01-21-1985 (City Council) Agenda Packet AGENDA SUMMARY CITY COUNCIL JANUARY 21 , 1985 ITEM NO. 1 - APPROVAL OF MINUTES - No additions or corrections . ITEM NO. 2 - CANVASS ELECTION RETURNS - No comments . ITEM NO. 3 - APPROVAL OF ORDINANCE TO ADOPT RESULTS OF ELECTION - This step is taken in accordance with Article 1169 V .A . C. S . It also is the official step adopting Home Rule for the city of Wylie . ITEM NO. 4 - DISCUSSION & DECLARATION OF PLACE SYSTEM FOR COUNCIL MEMBERS - Assuming the Home Rule Charter is passed on Saturday , we will need to be prepared to appoint a councilmember to fill the new position created by the passage of the charter . This will give us the opportunity to make recommendations and to be prepared to make the appointment at the next regular meeting , February 12 , 1985 . In addition , we will need to officially designate the current members ' with their place and term as prescribed in the transitional section of the charter . ITEM NO. 5 - CONSIDER APPOINTMENT TO VACANCY ON CONSTRUCTION TRADES BOARD - Mr . Potter , our master electrician , on the Construction Trades Board moved out of the city ; thus , creating a vacancy on that board which needs to be filled by some individual who is at least a journeyman electrician . If no one can be found , we may , under the provisions of the ordinance , place an ordinary citizen in this position . However , since one of the mainstays of this board ' s work is most often the electrical it would be adviseable to have an electrician in this position . ITEM NO. 6 - APPROVE ANNEXATION ORDINANCE FOR 35. 7 ACRES ON SH 78 - This poperty is described as 35 . 7 acres out of the Duke Strickland Survey , Abstract 841 . It is the property located just south of Roddy and Assoc . on SH 78 . ITEM NO. 7 - CONDUCT PUBLIC HEARING ON ZONING OF 35. 7 ACRES ON SH 78 - This is the property described above . The petitioner has requested industrial zoning . The planning and zoning commission recommends approval by a vote of 6-0 . ITEM NO. 8 - APPROVE ZONING ORDINANCE ON 35 . 7 ACRES ON SH 78 This is the property described above . No further comments . ITEM NO. 9 - CONDUCT FIRST PUBLIC HEARING ON ANNEXATION OF 5.539 ACRES IN STEEL INDUSTRIAL PARK - This property is described as 5 . 539 acres out of Wm. Sachse Survey , Abstract 835. It is one of the two remaining portions of the Steel Industrial Park. The planning and zoning commission recommends approval of this petition by a vote of 6-0 . ITEM NO. 10 - CONDUCT FIRST PUBLIC HEARING ON ANNEXATION OF ONE ACRE IN STEEL INDUSTRIAL PARK - This property is described as one ( 1 ) acre out of Wm. Sachse Survey , Abstract 835 . It , along with the property described in item no . 9 is the last of the Steel Industrial Park . With the annexation of these two tracts , Steel Industrial Park is complete . ITEM NO. 11 - CONDUCT FIRST PUBLIC HEARING ON ANNEXATION OF THREE ACRES ON FM 544 - This property is commonly known as Texas Fence and Spa and is described as three acres out of Wm. Sachse Survey , Abstract 835 . It is located on FM 544 in front of Steel Industrial Park . The planning and zoning commission recommends approval by a vote of 6-0 . ITEM NO. 12 - CONSIDER ADOPTION OF AMENDMENT TO MOBILE HOME PARK ORDINANCE - This document has been prepared keeping in 1 mind points discussed at our last council meeting and also points recommended by the planning and zoning commission . The recommendations of the planning zoning commission are outlined in the minutes found in your packet on pages 7-8 . If the proposed amendments meet with the council ' s approval , this agenda item allows them to be adopted even with changes made at the meeting itself . Should the council desire additional time, we can discuss the matter and place it agin for adoption at our next meeting. ITEM NO. 13 - CONSIDER APPROVAL OF FINAL PLAT FOR ROCKY TOP ADDITION - This tract of land is a 10 acre tract in Steel Industrial Park. It has been reviewed by the appropriate staff members and recommended for approval . The plat review committee recommends approval as does the planning and zoning commission by a vote of 6-0. ITEM NO. 14 - APPROVE RAISE IN PAY FOR VOLUNTEER FIREMEN - This raise in pay has , in fact , been in effect for some time but due to some oversight has not been made official . The Wylie City Council met in regular session on Tuesday , January 9 , 1985 at 7 : 00 P . M. in the Council Chambers at City Hall . Mayor Pro Tem Hughs presided . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were Mayor Pro Tem Don Hughes , Councilmembers William Martin , Cleo Adams , Percy Simmons , Joe Fulgham , City Manager Gus Pappas , City Secretary Carolyn Jones , Public Works Director Bill Windham, Code Enforcement Officer Roy Faires , Chief Abbott , Barron Cook , Scott Dorsey and Elayne Mayes from the Wylie News , Fred Ouellette , Larry Jackson , City Attorney . Mayor John Akin was out of town . Mayor Pro Tem Hughes called the meeting to order and Councilman Adams gave the invocation . APPROVAL OF MINUTES : Motion was made by Councilman Fulgham to approve minutes as submitted . Seconded by Councilman Adams , all in favor . APPROVAL OF ORDINANCE FINDING THE CITY OF WYLIE HAS MORE THAN 5000 INHABITANTS : Motion was made by Councilman Adams and seconded by Councilman Simmons to approve and sign the above ordinance . All in favor . City Manager Gus Pappas said there has been a lot of discussion about the Home Rule Charter and the City ' s ETJ under Texas Law. The above action just approved and passed has given the City of Wylie the one ( 1 ) mile ETJ. The Home Rule Charter does not have to pass in order to be at the one (1 ) mile ETJ . AWARD BID FOR BACKHOE: The City of Wylie received only one bid for a backhoe . This bid came from Mahanay International , Inc . for a 1981 Internatinal Model 280 Series A Loader-backhoe tractor . All standard factory equipment , 24" & 30" buckets , new 18. 4-28 10 ply tires on rear , digmor model 438-4 4 ' hydraulic extendible dipperstick , 90 day parts and labor warranty on engine , transmission , torque converter , rear axle , and hydraulic pumps . Total bid price of $20, 500 . Motion was made by Councilman Simmons to accept bid from Mahanay International , Inc . for the sum of $20 , 500 . Seconded by Councilman Fulgham , all in favor . FINAL PLAT FOR ROCKY TOP DEVELOPMENT : This item was put on the Council agenda prior to going through Planning and Zoning Commission . Therefore , this item will have to be 26 tabled . Motion was made by Councilman Simmons to table the final plat for Rocky Top . Seconded by Councilman Martin . All in favor . APPROVAL OF FINAL PLAT FOR CANTERBURY HILL : Canterbury Hill is an addition being developed in the county but inside the City of Wylie ' s ETJ . This development is located east of Wylie on Beaver Creek Road . City staff reports that Beaver Creek Road was not wide enough and the developer did agree to change the wi'Ith of this road . Also , there is a utility easement which has been made a part of this plat and will always be an open area . There is a 6" water line in this plat but the ordinance of the City of Wylie states this water line should be an 8" line for the right kind of fire protection . The developer has not shown alleys on the plat and the City ' s sub division ordinance does call for alleys . Staff does feel that the alleys are not necessary since these lots are 1 acre or more . Staff does feel there needs to be a sewer system put into this development instead of septic tanks . The City staff has requested the developer to put in sewer lines that will flow by gravity into a holding tank until such time a lift station is in this area . Planning and Zoning made a motion to reject this plat until it complied with the sub division ordinance . The vote was 4 in favor of rejection and 2 abstained . Staff recommends this plat be rejected until it complies with the sub division ordinance . Barron Cook said if the only problem with this plat is the septic tank system , he will be more than glad to put in a sewer system as explained above . Mr . Cook said his engineers has come up with a plat for 20 lots which will bring in additional funds for the cost of this sewer line , but he is not sure he wants to go to 20 lots . This is in an area where there are only one acre or more lots and he does not want to get away from this size lots . Barron Cook said this sub division is two ( 2) miles away from a concrete street and does not feel he should have to put in concrete streets . This is an improvement that is very costly and Mr . Cook does not for see the extra funds for such expense . Mr . Paul Phy , attorney for Mr . Barron Cook , said this was an unusal situation . These people developed Beaver Creek which has approximately 50 lots and now they want to developement an area just north of Beaver Creek , and did not understand this property was in the ETJ of Wylie . The developer has spent a lot of time in this area and does not feel they can come up the standards of the City codes . This would bring the lots to a cost of over $40 , 000 . plus the cost of building a home on the lots . The estimated cost of sewer lines is $71 , 500, this is for 20 lots , an estimated cost for the concrete street is $119 , 185 . The developer does not see why this one section has to be concrete when prior to this sub division will be black top and just south of the sub 27 division it will again be black top roads . Mr . Phy does not feel that the City ' s sub division ordinance addresses the fact of 1 acre country lots for a sub division . Mr . Phy said he agreed that it would take an amendment to the sub division ordinance in order for this plat to be approved . City Manager Gus Pappas asked Mr . Phy if this developer wanted the City to exempt sub division of 17 acres or less from having to comply with the sub division ordinance . Mr . Phy said he would not tell the city what to do but he would like to see an amendment to the sub division ordinance for this type of country developments . Councilman Simmons wanted to know what improvements the developer would make . This developer will bring in a 6" water line from the now existing 6" water line and tie it into a 2" water line , which will loop the system . Will add fire hydrants and put in a holding tank plus sewer lines . Councilman Fulgham wanted to know if the council would annex this property if it was not in compliance with the City ' s sub division ordinance . Councilman Martin said that is why the sub division ordinance was written to help with the future growth and planning of the City of Wylie . Motion was made by Councilman Simmons to deny approval of this final plat because it does not comply with the sub division ordinance for the city . Seconded by Councilman Martin , all in favor . AMENDMENTS TO MOBILE HOME PARK ORDINANCE: City Manager Gus Pappas said there should be some discussion about certain sections of this ordinance . First section is the annual permit fee section 2 . 05 . Staff recommends for your consideration a fee of $20. 00 per lot , instead cf the $150 . per lot . Next section is density requirements . The density in existing ordinance is greater than the lot size of the SF 1 lots in the new zoning ordinance . SF 3 is 6 . 05 units per acre . Staff recommends 7 . 5 density with a lot size of 50 ' X 110 ' . Fencing requirements should read a solid fence instead of brick. The operator of the park must keep the fence in good order . Section 7 . 02 B internal streets will be required to provide the city a public safety access . If the mobile home operator provides two ( 2) off street parking places then the streets can be 27 ' . Section 7 . 03 concerning concrete slab under each mobile home . The tie down may be required to be in concrete but it is not necessary for a slab to be under the entire home . All mobile home parks should be connected to the public water and sewer system of the City , and there must be sidewalks throughout the park . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. The meeting was called to order at 7 : 00 P . M . by Chairman , Randy Gaston . Members present were Bryant Barry , Kent Crane , Harold Spence , Ken Mauk and Nancy Conkle . Sarah Connelly was absent . Representing the city staff were Gus Pappas , City Manager ; Roy Faires , C . E . O . and Barbara LeCocq , secretary . ITEM NO. 1 - APPROVAL OF MINUTES - Randy Gaston reported that there was an error in the vote on Item No . 8 - approval of plat for Canterbury Hill . The vote was 5-0-1 rather than 4-0-2 as reported . There being no further corrections or additions , a motion was made by Bryant Barry and seconded by Ken Mauk to approved the minutes as amended . Motion carried 6-0 . ITEM NO. 2 - CONSIDER APPROVAL OF FINAL PLAT FOR ROCKY TOP ADDITION - Chairman Gaston asked for the recommendation of the staff . Mr . Pappas reported that the plat meets all specifications and regulations of the subdivision ordinance and that the developer has committed to participate in the improvement of Steel Road . The staff recommends approval . Chairman Gaston asked for a report of the Plat Review Committee . Kent Crane reported that the plat meets all specifications and that the Plat Review Committee recommends approval . There being no further discussion by the commission , a motion was made by Ken Mauk to recommend approval o.f the final plat for Rocky Top Addition to the city council of Wylie . Sachse Survey , Abstract 835 . The public hearing was opened by Chairman Gaston . With no comments or questions from the floor , the public hearing was closed and the item returned to the table for discussion . There being no discussion , a motion was made by Ken Mauk and seconded by Harold Spence to recommend to the city council approval of the annexation petition for three ( 3) acres known as Texas Fence and Spa . Motion carried 6-0 . ITEM NO. 5 - CONDUCT PUBLIC HEARING ON ANNEXATION OF 5 . 539 ACRES IN STEEL INDUSTRIAL PARK - This property is described as being 5 . 539 acres out of the Wm . Sachse Survey , Abstract 835 . Mr . Pappas explained that this is the last remaining piece of the Steel Industrial Park . The annexation of this tract of land will complete Steel Industrial Park . The public hearing was opened by Chairman Gaston . No questions or comments from the floor . The public hearing was closed and the item returned to the table for discussion . With no discussion , a motion was made by Bryant Barry to recommend to the city council , approval of the annexation petition for 5 . 539 acres out of Wm . Sachse Survey , owners Bill Davidson and Cecil Grattofiori . Seconded by Harold Spence . Motion carried 6-0 . ITEM NO. 6 - CONDUCT PUBLIC HEARING ON ZONING OF 35 . 7 ACRES LOCATED ON SH 78. - This property is described as 35 . 7 acres out of the Duke Strickland Survey , Abstract 841 . It is located on SH 78 adjacent to Roddy and Associates . Gus Pappas reported that Industrial zoning has been requested by the petitioner . Since this is compatible with zoning in the area the staff recommends approval . The public hearing was declared open by Chairman Gaston . Mr . Henry Martinez asked if Alanis will be continued through to SH 78 . Gus Pappas explained that Alanis is designated as a major thoroughfare and will go through to SH 78 and eventually through to Beaver Creek Road . Percy Simmons , the petitioner , said that plans call for Alanis to be installed as a 22 foot concrete street at this time . The developers are not going to put money into escrow but intend to install the street to SH 78 at the time of development . With no further questions or comments the public hearing was closed and the item returned to the table for discussion . A question from the board asked if the developer had considered retail on the frontage along SH 78 . Mr . Pappas explained that the developer had asked about the allowable uses in industrial zoning and was informed that retail , B- 1 and B-2 uses were also allowable in industrial zoning . There being no further discussion a motion was made by Bryant 24 Barry to recommend to the city council , industrial zoning for 35 . 7 acres described above . Motion seconded by Nancy Conkle . Motion carried 6-0. ITEM NO. 7 - CONDUCT PUBLIC HEARING ON ZONING OF 16 ACRES LOCATED NORTH OF RR ON FM 544 WEST OF COOPER DR . - This property is described as 16 . 6883 acres out of E . C . Davidson Survey , Abstract 266 . It is located north of the railroad tracks east of the Dwight Scott property . The public hearing was opened by Randy Gaston . There being no comments or questions from the floor , the public hearing was closed and the item returned to the table for discussion . Mr . Jim McKnight , petitioner was present and available for questions . There was discussion concerning the request for industrial zoning north of the railroad tracks . Members of the commission felt some reluctance to allow industrial zoning to cross north of the railroad tracks . After much discussion , the concensus of opinion was that the commission would like to see single family 2 north of Fleming Street and multi-family (apartments or duplex ) south of Fleming to the railroad . Mr . McKnight requested to withdraw the item and go back to his partners with the feelings of the commission and resubmit at a later date . Mr . Gaston reminded him that any action by the commission was only a recommendation and if he desired they ( the commission ) could make that recommendation and if it was acceptable to the partners they would not have to come back to P & Z . After lengthy discussion, Mr . McKnight elected to withdraw the item and resubmit . No action taken . Randy Gaston recessed the meeting for ten minutes . Meeting re-convened by Chairman Gaston . Seven ( 7 ) units per acre with a minimum lot size of 50 x 110 ft . Maximum lot coverage 25% . 4 . Pg 6 Add before 7 . 01 "i" "Sidewalks" . Must be two ( 2) feet from curb . 5 . 7 . 01 "i" Fencing requirements . Change "brick" to "opaque" kept in good repair . 6 . 7 . 01 "j" Minimum Size . Change to 900 square feet inside area . 3' 7 . 7 . 02 "b" Internal streets ( pg 6) . Twenty-seven ( 27) foot , concrete streets with curb and gutter with no on-street parking . Require off street parking for three vehicles . Include common guest parking . 25 per unit . 8. 7. 0a ( pg 6) Mobile Home Spaces . Delete last part of paragraph "Concrete slab with permanent tie down embedded in the slab for securing . Slab will be 6 inches in thickness and have a 28-day compressure strength of 3 , 000 psi . The size of the concrete slab upon which a mobile home is placed shall extend at least one ( 1 ) foot outside the walls of that mobile home in all directions . " 9 . 7 . 04 "d .4" ( pg 7 ) . ITEM NO. 9 - CONDUCT WORKSHOP ON PROPOSED ZONING ORDINANCE Chairman Gaston said that due to the late hour and the enormity of the task this item would be postponed to a later date . It was determined that if there is a light agenda for January 24 , this item would be included on that agenda . If not a meeting would be called for January 31 , 1985 at 7 : 00 P. M . for the sole purpose of conducting a workshop on the proposed zoning ordinance . Bryant Barry made a motion to adjourn . Motion carried . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law, In absence of a Chairman, the meeting was called to order at 7 : 27 P .M. by Roy F.aires , Electrical Code Official , Members present were Kevin St . John , Glenn Morrow, John Seeley , and BiII Chapman , Absent were Marvin Blakey and James Seabourne . Present from city staff were Gus Pappas , City Manager , Roy Faires , C ,E .O. and Maureen Dunlop, clerk , ITEM NO. 1 -ORCgANIZATIQN ANQ €LEQIIQN_QF OFFIQQ€RS1 This was a called meeting, Roy Faires , introduced those members who were present . Mr ,Faires asked that in view of the fact that they did not yet have a Chairman , would they mind if he conducted the election of a Chairman. All members concured with this . Mr . Faires asked for nominations for Chairman. John Seeley nominated Kevin St . John, Glenn Morrow seconded the motion. Mr . Faires asked if there were any further nominations , as there were none, Kevin St . John was elected Chairman , Mr . St . John took over the meeting at this point and asked for nominations for Vice-Chairman. Kevin St . John nominated Bill Chapman, Glenn Morrow seconded the nomination . There being no further nominations , nominations were closed, Bill Chapman was elected Vice-Chairman , After some discussion, Bill Chapman made a motion that the board hold called meetings when necessary, and that they meet on Mondays with 72 hrs . notice. John Seeley seconded the motion . Motion carried 4-0 . John Seeley asked if it would be possible to have minutes mailed out to the board members so they could be reviewed while the meeting was still fresh in their minds , Roy Faires said that the minutes would be mailed to them as soon as possible, ITEM NO. - DISCUSSION OF ELFQIRlQAL_QRgINANQg_FQR RECOMMENDATION TO COUNCIL: Bill Chapman made a motion to table the Electrical Code to give the Board more time to study it and until the • 9 remaining place on the board was filled. John Seeley seconded it . Motion carried 4-4 . Roy Faires asked when would they be able to meet again , Monday , Febuary 4 , 1985 was agreed on. AN ORDINANCE AMENDING ORDINANCE NO. 83-18 REGULATING MOBILE HOME PARKS: DELETING SECTION 2.05 ANNUAL PERMIT FEE; ADDING A NEW SECTION 3.02 ; AMENDING SECTION 3 .04 ; AMENDING SECTION► 7 .01 "g" DENSITY REQUIREMENTS ; ADDING TO SECTION 7 . 01 "i" ; CHANGING SECTION 7.01 "i" FENCING REQUIREMENTS ; AMENDING SECTION 7 .01 "j" MINIMUM SIZE OF UNIT; AMENDING SECTION 7 .02 "b" INTERNAL STREETS ; AMENDING SECTION 7 .02 "g" MOBILE HOME SPACES ; AND AMENDING SECTION 7.04 "d .4" ; PROVIDING FOR PUBLICATION OF THE CAPTION; PROVIDING A PENALTY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS ; 2 . 05 ANNUAL PERMIT FEE: delete 3. 02 ANNUAL LICENSE FEE: Twenty dollars ( $20) per space is payable by the licensee or his agent due on or before the 10th day of January each year . 3 .04 LICENSE FEE: All original license applications and license transfers shall be accompanied by a fee of five hundred dollars ( $500) . 7 .01g DENSITY REQUIREMENTS : Mobile home parks shall have a maximum density of seven ( 7) units per gross acre with a minimum lot size of 50 x 110. Maximum lot coverage of 25% . 7 . 01i SIDEWALKS : Must be two ( 2) feet from curb . 7. Oli FENCING REQUIREMENTS : (To be renumbered "j" ) . 1 . Any area that abuts an external street or highway shall be fenced with an opaque fence to a height of eight (8) feet . Such fence to be kept in good repair . 7 . 01j MINIMUM SIZE: Is designated as 900 square feet minimum inside area . (Renumber 7 . 01k . ) 7 . 02b INTERNAL STREETS : 1 . On all internal streets , roads or driveways designed or intended to provide access to two or more spaces , there shall be twenty-seven (27) feet of pavement width with no on-street parking (unobstructed for vehicular access at all times) . 7 . 03 MOBILE HOME SPACES : The area of the mobile home space shall be improved to provide adequate support for the placement of the mobile home , thereby securing the superstructure against uplift , sliding , rotation and overturning due to frost action , inadequate drainage , vibration or other forces acting on the structure . 7 . 04d WATER DISTRIBUTION SYSTEM: 4. The system shall be so designed and maintained as to provide a pressure of not less than thirty-five ( 35) pounds per square inch , under normal operating conditions , at service buildings and other locations requiring potable water supply . PENALTY CLAUSE: Any person who violates any provision of this ordinance shall be deemed guilty of a Class C 1 37 misdeameanor and upon conviction therefor shall be fined any sum not exceeding that established by the Texas State Law. Each day the violation continues shall be considered a separate offense . The caption of this ordinance shall be published one ( 1 ) time in a newspaper having general circulation in the city of Wylie and shall be effective immediately upon it ' s passage and publication .
