Background The City intends to issue approximately $330,000 in Public Property Finance Contractual Obligations (at 5% plus). This issue is to finance the purchase of a 65 Foot Emergency 1 Quint fire truck that was approved at the February 28, 1995 City Council meeting. f inanch*l Considerations This resolution is needed to protect the tax exempt status of this debt in case the City should choose to pay part or all of the new equipment cost prior to receiving the new monies. Legal Considerations The City's bond counsel, Fulbright & Jaworski recommendation is that two original signed resolutions be prepared. WHEREAS, the City of Wylie, Texas (the "Issuer") intends to issue debt for the purpose of purchasing personal property (the "Projects") and further intends to make certain capital expenditures for the Projects and currently desires and expects to reimburse such capital expenditures with proceeds of such debt; WHEREAS, under Treas. Reg. §1.50-2 (the "Regulation"), to fund such reimbursement with proceeds of tax-exempt obligations the Issuer must declare its expectation to make such reimbursement; and WHEREAS, the Issuer desires to preserve its ability to reimburse the Expenditures with proceeds of tax-exempt obligations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, THAT the Issuer reasonably expects to reimburse capital expenditures with respect to the Projects with proceeds of debt hereafter to be issued by the Issuer, and that this resolution shall constitute a declaration of official intent under the Regulation. BACKGROUND The City's automobile liability and physical damage insurance is currently provided by Reliance Insurance Company through arrangement with Wylie Insurance Agency. The policy expires March 22, 1995 and Reliance has declined to submit a quote on a renewal of this coverage. An invitation for competitive proposals was duly advertised and a quote was solicited and received from the TML Intergovernmental Risk Pool. The solicitation was based on the same coverage provided under the current policy.TML has quoted a total annual premium of $16,738.00, assuming the premium is paid within 30 days of the effective date. The TML pool is currently providing Workers Compensation and Property and General Liability insurance for the City. FINANCIAL CONSIDERATIONS The total premium for the previous auto policy, at it's inception, was $34,600.00 and approximately $6,000.00 in additional premiums was paid throughout the year as new vehicles were procured. Expenditures for fiscal '95 were projected and budgeted accordingly. The TML proposal represents a total savings of approximately $20,000.00 for the year. RECOMMENDATION Staff recommendation is for Council to accept the proposal from TML Intergovernmental Risk Pool to provide Automobile Liability and Physical Damage Insurance effective March 22, 1995. The attached proposal shows the annual price of various options for liability coverage which are available to you through the TML Intergovernmental Risk Pool. For each coverage, all standard options are shown in a grid, with Limits of Liability options shown across the top of the grid, and Deductible options shown on the left side of the grid. The annual contribution for the limit and deductible option you desire for each coverage will be found in the box where the limits column and deductible row intersect. If you join the Pool on a date other than October 1, the contributions will be extended to the second following October 1 at the same rates as provided in the proposal or lower, should the Pool Board of Directors approve a rate reduction. For instance, if your coverage is effective April 1, 1994, your coverage can be extended to 10/1/95. Your contribution will be adjusted for the additional period of coverage using the rates in effect at the time this proposal was prepared. 2. As a Fund Member you must buy General Liability coverage to buy Law Enforcement or Errors and Omissions coverage. You must buy Law Enforcement coverage to buy Errors and Omissions coverage, unless your entity has no law enforcement activities. There is a minimum deductible of$1,000 for Law Enforcement. The Errors and Omissions minimum deductible is based on the size of your entity. 3. The Pool Board of Directors has approved a PACKAGE CREDIT to all fund members who purchase both worker's compensation and liability coverages from the pool. The credits, if applicable, are shown in the PACKAGE CREDIT column for each coverage and deductible option. The liability contributions for the options you choose will be reduced by these amounts. 4. Other deductible options may be available in addition to those shown. There is also an aggregate stop loss program available for some deducible options. If you are interested, please contact the Pool or AmGRIP, Inc. 5. If you purchase Auto Liability coverage through the Pool, Auto Medical Payments coverage will be included at no additional charge, subject to a limit of$25,000 per person, for all vehicles with a design capacity of six passengers or less. If you want to purchase medical payments coverage on vehicles that have a capacity of more than six passengers it can be provided for a contribution charge. 6. When coverage is bound you will be billed for one quarter in advance. Subsequent billing will be quarterly thereafter. You should receive your first bill within four weeks of your binding date of coverage. If you pay the entire annual contribution in advance, your contributions will be reduced 3%. Background The Wylie Police Department has traditionally provided supplemental police patrols to Lake Lavon during the spring, summer, and early fall months. Financial Considerations The U.S. Army Corp of Engineers pays for the supplemental police patrols through the requested agreement. The police department budget reflects the costs of providing the supplemental patrols that are re-imbursed by the federal government. The supplemental patrol program enables the police department to provide services to areas that are already inside the city at no additional cost to the city or community. Legal Considerations There are no legal considerations that are applicable. Staff Recommendations Staff recommends approval of a resolution entering into a Cooperative Agreement with the U.S. Army Corp of Engineers to, provide supplemental police patrol. WHEREAS, The City if Wylie Police Department has in the past provided supplemental patrol and enforced City Ordinances, if applicable, on U.S. Government property which lies within the City Limits of Wylie; and, WHEREAS, The City is willing to provide such patrol and enforcement for the 1995 season (as specified in agreement) ; and, WHEREAS , The City Council desires to approve the City's providing such services and authorize the negotiation of an agreement, defining the terms and provisions of such service, and further authorizing the execution thereof by the City Manager; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, AS FOLLOWS: SECTION 1 The City of Wylie is hereby authorized to enter into an agreement with the U.S. Army Corps of Engineers whereby the Police Department will provide supplemental patrol and enforce City Ordinances, if applicable, on U.S. Government property, located with its City Limits on and around Lake Lavon. SECTION 2 The agreement shall provide that the City of Wylie Police Department shall be reimbursed for these supplemental patrols, at an agreed upon rate. SECTION 3 The City Manager is hereby authorized to negotiate such an agreement and to sign the same on behalf of the City of Wylie. Fees in the interlocal agreement cover the lodging of prisoners arrested for Municipal Class C Offenses. The county lodges prisoners arrested for Class B Offenses and above with no charge to the city. Background The Wylie Police Department lodges prisoners arrested on Municipal Class C Offenses in the Collin County Jail when the prisoners are suicidal, or self-destructive. Additionally, prisoners arrested in Collin County for Wylie Municipal Court Warrants are sometimes booked into the Collin County Jail before being transported to the Wylie City Jail. Historically, the county jail has charged the city for the lodging of the prisoners held on Municipal Class C charges. Financial Considerations Collin County charges $55.00 per day, for each inmate. During fiscal 1994 we paid $110.00 to the county for 2 days lodging of prisoners who were lodged on Municipal Class C offenses. Legal Considerations The agreement covers liability responsibility assigning the county as agent for the city, and making the city responsible for medical and other additional charges. If your agency currently uses our facility to board inmates on City charges or, wants the capability of doing so in the future, this agreement is required. Sections 11.02 and 16 of the attached agreement need to be executed by your City and sent to me for execution by the County Judge. I will send you a copy of the completed agreement.
