ITEM NO . 1 - ACCEPT TEMPORARY UTILITY EASEMENT - This item
is placed on your agenda to facilitate the installation of
the temporary sewer line from Southfork Mobile Home Park .
The property is owned by Mr . B . C . Wood and is located north
of FM544 and along FN544 on the south side for a site to
place an intermediate pump station .
ITEM NO . 2 - AUTHORIZATION TO GO OUT FOR BIDS FOR INLET WORK
The work referred to in this item is for the Nortex Tank
site inlet work . We are not yet certain that bidding this
item will be necessary because we are not sure the cost will
exceed the $5000 . 00 mark . However , in order not to delay
this work , we are asking for your authorization to seek bids
should they be necessary to complete this work .
ITEM NO . 3 - AUTHORIZATION TO GO OUT FOR BIDS FOR NTMWD
SEWER SERVICE LINE WORK - We are asking your authorization
to go out for bids for this work should the cost exceed
$5000 . 00 and because NTMWD has requested an outside
contractor do the work and that could increase the cost .
ITEM NO . 5 - WORK SESSION ON ANNEXATIONS - This is the first
of the work sessions we have discussed . The staff will
present an overview of State law , authority , history of
Wylie , etc . This presentation should enhance your
understanding of annexation and the mechanics of how it
operates as well as the negatives and benefits of
annexation . At the close of the session we will review the
policy that has been established up to the present time . We
invite your participation and input in order to help you
establish a clear working knowledge of how annexation works
in the State of Texas .

TEMPORARY UTILITY EASEMENT

COUNTY OF COLLIN
KNOW ALL MEN BY THESE PRESENT THAT B. C. Wood , hereafter
termed GRANTOR, whether one or several , of the County of
Collin , State of Texas, for and in consideration of the sum
of five hundred dollars and no cents ($500. 00) , and other
good and valuable consideration to GRANTOR in hand paid by
the City of Wylie, the receipt and sufficiency of which is
hereby acknowledged and confessed , have GRANTED and
CONVEYED, and do by these presents GRANT and CONVEY unto the
City of Wylie the following described tract or parcel of
land situated in Collin County, Texas, for use as a
temporary utility easement upon/or in which a sanitary sewer
may be constructed in accordance with the following
conditions:
1 . Minimum cover of eighteen ( 18) inches.
2. Back:f i l l of trench to be natural grade.
3. The City shall maintain backfill against any settlement
or erosion.
4. No above ground structures.
5. Removal , if implemented, is preferred to take place
during off season.
6. If removal is deemed necessary in a time period other
than off-season , damages in the amount of Five Hundred
dollars and no cents shall be paid to GRANTOR by the
City of Wylie.
7. Property shall be returned to natural grade upon
completion of sanitary sewer line removal .
and being more particularly described as follows:
BEING a 20 foot wide temporary easement in the 37. 03 acre
tract conveyed to B. C. Wood , of which 33. 70 acres is
situated in the Moses Sparks Survey, Abstract No. 849 and
3. 33 acres is situated in the G. W. Gunnell Survey, Abstract
No. 351 of Collin County, Texas as recorded in Volume 332,
page 137 of the Deed Recored of Collin County , Texas and
being more particularly described as follows:
COMMENCING at the Northwest corner of the said 37. 03 acre
tract of land and bearing East a distance of 821 . 80 feet to
the Point of Begining which point is an iron rod in the
Southeast corner of the Paul P. Taylor 27. 44 acre tract.
THENCE East a distance of 694. 22 feet to an iron rod which
is the Northeast corner of the said 37. 03 acre tract ;
THENCE South 2 degrees West a distance 654. 04 feet to an
iron rod for a corner;
THENCE West a distance of 221 . 76 feet to an iron rod for a
corner;
THENCE South 3 degrees West a distance of 556. 28 feet to an
iron rod for a corner which is in the North right-of-way
line of the St. Louis and Southwestern Railway Co. ;
THENCE North 84 degrees West a distance of 857, + or - feet
along the North right-of-way line of the St. Louis =.

line of FM 544 and the East property line of 86. 03 acre
tract of P. C. Wood;
THENCE North 77 degrees 1 minute 40 seconds West a distance
of 23. 00 feet for a corner;
THENCE North 39 degrees 59 minutes 30 seconds West a
distance of approximately 31 . 00 feet to the POINT OF
BEGINING of the tract of land which is in the south right-
of-way line of FM 544;
THENCE continuing on along the South right-of-way line

RE : ANNEXATIONS
As a result of numerous meetings , discussions and decisions
with the previous Councils , a policy regarding annexation
was established . This policy set forth guidelines which
directed the actions of the staff and myself in this area .
Because there are numerous new members of the City Council
who are not aware of these decisions , the staff needs to
review these policies and determine if they are still the
appropriate direction desired by this new Council . They are
in no particular order of priority as follows :
1 . Only the Council may approve or deny an
annexation . The staff has no right or authority
to decline to accept a voluntary annexation when
it is requested . Unless such request is not
legal or is decided already by some previous
boundary agreement .
2 . That the staff should seek to establish boundary
agreements with surrounding cities and should be
watchful of protecting our ETJ from encroachment .
3 . That the lake annexations should proceed up to
FM546 on the western tributary and up to the
second bay and Ticky Creek on the eastern
tributary of Lake Lavon . Said annexations should
include parks but no private property .
4 . Involuntary annexations should be started when the
property in question would help create our fixed
boundary .
5 . Involuntary annexation should be started when the
property in question is conducting or is suspected
of considering conducting a undesireable business
or subdividing in a manner non-consistent with our
subdivision ordinances .
6 . Involuntary annexations could also be instituted
on large tracts of undeveloped land in order to
bring that land clearly under our control for
zoning and subdivision . Staff could initiate ,
based on its own opinion , that such annexation was
in the best interest of the City . The City
Council would retain the final authority by the
passage or denial of the actual ordinance .
7 . Involuntary annexations should avoid properties
that are already developed or subdivided and might
represent a burden to the City .
8 . Voluntary annexations are encouraged , they extend
our ability to control the growth of the community
by zoning . While ETJ allows subdivision control ,
only actual annexation can control uses like
mobile home parks and salvage yards where no
subdivision is actually occurring .
