Martin in the amount of $600 . 00 GENERAL DISCUSSION 11 Citizen Participation 12 Council Discussion 13 Adjourn PLANNING AND ZONING MEETING MINUTES OCTOBER 1o, 1989 The Planning and Zoning Commission met in regular session on Monday, October 16, 1989, in the Council Chambers of the Municipal Complex ' A quorum was present and notice of the meeting had been posted in the time and manner required by law. Members present were Vice Chairman Bart Peddicord, Cecelia Wood , Bob Skipwith, Bobby Jennings and Jim Ferguson ' Staff members present were Code Enforcement Officer Roy Fairest City Secretary Carolyn Jones and Secretary Sandy Stevens. Vice Chairman Bart Peddicord called the meeting to order ' CITY SECRETARY_TO_ADMINISTER OATH OF_OFFICE_TO_NEWLy APPOINTED MEMBER. Carolyn Jones administered Gath of Office to newly appointed member , Richard Eckman. CONSIDER_APPROVAL_OF THE 'MIMUTES OF_THE AUGUST_28,_lq8q MEETING. Mr . Skipwith said that the word "lots" should be changed on the second page, first paragraph, secor.d sentence, to read "Mr . Skipwith said any time you increase the lotsize, he is Tor it . '' Ms. Wood said that the word "sale" should be changed on the third page, second paragraph, third line, to read "Mr . Peddicord also said that the last sentence in the fourth paragraph on page three should read " Mr. Faires said he feels that the fear of traffic congestion and light pollution is not something to worry about because the privacy of citizens would be required to be protected. " Mr. Peddicord made a motion to approve the minutes with the above corrections. Mr. Ferguson seconded the motion. The motion was carried with all in favor . CONDUCT PUBLIC HEARING ON THE_ZONING_ OF THE PROPERTIES_ON NORTH_SIDE_OF_FM_544_ (ACROSS_FROM_STEELE_INDUSTRIAL_PARK� 32�419_ACRES__OUT_OF__THE_MOSES_SPARK_SURVEY_ZONING_BUSINE-S 2. Mr. Pedd1cord said that twentyfour letters were mailed out , two responded, one for, one against . Mr . Peddicord opened the public hearing by requesting anyone wishing to speak in favor of rezoning to come forwaro. No one responded. Mr . Peddicord then asked for those against rezoning to come forward. Mr . Ernie Schultz stated that he wants pruperty to remazn zoned Agricultural . He said he owns one and a half acres along railroad on east end' Mr . Faires ad.ised Mr ' Schultz that his property is not included in rezoning . Ms. Mary Jones asked for clarification of whai B2 means. Mr . Faires advised it is fairly close to what is there now. He stated that it is the heaviest commercial zoning thaL permits outside sales. Ms' Jones asked if there are any plans to make it more attractive. She stated she owns two hundred acres and expressed concern over appearance o+ area. Mr. Faires advised there is no landscape ordinance at th1s time. The businesses now are pre-existing, non-conforming, however , once legitimate zoniqg is reached , it will become more conformed with what is permitted in thzs category. Kenneth McKinney statod his personal home is located on Lot 7 at the McCord 6. He said B2 zonirg is no problem but expressed concern over what will be aIlowen. Mr . McKInney advised that two wrecked cars oath expired tags moved onto Lot 8 that same day. Mr Faires. explained that a wrecbing yard is permitted on! , by Specific Use permit in 071 industrial Zoned area. He �dded th-t the OrAjnance defines a wrecking yard as containing five or more wrecked cars or the parts of such vehicles whereas a Junk car yard is more lenient and is allowed in a B2 Zone. Mr. Faires said he was unaware of a wrecking yard at this location but would investigate it. Mr . McKinney states that he will agree to B2 zoning as long as wrecking yards are not allowed. Mr. Jennings asked for a description of 22 zoning. Mr . Faires advises it permits anything except manufacturing. Accumulative zonzng, through Commercial districts, specifically states we have a Retail listing. A B1 listing starts out with anything in a Retail district plus the following and the B2 says anything in 91 district plus the following so it aermits almost anything except mvnufacruring and those things that are specifically listed as used in the Industrial district . Mr . Faires also added that junk or salvage yaros are listed as a Specific Use Permit in an Industrial district . Even in an Industrial AzstrzcL they do nor have vesteo right to have such yards' They still ha,e to apply for Specific Use Permit for Lhat location io Industrial district . Mr . Jennings asked if the railroad oeIng so close might present a problem. Mr . Faires said no, because in most cases a buffer : one of about fifty feet is left on ea� i ' side of the railroad track. However he did enjoy it and found it to be beneficial . Mr. Ferguson welcomed Mr. Eckman. Also repeated Mr. Jennings comments about prior meeting and expressed desire to take personal campaign of landscaping to Chamber of Commerce and Mr . Faires closer to holidays. Ms. Wood questioned Mr. Faires about need for a permit by person selling firewood at corner of Ballard and Stone Road, She stated that there is a truck with sign, phone number, camper trailer and firewood at this location . Mr . Faires said he understands it is being used as storage. Mr . Skipwith asked what can be done about cars left jacked Up In yards, Mr. Faires answered they must be kept covered, out of sight, if inspection and tags are invalid . Vice Chairman Bart Peddicord congradulaced Mr . Eckman stating he will give him a map of annexation of city and Kill also supply him with updated maps' Mr . Faires offered Mr ' Eckman help from his office in City Hall anyway possible at anytime. Mn . Jerry Houser states he owns a personal home on Lot 3 of l �:d to be rezoned B2. He questions the utility easement line locaten down center of property' He advised that in Past there was a large butane tank with lines to individual meters for other people. He said tne company is located in McKinney. Mr. Peddzcord advises the deeds should list company name who has easement. Mr . Houser replies deed does not list name. Mr . Faires assured Mr ' Houser that he would locate company, if still in existence, and notify each property owner of who to talk to and ask for release since no longer in use. Mr. Houser expressed appreciation for efforts made to keep area clean . Vice Chairman Bart Peddicord thanked citizens for their Presence. Motion to adjourn carried with all in favor . _______________ Bart Feddicord Vice Chairman Respectfully Submitted , Sandy Stevens, Secretary � . � ` LIBRARY BOARD MEETING MINUTES OCTOBER 18, 1989 The Library Board of the City of Wylie met in regular session on October 18, 1989 at 6: 30 p. m. in the workroom of the Rita and Truett Smith Public Library, 800 Thomas, Wylie, Texas. A quorum was present and notice of the meeting had been posted in time and manner required by law. Those present were Mr. Charles Norwood, City Manager, Cathie Upshaw, Rita Smith, Betty Stephens, Jan Morgan, Barbara Jennings, Valerie Wiggins, Rosanne Burgess, and Chairperson, Mary Jo Smith. The meeting was called to order by Mary Jo Smith at 6: 40 P. M. p. m. CONSIDER APPROVAL OF MINUTES. The library board minutes for September 20, 1989 were approved as written. MR. CHARLES NORWOOD PRESENTATION. Mr. Norwood has stated that he is interested in meeting with the library board as often as possible. The meeting change to Wednesday night would be better for him. He would like to see our budget improve and especially funding for books. More books make better circulation and better service to citizens. The library board needs to set goals and do a five year plan. Taking a leadership role in the community would help advertise the library. Betty Stephens expressed board member feelings about fund raisers and how difficult it is in a small town when everyone is trying to raise funds. She recommended that the library work jointly with the schools on the literacy problem. Mary Jo Smith recommended that we find out what needs have priority. Library board should call a meeting to establish goals and see improvements through year by year growth. Two authors are coming November 9th to discuss F. B. I . Undercover, with the evening being sponsored by the friends of the Smith Library. It will be free to the public but there will be limited seating. APPROVAL OF CHANGING REGULAR MEETING TIME. The board members unanimously approved changing the regular meeting night to the third Wednesday of every month. REPORT OF CALIFORNIA RAISIN CLUB. Contact has been made with all three elementary schools. Akin kindergarden children have come over for a library card. CHANGING THE REGULAR LIBRARY HOURS. Motion was made to recommend to City Council changing Monday, Wednesday, Thursday, and Friday hours to 10: 00 a. m. - 7: 00 0 p. m. for the convenience of the patrons. GENERAL DISCUSSION. Rosanne Burgess has been notified that the library will receive a NETLS microcomputer grant in March of 1990. Meeting adjourned. The cost of this lease agreement is $330. 00 I have found the crossing agreement to be acceptable and the fee to be reasonable ; therefore, I recommend that the City Council approve this agreement. Grant of Rights: Licensor hereby grants to Licensee the right to construct, reconstruct, maintain and operate, subject to'the terms of this agreement, a Twelve inch (12") sanitary sewer pipeline within a twenty (20 ) casing pipe to cross beneath licensor's Fort Worth Branch track at M'1 580.58 (E.S. 5330+83) c(lierein canteen `pstructure"), at or near Wylie , County of Collin and State of Texas in the location shown on the attached print. This grant is subject and subordinate to the prior and continuing right of Licensor, its successors and assigns, to use all of its property in the conduct of its business, Licensor reserving full rights,consistent with the rights herein granted, to construct, reconstruct, maintain and operate existing and additional transportation, communication, pipeline and power facilities upon, over and beneath its premises. • 2. Identifying Markers: Markers in form and size satisfactory to Licensor shall be installed and constantly maintained by Licensee at Licensor's property lines or such locations as Licensor shall designate and shall be relocated or removed by Licensee upon request of Licensor. The absence of markers does not constitute a warranty by Licensor that there are no sub- surface installations. Three Hundred Thirty Dollars no/100 3. Costs: Licensee shall pay Licensor partially to defray the cost of handling. Licensee shall bear the entire cost of constructing, reconstructing, maintaining and operating said structure on Licensor's premises. Licensee shall reimburse Licensor for all cost and expense to Licensor in furnishing any materials or performing any labor in connection with such work, including, but not limited to, installation of falsework and other protection beneath or along Licensor's tracks, and furnishing such watchmen, flagmen and inspectors as Licensor deems necessary. 4. Construction and Maintenance: Said structure shall be constructed, reconstructed and maintained in accordance with plans approved by Licensor. Approval by Licensor shall not constitute a warranty by Licensor that such plans conform with federal, state and/or local codes and regulations applicable thereto. All work upon or in connection with said structure shall be done to Licensor's satisfaction at such times and in such manner as not to interfere with Licensor's operations. In the construction, reconstruction and maintenance of said structure, Licensee shall keep Licensor's premises in a neat and safe con- dition, failing which Licensor may do so at Licensee's expense. If required by Licensor in its use of Licensor's premises. Licensee shall reconstruct, relocate or alter said structure. Except in emergencies, Licensee shall give Licensor five (5) days' written notice of the day and hour it proposes to do any work on said structure. Licensee shall cooperate with Licensor in making any tests it requires of any installation or condition which in its judgment may have adverse effect on any of the facilities of Licensor. All costs incurred by the tests, or any corrections thereafter, shall be borne by Licensee. CS•3400 • SHT2of3 REV. 7-85 No change shall be made by Licensee in the commodity being conveyed through said structure without Licensor's prior writ- ten approval. 5. The term "Licensor" as used in this section shall include the successors, assigns and affiliated companies of Licensor, and any other railroad company operating upon Licensor's tracks. 6. Condemnation: In the event all or any portion of Licensor's premises shall be condemned or taken for public use, Licensee shall receive compensation only for the taking and damaging of said structure. Any compensation or damages for takin z. said premises or Licensee's interest therein, shall be assigned to Licensor. 7. Termination: This agreement shall terminate: (a) upon abandonment of said structure or discontinuance of the use thereof; or (b) upon failure of Licensee to correct any default hereunder promptly after receipt of notice from Licensor; or (c) upon thirty (30) days' written notice by Licensor to Licensee; or (d) upon thirty (30) days' written notice by Licensee to Licensor. Upon termination of this agreement, Licensee shall remove said structure and restore the premises to Licensor's satisfac- don, failing which Licensor may arrange to do so at Licensee's expense. 8. Environmental Protection: Licensee shall, at its expense, comply with all applicable laws, regulations, rules and orders regardless of when they become or became effective, including, without limitation, those relating to health, safety, noise. environmental protection, waste disposal, and waste and air quality, and furnish satisfactory evidence of such compliance upon • request of Licensor. Should any discharge, leakage, spillage, emission or pollution of any type occur upon or arise from the premises covered hereunder as a result of Licensee's use, presence, operations or exercise of the rights granted hereunder, Licensee shall, at its ex- pense, be obligated to clean all property affected thereby, whether owned or controlled by Licensor or any third persons to the satisfaction of Licensor (insofar as the property owned or controlled by Licensor is concerned) and any governmental body hav- ing jurisdiction in the matter. Licensor may, at its option, clean Licensor's premises; if Licensor elects to do so, Licensee shall pay Licensor the cost of such cleanup promptly upon the reciept of a bill therefor. Licensee agrees to investigate, release, indemnify and defend Licensor from and against all liability, cost a--1 expense (Including, without limitation, any fines, penalties, judgments, litigation costs and attorney fees)incurred by Licensor as a result of Licensee's breach of this section,or as a result of any such discharge,leakage, spillage, cmisslon.or pollution,regardless of whether such liabilit cost or expcti:;c arises dur- ing the time this agreement is in effect or thereafter, unless such liability,cost or expense is proximately caused solely and ex- clusively by the active negligence of Licensor, its officers, agents or employees. 9. Contractors: No work on Licensor's premises shall be commenced by any contractor for Liccnscc until such contractor has entered into Liccnsor's standard Contractor's Right of Entry covering such work. 10. Non-assignability: This agreement is not assignable, in whole or in part, by Licensee without Liccnsor's prior written consent. 11. LIens: Licensee shall pay in full all persons who perform labor on said premises for Licensee, and will not suffer any mechanics' or matcrialmcn's liens to be enforced against Licensor's premises for work done or materials furnished at Licensee's instance or request. If any such liens arc filed thereon, Licensee agrees to remove the same at Licensee's own cost and expense and to pay any judgment which may be entered thereon or thereunder.Should the Licensee fail, neglect or refuse so to do, Licensor shall have the right to pay any amount required to release any such lien or liens, or to defend any action brought thereon, and to pay any judgment entered therein, and the Licensee shall be liable to the Licensor for all costs, damages, and reasonable attorney Ices, and any amounts expended in defending any proceedings or in the payment of any said liens or any judgment obtained therefor. 12- The provisions contained in the attached insert captioned "Liability" are hereby made a part of this agreement. 13. Said structure shall be installed in accordance with the minimum requirements of Drawing No. 1741 attached and ra..de a part hereof. 14. In addition to other provisions of this agreement requiring Licensee to give notice prior to commencing work, Licensee shall telephone Licensor at 1-800-283-4237 (a 24—hour number) to determine if a telecommunications system is buried anywhere on or about the premises defined or included herein. If it is, Licensee will telephone the owner of the system designated by Licensor, arrange for a cable locator and make arrangements for relocation or other protection for the system prior to beginning any work on the said premises. • IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed in duplicate the day and year first herein written. We do have patrons and mothers with small children who come in now between 9 a.m. and 10, but feel that they can change their schedules to a later time more readily than those people who work outside Wylie and have a hard time getting to the library before 6:00, closing time. The Library Board requests that this change be presented to the City Council for review and approval as soon as possible. If you would like me to be there for that Council meeting, please advise me. We discussed trying to adjust schedules for 9 a.m. until 7:00 p.m. , but with only two employees, that would mean working a 10 hours day for each of us once a week when the other person is off. Or, when vacation times are used, the 10 hour day is too long for an extended time. Thank you. J7 INTERLOCAL AGREEMENT FOR WARRANT OFFICER SERVICES An Interlocal Agreement (the "Agreement") , by and between the City of Rowlett, Texas, ("Rowlett") , the City of Rockwall , Texas ("Rockwall" ) , the City of Sachse, Texas ("Sachse" ) , and the City of Wylie, Texas ("Wylie") ( individually referred to herein as "Party" and collectively referred to herein as "Parties") , dated as of November 1 , 1989 . WITNESSETH: WHEREAS, pursuant to the Interlocal Cooperation Act , Article 4413 (32c) , Vernon ' s Revised Civ . Stat . Ann. (the "Act") , municipalities are authorized to execute interlocal agreements to provide warrant officer services to each other . WHEREAS, pursuant to the Act , a municipality may enter into an agreement with a neighboring municipality to provide for a warrant officer who shall be responsible for the service of arrest warrants issued by the Parties. WHEREAS, the parties desire to enter into an interlocal agreement in the manner and to the extent authorized by the Act ; NOW, THEREFORE, it is mutually agreed by and between the parties hereto as follows : I . The following words shall have the following meanings when used in this Agreement: (b) "OFFICER" means the warrant officer employed by the City of Wylie (c) "POLICE CHIEF" means the Police Chief of any Party, or his duly authorized designee (d) "CHIEF ADMINISTRATIVE OFFICER" means the Mayor or City Manager of any Party II . Wylie shall be responsible for hiring and training the Officer and shall be considered an employee of Wylie . When serving a warrant for Rockwall , Rowlett or Sachse, the Officer shall be considered an independent contractor of those three cities. III . Either Wylie, the Officer , or a combination of the two, shall be responsible for collecting arrest warrant fees and/or serving arrest warrants and for other duties and responsibilities of the officer . The Officer shall make all reasonable efforts to persuade Defendants to pay their outstanding fines prior to serving arrest warrants. IV. Wylie shall be responsible for providing the officer with an automobile, a telephone, an office and other items necessary for the performance of the Officer ' s duties pursuant to this Agreement . V. In performing his services, pursuant to this Agreement, the Officer shall be under the command of the Wylie Police Chief . VI . The Parties shall each be responsible for a proportionant share of the expenses and salary costs of the Officer equal to the percentage of fines collected for each of the Parties . Example: $100 ,00 fines collected and Rockwall has $20 ,000 , Rowlett $20 ,000 , Sachse $20 ,00 and Wylie $40 ,000 . The proportional share would be 50% for Rockwall , Rowlett and Sachse and 40% for Wylie. The Parties will pay their proportionate share quarterly as billed by Wylie . VII . The Officer , in the performance of his duties, shall spend his time among the Parties and shall not devote more of his time to one Party to the neglect of the Parties. All fines and/or warrant fees collected by the Officer shall be forwarded to the respective Party. VIII . Each Party shall execute a hold harmless and indemnity agreement whereby each Party will indemnify the other Parties in the event of accident of injury as a result of the performance of the Officer ' s duties. The hold harmless and indemnity agreement shall be approved by each Party' s legal counsel . IX. The Officer shall receive the same wages, salary, pension, and all other compensation and all other rights for such service, including injury to death benefits, and worker ' s compensation benefits , as other similarly situated employees of Wylie . X. Each Party to this Agreement expressly waives all claims against the other arty for compensation for any loss, damage, personal injury occurring as a consequence of the performance of this Agreement . XI . Third party claims against the Officer or the Parties hereto shall be governed by the Texas Tort Claims Act or other appropriate statutes, or the charters and ordinances of the Parties . XII . It is expressly understood and agreed that, in the execution of this Agreement , no Party waives, nor shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims arising in the exercise of governmental powers and functions. XIII . Each Party to this Agreement agrees that if legal action is brought under this Agreement, exclusive venue shall lie in the county in which any of the defendant Party or Parties is located , and if located in more than one county , in the county in which the principal office of the defendant Party is located . XIV. The validity of this Agreement and of any of its terms or provisions , as well as the rights and duties of the Parties hereunder , shall be governed by the laws of the State of Texas . XV. In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal or unenforceable in any respect , such invalidity , illegality or unenforceability shall not affect any other provision thereof , and this Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein. XVI . All payments hereunder shall be made from current revenues of the Parties. XVII . Any Party to this Agreement may terminate this Agreement by giving thirty (30) days written notice sent by certified mail to the Police Chiefs of each of the other Parties. Any Party who terminates this Agreement shall be responsible for the payment of its pro rata share of the Officer' s expenses up until the time of said Party' s termination. No Party may terminate this Agreement prior to sic (6) months from the effective date of this Agreement . XIX. This Agreement shall become effective between the Parties hereto on the day after it is fully executed and shall be automatically renewed annually until it has been terminated according to this Agreement . XX. This Agreement may be amended or modified by the mutual agreement of the Parties hereto expressed in writing to be attached to and incorporated into this Agreement. XXI . To summarize, the City had a Utility Contractor replace a sewer collection main in the alley bounded on the : 1 north by Calloway Street and the south by College and likewise on the west by S. Ballard and the east by S. Jackson. In the process, bearing in mind the contractor did this last summer and apparently did not tap the service lines for two of the three addresses on this block that •_ would be serviced by the main in the alley. City inspection of the process may bp a area of concern. Nevertheless, Mr. Martin replaced . a sewer line, which was over 30 years old, believing we had a problem at this rental property (110 College St) . It wasn't until late March that the City corrected the problem by going back in and tapping the main for this service address. Those are the basic facts as I understand it. I would request that you investigate the claim and determine the City's Liability, if any, in the matter and the validity of the expenses incurred by Mr. Martin. Box 428 Wylie, Texas 75098 Re: 110 College Street Wylie, Texas Dear Mr. Johnson: Pursuant to our telephone conversation on approximately April 3, 1989, this is a detailed description of my attached claim for $3330. 50 against the City of Wylie. I ' ll list transactions etc by the numbers for a better explanation. 1. Shortly after I purchased the property at 110 College Street, in Wylie, Texa: (Kel1ers #1, Block 5 Lots 9 & 10) the City of Wylie employed an outside con- tractor to install a new sewage line from College Street on the south side to a north direction which is on the east side of the above property. 2. Shortly after the installation of the new sewage line, I begin experiencing plumbing problems at the property. 3. Attached is an August 6, 1988 $55. 50 plumbing bill , which did not good, just temporary relief. 4 . Attached is an August 16, 1988 $205. 00 plumbing bill, which did no good, just temporary relief. 5. I was not able to collect rental fees of $300. 00 per month for 2 months and the house became empty, resulting in a $600. 00 loss. 6. I rented the house in about November and spent another $60. 00 on 12-17-88 for another plumbing bill (to unstop the sewer) . 7. During the month of January and February and part of March I had several tele phone conversations with: 2 with John Akin, 2 with Kenny Rogers and one with Fred Chambers regarding this problem, asking them to advise me if I was liable for the problem or if the City was to clean out the line. 8. Fred Chambers advised me that they had inspected the sight and found the problem was mine, the sewer line probably had tree roots inside and would have to be replaced and re-connected to the newly installed sewage line in the alley. 9. Towards the end of February or first of March, Turner Plumbing was employed to dig and install a new sewage line from the house to the alley, since there was no choice on my part as I was informed it was MY problem, very firmly (but nice) stated to me. . 10. As you are aware, we had several weeks of extremely cold/wet weather. However during the last week of March we were informed the house would be condemned if the sewage line from my house to the alley was not replaced, which I can understand. 11. The tennants in the house were experiencing extremely difficult plumbing problems as well as a terrible sewage oder this went on for approximately 3 months and I feel they deserve at least $500 00 for their inconvenience. 12. On or about March 28th or 29th Turner Plumbing begin installing the new sewage line and completed it on March 31 , 1988 . (During a very muddy time) . 13 . During the installation of the new sewage line, it was of course inspected by Kenny Rogers and a Gary somebody from the Wylie Public Works department was also there a time or two. This plumbing expense to me was $1910. 00. i4 . I personally was not there, however my brother in law, H. F. Moore who res;des in Wylie was present during the installation. 15. It was discovered during these 2 or 3 days; when the City' s sewage line in the alley was installed by an outside contractor; the existing sewage line from my house to the alley was NOT reconnected, thus causing the entire problem from back in the summer of 1988 . 16 . This was verified during a telephone conversation between me and a Mr. Don White of the Public Works Department in Wylie. It was verified by Mr. White that there was an outside firm, that installed the City ' s sewage line, even though John Akin informed me the City never does employ outside contractors, to do work of ..his nature said the City had it' s own crews for that type of work. 17. During the March 31, 1989 conversation with Mr. White, I ask him if the City required a permit and inspections by the City inspector when they had outside contractors to do their work. He informed me to his knowledge they did not. 18 . This I didn' t understand, since Turner Plumbing (to my expense) was require to obtain a permit and have an inspection - yet the outside contractor coul do the work (which as you can see by now, was NOT properly done) and not be required to have a City inspector, inspect their work. 19. On March 31 ,1989 during the conversation with Mr. White, he verified the sewage from my house at 110 College was NOT reconnected when the new line was installed in the alley. 20. I want it clearly understood, I am NOT filing this claim unjustly nor am I just trying to "get to the City of Wylie" for this claim. 21 . I grew up in Wylie and it' s still "home" , I have no bitter feelings, ana am NOT "Mad" at anyone. I just feel it nothing but "Right" that I be reimbursed for my claim. 1. Plumbing expense $2230. 50 (copies of bills attached) 2. Loss of Rent $ 600. 00 (2 months @ $300. 00 per month) 3. The contractor Hixs did not submit a written bid as an independent contractor on this job and agreed to do the work by the hour with the City of Wylie fur- nishing all materials. The work was inspected by Don White and Ron Haneyer and the old pipe was removed fran the ground as the new pipe was layed. The condition of the old pipe was such that it is possible that it was hard to de- termine if any taps actually came in from Martin's side of the alley. In speaking with Don White once again, it is indicated that the existing line that was there came out in bits and pieces, which would make it difficult to actually tell where a tap came in and where a tap did not cane in. He felt it could possibly be a legitimate error on either their part and/or the part of Hixs. It is also noted in speaking with Hixs that a City employee advised him that Martin's line came out the front instead of to the alley side. This is believed to be true according to Don White. He felt that in talking to a plumber in the Wylie area that was out there working on Martin's problems that the indication that the line did cane out of the front was discussed and this was haw it was revealed to Hixs that the line came to the front instead of to the side. In light of this information, I believe that it is possible that the City of Wylie would owe Mr. Martin some reimbursement on his expenses. Due to the con- dition of Martin's property and the sewer line in question, it is certainly not felt that a full payment should be made. I would suggest that we possibly consider the one bill for the sewer line only, which is $1910 and offer partial payment of $500 in this matter. I would appreciate your advise along this line when you have had a chance to review the new information. Medlin has based his recommendation for the City to assume a $500 liability in the Kenneth Martin claim. It is obvious to me that the City' s contractor, Mr . Kenneth Hix , was neglegent in his work because he did not reconnect a second sanitary sewer service line which he had been advised existed and was told must be reconnected. Why should the City assume the liability of a private utility contractor , even though his services were purchased on an hourly basis rather than a lump sum? The City forces have already replaced both of the sewer service taps which Mr . Hix did not install ; therefore, I feel that Mr . Hix should have to share in the cost of correcting his mistakes . Box 428 Wylie, Texas 75098 Dear Carolyn: This will acknowledge your question with regard to citizen participation and council discussion on council and board meeting agendas. Article III, Section 9, of the Charter provides that all city council meetings shall be held and notice given in conformance with Article 6252-17, V.A.T.S., as amended. This statute of course also applies to any board, commission, department, committee, or agency within the city which is under the direction of one or more elected or appointed members, together with every deliberative body having rule making or quasi- judicial power. This includes, among others, the Planning and Zoning Commission and the Board of Adjustment. The Charter also provides, in Article VIII, Section 3, that all meetings are subject to current and future laws of the state concerning public meetings. Article 6252-17 requires the posting of a notice of each meeting specifying any matter which will be considered or acted upon. There are numerous exceptions, one of which is that notice need not be posted with regard to matters about which specific factual information or a recitation of existing policy is furnished in response to an inquiry made at a public meeting, whether such inquiry is made by a member of the general public or by a member of the governmental body. Any deliberation, discussion, or decision with respect to the subject about which inquiry was made shall be limited to a proposal to place such subject on the agenda for a subsequent meeting of such governmental body for which notice has been provided in compliance with the Act. These latter provisions really mean that citizen participation should be limited to a citizen making a statement and asking questions. If the questions can be answered by a staff member or by a member of the city council or board by simply furnishing specific factual information or reciting existing policy, that is permitted. If the question or the statement by the citizen requires any deliberation, discussion, or decision by the council or board involved, then the subject may only be discussed with respect to a proposal to place it on an agenda for a future meeting. The same rule applies to a statement made or question asked by a member of the council or board. In that event, the council or the board involved may not deliberate, discuss, or decide on any matter raised by the member except to the extent necessary to decide on a proposal to place that subject on the agenda for a subsequent meeting. Ms. Carolyn Jones October 18, 1989 Page 2 The only danger that I see to the council or a board of the city in putting items such as citizen participation and council or board discussion on the agenda is that the members may not be sufficiently familiar with these rules to limit their own comments. This is dangerous for them because violation of the statute is a misdemeanor punishable by a fine of not less than $100.00 nor more than $500.00 or imprisonment in the county jail for not less than one month nor more than six months, or both. It is up to the council and the board involved to decide whether the political value of having citizen participation and council or board discussion outweighs the risk of violation of the statute. DRAIN HAD TRAVELED UNDER AN ALIAS, HAD SERVED IN MILITARY PRISON FOR A. W. O. L. OFFICER MAURIE ADVISED HE HAS DEALT WITH THIS PARTY ON SEVERAL OCCASIONS. HE HAS BEEN KNOW TO HAVE RODE WITH THE HELLS ANGELS. HE IS ALSO THE PARTY BEHIND THE ALLEGATIONS OF ME STEALING AN A. C. UNIT WHICH WAS LATER TURNED UP AT 302 S. THIRD. HE IS ALSO ACQUAINTED WITH SIDNEY MOUNSE WHO I HAD TEAR DOWN A GARAGE HE AND RAYMOND STRICKLAND, WHO HAD SENT THREATENING NOTES THROUGH MY WIFE. MR. DRAIN' S GRANDFATHER HAS THE WORKSHOP WHERE MOUNSE WORKED AFTER HAVING HIM TEAR DOWN THE GARAGE. FEBRUARY 21 , 1989 GREEN CARD RECEIVED.
