ITEM NO . 1 - APPROVE PROCLAMATION FOR SESQUICENTENNIAL DAY
This item is placed on the agenda at the request of Mrs .
Lydia Greer of the Wylie Middle School PTA . They are
sponsoring a Sesquicentennial celebration on May 17 and have
asked the Council to proclaim this as Sesquicentennial Day
at the Wylie Middle School .
ITEM NO . 2 - ACCEPTANCE OF RESIGNATION OF GELINE DODD - This
item is placed on the agenda for your action after receiving
a letter from Mrs . Dodd in the City Secretary ' s office on
April 23 , 1986 .
ITEM NO . 3 - ACCEPTANCE OF RESIGNATION OF DR . JOE FULGHAM
A letter rescinding his oral resignation has been received
in the City Secretary ' s office . The City ' s legal counsel ,
Larry Jackson , has advised that this letter makes Dr .
Fuigham an authorized member of the City Council , duly
elected by the citizens . However , this item remains on the
agenda by request of Councilwoman Sandra Donovan .
ITEM NO . 4 - ACCEPTANCE OF RESIGNATION OF MAYOR DON HUGHES
See comments on item no . 4 .
ITEM NO . 5 - CALL FOR SPECIAL ELECTION TO FILL VACANCIES ON
THE COUNCIL - This item is placed on the agenda in
compliance with the City ' s Home Rule Charter . Pages 2a and
2b in your packet will explain .
ITEM NO . 6 - AUTHORIZATION FOR REFERENDUM ON CURRENT
MUNICIPAL COMPLEX PROPOSAL - This item was placed on the
agenda by a councilmember ' s request at the last meeting .
The exact language of the referendum can be worked out when
the election is called . Basically , the issue would be
whether to approve or not approve the site , plan and monies
represented by the current plan . This vote could be on the
same election as the election for Mrs . Dodd ' s replacement .
ITEM NO . 7 - APPROVE AMENDMENT TO MOBILE HOME PARK ORDINANCE
This item is placed on the agenda at the request of Mayor
Pro Tem , Harold Spence in response to the City ' s legal
counsel . The amendment specifically deletes the not more
than four ( 4 ) model years old mobile homes provision from
the ordinance . The Council can , if it wishes , add the
provision of HUD approved construction .
ITEM NO . 8 - APPROVE ANNEXATION ORDINANCE FOR SOUTHFORK
MOBILE HOME PARK - This item is placed on the agenda at the
request of Mayor Pro Tem Harold Spence . See comments on
previous agenda summary .
ITEM NO . 9 - APPROVE ZONING ORDINANCE FOR SOUTHFORK - See
comments for Item No . 8 .

an oral overview presentation should the Council desire

ITEM NO . 18 - APPROVE ORDINANCE PROHIBITING THE PUBLIC TO
SPEAK ON AN ITEM AFTER THE COUNCIL HAS VOTED - This item is
placed on the agenda at the request of Councilwoman Donovan
who has advised the staff that she will have additional
items for your review and possible inclusion in this
ordinance at the meeting on Tuesday night .
ITEM NO . 19 - CITIZEN PARTICIPATION - Not an appropriate

The three firms named on the agenda were those selected as
finalists to be considered as consultants for the design and
construction of the proposed sewage treatment plant for the
City .
ITEM NO . 21 - AUTHORIZE GRANTING OF FULL RESPONSIBILITY FOR
THE SEWAGE TREATMENT PLANT TO NTMWD - Staff does not
recommend approval . There is nothing that they can do for
us that we cannot do for ourselves and save the overhead .

ITEM NO . 23 - AUTHORIZATION TO GO OUT FOR BIDS FOR MUNICIPAL

item and it passes on August 9th , then it will be October
before we can have the bids back .

TEXAS SESQUICENTENNIAL CELEBRATION
WHEREAS, The Wylie Middle School PTA recognizes the importance
of the Texas Sesquecentennial Birthday:
WHEREAS, The Wylie Middle School PTA is sponsoring a celebration
which includes a day of games, which begins with a
pancake breakfast and ending with "Happy Birthday, Texas"
cake. Between these events will be hot air ballon rides,
5K and 10K run, flag-raising ceremony with an air salute by
WW II planes, auction, square dance presentation, and many
more activities.
NOW, THEREFORE, I, DON HUGHES, BY THE AUTHORITY VESTED IN ME AS MAYOR

I talked with City Attorney Larry Jackson this morning and in accordance
with the City Charter, there will have to be a special election called
for the vacancy on the Council. The next general election date is
the second Saturday in August (Aug. 9) .
You can find this in the Home Rule Charter, Section 6 Vacancies,
Forfeiture, Filling of Vacancies, Parg. C. A copy of this is
attached.

C. FILLING OF VACANCIES
A single vacancy in the city council - shall be
filled within thirty (30) days of the occurrence
of the vacancy by a majority vote of the remaining
members of the city council by selection of a
person qualified for the position as described in
this charter. This appointee shall serve the
unexpired term for the place for which he was
appointed;
The city council shall not; however, fill more
than one (1) vacancy by appointment within a six
(6) month period, and in case a vacancy has been
filled by the city council within twelve (12)
months prior to a subsequent vacancy, or before a
subsequent vacancy bas been filled, or if more
than one (1) vacancy occurs at the same time, the
_city council shall order a special election
within thirty (30) days of the last vacancy to
elect the successor or successors to the office or
offices vacated. Vacancies filled by special
election shall be for the remainder of the term.
However, if the vacancies occur within one hundred
twenty (120) days of a regular election, then no
special election shall be called, and the

WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO
81-5) , TO CHANGE THE ZONING ON THE HEREINAFTER
DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICA-
TION HEREIN STATED; PROVIDING A REPEALING CLAUSE;
PROVIDING ASEVEF:AB I L I T`r CLAUSE; PROVIDING
PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO
EXCEED THE SUM OF TWO HUNDRED t$ ZOO. OO) FOR EACH
OFFENSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the City Council of
the City of Wylie, Texas, in compliance with the laws of the
State of Texas with reference to the granting of zoning
changes under the zoning ordinance and zoning map, have
given requisite notices by publication and otherwise, and
after holding due hearings and affording a full and fair
hearing to all property owners generally, the said Governing
Body is of the opinion that the said change of zoning which
is on application of Southfork LTD should
be granted and the Comprehensive Zoning Ordinance of the
City of Wylie should be amended in the exercise of its
legislative discretion:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1 . That the Comprehensive Zoning Ordinance of the
City of Wylie, Texas, be and the same is hereby amended by
amending the Zoning Map of the City of Wylie, to give the
hereinafter described property a new zoning district
classification to-wit:

Said property being described as follows:
125 Acres out of the J. Mitchell Survey Abstract # 589 (Commonly
known as Southfork Mobile Home Park)

SECTION 2. That all ordinances of the City in conflict with
the provisions of this ordinance be, and the same are
hereby, repealed and all other ordinances of the City not in
conflict with the provisions of this ordinance shall remain
in full force and effect .
SECTION 3. That the above described property shall be used
only in the manner and for the purposes provided for- in the
Comprehensive Zoning Ordinance of the City as amended herein
by the granting of this zoning classification.
SECTION 4. That should any parauraph, sentence,
subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional , illegal or invla.id ,
the same shall not affect the validity of this ordinance as
a whole or any part or provision thereof other than the part
so decided to be invalid, illectal or unconstitutional and
shall not affect the validity of the Comprehensive Zonind
Ordinance as a whole.
SECTION 5. That any person, firm or corporation violatino
any of the provisions or terms of this ordinance shall be
subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, a.s heretofore
amended, and upon conviction shall be punished by fine not
to exceed the sum of two hundred dollars ($200. 00) for each
offense, and that each day such violation shall continue to
exist shall constitute a separate offense.
SECTION 6. It is necessary to give the property described
herein the above mentioned zoning classification in order to
permi t its proper devel opment and in order to protect the
public interest, comfort and general welfare fo the City.
Therefore, this ordinance shall take effect immediately from
and after its passage, as the law in such cases provides.

TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE
CITY LIMITS AND GRANTING TO ALL INHABITANTS AND OWNERS OF
SAID PROPERTY, ALL THE RIGHTS AND PRIVILEGES OF OTHER
CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ORDINANCES ,
ACTS , RESOLUTIONS AND REGULATIONS OF THE CITY; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING THE EFFECTIVE DATE OF
SAID ORDINANCE.
WHEREAS, the City Council of the City of Wylie , Texas , finds
that the hereinafter described territory is contiguous and
adjacent to the corporate limits of the City of Wylie ; and
WHEREAS , the City has prepared a service plan for the area ,
a copy of which is attached hereto as Exhibit "A" ; and
WHEREAS , after notice was duly given , public hearings on the
proposed annexation were held by the City Council all in
compliance with Article 970—A , Vernon ' s Annotated Civil
Statutes of the State of Texas ; and
WHEREAS , the City Council has concluded that such area
should be annexed into and made a part of the City of Wylie ,
Texas :
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1 . That the following described territory be , and
the same is hereby , annexed into and made a part of the
corporate limits of the City of Wylie , Texas , and the same
shall hereafter be included within the territorial limits of
said City , and the inhabitants thereof shall hereafter be
entitled to all rights and privileges of other citizens of
the City , and shall be bound by the ordinances , acts ,
resolutions and regulations of the City of Wylie , Texas .
Said territory hereby annexed being described as follows :
173 . 5 acres out of the 0. Shelby Survey , Collin County
Abstract 799 owned by the United States of America .
SECTION 2 . It is the intention of the City to annex only
that territory which is legally subject to being annexed by
the City and should any portion of the above described
territory be not subject to legal annexation by the City of
Wylie , Texas , such fact shall not prevent the City from
annexing such portion of said territory which is subject to
legal annexation by the City of Wylie , Texas . Therefore , if
any provision or portion of the territory herein described
is held to be invalid by a court of competent jurisdiction ,
such provision or portion of land shall be deemed as
separate , distinct and independent and such holding shall
not affect the validity of the remaining provisions of this
ordinance or portions of land annexed by this ordinance .
SECTION 3 . This ordinance shall take effect from and after
its passage as the law in such cases provides .

that the hereinafter described territory is contiguous and
adjacent to the corporate limits of the City of Wylie ; and
WHEREAS , the City has prepared a service plan for the area ,
a copy of which is attached hereto as Exhibit "A" ; and
WHEREAS , after notice was duly given , public hearings on the
proposed annexation were held by the City Council all in
compliance with Article 970—A , Vernon ' s Annotated Civil
Statutes of the State of Texas ; and
WHEREAS , the City Council has concluded that such area
should be annexed into and made a part of the City of Wylie ,
Texas :
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1 . That the following described territory be , and
the same is hereby , annexed into and made a part of the
corporate limits of the City of Wylie , Texas , and the same
shall hereafter be included within the territorial limits of
said City , and the inhabitants thereof shall hereafter be
entitled to all rights and privileges of other citizens of
the City , and shall be bound by the ordinances , acts ,
resolutions and regulations of the City of Wylie , Texas .
Said territory hereby annexed being described as follows :
38. 30 acres (Tr . 6) and 6.4 acres (Tr . 7) out of the S .
Barrow Survey , Collin County Abstract 49 and being
Federal land owned by the United States of America -
total 44 . 34 acres .
SECTION 2 . It is the intention of the City to annex only
that territory which is legally subject to being annexed by
the City and should any portion of the above described
territory be not subject to legal annexation by the City of
Wylie , Texas , such fact shall not prevent the City from
annexing such portion of said territory which is subject to
legal annexation by the City of Wylie , Texas . Therefore , if
any provision or portion of the territory herein described
is held to be invalid by a court of competent jurisdiction ,
such provision or portion of land shall be deemed as
separate , distinct and independent and such holding shall
not affect the validity of the remaining provisions of this
ordinance or portions of land annexed by this ordinance .
SECTION 3 . This ordinance shall take effect from and after

AN ORDINANCE OF THE CITY OF WYLIE , A HOME RULE POLITICAL
SUBDIVISION OF THE STATE OF TEXAS , PROHIBITING PUBLIC
DISCUSSION OF ANY ITEM FOLLOWING A VOTE OF THE COUNCIL .
WHEREAS , the City Council of the City of Wylie has
determined a need to inihibit public discussion in open
meeting ;
THEREFORE , we the City Council of the City of Wylie do
ordain that the members of the public , present at a City
Council meeting , will be prohibited from speaking regarding
any item following the vote of the Council .
EFFECTIVE DATE :
This ordinance shall become effective immediately upon
approval and passage by the City Council of the City of
Wylie .
PENALTY :
Any person found to be in violation of this ordinance
may be fined not less than $1 . 00 nor more than $200 . 00
upon conviction .
