04-09-1985 (City Council) Agenda Packet AGENDA SUMMARY TUESDAY, APRIL 9, 1985 ITEM NO. 1 - APPROVAL OF MINUTES - No additions or corrections . ITEM NO. 2 - OATH OF OFFICE TO NEWLY ELECTED COUNCIL MEMBERS ITEM NO. 3 - RESOLUTION TO RECOGNIZE MUNICIPAL CLERKS CERTIFICATION PROGRAM - Mrs . Jones , our City Secretary , and her regional chapter of the Texas City Clerks and City Secretarys Association has asked that the Council consider supporting this law which would support and recognize the certification process for city secretaries . The law does not make certification mandatory but rather supports and recommends the concept that city secretaries should be provided with a program of career development . ITEM NO. 4 - ZONING OF TEXAS FENCE AND SPA - This property is described as three acres out of the Wm. Sachse Survey , Abstract 835 . The Planning and Zoning recommends to the council , by unanimous vote , a zoning of B-2 for this tract . This zoning would be compatible with the current use and with projected zoning patterns for the area . ITEM NO. 5 - ZONING ORDINANCE FOR TEXAS FENCE AND SPA - See comments for item number four . ITEM NO. 6 - ZONING OF ONE ACRE IN STEEL INDUSTRIAL PARK - This property is described as one acre out of the Wm. Sachse Survey , Abstract 835 . The Planning and Zoning Commission recommends to the City Council , by unanimous vote , Industrial zoning designation for this tract of land owned by Alex Anderson . ITEM NO. 7 - ZONING ORDINANCE FOR ONE ACRE IN STEEL INDUSTRIAL PARK - See comments on item no . six . ITEM NO. 8 - FIRST PUBLIC HEARING ON ANNEXATION OF 124.22 ACRES - This property is described as 124 . 22 acres out of the G. F . Gunnell Survey , Abstract 351 , Moses Sparks Survey , Abstract 849 ; Wm . Patterson Survey , Abstract 716 and J . W. Mitchell Survey , Abstract 589 . The Planning and Zoning Commission recommends approval of the petitions for annexation for this property by unanimous vote . This property is more commonly known as Lake Ranch Estates . As you will recall , we have been having conversations with Mr . Gilbert Welch , a property owner in this area , for many months . Mr . Welch is the one who came to us initially with a request for city services in this area . He is responsible for gathering together the current group of property owners to collectively pay for the necessary water improvements both to the property and within the property . We have already received those payments . Mr . Welch has acted as go between informing the property owners that water service and later sewer service would only be available if the property owners voluntarily annexed into the city . They all agreed . Since we are now involved in the process of extending that line it is timely to begin the annexation process . This action also helps our position relative to the City of Murphy . Mr . Welch also agreed , voluntarily , to pay a building permit fee and build his home under city codes and with city inspections . ITEM NO. 9 - FIRST PUBLIC HEARING ON ANNEXATION OF 295.284 ACRES NEAR GLEN KNOLL MOBILE HOME PARK - This property is described as 295 . 284 acres out of the R. D . Newman Survey , Abstract 660 - owner George Lewis . The Planning & Zoning Commission recommends , by unanimous vote , approval of this annexation petition . This tract is the large one south of both the mobile home park and the city landfill and stretches from east to west to almost SH 78 to almost S . Ballard . There is no cloud over this annexation as our right to annex this property was determined long ago by the annexation of the landfill area . Sachse can have no argument over this annexation . ITEM NO. 10 - PRESENTATION BY HONEY CONSTRUCTION COMPANY - Mr. Mike Boney has requested to be placed on the agenda for the opportunity to appear before the City Council . If his conversation with both Mr . Faires and myself are an indication of his intentions , then he intends to seek , from the council , relief from the staff ' s findings that the concrete paving which he was contracted to do in the Meadows Subdivision does not meet our minimum standards as outlined in the Subdivision Ordinance prior to the past amendment . The requirement at that time , was that streets shall be 6 inches thick and a minimum of 3000 psi of strength. In one area , of approximately 100 feet of linear length , Mr . Honey ' s streets fail in a number of locations to meet these standards after several retestings . For your information , this is a portion of the street that was poured during our past bad weather where it froze that night . The two alternate proposals that Mr . Boney has offered is that we accept a longer maintenance contract or insert into our ordinance a factor for error of plus or minus so much percent from the minimum. In either case , such action , if considered by the council , would require an amendment to the subdivision regulations . ITEM NO. 11 - AUTHORIZATION FOR PLAYGROUND EQUIPMENT - In their regular meeting on Tuesday , April 2 , 1985 , the Parks and Recreation Board voted to recommend construction of a piece of playground equipment for the Community Park . This structure will require the expenditure of approximately $4000 . 00 . This figure reflects the cost of materials and some playground swings . City employees will do the actual construction , assembly and installation . The configuration of this area would be a sand area of 100 by 100 feet with a large wooden type jungle gym piece of equipment erected within it . In addition, other items could easily be added later . The sanded area will have a wooden retaining wall surrounding it . This figure also includes money to plant weeping willow trees along the drainage ditch area next to the new picnic tables . ITEM NO. 12 - AUTHORIZATION OF FUNDS TO MATCH WSA FUNDS FOR SPRINKLER SYSTEM AT COMMUNITY PARK - The WSA has requested that the city match the funds which it raises through tournaments to install an underground sprinkler system on at least two ball diamonds outfields . The extent of the city ' s liability could be set at $4500.00 which is the full cost which has been estimated for sprinklering one field . The WSA will meet on Monday night prior to your meeting and Mr . Morgan is expected to notify or to attend the council meeting that they are preaared to pay their share and how much. Mayor Pro Tem Hughes attended the Parks Board meeting and can provide additional comment about the discussion . I4,01c.e_L. This property is located on Hooper Road , south of FM 544 . This property is owned by Duane and Alice Helmberger . Mayor Akin opened the public hearing , there being no questions or opposition , the public hearing was closed . FINAL FOR CONSTRUCTION PLAT FOR 544 INDUSTRIAL PARK : There was some discussion on the cul-de-sac , but this seems to be the only turn around for fire trucks . Century Trucking is next to this and there is no reason to make a street that goes through Century Trucking . Motion was made by Councilman Simmons to approve the final plat for construction . This motion carried with all in favor . CONSIDER REQUEST TO STATE HIGHWAY DEPT . ON SPEED LIMIT ON HIGHWAY 78 : This request is to lower the speed limit on State Highway 78 from Wylie Butane to Muddy Creek from 55 mph to 40 mph . Motion was made by Councilman Fulgham to instruct staff to request this speed limit change on State Highway 78 . Seconded by Councilman Adams . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - in favor . This motion carried with all in favor . CONSIDER REQUEST TO STATE HIGHWAY DEPT. FOR TURN LANE ON STATE HIGHWAY 78 : This request is for turn lanes from Highway 78 onto FM 544 (Kirby St . ) . Motion was made by Councilman Adams to instruct staff to request turn lanes on State Highway 78 and FM 544 (Kirby) . Seconded by Councilman Martin . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Gaston - in favor , Councilman Fulgham - in favor , Councilman Adams - in favor , and Councilman Martin - — in favor . CITIZEN PARTICIPATION : Mr . Fred Ouellette of Woodhollow Drive said the traffic behind his house which is on Akin Lane has become a race track for kids on motor bikes , and also a lot of speeding cars at night . City Manager Gus Pappas wanted to know if Mr . Ouellette has contacted the police station about his . Mr . Ouellette replied no . City Manager asked Mr . Ouellette to call the police station and report the racing the next time it happened , since the police are aware of this and are trying to watch this area . � f GENERAL COUNCIL DISCUSSION : Councilman Martin wanted to know if there was anything that could be done to get the area around the post office cleaned up . The building plus the outside area was in very poor concition for the type building and usage it receives . Also , there are no post office boxes available to the new residents moving into Wylie . Mayor Pro Tem Hughes wanted to know if there was any way there could be four (4) lanes of traffic from Wylie Butane through Wylie . Also when the crew is out patching streets , there is a large hole on Second Street and Highway 78 . There is also two rent houses on Secor.d Street and Highway 78 that need to be checked out . There appears to be more than one family living in these two houses . 3w .Y ,k 55 City Manager Gus Pappas reported on The Meadows , the staff received additional core samples , one of the main streets feeding off Stone Road (approximately 90 ft . ) has to be corrected . This means taking up the street and repouring it . Cement contractor has been given these instructions , but wants to come before the council before he takes up this street and repours . Also , the foundation for the water tank at Steel Industrial Park has been poured . The crew is working on the erection of the tank at Nortex site . Mayor Akin wanted to know how many was going to the Collin County Public Officials meeting on Thursday . There were twelve ( 12) who said they would go . The Chamber dinner is Wednesday , and wanted to remind the council of this . Motion was made by Councilman Martin to convene into executive session under the authority of Article 6252-17 of V . A . Kent Crane , Chairman bl 1 MINUTES PARKS & RECREATION BOARD TUESDAY, APRIL 2, 1985 The Parks & Recreation Board for the City of Wylie, Texas met in regular session in the council chambers at City Hall on Tuesday, April 2, 1985 at 7 :00 p.m. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were Chairman Retha Tibbals, Derek Ammerman, Don Hughes, Curtis Hale, John Morgan and Don Whitt. Absent were Lowell Brewster and Duane Helmberger. Representing the City Staff were City Manager, Gus Pappas; Direcor of Public Works, Bill Windham; Secretary, Barbara LeCocq; Secretary, Susan Marquardt; and Parks Supervisor, Marlin Goen. ITEM NO. 1 APPROVAL OF MINUTES - Chairman Tibbals asked if there were any additions or corrections to the minutes of March 5, 1985. Don Hughes made motion to approve the minutes as submitted. Motion seconded by Curtis Hale. Motion carried 4-0, ITEM NO. 2 PROGRESS ON THE PLAYGROUND EQUIPMENT - Bill Windham stated that he had done some research on playground equipment. On the 3 H swing structure now cost $3,413.00. The price for the same thing including the labor is $1 ,031 .38, buying material and putting together ourself. Bill Windham also informed the board that we looked into some Weeping Willows to put along the ditch. Putting them 30 feet between, we will need 22 of them. The lowest bid so far is $17 .96 each this was from two bids waiting on the third. There was a lenghthy discussion and the board also told Bill Windham to use his own discretion on the retainer wall . Don Whitt moved to proceed with construction on our own, and Don Hughes seconded the motion. Chairman Tibbals motion has been made and seconded that we proceed by building our own. Motion carried 5-0. Chairman Tibbals asked John Morgan if he would like to start discussion concerning the sprinkler system, it'was turned over to Derek Ammerman. Derek Ammerman had a report on a sprinkler system out of Richardson. The system is a computer type where you punch in the days and time period you want to water; its a Toro System Commercial Super with rubber covers with pop up heads. For a 380 foot radius would be $4,100.00 a field. After a lenghthy discussion Chairman Tibbals recommended to the board that we have action on this recommedation. John Morgan representing the WSA will take the recommendation to his board next Monday. Don Hughes will address the City Council concerning matching funds with WSA. The board also were in agreement to get a formal written bid on the sprinkler system. Don Whitt asked the board if all are in agreement to go ahead and take action on the system tonight. Don Whitt motioned. Derek Ammerman seconded. The motion was carried 5-0. Chairman Tibbals made a recommendation of putting up a volleyball court in the park. Derek Ammerman motioned. John Morgan seconded. Approved 5-0. 2 Bill Windham stated that we were working with T.P. & L to get lights stretched out from the road up to the Library on up to the parking lot down to the pavilion. We also made repairs to the roof and inside ceiling which was damaged from a storm. We attended• Collin County Fireman's Association meeting at Murphy Fire Department and received $650.00 from Collin County for first quarter fire runs in 1985. In April the new fire station will be finished and we are now ready to plan our Grand Opening. Chief Allen attended a Hazardous Material Accident Handling School , and a E.M.T. refresher school .
