MINUTES OF THE WYLIE CITY COUNCIL SEPTEMBER 19, 1995 CALL TO ORDER Mayor Jim Swartz called the meeting to order with the following Councilmembers present: Reta Allen, Cleo Adams, Joel Scott, and J. C. Worley. Steve Wright and John Mondy were absent. PROCLAMATION -JENNY ROAN'S 100TH BIRTHDAY Barbara Colburn, granddaughter of Jenny Roan accepted the Proclamation for her 100 year old grandmother. Mrs. Colburn expressed her appreciation to all who have honored her on her 100th birthday. PUBLIC HEARING TO CONSIDER CONCEPTUAL PLAN-PROPOSED PLANNED DEVELOPMENT OF BIRMINGHAM PARK BY WYLIE BILCO INC. Public Hearing was opened with no public response. Mike Collins, City Manager explained that due to no recommendation by Planning and Zoning, Council would not be able to take any action. Scott made the motion to pass the public hearing to another day certain, being October 24, 1995. Adams seconded the motion. Motion was passed unanimously. RESOLUTION 95-28 APPROVING THE FY 1996 COMMUNITY SERVICES FACILITIES CAPITAL IMPROVEMENTS PLAN AND THE FY 1996 MULTI-YEAR PLAN UTILIZING THE 4B SALES TAX Collins explained that there is a major long term issue that should be considered when considering for approval the FY 1996 Community Services Facilities Capital Improvement Plan and the FY 1996-1998 Multi-Year Plan. The project budgeted would be the Community Center, the Library Expansion, and the Central Park Complex. Collins stated by bringing this before Council, it will enable the planning to go forward. Worley made the motion to pass the resolution. Allen seconded the motion. Motion was passed unanimously. STAFF REPORT Collins stated that Wylie Bilco would be meeting with staff. Collins will give an update on the conceptual plan for the Service Center and at the October 10th Council meeting. Collins also stated that at the October 10th Council Meeting, Physicians Regional would be making a presentation and give Council an update on the hospital. Collins stated that a new secretary for the City Manager's office, Barbara Salinas would be starting October 3rd. ADJOURNMENT As there was no further business to come before Council for consideration, the meeting adjourned. C. Worley. Steve Wright was absent. MINUTES OF AUGUST 22, AUGUST 29 AND SEPTEMBER 12, 1995 Scott made the motion to approve the minutes. Allen seconded the motion. The motion was voted on and passed unanimously. RESOLUTION NO. 95-29 DECLARING SEPTEMBER 25-30TH AS WYLIE PIRATE WEEK Scott made the motion to approve the resolution declaring September 25-30, 1995 as Wylie Pirate Week. Adams seconded the motion. The motion passed unanimously. RESOLUTION NO. 95-30 DECLARING OCTOBER 9-14TH AS FIRE PREVENTION WEEK Fire Chief Shan English introduced the new mascot for the fire department "Sparky" the fire dog. Sparky will be used during Fire Prevention Week to educate children on Fire Safety. English gave Council an overview of the activities planned for the week. Adams made the motion to approve the resolution declaring October 9-14 as Fire Prevention Week. Worley seconded the motion. The motion passed unanimously. HEAR PETITIONS FOR VOLUNTARY ANNEXATION Mike Collins, City Manager stated that due to last minute information from the City Attorney, Richard Abernathy, this item was pulled from the agenda. A meeting with the City Attorney, City Manager and property owners would be scheduled later in the week. RESOLUTION NO. 95-31 CALLING FOR A PUBLIC HEARING TO ANNEX SPECIFIC PROPERTY ALONG THE FM 544 CORRIDOR Mondy made the motion to approve the resolution calling for a public hearing. Worley seconded the motion. The motion passed unanimously. PUBLIC HEARING REGARDING THE PROPOSED 1995-1996 OPERATING BUDGET Collins gave a brief overview of the proposed 1995-1996 Operating Budget. The Public Hearing was opened and closed with no public response. ORDINANCE NO. 95-22 OF THE CITY OF WYLIE, ADOPTING A BUDGET AND APPROPRIATING RESOURCES FOR FISCAL YEAR 1996, BEGINNING OCTOBER 1, 1995 AND ENDING SEPTEMBER 30, 1996; REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE Adams made the motion to adopt the budget for FY 1995-1996. Mondy seconded the motion. The motion was passed unanimously. ORDINANCE NO. 95-23 FIXING THE TAX RATE AND LEVY IN AND FOR THE CITY OF WYLIE, TEXAS UPON ALL TAXABLE PROPERTY IN SAID CITY OF WYLIE, TEXAS, FOR THE PURPOSE OF PAYING THE CURRENT EXPENSES OF SAID CITY OF THE FISCAL YEAR ENDING SEPTEMBER 30, 1996, AND FOR THE FURTHER PURPOSE OF CREATING A SINKING FUND TO RETIRE THE PRINCIPAL AND INTEREST OF THE BONDED INDEBTEDNESS OF SAID CITY; PROVIDING FOR A LIEN ON ALL REAL AND PERSONAL PROPERTY TO SECURE PAYMENT OF TAXES DUE THEREON; CONTAINING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE Collins stated that it was necessary to adopt the budget first before the tax rate can be adopted which would be necessary to support the budget. Worley made the motion to approve the tax rate. Adams seconded the motion. The motion was passed unanimously. ORDINANCE NO. 95-24 GRANTING A FRANCHISE FOR REFUSE COLLECTION, REMOVAL AND DISPOSAL WITHIN THE CITY OF WYLIE TO BROWNING-FERRIS INDUSTRIES; REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE Collins reminded Council that in May of 1995, Council awarded the contract to BFI. Council asked that the City Manager's office draft a contract. Brady Snellgrove, Finance Director, stated the award of this contract will necessitate the adoption of the ordinance. Mondy suggested that a meeting be set up with BFI to discuss the service being provided. Scott made the motion to approve the ordinance granting a franchise for refuse collection to Browning-Ferris Industries. Allen seconded the motion. The motion was passed unanimously. ORDINANCE NO. 95-25 ESTABLISHING FEES FOR THE RESIDENTIAL AND NON- RESIDENTIAL COLLECTION OF GARBAGE, TRASH, BRUSH AND RECYCLABLE MATERIALS; AMENDING SECTION 9 OF APPENDIX A TO THE WYLIE CITY CODE; AMENDING PORTIONS OF ORDINANCE 93-42 AND FURTHER REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A PENALTY CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE Collins stated that since the franchise was granted a rate schedule must be adopted in the form of an ordinance. Mondy made the motion that the ordinance be approved. Scott seconded the motion. The motion was passed unanimously. STAFF REPORTS Collins stated that there is a problem with the new fire truck. Paul Storey, District Manager with Freightliner stated that it had been brought to his attention that the wrong chaise was placed on the City of Wylie truck. He assured Council that he would check on the details of this problem. Collins stated that Freightliner Corporate is not taking responsibility but that the Orlando dealer was responsible. Collins and Storey will be in contact with the dealer to rectify the problem. Collins stated that Wylie Bilco contacted his office requesting a meeting with him. Gregg MacLean, consulting Engineer for The Hogan Corporation stated that a pre- construction meeting would be held for Cooper and Regency Parkway on Monday. CITIZENS PARTICIPATION BART PEDDICORD, 114 DOUGLAS DR. - Concerned about the conditions surrounding the animal shelter. He stated he was appalled about the high weeds and area near the shelter. Mayor Jim Swartz Susan Shuler, City Secretary In Bid t u i 29' Issue Consider a Recommendation for awarding the final contract for paving, drainage, water and sewer improvements for the Premier Business Park. Background At this time the Development Corporation of Wylie has recommended award of contract to the second low bidder, JRJ Paving based on a recommendation by the Hogan Corporation. The low bidder on the project was East Texas Construction. At the time of recommendation, insufficient/unfavorable background information was received for East Texas Construction. East Texas Construction is currently trying to provide additional information which may affect the decision on final award of contract by council. Staff Recommendations The Development Corporation of Wylie and The Hogan Corporation recommend award of contract for Premier Business Park to JRJ Paving. Womack,Executive Director Dear Mr. Yeager: On August 30, 1995,at 3:00 PM, sealed bids for the above referenced project were received at the office of the Purchasing Agent for the City of Wylie,opened and publicly read aloud. The Hogan Corporation has compiled a detailed item by item breakdown of the bids and checked the extensions of the items bid. No errors were detected that would affect the order of the bidders. The apparent low bidders on this project were East Texas Construction and JRJ Paving,Inc.. A"Bid Summary"with a detailed breakdown is attached for your reference. The Hogan Corporation has requested and received pre-qualification information from the two low bidders on this project, including references,bonding information,current work load, etc. We have reviewed the information supplied,and we have also endeavored to seek references from others not listed on the material provided. We offer the following observations: 1. Both contractors appear to have the financial stability and bonding capacity to perform the work as specified. 2. None of the references supplied by East Texas Construction Co. returned our calls. Therefore, we cannot comment on those references. 3. All references supplied by JRJ Paving,Inc. indicated that they were pleased with past performance and would have no hesitancy in using JRJ on future projects. 4. We have also contacted others not listed on the reference sheets supplied by the Contractor. In the case of JRJ Paving,Inc.,no negative comments were received. However,several items of concern were discovered with regard to East Texas Construction. Specifically, it was reported that East Texas Construction has shown a tendency to argue over bid quantities, request change orders,and dispute specifications. 5. We have had a chance to observe some of the workmanship of both contractors. On a current project in McKinney,Texas,East Texas Construction has had serious problems with the installation of storm sewer. The work displayed was not acceptable to the City of McKinney and would not be accepted by Wylie either. McKinney is making them reconstruct the line. JRJ Paving,Inc. has performed work in the City of Wylie in the past. Projects include Birmingham Street and parts of the new high school. We have contacted Latimore Materials,one of the major concrete suppliers in the area,and they have indicated that they have a lien against East Texas Construction for materials supplied this year. Karen Fitzgerald in the Credit Department has indicated that Latimore would probably not provide concrete to East Texas Construction for this size project. The only other supplier in the area is Bodin Concrete in Rowlett,and the City has concerns as to the quality of product provided in recent months on other projects. Therefore, in light of the information referenced above,The Hogan Corporation recommends that the Development Corporation of Wylie strongly consider recommending to City Council award of the contract to the second low bidder,JRJ Paving,Inc. The bid form and contract documents provide the following stipulation: "The right is reserved, as the interest of the OWNER may require, to award a contract for this project to a qualified low bidder, or to reject any and all bids and to waive any informality in the bids received." Please advise us to your recommendation to Council on this matter. We will be present at the next regularly scheduled meeting of the City Council of Wylie to answer any and all questions regarding this matter. Background The portion of the Thomas Street box culvert project performed by Thomco Construction is now complete. A final walk through was conducted on this project on September 13, 1995 and representatives from the City, The Hogan Corporation and Thomco Construction, Inc. were present. The contractor has performed the required work as shown on the plans and specifications satisfactorily and no deficiencies have been identified. Financial Considerations Pay Estimate No. 2 is for $5,206.50 and the retainage amount for final payment is $2,225.00 for a total of $7,431.50. Background The police department currently dispatches in rotation the wrecker or wreckers required to satisfy any call or request for wrecker service from citizens or from police officers. The city is currently using the services of Joe Bellows Wrecker Service and Anderson Wrecker Service. The maximum impound rate is currently $10.00 and the request is for a rate increase to $15.00. Legal Consideration Ordinance 93-17, Section IX(f) passed March 9, 1993 allowed the wrecker services to charge the maximum of$10.00 to impound a vehicle per day. The state now allows for a maximum of$15.00 to be charged. Both wrecker services also contract with the sheriff's department and other area police departments, which are allowing for the $15.00 per day charge. Financial Consideration The city would see no financial gain from changing this ordinance. Background The plans and specifications for the Utility Relocations along SH 78 have been complete for some time, and have been awaiting the acquisition of right-of-way by the Texas Department of Transportation (TxDot) for the proposed widening of SH 78 from Sachse to FM 544 in Wylie. TxDot has now acquired all of the rights- of-way needed to proceed with the construction of this project. The plans for the New 20-Inch Water Transmission Main from the NORTEX Ground Storage Tank to the New Elevated Storage Tank have also been complete for some time, but right-of-way and easement acquisition on some sections of the project have delayed construction of this project. At this time, the New High School near the intersection of FM 544 and FM 1378 does not have adequate water service and they will soon be in need of fire protection for the new facilities. The New High School is relying entirely on the New Water Transmission Main to provide all water service. The portion of the New 20-Inch Water Transmission Main Project along FM 544 from Westgate Way to. the New High School can be constructed without the need for additional right-of-way or easement acquisition. When completed it will provide adequate fire protection for the New High School even though the entire project is not complete. In the best interest of cooperation with, and service to the Wylie Independent School District (WISD), City Staff and the Engineer recommend breaking out the portion of the water transmission main project from Westgate Way to the New High School and bidding it along with the Utility Relocations along SH 78 project to provide water service to the high school as quickly as possible. The remainder of the water transmission main project will be bid and constructed as soon as the required rights- of-way and easements can be acquired. Financial Consideration This modification to, and re-packaging of projects can and will be done at no additional cost to the City of Wylie. Furthermore, the projected cost of construction for these projects and future projects will not be adversely affected.
