ITEM NO . 3 - VALIDATION OF BALLOTS - This is a housekeeping
matter required by law in order to hold the election on
April 6th .
ITEM NO. 4 - PUBLIC HEARING ON ANNEXATION OF PROPERTY ON
HOOPER RD . - This property is described as 7 . 50 acres out of
the Wm. Sachse Survey , Abstract 835 . It is located on
Hooper Rd . just south of FM 544 . The Planning and Zoning
Commission recommends approval of this petition by a vote of
6-0 . The property is contiguous to the City on three sides
making it a legal candidate for annexation . This is the
property currently owned by the Helmbergers and would tie
Steel Industrial Park to Hooper Rd . on the Northwest corner .
ITEM NO. 5- APPROVAL OF LIBRARY ORDINANCE - This ordinance
will repeal Ordinance 74-12 . This ordinance establishes
penalties for violation of the rules of the library ,
defacing property of the Wylie Public Library and for the
failure to return any item lent to them by the Wylie Public
Library in a "timely manner" . The passage of this ordinance
puts much better "teeth" into the enforcement and fine
system that the librarian will have to work with .
ITEM NO . 6 - APPROVAL OF AMENDMENT TO FEE ORDINANCE - This
amendment provides for the payment in lieu of construction
on periemeter streets by developers in Wylie . It also
provides for the warranty bond required on publicly
dedicated utilities and streets . These two items are
mentioned in the subdivision ordinance but not set amount
has been established . The subdivision ordinance refers to
the fee ordinance as being the place to go for that
information ; therefore , it needs to be amended into the fee
ordinance , which will be accomplished by this act . You will
recall that for the past several months , we have been using
the figure of $1 . 85 per square foot with our developers .
While that is a good figure to begin with , recent facts have
shown that it is probably not high enough and it did not
take into account the difference between 6 and 8 inch thick
streets . It also was a figure that evolved from informal
discussions and letters written to developers from my
office . While I am comfortable that each of you knew and
understood where that figure came from and what figure wa
being used , it is still much more appropriate to have
official council action on the exact figure that is to be
quoted .
ITEM NO. 7 - APPROVAL OF USER FEES FOR LANDFILL - Our
recently approved landfill lease contract with Moore
Industrial Disposal allows them to set fees for various
types of special users . It exempts city residents who
present a current water bill but sets rates for commercial
establishments and for any person or business outside the
city . The contract stipulates that while Moore Industrial
has the right to request certain rates that the Council must
officially act on adopting these rates . The rates presented
appear to be consistent with similar charges for the area
and should help Moore to defray some of its cost and better
hold the line on residential users .
ITEM NO. 8 - APPROVAL OF LONE STAR GAS REPAIR AGREEMENT -
Lone Star Gas Company has approached the City of Wylie with
a proposal for an agreement to no-bill each other for the
cost of repairs or lost product as a result of accidentally
cutting lines during work accomplished within the city by
either group . Lone Star Gas has suggested that this sort of
agreement has been made with numerous other cities in the
area . Mr . Windham , our public works director , has also had
these kinds of agreements in other cities and has found them
to work satisfactorily in balancing out the extent of
liability on both sides . Your attention is drawn to the
fact that the agreement does not include contracted crews
which Lone Star Gas may from time to time hire . It only
protects bonafide Lone Star Gas employees doing work . Out
bad recent experience has been primarily with GTE and Cable
Vision contract crews , thus the risk that we are granting is
really smaller than what we perceive . In addition , there is
a significant pricing difference in the cost of products
lost . On the city ' s side , it might be possible for Lone
Star Gas to cut a large water line which would then spill
water at a rate of approximately . 95 per thousand gallons ;
however , such water loss , while it might look dramatic ,
would take a long time to amount to a really significant
bill in terms of lost product . On the gas company ' s side ,
we recently had an incident where city crews busted a large
diameter high pressure gas line . The amount of lost gas
from this incident alone may very easily be in excess of
$1000 . 00 . Therefore , there seems to be great incentive for
reaching such an agreement and at least trying it for , let ' s
say , a one year period and then reviewing the results . A
representative of the gas company , one Mr . W . D . Lowe , will
be at the meeting should you require additional information .
ITEM NOS . 9 AND 10 - APPROVAL OF BILLS PAID AND ACCOUNTS
PAYABLE - Of note , in the bills paid , are two items . The
first is a payment from the general fund to the interest and
sinking fund of $19 , 600 . This payment completes our annual
required payment for bonded indebtedness reserve as required
by the bond covenants and good generally accepted accounting
procedures . I believe this is the earliest in the year that
we have been able to accomplish this task . Second , a group
of expenditures in the middle of the page of various amounts
totaling approximately $2400 has been made in order to
provide the police reserves with the necessary basic
equipment they need to perform in that capacity . You will
recall we discussed this possibility earlier if we found
during the year that the initial investment in gun , belt
etc . began to deter volunteers from joining the reserves .
We have found that to be the case and therefore , have
acquired a small amount of basic equipment that may be
shared by each of the volunteers while they are on duty .

FEBRUARY 26 , 1985
7 : 00 P . M .
The Wylie City Council met in regular session on Tuesday ,
February 26 , 1985 at 7 : 00 P . M . in the Council Chambers at
City i-fall . Mayor Akin presided . A quorum was present and
notice of the meeting had been posted for the time anu in
the manner required by law . Those present were Mayor John
Akin , Mayor Pro Ten Don Ilughes , Councilmen Percy Simmons ,
Ceo Adams , William Martin , Randall Gaston , and Joe Fulgham ,
City Manager Gus Pappas , City Secretary Carolyn Jones , Code
Enforcement Officer Roy Faires , Public Works Director Bill
Windham , John Seeley , Truett Smith , Carl Riehn , Fred
Ouellette , Elayne Mayes , Scott Dorsey from the Wylie News ,
and Ken Swayze , David Stevens , Bill Avery , Reagan Coo!. and

Mayor Akin called the meeting to order and Councilman Martin
gave the invocation .
APPROVAL OF MINUTES : There being no corrections or
additions to the minutes , motion was made by Mayor Pro Tem
Hughes to approve and submitted , seconded ov Councilman

questions or opposition , the public hearing was closed .
APPROVAL OF ORDINANCE ABANDONING A ROAD EASEMENT THROUGH THE
WYLIE CEMETERY : There exists on the records two easements
of public right-of-ways within the Wylie Cemetery . One is.
100 feet wide , the other is 24 feet wide . Obviously these
easements will never be used for there is no road with whitL.
they can connect . Further , there is a great probability
that actual cemetery plots have been used that lie within
this road easement . While this idea is clear I would
suggest that we abandon these easements to the Wylie
Cemetery Association and thus remove the potential for
future misunderstanding . Motion was made by Mayor Pro Tem
Hughes to approve the ordinance abandoning the above road
easements . Seconded by Councilman Simmons . The vote was as
follows , Mayor Akin - in favor , Mayor Pro Tem Hughes - in
favor , Councilman Simmons - in favor , Councilman Gaston - in
favor , Councilman Fulgham - in favor , Councilman Adams - in
favor , and Councilman Martin - in favor . This motion

APPROVAL OF ELECTRICAL CODE ORDINANCE : After some
discussion of this ordinance , the following recommendations
were made : in Section 3 . 3 . 2 the pharse SUCH ENTRY SHOULD BE
IN ACCORDANCE WITH LOCAL, STATE, AND FEDERAL LAW, should be
added ; Section 8 . 4 0 NO GROUND FAULT PROTECTION SHALL BE
REQUIRED should be deleted . Motion was made by Councilman
Gaston to approve with the above additions and corrections .
Seconded by Councilman Adams . The vote was as follows Mayor
Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman
Simmons - in favor , Councilman Gaston - in favor , Councilman

PRESENTATION TO THE CITY COUNCIL BY REPRESENTATIVES OF
NORTH TEXAS MUNICIPAL WATER DISTRICT : This presentation was
given by Mr . Carl Riehn , Mr . David Stevens , Mr . Bill Avery
and Mr . Reagan Cook . The presentation was about the future
water supply for the cities which North Texas Municipal
Water District supplies . Attached and a part of these
minutes is the presentation given by the above
representatives .
PRESENTATION BY CITIZENS FOR REMOVAL OF "NO PARKING" ZONE ON
THE WEST SIDE OF FIFTH STREET IN FRONT OF VILLAGE EAST
APARTMENTS : The person wishing to give this presentation
was not present at the meeting . Mayor Pro Tem Hughes wanted
to know if this area had been checked out and if the signs
were needed for public safety . City Manager Gus Pappas said
this area has been checked out and the signs were needed in

RATE INCREASE TO FUND
FUTURE WATER SUPPLIES
Wylie, Texas
Carl Riehn, Executive Director of North Texas Municipal Water District,
introduced officials from NTMWD that met with the Wylie City Council . They
described the NTMWD plan for obtaining additional raw water to meet the demands
of customer and member cities and the rate increase which has been set in motion
to fund those improvements. The NTMWD Board of Directors recently increased
the water rate by 5C per 1000 gallons for the year 1984-85. It is the first phase
of a 5 year rate increase program which will total 30C per 1000 gallons. The
additional revenue will be used, beginning this year, to fund $105, 000, 000 in
capital improvements necessary to meet the projected needs of the communities
already being served by NTMWD. The improvements include construction of a raw
water pipeline from Lake Texoma and parts of a program to construct two
additional reservoirs.
Currently, NTMWD serves approximately 560, 000 people through customer and
member cities. That demand, of course, varies with the weather conditions. David
Stephens, Manager of the NTMWD Water System, explained that current
projections indicate that the population of current customers and members will
grow to 1, 000, 000 by the year 2000. In order to meet the projected demand of 157
MGD at that time, NTMWD has studied potential raw water sources and has
adopted a plan for obtaining the most economical supplies. The projections used
by NTMWD are based on the most reliable figures available from the customer and
member cities, the North Central Texas Council of Governments, and the Texas
Department of Water Resources. Stephens emphasized that changes in several of
the variables could change the ultimate need either up or down, however, N TMWD
plans provide for some flexibility in meeting that demand.

The first new supply of raw water will be obtained through a pipeline from Lake
Texoma, partially shared with the Greater Texoma Utility Authority. The Texoma
project will provide NTMWD with an additional 35 MGD in Lake Lavon. That
supply of raw water should be available in Lavon by 1987. Cooper Lake, the long
delayed Corps of Engineers' project, is expected to supply an additional 44 MGD
of raw water beginning in 1991. In 1995, the New Bonham Reservoir will be
opened and will supply NTMWD with 73 MGD more water.
The 5 year, 304 total rate increase program will fund $105, 000, 000 in
improvements. Of that expense, the NTMWD share of the Texoma project will be
approximately $28 million, and the New Bonham Project will be $52 million. The
additional $25 million in the program is necessary for Water System Improvements
required to pump and transport water to the locations required by the customers
and members. The 5 year increase plan was adopted to minimize, to the extent
possible, the impact of the expenses on the individual cities. Bill Avery,
Administrative Officer for NTMWD, explained the effect of the bond sale on the
NTMWD Revenues and Expenditures and the impact on the average water user. A
typical water customer uses 10, 000 gallons per month and had a city bill of $12.00
for water service in the NTMWD service area. The NTMWD impact on that water
bill, exclusive of any other necessary city increases, would increase that citizen's
bill directly by $3.00 per month to $15.00 by the end of the 5 year program if all
of the increase is passed on to the individual water user. The rate increase to
the cities will be 104 per 1000 gallons in 1985-86, and 54 per 1000 gallons in each
of the subsequent 3 years.

APPROVAL OF $4600 OVER-SIZING COST OF WATER/SEWER LINES IN
EAST RIDGE ADN WYNDHAM ADDITIONS : As provided in the
Subdivision Ordinance , Section 6 .06 and Section 6 . 07 , the
city may elect to participate in a portion of the cost for
over-sizing . After meeting with the principals regarding
East Ridge Addition and Wyndham Estates , the staff
recommends paying for the over-sizing of the water/sewer
lines running through these developments for lines over 10"
in size . The cost to the City for these improvements is
$4600 . 00 . Motion was made by Councilman Gaston , seconded b .

APPROVAL OF FINAL PLAT FOR "THE MEADOWS" AND THE DCDICATIC ;
OF STREETS AND UTILITIES : City Manager Gus Pappas said the
only question at this time was staff was hoping to receive
the break test for the streets and alleys and also hoping to
receive the check for permimeter streets . The cost of the
permimeter streets is $108 , 178 . 50 , and the cost is reduced
by $1 , 100 . 00 for over-sizing in drainage . The City Staff
has received a maintenance bond . Motion was made by
Councilman Simmons to approve and sign plat after the test
results are in and found to be up to standards and after thL,
money for permimeter streets have been received . Seconded

INDUSTRIAL PARK : City Manager said because this improvement
is to be dedicated to the City of Wylie , upon completion , it
was felt that the plans should be approved in concept by the
City Council . The plans do meet and conform to the
subdivision ordinance . Motion was made by Councilman
Simmons to approve . Seconded by Councilman Adams . The vote
was as follows , Mayor Akin - in favor , Mayor Pro Tem Hughes
- in favor , Councilman Simmons - in favor , Councilman Gaston
- in favor , Councilman Fulgham - in favor , Councilman Adams
- in favor , and Councilman Martin - in favor . This motion

APPROVAL OF FINAL PLAT FOR 544 INDUSTRIAL PARK : This
development is located on 544 adjacent to Century Ready
The original plat called for a street to bi-sect the
development and end in a cul-de-sac ; however , the staff
participated in meetings with the adjacent property owners
and an agreement was reached to adopt a plan that would use
a common street thus eliminating the need for two streets
opening onto 544 in close proximity . This plat was reviewed
by the proper members of the staff and recommended for
approval to the Planning and Zoning Commission . Planning
and Zoning recommends approval by a vote of 6-0 . City
Manager stated that this plat would have to be approved on
this date as a preliminary plat instead of a final , as the
preliminary plat has not been brought forward . Motion was
made by Councilman Simmons to approve the preliminary plat
for 544 Industrial Park . Seconded by Councilman Martin .
The vote was as follows , Mayor Akin - in favor , Mayor Pro
Tem Hughes - in favor , Councilmam Simmons - in favor ,
Councilman Gaston - in favor , Councilman Fulgham - in favor .

APPROVAL OF REPLAT OF LOTS 2 AND 3 , BLOCK 6 OF KELLERS 1S1
ADDITION : This developer has requested the removal of the
lot line between the two lots making the two into one . The
proper members of the staff have reviewed this replat and
recommend approval . Planning and Zoning recommends approval
by a vote of 6-0 . Motion was made by Councilman Simmons to
approve the replat . Seconded by Councilman Gaston . The
vote was as follows , Mayor Akin - in favor , Mayor Pro Tem
Hughes - in favor , Councilman Simmons - in favor , Councilman
Gaston - in favor , Councilman Fulgham - in favor , Councilmen
Adams - in favor , and Councilman Martin - in favor . This

APPROVAL OF PRELIMINARY PLAT FOR EAST RIDGE ADDITION : This
tract is located south of Old Highway 78 and Eubanks Lane .
City Manager reported that all corrections have been made to
the preliminary plat and the city staff has reviewed this
plat . Planning and Zoning recommends this plat for approval
with a vote of 6-0 . Council wanted to make sure that
Eubanks Lane is checked so that it will join at the other
subdivision without any problems . Councilman Simmons wants
to rename Eubanks Lane to W . A . Allen i31vd . Motin was made
to approve the preliminary plat with the correction of
renaming Eubanks Lane to W . A . Allen Blvd . Seconded by
Councilman Martin . The vote was as follows , Mayor Akin _
favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons
in favor , Councilman Gaston - in favor , Councilman Fulgham --

APPROVAL OF FINAL PLAT FOR REGENCY BUSINESS PARK : This
development is a part of the Steel Industrial Park and is
owned by K . C . Swayze . Mr . Swayze requested that the street
"Regency Drive" be dead-ended with temporary barriers rather
than a cul-de-sac so that it can continue into a development
which he plans for the near future . The developer has
placed a letter on file with the city committing hirnnsel ; to
participate with his fair share in the improvements of Steel
Road . The staff reviewed this plat and recommends approval .
The Planning and Zoning recommends approval with a vote of
6-0 . Motion was made by Councilman Adams to approve the
final plat for Regency Business Park . Seconded by
Councilman Martin . The vote was as follows ; Mayor Akin - in
favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons -
in favor , Councilman Gaston - in favcr , Councilman Fuighac -
in favor , Councilman Adams - in favor , and Councilman Martin
- in favor . This motion carried with all in favor .
APPROVAL OF LANDFILL LEASE WITH MOORE INDUSTRIAL DISPOSAL :
This lease is to re-open the city ' s landfill with Moore
Industrial Disposal taking care of the property plus takins
care of the permit with the State Department . Mayor Pro Tem
Hughes wanted to know if Moore was going to hire someone to
keep the road way up to the landfill picked up . Mayor Pro
Tem Hughes had understood that this would be done . Mr .
Cornell of Moore Industrial said that only the immediate
area at the gate and on the property of the landfill would
be policed . Councilman Simmons said he didnot have a
problem with the lease but he wants to make sure that the
city has an ordinance to take care of the people dumping on
the roadway . Motion was made by Councilman Admas to approve
and sign the lease . Seconded by Councilman Gaston . The
vote was as follows , Mayor Akin - in favor , Mayor Pro Tem
Hughes - in favor , Councilman Simmons - in favor , Councilman

CITIZEN PARTICIPATION : Mr . 'Fred Ouellette wanted to kno .
why the cost of the new subdivision ordinance was $ 15 . 06 ,
feels this is to high . Also out in Steel Industrial Part ,
there is a mobile home park started . City Manager said
this mobile home park was not a part of Steel Industria !
Park and was not in the city limits . Also the cost of tl:r
subdivision ordinance is charged for only the printing of
the pages , not for the binder or cover or time spent in
putting it together .
COUNCIL DISCUSSION : Mayor Pro Tem Hughes wanted to thank
Roy for getting GTE contractors on patching the roads the%
have torn up .
Councilman Adams said he had had a report that there were
three ( 3) fire plugs in the Oaks Addition that are not

connected up. Mr . Faires said that instructions had been
given to connect these fire plugs and this would be checked
out first thing in the morning .
City Manager Gus Pappas reported on the computer purchases
as some of the councilmembers has requested at the last
meeting . Todate , the city has spent a total of $8 , 042 . 15
with approximately 46% left in the budget for programs , 747,
left for suplies and 28% left for equipment .
Motion was made by Mayor Pro Tem Hughes to convene into

PLANNING AND ZONING COMMISSION
THURSDAY , FEBRUARY 28 , 1985
The Planning and Zoning Commission for the City of Wylie ,
Texas met in regular session on Thursday , February 28 , 1985
in the Council Chambers at City Hall . A quorum was present
and notice of the meeting had been posted for the time and
in the manner required by law.
The meeting was called to order at 7 : 00 P .M. by Chairman ,
Kent Crane . Commission members present were Ken Mauk , Sarah
Connelly , Harold Spence and Nancy Conkle . Bryant Barry was
absent . Representing the staff were Gus Pappas , City
Manager , Roy Faires , C. E.O. and Barbara LeCocq , secretary .
ITEM NO. 1 - APPROVAL OF MINUTES - Chairman Crane called for
any corrections or additions to the minutes . There being
none , a motion was made by Ken Mauk and seconded by Harold
Spence to approve the minutes as submitted . Motion carried
5-0.
ITEM NO. 2 - CONDUCT PUBLIC HEARING ON THE ZONING OF 21 . 0541
ACRES - Chairman Crane described this property as being
21 .0541 acres out of the L. K . Pegues Survey , Abstract 703
and the I . & G.N. Ry . Co . Survey , Abstract 1061 located on
the southeast corner of Hooper Rd and FM 544 . The
petitioner has asked for "I" Industrial zoning . The public
hearing was opened by Chairman Crane . There being no
comments from the floor , the public hearing was closed and
the item returned to the table for discussion . Harold
Spence noted that the request for "I" zoning was compatible
with the area . Kent Crane asked other commission members
how they felt about a business designation for the property
fronting on FM 544 . He said he felt to set this trend as
the annexations move along 544 toward town would be an
esthetic plus for the area .' It was also discussed that
there is very little B-2 zoning on the city . After lengthy
discussion regarding B-2 ( Business 2 ) zoning for this piece
of property as well as others in the area , a motion was made
by Harold Spence to recommend to the City Council of Wylie
that the front 200-400 ft . of the 21 . 0541 acres out of L . K .
Pegues Survey and I . & GN. Ry . Co . Survey be designated "B-
2" Business 2 zoning with the remainder receiving a
designation of "I" Industrial zoning . The motion was
seconded by Ken Mauk . sMotion carried 5-0 .
ITEM NO. 3- CONDUCT PUBLIC HEARING ON ANNEXATION OF 7 . 50
ACRES ON HOOPER ROAD - Chairman Crane described this tract
of land as being 7 . 50 acres out of the Wm. Sachse Survey ,
Abstract 835 . It is located on Hooper Rd . The public
hearing was opened by Chairman Crane . There being no

Council of Wylie approval of the annexation petition of 7 . 50
acres out of the Wm . Sachse Survey , Abstract 835 , owner
Duane and Alice Helmberger . Motion seconded by Nancy
Conkle . Motion carried 5-0 .
ITEM NO. 4 - APPROVAL OF PRELIMINARY PLAT FOR SOUTHPLACE
ESTATES - Chairman Crane called on City Manager Pappas for a
staff report . Mr . Pappas reported that this plat has been
through the proper staff review. The property will be
platted for development in three phases . The staff is
working with the developers at this time on a sewer program
to serve the project . The developer has been apprised of
perimeter street requirements . Mr . Pappas also pointed out
that the long block has 29 lots , which is not usually
desireable in a development ; however , could see no real
advantage to breaking the block . Chairman Crane asked for
comments from the commission members . Harold Spence
commented that he would like to see Aspen Drive lining up
with Stoneybrook St . and make that a continuation of
Stoneybrook.
Roy Faires , C . E.O. said that he thought there should be some'
sort of sidewalk through the development for school children
to travel on their way to school rather than for them to
have to walk out on the main thoroughfare . Discussion with
the City Manager and the commission members and the
principals showed that the city would be willing to grant a
variance on the side yards between lots 20 and 21 and lots
10 and 11 in order to gain an easement for a four ( 4 ) foot
sidewalk . Such sidewalk to be installed by the developer
and dedicated to the city . After lengthy discussion a
motion was made by Harold Spence to recommend approval of
this plat to the City Council with the following
stipulations : ( 1 ) two ( 2), easements , between lots 20 and
21 and lots 10 and 11 for a school walkway and (2 ) to line
up Aspen with Stoneybrook across- S . Ballard Street . Motion
seconded by Ken Mauk. Motion carried 5-0 .
There being no further business , Chairman Crane said he
would entertain' a motion to adjourn . Nancy Conkle made the.
motion to adjourn , seconded by Ken Mauk . Meeting adjourned
by Chairman Crane .

PARKS & RECREATION BOARD
TUESDAY , MARCH 5 , 1985
The Parks and Recreation Board for the City of Wylie , Texas
met in regular session in the council chambers at City Hall
on Tuesday , March 5 , 1985 at 7 : 00 P . M . A quorum was present
and notice of the meeting had been posted for the time and
in the manner required by law . Those present were Chairman ,
Retha Tibbals , Derek Ammerman , Don Hughes , Curtis Hale , John
Morgan and Don Whitt . Absent were Lowell Brewster , Stuart
Wallace and Duane Helmberger . Representing the city staff
were City Manager , Gus Pappas ; Director of Public Works ,
Bill Windham; Secretary Betty Snow and Secretary Barbara
LeCocq .
The meeting was called to order at 7 : 00 P. M. by Chairman
Tibbals .
ITEM NO . 1 - APPROVAL OF MINUTES - Chairman Tibbals asked if
there were any additions or corrections to the minutes .
Chairman Tibbals said she felt the large park should be
referred to as the Community Park rather than the City Park .
She asked for comments . After some discussion , Don Hughes
made a motion to approve the minutes as submitted . Motion
seconded by Curtis Hale . Motion carried 6-0 .
Chairman Tibbals asked City Manager Pappas to make a
presentation to the board concerning the short and long
range plans for city parks .
City Manager Pappas first presented a copy of the P & R
budgets to each member . He then introduced Bill Windham ,
Director of Public Works who will be the staff
representative to the Parks & Recreation Board and his
secretary , Betty Snow who will keep the minutes . Mr .
Pappas then explained that the new Home Rule Charter
establishes the Parks & Recreation Board and the board will
act in an advisory capacity to the City Council on matters
concerning the parks and recreation activities of the City .
The actions of the board will be transmitted by letter to
the City Council for their consideration and action . Mr .
Pappas then explained the changes in the configuration of
the park from that shown in the original artists concept
drawing . He pointed out the location of the mini-park
located behind Valentine Lane , recently donated to the city .
Mr . Pappas also pointed out on the map areas where the city
would like to develop parks in the future . One such area is
on FM 3412 just south of the lake located on the Birmingham
Trust land . Council is working with the developers for the
dedication of park land to, be kept in a natural state , with
the possible use of the lake for fishing . Also the Muddy
Creek area has some potential for a strip park along the

creek bank . Possibly another formal stylized park on the
Northeast side of the city and another strip park in the
south quadrant of the city . Mr . Pappas said the cite would
keep the board informed when park areas are acquired .
ITEM NO . 2 - ELECTION OF VICE-CHAIRMAN - Don Whitt nominated
Lowell Brewster for vice-chairman , nomination seconded by
Curtis Hale . Don Hughes moved the nominations be closed .
Lowell Brewster elected unanimously .
ITEM NO. 3 - REVIEW STATUS OF PROJECTS NOW IN PROGRESS -
Bill Windham reported that the pavillion at the community
park is now completed . The sidewalks are poured and the
picnic tables in place . At the mini-park ( Valentine Lane
park) the posts for the backstop are not yet set . They are
on site but have not yet been set by T . P . & L. Don Hughes
asked if we are planning to do some landscaping around the
pavillion . Bill Windham said there are plans for
landscaping and hauling sludge to be spread to encourage a
good stand of grass for the area . Don Hughes also asked
when we would be planting trees . Mr . Windham said that it
is difficult to set a time frame since park personnel is
seasonal and the actual time for planting is now , before the
seasonal personnel are on board . However , these projects
will be carried out as soon as possible . Gus Pappas noted
that Mr . Windham feels it would be more effective to hire
one full-time parks employee rather than two part-time
employees .
ITEM NO. 4 - SPRINKLER SYSTEM DISCUSSION - John Morgan ,
representing the W. S . A . stated that there is a severe
problem with watering the baseball fields at the park . They
would like to have a spinkler system similar to that en the
practice fields at the school . Mr . Morgan also stated that
there were volunteers willing to dig the trenches for the
pipe and a donor for the P . V . C . pipe . lie also stated thet
they need supervisory personnel . Mr . Morgan stated that the
W. S .A . would match any ci;y funds used for the sprinkler
system . Don Whitt said he would get in touch with th(
installers and designers of the school ' s sprinkler system .
Derek Ammerman said he would get some prices from a supl; lle ,
he is familiar with .
ITEM NO. 5 - GENERAL DISCUSSION ITEMS -- Chairman Tib .A1 ._

they should consider some playground equipment . Mr . Hughes
commented that the park should be fitted out to serve
families and those people not involved necessarily with the
organized sports activities in the park . Don Whitt stated
that he felt they should look at the area and make a plan
that would incorporate the picnic tables and the playground
area rather than to randomly place the tables . After some

discussion agreement was reached on placing tables a .lon,; t `,r
creek bank more or less ringing the playground area in
semi-circle configuration . The playground area would H
approximately adjacent to the pavillion area , thus makins�
the playground centrally located . Discussion ensued
concerning the cost of the tables . Mr . Pappas and Mr
Windham reported that the tables could be made for a cost
about $200. 00 per table including a concrete pad . Johi.
Morgan made a motion to build five ( 5 ) tables to be located
along the creek bank area . Motion seconded by Don flushes .
Motion carried 6-0 .
Additional discussion concerning a sprinkler system was
held . Several avenues were explored . Mr . Pappas explained ,
after hearing of the potential of revenue from league
tournaments , that a lease purchase plan might be worked out
through the city with a pay-out for the W . S . A .
Don Hughes said the mayor was interested in seeing the
fourth baseball field developed for the use of the general
public . He was not advocating the formal type development
such as that of the other three fields , just a backstop and
a graded lot with bases for a pick-up game or scrub field
for the use of the general public , those not involved with
the organized sports of the W. S . A . The city staff has
agreed to gather prices for a backstop and report back to
the board .
John Morgan said the W . S .A . has acquired some sandy loam and
would like for the city staff to spread it for them . Ise
also wanted to know what could be done about the motorcycles
and three-wheelers that are damaging the fields . Mr . Pappas
said the greatest deterrent is to ticket the violaters .
Chairman Tibbals asked if there was any further discussion .
There being none , she asked for a motion to adjourn . Don
Whitt made the motion to adjourn and Don Hughes seconded .

PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS:
SECTION 1 . That Ordinance No. 74-12 is hereby repealed :
SECTION 2. That every person who shall take from the Wylie
Public Library any book, pamphlet, periodical , paper or
other property, except in accordance with the rules of such
library, shall be deemed guilty of a misdemeanor;
SECTION 3. That every person who shall take or borrow from
the Wylie Public Library any book, pamphlet, periodical ,
paper or other property and neglect , refuse or fail to
return the same within two weeks of the date of mailing a
notice by registered mail with return , receipt requested to
his address, shall be deemed guilty of a misdemeanor ;
SECTION 4. That every person who shall willfully or
wantonly cut, mutilate, mark, tear, write upon, deface or
otherwise destroy or injury in whole or in part , any boos
pamphlet, periodical , map or document , picture, or writ -
or engraved or printed paper belonging to the Wylie PubiT
Library, or shall suffer any such injury to be inflicte,_'
while such property is in his custody , or shall willful ]
wantonly injury any of the furniture or property in th
building of the Wylie Public Library, or shall w:illfi_rlly

wantonly mark or deface or in any way injury the Wylie
Public Library or any part thereof , or any fixtures therein
or appurtaining thereto, shall be deemed guilty of a
misdemeanor;
SECTION 5: That every person who is assessed a penalt. for
failure to timely return any item lent them by the Wylic
Public Library and who refuses to pay the penalty shall be•
deemed guilty of a misdeamenor;
SECTION 6: That any person who violates any provision of
this ordinance shall be deemed guilty of a misdeameanor and
upon conviction therefore shall be fined any sum not
exceeding the limit provided by State Law. Each day the
violation continues shall be considered a separate offense;
SECTION 7: That if any section, sub-section, paragraph ,
sentence, phrase or clause of this ordinance shall be
declared invalid for any reason whatsoever, such decision
shall not effect the remaining portions of this ordinance
which shall remain in full force and effect; and to this end
the provisions of this ordinance are hereby declared to he
severable;
SECTION 8: The caption of this ordinance shall be
published one (1 ) time in a newspaper having general
circulation in the City of Wylie and shall be effective
immediately upon its passage and publication.

AN ORDINANCE OF THE CITY OF WYLIE , A HOME RULE POLITICAL
SUBDIVISION OF THE STATE OF TEXAS , PROVIDING AMENDMENTS TO
ORDINANCE 84-12 WHICH ESTABLISHES VARIOUS FEES FOR THE CITY
OF WYLIE. SPECIFICALLY ADDING A NEW SECTION 6 , PERIMETER
STREETS AND A NEW SECTION 7 , MAINTENANCE BONDS FOR ONE YEAR
WARRANTY ON DEVELOPMENT CONSTRUCTION OF PUBLIC FACILITIES ;
PROVIDING A PENALTY CLAUSE, SEVERABILITY CLAUSE; AND AN
EFFECTIVE DATE.
Whereas , the City Council of the City of Wylie has
determined a need to amend the previous fee ordinance ;
Therefore , be it resolved by the City of Wylie Texas :
The following amendment fees and bonds are adopted by the
City Council of the City of Wylie , Texas , adding said
sections to read as follows :
SECTION 6 : PERIMETER STREETS FEE IN LIEU OF CONSTRUCTION :
As referenced in the City of Wylie Subdivision
Ordinance , developers may in certain approved
circumstances make a payment to the City of Wylie
of funds in an appropriate amount to provide for
the cost of construction of the required perimeter
streets in association with their development .
The fee for such payment in lieu of construction
shall be as follows :
1 . Six inch (6" ) thick required street
construction : $2 .00 a square foot .
2 . Eight inch (8" ) thick required street
construction : $2 . 25 a square foot .
SECTION 7 : MAINTENANCE BONDS
As required by the City of Wylie ' s Subdivision
Ordinance , maintenance bonds to cover the cost of
any repairs that may be required during the one
year warranty period to public works improvements
and facilities dedicated to the City of Wylie at
the time of final plat acceptance shall be in the
amount of ten ( 10) percent of the total value of
all improvements dedicated and shall be delivered
to the City of Wylie prior to the Council ' s
consideration of final acceptance .
PENALTY

Any person , firm, corporation or other entity who is found
guilty of violating the terms of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction of any
such violation , shall be subject to a fine of not less than
$1 .00 no more than $200 .00.
SEVERABILITY
All ordinances or parts of the ordinance in conflict
herewith are specifically repealed and are superceded by
this ordinance. All other parts of such ordinances are not
repealed .
It is hereby declared to be the intention of the City
Council that the sections , paragraphs , sentences , clauses
and phrases of this ordinance are severable and if any
phrase , clause , sentence or section of this ordinance shall
be declared unconstitutional or invalid by any judgement or
decree of a court of competent jurisdiction , such
unconstitutionality or invalidity shall not affect any other
remaining phrase , clause , sentence , paragraph or section of
this ordinance ; and the City Council hereby declares it
would have passed the remaining portions even though it had
known the affected parts would be held unconstitutional .
EFFECTIVE DATE
This ordinance and its amendments and the fees which it
amends shall become effective upon publication .

NOTICE
Ordinance No. 1488, effective December 3, 1984, has amended Landfill User
Fees as follows:
Section 27-32:
C. City residents hauling refuse from their homes to the City Landfill
may use the Landfill at no charge upon presentation of a current or
previous month's utility bill showing evidence of paying a garbage
collection fee. Each such utility bill shall entitle a resident to
two (2) free loads.
D. Operators of vehicles within the Landfill shall follow the traffic
control directions of the sanitation superintendent or designated
agent. Refusal to follow directions shall be a violation of this
ordinance.

Effective November 1 , 1984, Landfill use fees .will increase from -
300 per C.W.T. to 500 per C.W.T. This increase is necessary due to
increased operational cost - and to provide facilities for continued
operations. The conversion_schedule set out below will be- used
until scales are installed at the Landfill and during times when the
scales are inoperable.
It is hoped the increased fee schedule - will not create any major
-problem for the various users of the Landfill , but it should be
recognized that waste disposal is becoming a major problem.- - Should
- - you have- any--questions concerning this matter,-please do not hesitate

of installation or maintenance of the City of Wylie facilities.
It is likewise agreed the City of Wylie, Texas will repair at no
charge any accidental damage to the City of Wylie facilities caused
by employees of Lone Star Gas Company excavating in performance of
their duties of installation or maintenance of Lone Star Gas Company
facilities.
This agreement does not include damage caused by negligence of
Contractors employed by Lone Star Gas Company or Contractors
employed by the City of Wylie, Texas.
This agreement does not release either party from the obligation
of requesting facility locations when excavating is to be done.
This agreement may be terminated at any time by either party in
the event it proves unsatisfactory.

Volunteer Police Unit Monthly Report February 1985
Total number of volunteer hours donated to the PD for month of
February 1985, 402.5.
Of these 402.5 hours, 280 hours represents 4 officers' 70 hours basic
reserve schooling in McKinney; 6 hours were spent on miscellaneous
assignment for the Police Department, 126.5 hours were spent on patrol.
The 126.5 hours represents greater than 10 twelve hour shifts donated
to the department during the month of February.
Terry Minier, Michael Nunns, Bobby Hemby and Ken Simmons were the of-
ficers completing the basic reserve academy.
