crews. Rain gear and small tools are checked in and out daily. City Manager John Pitstick said that staff would get a job description for the warehouseman and bring back to Council . Councilman Messenger feels that each department head should be able to purchase for their own department and therefore eliminate the purchasing agent. James Johnson said in centralized purchasing, you have more control . The purchasing agent has to have the purchase order approved prior to ordering. James Johnson said when he wrote the purchasing manual , it was to control the buying and getting estimates prior to purchasing. If department heads do purchasing it is not controlled and is bad. Councilman Messenger said department heads should be responsible enough to purchase for their departments. Mayor Trimble said need to look at allocating payroll to the right department for the City Manager and Finance Director. REIMBURSEMENT OF TRAVEL FOR CITY EMPLOYEES: City Manager John Pitstick said not all City' s provide cars for department heads. City Managers are paid a car allowance. Actual cost per year for City car - 12,000 miles is $4 ,600 , if given car allowance of $250 .00 - $3 ,000 .00 . Reimbursement at $.225 would be $2,700 .00 . City Manager John Pitstick said staff recommends City Manager, Public Works Superintendent, Engineer, and Code Enforcement to get car allowance and keep a pool car for Finance Director and City Secretary and others . // VEHICLE MAINTENANCE DEPARTMENT: Don White stated the justification for the fleet maintenance to stay in house is the labor cost. The labor rate is a lot less than if sent out side of our office. We buy parts on wholesale prices, if sent out for repairs , would pay retail prices for parts . Mr . White gave the Council a list of repairs that had been done on City vehicles and what the City has paid versus what it would have cost if sent out . The salary for the mechanic with benefits is $19 ,000 .00 per year. Mr . White also stated that General Motors offers certification courses free to municipalities and the mechanic is going to these classes . Councilman Naish wanted to know if he worked a swing or grave yard shift would this be better in having the vehicles available for maintenance. Councilman Messenger said if you add up all the repairs on all vehicles in the City, why is it costing so much for outside services and why so much on tires. James Johnson said right front tires will wear out first on the police cars. Mr. Johnson said the City buys tires wholesale and they are mounted and balanced. This is through a contract with City of Plano. Mr . White said we send out transmission and front end work. We do not have equipment for this type of heavy repair in house. Councilman Swartz wanted to know if the cars were getting into the garage on a timely basis. Mr . Mike Stone, mechanic, said if they would bring them in when they are suppose to and being able to get the parts , would help. Councilman Blakey asked about abuse to vehicles. Mr . Stone said if he feels a vehicle has been abused, I will report it to Mr . White. Mr . White said he would like to keep the program a least one more year in order to get a better feel of the program. Councilman Blakey wanted to know if we were making the employees aware of taking care of the their vehicles. CONTRACT TAX COLLECTING SERVICES FOR 1988 : James Johnson said he talked with Ken Maun and they would do the City Tax Roll Billing and would provide some maintenance service, the charge for this would be $ .75 per account. Mr . Johnson said he asked if they collect Monday - Friday and wire monies to entity next week. They do not pay any interest on these collections , and we could loose about $800 .00 from interest . City would loose control . Until the roll is clean, we have to do some tax services from here as well . Mr . Johnson said there should be a contract with the County if Council decides to do this. Mayor Trimble said he had a contract plus the State Law on this that the City could use. Mr. Johnson said from personal standpoint, I would recommend City/School joint collection system. Mr . Johnson said the issue he is concerned with is the cash flow control and access to the delinquent accounts . Mayor said to go ahead and look in to this further . Mr. Johnson did state after being asked, that this collection by County would free up one employee to be in just Finance and illuminate one tax clerk. /o- DISCUSSION OF 1988/89 PROPOSED WATER AND SEWER FUND BUDGET: The following have been proposed as revenues for the Water and Sewer Fund Budget: Water Sales $775 , 000 . Binford to base the growth rate on the water and sewer rate study at zero. The following is the expenditures budgeted for the Utility Fund: Department 501 - Administration total budget of $148 ,250 . with two employees Department 502 - Water total budget of $533 , 500 . with four employees Department 503 - Sewer total budget of $604 , 250 . with three employees Department 520 - Utility Billing total budget of $180 ,000 . five employees Department 515 - Debt Service total budget of $153 ,000 Department 520 - Building Services - Municipal Complex total budget of $ 14 ,500 . Department 521 - Building Services - Public Works total budget of $25 , 500 . This is the preliminary budget for Utility Funds , between now and the next meeting staff will get both General and Utility Funds balanced. A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Chairman Robert Fultz , Board Members Rita Smith, Mary Jo Smith, Judy Lippe, Betty Stephens , and Pat Zimmerman, City Manager John Pitstick, and Library Director Patricia Kralisz. Library Board Member Carol Barry and Library Aide Kay Daniel were absent. Chairman Fultz called the meeting to order. Board members discussed their progress in searching for contributions to match the Meadows Grant . Chairman Fultz has made contact with Texas Instruments and Holland Hitch. Judy Lippe has contacted GTE and Rockwell and each corporation has requested more information. Mary Jo Smith received checks from Wylie Insurance, State Farm and an individual donor for a total of $225 .00 . Rita Smith has contacted First State Bank, TU Electric, Hardcast and the Sachse Bank. All board members will continue to make contacts at all anticipated levels of donation. Patricia Kralisz reported that she was pursuing other potential foundations . She stated that she had conducted preliminary interviews with three candidates for the position of Library Director. Mrs . Kralisz said that in order to offer the position the Meadows monies had to be matched for a candidate to consider moving to Wylie. The hiring for this position will be delayed until the money is found. Mrs . Kralisz explained that despite the December 1 , 1988 Meadows deadline for collecting the matching funds, on October 1, 1988 there would be money enough for only one paid staff member and a core of volunteers that has not been able to cover a large number of hours . Mrs. Kralisz further stated that unless the money is found quickly, the opportunity to work with the new Director will be lost and the report of assessment on the state of the library would quickly become obsolete. The Library Board Members promised to seek all possible revenue sources. The next meeting of the Board will be on Monday, September 12 , 1988 . APPROVAL OF MINUTES: Bart Peddicord corrected the minutes of the August 15 , 1988 meeting as follows: first page, last paragraph , second line should be idea not ideal . Second page, second paragraph, second line, City Manager John Pitstick said dedication of half of the street- to continue with, " would be sufficient" . On the last page third paragraph , third sentence insert "the county bond election" after the word since and take out the word it . Also Mrs . Wood said in the first item, approval of minutes she did not say she wanted to correct the voting to not show a number for and name a person who voted against . She stated that she wanted it to say, "She wanted consistency and continuity in the voting when typing the minutes" . CONDUCT PUBLIC HEARING ON THE REZONING OF LOT 3 BLOCK 35 RAILROAD ADDITION: The piece of property is a triangular piece property and the staff was concerned with the shape. Mr . Faires stated that he and the Engineer Ron Homeyer went over the plans for the building and it would be a tight fit but it would fit . City Manger John Pitstick stated that in the future we will be getting a lot of requests and pressures for B-1 zonings , and that was something he wanted P&Z to consider when making a decision on this request . Mr . Chapman of 311 Woodhollow Circle Wylie , Texas was present to speak in behalf of the request . Mr . Chapman owns the property. He stated that three years ago there was a blanket zoning on the property which zoned it retail . He felt the only way he could utilize the property at this time was to re-zone it B-1 . He stated it would be much appreciated if the request was granted . Mr . Mitchler of 309 Highland Dr . Rockwall , Texas who is purchasing the property was present and stated that the business he wanted to put there was a quick oil change operation. He intended to make the appearance of the building attractive with landscaping and an old fashion country look . Mr . Chaney asked him if he was aware that Hwy 78 would be widened and if he would be willing to dedicate 20 feet R.O.W. to the City. Mr . Mitchler replied that he was not willing to dedicate the property at this time because of the uncertainity of the state completing the job, however he is aware that the possibility will cause a difference in his set back requirements . After some discussion Chairman Chaney closed the Public Hearing . CONSIDER APPROVAL OF RECOMMENDATION TO CITY COUNCIL ON THE REZONING OF LOT 3 BLOCK 35 FROM RETAIL TO B-1 : Mr . Chaney made a motion to recommend to City Council the rezoning of lot 3 block 35 from retail to B-1 . Seconded by Mr . Peddicord . The motion passed with three in favor and three against . CONDUCT PUBLIC HEARING ON REZONING 95 .49 ACRES ABSTRACT 841 FROM AGRICULTURE TO INDUSTRIAL: The staff stated that this is presently Sandens property and they are building on it at this time. The staff stated that this is being brought before the Planning and Zoning Board due to the fact that it has not been officially zoned industrial and a hearing is needed to re-zone this property. After some discussion the public hearing was closed. CONSIDER APPROVAL OF RECOMMENDATION TO CITY COUNCIL ON THE REZONING OF 95 .49 ACRES ABSTRACT 841 FROM AGRICULTURE TO INDUSTRIAL: Mr . Peddicord made a motion to recommend to City Council the rezoning of 95 . 49 acres out of Abstract 841 from Agriculture to Industrial . Seconded by Mrs . Wood. The motion carried with all in favor . CONSIDER RECOMMENDATION TO CITY COUNCIL OF PRELIMINARY PLAT FOR SMITH ESTATES: This plat was presented once before to the Planning and Zoning on July 18 , 1988 . The City Council denied the plat for various reasons . After some discussion Mr . Jeffries made a motion to accept the preliminary plat for the Smith Estates with the stipulations that it meet full sub- division requirements now set up by the City. Seconded by Mr . Stovall . The motion carried with in all favor . CONSIDER RECOMMENDATION TO THE CITY COUNCIL FOR APPROVAL OF FINAL PLAT TWIN LAKES PHASE II : There were some corrections to be made on the preliminary plat . The corrections were made and the final plat is ready for approval . After some discussion Mrs . Wood made a motion to recommend to the City Council the approval of the final plat for Twin Lakes Phase II . Seconded by Mr . Pritzkau . The motion carried with all in favor . DISCUSSION OF MASTER USE PLAN: Mr . Pitstick presented a map showing existing zoning in the South-West quadrant of the City, he then presented the percentages of acres in the respective zoning categories in the City. Mr . Pitstick stated that there is no " ideal City" however , these percentages in the existing City seem to be fairly balanced between the different categories. He suggested that the Planning and Zoning Commission could possibly wish to consider some other use for land that has not yet been annexed , than that which has been previously land use planned for that property. The presentation closed with Mr . Pitstick suggesting that the commission take the map home and study it , also that they should possibly drive by and look at the properties in question to see how the land could best be utilized in the minds of the individual commission members , for action at a future date. AN ORDINANCE OF THE CITY OF WYLIE, TEXAS AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO 81-5) , TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICA- TION HEREIN STATED; PROVIDING A REPEALING CLAUSE ; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED ($200 .00 ) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the City Council of the City of Wylie, Texas , in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that the said change of zoning which is on application of William Chapman & Jayne Chapman should be granted and the Comprehensive Zoning Ordinance of the City of Wylie should be amended in the exercise of its legislative discretion: NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE , TEXAS: SECTION 1 .That the Comprehensive Zoning Ordinance of the City of Wylie, Texas , be and the same is hereby amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described property a new zoning district classification to-wit : BUSINESS ONE (B-1) Said property being described as follows : Lot 3, Block 35, Railroad Addition SECTION 2 .That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect . SECTION 3 .That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional , illegal or invlaid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5.That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended , and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars (S200 .00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6 . It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest , comfort and general welfare fo the City. Therefore, this ordinance shall take effect immediately from and after its passage, as the law in such cases provides. The City of Wylie Subdivision Regulations, Revised Edition, June 11, 1985, describes all of the improvements associated with property subdivision. My interpretation of the requirements are as follows: 1. Preliminary Plat (Section 4.03) - shall be submitted on a sheet not to exceed 24" X 36" and the scale shall not exceed 1" = 100' ; shall show all existing and proposed features and facilities. Meets requirements. 2. Lots (Section 5.03) - all lots shall face onto a public street. Meets requirements. 3. Streets (Section 5.01) - all streets shall conform to general plan for community, including access to adjacent properties where required. Meets requirements without any proposed streets because all of lots have access to a public street and the property north of this subdivision is government land, which does not require access. 4. Water System (Section 6.06) - systems shall have sufficient number of service outlets and shall be of sufficient size to furnish fire protection to all lots. Does not meet requirements as far as fire protection because existing distribution line is 4" nominal diameter (ordinance requires 6" nominal diameter minimum) . 5. Sanitary Sewer (Section 6.07) - subdivider shall pay cost of sewer improvements, including allnecessary off-site improvements. Does not comply; there is no plan for sanitary sewer service, other than septic tanks and drainfields according to County requirements. Based upon these interpretations, I recommend that this preliminary plat be approved for preparation of final plat, contingent upon the submission of utility plan for servicing this subdivision with water and sewer systems which comply with City of Wylie standards. The existing pump that sits atop the old well is probably 40-50 years old and is 30 H.P. General Pump. It ' s last known usage was in the 1956-57 era. This was about the time the City converted to surface water through NTMWD. TWC requirements are such that a professional water well company should be employed to do this work. Property records indicate that the city of Wylie is the landowner of the subject property. Abandoned wells not only serve as conduits or channels for contamination to reach ground water but these wells can also be a hazard to human and animal life. As the property owner, you are responsible for plugging or properly capping the abandoned well as stated in the Water Well Drillers Act and in 31 TAC 287.48 and 287.49. If you choose to plug the well and the well has no cement behind casing, then the casing must be removed and a cement plug extended from land surface to a depth of not less than ten (10) feet. Within thirty (30) days of plugging the well , a report must be filed with the Commission on forms supplied by the TWC Drillers Board Assistance Program. After receiving Bill Klemt's letter of December 4, 1987, I contacted several companies that have experience in plugging abandoned water wells and that are familiar with the applicable statutes, rules and regulations governing this process. The City received a formal written estimate and an oral one that projected the costs for this plugging to be in the $7,000 to $8,000 range. At this level of projected expenditure, the matter would be subject to competitive bidding per the City Charter. Consequently, the staff will be forwarding a report to the Council for a reallocation of funds for this project from current budgeted funds and authorization to seek bids on plugging the well. If City Council remembers this was after the budget was approved and just before the tax rollback election so therefore we had not budgeted any funds for this. We did go out for bids on capping this well in February and opened bids on March 1 , 1988 . The low bid was Layne Texas Co. for $6 ,750 .00 . Since that time there has been some discussion regarding making the area an historical marker . Evidently since no formal action has been taken the City of Wylie has been called to a preliminary hearing in Austin on Thursday, July 7 , 1988 at 9 : 30 A.M. regarding our failure to properly cap the abandoned water well . I plan on attending that meeting and request that the Water Well Drillers Board give us until the next budget year to cap the well . I feel confident that they will probably require it to be capped by November, 1988 . This item came up in the middle of the budget year and frankly it is a concern since we don ' t have $6 ,750 . in extra funds . I think it is important to try to accommodate the Texas Water Commission as best we can because of the problems we have had in the past. Under normal circumstances we would probably get more time but since Wylie does not have a good record for responding to the Texas Water Commission we don' t receive much slack. I have talked to the Austin office and they feel if we plan to get any leeway on this item it is important to have someone there to explain our situation. The Data Plate is missing however it is evidently a 220/440 three phase motor. 2. The connection point cover is missing and a competent electrician would not connect a motor with exposed joints. We would have to purchase a new cast iron box if it was available. 3. The wires provided for connection have been exposed to the elements for an extended period of time leaving them suspect. It looks like someone may have dismounted this pump at some time in the past . 4. An attempted was made to turn the shaft and it could not be budged. My experience has always been that a motor should be able to turn freely with no more pressure than can be exterted by hand in order to start and run on electricity. 5. In conclusion it is my opinion that we would have to kat the very least ) overhaul the pump and then build a temporary service complete with magnetic switch and start stop station to even test the well ano see if we could argue that it is an active well and srould we Le successful in all this what use would justify the maintenance of this source of naturally hot water? There is evidence of the old holding tank that was used to allow the water to cool before it was entered into the system. We feel that the expenditure would not be Justified in view of the strong odds against the desired solution. REpoRrs 60 Informal Report to Mayor and City Council SUBJECT: DATE: No: VANDALISM AT WYLIE HIGH SCHOOL 9-23-88 As you are all probably aware by now, the Police Department received a call at 6 : 11 A.M . , Wednesday, September 20 , 1988 that the high school had been vandalized . The call was reported by Gary Wescott , Wylie High School custodian . Sergeant Holley was dispatched to the high school at 6 : 11 A .M. and Officer Mauri was dispatched at 6 : 34 A .M. Detective Snead was called at 6 : 37 A.M. The office area was completely ransacked with sports trophies all over the floor , intercom system on floor and various records strewn all over . Officer Mauri , the reporting officer , observed smashed windows , along with fire extinguishers that had been removed from the brackets and discharged on floors and walls in the hallways . Sink drains had been stopped up with paper towels and faucets left running , causing water to overflow onto floor . The entry door into the teachers lounge had been shot approximately seven times with a 9mm automatic weapon , and several bullet holes were observed in the refrigerator , microwave and coke machine . Evidence indicated that 28 rounds were fired from this weapon. Exact point of entry was not determined , due to multiple windows being broken out at different places . The time the offense occurred is presumed from the clocks that were torn off the walls that indicated between 2 : 00 A.M. and 2 : 10 A .M. , the latest being 4 : 05 A .M. The Texas slature has recognized that competitive bidding for professional engineering services could result in the selection of the least able or qualified and the most incompetent practitioner for the perform- ance of services vitally affecting the health, welfare and safety of the public. Therefore, it has displaced price competition with regulation for the procurement of engineering services for publi entities. (Reference the Professional Services Procurement Act, Texas Civil Statutes, Article 664-4. (iii) EC 5.3. Fill the ditch, redig it. and line the bottom with concrete. Approximate cost is $200, 000. 00. 3. Manually clean the ditch after the weeds have died out this winter . Unfortunately Public Works does not employ enough people to expeditiously complete the job, and would take endless hours of time away from other priority duties within the City. I could possibly contract out extra labor to alleviate the problem, however the approximate cost of this would run over $5. 000. 00.
