ITEM NO. 2 - APPROVAL OF ORDINANCE DECLARING WYLIE HAS POPULATION OF MORE THAN 5000 - This ordinance was prepared by our city attorney finding that Wylie has more than 5000 inhabitants . This is an official step that must be taken before the election for the Home Rule Charter . ITEM NO. 3 - AWARD BID FOR BACKHOE - Recently the staff held the required public bid opening to purchase the used International backhoe that we now have on loan . The bid amount was $20, 500.00 which is the same amount which we were earlier quoted but includes a few additional goodies . Our experience with the backhoe suggests that it is still a good purchase and therefore the staff recommends award of the bid to the sole and cheapest bidder . ITEM NO. 4 - CONSIDER APPROVAL OF FINAL PLAT FOR ROCKY TOP DEVELOPMENT - This plat is similar to a number of those which we have looked at in Steel Industrial Park and as finally submitted offers no problems and we would recommend approval for construction . ITEM NO. 5 - CONSIDER APPROVAL OF PLAT FOR CANTERBURY HILL See agenda summary for the meeting on December 31 , 1984 . We anticipate that they will make this meeting and present their argument for special consideration in the subdivision on Canterbury Hill . ITEM NO. 6 - DISCUSSION ON AMENDMENTS TO MOBILE HOME PARK ORDINANCE - The actual ordinance document which is currently in effect has been included as an enclosure in your packet . The amendments were not completed at the time the agenda summary and packet were compiled . Please read over the current ordinance so that we may discuss the possible amendments at the January 8th meeting for formal revision and adoption at the meeting on January 22nd . ITEM NO. 10 - EXECUTIVE SESSION - This executive session possibility has been provided in order that the council , chief of police and representatives of the Federal Immigration and Naturalization Service may speak privately about strategies for the enforcement of existing laws on illegal aliens within the city of Wylie . It is our understanding that a representative of the I & N Service will be present . Should he be unable to attend , the staff would have no reason to conduct the executive session and would recommend , in that case , that it not be convened . 14 CITY COUNCIL MEETING MINUTES DECEMBER 11 , 1984 7:00 P. M. The Wylie City' Council met in regular session on Tuesday , December 11 , 1984 at 7 :00 P.M. in the Council Chambers at City Hall . Mayor Akin presided . A quorum was present and notice tf the meeting had been posted for the time and in the manner required, by - law. Those present were Mayor John Akin , Mayor Pro Tem Don Hughes , Councilmembers Percy Simmons, William Martin, Cleo Adams , and Joe Fulgham , City Manager Gus Pappas , City Secretary Carolyn Jones , Public Works Director ' Bill Windham, Code Enforcement Officer , Roy Faires , Chief Royce Abbott , Fire Chief Mike Rawlings , Fire Chief Larry Allen, Gary Roddy , and other citizens . Mayor Akin called the meeting to order and gave the invocation . APPROVAL OF MINUTES: Motion was made by Councilman Martin to approve minutes as submitted. Seconded by Councilman Adams , all in favor . APPROVAL OF ANNEXATION ORDINANCE ON 48.816 ACRES OUT OF THE ALLEN ATTERBURY SURVEY, ABSTRACT NO. 23: This property is located on S. Ballard St. adjacent to the new water tower . Motion was madeby Councilman Simmons to approve and sign annexation ordinance for the above property . Seconded by Councilman Martin, all in favor . PUBLIC HEARING - ZONING OF 48 . 816 ACRES OUT OF ALLEN ATTERBURY SURVEY, ABSTRACT NO. 23 This property is located on S . Ballard St . adjacent to the new water tower . This property is commonly known as Southplace Addition . The request for zoning is B-1 , B-2 , and Single Family 2 . Nayor Akin opened the public hearing , and asked if any of the citizens would like to comment . There were no citizens , but Mr . Gary Roddy , one of the developers , said they were requesting Single Family 2 in order to have smaller lots and to help keep the price of the lots and homes down . Mr . Roddy will have deed restrictions on these lots which will state there has to be 1400 sq . ft . of living area . The other areas are for Business 1 and Business 2 are being requested due to the area belonging to Lone Star Gas Company , on which there is equipment . City Manager Gus Pappas it was approximately 300 feet south of the new fire stati _r where Alanis would come through . City Manager Gus ':'apn: also said at the Planning and Zoning meeting , sor::e of tb residents did not want to see business areas on this property . Councilman Simmons wanted to know if this creates spot zoning . City Manager Gus Pappas said or ta( single family area no , but there would be a questions Cr commerical area . If you take one lot and re-zone it , t :; ! does create spot zoning , but when you take ] arse lots could be done without questions . Mr . Roddy said when you look at the appraisal of a ho::;e it has less value placed on it when it is located on a busy road and Sachse road is very busy . Also , the Lone Star as equipment and water tower and fire station will lower thi appraisal of these homes . Mayor Pro Tem Hughes wanted to know if Business 2 would continue down Sachse Road toward Alanis , or would it zoned single family . B. /WYLIE PROPERTIES : This easement has been granted to the City in order for the water lines . to be laid for the new ground storage tank . Motin was made by Councilman Simmons to accept this easement . Seconded by Councilman Martin . All in favor . APPROVAL OF CONTRACT TO LEASE CITY LANDFILL: City Manager Gus Pappas said there has been no response from Moore Industrial on this lease agreement . Motion to table this item was made by Councilman Simmons. Seconded by Councilman Adams , all in favor. AWARD BID FOR POLICE CAR: The City received three bids for this polic car which are : Tomes Ford $11 , 092 . 32 Lakeside Chew. $10, 998. 18 Carter Chew. $10, 995 .00 Staff recommends awarding the bid to Carter Chevrolet . Motion was made by Councilman Fulghman to award bid to Carter Chev. Seconded by Councilman Martin . All in favor . APPROVAL OF BILLS PAID AND ACCOUNTS PAYABLE: Motion was made by Councilman Simmons to approve bills paid and accounts payable with the exception of Speed Fab , which is to be called about . Seconded by Councilman Adams . All in favor . DEPARTMENTAL REPORTS: All departmental reports were accepted as submitted . GENERAL COUNCIL DISCUSSION : Councilman Simmons said the Fire Marshal reported he was not getting called to inspect building plans before permits were being issued . City Manager Gus Pappas said he had talked with the Fire Marshal ' 7 this date and the problem has been taken care of . Councilman Simmons wanted to know if the Construction hear ! had been called about a meeting and if so when was the meeting . Code Enforcement Officer lioy Faires said the meeting had been set for January 14 , 1985 . Councilman Simmons wanted to know if the Code Enforcement Officer Lee checked out the wrecking yard next to Rushin Truss . City Manager said this would he done if it has not already bean done . Mayor Pro Tem Hughes wanted to compliment the staff on thc Christmas party for the city employees . Also wanted to if any• of the council had recieved circulars in their ( Or:) ,: about a sale in a home on Briarwood . Payor Pro Tem hue - wanted to know if this could be checked out , since there should not be a business in a residential area . Councilman Fulgham said a man at 109 S . Birmingham coilieh him and said a man in a City car was looking threwh binoculars and when the man asked what the City employee doing the car left . City Manager Gus Pappas said he woa1 look into this , but sometimes it was possible for the coc. enforcment officer to be using binoculars . Is the Construction Board taking the place of the Electrical Board . City Manager Gus Pappas said yes , but is does more than just electrical . Also , Councilman Fulgham wanted to know if a man had taken the electrical test and needed a points to pass . City Manager Gus Pappas said that Hr . Faires uses test that are made up by an electrical instructor in Garland . Yes , a man did take the test and hhs come to Mr . Faires in protest due to the fact he needed'. a few points to pass . This problem has been worked out . Councilman Martin wanted to compliment the staff on the Christmas party . Also , at Steel Industrial Parl: there . been a camp area or mobile home park opened up . City: Manager Gus Pappas said this is not a part of Steel Industrial Park , but that a Mr . Roy Jacobs owns this property . IIe has a water tap from North Texas H.unicipe 1 Water District , but has begin to sell water to several property owners . When NTNWD found out about ';jr . Jacob:: selling water to others , they have informed him of puliin his water meter . Whem NTMWD pulled this meeter , it has 1 :.,fl several people without water , including Steel Industrial Park . Because the City knew this was going to happen , r . Windham made arrangments to have water for the people the city limits . The City has made several complaints to County Health Officer and will continue to make these compalints until this has been cleaned up . If :ir . Jacob request annexation and water service , the staff would recommend that it be refused , due to the pre-existinc, cier in annexation . • / �' Mayor Akin wanted to know if there had been a response from the people west of town on the new water lines . City itancer Gus Pappas said a letter committing Wylie Lake Ranch plus a check for this area has been received , also a letter from Nortex Nursery stating they were willing to pay their share . Mayor Akin wanted to know if there was a need for the second meeting in December. City Manager Gus Pappas said if there was a meeting it would be to act on the pending annexations that could have the ordinances signed . Mayor Akin also commented on the Tree Lighting and the Christman Parade and stated that it was the best the City has had in some time. Mayor Akin thanked Carolyn Jones , Elayne Mayes , and Mr . & Mrs . Wakefied for their work of these two programs. Mayor Akin also asked about the ground storage tanks . This company is moving along , Mr .Windham has already received the tie down bolts. Sometimes next week the City crew will begin preparing the site for the pouring of the pad . City Manager Gus Pappas said the Charter is printed and labels are on the envelopes and some have been stuffed . Should be ready: for mailing in a few more days . APPROVAL OF PRELIMINARY PLAT FOR REGENCY BUSINESS PARK IN STEEL INDUSTRIAL PARK: Staff recommends approval of this preliminary plat and at the Planning and Zoning meeting , there was a vote of 6 in favor and none against . This plat indicated that the streets will be put in according to City specifications and will be dedicated to the City upon the completion of this subdivision. Motion was made by Councilman Martin tp approve this preliminary plat for Regency Business Park. Seconded by Councilman Simmons . All in favor . APPROVAL OF PRELIMINARY PLAT FOR WYLIE PLAZA: This property is located on Highway 78 between the Texaco Station and the Dairy Queen . This plat is being presented to Council for the purpose of, removing the lot lines and showing this as just one big ; lot . This property is zoned Planned Developement . Planning and Zoning had a vote of 6 in favor and none against, and staff recommends approval . After much discussion about the problem of this not being a complete plat and does not have all the information need , motion was made by Councilman Simmons to reject this plat due to lack of detail . Seconded by Councilman Martin , all in favor . APPROVE REPLAT OF KTNSINGTON MANOR : AT the time Kinsington Manor was approved and platted there was noted a large section of this area that was not divided into lots due to the easements for utilities . The developer is now requesting a replat adding Lot 1 Block D in order for the use of this property which contains the utility easement . Planning and Zoning had a vote of 6 in favor and none against and staff recommend approval . This lot will have Single Family 2 zoning which is the same zoning for this entire subdivision. Pappas had been contacted by the Cities of Murphy and Parker voicing concern about a wastewater treatment plant being built between the Cities of Wylie , Murphy and Parker. This wastewater treatment plant will be flowing into Muddy Creek which comes through Wylie . Some eight or nine months ago a Mr. Holigan went to Murphy with a piece of property, just outside of Murphy ' s city limits with the ideal of developing . a large mobile home park . Mr . Holigan thought he would work with the City of Murphy on zoning and services such as water and sewer . Murphy is having problems serving water and sewer to their area and does not feel they will beable to provide proper service to this property . The Cities of Murphy and Parker have strong feelings about . not wanting a mobile home park due to the fact they do not have an , ordinance to help control and maintain an area such as this one . The City of Parker is ruling the ETJ to the City of Murphy since Murphy has annexed a piece of property just across the road from the land belonging to Mr . Holigan. The Cities of Murphy and Parker have come to the City of Wylie due to the fact that Parker has no zoning or subdivision ordinance and Murphy has a weak zoning and subdivision ordinances . Mr . Holigan does have knowledge of all the above facts and has decided to proceed . He has petitioned directly to the State for a wastewater treatment plant since there are no services available. The City of Wylie has not been contacted about such a petition and has sent numerous letters requesting the right to be heard on the subject of a wastewater treatment plant. This wastewater treatment plant is to flow into Muddy Creek and would create a bad problem for the City of Wylie in taking care of the additional growth caused in the creek from this plant . Until Wylie entered into this discussion , there was no water or wasterwater services available to this mobile home park . in order to make our objection ,work, it would be necessary for a large sewer line be laid to to this property and offerec to this mobile home park with a bulk rate for sewer discharge being billed to the City of Murphy . The City of Murphy would then take care of annexing this property into their city limits . Also, the Cities of Murphy and Parker has requested that the City of Wylie join in with them to hire an attorney out of Austin to represent the three cities in court to voice their opinion of this treatment plant . The cost of this :would be approximately $1 , 200.00 per city . The ideal boundary line between Murphy and Wylie has been discussed and decided that the county road shown on the throughfare maps that comes between Murphy and Wylie and ends at West FM 544 just about a mile from Steel Industrial Park. The City of Wylie needs to proceed and sign a written 9 agreement with Murphy for this boundary . Approval of a subdivision is required, by the county from the city in whose ETJ the subdivision is located or the city nearest to the subdivision . Mr . Pappas reported that this plat does not conform to the city ' s subdivision regulations and for `this reason was rejected by the staff reviewers TIM. the Plat Review Committee . IIe also e::plained that the developer chose to come before the P :e Z and the cit '; council to state his case . Mr . Pappas also stated that Beaver Creek Road is on the city ' s thoroughfare alai: and would thus be required to meet those specifications . Chairman Gaston asked Mr . Barron Cook , the developer to state his case before the commission . Nr . Cook stated that this subdivision is actually an extension of his previous subdivision of Beaver Creek Estates and he felt ',soul;: be consistent with that SD . IIe is asking that he be allowed to waive the requirement for alleys since these arc one acre lots and have no need for an alley . He alsc is asking for septic system for sewage . Iie feels that he should not be required to install a concrete street to meet thoroughfare standards since the road on both sides is of two-shot penetration asphalt . Ile reasons that it is financially prohibitive for him to develop these 14 lots if he is required to meet the concrete street requirement . Phy , attorney for Mr . Cook , stated that in most cities , provision is made in the subdivision regulations for ranchettes and that standard subdivision regulations co not apply . Mr . Cook and Mr . Phy contend that the fact of 'beaver Creek Road becoming a thoroughfare is minimal and in the far future and this subdivision should not he required to comply . Mr . Pappas stated that an alternative to the septic ton': system had been suggested to the developer which woul , include a sewer system for the homes in the area to be fed into a holding tank that would be pumped out by the city anc dumped into the city ' s waste treatment plant . After lengthy discussion , the members of the commission , although sympathetic to the developer ' s problems , conside.-ec. their only option was to uphold the subdivision regulations of the city . A motion was made by Bryant Harry to recommend to the city council rejection of the plat for Canterbury Hill Addition , with the recommendation that the council tae into consideration ( 1 ) the proper handling of a sewe collection tank in order to comply with the best interests of the city , ( 2) we would be open to consideration of a 22 • ft . concrete street which would comply with construction standards . ( 3) that we recognize that the 6" water line is acceptable and that alleys are not a consideration in this development and that they ( the developers ) have complied with the 65 ' right-of-way as requested ; and that R0W be granted to the city to provide ingress and egress for the sewage holding tank. Motion seconded by Kent Crane . Motion carried 4-0-2 . Nancy Conkle and Randy Gaston abstaining . ITEM NO. 9 - DISCUSSION OF MUDDY CREEK RESERVOIR - Gus. Pappas made a presentation aprising the commission members of a problem that has come to the attention of the city concerning proposed mobile home parks . sir . Pappas explainer' that two developers have come to the city with proposed mobile home parks. One developer , Mr . Iloli;an , has a development near Muddy Creek and has petitioned the state for a private sewage treatment plant . After speaking with Mr . Pappas , he is willing to annex into the city , run water and sewer lines and be served by the city of t lylie . The other developer , Mr . Roberts , has a proposed development or: our southeastern border . Mr . Pappas explained that our existing mobile home park ordinance is legally undefendable and asked for the commission to read the ordinance and mate any suggestion for revision that would put the city in better position for defense . Mr . Pappas explained that 1 city ' s strongest protection is zoning and that perhaps we might want to make provision for mobile home parks by zoning . Annexing the parks also puts the city in a position for control . There being no further discussion , a motion was made by Bryant Barry and seconded by Kent Crane for adjournment . Motion carried . Randy Gaston , Chairman it I, MINUTES ZONING BOARD OF ADJUSTMENTS CITY OF WYLIE, TEXAS THURSDAY, DECEMBER 6 , 1984 The Zoning Board of Adjustments met in regular session on Thursday , December 6 , 1984 in the Council Chambers at Csty Hall , ' quorum was present and notice of the meeting had been posted for the time and in the manner required by law . Members present were Anna Starnes , Art Harris , Brian Chaney , John Hamilton and Chairman Richard Hampton . Representing the city staff were Gus Pappas , City Manager , Roy Faires , C.E . O. and Permit Clerk Maureen Dunlop . The meeting was called to order by Chairman Richard Hampton , the first order of business was to approve the minutes from the last meeting . Chairman Hampton asked if everyone had a copy of the minutes and if they had read them over would all who approved please raise their right hand , all approved , none opposed . Next order of business was to consider request for variance on Lot 14 Block D of Rush Creek II , sideyard setback for Rick St . John . . Chairman Hampton asked Rick St . John to explain it to the board , Mr . St . John explained how the encroachment came about . Most of the subdivisions in that area have 20 ' setback requirements , Since March of 81 the setback requirement has been 15 ' . Mr . St . John was aware of this , but somewhere between the preliminary plan stage and the final plan , the 20 'was changed to 15 ' , making St . John ' s house off 4 , 2 ' . This did not come to the attention of St . John until after the people had moved in , were ready to close, and the title company called him, Gus Pappas stated that the ordinance did call for a 20 setback and that St . John had violated that setback . There is no argument with that , the question is , does the Zoning Board want to grant that variance. Mr . Pappas stated that 12 letters had been sent out , 4 were returned , all were in favor of the variance . After some discussion , Chairman Hampton said he had no further questiones , Brian Chaney made a motion for consideration that all letters were for and that it was not a gross violation , therefore , that they go ahead and grant the variance .
