Background Mr. Nance is currently constructing Mill Creek Crossing Subdivision which is located on Stone Road directly across the street from this 77.036 acre tract. He has been asked by several prospective buyers in this new subdivision and surrounding area to rezone his property across the street. The current zoning is not desirable (especially the MF and R) to ;these homeowners and the properties surrounding this area are zoned residential with one "Public" zoning (Community Park). A residential zoning is in compliance with the City's Comprehensive Plan's Land Use Map. Board/Commission Recommendations The Planning & Zoning Commission recommends approval of this zone change. Background Mr. Heath's entire property consists of the Windmill Trading Post which is a used furniture business, two office buildings and mini storage buildings in the back. This B-2 zoning would bring his entire property in compliance. Mr. Heath is interested in leasing out his facilities to retail type businesses and has considered building more mini warehouses. Board/Commission Recommendations The Planning & Zoning Commission recommends approval of this zone change. Staff Recommendations City Staff recommends approval of this zone change, however be aware that Hwy. 78 is a major corridor into Wylie and the B-2 zoning allows may uses that are more industrial in nature which may not be desirable at this location. ITEMS: To the Mayor and City Council: • The following agenda items are related to the grant recently awarded to the city for Water and sewer improvements in the old downtown sector of the city. The grant was awarded by the Texas Department of Housing & Community Affairs under its 1995 Community Development Program. Under the rules of the program, cities receiving these funds arc required to comply with all state and federal laws regarding equal QJ portunity. These laws prohibit discrimination on the basis of race,national origin, religion,color, sex,age familial status and/or physical and mental handicap. Agenda Item: Public hearing to discuss issues relating to handicapped persons as required by Texas Department of Housing and Community Affairs grant guidelines. This hearing is to examine policies and practices involving handicapped perons. Especially important is noting past complaints about handicap accessibility, if any; and responding to any future complaints quickly and thoroughly. Improving handicap persons mobility and general ability to function fully and easily should be a serious concern of all citizens. Please discuss your own ideas on how this might be done. :The following items are good places to focus discussion: * Building or facilities for physical accessibility * Employment * Complaint processing procedures • • Agenda Item Consider resolution establishing a complaint/grievance procedure for services funded by the Texas Department of Housing and Community Affairs grant guidelines. Background This Plat was submitted and approved previously by the Planning & Zoning Commission on May 17, 1994 and by the City Council on May 25, 1994. Due to a mix up between the surveyor and Richard Lane, time ran out and they had to resubmit. The home on Lot 3 encroaches the property line of Lot 4. To accommodate this mistake, Richard lane requests an Amended Final Plat which would add 10' to Lot 3, and lessen the lot sizes of Lots 4-7 by approximately 3' each. This would still allow Lots 3-7 to be in compliance with the SF-3 zoning requirements. The North Central Texas Council of Governments has developed a mutual aid for disaster assistance plan. The costs of this plan is $500 and will require that the city pay an additional $500 should a member city have a disaster, and F.E.M.A. does not reimburse the member cities expenses. This mutual aid plan will provide: 1. Back up communications and a back up emergency operations center. 2. Provide assistance from a central contact point. 3. Help reduce the onslaught of unneeded resources and provide the resources requested. 4. Will be responsible for maintaining an up to date contact list for all member cities. 5. The required procedures to qualify for F.E.M.A. disaster reimbursement funds. Background 1. Although the City of Wylie has been very aggressive in the development of the Emergency Operations Center, This will provide a effective back up system in the case of total devastation. 2. Past incidents have shown that during a disaster coordination of resources must be a priority and initially there is too much and several days later there is too little. This system should help alleviate this problem. 3. In the event of a catastrophic disaster the City of Wylie will require assistance from neighboring cities in equipment as well as manpower. Legal Consideration NCTCOG has provided a mutual aid agreement for all member cities included in this section. This agreement has been developed to establish a central response point for all NCTCOG cities either in need of or willing to provide assistance during a natural or other disaster. The City of Dallas Emergency Operations Center (EOC) will act as the coordinating agency for all responses in the NCTCOG area. Dallas will keep up-to-date lists of the names, phone numbers and other pertinent information necessary to quickly contact the appropriate person(s) in participating cities. Why Have An Agrec,menf? This agreement was developed after noting the deficiencies in coordinating the response to the Lancaster and DeSoto tornadoes last year. In reviewing this agreement with your city council, please keep the following factors in mind: 1. The agreement should be viewed as a method to provide your city a quick and efficient way to ask for and receive help, especially if your own communication facilities have been compromised. The Dallas EOC is capable of operating 24 hours a day, seven days a week. 2. The agreement will allow all cities wishing to provide assistance a central contact point. 3. The agreement will provide coordination to ensure a match of resources to needs. You will not be faced with an onslaught of unneeded assets but will be assured that someone will be working to get you the assets you do need. 4. The agreement will insure that up-to-date lists of contacts are maintained with each member city. Th,7 will save valuable time in the hours and days immediately following the disaster. In the case of Lancaster and DeSoto, a week passed before the cities met to begin a coordinated response using the Dallas EOC. 5. The agreement, as drafted, provides that member cities will bill the agency to which they respond for services. The Federal Emergency Management Agency (FEMA) requires this approach if a city is to receive reimbursement for monies spent in a response. In meeting with city managers, it was generally agreed to take this approach with the understanding that if a city provided aid to a city that experienced a disaster, it would bill for services rendered but would not pursue payment, especially if relief funding was not forthcoming from FEMA. 616 Six Flags Drive, Centerpoint Two P. 0. The actual time spent by Dallas coordinating the Lancaster and DeSoto relief equated to a cost of approximately $28,000. If 90 cities participate in this agreement, the resulting $45,000 could last for several years depending on the number of disasters. 7. Signing the agreement does not obligate your city to respond. Steps for Implementation The agreement was prepared by University Park's City Attorney, Rob Dillard. His firm also serves a number of other cities in the Metroplex. The agreement has also been reviewed by the City of Dallas. 'Nhile everyone can probably suggest changes, it will be much easier if we just execute the agreement as proposed.
