09-24-1985 (City Council) Agenda Packet AGENDA SUMMARY TUESDAY, SEPTEMBER 24, 1985 ITEM NO. 1 - APPROVAL OF MINUTES - No addition or corrections . ITEM NO. 2 - CHANGE IN REGULAR MEETING TIME FOR P & Z - This item was placed on the last P & Z agenda by the staff . At their meeting they voted unanimously to recommend a change to the first and third Thursday of each month rather than the second and fourth Thursday . The primary reason for this change is that items usually appear before the P &Z before they are placed on the Council agenda but , with the meeting times set as they are , the P&Z meets after the Council and any item transmitted to the Council , then has a full two week delay. With this change , we feel we can expedite some items , particularly plat approvals. pren _it_aAppo.ctd , this change could not be affected until 1 Jan, 1986 . ITEM NO. 3 - APPROVE ANNEXATION ORDINANCE FOR 128. 12 ACRES ON MCMILLAN ROAD - This is of course simply the formal action to incorporate this property into the City of Wylie . The required public hearings have been held and the 20 day waiting period required by law has been satisfied. ITEM NO. 4 - PUBLIC HEARING ON ZONING OF 128. 12 ACRES ON MCMILLAN ROAD - This property is described as Tract Nos . 6 , 7 and 8 out of the J. Mitchell Survey , Abstract 589 total 128 . 12 acres . The petitioner is asking for agricultural zoning . The P & Z voted 6-0 to recommend agricultural zoning to the City Council . The property has one single residence on it and the rest seems to be primarily used as open pasture land , thus , the requested zoning would be compatable with present use . ITEM NO. 5 - APPROVE ZONING ORDINANCE FOR 128. 12 ACRES ON MCMILLAN ROAD - No further comments . ITEM NO. 6 - PUBLIC HEARING ON ZONING AND CONCEPT PLAN FOR BENEDICT ESTATES - This property is described as 57 . 1017 acres out of the Francisco de la Pina Survey , Abstract 688 . The petitioner is asking for a change in zoning to Planned Development . Under the terms of our subdivision regulations , the request for PD zoning must be accompanied by either a concept plan, which is comparable to a preliminary plat or a development plan which is a much more detailed plan, comparable to the final plat . This developer has chosen to present the concept plan along with the request for PD designation. The development plan will come before you at a later date . The Planning and Zoning Commission, at their last regular meeting voted 6-0 to recommend approval of the PD designation , along with approval of the concept plan. ITEM NO. 7 - APPROVE ZONING ORDINANCE FOR BENEDICT ESTATES No futher comments . ITEM NO. 8 - PUBLIC HEARING ON ANNEXATION OF 2 ACRES ON 3412 This property is described as 2.97 acres out of the E. C . Davidson Survey, Abstract 266 located on FM 3412. The P & Z voted 6-0 to recommend approval at their last regular meeting . Several months ago , the staff contacted the property owners along FM 3412 and advised them of the fact that the City was going to be extending a water line along that route and invited them to share in the cost of that line and to annex into the City of Wylie in order to be connected to that line . This petition for annexation and the one in Item no . 9 are in response to that request . ITEM NO. 9 - PUBLIC HEARING ON ANNEXATION OF 3 ACRES ON 3412 This property is described as 3 acres out of the E. C. 1 Davidson Survey , Abstract No . 266 located on FM 3412 . The Planning & Zoning Commission voted 6-0 to recommend approval . ITEM NO. 10 - PUBLIC HEARING ON ANNEXATION OF 45 ACRES ON ELM ROAD - This property is described as 45 . 182 acres out of the D . W. Williams Survey , Abstract 980. It is located on the north side of Elm Road east of the intersection of S . Ballard St . and Elm Road. The Planning and Zoning Commission voted 6-0 to recommend approval of this annexation petition. ITEM NO. 11 - PUBLIC HEARING ON THE ANNEXATION OF 11 .265 ACRES ON 1378 - This property is described as 11 . 265 acres out of the W. D. Barnett Survey , Abstract 56. P & Z voted 6-0 to recommend approval of this petition for annexation . The property is located just north of and adjacent to the recently annexed property belonging to Stanley Moussa. This small tract will become a part of the joint venture between Mr . Moussa and Sparky Beckham known as Crescent Cove . ITEM NO. 12 - PUBLIC HEARING ON ANNEXATION FOR 7.599 ACRES ON FM544 - This property is described as 7 . 599 acres out of the M. Sparks survey , Abstract 840. It is located on the north side of FM544 at the city limits sign for Wylie/Murphy . This property will help to fix the western boundary of the City . ITEM NO. 13 - PUBLIC HEARING ON ANNEXATION OF 22 ACRES OWNED BY ST. LOUIS & SOUTHWESTERN RR - The P & Z Commission voted 6-0 to recommend approval of this annexation. The property represented in this agenda item and those through item no . 20 involuntary annexations , initiated by the City of Wylie . Letters were mailed to the various property owners advising them of our intentions and giving them a schedule for hearings and final action . We invited them to annex voluntarily and mailed the appropriate forms . It is our understanding the railroads do not voluntarily annex property ; however , we did have correspondence with them and there has been no opposition . ITEM NO. 14 - PUBLIC HEARING ON ANNEXATION OF 112. 12 acres on FM544 - This property is described as Tract No. 4 , 105 . 22 acres ; Tract No . 5 , 3. 3 acres and Tract No . 38 , 3 . 6 acres out of the M. Sparks Survey , Abstract 849 . The P & Z voted 6-0 to recommend approval of this annexation. This property is located on the North side of of FM544 and adjoins the 7 acre tract described in item no . 12 . ITEM NO. 15 - PUBLIC HEARING ON ANNEXATION OF 83 AND 106 ACRES ON FM544 - This property is described as 83 . 28 acres and 106 . 53 acres out of the Wm. Sachse Survey , Abstract 835 . It is located on the South side of FM 544 west of Steel Industrial Park. The P&Z voted 6-0 to recommend approval of this annexation . This property will form the western boundary of the City on the southside of FM544. ITEM NO. 16 - PUBLIC HEARING ON ANNEXATION OF 95 ACRES ON FM544 - This property is described as 95 .49 acres out of the D. Strickland Survey , Abstract 541 located on the southside of FM544 west of Hardcast Co . The P&Z voted unanimously to recommend approval to the City Council . ITEM NO. 17 - PUBLIC HEARING ON ANNEXATION OF 9 ACRES ALONG SH78 - This property is described as 4 . 132 acres and 5 . 739 acres out of the W. S . Bohannon Survey , Abstract 121 and is the ROW for SH78. The P&Z voted unanimously to recommend approval . ITEM NO. 18 - PUBLIC HEARING ON ANNEXATION OF 20 ACRES OWNED BY ATSF RR - This property is described as 5 .968 acres out of the W. S . Bohannon Survey and 9 . 8 and 5 . 18 acres out of 2 the W. C . Twitty Survey for a total of 20 . 948 acres and is the ROW for the Atcheson , Topeka & Santa Fe Railroad . The P7Z voted unanimously to recommend approval at their last meeting . ITEM NO. 19 - PUBLIC HEARING ON ANNEXATION OF 1117.9 ACRES IN AND AROUND LAKE LAVON - The Planning & Zoning voted unanimously to recommend approval at their last meeting . This is of course Federal land . We spoke with Jerry Hammers of the Corps of Engineers some months ago and advised him of our plan to annex portions of the Lake and the Federal land surrounding it . He advised us that the U.S . government does not voluntarily annex any property ; however , they were not opposition to this annexation and would in fact welcome having the City of Wylie in the area . The annexation of this property not only extends our ETJ but allows us some jurisdiction in curtailing the proliferation of such things as open septic systems and gives us law enforcement authority . We feel this will encourage the use of the park areas by families again. ITEM NO. 20 - PUBLIC HEARING ON ANNEXATION OF 1360. 748 ACRES IN AND AROUND LAKE LAVON - At their last meeting , the P&Z voted unanimously to recommend approval of this annexation . ITEM NO. 21 - CONSIDER ACCEPTANCE OF PUBLIC IMPROVEMENTS OF POINTE NORTH - You will note there is no letter from the Inspector ' s office recommending approval of this item. The developer had requested that this item be placed on the agenda and receive approval of the Council pending a report stating that the streets have met our break requirement . they did not meet it in 7 days and we have another 21 days before the final breaks will be complete , in accordance with the ordinance . Therefore , the staff believes this action would be more appropriate on the next agenda and we advised the developer of our decision. He however , wanted it to go on the agenda anyway . Thus , here it is and we recommend disapproval until the breaks meet specifications . ITEM NO. 22 _- AUTHORIZATION TO GO OUT FOR BID FOR TWO JEEPS These jeeps were authorized in the 1985-86 budget , one goes to engineering , one goes to meter reading . A bid now will provide delivery in late October or November . ITEM NO. 23 - AUTHORIZATION TO GO OUT FOR BID TWO PATROL CARS - These Police cars are for the Patrol division of our Police Department and are authorized in the 1985-86 budget . A bid process started now will get delivery of the two cars in February/March. ITEM NO. 24 - AUTHORIZATION TO GO OUT FOR BID FOR WATER GROUND STORAGE TANK - This tank is needed to be bid in order that we may have a tank coming for the development of Moussa/Beckham on FM1378 North of Birmingham. ITEM NO. 25 - AUTHORIZATION TO GO OUT FOR BID FOR METERING EQUIPMENT - This item needs to be advertised for bid in order to place an order for calibrated metering equipment to be installed turn-key at the various tank sites . The individual pieces are less than the bid requirements but the whole package is just over the $5000 level and we want to buy the entire item, including adjustments and setting from one source . ITEM NO. 26 - PRESENTATION BY FIRE MARSHAL - This is at his request . If I may be so bold as to suggest , the soft approach is not going to work, the staff has tried this , at some point we are going to have to tell Mr . Gayler our feelings , clearly and distinctly . The Wylie City Council met in regular session on Tuesday , September 10 , 1985 at 7 :00 P . M. in the Wylie Community Center . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were Mayor John W. Akin , Mayor Pro Tem Don Hughes , Councilmembers Percy Simmons , William Martin , Harold Spence , Randall Gaston , and Joe Fulgham, City Manager Gus Pappas , City Secretary Carolyn Jones , Finance Director James Johnson , Code Enforcement Officer Roy Faires , Director of Pubic Works Bill Windham, Elayne Mayes and Scott Dorsey of the Wylie News , Tom Mayes , Roland Forester , Bro . Al Draper , Alan Stroud and other citizens . Mayor Akin called the meeting to order and gave the invocation . APPROVAL OF MINUTES : There being no corrections or additions to the minutes , Councilman Gaston made a motion to approve as submitted . Seconded by Councilman Martin . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Spence - in favor , Councilman Martin - in favor, Councilman Fulgham - in favor , and Councilman Gaston - in favor . This motion carried with all in favor . OATH OF OFFICE TO DR. TOM JONES , CITY HEALTH OFFICER. Mayor Akin asked the City Secretary to give the oath of office to Dr . Tom Jones. Mayor Akin then thanked Dr . Jones for accepting this office. LIST OF GUIDELINES FOR COMMUNITY ROOM RENTAL ORDINANCE: Mayor Pro Tem Hughes said he sat in on the meeting with the Park Board and there was a lot of discussion on these guidelines . The Park Board would like to resend item No . 8 . After much discussion on letting one group lease reserve the center for a year on every Saturday night , Mrs. Tibbals said the Park Board had the same problem of not wanting one group to have the center for each week end . Mrs . Tibbals suggested that the length of time in item 7 be shortened . Mayor Pro Tem Hughes said he had a problem of leasing out for one year on the weekend , that if a group wanted it during the week for a year , it would be ok. Mrs . Tibbals suggested that in item 1 if the phrase "any multiples thereof" be deleted . City Manager Gus Pappas said this phrase was to add hours not months . City Manager Gus Pappas requested that Item 8 the sentence "Termination for this cause will result in forfeiture of all fees and rental paid � r", 1, f`� for the period and could result in the disallowing of any future opportunity for rental" be left in the guidelines . Motion was made by Mayor Pro Tem Hughes to approve the guidelines with the correction in item one of deleting the phase any multiples thereof and leaving the one sentence in item 8. Seconded by Councilman Fulgham. The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Spence - in favor , Councilman Martin - in favor , Councilman Fulgham - in favor , and Councilman Gaston - in favor . This motion carried with all in favor . APPROVAL OF PLAN FOR STREET THROUGH "THE MEADOWS" : This is the street that will from S . Birmingham through to S . Ballard and align with the entry drive to Wylie Middle School . City Manager Gus Pappas said this is a accident prone area and this proposal would make this a safer right angle turn onto Ballard . Councilman Fulgham said this was requested by Planning and Zoning at one time . City Manager Gus Pappas said it has also been requested by the Middle School Principal. Motion was made by Councilman Simmons for the public works department to prepare this road . Seconded by Councilman Fulgham. The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Spence - in favor , Councilman Martin - in favor , Councilman Fulgham - in favor , and Councilman Gaston - in favor . This motion carried with all in favor . APPROVAL OF FINAL PLAT FOR JACOBS ADDITION: This is the final plat for the Jacobs Addition. This is an ETJ review since this property is not yet in the City Limits of Wylie . This subdivision takes place to accommodate the desires of the owners of DC Automotive who wish to be in the City of Wylie . This property will not take in the "RV Park" . The City did require an additional 20 feet of right-of-way necessary for future widening of FM 544 . Staff recommends approval . Motion was made by Councilman Martin to approve final plat . Seconded by Mayor Pro Tem Hughes . AUTHORIZATION TO PAY FOR OVER-SIZING OF WATER LINE AND VALVES AT NTMWD IN CONNECTION WITH THE DEVELOPMENT OF WYNDHAM ESTATES : City Manager Gus Pappas said the over- sizing occurred during the time in which the staff and council were putting together the regulations for over- sizing of lines . City Manager Gus Pappas said the City Engineer reviewed this and we asked the developer to over- size the line . The amount to be paid to the developer is $10 , 086 . 87 . Motion was made by Councilman Gaston to approve 000163 the payment for over-sizing of the water lines . Seconded by Councilman Simmons . The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - in favor , Councilman Spence - in favor , Councilman Martin - in favor , Councilman Fulgham - in favor , and Councilman Gaston - in favor . This motion carried with all in favor . AUTHORIZATION TO INSTRUCT CITY ATTORNEY TO PREPARE A "QUIT CLAIM" DEED TO CURVED RIGHT-OF-WAY ON THE NORTHWEST CORNER OF MASTERS ST. AND FOURTH STREET: This request has come from one of the property owners . The staff feels that this is a proper thing to do as the curve is dangerous and simply increases the amount of streets within the City without any benefit . The staff recommends approval . Mayor Akin said that the property owner will be responsible for breaking up the road in this area . Motion was made by Mayor Pro Tem Hughes to approve with the stipulation that the property owner will have the responsibility of breaking up the road . Seconded by Councilman Gaston. The vote was as follows : Mayor Akin - in favor , Mayor Pro Tem Hughes - in favor , Councilman Simmons - against , Councilman Spence - against , Councilman Martin - in favor , Councilman Fulgham - in favor , and Councilman Gaston - in favor . PUBLIC HEARING ON THE ZONING OF 2 ACRES (LOT 1 , BLOCK B JACOBS ADDITION) OUT OF THE WILLIAM SACHSE SURVEY , ABSTRACT NO. 835 : Mayor Akin opened the public hearing, and stated that the request for zoning is for Business -2. . City Manager Gus Pappas gave the location of this property as being on FM 544 and just in front of Steel Industrial Park. This is the property commonly known as DC Automotive . Mr . Fred Ouellette of 407 Woodhollow asked if this is the property with the campers . City Manager said no this property does not include the campers. Mr . Ouellette than wanted to know if the owner had to comply with the city ordinances now. City Manager said he had to conform to the ordinances . PUBLIC HEARING ON THE ADOPTION OF THE PROPOSED TAX RATE FOR THE CITY OF WYLIE FOR THE FISCAL YEAR 1985-86 : The proposed OCO16 tax rate for the fiscal year 1985-86 is 49 cents per $100 of appraised value . Mayor Akin opened the public hearing . Mr . Fred Ouellette , 407 Woodhollow wanted to know if the computer run todate for the City is the $100 , 000. for City Hall and the $25 ,000 . for Council Reserve still in tack . City Manager Gus Pappas said that the funds for the city hall were still in tack , but that the Council had votes some time back to use a portion of their reserve for a bill of approximately $18 ,500. The Reserve in the Water and Sewer Fund is still in tack. Mr . Fred Ouellette also stated that the figures in the 1984 column was different from the 1984 budget , why . City Manager said that was because a few months ago the Council had votes to amend the budget . Mr . Ouellette wanted to know if the budget could be amended without a public hearing . City Manager said it could as long as it was just moving money from item to time , to update revenues received above what was budgeted . Mr . Ouellette wanted an explanation about the tax rate being an increase when it was staying the same rate as last year . City Manager said that the State of Texas requires you to have public hearings and state that the tax rate is more on a percentage basis of amount of revenues being received from one year to the next . Mr . Ouellette also had several questions about different line items in different departments . The City Manager answered these questions as they were asked. Mr . Ouellette then said that he did not have a good feeling that the Council was trying to reduce spending . Mayor Pro Tem Hughes said that if Mr. Ouellette has lived here as long as the Council , he would know the complaints about what needs the City needed to take care of . Mayor Pro Tem Hughes also stated that all the other citizens , with the exception of Mr . Ouellette , had only good things to say about the budget and were glad to have a Council not afraid to up grade the City . Mayor Akin said this city has always stayed out of Bonds due to the long term issues . He said he felt it was poor taste for Mr . Ouellette to regard the reserve as a Council slush fund . Mayor Akin said Mr . Ouellette needed to see the worn out water lines , poor streets and have done without for as long a time as this city has . Mayor Akin also said we are preparing for the future . Mr . Chris DiTota of 803 Douglas Court wanted to know if anyone was exempt from paying taxes . City Manager said by law you cannot tax some and not others . The City does have a senior citizens over 65 exemption of $15 ,000 .00 , and there is also a VA exemption that is state regulated . Mr . DiTota wanted to know about the voluntary fire department and if it will ever be a paid department . Councilman Simmons asked if UCU166 Mr . DiTota would feel better if the city had a paid full time fire department . Mr . DiTota said he would feel better with a full time fire department . Councilman Fulgham said most of the increase in budget is coming from the growth through annexation and building . Mr . DiTota then asked about FM 544 and was it going to be six lanes . City Manager Gus Pappas said this was a State Highway and the State does move slow. Although Highway 78 is to be widened beginning in 1987 and completed in 1989 . There being no other questions , Mayor Akin closed the public hearing . Lester Gaylor did not show up for the meeting . CITIZEN PARTICIPATION : Mr . Chris DiTota of 803 Douglas wanted to know what the weed ordinance was . Roy Faires said it was grass and weeds in excess of 18" in height . Mr . DiTota wanted to know the status of the Rush Creek Lift Station . City Manager said the tank has been order and engineering has been completed . Construction should begin soon . Mr . DiTota has had a lot of problems with sewer in he year and a half he has lived here. Also had verbal abuse from the city employees . Mr . Bill Windham asked Mr . DiTota to see him after the meeting in regards to the city employees . Art Harris of 324 S . First said along the west side of Ballard Street there has been water in the ditch between Ballard and Butler . Mr . Windham said this water lines belongs to North Texas Municipal Water District. They are working on this problem. Also some of the property owners are fencing in the alley easement . There are TP&L poles in this alley that need repairing and there is no way to get to these poles . Also there is a problem with the storm drainage . It backs up in their back yard and other property owners along First Street . Mr . Harris also said he had of problem of needing some dirt under his sidewalk. COUNCIL DISCUSSION: Councilman Martin would like for the representative from Texas Power and Light Company to be at the next meeting if possible . Councilman Martin said there has been a lot of power failures in the Wylie area . Councilman Martin wants to know of the plans for the future that TP&L may have . Also he has been receiving complaints on the traffic hazard caused by cars setting with for sale signs on them on Highway 78 and blocking the view of crossing the highway . City Manager said Council could adopt an ordinance that would help correct this . Councilman Fulgham asked if there would be a smoother finish when Kirby Street is finished . Mr . Bill Windham said yes . Also , Councilman Fulgham thanked the citizens who had come to the meeting and showed interest in the City . Mayor Akin wanted to know if the flag pole at the Police Department could be extended . Mr . Bill Windham said this pole should not be extended because it is fiber glass . City 000168 Manager said that Bill had talked to him about changing out this flag pole , but with the upcoming move for City Hall , we would want new poles and therefore we would not go the expense of changing out this pole. Mayor Akin said if the cost was not to great , to go ahead and change out this flag pole . Councilman Martin also has had complaints about the walk way at Hartman Elementary . Since the road work the walk way to cross the street has been destroyed and the kids are having to walk into the ditch to cross . Mr . Bill Windham said this would be corrected as soon as the street is completed . Mayor Akin said he would be leaving on September 21st and would be gone through Oct . 12th on vacation . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were Chairman Kent Crane , Don Montgomery, Joe Strigle , Bill Chapman, Brian Chaney and Ken Mauk. Representing the City staff were City Manager , Gus Pappas; Code Enforcement Official, Roy Faires ; and secretary Barbara LeCocq. The meeting was called to order at 7 :00 P.M. by Chairman Crane . ITEM NO. 1 - APPROVE MINUTES - Chairman Crane asked for any corrections or additions to the minutes. Hearing none, a motion was made by Bill Chapman to approve the minutes as submitted. Ken -Mauk seconded the motion, motion carred 6-0. Chairman Crane stated that before proceeding with the next agenda item he would like to take the opportunity to introduce Joe Strigle , the newest member of the commission, appointed by the City Council to fill the vacancy left by the resignation of John Hamilton . ITEM NO. 2 - APPOINTMENT OF VICE-CHAIRMAN - Chairman Crane stated he would entertain nominations for vice-chairman . Don Montgomery placed the name of Brian Chaney into nomination. Ken Mauk moved the nominations be closed. Brian Chaney elected vice-chairman by unanimous vote. ITEM NO. 3 - CONDUCT PUBLIC HEARING ON PETITION FOR ZONING FOR 129 ACRES - This property is described as tracts 6 , 7 & 8 out of the J . Mitchell Survey, Abstract 589 with a total of 129 . 12 acres located on McMillan Road adjacent to Southfork , Ltd . The petitioner has asked for agricultural zoning . At the request of Chairman Crane , Gus Pappas , City Manager pointed out the property on the map. He also noted that the zoning was compatable with current use . Motion carried 6-0. 1 9 ITEM NO. 4 - PUBLIC HEARING ON RE-ZONING OF BENEDICT ESTATES This item is described as 57 . 1017 acres out of the Francisco de la Pina Survey , Abstract 688. The petitioner is asking for this tract to be designated PD (Planned Development) coupled with the approval of the concept plan for Benedict Estates. At the request of Chairman Crane, City Manager Pappas located the property on the map and noted that Rush Creek runs through the property and also that there is flood plain which the developer has to incorporate into his plans . Mr . Pappas explained that the property was originally zoned SF-1 and that the current plan for Planned Development retained the 10,000 plus square foot lots with 2200 square foot dwellings in the single family areas . The flood plain necessitated the elimination of alleys. Mr . Pappas further explained that the zoning designation of Planned Development calls for a different procedure . Planned Development presents the developer with an opportunity to do something unique ; however , it also necessitates the approval of a concept plan at the time the zoning is requested. Chairman Crane declared the public hearing open. Mike Cummings , engineer for the developer, Benedict Development, began his presentation by saying that Eubanks Lane will be extended to Stone Road and -will be a divided boulevard . He further stated that Rush Creek will be maintained in a natural state . He stated that a Homeowners Association will have responsibility for maintaining the Creek. Gus Pappas stated that a copy of the Homeowners agreement must accompany the development plan. Mr . Cummings stated that the lots are planned to have an open slope down toward the Creek and Mr . Simmons , one of the developers said they plan to have an open, rolling environment similar to that of Seis Lagos , with fencing only allowed around private swimming pools . With no further comment or questions from the floor , the public hearing was closed and the item returned to the table for discussion. Brian Chaney asked if , since there were to be no alleys , would they have front entry garages? Mr . Cummings stated that the houses would have rear entry garages with drives along one side of the dwelling and curving into the back of the house . He stated that the townhouse area would have alleys and would have rear entry garages. Don Montgomery asked about trash pick-up. Mr. Cummings answered that trash pick-up would be at the front curb . Kent Crane asked about ownership of the Creek. Mr . Simmons stated that ownership of the Creek would remain with the homeowners association . Gus Pappas interjected that there must be strong language in the homeonwers agreement about the maintenance of the Creek. Joe Strigle asked if the Creek is to be rechanneled . Mr . Cummings answered that it will be rechanneled to some extent . Mr. Strigle further asked about additional trees along the Creek. Mr . Cummings stated that they would need to clean out and smooth the channel and that the plan includes the planting of a number of trees and shrubs. Kent 2 • Crane asked what kind of bridge is to be placed over the Creek. Mr. Simmons said they will use a box culvert . They are considering a series of small dams to create some standing water . With no further discussion, a motion was made by Bill Chapman to recommend to the City Council approval of the zoning designation of Planned Development and approval of the concept plan for Benedict Estates . Bramlett , owners of the property wanted to know when the concrete reservoir that is in their front yard will be filled in. Gus Pappas stated that the City will honor their promise to fill in the reservoir . Chairman Crane asked City Manager Pappas for staff comment . Mr . Pappas located the property on the map and went on to explain that this is the first of 4 /o? a group of involuntary (forced) annexations that the City of Wylie has initiated . He further stated that the authority to involuntarily annex property , as authorized by State statute , allows cities to plan for orderly growth and development . Chairman Crane opened the public hearing , hearing no questions or comments from the floor , he closed the public hearing and returned the item to the table for discussion. Bill Chapman asked if the City had heard from the owner of the property . Mr . Pappas stated that Mrs . Jones had contacted the City and expressed her opposition to annexation . He also stated that the City of Sachse was apparently contemplating legal action against Wylie annexing this property . Mr . Pappas pointed out that this property would form another corner of the Western boundary between the City of Wylie and the City of Murphy . The property is under the trusteeship of MBank Dallas. This is another of the involuntary annexations initiated by the City of Wylie . Chairman Crane asked for the property to be located on the map by Mr. Pappas , after which he declared the public hearing opened . Twitty Survey , Abstract 918 being a total of 20.948 acres being the right- of-way owned by the Atcheson , Topeka and Santa Fe Railroad . Chairman Crane asked City Manager Pappas for staff comment . Pappas located the property on the map and explained that the annexation of this property would move the city limits sign 400 ft . to the east as well as to establish contiguity for other tracts of land to be annexed into the City . Mr . Pappas further explained that these tracts are part of what we refer to as the "Lake Lavon" annexation of Federal land in and around Lake Lavon . Chairman Crane opened the public hearing. A question from the floor asked if the City would now have liability for Parks around the lake. Mr . Pappas explained that the property still belongs to the Federal government , the annexation of this property 5 -. _. _.arr. will give the City the Police powers in the area just as it would for any other area annexed into the City . Pappas if the City would have the authority to regulate the proliferation of open septic tanks in areas surrounding the lake , even though they might not be inside the corporate limits of the City . Bohannon Survey , Abstract 121-1 being the right-of-way for the State of Texas located SH 78 . Mr . Pappas pointed out the property on the map. The public hearing was opened by Vice-Chairman Chaney . Hearing no comment from the floor , the public hearing was closed and the item returned to the table for discussion. ITEM NO. 16 - PUBLIC HEARING ON THE ANNEXATION OF 1117 .9 ACRES OF FEDERAL LAND - This property is described as 1117 . 9 acres being Federal land owned by the United States of America and contained in the Francisco de la Pina Survey , Abstract 688-1&2; the Jno . Campbell Survey , Abstract No . 800 ; the S . Barrow Survey , Abstract No . 54; and the M. Phelan Survey , -Abstract 697 , located near the East fork of the Trinity River North through the dam location into the water and West to approximately the East Fork Park site in and around Lake Lavon . At the request of Vice-Chairman Chaney , the property was pointed out on the map by City Manager Pappas. The public hearing was opened and hearing no comment or question from the floor , the public hearing was closed and the item returned to the table for discussion . After brief discussion, a motion was made by Ken Mauk and seconded by Bill Chapman to recommend to the City Council , approval of this annexation. Motion carried 5-0 . ITEM NO. 17 - PUBLIC HEARING ON THE ANNEXATION OF 1360 ACRES OF FEDERA LAND- This property is described as 1360. 748 acres of Federal land owned by the United States of America , contained in the S. Coose Survey , Abstract 187 ; the W. S . Bohannon Survey, Abstract 121-1 ; the W. C. Twitty Survey , Abstract 918 ; L. B. Hill Survey , Abstract 433-1&2 ; the Francisco de la Pina Survey , Abstract 688-3; W. H. Moore Survey , Abstract 638-2 located from approximately the East Fork Park site out into Lake Lavon with a Western border going North along the shoreline and Federal land to a point around Collin Park. At the request of Vice-Chairman Chaney , Mr . Pappas pointed out the property on the map . Vice- Chairman Chaney opened the public hearing and with no comment or question from the floor , the public hearing was closed and the item returned to the table for discussion . With no discussion , a motion was made by Don Montgomery to recommend to the City Council approval of the annexation of this property to the City of Wylie . Motion seconded by Bill Chapman. Motion carried 5-0. 7 • • ITEM NO. 18 - POSSIBLE CHANGE OF MEETING TIME FOR P & Z - At the request of Vice-Chairman Chaney , Mr . Pappas explained that this item was placed on the agenda by the City staff . The reason being that because of the fact that most items appear before the Planning & Zoning Commission before they go before the City Council , the fact that the Planning & Zoning Meetings usually follow the Council meetings in the same week, it delays action on various items , particularly the approval of plats . Bill Chapman stated that he would like to have about 30 minutes before the meetings for a briefing. Mr . Pappas stated that they could certainly do that ; however , the briefing meeting would have to be an agenda item and be open to the public . After a brief discussion a motion was made by Bill Chapman to recommend to the City Council that the meeting times for the Planning & Zoning Commission be changed to the first (1st) and third (3rd) Thursday of each month, rather than the second (2nd) and fourth (4th) Thursday . AN ORDINANCE OF THE CITY OF WYLIE, TEXAS AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO 81-5) , TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICA- TION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED ($200. 00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional , illegal or invlaid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. ` SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars ($200. 00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare fo the City. Therefore, this ordinance shall take effect immediately from and after its passage, as the law in such cases provides. Should a fire of any magnitude occur on your property or in any structure on your property , a call to the City of Wylie Police/Fire number at 442-2222 will cause the fire department to be dispatched to the scene to combat the fire . In addition , new structures and existing structures will be subject to random inspection in order to insure the control of potentially dangerous fire hazards to both yourself and to your neighbors . ZONING AND CODES ENFORCEMENT: Immediately following the final vote by the City Council to sign the annexation ordinance your property will be subject to the enforcement of all the provisions of the current editions of the Uniform Building Code which sets forth basic policies on methods which are approved for new construction and remodeling . Such codes cover areas of construction , electrical , plumbing and mechanical and plans for any improvement on your property should be submitted following the date of annexation to the Codes Enforcement Office at City Hall for review and for the issuance of a building permit . There is a fee for this service and it is relative to the cost of the improvement . Zoning is a public process that will begin during the time your annexation is being processed . This action should be final shortly after your annexation is complete . Zoning is a public act by which the governing body of your City designates a particular use for your tract of land in order to provide for the orderly growth of the City . Any use which was in existance on your property prior to the completion of the annexation will be allowed to continue . This concept is called "grandfathered" . Under the grandfathered provision , you may continue to use your property in a way that is not consistant with the zoning placed upon it by the public body ; however , such use may not be expanded and if the use is discontinued it may not be reinstated . You may indicate , by signing the enclosed forms , any preference which you may have for the zoning designation to be placed upon your property . While you may not have been aware of it , while your property was in the county and was not within the city limits of any city , you did not have zoning protection ; thus , your neighbors could have used their property for any purpose which may or may not have been consistant with your use or with the best use of the property in general . Zoning will protect your property and your area from that type of abuse and generally adds both to your personal security and to the value of your property . �O 1S LIBRARY AND PARKS & RECREATION SERVICES : Upon completion of annexation , you and any residents of the property shall be entitled to the use of the City Library and our various parks and recreational facilities . This segment of our city services are undergoing a great deal of expansion and improvement and although they provide excellent services now, they will provide even greater service opportunities in the near future . Many of these services are provided free of charge to citizens to the City of Wylie , others are provided with the charge of a small user fee . You are entitled to pay the "in-city" rate for these services after your annexation is complete . ANIMAL CONTROL SERVICES : The City provides an animal control service to deal with problems associated with the control of both and large and small animals that either wild or domestic . This service is provided through our Public Works Department which may be contacted by telephone at 442- 7588 . On completion of your annexation process , you may contact this office for any questions regarding this service . STREETS & DRAINAGE SERVICES : The City of Wylie operates a department charged with the responsibility of maintaining city streets and keeping existing drainage devices flowing properly . If your property abuts or contains drainage ditches or streets which are under the City ' s dominion and control , you may request , upon completion of annexation , that repairs or maintenance be performed upon these public facilities . These requests should be phoned to the Public Works Department at 442-7588 . Upon receipt of your phone call and verification of eligibility these requests will be grouped and scheduled for an appropriate work period . Improvements to streets and drainage which are above the simple maintenance level involve a more complicated procedure of prioritizing and , in most cases , some form of financial participation between the City and the adjacent property owner . Should you desire this level of services , you should contact City Hall to discuss what improvements you had in mind and what financial arrangements can be made . WATER SERVICES : The City of Wylie provides potable water service to residents within it ' s city limits . In certain areas there may be a previously existing legitimate water supply corporation . If such is the case on your property , then water service has already been provided . The City of Wylie will be happy to assist you in assuring that such provided service is adequate . Should you not be satisfied with services provided by such a water service , please contact City Hall with your complaints . We will be happy to act as an intermediary on your behalf to see what improvements can be made . If service is not currently available , the City , in participation with you and other property owners , will be happy to assemble a plan which provide water service within a reasonable distance from your proeprty . We have several plans available and need only arrange a meeting with you to decide which of the various plans is most suitable for your needs and financial situation . The City has numerous water service points within the area and should have little difficulty providing such service within a reasonable time after annexation . SEWER SERVICES : The City of Wylie owns it ' s own sewage treatment facility and has divided the City into several large lift station districts . Your property will fall into one of these districts . Sewer service is being extended throughout the City at a rapid rate . In order to obtain sewer services to your property , you will need to contact City Hall following your annexation to discuss the specifics of extending such service . In addition , as you will recall , I recieved a once a year check for $500 .00 to compensate me for the week that I must close my barber shop in order to attend the required training courses at Texas A & M.
