A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor Chuck Trimble, Mayor Pro Tem John Akin, Council Members Jim Swartz , Bud Naish, Ortie Messenger , Tom Pritzkau and Marvin Blakey, City Secretary Carolyn Jones, Finance Director James Johnson, Assist . City Engineer Ron Homeyer, Public Works Superintendent Don White, Code Enforcement Officer Roy Faires , Chief of Police James Gilmore and City Attorney Rob Dillard. Mayor Trimble called the meeting to order and gave the invocation. APPROVAL OF MINUTES FOR MARCH 28TH AND MARCH 30TH AND THE RE-SUBMITTAL OF FEBRUARY 23RD MINUTES: There being no corrections or additions to the minutes, a motion was made by Councilman Messenger to approve as submitted. Seconded by Councilman Blakey. The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Akin - in favor, Councilman Swartz - in favor, Councilman Pritzkau - in favor , Councilman Messenger - in favor , Councilman Blakey - in favor , and Councilman Naish - in favor . This motion carried with all in favor. PRESENTATION FROM TERRI MANNING, COMMUNICATIONS SUPERVISOR FOR COLLIN COUNTY SHERIFF 'S DEPARTMENT ON 9-1-1 TASK FORCE: Ms. Manning called today and ask that this item be pulled from the agenda and put on the next Council Agenda. PRESENTATION BY CAROLYN JONES, CITY SECRETARY AND RON HOMEYER, ASSIST. CITY ENGINEER ON PROPOSED ANNEXATIONS: Mrs . Jones stated that these areas being presented tonight are completely surrounded by the City of Wylie. There are a total of 56 acres. The first area is on FM 544 and just off Hooper Road and contains 8 .08 acres and involves eight property owners . Mr . Homeyer stated that water and sewer were available to all of these properties except one, it would be around 1 ,000 feet to get sewer to this property. In the second set of properties, there are four (4) property owners and 4 . 192 areas. This area is off West Brown just West of the Birmingham Elementary School . All of these property owners are on the City water line and sewer is available. The third set of property owners contains two pieces of property and is for one acre. Both water and sewer are available. The fourth set of property owners is just south of the City complex and contains 5.190 Acres and involves three owners. There is water and sewer within a reasonable distance. The fifth group of property owners is located on East Brown Street and contains 6 .752 Acres of land, out of this 3.80 acres is the Hughes Cemetery and the other propertieswould have water and sewer available. Mrs. Jones stated that she needed direction from the Council tonight, inregards to taking in all of these areas or which portion Council wanted to look at. The next item on the agenda is for Council to vote on all of these or part of them being annexed . Councilman Naish stated to annex only those properties that have water and sewer already available . Mayor Pro Tem Akin wanted to know if Council shouldn' t define available and to set guide lines for staff. Mayor Trimble said said we had a problem last time where the people thought the City was going to lay the distance to their property for water and sewer and we want to make sure that these property owners do not think we are going to do that this time. Councilman Naish requested that the City Secretary send out letter requesting voluntary annexation of these properties prior to setting up public hearings on annexation. APPROVAL OF THE PROPOSED ANNEXATIONS : A motion was made by Mayor Pro Tem Akin to proceed on these annexations that have water and sewer available now, by sending out letters requesting voluntary annexation first . Seconded by Councilman Messenger . The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Akin - in favor, Councilman Swartz - in favor, Councilman Pritzkau - in favor , Councilman Messenger - in favor , Councilman Blakey - in favor, and Councilman Naish - in favor . This motion carried with all in favor . APPROVAL OF PROCLAMATION FOR NATIONAL CONSUMERS WEEK - APRIL 23RD THRU APRIL 29TH, 1989 : This proclamation has been placed on the Council agenda at the request of the office of Consumer Affairs in Washington, D. C. Motion was made by Mayor Pro Tem Akin to approve the Proclamation for National Consumers Week - April 23rd thru April 29th, 1989 . Seconded by Councilman Swartz. The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Akin - in favor, Councilman Swartz - in favor, Councilman Pritzkau - in favor , Councilman Messenger - in favor , Councilman Blakey - in favor, and Councilman Naish - in favor . This motion carried with all in favor . APPROVAL AND ACCEPTANCE OF A TEMPORARY DRAINAGE EASEMENT FROM B. C. WOOD PROPERTY FOR SANDEN BLVD. : This item was pulled at the request of Mrs . Ida Pearl Scholz. APPROVAL AND ACCEPTANCE OF THE FINAL PLAT FOR TWIN LAKES PHASE I SUBDIVISION: Mr . Ron Homeyer stated that in one place where there was not enough lime stabilization, the contractor poured two (2) inches of extra concrete. This should work the same as having the lime stabilization. Staff recommends approval and acceptance of the final plat. Motion was made by Mayor Pro Tem Akin to approve and accept the Final Plat for Twin Lakes Phase I Subdivision. Seconded by Councilman Messenger. Councilman Naish wanted to know what the $79,800 . under Development Fees was . Mr. Homeyer said it was for the off site sewer line and for the lift station, the 15 ft . sewer line from Alanis and Ballard behind Westwind Meadows Sub-Division. There being no other questions, Mayor Trimble called for a vote on the motion to approve and accept this final plat. The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Akin - in favor , Councilman Swartz - in favor, Councilman Pritzkau - in favor , Councilman Messenger - in favor , Councilman Blakey - in favor, and Councilman Naish - in favor . This motion carried with all in favor. DISCUSSION OF ATTENDANCE RECORDS FOR ALL BOARDS AND COMMISSIONS: City Secretary Carolyn Jones stated that this item was placed on the agenda at the request of some of the Council . As you will note some of the boards have members who have missed three or more meetings . Some of the members terms will be up this July, 1989 . Mrs . Jones said she would be running ads in both the papers for persons wishing to serve on one of the boards or commissions to fill out and return to her office. This should appear on your June agendas for the replacements or extending terms on these boards. AUTHORIZATION FOR STAFF TO SEEK BIDS FOR CAPPING THE OLD WATER WELL: This well is located behind the old police station on Ballard Street. Mr . James Johnson said the bidder that was awarded the bid for this job, sold to another contractor . This contractor defaulted on the bid . We need to seek bids again . We did not put a bid bond on this as it was such a small amount and would have made the bid price a lot higher . There was another bidder that said he would do the job, but he did not bid on this job the second time we went out for bids. Councilman Naish said to send a letter to them and copy TWC that we are going to sue if the job is not done. Councilman Blakey wanted to know what the City Attorney thought . Mr . Dillard said I am not sure we have to go out for bids . Mr . Johnson said the other bidder did not bid on the job the second time we went out for bids . Mr . Dillard said we will need to bid again. Mayor Pro Tem Akin wanted to know if we could plug this well ourselves. Mr . Johnson said no, that staff could not obtain the permit for this . Motion was made by Councilman Messenger to table this item. Seconded by Councilman Naish. The vote was as follows: Mayor Trimble - in favor, Mayor Pro Tem Akin - in favor, Councilman Swartz - in favor , Councilman Pritzkau - in favor, Councilman Messenger - in favor , Councilman Blakey - in favor , and Councilman Naish - in favor. APPROVAL OF PAYMENT REQUEST FOR XIT PAVING AND CONSTRUCTION INC. : The payment request is in the amount of $159,475 .45 and is in connection with the Street Reconstruction Program. Mr. Homeyer stated that all the work listed on this invoice has been done. The contractor is also in penalty status and this will be dealt with later . Councilman Blakey wanted to know if staff was checking on the ponding to be sure that was no ponding when job was completed . Mr . Homeyer said as they pour a section and it has dried, they run water down it to be sure the water is running off . Councilman Naish wanted to know the completion date. Mr . Homeyer said all that is left is three approaches and the sidewalks . The contractor should be through in about another 14 days . Mr. Homeyer stated that Wylie citizens moved the barricades and drove on a section of the street which had fresh concrete. Councilman Pritzkau stated if that breaks , the paving bond will not cover this since we broke the contract . Mr . Homeyer said the Martin family at Kirby and Birmingham would not give an easement so there will not be a sidewalk in this area. Motion was made by Councilman Pritzkau to approve the payment request in the amount of $159 ,475 .45 to XIT Paving and Construction, Inc. Seconded by Mayor Pro Tem Akin. The vote was as follows : Mayor Trimble - in favor, Mayor Pro Tem Akin - in favor, Councilman Swartz - in favor, Councilman Pritzkau - in favor, Councilman Messenger - in favor , Councilman Blakey - in favor , and Councilman Naish - in favor. This motion carried with all in favor . APPROVAL OF PAYMENT REQUEST FOR CUMMINGS AND PEWITT, INC. : This payment request is in the amount of $4 ,500 .00 and is J part of the street reconstruction program. Mr . Homeyer said this is for the last 30 days of construction staking . Staff recommends approval . Mayor Pro Tem Akin said he has never seen them at the site, and also how much have we paid them. Mr. Homeyer said he would have to check on the total amount that has been paid to Cummings and Pewitt . Motion was made by Councilman Pritzkau to approve the payment request in the amount of $4 ,500 .00 . Seconded by Mayor Pro Tem Akin. The vote was as follows : Mayor Trimble - in favor , Mayor Pro Tem Akin - in favor, Councilman Swartz - in favor , Councilman Pritzkau - in favor, Councilman Messenger - in favor, Councilman Blakey - in favor , and Councilman Naish - in favor . This motion carried with all in favor. CITIZEN PARTICIPATION: Mayor Trimble invited anyone wishing to speak to the Council to come forward at this time, to state their name and address for the record and to keep their comments within two minutes. There were no speakers at this time. COUNCIL DISCUSSION: Councilman Naish paid a comment to the staff for the courtesy being extended to the citizens. I just want to thank staff . What is the date for the Commissioners Court. Mayor Pro Tem Akin said Monday, April 17th at 10:00 A.M. Councilman Blakey wanted to know the policy for changing the population signs. Mr. Johnson said Mr. Homeyer can request the Texas Highway Department to change them. We are over 9,000 and if any growth at all comes, should be over 10 ,000 this year . Councilman Blakey also wanted to know if Mr . Holigan ever contacted Mayor Pro Tem Akin about the road. Mayor Pro Tem Akin said no. Councilman Blakey said the reason is the patching that was done will not last forever . Councilman Messenger said if the Commissioners Court approves the funds being moved, we can assess the property owners . Councilman Messenger complimented Mayor Pro Tem Akin and who everelse was involved, in the street patching work being done in the City. Also I have had some comments on the big W" Mayor Pro Tem Akin said he heard someone say it cost up to $60 ,000 . Councilman Pritzkau stated he liked what Public Works has done on Brown Street . Councilman Pritzkau said he had a question about the 12 ton roller going down the shoulder of Highway 78 . Mr . White said it was the City' s roller and the trailer was loaded and we were on Jackson Street and therefore drove the roller to the yard. Mayor Pro Tem Akin said that Mr . Johnson, Mr . Homeyer and Mr . McKnight and himself met with TWC on the sewer penalties. They called and have lowered the fines by $2,000 .00 . Mayor Pro Tem Akin said he felt that this should be appealed . Mayor Pro Tem Akin also stated that the joint meeting with the Chamber was very good and I feel we accomplished a good working relationship with them. Mayor Akin also pointed out that the monthly report from the Library shows the circulation is up compared to the last few years . Also want to thank John Tobin for his funding the March Reading program. Mayor Pro Tem Akin also noted the number of work orders for Public Works and the Complaints for Code Enforcement Office. These areas are doing a fine job in our City. Mayor Pro Tem Akin also noted that he has been having complaints about the trains coming through Wylie to fast. There should be an ordinance on the next agenda for approval . Mayor Pro Tem Akin also requested anyone that could go, please do so, to the Collin County Commissioners Court next Monday. City Secretary Carolyn Jones reminded Council of the Collin County Public Officials meetings in April and May. Councilman Naish reported that the meeting on Gaston Dr . was held on April 1st and that each resident should be using Gaston Dr . North and Gaston Dr . East plus the City is to put up better signs. If this works, then the problems are solved , otherwise we will hold another meeting . Mr . Faires said he felt this solution was one that the citizens could live with. Mayor Pro Tem Akin said he met last week with the Highway Department on the Beautification Program and our problem now is where the alignment of the widening of Highway 78 will be when it is extended. M. in the Council Chambers at the Municipal Complex. A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Chairman D. F. Whitlow, Vice Chairman Ron Ferguson, Board Members Jill Tomek, Joanie Zeeb, Bill Emsoff, and Bill Burge, Public Works Superintndent Don White, Grounds Maintenance Foreman Philip Bounds, and Secretary Lisa Keith. Board Member David Orr was absent. Chairman Whitlow called the meeting to order. OATH OF OFFICE TO NEW MEMBER BILL BURGE: City Secretary Carolyn Jones gave the oath of office to new member Bill Burge. The park board welcomed him. APPROVAL OF THE MARCH 6, 1989 MINUTES: There being no other additions or corrections a motion was made to approve the minutes as submitted. The motion was seconded with all in favor. DESIGN A TENTATIVE PARK MASTER PLAN: D. F. Whitlow said we need to go ahead and finalize a tentative plan, have Don White take it to engineering to have the new plans drawn up. When I say tentative I mean a 3 to 5 year plan of action, taking into consideration if the money is available or not, and submitting it to City Council for approval . Joanie Zeeb said a swimming pool still needs to be put in and maybe WISD will go co-op. Ron Ferguson said the school would not be interested at this time. Jill Tomek said if we keep the pool in the same spot the school may eventually want to use it. We should also look at putting two tennis courts in the same area. D. F. Whitlow said my thoughts on a swimming pool are that it should be at least a 50 meter pool , based on the pattern of how communities use pools. Jill Tomek had drawn up tentative plans and went over them with the Board. •Y'm ,w Jill Tomek pointed out on the plans, and said a 75x40 foot pool with a diving board, shower area, concession area, and tennis courts should remain in the general area as shown on the old park master plan. D. F. Whitlow said where the current playground area is, if you position two tennis courts there, you could almost create a mini complex. I suggest that we entertain the thought of, if there is enough land, to build four or five more courts in the picnic/pavilion area. Jill Tomek suggested a larger area near the school . D. F. Whitlow said I think there would have to be some sort of co-op program with the school , if the courts were put by the school , for parking. • Jill Tomek pointed out on the plans, and said jogging trails and walking paths can be put in for access to all facilities. Frisbee golf is coming back and is becoming a national sport, and is very inexpensive to put in. Anybody in the City could utilize this. We might consider extending the road from the first parking lot and put another parking lot in that is about the same size. I received a quote to stripe the existing parking lot of $315. 00 that will accomodate 149 cars. The area next to the pavilion could be set up for croquet and a horse shoe pit. I would also like to see another restroom on the other side of the road. I have drawn in a sand volleyball pit and garden club. Don White said the small area by the library would be good for a garden club and would be easy to put in and maintain. D. F. Whitlow said there is no question that the soccer fields will have to go down in the southeast section of the park. As soon as soccer season ends all the goal posts and poles need to be moved to the new location. Go ahead and set two fields since they won' t be played on for the rest of the summer. D. F. Whitlow said I 'm not sure about frisbee golf. I don' t want to run into the same problem with the greenbelt area, I don' t want to clutter it up. What I would like to do with the baseball complex is within 3 years to enclose it to nothing but a baseball area. My thoughts on the jogging/walking trail is that it should cover the outskirts of the park. My guess is it would be approximately 2. 1 or 2. 0 miles. Would be low cost and out of the way. Philip Bounds said we need to have a regulation size pool . Bill Emsoff said if we put in a 50 meter pool it would be double the size of the one on the old plans. • • • D.F. Whitlow said I like where the extra parking lot is on the old plans because it doesn' t get into the greenbelt area. Philip Bounds said you need to think about building another road for access to the park. Don White said maybe a street from the Twin Lakes subdivision can adjoin the park for a' south entrance. We can always ask the engineer if the developer can change their plans to accomodate a road into the park. Bill Emsoff said from what I ' ve heard City Council would be willing to fight for a pool first. I think this would be th easiest project to get accomplished. I would suggest that we build that complex first, with adjoining dressing. rooms. Jill Tomek said we also need a concession stand for that area, people want cold drinks. Don White . said you need to agree on the whole plan then I will have the engineer draw up the plans and bring it to the next available Park Board meeting for further discussion. Jill Tomek said Don White had given her some bad news last week about the new sewage line. The plans were checked to find that the line will be installed through the park, not on the boundary line. D. F. Whitlow said I am concerned with the technical things like the sprinkler system when new lines have to be laid. Don White. said the City employs a licensed irrigator. He looked at the park and said it would not be a problem. He is going to put in sprinkler heads that will shoot water approximately 50 feet. I don' t feel that the new sewer line will be a problem. We have $2, 500 for the sprinkler system. We will extend the system as much as we can. There was some discussion of XIT having to pay the City $240 per day for everyday they are over on the penalty clause and possibly using this money for the parks. Don White said he would rather XIT trade the money owed for work. But we have to see what City Council wants to do. Whitlow said what would it take, cost wise, for Commmunity Park to be like new. This includes everything, irrigation, seed, new poles, even down to the smallest bolt. What would be the cost 3 to 5 years down the road. Don White said I ' ll take a wild guess and say $250, 000 per year plus four people. D. F. Whitlow said maybe over a 3 to 5 year peiord we can create this. Don White said we used to have $185,000 in the park budget. Within that budget it could look new. $185, 000 would just cover operating expenses, the capitol outlays would be added every year to the budget. Jonaie Zeeb said I think the park is real important, but it is a small part of the City. We have to do something to . make the whole City look pretty. Don White said after you put together a master plan for Community Park then you can do a total park system plan. Don White read a list of priorities that Jill Tomek had put together for Community Park. Jill Tomek said these are all lost cost items we can get done. Don White said remember that the more you add to the park the more one employee has to take care of . Make a decision on what large items and facilities you want and what area you want them in _and maybe Jill Tomek could work closer with Lisa in the engineering department to get some plans done. D. F. Whitlow said the swimming pool area will basically remain the same except have a larger pool and add two tennis courts. 2 or 3 soccer fields will be in the west end quadrant, that would be no cost to put in just labor, and would be combination soccer/football fields. Jill Tomek asked if there would be any objections to changing the parking lot and put it in horizontally. There was no objection. Don White said myself , Jill Tomek, and Lisa in engineering can all get together and draw up the new plans before the next meeting. There was some discussion and agreement on eventually making the baseball complex only for baeball and it should remain the same on the new plans. Whitlow said the only changes to the old plan are removing the ampitheatre, putting tennis courts in, and moving the parking area. DEVISE A LIST OF ITEMS FOR THE WOMENS LEAGUE: Jill Tomek said I don' t know how much money the Womens League will raise. So it may not be a good idea to ask them for playground equipment. The last proposal we received on equipment was way to high. I was advised by a gentleman in Plano that metal equipment last longer and you are not constantly revamping. He also informed me that rather than pea gravel they use what I think is called buckshot. It' s smaller and would cause less damage when children throw it. Ron Ferguson said that buckshot is a upgraded version of . sand. The metal equipment you are talking about has a heavy duty plastic coating, is color fast, and does not absorb heat or reflect cold. I have all of the literature and cost factors on this type of equipment at my office. Jill Tomek said she would get the information from Ron Ferguson as soon as possible. Ron Ferguson said that the equipment, if purchased, must be professionally installed. This is a safeguard. Jill Tomek said she had mentioned the playground equipment to a Council Member and she got feed back in that they feel we are asking for too much with wood equipment, it' s way to expensive. Ron Ferguson said wood equipment is more expensive than metal . Jill Tomek said this Council Member has the idea that the Womens League willl donate the material and the Park Board will get 'volunteers to build and install it. I would rather get quality first. Don White said one item I would like for you to consider that would be of interest to myself and Philip Bounds, from a working stand point of it, is a greenhouse so we can keep plants for the park in order to keep it nice. Jill Tomek said we might could put in a small greenhouse on the back side of the library since the bluebonnet room is there at the library. Jill Tomek said that McDonalds is willing to put on a pancake breakfast fund raiser so we can get new playground equipment. So we might want to suggest other things to the Womens League. Joanie Zeeb said we might suggest trees, the cost on a good sizeddone is around $250. /0 t Jill Tomek said we are estimating $3000 from the Womens League Fund Raiser. Ron Ferguson said there are alot of different things like spiracle and poles for different age categories that run from $500 to $1000 in the plastic coated metal playground equipment. I would recommend looking at equipment that covers a small area. Jill Tomek said we need to start looking at some plans to get ideas. There is alot more to a playground than just physical development. We need areas where imagination and coordination would be used. When we ask for something we need to know exactly what we want. • D. F. Whitlow said the playground area would still be an opportunity for the Womens League fund raiser. Don White said the Womens League fund raiser last year for the police department was a great success. The Womens League bought equipment that was needed. They do have the final decision on what is bought. D. F. Whitlow said we will have to get bids from at least three companies. Don White said City Council never goes out on bids for engineering services. This isn ' t really a bid item. Proposals are made and the best one is accepted. DISCUSSION OF THE PLAYGROUND AND PICNIC AREA: D. F. Whitlow said this area is generally in pretty good shape. I think the large grill at the pavilion needs to be replaced with a smaller one. The large one is not being utilized. • Don White said the barbecue pit was put there for City functions. It was utilized the first few years. The initial idea was to rent the pavilion for large family reunions. For those who want to cook the avilability is there. D. F. Whitlow said I 'm sure that the intentions at that time were great, but it needs to be maintained. Most people who plan to cook are going to bring their own grill rather than take the time to clean that one. The area is utilized but the grill is not. CITIZEN PARTICIPATION: There being no citizens present the Board moved on to the next order of business. GENERAL DISCUSSION: Bill Emsoff asked that the order of business regarding the Birmingham Farm Tract be placed on the next agenda. // • .. ''§t'"'+:, y ..tom .. .. Jill Tomek expressed the need for a workshop to discuss the playground. If we wait until the next regular session it will be to late to plant. Don White said we have $2, 500 in the budget for the sprinkler system. Phil Blakely is drawing up the plans and will get us the costs and everything. Jill Tomek said to Bill Burge she understood that he had a hydromulching business. Bill Burge said we have a hydromulch machine. Jill Tomek asked Bill Burge how late in the Spring you can plant Bermuda and still expect it to grow. Bill Burge said at least by the middle of next month for best results but you can plant clear through September. Jill Tomek said do we need to kill out the weeds in the picnic area before seeding since it' s mostly weeds now. Bill Burge said if you can get the seed in you must have irrigation if you expect it to grow. Don White said I would like to start on the sprinkler system in the picnic area within the next week. I ' m still banking on a concrete retaining wall for the playground area. Bill Burge said that if it is hydromulched you will be mowing in one month. If the area to be seeded is a size we can do, we will donate the machine and labor if the City supplies the material . Jill Tomek said should we get the parking lot striped now or wait another year. Bill Emsoff said I think we should get it done before the ball games start. Don White said the quote he got on striping was for 90 degree parking. It' s less parking spaces but not as much of a hazard. Jill Tomek said if that' s more feasible and safer then 90 degree would be better. I received at quote for straight spaces. Jill Tomek gave Don White the name and phone number of the company she received a quote from so that he could get another quote for 90 degree parking. D. F. Whitlow said we need to have a bunch of volunteers or boy scouts to clean up the park. There's broken glass, pop tops, etc. everywhere. Don White said maybe we can get some people that owe community service time through the courts to do it. 111 • /� .ar. • , _ Don White said if you know anyone who wants to volunteer to help weed-eat and generally clean up the park for the next couple of Saturdays, we will be out there trying to get this done. We have about six weeks that it is difficult to keep up with because we only have one man. The two temporary workers don' t start working until June. (c)Any person affected by a violation of this section shall have the right to file a formal complaint with the Municipal Court of the City of Wylie. (d) In any prosecution of a violation of this section, proof of the violation shall constitute in evidence a Prima Facie presumption that the owner or lessee of the train was cognizance of and authorized such violation. SECTION 3 REPEALING CLAUSE - That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provision of this ordinance shall remain in full force and effect. SECTION 3 A Garage Sale or a temporary sale (temporary, occasional sale of personal property) is defined as each of one or two sales of tangible property at retail for a period not to exceed four consecutive days in length for each sale during any calendar year, carried on at a home or residence by a person who is not held out as engaging in or who does not habitually engage in the business of selling such tangible personal property at retail and who does not carry on such sales in such a manner as to create a disturbance or become a nuisance in the neighborhood; and only so long as such person is selling only personal property that belongs to such person personally and has not been purchased for the purpose of re- sale. To emphasize a person may not conduct more than two garage sales per year and each garage sale must be limited to a period not exceeding four consecutive calendar days in length. SECTION 4 Signs may be posted on any residential property where permission has been requested and granted. No sign shall exceed the size of two square feet. No sign may be posted on any utility pole. Signs will be permitted within the rights of way of the City of Wylie only between the hours of twelve noon on Friday through twelve noon on Monday. For the purpose of clarification a person may place a advertising sign for a Garage Sale along the streets right of way, provided such sign is not placed before noon on Friday and in placing the sign the person conducting the Garage Sale agrees to pick up the sign before noon on Monday. The existence of a sign on a public right-of-way within the City shall be considered Prima Facie Evidence, rebuttable as in other cases, that such sign was placed by or under the direction of the person conducting the Garage Sale. a7 SECTION 5 REPEALING CLAUSE - That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Our library may not be very large, but the hearts of the people working there certainly are ! Rosanne Burgess, Director of the Library, and Kay Daniel , Library Assistant, are always pleasant and helpful when we visit the library. It is a pleasure to use our library facilities. Our librarians are not the stereotypical librarians that "ruled" libraries during the time I was in school; i .e. , cantankerous ladies who glared when anyone spoke above a whisper and "kept guard" over "their" books in the library. A trip to the library when I was in school was not a pleasant experience, and the librarians were almost always the target of jokes. On the contrary, our library is inviting due to the friendliness and enthusiasm of the library staff and volunteers and the attractiveness of the library--it is always decorated with holiday themes, posters, pictures, etc. My children feel the library belongs to them and the library staff are their friends. I am grateful for that ! Beth Brewster is excellent in her position as Children 's Specialist. She and Cathie Upshaw recently coordinated the Spring Break Reading Program and did a wonderful job. Our children, who are kindergarten aged, were so excited to attend each day. In fact, I had to rearrange my schedule that week in order to accommodate the morning and afternoon sessions. They just couldn 't get enough! The closing program on Friday of that week was first rate--everyone had a great time and benefited from Beth 's endless efforts and organization. My children can hardly wait for the next program at the library. Creative programs of this typeand quality are a wonderful way to promote a cultivate a love for reading and good reading habits in our young people. I sincerely hope our library will continue to maintain this standard of programming for our children. Thank you for your consideration of this letter from a pleased and supportive parent.
