ITEM NO . 2 - APPROVAL OF PLAQUE FOR NEW CITY HALL - The
Mayor has asked that we gather information on the
dedication plaque for the new City Hall . The City Secretary
is looking into prices and formats and will have information
at the meeting on Tuesday night .
ITEM NO . 3 - PUBLIC HEARING ON ZONING OF 7 ACRES ON FM544
This property is described as 7 . 599 acres out of the M.
Sparks Survey , Abstract 849 and is located on W. FM544 ,
known as the Brigham property . The petitioner is asking for
B2 zoning . The Planning & Zoning Commission recommend
approval .
ITEM NO. 4 - APPROVAL OF ZONING ORDINANCE FOR 7 . 599 ACRES ON
W . FM544 - See comments for item no . 3 .
ITEM NO. 5 - PUBLIC HEARING ON ANNEXATION OF 320 ACRES ON
SH78 - This property is described as 320 . 907 acres out of
the Francisco de la Pina Survey , Abstract 688 , located on E .
SH78 and is the property surrounding the site of the new
municipal complex . The P&Z recommends approval unanimously .
ITEM NO. 6 - PUBLIC HEARING ON ANNEXATION OF 148 ACRES ON E.
SH788 - This property is described as 148 . 5696 acres out of
the Francisco de la Pina Survey , Abstract 688 and is located
on E . SH78 next to the Wylie Ranch East Estates . The staff
has had the required pre-development conference with the
petitioners representative and we see no problem with this
tract becoming a part of the City . The P&Z recommends
approval unanimously .
ITEM NO . 7 - PUBLIC HEARING ON ANNEXATION OF 7 ACRES WEST OF
SH78 - This property is described as 7 . 228 acres out of the
Duke Strickland Survey , Abstract 841 located west of S . SH78
and is adjacent to the Harvard tract , and as a matter of
fact was at one time a part of that tract . The owner
reserved this small piece , which he now wants to bring into
the City . The owner has had the prescribed pre-development
conference with the staff and we see no problem with this
petition . The P&Z has unanimously recommended approval .
ITEM NO . 8 - PUBLIC HEARING ON ANNEXATION OF 80 ACRES ON OLD
SACHSE ROAD - This property is made up of four tracts ,
three of which lie in Collin County with the fourth in
Dallas County . It is out of the Guadalupe de los Santos
Survey , Collin Co . Abstract 1100 and Dallas Co . Abstract
1384 . It is owned by Fred Brunner . The staff made the
decision to annex this property in order to establish
contiguity to several other tracts in the area whose owners
have long desired annexation into the City . We have had a
couple of meetings with Mr . Brunner and while he has not
actually signed voluntary annexation papers , he is talking
development for the property . The P&Z recommends approval
by a vote of 5-1 .
ITEM NO . 9 - PUBLIC HEARING ON ANNEXATION OF 135 ACRES ON
PLEASANT VALLEY ROAD - This property is described as 135 . 89
acres out of the Guadalupe de los Santos Survey , Collin
County Abstract 1100 and Dallas County Abstract 1384 .
Twenty-two acres lie in Collin County and 113 . 89 acres lie
in Dallas County . The owner , Roddy Groves , signed a letter
some months ago indicating his desire to be a part of the
City when we became contiguous . The staff sees no problem
with this annexation . The P&Z unanimously recommends
approval .

ITEM NO . 10 - PUBLIC HEARING ON ANNEXATION OF 31 ACRES ON
PLEASANT VALLEY ROAD - This property is described as 15
acres out of the Guadalupe de los Santos Survey , Dallas Co .
Abstract 1384 and Collin County Abstract 1100 and 16 acres
out of the m. Sutton Survey , Abstract 1275 . The staff has
reviewed this petition and sees no problem with this
annexation request . The P&Z recommends approval by
unanimous vote .
ITEM NO . 11 - PUBLIC HEARING ON 84 .98 ACRES BETWEEN PLEASANT
VALLEY ROAD AND OLD SACHSE ROAD - This property is described
as 84 . 98 acres out of the Guadalupe de los Santos Survey ,
Abstract 1384 and lies solely in Dallas County . It is
directly adjacent to the Groves property described above .
the PiZ recommends approval by unanimous vote .
ITEM NO . 12 - APPROVE AMENDMENT TO ORDINANCE 33-15 - This
amendment to Ordinance No . 83-15 will require all wood
shingles and shakes to be of fire retardant treated wood or
not used at all . The advantages are obvious as a protection
to life and property with the City . These shingles are
notorious across the country for causing the rapid spread of
fire through whole neighborhoods from these shingles blowing
in the wind .
ITEM NO . 13 - ACCEPTANCE OF PUBLIC IMPROVEMENTS IN QUAIL
HOLLOW PHASE I - This subdivision is located on E . Stone
Road and Akin Lane . The inspections have been made in
accordance with subdivision regulations and found
acceptable . The report is contained in your packet on page
4 . The inspection staff and engineering staff recommend
acceptance of Quail Hollow public improvements by the City .
ITEM_NO . 14 - APPROVE PRELIMINARY PLAT OF ROAD RIGHT OF WAY
DEDICATION BY SOUTHFORK LTD . - This is primarily a formality
as dedication of a road right-of-way through a parcel of
land technically constitues subdivision , therefore we must
have a plat approved by the Council showing same . The
engineering staff has reviewed this plat and recommends your
approval .
ITEM NO . 15 - APPROVE REPLAT OF LOT R1 , BLOCK 3 , KELLER' S
1ST - This replat is submitted for your approval by the
engineering staff who has reviewed the replat and find that
it is in compliance with the City ' s subdivision regulations .
This replat and the item below is a necessary requirement to
prepare the lot lines , combine lots and relocate the
sanitary sewer in order that the Savings and Loan can be
built . The other item involves the replatting of a lot so
that retail construction can occur on that lot .
ITEM NO . 16 - APPROVAL OF REPLAT OF LOT R1 , BLOCK 2 ,
KELLER ' S 1ST - See comments above .
ITEM NO . 17 - APPROVE CITY/COUNTY AGREEMENT WITH ROCKWALL
COUNTY - This is the renewal of the fire protection
agreement with Rockwall County which we entered into one
year :go . We have added a phrase which we hope will make
this contract automatic if their County Attorney agrees .
ou will recall that this contract provides for financial
reimbursement to the City for fire calls which we make in
tilat portion of Rockwall County that is near the Finholt
iobile Home Park .
ITEM NO . 18 - PRESENTATION BY LONE STAR GAS - This
presentation will be made by B .J . Parrish , Representative of
Lone Star Gas . It is a request for a rate increase . Lone
Stnr ' s case is included in your packet on pa es -73 and
under separate cover , along with a copy of a memo from James
Johnson , the Director of Finance written to the hayor and
me . Wr . Johnson will also be available to answer any
questions you nav have . We recommend initially that you

pass the resolution suspending the rate increase at our next
meeting and that you consider the possibility of having the
rate request enalyzed through a couple of different methods
that Mr . Johnson will suggest .
ITEM NO . 19 - PRESENTATION BY REPRESENTATIVE OF WYLIE RANCH
EAST - There is very little we can tell you about this item.
The presenter , Mrs . ;Marge Feivor , called the City Secretary
yesterday and asked to appear before the Council relative to
"bad streets in Wylie Ranch East" . As you may know , I met
with a group of homeowners in this addition a short time ago
and this problem was discussed at that time . It was my
impression that we had covered the alternatives and after
they , as a group had an opportunity to discuss the matter
and come to a decision , they would again hold a meeting at
which the City would be represented and we would decide what
path to follow . My impression at the conclusion of the
meeting was that while the residents were not delighted with
the turn of events , they did seem to realize that there were
certain advantages being in the City and that we would be
perfectly willing to extend to them the same type of
agreement to reconstruct their streets that the County has
proposed . Thus , I was surprised to find that apparently a
member or group of individuals wants to circumvent ,
apparently this process already begun . For the most part ,
the group was reasonable and we had a good discussion .
There was ; however , a couple of hotheads in the crowd .
Since no names were given , I cannot tell you if the
requesting party was part of that group or not . jou should
be aware that what has brought us to this dilemma is the
hno,. ledge , discovered by the property owners in Wylie Ranch
East themselves , that their streets and utility easements
were long ago dedicated to the City of Wylie . Thus , the
County would not fix them and their president came to us
with Life facts he had discovered . Since that time , we have
sent patching crews to the streets in question in order to
uphold oar responihility . I have had no further contact
with the ;roux .
ITEM NO . 20 - APPROVAL OF COMPENSATORY PAY FOR
COUNCILMEMBERS This is the appropriate time for this matter
to be handled by the Council with the election just ahead of
us . According, to our charter , if an increase is approved
now , only those places which pass through the election
process this April who will receive the increase , places up
for election in 1987 will receive the increase in 19bi .
According to our Charter , no seated Councilperson can
benefit from an increase which they , as a Council , approve
unless that place has passed through the election process .
Currently , the Mayor receives 4;150 . 00 for general expenses
and for car expenses for a total of Y2w' . UO per
month . The Councilmernbers currently receive $100 . 00 for
general expenses and g.,,__ . v0 for car expenses tor a total
t125 . 00 per month .
ITEM NO . 24 - EXECUTIVE SESSION - It once again is that time
of year when we usually conduct the annual review and
evaluation of the performance of the City Manager . State
law allows this conversation to be held in Executive
Session . Actions which are a result of this discussion
must , however , be done in open session . I 'oak forward to
the opportunity of sitting down with you once again and
. earin , our comments and concerns .

CITY COUNCIL MEETING
MINUTES
JANUARY 28 , 1986
7 :00 P . M.
The Wylie City Council met in regular session on Tuesday ,
January 28 , 1986 at 7 : 00 P . M . in the Community Center of
Wylie . A quorum was present and notice of the meeting had
been posted for the time and in the manner required by law .
Mayor John Akin presided . Those present were Mayor John W .
Akin , Mayor Pro Tem Don Hughes , Councilmembers Percy
Simmons , Joe Fulgham, Harold Spence and Randall Gaston , City
Manager Gus Pappas , City Secretary Carolyn Jones , Public
Works Director Bill Windham, Code Enforcement Officer Roy
Faires , Brent Doll , Mayor Poindexter and Mayor Pro Tem Terry
Hall from the City of Murphy . Dan Sefco , Dr . Tom Jones ,
Scott Dorsey of the Wylie News and other citizens
Mayor Akin called the meeting to order and gave the
invocation . Mayor Akin also stated that Councilman Martin
was out of town .
APPROVAL OF MINUTES : There being no corrections or
additions to the minutes , Mayor Pro Tem Hughes made a motion
to approve as submitted . Seconded by Councilman Spence .
The vote was as follows : Mayor Akin - in favor , Mayor Pro
Tem Hughes - in favor , Councilman Simmons - in favor ,
Councilman Spence - in favor , Councilman Fulgham - in favor ,
and Councilman Gaston - in favor . This motion carried with
all in favor .
ANNUAL AUDIT REPORT FROM BRENT DOLL, CPA OF DOLL KARAHAL &
CO . , P .C . , C . P. A. FOR FISCAL YEAR 1984-85 : Mr . Doll thanked
the Mayor and Council for this opportunity to be of service
to the City of Wylie . The General and Utility revenue funds
were found to be in excess of what was budgeted for in this
years budget . Mr . Doll also stated that the problems that
were of concern to him was due to the rapid growth of the
City and the computer program being used and the lack of
experience and technical ability of the City ' s accounting
personnel . Since this report and since the letter of
recommendation , there has been several visits back to the
City of Wylie . We have found on these visits that the
accounting system and personnel have improved and are
working on these correction . Mr . Doll also stated that the
City Staff should be commended for the job they are doing .
Councilman Fulgham wanted to know if the software the City
was using is capable of handling the finances of the City .
Mr . Doll said yes , it will and is beginning to do a better
job since he was here doing the audit . Mr . Doll also said

that he met with Mr . James Johnson and Mr . Frank Dunlop so
these program problems could be installed and worked out .
There being no other questions from the Council , Mayor Akin
thanked Mr . Doll for his time and for coming out to the
meeting .
ADOPTION OF REVENUE SHARING BUDGET FOR FISCAL YEAR 1985-86 :
The Council has held the two public hearings required by law
prior to the adoption of this budget . This budget
anticipates receiving some $41 ,000 . This budget will
purchase two (2) police cars and their equipment , and will
also go toward the street fund ( such as asphalt , rock , lime ,
etc . ) . This will probably be the last year for revenue
sharing . Motion was made by Councilman Simmons to approve
the Revenue Sharing Budget . Seconded by Councilman Fulgham .
The vote was as follows : Mayor Akin - in favor , Mayor Pro
Tem Hughes - in favor , Councilman Simmons - in favor ,
Councilman Spence - in favor , Councilman Fulgham - in favor ,
and Councilman Gaston - in favor . This motion carried with
all in favor .
PUBLIC HEARING ON THE REQUEST OF RE-ZONING 674 . 2539 ACRES
OUT OF THE D . WILLIAMS SURVEY : This property is located on
FM3412 and FM 1378 and is commonly known as the Birmingham
Trust Land . Mayor Akin opened the public hearing . This re-
zoning has been the result of the request by the City staff
for the realignment of one street . This re-zoning has been
before the Planning and Zoning Commission and is being
recommended to Council with a change of 20 Acres from SF-3
to SF-2 . This addition of SF-2 has been made , along with
the decrease of SF-3 .
Mr . Dan Sefco said these developers will abide by what the
City has requested on the park area and they did not mind
increasing SF-2 20 acres and decreasing SF-3 20 acres . Mr .
Sefco also said that Park Blvd . will be 100 ft . R-O-W .
There being no other questions or opposition , Mayor Akin
closed the public hearing .
APPROVAL OF ZONING ORDINANCE FOR 674 . 2539 ACRES OUT OF THE
D. WILLIAMS SURVEY : This property is located on FM 1378
and FM 3412 and is commonly known as the Birmingham Trust
Land . This tract of land is being zoned as follows :
Single Family - 1 96 . 2 Acres
Single Family - 2 107 . 8 Acres
Single Family - 3 116 . 5 Acres

Motion was made by Councilman Gaston to approve the zoning
as listed above . Seconded by Councilman Spence . The vote
was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes
- in favor , Councilman Simmons - in favor , Councilman Spence
- in favor , Councilman Fulgham - in favor , and Councilman
Gaston - in favor . This motion carried with all in favor .
PUBLIC HEARING ON THE ZONING OF 30 ACRES OUT OF THE G . W .
GUNNELL SURVEY : This property is located on FM 1378 and is
bordered on the west by lake Ranch Estates and on the north
by Lake Ranch Road . This request for zoning is for Single
Family 1 and Single Family 2 . Mayor Akin opened the public
hearing . Mr . Jim McKnight said he has met with Mr . Welch and
then talked with builders . The builders indicated they
would not be interested in SF-1 lots . Mr . McKnight has
requested zoning for SF-1 and SF-2 . There would be
approximately 31 lots for SF-1 and 61 lots for SF-2 .
Mr . Gilbert Welch said all home builders are becoming a
little more conservative . There is a market for SF-1 homes .
After going through the last five public hearings held on
this property , Mr . Welch stated the average home in Lake
Ranch Estates will be 2800 square feet . The closest zoning
to this the City has is SF-1 . Mr . Welch then ask the
Council to zone the entire 30 acre tract Single Family 1 .
Mr . Welch also ask the people who had come out to support
him in this zoning matter to stand .
Mr . Jim McKnight stated that he has offered this 30 acres to
Mr . Welch at the same cost per acre of the property across
the street is selling for . Mr . Welch did not want to buy
this property .
Mr . Welch said it did not matter nor should it have any
bearing on the zoning of this property that Mr . McKnight had
offered to sell the property to him .
There being no other questions or opposition , Mayor Akin
closed the public hearing .
APPROVAL OF ZONING ORDINANCE FOR 30 ACRES OUT OF THE G . W .
GUNNELL SURVEY : This property is located on FM 1378 and is
across the Birmingham Trust Land and is bordered on the west
and north by Lake Ranch Estates . Planning and Zoning
recommends this to Council with zoning of SF-1 and SF-2 with
15 acres in each zoning . Motion was made by Councilman
Simmons to approve this zoning as SF-1 for the entire 30
acre tract . Seconded by Councilman Gaston . The vote was as
follows : Mayor Akin- against , Mayor Pro Tem Hughes - in
favor , Councilman Simmons - in favor , Councilman Spence - in

favor , Councilman Fulgham - in favor , and Councilman Gaston
- in favor . This motion carried with five ( 5) in favor , and
one ( 1 ) against .
FINAL PUBLIC HEARING ON THE ANNEXATION OF 1 . 04 ACRES OUT OF
THE FRANCISCO DE LA PINA SURVEY , ABSTRACT 688 : This
property is located on E . SH78 , adjacent to "Steaks Over
Texas" , and is commonly known as Discount Bait House .
Mayor Akin opened the public hearing , there being no
questions or opposition , the public hearing was closed .
FINAL PUBLIC HEARING ON THE ANNEXATION OF 51 . 531 ACRES OUT
OF THE WILLIAM SACHSE SURVEY , ABSTRACT 835 : This property is
located on the west side of Hooper Rd . and south of FM 544 ,
adjacent to Regency Business Park . This property is owned
by B . C . Wood . Mayor Akin opened the public hearing , there
being no questions or opposition , the public hearing was
closed .
FINAL PUBLIC HEARING ON THE ANNEXATION OF 143 . 692 ACRES OUT
OF THE R . D . NEWMAN SURVEY , AND 7 . 297 ACRES OUT OF THE H . J .
HARDIN SURVEY : This property is located east of S . SH 78
and is known to us as the Louis Reese property and is
adjacent to the George Lewis property annexed some time ago .
Mayor Akin opened the public hearing . Mr . Tony Blancher who
is a representative for Mr . Reese said that Mr . Reese wanted
this property in the City of Wylie for several reasons . One
reasons was the availability of Water and Sewer , another
reason is the zoning flexibility . There being no other
questions or opposition to this annexation , Mayor Akin
closed the public hearing .
FINAL PUBLIC HEARING ON THE ANNEXATION OF 12 . 5168 ACRES AND
3 . 7014 ACRES OUT OF THE R . D . NEWMAN SURVEY , AND 2 ACRES OUT
OF THE H . J . HARDIN SURVEY AND 5 ACRES OUT OF THE I . CLIFTON
SURVEY - A TOTAL OF 23 . 2182 ACRES : This property is located
west of S . SH78 , west of the railroad tracks across SH78
from Century Business Park , bordered by the Harvard tract
and the Dingban Wang tract . The owner is John Robinson .
Mayor Akin opened the public hearing , there being no

This property is owned by Mr . Dingban Wang . Mayor Akin
opened the public hearing , there being no questions or

FINAL PUBLIC HEARING ON THE ANNEXATION OF 4 ACRES OUT OF THE
FRANCISCO DE LA PINA SURVEY : This property is located on
the SE corner of Eubanks Land and SH 78 . The property owner

FINAL PUBLIC HEARING ON 262 . 34 ACRES OUT OF THE W. BELL
SURVEY , ABSTRACT NO. 37 : This is all federal land and is
known as Lake Annexation No . 9 . Mayor Akin opened the
public hearing , there being no questions or opposition , the
public hearing was closed .
FINAL PUBLIC HEARING ON 2628 . 43 ACRES OUT OF THE BRICE M .
CARR SURVEY ABSTRACT NO . 175 , JOHN KIRBY SURVEY ABSTRACT NO .

federal land and is known as Lake Annexation No . 10 . Mayor
Akin opened the public hearing , there being no questions or
opposition , the public hearing was closed .
FINAL PUBLIC HEARING ON THE ANNEXATION OF 27 . 7 ACRES OUT OF
THE S . M. RAINER SURVEY , ABSTRACT 740 : This is all federal
land is known as Lake Annexation No . 11 . Mayor Akin opened
the public hearing , there being no questions or opposition ,
the public hearing was closed .
APPROVAL OF FINAL PLAT AND CONSTRUCTION PLANS FOR WESTGATE
PHASE 1 : These plans have been reviewed by the required
staff members and the engineering department . Mr . I . W .
Santry recommends this plat for "approve for construction" .
There being no questions from Council , motion was made by
Councilman Spence to approve this plat for "approved for
construction" . Seconded by Councilman Fulgham . The vote
was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes
- in favor , Councilman Simmons - in favor , Councilman Spence
- in favor , Councilman Fulgham - in favor , and Councilman
Gaston - in favor . This motion carried with all in favor .
APPROVAL OF CONSTRUCTION PLANS FOR WATER LINE ON FM 544 :
This is the water line that will come down the extension of
McCreary Road and down FM 544 to Steel Road . This line has
been put in by the developers of Southfork Mobile Home Park .
This developer has been out of $180 , 000 . to $200 , 000 . for
the construction of this line . These plans have been
reviewed by the Engineering Department and are being
recommended to you for approval . Motion was made by
Councilman Gaston to approve for construction . Seconded by
Councilman Fulgham. The vote was as follows : Mayor Akin -
in favor , Mayor Pro Tem Hughes - in favor , Councilman
Simmons - in favor , Councilman Spence - in favor , Councilman

Fulgham - in favor , and Councilman Gaston - in favor . This
motion carried with all in favor .
PRESENTATION BY MEMBERS OF MURPHY CITY COUNCIL RELATIVE TO
WYLIE/MURPHY BOUNDARY LINES : Mayor Poindexter and Mayor Pro
Tem Terry Hall met with Mayor Akin , Councilman Simmons and
City Manager Gus Pappas last Monday and presented a proposal
for establishing an ETJ agreement between the two cities .
The agreement Mayor Poindexter and Mayor Pro Tem Terry Hall
is asking for is to give Wylie the Southfork Mobile home
Park and Wylie is to give Murphy the Santos Property and the
i3righam property . The Murphy Council is concerned due to
Wylie ' s annexations and zoning on FM 544 . Mayor Akin asked
City ?`Manager Gus Pappas if any of this land Murphy would be
getting is annexed . City Manager Gus Pappas said most of it
was already annexed into Wylie . Councilman Fulgham wanted
to know if the Council of Wylie had not gone to Murphy some
three years ago and tried to reach an ETJ agreement which
would have been this extension of McCreary Road and would be
at the point on FM 544 where the City Limits sign is now .
It was agreed upon that Wylie did go to Murphy about three
years ago to try and reach an ETJ agreement .
Mr . Bud Wiser wanted to state on record that Dr . Santos has
some 300 plus acres that he wanted to come into the City of
Wylie . Mr . Wiser said he had made the Murphy City Council
meeting the night before and they were aware that Dr . Santos
wanted to come into Wylie .
Mr . Tom Sonders said the Ben Young track also wants to come
into the City of Wylie , they do not want to go to Murphy
because of water and sewer and their zoning .
Mayor Poindexter asked Mayor Akin when Murphy could expect
some type of answer to this proposal . Mayor Akin said
within the next few weeks .
AWARD BID FOR AIR COMPRESSOR AND JACK HAMMER FOR PUBLIC
WORKS DEPARTMENT : There were several bid letters sent out ,
and two letter returned . One was a no bid and the other was
from Moody Day , Inc . Their bids was as follows :
Air Compressor - $6 , 945 . Jack Hammer - $603 .
Motion was made by Councilman Fulgham to award the bid to

AUTHORIZATION TO SOLICIT "INVITATION TO BIDDER" FOR PURCHASE
OF TRASH BAGS : The Council awarded the last bid for trash
bags on July 10 , 1984 for 75 , 000 bags in boxes of 50 each .
Our sales average 100 boxes/rolls per month and our present
supply is approximately 225 boxes/rolls . Motion was made by
Councilman Spence to grant authorization to go out for bids
for trash bags . Seconded by Councilman Fulgham. The vote
was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes
- in favor , Councilman Simmons - in favor , Councilman Spence
- in favor , Councilman Fulgham - in favor , and Councilman
Gaston - in favor . This motion carried with all in favor .
COUNCIL DISCUSSION : Councilman Simmons wanted to know if
the engineering department took into consideration the
zoning during the platting stage . City Manager Gus Pappas
said this was done during the planning and zoning stage .
Councilman Spence has several complaints from developers
that when builders have supplies delivered and during this
time there is mud and trash left on the roads and on the lot
where delivery has been made . In Dallas , the builders have
to pay for cleaning up these streets . Councilman Spence
would like to see something put in the news letter to the
builders and developers about keeping their areas clean .
Councilman Gaston would like for the City Manager to look
into the cost of two ( 2 ) ventilators for the Community Room .
Mayor Akin would like to see a report to track the
expenditures of the city . Feb . 28th is the Collin County
Public Official banquet . There is reason to believe there
will be around 30O attend this dinner .
City Manager Gus Pappas said the Land Use Master Plan map is
completed to an initial phase . City !'ianager bus Pappas
recognized Mr . Roy Faires for the hours he and his staff put
in on putting this map together . From the initial
completion phase , the city limits is 16 square miles with
the ,,ossibility of being 40 square miles when the city
reaches its future border . In the current city limits , there
is v SF—I , 13% SF-2 , 25% SF-3 and S . 2% ilobile homes . r'or
the future city limits of 40 square miles , 46% public use ,
03% Single Family ( SF-1 10% , SF-2 SF-3 222) Multi use
(apts , duplex , etc . ) 13% , Retail - Industrial 21% . These
projects are done on the staff level of the land use map .
These projects may and will probably change after the
rlanning and Honing and Council meet to complete and
finalize this map .
There being no other business , Mayor Akin called for a
motion to adjourn . Councilman Spence made the motion to
adjourn, seconded by Councilman Spence . All were in favor .

THURSDAY, JANUARY 16, 1986
The Planning and Zoning Commission for the City of Wylie,
Texas met in regular session on January 16, 1986 in the
Wylie Community Center. A quorum was present and notice of
the meeting had been posted for the time and in the manner
required by law. Those present were: Vice-chairman Brian
Chaney, Ben Scholz , Joe Strigle, Ken Mauk and Bill Chapman.
Representing the staff was Gus Pappas; City Manager , Roy
Faires; Code Enforcement Officer , and Susan Marquardt;
Secretary. Those absent were Chairman Kent Crane, and Don
Montgomery.
The meeting was called to order at 7: 00P. M. by Vice-Chairman
Chaney.
ITEM NO. I - APPROVAL OF MINUTES - Vice-Chairman Chaney
asked for any additions or corrections from the minutes.
Ben Scholz mad motion to accept the minutes as submitted.
Ken Mauk second the motion. Motion carried 5-0.
ITEM NO. 2 - APPROVAL OF FINAL PLAT FOR WESTBATE ADDITION -
Mr. Pappas addressed the commission in regards to the final
plat of Westgate addition , which lies on Brown Street or FM
3412 just South of the Birmingham Farms. As a matter of
fact , it is because of Westgate and its road realignment
problems that we had to do some triming up of Westgate and
have to do some rezoning of Birmingham Farms tonight;
because we wanted the two roads to meet and meet properly.
Westgate, in addition to that , has phased their development
into two large blocks; and that final plat is before you
tonight for your consideration. In the review of the plat
there were only two things that gave some concern to the
city staff . One was the problem of insuring that when a
phase is divided up into different lots that all the lots
fit together. Also, that the responsiblity is taken for any
changes. Secondly, you will recall , that in the Westgate
addition there was a long crooked road that joined at FM
3412 and eventually with 544. What has happened is that
different developers want to develop tracts of that
property' The City Staff was not sure if the road would be

dedicated so that it would go all the way through' We do
have the documents in hand this evening to assure that the
road has been dedicated. The second item that gave us some
concern was some building line problems on Westgate Way,
which is the main North-South road curving through the
development. there was a number of lots facing the road of
different categories some were single family, some duplex ,
some faced the road and some side on the road. After some
discussion with the developer and with the City Staff , we
have no problems with that and we recommend approval of the
phase one final plat of the Westgate Addition. After some
discussion with the commission , Bill Chapman made motion to
accept the final plat of the Westgate Addition. Ben Scholz
second the motion. Motion carried 5-0.
ITEM NO. 3_ -_ APPROVAL OF RE-ZONING REQUEST FOR BDRM%NGHAM
FARMS - Mr. Pappas addressed the commission on the property
that is commonly known to us as the "School Land. " This
land was recommended for zoning by this commission only a
few months ago. This change was brought about by the
developers compliance with the City 's request for the
realignment of the road. The developer is resubmitting this
property for some revision of that zoning, at this time.
This will probably not be the last time to see it; even
after this. What appears to have happened is that the
zoning category of SF2 shrank considerably, most of the
shrinkage went into SF3, now we have more SF3 in the
Birmingham Farm than we had before and most of the acreage
use to be in something else came from SF2 a little from SFA
and a little from multi-family. We gave up some acreage
that was zoned multi-family and single- family attached
which was townhomes. And the acreage which was zoned SF2
jumped considerably in acreage zoned for SF3. This caused
very little change in the lot layout; however , there was
some street shifting and that was the major change that
occurred. Tract 17 on the old plan , which is tract 22 on
the new plan, changed completely. It had been a SF2 tract
which is no SF3. In the commercial units, retail increased
entirely on the expense of Bl and B2. Both of them shrank.

Vice-chairman Chaney opened the public hearing, all those
who are in favor of the re-zoning. Bob Stoffels with J. T
Duncan & Associates representing the owners and developers
of this tract , which are: Morgage Corp of Texas and Bill
Gilligan of Zyland Development Company' They will also be
developing the tract as soon as the zoning changes have been
approved and engineering has been completed. After a
lengthy discussion the public hearing was closed and brought
back to the commission. After a lengthy discussion Bill
Chapman made motion to accept the zoning changes except ,
tract 17 be recommend to the council that the zoning change
of 20 acres by the park be changed to SF2 with Boundries of
SF3. Joe Strigle second the motion. Motion carried 5-0.
ITEM NO. 4 - ADJOURN - Motion was made by Joe Strigle for
adjournment. Ben Scholz second the motion. Motion carried
5-0.

THURSDAY, JANUARY 9, 1986
The Zoning Board of Adjustments met in regular session on
Thursday, January 9, 1986 in the Conference Room in the
Community Center. A quorum was present and notice of the
meeting was posted in a time and manner required by law.
Members present were Vice Chairman Art Harris, Cleo Adams,
N. C. Jefferies, Alternate Wanda Graff, Code Enfarcment
Officer Roy Faires, and Ruth Bennett, Secretary.
The meeting was called to order by Vice Chairman Art Harris.
A motion was made to elect a new Chairman to replace Richard
Hampton who had resigned. Cleo Adams nominated Art Harris
and N. C. Jefferies seconded i t. Mr. Faires was ask by Mr.
Harris if he would Chair the nomination, Mr. Faires
accepted. Mr. Faires ask if all were in favor, all were in
favor and none opposed.
APPROVAL OF THE MINUTES^ Corrections to be made on the
minutes from the December 9, 1985 meeting were as follows;
Art stated "the application said forms possibly moved during
rain in course of construction",on", instead of the forms moved
because of rain during construction . Also need to correct
Nancy Graff to Wanda Graff.
N. C. Jefferies made a motion for approval of the minutes and
Cleo Adams second it. All were in favor.
APPROVAL FOR VARIANCE FOR FRONT YARD SET BACK AT LOT 9,
BLOCK Ji POINTE NORTH ADDN. i 515 KAMBER LANE: Mr. Faires
said that Mr. Biggs applied for his building permit and
brought us a plot plan, later we informed him of a zoning
change on his lot from a SF-1 to a SF-2 requiring a 7ft. set
back on the interoir lot line. He would still be requesting
3" variance at the back of the building. If the board would
grant the variance he could tip the building in the rear
still being off 3" but the front up to middle way of the
building would be in conformance and be able to maintain a
20 ft. set back on the street side. Mr. Biggs has submitted
a revised plot plan . For the record staff cannot recommend
approval for any variance.
There was one letter sent out and one returned. It was in
favor, none opposed.
Art Harris ask for motion of approval of this variance, Clec'
Adams made the motion, N. C. Jefferies second it. All were
in favor, none opposed.

THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO
81-••5) , TO CHANGE. THE: ZONING ON THE HEREINAFTER
DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICA-
TION HEREIN STATED; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING

a whole or any part or provision thereof other than the part
so decided to be invalid, illegal or unconstitutional and
shall not affect the validity of the Comprehensive Zoning
Ordinance as a whole.
SECTION 5. That any person, firm or corporation violating
any of the provisions or terms of this ordinance shall be
subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore
amended, and upon conviction shall be punished by fine not
to exceed the sum of two hundred dollars ($200. 00) for each
offense, and that each day such violation shall continue to
exist shall constitute a separate offense.
SECTION 6. It is necessary to give the property described
herein the above mentioned zoning classification in order to
permit its proper development and in order to protect the
public interest, comfort and general welfare fo the City.
Therefore, this ordinance shall take effect immediately from
and after its passage, as the law in such cases provides.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS ANNEXING THE
HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF WYLIE,
TEXAS , AND EXTENDING THE BOUNDARY LIMITS OF THE CITY SO AS
TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE
CITY LIMITS AND GRANTING TO ALL INHABITANTS AND OWNERS OF
SAID PROPERTY, ALL THE RIGHTS AND PRIVILEGES OF OTHER
CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ORDINANCES ,
ACTS, RESOLUTIONS AND REGULATIONS OF THE CITY; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING THE EFFECTIVE DATE OF
SAID ORDINANCE.
WHEREAS , the City Council of the City of Wylie , Texas , finds
that the hereinafter described territory is contiguous and
adjacent to the corporate limits of the City of Wylie ; and
WHEREAS , the City has prepared a service plan for the area ,
a copy of which is attached hereto as Exhibit "A" ; and
WHEREAS , after notice was duly given , public hearings on the
proposed annexation were held by the City Council all in
compliance with Article 970—A , Vernon ' s Annotated Civil
Statutes of the State of Texas ; and
WHEREAS , the City Council has concluded that such area
should be annexed into and made a part of the City of Wylie ,
Texas :
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1 . That the following described territory be , and
the same is hereby , annexed into and made a part of the
corporate limits of the City of Wylie , Texas , and the same
shall hereafter be included within the territorial limits of
said City , and the inhabitants thereof shall hereafter be
entitled to all rights and privileges of other citizens of
the City , and shall be bound by the ordinances , acts ,
resolutions and regulations of the City of Wylie , Texas .
Said territory hereby annexed being described as follows :
38 . 13 acres (Tr . 3) and 18. 13 acres (Tr . 1 ) and 3 . 89
acres (Tr . 2) out of the Guadalupe de los Santos Survey ,
Collin County Abstract No . 1100 and 20 acres (Tr . 6) out
of the Guadalupe de los Santos Survey , Dallas County
Abstract No . 1384 — total 80. 15 acres — located at the
corner of Old Sachse Rd . and Pleasant Valley Rd .
SECTION 2 . It is the intention of the City to annex only
that territory which is legally subject to being annexed by
the City and should any portion of the above described
territory be not subject to legal annexation by the City of
Wylie , Texas , such fact shall not prevent the City from
annexing such portion of said territory which is subject to
legal annexation by the City of Wylie , Texas . Therefore , if
any provision or portion of the territory herein described
is held to be invalid by a court of competent jurisdiction ,
such provision or portion of land shall he deemed as
separate , distinct and independent and such holding shall
not affect the validity of the remaining provisions of this
ordinance or portions of land annexed by this ordinance .
SECTION 3 . This ordinance shall take effect from and after
its passage as the law in such cases provides .

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE , TEXAS ANNEXING THE
HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF WYLIE,
TEXAS , AND EXTENDING THE BOUNDARY LIMITS OF THE CITY SO AS
' TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE
CITY LIMITS AND GRANTING TO ALL INHABITANTS AND OWNERS OF
SAID PROPERTY, ALL THE RIGHTS AND PRIVILEGES OF OTHER
CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ORDINANCES ,
ACTS , RESOLUTIONS AND REGULATIONS OF THE CITY ; PROVIDING A
SEVERABILITY CLAUSE ; AND PROVIDING THE EFFECTIVE DATE OF
SAID ORDINANCE.
WHEREAS , the City Council of the City of Wylie , Texas , finds
that the hereinafter described territory is contiguous and
adjacent to the corporate limits of the City of Wylie ; and
WHEREAS , the City has prepared a service plan for the area ,
a copy of which is attached hereto as Exhibit "A" ; and
WHEREAS , after notice was duly given , public hearings on the
proposed annexation were held by the City Council all in
compliance with Article 970-A , Vernon ' s Annotated Civil
Statutes of the State of Texas ; and
WHEREAS , the City Council has concluded that such area
should be annexed into and made a part of the City of Wylie ,
Texas :
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE , TEXAS :
SECTION 1 . That the following described territory be , and
the same is hereby , annexed into and made a part of the
corporate limits of the City of Wylie , Texas , and the same
shall hereafter be included within the territorial limits of
said City , and the inhabitants thereof shall hereafter be
entitled to all rights and privileges of other citizens of

the City , and shall be hound by the ordinances , acts ,
resolutions and regulations of the City of Wylie , Texas .
Said territory hereby annexed being described as follows :
84 . 98 acres (Tr . 10) out of the Guadalupe de los Santos
Survey , Dallas Co . Ab . 1384
SECTION 2 . It is the intention of the City to annex only
that territory which is legally subject to being annexed by
the City and should any portion of the above described
territory be not subject to legal annexation by the City of
Wylie , Texas , such fact shall not prevent the City from
annexing such portion of said territory which is subject to
legal annexation by the City of Wylie , Texas . Therefore , if
any provision or portion of the territory herein described
is held to be invalid by a court of competent jurisdiction ,
such provision or portion of land shall be deemed as
separate , distinct and independent and such holding shall
not affect the validity of the remaining provisions of this
ordinance or portions of land annexed by this ordinance .
SECTION 3 . This ordinance shall take effect from and after
its passage as the law in such cases provides .

STATE OF TEXAS
COUNTY OF ROCKWALL *
CITY/COUNTY AGREEMENT
WHEREAS , the City of Wylie , hereinafter called "City" and
the County of Rockwall , Texas , hereinafter called "County" ,
want to enter into an agreement for the "City" to furnish
fire protection for those citizens of the "County" who
reside in the non-contiguous portion or northwest corner of
the "County" . That portion of the "County" to be served by
the "City" is bounded on the east by Lake Ray Hubbard ;
bounded to the west by the "County/Dallas County line ;
bounded to the south by Liberty Grove Road and the
"County/Dallas County line ; and bounded to the north by the
"County/Collin County line (Attachment 1 ) ; and
WHEREAS , Article 4413 ( 32c) , Vernon ' s Annotated Civil
Statutes , provides authorization for local governments to
enter into contracts ;
NOW THEREFORE , THIS MEMORANDUM OF AGREEMENT is hereby made
and entered into by the "City" and "County" upon and for the
mutual consideration stated herein ;

described , from the date of this agreement through
December 31 , 1986 , the "County" will pay , upon receipt
of billing, the sum of seventy-five dollars , ( $75 .00) .
Said agreement shall remain in force and effect
automatically renewing itself , annually , until either
the County of Rockwall or the City of Wylie chooses to
terminate or amend said agreement . The party desiring
to amend or terminate this agreement shall notify the
other party of their desires or intentions ninety (90)
days prior to any such action in order to allow time
for notice and discussion prior to action .

Gentlemen:
On February 3, 1986, I filed a Statement of Intent (Attachment No. 1) to change
the rates charged for natural gas service in Wylie. The new rates will result
in an estimated annual revenue increase for Lone Star's Wylie distribution system
of $32,8/45.O0.
The proposed increase in annual revenues is intended to allow Lone Star Gas Company
the recovery of its expenses and also to provide Lone Star with the opportunity
to earn a fair and reasonable rate of return upon the investment in the Wylie
distribution system. This return, of course, goes to pay the people whose monies
are invested in the system.
The revenues, expenses and investment on which our filing is based have been
measured as of June 30, 1985, this is the end of the test year. The proposed
rate is based upon sales volumes (use per customer) measured as of that same date.
Attachment No. 2 is the summary of the Wylie distribution system's revenue require-
ment which is supported by documents recently filed. with the city. The revenue
required to overate this system, as with most other businesses in Wylie, equals
the wholesale cost of the product plus operating expenses, federal income tax and
a return on investment sufficient to make it worthwhile to stay in business.
Lone Star's last rate increase in Wylie occurred in November, 1982. Since that
time, revenues have become inadequate to cover operating expenses and still allow
a reasonable return. Even though these expenses have continued to rise, Lone Star
Gas Company still has one of the lowest average gas costs and operating costs per
customer among the major gas utilities. With this proposed increase, Lone Star
will. be able to continue to provide its customers in Wylie an excellent quality
of service at the lowest possible cost.
Because one of the greatest concerns in any rate proceeding is the impact of the
increase upon the consumer, I have attached a bill comparison using the current
and the proposed rates (see Attachment No. 3) .

STATEMENT OF INTENT TO CHANGE RESIDENTIAL AND COMMERCIAL RATES
TO THE CITY OF WYLIE:
COMES NOW Lone Star Gas Company, a Division of ENSERCH
CORPORATION (Lone Star) , a public utility under Article 6050 et. seq.
V.A.C. S. and Article 1446e V.A.C.S. , and files this its Statement
of Intent to Change Residential and Commercial Rates in the City
of Wylie, Texas , under the provisions of Article 1446e, Section 5. 08 ,
V.A.C.S.
I .
Lone Star proposes to change its rates , and the details
of the proposed changes in rates are as follows :
1. Name of Utility - Lone Star Gas Company
2 . Description of Area Affected - City of Wylie, Texas
3 . Proposed Tariffs & Schedules :
A. The following rates are the maximum applicable to residential
and commercial consumers per meter per month or for any part
of a month for which gas service is available at the same
location. Summer rates shall be applicable between the meter
reading dates in May and October ( five months) . Winter rates
shall be applicable at all other times.
Residential: Winter Summer
Customer Charge $6 . 5000 $4 . 5000

If the service period is less than 28 days in the winter
months , the winter customer charge is $. 2321 times the
number of days service.
If the service period is less than 28 days in the summer
months , the summer customer charge is $ . 1607 times the
numer of days service.

Bills are due and payable when rendered and must be paid
within ten days from monthly billing date.
B. Gas Cost Adjustment :
Each monthly bill at the above rates shall be adjusted for
gas cost as follows :
( 1) The city gate rate increase or decrease applicable to
current billing month residential and commercial sales
shall be estimated to the nearest $0. 0001 per Mcf based
upon:
(a) A volume factor of 1. 0526 determined in establishing
the above rates for the distribution system as the
ratio of adjusted purchased volumes divided by adjusted
sales volumes .
( b) The city gate rate estimated to be applicable to volumes
purchased during the current calendar month, expressed
to the nearest $0 . 0001 per Mcf ( shown below as "Re") .
(c) The base city gate rate of $4 . 0200 per Mcf.
( 2) Correction of the estimated adjustment determined by Item 3B ( 1)
above shall be included as part of the adjustment for the
second following billing month. The correcting factor
( shown below as "C") shall; be expressed to the nearest
$0 . 0001 per Mcf based upon:
(a) The corrected adjustment amount based upon the actual
city gate rate, less
( b) The estimated adjustment amount billed under Item 3B
(1) above , divided by
(c) Distribution system residential and commercial sales
Mcf recorded on the Company ' s books during the prior
year for the month that the correction is included
as part of the adjustment.
( 3) The adjustment determined by Item 3B (1) and Item 3B ( 2)
above shall be multiplied by a tax factor of 1. 04172 to
include street and alley rental and state occupation tax
due to increasing Company revenues under this gas cost
adjustment provision.
In summary, the gas cost adjustment (GCA) shall be determined
to the nearest $0 . 0001 per Mcf by Item 3B (1) , Item 3B ( 2) ,
and Item 3B ( 3) as follows :

C. Tax Adjustment :
The tax adjustment shall be an amount equivalent to the
proportionate part of any new tax, or increased tax, or any
other governmental imposition, rental, fee or charge (except
state, county, city and special district ad valorem taxes and
taxes on net income) levied , assessed or imposed subsequent
to July 1, 1985 , upon or allocable to the Company ' s distribution
operations , by any new or amended law, ordinance or contract.
D. Rate Case Expense :
If rate case expense is incurred in this current case, it is
the intention of Lone Star Gas Company to recover the current
and any unrecovered prior rate case expense through a surcharge
designed for a six-month nominal recovery period. The surcharge
per Mcf would be calculated by dividing the rate case expense
to be recovered by one-half of the adjusted annual sales volume
to residential and commercial customers . When a surcharge is
applicable, monthly status reports will be provided to account
for the collections .
E. The following service charges shall be applicable :
( 1) Reconnect Charge $25 . 00
( 2) Return Check Charge 7 . 50

based upon Current Annual Revenue from Residential and Commercial
Customers (Test Year ended 06 30 85) of $790 , 597 and Estimated
Annual Revenue under the proposed rates of $823 ,442 .
