Construction Code Board CITY OF WYLIE Minutes Construction Code Board Thursday, December 8, 2011 — 7:00 pm Wylie Municipal Complex — Council Chambers 300 Country Club, Bldg 100 CALL TO ORDER Announce the presence of a Quorum. Vice Chairman, Bryan Rogers called the meeting to order with the following Construction Code Board Members present: Bryan Rogers, Billy McClendon, Sunil Verma, Brian Huddleston, Terry Benjamin, Mike Grubbs, and Bobby Heath. Staff present was: Building Official, Mike McAnnally; Code Enforcement Officer, Pat Mitchell; Assistant Building Official, Dwight Lancaster; Chief Inspector, Todd White; and Construction Code Board Secretary, Leisa Price. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Construction Code Board regarding an item that is not listed on the Agenda. Residents must provide their name and address. Construction Code Board requests that comments be limited to three (3) minutes. In addition, Construction Code Board is not allowed to converse, deliberate or takes action on any matter presented during citizen participation. There were no citizens present to address the Construction Code Board during Citizens' Comments. BUSINESS ITEMS 1. Consider, and act upon, approving the Minutes from the July 28, 2011 Construction Code Board meeting. Staff Discussion Vice Chairman, Bryan Rogers asked for the board to approve the minutes from the July 28, 2011 Construction Code Board Meeting. Board Action Billy McClendon made a motion to approve the minutes from the July 28, 2011 Construction Code Board meeting. Sunil Verma seconded the motion. A vote was taken and a motion passed 7-0. Minutes— December 8, 2011 Construction Code Board Pagel 2. Consider, and act upon, request of a Sign Appeal Hearing from Wylie First Baptist Church seeking an appeal of a sign permit denied on November 28, 2011. Wylie First Baptist Church is requesting a variance to Sec. 22-445 of the City of Wylie Sign Ordinance #2008-33. The request is to place a temporary banner to promote a Free Gift Wrapping Outreach Ministry that will be from November 26,2011 through December 24, 2011. The banner is 8' x 40'. Staff Discussion Vice Chairman, Bryan Rogers asked if there were any members of the Wylie First Baptist Church on the Board, and if so would they recuse themselves. Zachary Herrera and Terry Benjamin recused themselves and will not be voting on the variance. Charlie Busby on behalf of the Wylie First Baptist Church asked the Construction Code Board to approve a variance for the oversized banner to be placed on the side of a trailer in the field beside the buildings located at 3360 W FM 544 for the period of November 26, 2011 through December 24, 2011. Mr. Busby stated that the banner was promoting a free community outreach ministry and was only to be up for the above mentioned days and would be promptly removed right after Christmas. Building Official, Mike McAnnally stated that the Building Inspections Department had no objection to the granting of the variance and would be issuing a permit for the banner upon approval of the Construction Code Board. Board Action Billy McClendon made a motion to approve the variance. Sunil Verma seconded the motion. A vote was taken and a motion passed 5-0. 3. Bold a public hearing, to provide evidence, seeking a determination that a building(s) located at or near 507 Kylie Ln., Pointe North #2, Block F, Lot 13, Wylie, Collin County, Texas was in violation of standards set out in Ordinance#2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and, seeking an order of approval of the Emergency Secure conducted on May 31,2011. This item was postponed from the July 28,2011 Construction Code Board meeeting. Staff Discussion Code Enforcement Officer, Pat Mitchell presented slides and discussed the reasons for the securing of the property. She also explained that this case had been tabled from the July 28, 2011 Construction Code Board hearing at the request of Mr. Vetter the property owner. Mr. Vetter had requested the postponement of his case until he could be present for the hearing since he currently resided out of town. She also stated that Mr. Vetter had not responded to any of the notices sent to him about the current meeting. She also presented slides showing the condition of the property on December 5, 2011 due to a new complaint and that the property was still in violation. Board Action Billy McClendon made a motion to approve the action taken by the City of Wylie Construction Code Board staff in regards to the property located at 507 Kylie Ln., Pointe North #2, Block F, Lot 13, Wylie, and Collin County. Hold a public hearing, to provide evidence, seeking a determination that a building(s) located at or near 2817 Sutters Mill Way, Cimarron Estates, Block H, Lot 33,Wylie, Collin County, Texas was in violation of standards set out in Ordinance#2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on October 14, 2011. Staff Discussion Pat Mitchell, Code Enforcement Officer presented slides and discussed the reasons for the securing of the property. Board Action Brian Huddleston made a motion to approve the action taken by the City of Wylie Construction Code Board staff at the property located at 2817 Sutters Mill Way, Cimarron Estates, Block H, Lot 33, Wylie, Collin County, Texas. Sunil Verma seconded the motion. A vote was taken and passed 7-0. 5. Authorizing the Chairman of the Construction Code Board to sign the final orders prepared by City staff so long as such final orders are consistent with the orders issued by the Construction Code Board on December 8, 2011. Board Action Sunil Verma made a motion to accept and approve the orders. Michael Grubbs seconded the motion. A vote was taken and passed 7-0. ADJOURNMENT With no further business before the Construction Code Board, a motion was made by Bill McClendon to adjourn the meeting. Sunil Verma seconded the motion.
