EXECUTIVE SUMMARY This item was tabled from the February 12, 2002 City Council Meeting. Council adopted new Residential Districts in July,2000 with the desire to encourage flexibility of design as well as raise the standards of construction. From the time of adoption no developers have fully implemented the new flexible point system. Recent developments have been zoned as Planned Development Districts which establish unique development requirements or have not yet initiated construction under the new requirements. Following Work Sessions held in December and January,with numerous developers and builders, the Planning and Zoning Commission held a Public Hearing to consider several issues concerning the architectural requirements for Single Family Districts. Please refer to your agenda communication for the recommended revisions for consideration by the City Council. 2. Hold a Public Hearing to consider and act upon certain proposed revisions to the Townhouse (TH/15) District Requirements of the Comprehensive Zoning Ordinance, including the Minimum Lot Size and Dwelling Unit Size of Section 3.3.B and Parking of Section 5.8.0 and correction of the Land Use Tables(Figure 5-3) concerning permitted uses in the Townhouse District. Consider and act upon authorizing the City Manager to execute and award a contract to The Hogan Corporation,in the amount of$10,900 for engineering services related to the design of a 12-inch water line along Sanden Blvd. EXECUTIVE SUMMARY The City's Water and Sewer Master Plan indicates a 12-inch water line along Sanden Blvd. Recent development along Sanden has constructed portions of the water line from FM 544 south and from Hensley Lane north as shown on the attached map. The proposal is for the design of the remaining 1,100 feet of water line needed to complete the loop along Sanden and provide additional capacity to the Hensley Lane area. MEMORANDUM TO: Members of the Planning and Zoning Commission FROM: Claude Thompson, and Dale Jackson, Planning Director Building Official THRU: Mindy Manson, Assistant City Manager SUBJECT: Proposed Revisions to the Residential Regulations of the Zoning Ordinance DATE: February 26, 2002 At the February 12, 2002 public hearing, the City Council discussed several proposed revisions to the residential regulations of the Zoning Ordinance and tabled further discussion until a February 26, 2002 work session. The proposed revisions grew out of concerns expressed to staff by a number of residential builders related to several of the regulations adopted in July of 2000. Since their adoption, no subdivisions have been initiated which comply with these requirements. Several subdivisions have been approved which modify the regulations to varying degrees through special conditions of Planned Development Districts. Staff raised these issues to the Planning and Zoning Commission on several occasions, and the Commission agreed to reconsider the regulations as had been adopted. The Commission held three work sessions with a representative cross-section of the home building industry and builders and developers constructing residential subdivisions in Wylie. Based on discussions of these work sessions, the Commission formulated the proposed revisions which were considered by the City Council at the February 12 public hearing. These are recommended by a unanimous vote of the P&Z Commission and supported by staff. It is recommended that the current requirement of"100% brick or stone" for exterior wall materials on residences be expanded to include brick, stone or masonry stucco. The current exception which allows "wood siding on dormers or other elements supported by the roof structure" will be revised to allow composite masonry materials having the same durability as masonry or stone such as stucco and Hardy Plank in upper story areas supported by the roof structure and when the face of the exterior wall is offset at least two feet from the first floor. The currently allowed "wood siding and shingles" as well as other new composite exterior finishing systems (EIFS) will not be permitted on any portion of the building. It is recommended that all other issues for which revisions were proposed at the public hearing (including the repetition of floor plans and front elevations, covered front porches of the Single Family Districts and lot and dwelling size of Townhouse District) remain as adopted in July of 2000. CONSIDER AND ACT UPON AN ORDINANCE ADOPTING A NEW CROSS-CONNECTION PREVENTION AND CONTROL PROGRAM, REPEALING ORDINANCE NUMBER 99-34 AND REPEALING ALL CONFLICTING ORDINANCES. Mr. Dale Jackson, Building Official addressed this item. Mr. Jackson explained the purpose and intent of repealing the ordinance adopted on November 9, 1999 that originally established the City's cross connection program, as required by the TNRCC in compliance with state law. He stated that the 1999 ordinance required installation of vacuum breakers or a Reduced Pressure Principle device to protect water supply contamination from residential lawn sprinklers,which has proven to be problematic and that previously, double-check assemblies were allowed. The consultants, Backflow Management, Inc, included the change in backflow devices in the 1999 ordinance, anticipating that the TNRCC would disallow the use of double-check assemblies for residential lawn sprinklers, however, the TNRCC has no plans to disallow this use. Mr. Jackson concluded by stating that the proposed ordinance also addresses adequate protection of fire sprinkler systems, upgrading the requirement for backflow protection of fire sprinkler systems to help ensure that the contaminated water contained within the lines does not contaminate the drinking water supply. Councilman Worley made a motion to approve the ordinance adopting a new cross connection prevention and control program, repealing ordinance number 99-34 and repealing all conflicting ordinances. Councilman Young seconded the motion. A vote was taken and the motion was approved, 5-0. Councilman Hogue and Trout were absent. 3. He stated that the applicant is requesting rezoning of the subject tracts currently zoned Multi-family, Business and Single-Family in order to relocate the Multi-family and eliminate the Business uses. Recently adopted revisions to the Zoning Ordinance and Map, changed the subject Business-2 District to Neighborhood Services and the Single Family-3 to Single Family-8.5/17. The subject Multi-family remained MF. Application for rezoning submitted for review prior to the adoption of the November revisions. Proposed rezoning will eliminate the commercial zoning district and relocate the Multi-family zoning to the frontage along Elm Road and expand the MF from 8.23 acres to 10.44 acres. The remainder of the property will remain zoned SF-8.5/17. Public Comment Forms were mailed to four (4) property owners within 200 feet of this request. Two Comment Forms FAVORING and one OPPOSED to the proposal. At the January 15, 2002 Planning and Zoning meeting, the Commission voted 4-1 to recommend approval of this zoning case. There was considerable discussion regarding multi-family development with regard to the proposed relocation and the number of units. Mr.Frankie Delgado,1011 Meandering Way Mr. Delgado read from an email that he had sent to the Mayor and Council expressing his opposition to the development. Mr. Delgado's concerns were specifically related to the development of multi-family/apartments and its impact on the existing property owners and burden to the taxpayers and school district to support the additional families. Mr.James Smith,112 Martin,Wylie,Texas Mr. Smith spoke in opposition of the request. His concerns were changes to the comprehensive plan and undesired growth patterns. Mr.Bob Skipwith, 1450 Elm Drive Mr. Skipwith spoke in opposition to the request. His concerns were property value, impact to traffic and school district and lack of tax benefit from apartments. Mr. Rick Foster,2010 Elm Drive Mr. Foster spoke in opposition to the request. His concerns included those of his neighbor, Mr. Skipworth,as well as the traffic impact on existing roads, specifically 381. He asked that the Council consider tabling this item for further review and consideration of issues. Mr. Carl Foster,2320 Elm Drive Mr. Foster spoke in opposition of the request. He stated his concerns were with the impact that additional traffic will have on the existing roads. He also stated that he had visited with Mr. Parsons and multi-family development was not mentioned. He advised Council to consider all issues before taking any action. Mr.Kevin Sanders, 1780 Elm Drive Mr. Sanders spoke in opposition of the request stating that he agreed with all that had been already stated. He stated that he felt that there was no vision for Wylie. Mr.Willis Dykes, 1820 Elm Drive—C.R.381 Mr. Dykes spoke in opposition of the request. His concerns were the existing roads and the future widening and maintenance. He asked that Council review with the developer and consider develop Single Family homes. Mr. Skipworth,Sr.,315 Hilltop Mr. Skipworth spoke in opposition of the request. His concerns were the multifamily development, specifically that there was not a need in Wylie for apartments,citing the existing mobile home communities as sufficient. Mr.Wylie Dunham, 1740 Elm Drive Mr. Dunham echoed the concerns of his neighbors. He stated his reasons for moving from the big city to the atmosphere offered. He urged Council to consider this request and keep Wylie the place everyone loves. Mr. Steve Parsons, developer apologized to those who were unaware of the zoning request. He stated that he wants to produce a quality project and asked for guidance from the Council. Ms.Mindy Manson stated that Council had some options. She stated that if the item is tabled to the next meeting, then we could look at alternatives. If Council chooses to deny, it would go back to the Planning and Zoning Commission. Mr. Johnson, City Manager added that if Council chooses to table the item, the only alternative would be to come back with what was requested only more restricted. His concerns included the addition to an already overcrowded school district; existing road conditions combined with additional traffic; increase in refuse service and the proposed treatment plant. He reminded council that the zoning board has met and unanimously voted to reject the proposal of smaller homes and asked that Council take some time and review the proposed request. His expressed his desire to keep the area a rural atmosphere area with two-acre lots and 2,500 square foot homes. Carolyn Proctor,4035 Avion Ms. Proctor spoke in opposition of the request. She agreed with the action to annex, however, she expressed concerns regarding the proposed development. She then read the city of wylie's mission statement. She stated that she did not want to see smaller homes and would recommend two-acre lots and 2,500 to 4,000 square foot homes. Scott White,9470 Wells Road Mr. Scott asked that the Council table this item. He expressed his concerns regarding the size of the homes, the Garland landfill that would increase the truck traffic and the new wastewater treatment plant. He also expressed concerns regarding access from Sachse Road and school bus traffic. He asked that Council consider two-acre tracts for the proposed development. Becky Sanoja,4060 Avion Drive Ms. Sanoja spoke in opposition of the request. She stated that she moved to the United States and is originally from England and chose the area because of the atmosphere. She is opposed to small houses on small lots and the proposed treatment plant and Garland landfill. Vanessa Sanoja,4060 Avion Drive Ms. Sanoja spoke in opposition of the request. She stated that she and her family moved to Wylie from Plano four years ago and that they enjoy the country side atmosphere. She stated opposition to small house on small lots, the proposed Garland landfill, the wastewater treatment plant, and the burden of additional students on an already overcrowded school system. She asked that the Council vote against the proposed zone change. Melinda Bento,3525 Whitley Road Ms. Bento spoke in opposition of the request and asked that the Council consider tabling the item. She expressed concerns including increased traffic and burden to school systems. Richard Proctor,4035 Whitley Road Mr. Proctor spoke in opposition of the request. He expressed his concerns regarding the quality of life and suggested a one to two acre lot development. Mr.RP.Miller,101 Hunter Glen Mr.Miller spoke in opposition to the request. He expressed concerns that included non-consistency to the existing area;opposition to the smaller homes. He stated that the City of Wylie has plenty of starter homes within the city. He concluded by stating that the proposed development would not enhance the entrance to the city. Mr.Don Smith,5102 Sachse Road Mr. Smith spoke in opposition of the request. He stated that he currently lives at Happy Acres Ranch and he is opposed to small houses on small lots. He stated that this type of development is similar to a project in Lewisville and it attracted an element of residents that caused the crime rate to escalate. He also mentioned issues with sewer and landfill and the addition of starter homes. Ms. Cecile Mekias,3507 Pleasant Valley Road Ms. Mekias spoke in opposition of the request. She expressed concerns regarding the burden to the already overcrowded school district and conditions of existing roads. Background This item was tabled from the February 12, 2002 City Council Meeting. Council adopted new Residential Districts in July, 2000 with the desire to encourage flexibility of design as well as raise the standards of construction. From the time of adoption no developers have fully implemented the new flexible point system. Recent developments have been zoned as Planned Development Districts which establish unique development requirements or have not yet initiated construction under the new requirements. Following Work Sessions held in December and January, with numerous developers and builders,the Planning and Zoning Commission held a Public Hearing to consider several issues concerning the architectural requirements for Single Family Districts. The following revisions are recommended for consideration by the City Council. 1. Revise the current requirements of Section 3.4.F.1.2 for Exterior Facade Materials from "100% brick or stone" to 100% masonry on the front facade and 80% masonry on the remaining walls("masonry"to include brick or stone units, stucco,EFIS and other composite cementitious products thereof as approved by the Building Official). 2. Revise the current requirements of Section 3.4.F.6 pertaining to Repetition of Same Floor Plan and Street Elevation to require skipping 4 lots on the same side of the street and 2 lots skipped on the opposite side of the street before repeating the same elevation and no floor plan repeated side by side. Points would then be given for achieving 7 lots skipped before repeating the same floor plan and same street elevation. 3. Revise the current requirements of Section 3.4.F.9, Village Residential Front Entry Cover, from required 40 sq.ft.minimum front porch with 4 ft.minimum depth,to 20 sq.ft.minimum front porch with a 5 ft. minimum width. A 40 sq. ft.porch would then earn additional points towards meeting the desirable design criteria. 4. Revise the Village Residential Garage Door requirements of Section 3.4.F.11 to define the required offset as 12 inches. Financial Considerations N/A Other Considerations 1. Exterior Façade Materials. The requirement for 100% brick or stone laid units currently allows non-masonry products to be used on portions of walls where there is no structural support for masonry, as well as to establish an historic or architectural style. Composite masonry products now offer the same durability as brick and stone as well as added flexibility in design. The required 100%brick or stone tends to produce subdivisions with very little visual diversity, and appears contrary to the goal of the new flexible point system.A broader masonry definition is already permitted for nonresidential construction. 2. Repetition of Same Floor Plan and Street Elevation. The current requirement to skip at least 7 lots on the same side of the street before repeating plan and elevation has been identified as being difficult to implement for several reasons. First, the ordinance requirement for short curvilinear streets makes this requirement unnecessary in order to reduce visual similarity. Secondly, the residential building industry attempts to accomplish the intended diversity by skipping 3 or 4 lots,when allowed to do so by market pressures. Finally,the requirement to skip lots greatly reduces buyer choice in the final stages of development of a subdivision. 3. Village Residential Front Entry Cover. The current requirement for a front porch to be 40 sq. ft.with a minimum depth of 4 ft. appears to limit the desired flexibility intended to result from the point system.Large porches introduce a standard or theme that reduces design creativity and variation. The larger dwellings of the Suburban and Country Residential Districts currently require only a 20 sq. ft. front porch. 4. Village Residential Garage Doors. The requirement for an offset in the façade ofthe garage is not defined for Village Center dwellings. The other residential districts on larger lots have the offset defined as five feet minimum. The proposed offset of 12 inches is considered adequate to achieve the desired visual articulation on smaller house fronts, as well as be economically achievable without special foundation designs. Board/Commission Recommendation At the February 5, 2002 Planning and Zoning Commission meeting, the Board voted 5-0 to recommend approval of these proposed revisions to the Comprehensive Zoning Ordinance. Staff Recommendation Staff is prepared to enforce the requirements as adopted until additional direction is provided by the Commission and City Council. February 26, 2002 Issue Hold a Public Hearing to consider and act upon certain proposed revisions to the Townhouse (TH/15)District Requirements of the Comprehensive Zoning Ordinance,including the Minimum Lot Size and Dwelling Unit Size of Section 3.3.8 and Parking of Section 5.8.C and correction ofthe Land Use Tables(Figure 5-3) concerning permitted uses in the Townhouse District. Background This item was tabled from the February 12, 2002 City Council meeting. New Residential Districts and requirements were adopted in July,2000 which combined Duplex(2F) and all other Single Family Attached(SF-A)residential types into one Townhouse(TH/15)District. However,these new requirements have not been tested. Following a Work Session held in January, the Planning&Zoning Commission held a Public Hearing to consider the new Townhouse(TH/15) District requirements. The following revisions are recommended for consideration by the City Council. 1. Lot Area—Current requirements: 4,000 square feet minimum Proposed: 3,500 sq. ft. minimum for all Townhouse District dwellings except where 3 or more units are attached on zero lot lines the minimum is 3000 sq. ft. for interior units with no side yards. 2. Minimum Unit Size—Current requirements: 1,500 sq. ft. minimum Proposed: 1,000 sq. ft. minimum for duplex units and 1200 sq. ft. for all others. 3. Parking—Current requirements:Two spaces for every dwelling and an additional'/2 space for guest parking within the development. Proposed: Two spaces for every dwelling one of which must be enclosed. All required parking shall be located behind the front building line. 4. Land Use Tables—Remove Single Family Dwelling Detached from the permitted uses under the Townhouse heading in Figure 5-3 Land Use Tables. The previous Two-Family District (2F)lots were required to be platted in pairs of no less than 8,500 sq. ft. or 4,250 sq. ft. minimum per each dwelling unit. The minimum dwelling unit size was 900 sq. ft. The Single-Family Attached District (SF-A) required units to be built on separately platted lots of at least 3,000 sq. ft. with a minimum dwelling size of 1,200 sq. ft. The new Townhouse District(TH/15)requires that each unit be on a separately platted lot of 4,000 sq. ft. with a minimum dwelling unit size of 1,500 sq. ft. By comparison, the Multi-Family District(MF)minimum dwelling sizes remained the same with a two bedroom unit of 900 sq. ft. and a three bedroom unit of 1,000 sq. ft. Financial Considerations N/A Other Considerations 1. The private development sector points out that duplex and attached dwellings differ from Single-Family detached dwellings in that they are more often purchased at least partially as investment properties and for rental occupancy. Therefore, the dwelling size should correspond more closely to its multifamily competitor than to owner occupied detached housing. The required size of multifamily units is 900 to 1,000 sq. ft. compared to 1,500 sq. ft. for attached units and 1,700 sq. ft. for the smallest allowed detached housing. 2. When three or more Single-Family Attached units are constructed together the interior units which do not have side yards are forced to either increase lot depth or dwelling width in order to meet the minimum lot dwelling sizes. By reducing the minimum size of interior lots, consistency in size of lots and dwellings can be achieved. 3. The requirement for enclosed parking was omitted by the Residential revisions ofthe Zoning Ordinance. The '/2 space for guest parking more appropriately applies to multifamily complexes that have common areas than to Single Family Districts. 4. The Land Use Tables(Figure 5-3)inappropriately allows Single Family Detached dwellings to be located in the Townhouse District. Board/Commission Recommendation At the February 5, 2002 Planning and Zoning Commission meeting, the Board voted 5-0 to recommend approval of the proposed Townhouse (TH) District Requirements revisions to the Comprehensive Zoning Ordinance. Staff Recommendation Staff agrees that attached single-family dwellings should be smaller than detached single-family dwellings. However, staffbelieves that a minimum size of 1,200 sq. ft. or 1,300 sq. ft.both addresses the special qualities of attached dwellings and better serves to transition from the smaller multifamily units (1,000 sq. ft.) to the detached single-family units (1,500 sq. ft. min.). Staff is prepared to enforce the requirements as earlier adopted until additional direction is provided by the Commission and City Council. February 26, 2002 Issue Hold a Public Hearing to consider and act upon a change in zoning from Single-Family Residential (SF-8.5/17),Multifamily Residential(MF)and Neighborhood Services(NS)to Planned Development (PD)District for Single-Family Residences,being a certain 66.8583 acre tract of land situated in the D.W. Williams Survey,Abstract No. 980 and the Allen Atterberry Survey,Abstract No. 23,City of Wylie, Collin County, Texas,being a part of a tract conveyed to JCM Properties,L.P. according to the deed recorded in Volume 2233,Page 874 of the Deed Records of Collin County,Texas,and all of two tracts conveyed to JCM Partners,L.P. according to the deed recorded in County Clerk's File No. 96-0045039 of the Deed Records of Collin County, Texas, and being all of the tract conveyed to Verna M. Poor according to the deed recorded in Volume 4409,Page 2100 of the Deed Records of Collin County, Texas. (Zoning Case No. 2002-01) Background The subject property totals 66.8583 acres,and is currently zoned Multifamily Residential(8.23 acres), Neighborhood Services Retail (3.38 acres) and Single-Family Residential for 8,500 square feet minimum lot size. The requested rezoning will eliminate the Multifamily and Retail uses, and allow the entire property to develop as Single-Family Detached Residences of 8,000 square foot lots. The entire property is unplatted and undeveloped. The eastern half ofthe subject property was annexed into the City of Wylie in November of 1985,and zoned as Single Family-3 Residential (allowing 7,200 square foot lots) and Business-2. The Multifamily portion was rezoned in 1987. In November of 2001,the Council adopted revisions to the Zoning Ordinance and Map which changed the SF-3 to SF-8.5 and the B-2 to Neighborhood Services (NS). The western half of the property was annexed into the City of Wylie in July of 2001, and rezoned to Single-Family 8.5/17 Residential in September of 2001. A request to eliminate the Neighborhood Services use and relocate the Multifamily use to the Elm Road frontage was denied by the City Council on January 22, 2002. With that decision, Council expressed willingness to support residential lots somewhat smaller than the required 8,500 square feet as a possible compromise for elimination of the potential for Multifamily uses as well as the Business uses on the property, as is reflected by the subject request. The requested Conditions ofthe Planned Development District establishes certain variances fromthe standard requirements of the Zoning Ordinance. All other standard requirements of the SF-8.5/17 District will be complied with. Five additional written comments have been received from properties beyond the legal Notification Area, all favoring the proposed zoning change. Financial Considerations Zoning Application Fee—Paid Other Considerations 1. The Comprehensive Plan recommends that the subject property be developed as Country Residential. The Plan defines Country Residential as lots of one acre or larger served by rural roadways. The proposed rezoning does not comply with this recommendation of the Plan. 2. The Comprehensive Plan and Thoroughfare Plan recommend that Elm Road become a six- land parkway with divided median as part of a new Lakeshore Drive loop system to connect the downtown core with lake-oriented developments. The higher densities of the requested smaller lots are more compatible with this major traffic corridor than is the rural roadway envisioned to accommodate the Country Residential classification ofthe Comprehensive Plan. 3. The proposal does eliminate the potential for as many as 123 apartments which could be constructed on the Multifamily tract. The reduction in Single-Family lot size from the currently required 8,500 square feet to the 8,000 square feet allows the possibility of approximately an additional 22 single-family detached dwellings. 4. The PD Conditions for Development require compliance with all regulations of the Single Family-8.5 District, with the exceptions of reductions in the minimum lot size and the minimum lot width. Minimum lot size is established at 8,000 square feet. Minimum lot widths may be reduced from 70 to 65 feet. Side yards will be reduced from 7 feet to 6 feet for interior yards and from 25 to 15 feet for yards adjacent to streets except when the lot is a key lot. 5. The PD Concept Plan reflect that alleys will be provided throughout the development,except where proposed lots back to the floodplain on the northeast,to existing platted residential lots without alleys to the north and to undeveloped property within unincorporated Collin County to the southeast. Approval of the PD and its Concept Plan and Conditions of Development will constitute a waiver of the required alleys for these locations. Board/Commission Recommendation At the February 19, 2002, Planning and Zoning Commission meeting,the Commission voted 5-0 to recommend approval of this zone change. Staff Recommendation Approval. AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON'I HE HEREINAFTER DESCRIBED PROPERTY,ZONING CASE NUMBER 2002-01, TO PLANNED DEVELOPMENT (PD) DISTRICT CLASSIFICATION;PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILTTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Planning and Zoning Commission and the governing body of the City of Wylie, Texas,in compliance with the laws of the State of Texas with reference to the amendment of the Comprehensive Zoning Ordinance,have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to owners of the affected property,the governing body ofthe City is ofthe opinion and finds that the Comprehensive Zoning Ordinance and Map should be amended; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Wylie, Texas,be, and the same is hereby,amended by amending the Zoning Map ofthe City of Wylie,to give the hereinafter described property a new zoning classification of Planned Development (PD) District Classification, said property being described in Exhibit"A",Exhibit`B"and Exhibit"C"attached hereto and made a part hereof for all purposes. SECTION 2. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City,as amended herein by the granting of this zoning classification. SECTION 4. Any person, firm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby,commits an unlawful act and shall be subject to the general penalty provisions of Section 38 ofthe Zoning Ordinance,as the same now exists or is hereafter amended. SECTION 5. Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional,illegal or invalid,the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional,and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 6. This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. SECTION 7. The repeal of any ordinance,or parts thereof by the enactment of this Ordinance, shall not be construed as abandoning any action now pending under or by virtue of such ordinance;nor shall it have the effect of discontinuing,abating,modifying or altering any penalty accruing or to accrue,nor as effecting any rights of the municipality under any section or provisions of any ordinances at the time of passage of this ordinance. The proposal is for the design of the remaining 1,100 feet of water line needed to complete the loop along Sanden and provide additional capacity to the Hensley Lane area. Financial Considerations • The FY 2002 budget included$90,000 for the Sanden water line project. Prepared by Revie jr by Finance City M er Approval 02/11/02 WORK ORDER FOR PROFESSIONAL SERVICES WORK ORDER NO.WYL-44 This will constitute authorization by the City of Wylie,Texas(Owner), for The Hogan Corporation, Engineers-Planners-Consultants, Dallas, Texas (Engineer), to proceed with the following described engineering services. SANDEN WATERLINE EXTENSION A. PROJECT DESCRIPTION The Engineer shall perform Design and Construction Phase Services and such other related Additional Services that may be authorized by the Owner for the construction of the proposed water and wastewater line replacement. This project is comprised of approximately 1,100 linear feet of 12-inch diameter water main and related appurtenances as shown on the attached location map. It is mutually agreed that all improvements contemplated herein will be bid and constructed as a single contract. The services described herein are to be performed in accordance with the applicable sections of the Agreement for Engineering Services by and between the City of Wylie, Texas(Owner), and The Hogan Corporation(Engineer), as approved on July 27, 1993. B. PRE-WORK CONFERENCE The Engineer will meet with the Owner and other appropriate entities as/if needed to discuss the design criteria, work program and schedule, procedures of communication, additional surveys, assignments of personnel, and any other matters that may have a direct or indirect effect upon the completion and results of this project. C. DESIGN PHASE 1. Preliminary Planning a. Review existing conditions at the project site to identify areas of special concern in design and possible problems to resolve. b. Review previous field work completed, and determine additional surveys required. c. Address other considerations of the project, such as utility relocations, adjustments or replacements, and note locations where conflicts may occur. -1- 02/11/02 d. Proceed, upon direction of the Owner, with the Design Phase services of the selected plan. 2. Preliminary Design a. Reduce and plot field notes of profile,cross-sections, and topography. b. Confirm existing and future utility (water, sewer, drainage, gas, cable, TV, telephone, electric)locations,based on data furnished by utilities. c. Set preliminary alignments and locations for the proposed water line. d. Coordinate preliminary layout of improvements with the City of Wylie, property owners, and utility companies. e. Field-check preliminary design. f. Present preliminary design drawings with preliminary cost projections to the Owner for review and comment. 3. Final Plans and Specifications a. Draft plan sheets to conform with final comments of the Owner from preliminary design review. b. Prepare final details. c. Prepare quantity of materials. d. Prepare final bid schedule, special conditions, specifications, proposal, and contract documents. e. Prepare projected cost of construction. f. Submit one (1) set of prints of the final plans and specifications to the utility companies for review and comment. g. Present two (2) copies of plans and specifications to the Owner for final approval and authorization to proceed with the Construction Phase. -2- 02/11/02 D. CONSTRUCTION PHASE 1. Advertise and Receive Bids a. Coordinate the final printing of the construction plans and specifications for distribution to the proposed bidders. b. Notify individual qualified contractors of the project, and contact the Texas Contractor and Dodge Reports for publishing the description of the project and date for receiving bids. c. Assist the Owner in securing, opening, tabulating, and analyzing of bids. The Engineer will furnish recommendations on the award of the contract based on the lowest qualified bidder. d. Assist in the engineering phases of the preparation of the formal contract documents between the contractor and the Owner. 2. General Review of Construction a. Conduct a preconstruction meeting on site with representatives of the Contractor and OWNER. b. Make periodic visits to the site (as distinguished from the continuous services of a resident project representative) to observe the overall progress and quality of the work, and to determine general conformance with the requirements of the contract. c. Consult and advise with the Owner during construction, make recommendations to the Owner regarding the materials and workmanship, and prepare change orders with Owner's approval. d. Check and review samples, catalog data, schedules, shop drawings, laboratory, shop and mill tests of material and equipment and other data which the contractor is required to submit for conformance with the design concept of the Project and compliance with the information given by the contract documents, and assemble written guarantees which are required by the contract documents. e. Assist the Owner in arranging for testing of materials and laboratory control during construction to be conducted at the Owner's expense and interpret the results of such tests. f. Interpret intent of the plans and specifications for the Owner and contractor(s). -3- 02/11/02 g. Review and comment on monthly and final estimates for payment to contractor(s). h. Conduct in company with the Owner's representative a final inspection of the Project for conformance with the design concept of the Project and compliance with the contract documents, and review and comment on the certificate of completion and the recommendation for final payment to the contractor(s). i. Prepare revisions of construction drawings with the assistance of the Owner's Project personnel and the construction contractor(s) reflecting changes in the Project made during construction. These "Record Drawings" shall be provided by the Engineer to the Owner as one set of reproducible sheets and two sets of prints. E. ADDITIONAL SERVICES It is mutually understood that the following services are not included in the Engineer's basic services described above, and if the Owner elects for the Engineer to provide such services, they are to be considered as "Additional Services"and will be compensated for accordingly. 1. The Owner will contract directly with a Registered Professional Land Surveyor (RPLS) for performing design and topographic surveys and any necessary land or boundary surveys for site or easement acquisitions. 2. It is anticipated that the Owner will furnish a full time Resident Project Representative to observe the construction work on a day-to-day basis and to give any necessary directives to the construction contractors. 3. Representatives of the Owner will prepare deed, easement dedication, and/or permit forms for properties, easements, or permits to be acquired and will need to take necessary steps for those acquisitions in a timely manner. 4. Provide consultation and advise as to the necessity of the Owner providing or obtaining other services such as auger borings, soil tests, or other subsurface explorations; laboratory testing and observation of samples or materials; environmental reviews or assessments; or other special consultations. The Owner will contract directly with qualified Geotechnical Engineering, Materials Testing, or Environmental Consulting firms as required. The Engineer will review any tests required and act as the Owner's representative in connection with any such services. -4- 02/11/02 F. RESPONSIBILITY OF THE OWNER Unless otherwise authorized in writing by the Owner for the Engineer to perform such other additional or special services,the Owner shall be responsible for the following services: 1. Provide the Engineer the assistance needed for collecting data from Owner's records for the design of the water system improvements. The acceptance and use of the data furnished by the Owner to the Engineer shall not operate to impose any obligation upon the Engineer to determine that the data is true, accurate, complete, or correct. 2. Provide the services of a qualified surveyor to furnish the necessary field data for the design of the proposed improvements. 3. Prepare applications for routine permits required by government and regulatory agencies. 4. Arrange for and coordinate the subcontract services of a Geotechnical Consultant for the soils investigation, as may be required. Also, the Geotechnical Consultant will investigate the soil conditions and recommend the requirements for preparing a trench safety program. 5. Authorize the Engineer to print, collate, and assemble an agreed number of plans, specifications,and bidding documents for distribution to prospective bidders. 6. Provide qualified personnel for daily observation of construction. 7. Furnish and coordinate qualified personnel to perform the field layout and staking for construction in accordance with the contractor's sequence of work to be accomplished. 8. Prepare daily reports of construction activities, with copies of reports furnished to the Engineer. If needed, daily report forms will be furnished to the Owner by the Engineer. 9. Advise Engineer by telephone, on a weekly basis, of the progress of work,problems encountered in construction, quality of work performed, and other matters concerning the project status. 10. Confirm the percentage of completion for work performed, as submitted by the contractor, during each month. 11. Furnish the local news media with Notice to Bidders and coordinate the appropriate times that the notice is to appear prior to the bid opening date. -5- 02/11/02 G. BASIS OF COMPENSATION 1. Availability of Funds The Owner agrees that funds, to the extent required, are currently available and sufficient to complete all phases of the proposed engineering services authorized under this Proposal. All invoices submitted by the Engineer and approved by the Owner shall be paid within thirty(30) days of the invoice date. For any payments not made within thirty (30) days, a charge will be made monthly in the amount of one and one-half percent (1-1/2%) of the unpaid balance, beginning thirty(30)days from the date of the statement. 2. Design Phase a. Engineering The Owner shall make payments to the Engineer for performing the engineering services described in the Design Phase on a monthly billing basis in proportion to that part of the services proposed herein which has been accomplished, as evidenced by monthly statements submitted by the Engineer and approved by the Owner. Final payment shall be due upon completion of these services. The compensation for the engineering design services performed shall be based on a lump sum amount of$7,600.00. b. Additional Services For Design Phase For performing any Additional Services for the Design Phase, the Engineer will assist the Owner, as directed, and is to be paid on a monthly billing basis at a per diem rate of the personnel's salary cost times a multiplier of 2.5. The Engineer is to be reimbursed for all direct non-labor, field surveys, and other subcontract expenses at the invoice cost plus 10 per cent for coordination and handling. 3. Construction Phase a. Advertise and Receive Bids For performing these Construction Phase services, the Engineer is to be paid on a monthly billing basis in proportion to the services proposed herein which has been accomplished, as evidence by the monthly statements -6- 02/11/02 submitted by the Engineer and approved by the Owner. Final payment shall be due upon completion of these services. The total compensation for the services performed shall be based on a per diem rate not to exceed the amount of$1,100.00. b. General Review of Construction For performing the General Review of Construction, the Engineer is to be paid on a monthly billing basis at a per diem rate of the personnel's salary cost times a multiplier of 2.5,with reimbursement of all direct non-labor and subcontract expenses at the invoice cost plus 10 per cent for coordination and handling. Total compensation for the above services will not exceed$2,200.00. c. Additional Services For Construction Phase For performing any Additional Services For Construction Phase, the Engineer is to be paid on a monthly billing basis at a per diem rate of the personnel's salary cost times a multiplier of 2.5, with reimbursement of all direct non-labor and subcontract expenses at the invoice cost plus 10 per cent for coordination and handling. 4. Other Special Services- (As Directed By The Owner) If authorized in writing by the Owner, the Engineer shall furnish other services or tasks in addition to the scope of services proposed herein. For performing these special services, the Engineer shall be paid on a monthly billing basis at a per diem rate of the personnel's Salary Cost times a multiplier of 2.5, with the reimbursement of all direct non-labor and subcontract expenses at the invoice cost plus 10 per cent for coordination and handling. H.
