M. in the Council Conference Room of the Municipal Complex . A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor John W. Akin, Mayor Pro Tem Jay Davis , Council Members Don Hughes, Percy Simmons, Ortie Messenger, Williams Martin and Jim Swartz (arrived late) , and City Manager Steve Norwood, City Secretary Carolyn Jones, City Engineer Paul Beaver, City Attorney Steve Deiter, Public Works Director Bill Flowers , Project Coordinator Tommy McDanel , Public Works Superintendent Jackie Jones and Terry Milligan, Engineer Consultant on Impact Fees and Capital Improvements Plan. Mayor Akin called the meeting to order. WATER SYSTEM IMPROVEMENTS: Mr. Paul Beaver, City Engineer, introduced Mr. Terry Milligan who was involved with the impact fee study and the ten (10 ) year capital improvements plan. City Manager Steve Norwood requested Mr. Beaver to move to the water pressure problem in Newport Harbor since there were citizens present for that discussion. Mr. Beaver stated that there were several options which are: EXISTING SYSTEM UPGRADE Option 1 : Booster Pump Station (FM 1378 ) $ 43, 375. Option 2: Ground Storage Reservoir and Pump Station (Newport Harbor) $176 , 760 . Option 3 : Nortex Pump Station - Back Pressure Sustaining Valve and Pump Controls $ 37 , 812 . Option 4 : 8" Loop line ( 11 , 500 l .f . ) $207 , 625. WYLIE NORTHEAST WSC AGREEMENT Option 1: 8" Tie-in ( 1 , 900 l .f . ) $ 43, 080. Option 2: 12" Tie-in ( 1 ,900 l .f . ) $ 71 , 760 . Mr. Beaver said that the Wylie Northeast WSC new tower is not tied-in to the North Texas Municipal Water District' s system as yet. There was at one time an acre of land given to the City to use for a water tower, but the land was not used in the time frame designated . Mr. Beaver stated in a short term solution, option 3 of the existing system upgrade and option 1 of Wylie Northeast WSC Agreement. Any type of pumping facility the city uses would mean that a pump would be running at all times. A pump station alone will not solve the fire protection problem. City needs to have an elevated storage tank or ground storage tank in the area to improve fire protection. The question of how other cities get away with not having elevated water storage tanks and state standards states you must have them. Mr. Milligan stated that Dallas and Garland are not having to pay penalties on this , but if state ever decided to start enforcing this provision of elevated tanks , these cities would probably be fined . Mr. Beaver went over the priority list of improvements for the Wylie Water System which are as follows : FISCAL YEAR 1991-1992 1 . Upgrade pump controls "Telemetry" $ 10,000 . 2 . If Council so chooses, these projects can be moved from one year to another to taken off all together. There will be a mid-year budget review the middle of May with the new budget meetings starting in June and July. The Department Heads will present their budgets to Council sometimes in July. M. in the Council Chambers of the Municipal Complex. A quorum was present and notice of the meeting had been posted in the time and manner required by law. Those present were Mayor John W. Akin, Mayor Pro Tem Jay Davis , Council Members Percy Simmons, Don Hughes, Jim Swartz , Ortie Messenger, and William Martin, City Manager Steve Norwood, City Secretary Carolyn Jones, City Engineer Paul Beaver, City Attorney Steve Deiter, Accounting Assistant Prudence Kling and Chief of Police Harvey Hightower. Mayor Akin called the meeting to order and gave the invocation, which was followed by the Pledge of Allegiance . APPROVAL OF MINUTES OF APRIL 14TH COUNCIL WORK SESSION AND MEETING: There being no corrections or additions to the minutes, a motion was made by Councilman Martin to approve as submitted. Seconded by Councilman Swartz . The vote was as follows : Mayor Akin - in favor, Mayor Pro Tem Davis - in favor, Councilman Swartz - in favor, Councilman Martin - in favor, Councilman Hughes - in favor, Councilman Messenger - in favor, and Councilman Simmons - in favor. This motion carried with all in favor. PRESENTATION OF PROCLAMATION FOR NATIONAL NURSING HOME WEEK MAY 10-16, 1992 : Mayor Akin read the proclamation for National Nursing Home Week May 10-16, 1992 and recognized Hillcrest Nursing Home of Wylie for their dedicated staff and their work. Mayor Akin also read several letters of appreciation from Fairview Volunteer Fire Department and from a citizen of Wylie for the help the Wylie Police Department has been. APPROVAL OF LOCAL AGREEMENT FOR COMMUNICATIONS CENTER AND DISPATCH SERVICE BETWEEN THE CITY OF WYLIE AND THE NEVADA VOLUNTEER FIRE DEPARTMENT: This is the same type of agreement that the Council approve a few weeks ago with the City of Lucas and Branch Volunteer Fire Department. Nevada' s agreement will be from May, 1992 through September, 1992 and will bring in revenues in the amount of $761 . 55 for this time period. A motion was made by Councilman Messenger to approve the local agreement for Communications Center and Dispatch Service between the City of Wylie and the Nevada Volunteer Fire Department. Seconded by Councilman Martin. The vote was as follows : Mayor Akin - in favor, Mayor Pro Tem Davis - in favor, Councilman Swartz - in favor, Councilman Martin - in favor, Councilman Hughes - in favor, Councilman Messenger - in favor, and Councilman Simmons - in favor. This motion carried with all in favor . APPROVAL OF AWARD OF BID FOR ANNUAL UNIFORM RENTAL SERVICES CONTRACT: The City Staff received two bids on Uniform Rental Services. One bid was from American Uniform Rental in the amount of $9, 285 . 12 and the other was from Aratex Services in the amount of $9 , 680. 87 . Staff recommends award of bid to American Uniform Rental as it is low bid and has come in 20% under last years bid . This contract will be for one year. A motion was made by Councilman Martin to approve the award of bid to American Uniform Rental in the amount of $9 , 285. 12 . Seconded by Councilman Swartz . The vote was as follows : Mayor Akin - in favor, Mayor Pro Tem Davis - in favor, Councilman Swartz - in favor, Councilman Martin - in favor, Councilman Hughes - in favor, Councilman Messenger - in favor, and Councilman Simmons - in favor. This motion carried with all in favor . APPROVAL OF SITE PLAN FOR KWIK CHEK CONVENIENCE STORE (EXXON) : This site plan location is on the corner of Kirby St. and Highway 78 just North of Eckerd' s. The developer has met all requirements and standards requested by the City Codes and staff recommends approval . A motion was made by Councilman Swartz to approve the site plan for Kwik Chek Convenience Store (Exxon) for the corner of Kirby St . and Highway 78 . Seconded by Councilman Martin. The vote was as follows : Mayor Akin - in favor, Mayor Pro Tem Davis - in favor, Councilman Swartz - in favor, Councilman Martin - in favor, Councilman Hughes - in favor, Councilman Messenger - in favor, and Councilman Simmons - in favor. This motion carried with all in favor. RESOLUTION AUTHORIZING THE CITY TO PROVIDE SUPPLEMENTAL PATROL ON LAKE LAVON AND TO ENTER INTO A COOPERATIVE AGREEMENT WITH THE U. S . ARMY CORPS OF ENGINEERS DEFINING THE TERMS OF SUCH PATROL: It is time for the renewal of the contract with the Corps of Engineers for lake patrol and in order for this contract to be negotiated, there must be a resolution authorizing the City Staff to proceed with the agreement . Chief Hightower stated that this contract would begin Memorial Day week end and go through Labor Day week end. The revenues received from the Corps of Engineers will cover the City ' s cost for patrolling . A motion was made by Councilman Martin to approve the Resolution authorizing the City to provide supplemental patrol on Lake Lavon and to enter into a cooperative agreement with the U. S. Army Corps of Engineers . Seconded by Councilman Messenger. This motion carried with all in favor . FINANCIAL REPORT FROM FINANCE DEPARTMENT FOR MONTH ENDING MARCH, 1992 : Miss Prudence Kling gave the following finance report. The General Fund revenues through March, 1992 are $3, 214 ,432 . with expenditures of $3 ,140 ,488. The Utility Fund has revenues of $1 , 327 , 538 and expenditures of $1, 106,945. Delinquent Tax statements will be going out this month for the current year and in June for the prior years. It was noted that the delinquent taxes , penalty and interest and sales taxes will not meet the expected revenues this year. CITIZEN PARTICIPATION: Mayor Akin invited citizens wishing to address the Council to come forward at this time, state their name and address and to keep their comments to five minutes. Mayor Akin also stated that any discussion must be limited to placing the item on a future agenda. Mr. Leon Isbell stated he was representing his wife , Helena Isbell , who is the Election Judge for the precincts voting at the Methodist Church . Due to the past problems she will need to know that she has total support from the City Staff, City Council and that the City Attorney will be available on election day. If this does not come about , she will have to resign as election judge. There being no there items for discussion, a motion was made to adjourn with all in favor. John W. They are a county service for us . " Frisco : "No complaints . Doing really well in coordinating with us . Only problem we have is that they will only take emergency calls on weekends . We see them on patrol all the time . We are real satisfied . " The Collin County Humane Society also contracts for the cities of Leonard and Little Elm but there are no listings for a city hall for either city. Jennifer Golden of the Collin County Humane Society to see what exactly the proposed $28, 400 . 00 contract included . Ms . Golden advised that this contract included personnel patrolling in our city limits for the time specified in the contract, any after hour calls where our communications personnel would page the appropriate on-call person, and all contractual services and supplies . The Humane Society will use their own vehicle and will be responsible for its fuel, repair and maintenance . They will pay for the telephone, water, and electricity. They also have their own veterinarian personnel, insurance, and medical supplies . The Humane Society will also provide its own office supplies, forms, and animal supplies, including food for the animals . The Humane Society would use our animal shelter and would retain any fees collected such as registration fees, etc. . . Ms . Golden also advised that they would take special attention in following our city ordinances as well as any philosophical views the City may have . Of the eighteen votes , nine were to open the alley and nine for it to remain closed . Of the eighteen votes cast there were seventeen owners with one renter voting . Even though the vote totals were even over all , they are not even if evaluated in relation to the residences proximity to the closed alley . Those that were most directly affected by the alley are the residences on Woodhollow Court , Butler Circle and Dogwood Court . The opinion of the nine residences on these three streets was seven for closure and two to open which is more than three to one for closing the alley. I believe this is significant because it is these nine persons ( and their silent neighbors ) who are most inconvenienced by the closure , yet , they are overwhelmingly in support Hof the the alley remaining closed . When the next level down is considered ( that is those with property abutting east west alley between Woodhollow Court and Briarwood Drive ) which is four owners , there are three votes for closing and one for opening . Once again in excess of a three to one ratio for keeping the alley closed . And again these are the owners who are more affected ( or inconvenienced ) by the closure . The remaining six owners , all open votes , live on down South of the Hilltop alley ( either on Hilltop or Briarwood Dr . ) and therefore are not significantly inconvenienced by the closure . When the residents opinions are viewed in relation to their location to the closed portion , as above analyzed , it is obvious that the opinion of the most affected owners is strongly in favor of closure . This being the case I would suggest that if the Council truly desires to do the will of the people on this issue then it should vote to close the alley . As I have previously mentioned , in the event the alley is closed I believe it should be closed with an ordinance passed by the City Council . I would further recommend that the ordinance contain provisions whereby the dedicated alley would revert back to the adjoining property owners , save and except a four foot strip which could be reserved as sidewalk from the alley to Butler Street and also except retention of utility easements . I would further suggest that the curb cut which allowed access to the alley be raised up and make a regular curb contiguous with the existing South curb on Butler Street . I have attached a map hereto which indicates the various property owners and their votes . The "open" votes are indicated by perpendicular lines drawn on the lots while the " closed" votes are indicated with a slanted line . Subsequent to the meeting Jack Jones conveyed the following to me as his recommendation . 1 ) Open alley at North end (where currently barricaded ) 2 ) Put speed bumps in East-West alley between Butler Ct . and Woodhollow Ct . 3 ) Barricade Hilltop alley at South end where it intersects Park ( approximately South end of Lot 32 , 325 Hilltop) both new barricades would be movable . He opines that this would solve both problems ( access and dust ) with minimal ( less than $500 ) cost . However it does not satisfy the affected owners at the North end . I believe there may be merit to permanent closure of North end , as mentioned above , and barricading South end , as suggested by Jack . It seems this would be a solution more palatable to most people of the area .
