Issue Consider and act upon approval of a resolution casting ballots for the Board of Directors for the Central Appraisal District of Collin County, Texas. Background The City of Wylie has 28 votes that they may cast for the Board of Directors of the Central Appraisal District. There are nine nominations and only five board members are selected. Each voting unit must vote in open meeting, report its vote by written resolution and submit it to the Chief Appraiser by November 15, 1997. Each unit may cast all its votes for one candidate or distribute the votes among any number of the candidates listed. There is no provision for write-in candidates and the Chief Appraiser will not count votes for someone not listed on the official ballot. Listed below are the candidates and a brief description about them. RONALD CARLISLE Is a current board member and has served since January, 1994. Nominated by Frisco City and School. DR. LEO FITZGERALD Is a current board member and has served since the beginning of the Appraisal District, January, 1980. Nominated by Plano ISD. ANTHONY GEER Is a current board member and has served 2 different times for a total of 12 years. The first time was April, 1982 - December, 1986 and the second time began January, 1990 to current. Nominated by Anna ISD, Celina ISD and McKinney ISD. OLIN JAYE Is a current board member and has served since January, 1994. Nominated by the City of Plano. Background Mr. Bart Peddicord had been a member of the Planning & Zoning Commission since 1987. Mr. Peddicord passed away in October, 1997. His term would have expired in July of 1998. The Planning & Zoning Commission is a seven member board that makes recommendations to the City Council on the master plan; proposed ordinances and amendments to ordinances regarding planning, zoning and environmental quality; review ordinances and amendments proposed by the City Council relative to the City Council's planning and zoning function; and receive and review all platting and subdivision proposals and makes recommendations to City Council for appropriate actions. The Commission shall meet not less than once each month. Vacancies in an unexpired term shall be filled by the City Council within thirty (30) days from the date of the vacancy. Members of the Planning & Zoning Commission shall be residents of the City of Wylie for at least twelve (12) months preceding the date of appointment; be knowledgeable in the affairs of the city and be knowledgeable in the functions and activities concerning the commission. Applications were taken during the month of May, 1997 to fill any vacancies. Those interested in the serving on the Board are: Weldon Bullock, Jennifer Sherman, Eric Hogue, Gary Starnes and Marie Routon. Financial Considerations N/A Other Considerations Article 9, Section 2(A&B) of the Wylie Home Rule Charter sets out the qualifications for members of the Planning & Zoning Commission. Background Mr. Greg Alford was selected to the Board of Adjustments in July of 1997. Mr. Alford has recently moved out of the city limits. His term will expire in July of 1999. The Board of Adjustments is a five (5) member and two (2) alternate members who shall serve in accordance with Article 1011g, V.A.C.S. Members of the board shall meet at the call of the chairman within thirty (30) days of receipt of written notice from anyone aggrieved as a result of the refusal of a building permit or administrative decision by the city building official. Rules and regulations shall be prescribed for the functioning of the board consistent with the laws of the State of Texas and the building codes of the City of Wylie. The alternates for the Board of Adjustments are: Denise May and Jeff McCoy. Applications were taken during the month of May, 1997 to fill any vacancies. AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE AS HERETOFORE AMENDED SO AS TO GRANT A SPECIFIC USE PERMIT FOR A PERMANENT BATCH PLANT AS HEREIN DEFINED ON A TRACT OF LAND DESCRIBED AS LOTS 11A, 12A, 14 & 15 IN THE WYNDHAM ESTATES, PHASE III SUBDIVISION, ALSO BEING 220 WINDCO CIRCLE; PROVIDING FOR A SEVERABILITY CLAUSE; AND REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a permanent batch plant has been requested by Metrodeck&Affiliated Concrete Company for the property described as Lots 11A, 12A, 14 & 15 in the Wyndham Estates, Phase III subdivision and also being 220 Windco Circle; and, WHEREAS, the Planning and Zoning Commission of the City of Wylie and the governing body of the City of Wylie, in compliance with the laws of the State of Texas and the ordinances of the City of Wylie, have given the requisite notices by publication and otherwise, and have held public hearings and afforded a full and fair hearing to all property owners generally, and to all persons interested in and situated in the affected area and in the vicinity thereof, the governing body in the exercise of its legislative discretion has concluded that the Comprehensive Zoning Ordinance of the City of Wylie should be amended as follows: NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Wylie, Texas: SECTION 1 That the Comprehensive Zoning Ordinance of the City of Wylie, as heretofore amended, be and the same is hereby amended so as to grant a Specific Use Permit for a permanent batch plant as provided herein on the following described property: Lots 11A, 12A, 14 & 15 in the Wyndham Estates, Phase III subdivision, and also being 220 Windco Circle and further described on the approved site plan attached hereto as Exhibit "A". SECTION 2 That the Specific Use Permit shall be subject to the following special conditions: 1. Obtain appropriate permit or exemption from the Texas Natural Resources Conservation Commission (TNRCC) and must comply with the conditions of the Standard Exemption List as follows: Any permanently or temporarily located concrete plant that accomplishes wet batching, dry batching, or central mixing, and operates in compliance with the following conditions: (a) All stockpiles shall be sprinkled with water and/or dust- suppressant chemicals as necessary to achieve maximum control of dust emissions. The stockpile sprinkler system shall be operable at all times. (b) A mechanism shall be installed on each bulk storage silo to warn operators when the silo is full. (c) All permanent in-plant roads (batch truck and material delivery truck roads) shall be pave with a cohesive hard surface that can be repeatedly swept, washed, and maintained intact and cleaned as necessary to achieve maximum control of dust emissions. All batch trucks and material delivery trucks shall remain on a paved surface when entering, conducting primary function, and leaving the property. Other areas on the property subject to vehicle traffic shall be watered, treated with dust suppressant chemicals, oiled, or paved and cleaned as necessary to achieve maximum control of dust emissions. (d) The cement weigh hopper shall be vented to its own fabric filter or the central collection system specified in condition (f). (e) All bulk storage silos shall be equipped with fabric filter(s) having a maximum filtering velocity of 4.0 feet per minute (ft/min) with mechanical cleaning or 7.0 ft/min with automatic air cleaning or shall be vented to the central collection system specified in condition (f). (f) The dust emissions at the batch drop point (drum feed for central mix plants) shall be controlled by a shroud or other pickup device delivering a minimum of 4,000 actual cubic feet per minute of air to a fabric filter with automatic air cleaning and a 7.0 ft/min maximum filtering velocity, or automatic sequenced mechanical cleaning (not manually activated) and a 5.25 ft/min maximum filtering velocity. (g) Unless the facility is to be located temporarily in or contiguous to the right-of-way of a public works project, public notice and opportunity for public hearing, as specified in Section 116.10(a) (3) and (4) and (b), must be published and documentation provided to the Texas Natural Resource Conservation Commission (TNRCC). A temporarily located plant exempt from public notice may provide concrete for the same contractor for project segments with the same governmental entity, but may not produce concrete for other unrelated projects or other governmental entities. (h) Spillage of cement and fly ash used in the batch shall be cleaned up immediately and contained or dampened so that dust emissions from wind erosion and/or vehicle traffic are minimized. (i) All open-bodied vehicles transporting material from a dry batch plant to the paving mixer(s) shall be loaded with a final layer of wet sand and/or the truck shall be covered with a tarp to reduce the emissions of dust to the minimum level possible under existing conditions. (j) Before construction of the facility begins, written site approval shall be received from the Executive Director of the TNRCC, and the facility shall be registered with the TNRCC Office of Air Quality in Austin using Form PI-7, including a current TNRCC table 20. 2. Comply with all other provisions and the requirements pertaining to manufacturing processes in the Industrial District "I" of the Comprehensive Zoning Ordinance including smoke, particulate matter, dust, odor, gas, fumes, glare, vibration, noise, and water pollution. SECTION 3 That the above described tract of land shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City of Wylie as heretofore amended, as amended herein by granting of this Specific Use Permit and as may be amended in the future. SECTION 4 That all ordinances of the City of Wylie in conflict with the provisions of this ordinance be, and the same are hereby repealed to the extent of that conflict. SECTION 5 Any person violating the provisions of this ordinance, or any pat hereof, shall be guilty of committing an unlawful act and shall be subject to the general penalty provisions of Section 38 of the Zoning Ordinance, as the same now exists or is hereafter amended. SECTION 6 If any section, paragraph, or provision of this ordinance or the application of that section, paragraph, or provision to any person, firm, corporation or situation is for any reason judged invalid, the adjudication shall not affect any other section, paragraph, or provision of this ordinance or the application of any other section, paragraph or provision to any other person, firm, corporation or situation, nor shall adjudication affect any other section, paragraph, or provision of the Comprehensive Zoning Ordinance No. 85-23A of the City of Wylie, Texas, and the City Council declares that it would have adopted the valid portions and applications of the ordinance without the invalid parts and to this end the provisions for this ordinance are declared to be severable. Background Metrodeck&Affiliated Concrete Company is requesting to construct and operate a permanent concrete batch plant at 220 Windco Circle. The property on which the "SUP" is being requested is currently zoned Industrial. The City of Wylie's Zoning Ordinance allows a batch plant (permanent)to be located on an Industrial zoned property with the granting of an "SUP". The site under consideration comprises the four lots on the north end of Windco Circle. The property to the west is zoned "I", Industrial, and north of the site is currently zoned "A", Agricultural. The property immediately to the east is zoned "SF-3", Single Family and is the Wyndham Estates subdivision which is built out with single family dwellings. The property to the south is the remainder of Wyndham Estates, Phase III which is currently zoned "I", Industrial. Three of the lots have buildings constructed on them which are office/warehouse type uses and the remaining lots are vacant. The proponent plans to construct an office and a concrete batch facility. The proponent plans to build the facilities in phases with the office and a portion of the yard in the initial phase. A site plan is included to show the layout of the facilities. Metrodeck & Affiliated Concrete Company has made application with the Texas Natural Resource and Conservation Commission (TNRCC) for a Standard Exemption for a permanent concrete batch plant and is passed the notification phase of that process. Enclosed is a list of conditions which must be met to obtain the Standard Exemption. On March 26, 1996, the Planning and Zoning and the City Council considered a request from Bodin Concrete for an "SUP"for a concrete batch plant at 1502 W. Kirby (FM 544). The site was formally a batch plant and was located approximately 1200'from the nearest single family development. The zoning in this location is "I", Industrial to the east and west and "SF-A", Single Family-Attached to the north. Given the fact that the site was located on a major thoroughfare, had previously contained a batch plant, and was separated by the rail right-of- way and some distance from single family development, the Council approved the "SUP"with the condition that all restrictions imposed by the TNRCC be met. Action Agenda Item No 5 Page 1 Background -continued City Staff sent out Public Hearing Notifications to property owners within 200' of the proposed site and to date five have been returned, all opposed to the Specific Use Permit. Included also is all other correspondence that has been received regarding this proposal. Financial Considerations N/A Other Considerations Under Article 9, Section 2 (B2) of the Wylie Home Rule Charter, it states that the Planning and Zoning Commission will recommend to Council proposed ordinances and amendments regarding planning and zoning changes. Board/Commission Recommendations The Planning and Zoning Commission met at their Regular Business Meeting on November 3, 1997 and determined that the use is not in general compliance with the Master Plan of the City. The Board has also determined that the use would not be harmonious and adaptable to building structures and uses of abutting properties and other properties in the vicinity of the premises under consideration. The Planning and Zoning Commission recommended denial for a Specific Use Permit for a concrete batch plant (permanent), by a unanimous vote of 6-0. The applicant was not present at the Planning and Zoning Meeting. Staff Recommendations The property on which this "SUP" is proposed was zoned "I", Industrial in August 1983. The Comprehensive Plan, adopted in 1994, shows this area is to be developed primarily for low density residential. Industrial zoning is not recommended adjacent to single family residential zoning in the Comprehensive Plan and limiting the types of uses allowed in this area is desirable. The use of batch plant (permanent) is a more intensive use of Industrial zoning and should not be permitted adjacent to single family zoning. Therefore, Staff recommends denying this "SUP" request. It would be very costly for us to clean every part in order to remove the concrete dust prior to shipment. Any permanently or temporarily located concrete plant* that accomplishes wet batching, dry batching, or central mixing, and operates in compliance with the following conditions: • (a) All stockpiles shall be sprinkled with water and/or dust-suppressant chemicals as necessary to achieve maximum control of dust emissions. The stockpile sprinkler system shall be operable at all times. • (b) A mechanism shall be installed on each bulk storage silo to warn operators when the silo is full. (c) All permanent in-plant roads (batch truck and material delivery truck roads) shall be paved with a cohesive hard surface that can be repeatedly swept, washed, and maintained intact and cleaned as necessary to achieve maximum control of dust emissions. All batch trucks and material delivery trucks shall remain on a paved surface when entering, conducting primary function, and leaving the property. Other areas on the property subject to vehicle traffic shall be watered, treated with dust- suppressant chemicals, oiled, or paved and cleaned as necessary to achieve maximum control of dust emissions. (d) The cement weigh hopper shall be vented to its own fabric filter or the central collection system specified in condition (f). • (e) All bulk storage silos shall be equipped with fabric filter(s) having a maximum filtering velocity of 4.0 feet per minute (ft/min) with mechanical cleaning or 7.0 ft/min with automatic air cleaning or shall be vented to the central collection system specified in condition (f). (f) The dust emissions at the batch drop point (drum feed for central mix plants) shall be controlled by a shroud or other pickup device delivering a minimum of 4,000 actual cubic feet per minute of air to a fabric filter with automatic air cleaning and a 7.0 ft/min maximum filtering velocity, or automatic sequenced mechanical cleaning (not manually activated) and a 5.25 ft/min maximum filtering velocity. (g) Unless the facility is to be located temporarily in or contiguous to the right-of-way of a public works project, public notice and opportunity for public hearing, as specified in Section 116.10(a) (3) and (4) and (b), must be published and documentation provided to the Texas Natural Resource Conservation Commission (TNRCC). A temporarily located plant exempt from public notice may provide concrete for the same contractor for project segments with the same governmental entity, but may not produce ' concrete for other unrelated projects or other governmental entities. (h) Spillage of cement and fly ash used in the batch shall be cleaned up immediately and contained or dampened so that dust emissions from wind erosion and/or vehicle traffic are minimized. (i) All open-bodied vehicles transporting material from a dry batch plant to the paving mixer(s) shall be loaded with a final layer of wet sand and/or the truck shall be covered with a tarp to reduce the emissions of dust to • the minimum level possible under existing conditions. (j) Before construction of the facility begins, written site approval shall be received from the Executive Director of the TNRCC, and the facility shall be registered with the TNRCC Office of Air Quality in Austin using Form PI-7, including a current TNRCC table 20. • A temporarily located concrete facility occupies a designated site for not more than 180 consecutive days or supplies concrete for a single public works project or for the same contractor for related project segments, but not other unrelated projects. Horton for a zone change from "ME', Multi-Family and "B-1", Business to "SF-3", Single Family-3 for a 56.287 acre tract of land, located directly north of the Newport Harbor Subdivision, east of FM 1378, and further described as the James McUlmurry Survey, Abstract No.l'629, Tract 5. Background D. R. Horton has applied for a zone change on property currently owned by the Baylor Health Care System Foundation and has the permission of the Baylor Health Care System Foundation to seek the requested zone change. The property is located on the east side of FM 1378, directly north of Phase I of the Newport Harbor Subdivision. The current zoning on the property, established in 1985, was a combination of"MF", Multi-Family and "B-1", Business. The Comprehensive Plan, adopted by the City of Wylie in 1994, recognized the zoning in place in the Land Use Map. However, the Comprehensive Plan calls for the predominate land use for the City of Wylie to be low density residential and the use of single family residential would be more desirable in this particular location than the multi-family use or the more intense commercial use of"B-1". The SF-3 zoning classification satisfies the definition of low density residential. The proposed zoning in this subdivision continues the established pattern of single family residential development in the area. The northern boundary of the property is the northern City Limits of the City of Wylie. FM 1378 is located to the west and is the western City Limits. The eastern edge of the subdivision is the City Limit shared with the City of St. Paul. Since none of these areas are in the City of Wylie, there is no zoning established on these tracts of land. The southern edge of this property is bounded by the Newport Harbor Subdivision which is zoned SF-3. Forty-eight Public Hearing Notices were sent to property owners within 200' of the property. Six responses were returned, all in favor of the zone change request. Financial Considers ions The Zoning Application fee of$250 has been paid. Action Agenda Item No 6 Page 1 Other Considerations Under Article 9, Section 2 (B2) of the Wylie Home Rule Charter, it states that the Planning and Zoning Commission will recommend to Council proposed ordinances and amendments regarding planning and zoning changes. Board/Commission Recommendations At the Planning and Zoning Meeting of October 20, 1997, the Commission made a motion to deny the zone change request with all in favor, 5-0. Sincerely, Steve Topletz WYLIE CITY COUNCIL r1/141 ACTION AGENDA COMMUNICATION ITEM NO 8 November 11, 1997 Issue Hold the first of two public hearings for the annexation of 22.52 acres out of the Richard Newman Survey, Abstract No. 660, Collin County, Texas and being part of the 411.15 acre tract of land described in deed to C. J. Thomsen, recorded in Volume 742, Page 64 of the Deed Records of Dallas County, Texas. Background The Wylie City Council on February 24, 1997 gave approval to Herzog Development Corporation's Woodbridge Development District Conceptual Plan. The issue of a boundary exchange between the cities of Sachse and Wylie were discussed during a January 1997 work session and action was formally taken at the October 28, 1997 Council Meeting. The proposal to exchange boundaries arose after a thorough evaluation of the conceptual plan. A conclusion was made that it would be difficult to provide some city services to several of the lots shown to be in Wylie. Specifically, a portion of the golf course would physically separate 43 lots from the approximately 940 lots to be developed within Wylie. The only access to these 43 lots would be from a thoroughfare extending east from State Highway 78 and located in the City of Sachse. Attachment B shows the city limit boundaries between Wylie and Sachse when the original conceptual plan was approved. Attachment C shows the proposed city limit boundaries. The Boundary Agreement requires an exchange of land between the two cities. Wylie will disannex two tracts into Sachse's ETJ totaling approximately 18.82 acres, that are shown in the original conceptual plan as 43 lots. Sachse will disannex two tracts into Wylie's ETJ, totaling approximately 75.36 acres, that are shown in the original conceptual plan as a portion of the golf course. The cities will then annex the tracts within their ETJ. Under this agreement, the golf course would be located solely within the City of Wylie. The 43 lots that the City of Wylie is exchanging for the golf course portion included 20 lots with a minimum lot size of 7,200 square feet and 23 lots with a minimum lot size of 9,000 square feet. Action Agenda Item No 8 Page 1 Background - continued A golf course is a very popular and important quality of life amenity that is a proven draw for residential development and a valuable business/commercial development tool as well. The overall value that the golf course represents is of greater value than the loss of property tax revenue. In addition, the city would no longer be responsible for the provision of services to the 43 remote lots. The tract of land which adjoin Sachse's city limits, but presently now lie within the city limits of the City of Sachse, is a 22.521 acre tract of land, described on Exbihit "C", by metes and bounds. By annexing this property, the City of Wylie will obtain the extraterritorial jurisdiction to the said tract so that the tracts will belong to the City of Wylie. The time line for the annexation is as follows: First Notice to the Paper October 29, 1997 First Public Hearing November 11, 1997 Second Notice to the Paper November 26, 1997 Second Public Hearing December 9, 1997 Adpot Ordinance January 9, 1997 The approval of equal access demonstrates an act of good faith and cooperation by the City of Wylie. It is anticipated in the future that there will be several issues in which a level of cooperation will be necessary between the two cities. Financial Consideration The exchange of the 43 lots represents a potential loss of ad valorem tax revenue. If the average value of the homes constructed was $125,000, the annual property taxes paid per year at the current tax rate of .0665 (43 lots X $830) would be approximately $35,690. The Collin County Central Appraisal District has provided information to the city that establishes the assessed valuation of a golf course is calculated at $10,000 per acre plus the value of the golf course. Preliminary plans show that the golf course will be constructed on 170 acres and will be built for approximately six (6) million dollars. Based on these figures, approximately $47,000 would be generated in property taxes per year at the current tax rate of .0665. Additional revenues will also be generated through sales taxes collected on green and cart fees and merchandise and concession items in the Club House. Based on revenue of one (1) million, the combined sales taxes collected for the general fund, 4A and 4B would be $20,000 annually. The golf course will also use a large amount of water. Specific details regarding amounts of water are not known at this time. The golf course will open as a privately operated facility. The city has no financial obligations. Action Agenda Item No 8 Page 2 Other Consideration Article 1, Section 3 of the Wylie City Charter provided authority to the City Council to adjust boundaries. Wylie will also be required when the annexations are considered, under Section 43.056 of the Local Government Code, for provisions of Services to the annexed areas and use it as directed in said statute. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") under the authority of Section 43.021, Local Government Code and City of Wylie, Texas' ("Wylie") Home Rule Charter, investigated and determined that it would be advantageous and beneficial to Wylie and its inhabitants to annex the below-described property (the "Property") to Wylie; and WHEREAS, prior to conducting the public hearings required under Section 43.052, Local Government Code, the City Council also investigated and determined that the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and contiguous to the existing city limits of Wylie; and WHEREAS, before the publication of the notice of the first public hearing regarding the annexation of the Property, the City Council directed the appropriate persons to prepare a service plan that provides for the extension of full municipal services to the Property to be annexed; and WHEREAS, the City Council finds that the service plan has been prepared in full compliance with Section 43.056, Local Government Code, and has been made available for public ORDINANCE ANNEXING 22.52 ACRES,CITY OF WYLIE,COLLIN COUNTY,TEXAS-Page 1 inspection and was available for explanation to the inhabitants of the Property at the public hearings; and WHEREAS, the City Council finds that the field notes close the boundaries of the Property being annexed; and WHEREAS, the City Council has conducted at least two (2) public hearings at which persons interested in the annexation were given an opportunity to be heard regarding the proposed annexation and the proposed service plan; and WHEREAS, the City Council finds the public hearings were conducted on or after the fortieth (40th) day but before the twentieth (20th) day before the date of institution of the annexation proceedings; and WHEREAS, the City Council finds it has completed the annexation process within ninety (90) days after the City Council instituted annexation proceedings; and WHEREAS, the City Council finds that all legal notices, hearings, procedures and publishing requirements for annexation have been performed and completed in the manner and form set forth by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: The Property described as follows and all public streets, roadways and alleyways located within or contiguous to the same is hereby annexed to Wylie, to-wit: 22.52 acre tract of land, more or less, situated in the Richard Newman Survey, Abstract No. 660 and being part of the 411.15 acre tract of land described in Deed to C. J. Thomsen, recorded in Volume 742, Page 64 of the Deed Records of Dallas County, Texas. ORDINANCE ANNEXING 22.52 ACRES,CITY OF WYLIE,COLLIN COUNTY,TEXAS-Page 2 SECTION 2: The Service Plan for the Property is attached hereto as Exhibit "B" and made a part hereof for all purposes. SECTION 3: That from and after the passage of this Ordinance, the Property shall be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and privileges of all of the citizens of Wylie and shall be bound by all of the ordinances and regulations enacted pursuant to and in conformity with the City Charter and the laws of the State of Texas. SECTION 4: That the official map and boundaries of Wylie are hereby amended to include the Property as part of the City of Wylie, Texas, and that a certified copy of this Ordinance shall be filed in the county clerk's office of Collin County, Texas. SECTION 5: It shall be unlawful for any person, firm or corporation to make use of the Property in some manner other than as authorized by this Ordinance and Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto; and it shall be unlawful for any person, firm or corporation to construct on the Property any building that is not in conformity with the permissible use under this Ordinance and Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto. SECTION 6: Any person, firm or corporation who violates any provision of this Ordinance and Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto, shall be deemed guilty of a misdemeanor and upon conviction shall be fined a sum not exceeding Two Thousand and 00/100 Dollars ($2000.00), and each and every day such violation continues shall be considered a separate offense; provided, however, such penal provision shall not preclude a suit to enjoin such violation. SECTION 7: Should any part or portion of this Ordinance, or the use created herein or ORDINANCE ANNEXING 22.52 ACRES,CITY OF WYLIE,COLLIN COUNTY, TEXAS-Page 3 under Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto, be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions shall remain in full force and effect. POLICE SERVICE 1 . Patrolling, responses to calls and other routine police services, within the limits of existing personnel and equipment and in a manner consistent with any of the methods of the City of Wylie, Texas, extends police service to any other area of the municipality, will be provided within sixty(60) days of the effective date of the annexation ordinance, 2. As development and construction commence in this area, sufficient police personnel and equipment will be provided to furnish this area the maximum level of police services consistent with the characteristics of topography, land utilization and population density within two(2)years from the effective date of the annexation ordinance, or upon commencement of development within the area, whichever occurs later. 3. Upon ultimate development of the areb, the same level of police services will be provided to this area as are furnished throughout the City. B. FIRE SERVICES 1. Fire protection and emergency ambulance equipment by the present personnel and the present equipment of the Fire Department, within the limitations of available water and distances from existing fire stations, and in a manner consistent with any of the methods of the City of Wylie, Texas, extends fire service to any other area of the municipality, will be provided to this area within sixty (60) days of the effective date of the annexation ordinance. As development and construction commence in this area, sufficient fire and emergency ambulance equipment will be provided to furnish this area the maximum level of police services consistent with the characteristics of topography, land utilization and population density within the area as determined by the City Council within two (2) years from the effective date of the annexation ordinance, or upon commencement of development within the area, whichever occurs later. 3. Upon ultimate development of the area, the same level of fire and emergency ambulance services will be provided to this area as are furnished throughout the City. C. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES 1 . Enforcement of the CrtVs environmental health ordinances and regulations, including but not limited to, weed and brush ordinances, junked and abandoned vehicle ordinances and animal control ordinances, shall be provided within this area sixty (60) days of the effective date of the annexation ordinance. These ordinances and regulations will be enforced through the use of existing personnel. Complaints of ordinance or regulation violations within this area will be answered and investigated within sixty(60) days of the effective date of the annexation ordinance. 2. Inspection services, including the review of building plans, the issuance of permits and the inspection of all buildings, plumbing, mechanical and electrical work to ensure compliance with City codes and ordinances will be provided within sixty(60) days • of the effective date of the annexation ordinance. Existing personnel will be used to provide these services, 3. The City's zoning, subdivision, sign and other ordinances shall be enforced in this area beginning within sixty (60) days of the effective date of the annexation ordinance. 4. All inspection services furnished by the City of Wylie, but not mentioned above, will be provided to this area beginning within sixty (60) days of the effective date of the annexed ordinance. 5. As development and construction commence in this area, sufficient personnel will be provided to furnish this area the same level of Environmental Health and Code Enforcement Services as are furnished throughout the City. Page 2 D. PLANNING AND ZONING SERVICES The planning and zoning jurisdiction of the City will extend to this area within sixty(60) days of the effective date of the annexation ordinance, City planning will thereafter encompass this property, and it shall be entitled to consideration for zoning in accordance with the Citys Comprehensive Zoning Ordinance and Comprehensive Plan, E. PARK AND RECREATION SERVICES 1 , Residents of this property may utilize all existing park and recreational services, facilities and sites throughout the City, beginning within sixty (60) days of the effective date of the annexation ordinance. 2, Additional facilities and sites to serve this property and its residents will be acquired, developed and maintained at locations and times provided by applicable plans, policies and programs and decisions of the City of Wylie. This property will be included in all plans for providing parks and recreation services to the City. 3, Existing parks, playgrounds, swimming pools and other recreational facilities within this property shall, upon dedication to and acceptance by the City, be maintained and operated by the City of Wylie, but not otherwise. F. SOLID WASTE COLLECTION 1 , Solid waste collection shall be provided to the property in accordance with existing Ctty policies, beginning within sixty(60)days of the effective date of the annexation ordinance. Residents of this property utilizing private collection services at the time of annexation shall continue to do so until it becomes feasible because of increased density of population to serve the property municipally. Commercial refuse collection services will be provided to any business located in the annexed area at the same price as presently provided for any business customer within the City of Wylie, upon request, 2, As development and construction commence in this property and population density increases to the property level, solid waste collection shall be provided to this property in accordance with the current policies of the City as to frequency, changes and so forth. 3. Solid wast collection shall begin within sixty (60) days of the effective date of the annexation ordinance. • Page 3 • G. STREETS 1. The City of Wylie's existing policies with regard to street maintenance, applicable throughout the entire City, shall apply to this property beginning within sixty(60) days of the effective date of the annexation ordinance. Unless a stoat within this property has been constructed or is improved to the Citys standards and specifications, that strcct will not be maintained by the City of Wylie. 2. As development, improvement or construction of strcots to City standards commences within this property, the policies of the City of Wylie with regard to participation in the costs thereof, acceptance upon completion and maintenance after completion, shall apply, 3. The same level of maintenance shall be provided to strccts within this property which have been accepted by the City of Wylie as is provided to City strccts throughout the City. 4. Strect lighting installed on strccts improved to City standards shall be maintained by either TU Electric or Collin County Co-Op in accordance with current City policies. H. WATER SERVICES 1 . Connection to existing City water mains for water service for domestic, commercial and industrial use within this property will be provided in accordance with existing City policies. Upon connection to existing mains, water will be provided at rates established by City ordinances for such service throughout the City. 2. As development and construction commence in this property, water mains of the City will be extended in accordance with provisions of the Subdivision Regulations and other applicable ordinances and regulations. City participation in the costs of these extensions shall be in accordance with the applicable City ordinances and regulations. Such extensions will be commenced within two (2) years from the effective date of the annexation ordinance and substantially completed with four and one-half (41/2)years after that date. 3. Water mains installed or improved to City standards which are within the annexed area and are within dedicated easements shall be maintained by the City of Wylie beginning within sixty(60) days of the effective date of the annexation ordinance. 4. Private water lines within this property shall be maintained by their owners in accordance with existing policies applicable throughout the City. Page 4 I. SANITARY SEWER SERVICES 1 . Connections to existing City sanitary sewer mains for sanitary sewage service in this area will be provided in accordance with existing City policies. Upon connection, sanitary sewage service will be provided at rates established by City ordinances for such service throughout the City. 2. Sanitary sewage mains and/or lift stations installed or improved to City standards, located in dedicated easements, and which are within the annexed area and are connected to City mains will be maintained by the City of Wylie beginning within sixty (60) days of the effective date of the annexation ordinance. . . 3. As development and construction commence in this area, sanitary sewer mains of the City will be extended in accordance with provisions of the Subdivision Regulations and other applicable City ordinances and regulations. Such extensions will be commenced within two (2)years from the effective date of the annexation ordinance and substantially completed within four and one-half (41)years after that date. J. MISCELLANEOUS • 1 . Any facility or building located within the annexed area and utilized by the City of Wylie in providing services to the area will be maintained by the City commencing upon the date of use or within sixty (60) days of the effective date of the annexation ordinance, whichever occurs later, 2. General municipal administration and administrative services of the City shall be available to the annexed area beginning within sixty(60) days of the effective date of the annexation ordinance. • Page 5 WYLIE CITY COUNCIL ACTION AGENDA COMMUNICATION ITEM NO 9 November 11, 1997 Issue Hold the first of two public hearings for the annexation of 52,84 acres out of the Richard Newman Survey, Abstract No. 660, Collin County, Texas and the Richard Newman Survey, Abstract No. 10-72, Dallas County, Texas and being part of the 411.15 acre tract of land described in Deed to C. J. Thomsen, recorded in Volume 78045, Page 4135 of the Deed Records of Dallas County, Texas. Background The Wylie City Council on February 24, 1997 gave approval to Herzog Development Corporation's Woodbridge Development District Conceptual Plan. The issue of a boundary exchange between the cities of Sachse and Wylie were discussed during a January 1997 work session and action was formally taken at the October 28, 1997 Council Meeting. The proposal to exchange boundaries arose after a thorough evaluation of the conceptual plan. A conclusion was made that it would be difficult to provide some city services to several of the lots shown to be in Wylie. Specifically, a portion of the golf course would physically separate 43 lots from the approximately 940 lots to be developed within Wylie. The only access to these 43 lots would be from a thoroughfare extending east from State Highway 78 and located in the City of Sachse. Attachment B shows the city limit boundaries between Wylie and Sachse when the original conceptual plan was approved. Attachment C shows the proposed city limit boundaries. The Boundary Agreement requires an exchange of land between the two cities. Wylie will disannex two tracts into Sachse's ETJ totaling approximately 18.82 acres, that are shown in the original conceptual plan as 43 lots. Sachse will disannex two tracts into Wylie's ETJ, totaling approximately 75.36 acres, that are shown in the original conceptual plan as a portion of the golf course. The cities will then annex the tracts within their ETJ. Under this agreement, the golf course would be located solely within the City of Wylie. The 43 lots that the City of Wylie is exchanging for the golf course portion included 20 lots with a minimum lot size of 7,200 square feet and 23 lots with a minimum lot size of 9,000 square feet. Action Agenda Item No 9 Page 1 Background -continued A golf course is a very popular and important quality of life amenity that is a proven draw for residential development and a valuable business/commercial development tool as well. The overall value that the golf course represents is of greater value than the loss of property tax revenue. In addition, the city would no longer be responsible for the provision of services to the 43 remote lots. The tract of land which adjoin Sachse's city limits, but presently now lie within the city limits of the City of Sachse, is a 52.84 acre tract of land, described on Exbihit "C", by metes and bounds. By annexing this property, the City of Wylie will obtain the extraterritorial jurisdiction to the said tract so that the tracts will belong to the City of Wylie. The time line for the annexation is as follows: First Notice to the Paper October 29, 1997 First Public Hearing November 11, 1997 Second Notice to the Paper November 26, 1997 Second Public Hearing December 9, 1997 Adpot Ordinance January 9, 1997 The approval of equal access demonstrates an act of good faith and cooperation by the City of Wylie. It is anticipated in the future that there will be several issues in which a level of cooperation will be necessary between the two cities. Fin.ncial Consideratio The exchange of the 43 lots represents a potential loss of ad valorem tax revenue. If the average value of the homes constructed was $125,000, the annual property taxes paid per year at the current tax rate of .0665 (43 lots X $830) would be approximately $35,690. The Collin County Central Appraisal District has provided information to the city that establishes the assessed valuation of a golf course is calculated at $10,000 per acre plus the value of the golf course. Preliminary plans show that the golf course will be constructed on 170 acres and will be built for approximately six (6) million dollars. Based on these figures, approximately $47,000 would be generated in property taxes per year at the current tax rate of .0665. Additional revenues will also be generated through sales taxes collected on green and cart fees and merchandise and concession items in the Club House. Based on revenue of one (1) million, the combined sales taxes collected for the general fund, 4A and 4B would be $20,000 annually. The golf course will also use a large amount of water. Specific details regarding amounts of water are not known at this time. The golf course will open as a privately operated facility. The city has no financial obligations. Action Agenda Item No 9 Page 2 Other Consideration Article 1, Section 3 of the Wylie City Charter provided authority to the City Council to adjust boundaries. Wylie will also be required when the annexations are considered, under Section 43.056 of the Local Government Code, for provisions of Services to the annexed areas and use it as directed in said statute. AN ORDINANCE ANNEXING A 52.84 ACRE TRACT OF LAND, MORE OR LESS, SITUATED IN THE RICHARD NEWMAN SURVEY, ABSTRACT NO. 660 AND ABSTRACT NO. 1072, BEING PART OF THE 411.15 ACRE TRACT OF LAND DESCRIBED IN DEED TO C. J. THOMSEN, RECORDED IN VOLUME 78045, PAGE 4135 OF THE DEED RECORDS OF DALLAS COUNTY, TEXAS; PROVIDING THAT THE OWNERS AND INHABITANTS OF THE ABOVE-DESCRIBED TRACT OF LAND SHALL BE ENTITLED TO THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF WYLIE AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND HEREINAFTER ADOPTED; PROVIDING FOR A PENALTY FOR A VIOLATION OF THIS ORDINANCE AND COMPREHENSIVE ZONING ORDINANCE NO. 91-24, CHAPTER 12, EXHIBIT "A" OF WYLIE'S CODE OF ORDINANCES; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") under the authority of Section 43.021, Local Government Code and City of Wylie, Texas' ("Wylie") Home Rule Charter, investigated and determined that it would be advantageous and beneficial to Wylie and its inhabitants to annex the below-described property (the "Property") to Wylie; and WHEREAS, prior to conducting the public hearings required under Section 43.052, Local Government Code, the City Council also investigated and determined that the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and contiguous to the existing city limits of Wylie; and WHEREAS, before the publication of the notice of the first public hearing regarding the annexation of the Property, the City Council directed the appropriate persons to prepare a service plan that provides for the extension of full municipal services to the Property to be annexed; and ORDINANCE ANNEXING 52.84 ACRES,CITY OF WYLIE,COLLIN COUNTY,TEXAS-Page 1 WHEREAS, the City Council finds that the service plan has been prepared in full compliance with Section 43.056, Local Government Code, and has been made available for public inspection and was available for explanation to the inhabitants of the Property at the public hearings; and WHEREAS, the City Council finds that the field notes close the boundaries of the Property being annexed; and WHEREAS, the City Council has conducted at least two (2) public hearings at which persons interested in the annexation were given an opportunity to be heard regarding the proposed annexation and the proposed service plan; and WHEREAS, the City Council finds the public hearings were conducted on or after the fortieth (40th) day but before the twentieth (20th) day before the date of institution of the annexation proceedings; and WHEREAS, the City Council finds it has completed the annexation process within ninety (90) days after the City Council instituted annexation proceedings; and WHEREAS, the City Council finds that all legal notices, hearings, procedures and publishing requirements for annexation have been performed and completed in the manner and form set forth by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: The Property described as follows and all public streets, roadways and alleyways located within or contiguous to the same is hereby annexed to Wylie, to-wit: ORDINANCE ANNEXING 52.84 ACRES,CITY OF WYLIE,COLLIN COUNTY,TEXAS-Page 2 52.84 acre tract of land, more or less, situated in the Richard Newman Survey, Abstract No. 660 and Abstract No. 1072, being part of the 411.15 acre tract of land described in Deed to C. J. Thomsen, recorded in Volume 78045, Page 4135 of the Deed Records of Dallas County, Texas. SECTION 2: The Service Plan for the Property is attached hereto as Exhibit "B" and made a part hereof for all purposes. SECTION 3: That from and after the passage of this Ordinance, the Property shall be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and privileges of all of the citizens of Wylie and shall be bound by all of the ordinances and regulations enacted pursuant to and in conformity with the City Charter and the laws of the State of Texas. SECTION 4: That the official map and boundaries of Wylie are hereby amended to include the Property as part of the City of Wylie, Texas, and that a certified copy of this Ordinance shall be filed in the county clerk's office of Collin County, Texas. SECTION 5: It shall be unlawful for any person, firm or corporation to make use of the Property in some manner other than as authorized by this Ordinance and Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto; and it shall be unlawful for any person, firm or corporation to construct on the Property any building that is not in conformity with the permissible use under this Ordinance and Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto. SECTION 6: Any person, firm or corporation who violates any provision of this Ordinance and Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto, shall be deemed guilty of a misdemeanor and upon conviction shall be fined a sum not exceeding Two Thousand and 00/100 Dollars ($2000.00), and each and every day such violation continues shall be considered a separate offense; provided, however, such penal ORDINANCE ANNEXING 52.84 ACRES,CITY OF WYLIE,COLLIN COUNTY,TEXAS-Page 3 provision shall not preclude a suit to enjoin such violation. SECTION 7: Should any part or portion of this Ordinance, or the use created herein or under Comprehensive Zoning Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendments thereto, be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions shall remain in full force and effect. POLICE SERVICE 1. Fire protection and emergency ambulance equipment by the present personnel and the present equipment of the Fire Department, within the limitations of available water and distances from existing fire stations, and in a manner consistent with any of the methods of the City of Wylie, Texas, extends fire service to any other area of the municipality, will be provided to this area within sixty (60) days of the effective date of the annexation ordinance. Page 1 2, As development and construction commence in this area, sufficient fire and emergency ambulance equipment will be provided to furnish this area the maximum level of police services consistent with the characteristics of topography, land utilization and population density within the area as determined by the City Council within two (2) years from the effective date of the annexation ordinance, or upon commencement of development within the area, whichever occurs later. 3, Upon ultimate development of the area, the same level of fire and emergency ambulance services will be provided to this area as are furnished throughout the City. C. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES 1 . Enforcement of the Citys environmental health ordinances and regulations, including but not limited to, weed and brush ordinances, junked and abandoned vehicle ordinances and animal control ordinances, shall be provided within this area sixty (60) days of the effective date of the annexation ordinance, These ordinances and regulations will be enforced through the use of existing personnel. Complaints of ordinance or regulation violations within this area will be answered and investigated within sixty(60) days of the effective date of the annexation ordinance, 2, Inspection services, including the review of building plans, the issuance of permits and the inspection of all buildings, plumbing, mechanical and electrical work to ensure compliance with City codes and ordinances will be provided within sixty (60) days of the effective date of the annexation ordinance, Existing personnel will be used to provide these services, 3, The City's zoning, subdivision, sign and other ordinances shall be enforced in this area beginning within sixty (60) days of the effective date of the annexation ordinance. 4. All inspection services furnished by the City of Wylie, but not mentioned above, will be provided to this area beginning within sixty(60) days of the effective date of the annexed ordinance, 5. As development and construction commence in this area, sufficient personnel will be provided to furnish this area the same level of Environmental Health and Code Enforcement Services as are furnished throughout the City. Page 2 • D. PLANNING AND ZONING SERVICES The planning and zoning jurisdiction of the City will extend to this area within sixty(60) days of the effective date of the annexation ordinance. City planning will thereafter encompass this property, and it shall be entitled to consideration for zoning in accordance with the Citys Comprehensive Zoning Ordinance and Comprehensive Plan. E. PARK AND RECREATION SERVICES 1 . Residents of this property may utilize all existing park and recreational services, facilities and sites throughout the City, beginning within sixty (60) days of the effective date of the annexation ordinance. 2. Additional facilities and sites to serve this property and its residents will be acquired, developed and maintained at locations and times provided by applicable plans, policies and programs and decisions of the City of Wylie. This property will be included in all plans for providing parks and recreation services to the City. 3. Existing parks, playgrounds, swimming pools and other recreational facilities within this property shall, upon dedication to and acceptance by the City, be maintained and operated by the City of Wylie, but not otherwise, F. SOLID WASTE COLLECTION 1 , Solid waste collection shall be provided to the property in accordance with existing City policies, beginning within sixty(60)days of the effective date of the annexation ordinance. Residents of this property utilizing private collection services at the time of annexation shall continue to do so until it becomes feasible because of Increased density of population to serve the property municipally. Commercial refuse collection services will be provided to any business located in the annexed area at the same price as presently provided for any business customer within the City of Wylie, upon request. 2. As development and construction commence in this property and population density increases to the property level, solid waste collection shall be provided to this property in accordance with the current policies of the City as to frequency, changes and so forth. 3. Solid wast collection shall begin within sixty (60) days of the effective date of the annexation ordinance. • Page 3 G. STREETS 1 . The City of Wylie's existing policies with regard to street maintenance, applicable throughout the entire City, shall apply to this property beginning within sixty(60) days of the effective date of the annexation ordinance. Unless a street within this property has been constructed or is improved to the Citys standards and specifications, that street will not be maintained by the City of Wylie, 2. As development, improvement or construction of streets to City standards commences within this property, the policies of the City of Wylie with regard to participation in the costs thereof, acceptance upon completion and maintenance after completion, shall apply. 3. The same level of maintenance shall be provided to streets within this property which have been accepted by the City of Wylie as is provided to City streets throughout the City. 4. Street lighting installed on streets improved to City standards shall be maintained by either TU Electric or Collin County Co-Op in accordance with current City policies. H. WATER SERVICES 1 . Connection to existing City water mains for water service for domestic, commercial and industrial use within this property will be provided in accordance with existing City policies. Upon connection to existing mains, water will be provided at rates established by City ordinances for such service throughout the City. 2. As development and construction commence in this property, water mains of the City will be extended in accordance with provisions of the Subdivision Regulations and other applicable ordinances and regulations. City participation in the costs of these extensions shall be in accordance with the applicable City ordinances and regulations. Such extensions will be commenced within two (2)years from the effective date of the annexation ordinance and substantially completed with four and one-half (41)years after that date. 3. Water mains installed or improved to City standards which are within the annexed area and are within dedicated easements shall be maintained by the City of Wylie beginning within sixty(60) days of the effective date of the annexation ordinance. 4. Page 5 WYLIE CITY COUNCIL ACTION AGENDA COMMUNICATION ITEM NO 10 November 11, 1997 Issue Hold the first of two public hearings for the diannexation of 3.21 acres out of the Richard Newman Survey, Abstract No. 660, Collin County, Texas and being part of the 195.939 acre tract of land described in deed to Belco Equities, Inc., recorded in Collin County Clerk's file no. 95-0003093 of the land records of Dallas County, Texas. Background The Wylie City Council on February 24, 1997 gave approval to Herzog Development Corporation's Woodbridge Development District Conceptual Plan. The issue of a boundary exchange between the cities of Sachse and Wylie were discussed during a January 1997 work session and action was formally taken at the October 28, 1997 Council Meeting. The proposal to exchange boundaries arose after a thorough evaluation of the conceptual plan. A conclusion was made that it would be difficult to provide some city services to several of the lots shown to be in Wylie. Specifically, a portion of the golf course would physically separate 43 lots from the approximately 940 lots to be developed within Wylie. The only access to these 43 lots would be from a thoroughfare extending east from State Highway 78 and located in the City of Sachse. Attachment B shows the city limit boundaries between Wylie and Sachse when the original conceptual plan was approved. Attachment C shows the proposed city limit boundaries. The Boundary Agreement requires an exchange of land between the two cities. Wylie will disannex two tracts into Sachse's ETJ totaling approximately 18.82 acres, that are shown in the original conceptual plan as 43 lots. Sachse will disannex two tracts into Wylie's ETJ, totaling approximately 75.36 acres, that are shown in the original conceptual plan as a portion of the golf course. The cities will then annex the tracts within their ETJ. Under this agreement, the golf course would be located solely within the City of Wylie. The 43 lots that the City of Wylie is exchanging for the golf course portion included 20 lots with a minimum lot size of 7,200 square feet and 23 lots with a minimum lot size of 9,000 square feet. Action Agenda Item No 10 Page 1 Background _cmiin ext A golf course is a very popular and important quality of life amenity that is a proven draw for residential development and a valuable business/commercial development tool as well. The overall value that the golf course represents is of greater value than the loss of property tax revenue. In addition, the city would no longer be responsible for the provision of services to the 43 remote lots. The tract of land which adjoin Sachse's city limits, but presently now lie within the city limits of the City of Wylie, is a 3.21 acre tract of land, described on Exbihit "B", by metes and bounds. By disannexing this property, the City of Wylie will release and relinquish its extraterritorial jurisdiction to the said tracts so that the tracts will belong to the City of Sachse, Texas. The time line for the disannexation is as follows: First Notice to the Paper October 29, 1997 First Public Hearing November 11, 1997 Second Notice to the Paper November 26, 1997 Second Public Hearing December 9, 1997 Adpot Ordinance January 9, 1997 The approval of equal access demonstrates an act of good faith and cooperation by the City of Wylie. It is anticipated in the future that there will be several issues in which a level of cooperation will be necessary between the two cities. Financial Concfr' ration The exchange of the 43 lots represents a potential loss of ad valorem tax revenue. If the average value of the homes constructed was $125,000, the annual property taxes paid per year at the current tax rate of.0665 (43 lots X $830) would be approximately $35,690. The Collin County Central Appraisal District has provided information to the city that establishes the assessed valuation of a golf course is calculated at$10,000 per acre plus the value of the golf course. Preliminary plans show that the golf course will be constructed on 170 acres and will be built for approximately six (6) million dollars. Based on these figures, approximately $47,000 would be generated in property taxes per year at the current tax rate of.0665. Additional revenues will also be generated through sales taxes collected on green and cart fees and merchandise and concession items in the Club House. Based on revenue of one (1) million, the combined sales taxes collected for the general fund, 4A and 4B would be $20,000 annually. The golf course will also use a large amount of water. Specific details regarding amounts of water are not known at this time. The golf course will open as a privately operated facility. The city has no financial obligations. The time line for the disannexation is as follows: First Notice to the Paper October 29, 1997 First Public Hearing November 11, 1997 Second Notice to the Paper November 26, 1997 Second Public Hearing December 9, 1997 Adpot Ordinance January 9, 1997 The approval of equal access demonstrates an act of good faith and cooperation by the City of Wylie. It is anticipated in the future that there will be several issues in which a level of cooperation will be necessary between the two cities. Financial Consideration The exchange of the 43 lots represents a potential loss of ad valorem tax revenue. If the average value of the homes constructed was $125,000, the annual property taxes paid per year at the current tax rate of .0665 (43 lots X $830) would be approximately $35,690. The Collin County Central Appraisal District has provided information to the city that establishes the assessed valuation of a golf course is calculated at $10,000 per acre plus the value of the golf course. Preliminary plans show that the golf course will be constructed on 170 acres and will be built for approximately six (6) million dollars. Based on these figures, approximately $47,000 would be generated in property taxes per year at the current tax rate of .0665. Additional revenues will also be generated through sales taxes collected on green and cart fees and merchandise and concession items in the Club House. Based on revenue of one (1) million, the combined sales taxes collected for the general fund, 4A and 4B would be $20,000 annually. The golf course will also use a large amount of water. Specific details regarding amounts of water are not known at this time. The golf course will open as a privately operated facility. The city has no financial obligations. The City Council again thanks everyone for helping determine the future of this city. The City Council respects this vote. The delay in making this statement was only out of a genuine intent to thoroughly understand all related issues. We must now come back together as a city and continue our success. We can only work together as a community if we work together as a team. We must respect diverse opinions, eliminate personal attacks, and agree to disagree on some issues. We recognize that Wylie residents and property owners are interested in development issues and will stay involved in land use and planning decisions that affect their homes, businesses, and neighborhoods. We welcome this citizen involvement. Your City Council wants to continue an atmosphere of positive and productive leadership. Years ago, this city was known for divisive and mean spirited politics that created constant City Council and staff turnover. With stable and effective leadership from elected officials, the city and school district have experienced much success in recent years. This same stability among our elected officials has had a positive affect on the city's bond rating which directly impacts our ability to finance the facilities needed for a growing community. This city has also benefited from having the most experienced and long tenured staff we have ever had. Multi Million dollar bond programs have passed. Capital projects have been completed on time and within budget. New parks have been developed and old parks improved. A Community Center and Library have been renovated. Every city department has undergone a process improvement to more efficiently and effectively service the customer. There are more well trained police officers on the street. A well trained and equipped Fire Department has dramatically reduced fire losses. Experienced and knowledgeable staff members are following code enforcement, building inspection, and construction plan review processes with thoroughness and consistency. Our Public Works Department was recently recognized at the 1997 Texas Municipal League Annual Conference with an award of excellence for Innovation for the city's with a population under 25,000. These and many other successes are a direct result of hard work, dedication and experience. Make no mistake about it. We don't want to rest on these previous accomplishments. We will continue a total process improvement of everything that this city does. We'll be even better in the future, but only with cooperation and constructive participation. -continued on reverse- MEMO To: Mayor, City Council From: Mike Collins, City Manager Subject: New Planning Director Date: November 11, 1997 On Friday, November 7, Mr. Tobin Maples accepted the job of Planning Director for the City of Wylie. Tobin comes to us from the City of Irving where he has served as a Planner since December, 1996. Prior to that he worked for the City of Mansfield as City Planner and for the City of Fort Worth as a Planning Intern. Tobin has a Bachelor's Degree in Urban Geography from Texas A&M and a Masters in City and Regional Planning from UTA. He will be completing a second Masters in Public Administration from UTA this December. Tobin will begin work on January 5, 1998 and will be bringing to our organization experience in both long range and current planning issues, in addition to extensive work with various Boards, Commissions and citizen groups. The Rolling Warehouse Different companies such as Frito-Lay, Mrs. Bairds and others use vans to deliver their products to area customers. An idea came forth in serving our citizens with the same concept. With this thought was born the"Rolling Warehouse". The Rolling Warehouse is a concept that was developed out of a necessity for a second unit for the Utility Operations Water Department. Increasing daily field demands, limited personnel and tight budget were key factors in utilizing the Rolling Warehouse. The truck is equipped with built-in shelving to accommodate fillings used in repair of water leaks and ruptured mains. Necessary hand tools are available for installation of valves, meters, clamps and fire hydrant repairs. Also on board is a 5 K.W. generator, electric sump pump, 2" water pump, cones, hydraulic valve turning machine and other equipment. This used unit was purchased and has saved the citizens$12,000.00 versus the purchase of a new unit with side boxes. This concept will handle twice the load capacity than a 3/4 ton pickup with a utility box. An additional plus to the van is that all parts and equipment are locked inside and nothing is left exposed to outside elements. The Rolling Warehouse has proven its worth by an increase in the production and less vehicle wear and tear. Man hours that were used going to the parts warehouse have ultimately been eliminated. Personnel has the ability to respond to citizens promptly, survey the situation, and perform the job with little interruption. The citizens have been very receptive to this well organized operation. This unit has been in service for approximately eighteen (18) months and has been so successful, future plans are to add a unit to the Utility Operations Wastewater Department and the Street Department. We are happy to announce that the City of Wylie was selected as a winner of a Texas Municipal League Municipal Excellence Award. The City is the winner in the Public Works Category for cities under 25,000. This award was presented to the City at the annual Texas Municipal League Conference held in Ft. Worth, Texas.
