CALL TO ORDER
Announce the presence of a Quorum.
Vice Chairman, Bryan Rogers called the meeting to order with the following Construction Code
Board Members present: Bryan Rogers, Billy McClendon, Brian Huddleston, David Williams,
Michael Grubbs, Zachery Herrera, Bobby Heath, Sunil Verma and Rob Hunter.
Staff present was: Interim Building Official, Dwight Lancaster; Code Enforcement Officer, Pat
Mitchell; and Construction Code Board Secretary, Leisa Price.
CITIZENS COMMENTS ON NON-AGENDA ITEMS
Residents may address Construction Code Board regarding an item that is not listed on the Agenda. Residents must
provide their name and address. Construction Code Board requests that comments be limited to three (3) minutes.
In addition, Construction Code Board is not allowed to converse, deliberate or takes action on any matter presented
during citizen participation.
There were no citizens present to address the Construction Code Board during Citizens'
Comments.
BUSINESS ITEMS
1. Consider, and act upon, the appointment of the Chairman / Vice Chairman for a new one
year term beginning July 2012 and ending July 2013.
Staff Discussion
Vice Chairman, Bryan Rogers asked for nominations for the new Chairman and Vice Chairman.
Billy McClendon nominated Bryan Rogers for Chairman, Brian Huddleston seconded the
motion. A vote was taken and passed 6 — 0. Bryan Rogers asked for nominations for the new
Vice Chairman. Billy McClendon nominated Brian Huddleston for Vice Chairman, Zachery
Herrera seconded the motion. A vote was taken and passed 6— 0.

Billy McClendon nominated Bryan Rogers for Chairman, Brian Huddleston seconded the
motion. A vote was taken and a passed 6 —0. Bryan Rogers asked for nominations for the new
Vice Chairman. Billy McClendon nominated Brian Huddleston for Vice Chairman, Zachery
Herrera seconded the motion. A vote was taken and passed 6—0.
2. Consider, and act upon, approving the Minutes from the June 21, 2012 Construction
Code Board meeting.
Staff Discussion
Chairman, Bryan Rogers asked for the board to approve the minutes from the June 21 2012
Construction Code Board Meeting.
Board Action
Michael Grubbs made a motion to approve the minutes from the June 21, 2012 Construction
Code Board meeting. Brian Huddleston seconded the motion. A vote was taken and a motion
passed 7 - 0.
3. Consider, and act upon, a request for a Sign Appeal Hearing from Starlite Sign who
represents Dairy Queen in seeking an appeal of one (1) sign permit denied on July 11, 2012.
Starlite Sign is requesting a variance of the City of Wylie Sign Ordinance #2009-21. The
request is to install one (1) thirty-five foot (35) Dairy Queen pole sign. Pole signs are
currently excluded by The City of Wylie Sign Ordinance. Existing pole / pylon signs around
town have legal nonconforming status as long as they are being used by a local business that
is in operation on the same lot as the pole/pylon sign.
Staff Discussion
David Scott with Starlite Sign asked that the board accept a (thirty-five foot) 35' pylon sign in
place of the pole sign. Mr. Scott said that because of the landscaping a monument sign would
be difficult to see from the road and that a pylon sign of less than 35' would also be difficult to
see due to the landscaping. Interim Building Official, Dwight Lancaster said that a pylon sign
would be acceptable because there were several pylon style signs up and down Hwy 78 that
could be seen from the Dairy Queen location. But, that the height needed to be more in line with
the height of the other pylon style signs on Hwy 78. There was a lot of discussion about the
landscaping and keeping the continuity with the other signs on Hwy 78. There was even a
suggestion to move some of the landscaping. But, it was decided that moving the landscaping
would not work. The landscaping presents a definite problem for a monument sign to work and
been seen at this location.
Interim Building Official, Dwight Lancaster stated that the Building Inspections Department had
no objection to the granting of the variance as long as the sign was kept below thirty feet (30')
and was a pylon style that the Building Inspections Department would be issuing the permit for
the sign upon approval of the Construction Code Board.
Board Action
Billy McClendon mad a motion to accept a pylon sign no taller than twenty-five foot (25'). David
Williams seconded the motion. A vote was taken and a motion passed 4 - 3.
4. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 2703 Deerborn Street, Cimarron Estates #1, Block G, Lot 14, Wylie,
Collin County, Texas was in violation of standards set out in Ordinance #2008-49

Wylie, Texas; and, seeking an order of approval of the Emergency Secure conducted on
March 15,2012.

Code Enforcement Officer, Pat Mitchell presented slides and discussed the reasons for the
securing of the property.
Board Action
Brian Huddleston made a motion to approve the action taken by the City of Wylie Construction
Code Board staff in regards to the property located at 2703 Deerborn Street, Cimarron Estates
#1, Block G, Lot 14, Wylie, Collin County. Sunil Verma seconded the motion. A vote was taken
and passed 7 - 0.
5. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 1209 Wyndham Drive, Wyndham Estates #1, Block B, Lot 18, Wylie,
Collin County, Texas was in violation of standards set out in Ordinance #2008-49
DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of
Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on May
29,2012.

6. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 201 Duncan Way, Caldwell Estates, Block 3, Lot 5, Wylie, Collin County
Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS
BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas;
and seeking an order of approval of the Emergency Secure conducted on June 20,2012.

passed 7 - 0.
7. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 422 Woodhollow Drive,Wylwood Estates #4, Block 7, Lot 32,Wylie, Collin

8. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 1312 Anchor, Newport Harbor#1, Block 15, Lot 24, Wylie, Collin County
Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS
BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas;
seeking an order of approval of the Emergency Secure conducted on March 20,2012.

County Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS
BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas;
seeking an order of approval of the Emergency Secure conducted on May 4,2012.

was taken and passed 7 - 0.
10. Hold a public hearing, to provide evidence, seeking a determination that a building(s)

Board Action
Billy McClendon made a motion to approve the action taken by the City of Wylie Construction
Code Board staff in regards to the property located at 1413 Scottsdale Drive, Quail Meadow,
Block G, Lot 7, Wylie, Collin County Texas. Michael Grubbs seconded the motion. A vote was
taken and passed 7 - 0.
11. Authorizing the Chairman of the Construction Code Board to sign the final orders
prepared by City staff as long as such final orders are consistent with the orders issued by
the Construction Code Board on September 20, 2012.
Board Action
Zachery Herrera made a motion to accept and approve the orders. Billy McClendon seconded
the motion. A vote was taken and passed 7 - 0.
ADJOURNMENT
With no further business before the Construction Code Board, Billy McClendon made a motion
was made by to adjourn the meeting. Brian Huddleston seconded the motion. A vote was taken
