Issue
Discuss and Consider award of the contract for the construction of a new 20" Water Transmission Main and
Paving & Drainage Improvements in association with the extension of Westgate Way from the Westgate
Subdivision to FM 544.
Background
Sealed bids were opened and read aloud on June 14, 1996. The apparent low bidder on these projects was
East Texas Construction Company. The Hogan Corporation has evaluated the bids and checked the low
bidders' qualifications. A detailed breakdown of bid prices and alternate bid items is attached to aid Council
in evaluating the various options. Greg MacLean will be present at Council to explain the bids received,
answer any questions, and recommend award of contract.
In order to incur the least amount of confusion and inconvenience to the property owners, the contractor will
be required to comply fully with the terms and conditions as specified in the Contract documents. These
items will be addressed at the preconstruction meeting and required of the contractor:
1. Submit a detailed construction sequence plan including traffic control and project schedule for review
by the Engineer and Staff. The traffic control plan must allow access to all businesses and properties
adjacent to the project at all times.
2. Coordinate through City Staff a meeting with the adjacent businesses and property owners to discuss
the proposed plan and schedule and make adjustments if necessary.
3. Prepare a form letter of notification to be used to inform affected businesses of any construction
related activities which may affect access. This letter must be reviewed by staff prior to issuance.
4. Deliver letter of notification to affected parties 48 hours in advance of specified construction activity.
A copy must be simultaneously submitted to the City and Engineer.
5. Notify the City's Inspector as soon as possible as to any changes or problems which may affect the
progress of the project.
6. Prepare the monthly pay request and review it with the City Inspector prior to submittal to the
Engineer for further processing.
7. Coordinate with Staff and the Engineer monthly progress meetings to be held at the site to review
monthly progress and discuss any changes or problems.
8. Fully comply with all other aspects of the Contract Documents.

Financial Considerations
Financing for these two projects will be provided by funds from the 1995 Bond Package.
$160,000 for the railroad crossing was not included in the bid. This cost was omitted because Kansas City
Southern Railway Company (KCS) will have to contract the work. There was no point in making the
contractor be the middle man between the City and Kansas City Southern when we can deal with the KCS
directly.
Part A-20"water main along the future Westgate Way *pro-rated bond projection was $206,080.00. The
actual cost of this project is $181,808.92, with the difference being $24,271.08 or 11.78% under the bond
budget.
Part B - Westgate Way paving and drainage original bond budget projection for construction of 1/2 the
street, including the railroad crossing signalization was $747,217.00. The actual cost of construction for
both sides of the street , including the railroad crossing signalization is $629,574.51, with the difference
being $117,642.49 or 15.74% under the bond budget.
*Original bond projections were based on a different construction sequence. The dollar number has been
pro-rated to reflect the new construction sequencing.

Dear Mr. Collins:
On June 14, the City received and publicly opened a total of twelve bids for the above
referenced projects. The bidding documents were arranged in two parts, corresponding to
the water transmission main portion and the paving& drainage portion, and bidders were
allowed to submit on either or both parts. The apparent low base bid for the 20-inch
Water Transmission Main(Part A)was submitted by East Texas Construction Co., Inc. in
the amount of$157,808.92. The apparent low bid for the Westgate Way Paving&
Drainage Improvements was also submitted by East Texas Construction Co., Inc. in the
amount of$424,574.52. A copy of the detailed bid tabulation is attached for your review
and reference.
After the bids were opened, The Hogan Corporation reviewed each bid package for
completeness, format, and accuracy. No mathematical errors in the extension of line items
were detected which would alter the order of the bids. We have solicited qualification
information from the apparent low bidder, and contacted references. We have not
obtained any information which would indicate the low bidder is incapable of performing
the work. East Texas Construction Co., Inc. has performed successfully on two projects
in the City of Wylie within the last year, including the Premier Business Park, and the New
Service Center Site Work.
The Hogan Corporation hereby recommends award of both Part A(20-inch Water
Transmission Main) and Part B (the Westgate Way Paving& Drainage Improvements)to
East Texas Construction Co., Inc. for the total bid for Parts A& B in the amount of
$582,383.44.
With your authorization, we will prepare construction contract documents for execution
by the City and contractors. We appreciate this opportunity to provide engineering
services to the City of Wylie, and look forward to presenting and discussing the details of
this bid with the City Council at the next regularly scheduled meeting.

Approval of Ordinance Amending fee Schedule- Street and Alley Abandonments
Issue
Discuss and Consider approval of an Ordinance amending the Fee Schedule for assessment of street or
alley abandonments.
Background
The issue of street/alley abandonments was brought before the City Council in December of 1995. Mr.
Richard Parker owned a tract of land in the Railroad Addition which was located South of Hwy. 78 between
Third and Fourth Street, with Oak Street bordering the South property line. At that time there was an
unimproved alley that contained no utilities. This alley ran down the middle of his property, and Mr. Parker
was requesting an alley abandonment to make the property more desirable to prospective
buyers/developers.
This issue will also relate when Hwy. 78 is finally widened. Due to the layout of medians and distance
restrictions by the Texas Department of Transportation (TxDot) there will be many streets that will no longer
have access onto the Highway. This will leave small strips of roads that are not proper cul-de-sacs and
have no real use. There may be property owners who will wish to have these old rights-of-way abandoned
for parking lot expansion or other developmental uses.
The City of Wylie has no set policy regarding procedures or fees to be assessed. Staff surveyed area cities
(see attached), and based on their information, has concluded that our street or alley abandonment
procedure should be as follows:
The applicant requesting the abandonment must submit a written request with the Community Development
Department. If more than one property owner is involved, the applicant must have a written agreement from
all property owners involved. An internal evaluation will be completed to determine if the City will
recommend abandonment of the alley. A review will be conducted to check for miscellaneous utilities in
the alley. If any utility lines are found in the alley, the property owner(s) will be required to donate a utility
easement for the existing lines. The City will complete an appraisal (this cost will be charged back to the
applicant) and the applicant will be assessed fair market value for the alley property. If more than one
property owner is involved, the alley will be divided to the abutting property owners in proportion to their
abutting ownership. This division between owners must be made in an equitable manner, according to State
Law. The request will be forwarded to the City Council for formal approval. The abandonment takes place
through an Ordinance or Quit-Claim Deed.

Financial Considerations
The applicant will be charged for the fair market value of the property as established by an appraisal,
including the actual cost of conducting the appraisal. The money will be placed in Street Capital Funds for
improvements and purchases of streets and/or alleys.
Legal Considerations
Under State Law, cities are precluded from giving property away. Cities must, under Section 272.001 of the
Local Government Code, obtain an appraisal to establish fair market value. The City is then not allowed to
convey, sell, or exchange that land and those interests for less than the fair market value of the land or
interest.
Staff Recommendations
Staff recommends approval of an Ordinance amending the Fee Schedule for assessment of alley
abandonments.

the price may be lessened). The abandoned alley area is divided
evenly among property owners. The request goes before Council
and the abandonment takes place through an Ordinance or Quit-
Claim Decd.
Plano Have all property owners involved agree to the abandonment. An
internal evaluation is done to determine if the City wants to give up
the alley. Check with utility companies for services in alley. The
applicant would then have the alley appraised and a fee based on
the fair market value would be charged. (Under State law, cities are
precluded from giving away property). Make sure the alley property
is split equally if other properties are involved. The request goes
before Council and the abandonment takes place through an
Ordinance .
Alien Have all property owners involved agree to the abandonment, An
internal evaluation is done to determine if the City wants to give up
the alley. Check with utility companies for services in alley. If there
are utilities in alley, the property owners must donate a utility
easement in the same spot as the alley. Allen does not have any
fees associated with this procedure. They just give it to the property
owner. The request goes before Council and the abandonment
takes place through an Ordinance .
Rowlett When a request is received, it is sent to the Consulting Engineer for
review to evaluate if the City has reason to give up the alley, and to
determine if any utilities are located within the alley. The applicant
would then have the alley appraised and a fee based on the fair
market value would be charged. The request goes before Council
and the abandonment takes place through an Ordinance or Quit-
Claim Deed.
Richardson The applicant must submit a written request to Development Services.
This would go before Council to determine if the City wants to give up
the alley. The applicant would then have the alley appraised and
again submit the request with a check for the assessed value of the
alley. The Development Services Dept. checks with the various utility
companies to determine if any services lie within the alley, then
forwards the request to Council. The alley would then be abandoned
through an Ordinance or Quit-Claim Deed.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING
APPENDIX"A" OF THE WYLIE CITY CODE (WYLIE FEE SCHEDULE) BY
ADDING SECTION 43.00 RIGHT-OF-WAY ABANDONMENT FEE;
PROVIDING FOR A PENALTY CLAUSE; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Staff has undertaken a review of its existing fee schedule and
structure and determined that certain new fees be added; and,
WHEREAS, The City of Wylie currently does not have a fee for the abandonment
of right-of-way and has determined there is a need for said fee; and,
WHEREAS, State Law requires that the proceeds from the sale of right -of-way
must be used to improve or purchase property for similar purposes, the funds would be set
aside for accordingly; and,
WHEREAS, the City Council has reviewed the suggested addition to the fee
schedule and determined that the same should be adopted and put into effect by the
adoption of this ordinance; and,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, as follows:
SECTION 1
That Appendix"A" of the Wylie City Code be, and it hereby is, amended to add as
follows:
§ Section 43.00 Right-of-Way Abandonment Fee
Under State Law, cities are precluded from giving property away. Cities must, under
Section 272.001 of the Local Government Code, obtain an appraisal to establish fair
market value. The City is then not allowed to convey, sell, or exchange that land and
those interests for less than the fair market value of the land or interest.
SECTION 2
Any person violating the provisions of this ordinance, or any part thereof, commits
an unlawful act and shall be subject to the general penalty provisions of the Wylie City
Code as set forth in Section 1-1.06, therein, as the same now exists or is hereafter
amended and shall not be allowed their permit, privilege, or license to which the fee
pertains.
SECTION 3
Should any paragraph, sentence, sub-division, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole or any part or provision thereof, other than
the part or parts as declared to be invalid, illegal, or unconstitutional.
SECTION 4
This ordinance shall be in full force and effect from and after its adoption by the
City Council and publication of its caption as the law and the City Charter provide in such
cases.
SECTION 5
That all other ordinances and code provisions in conflict herewith are hereby
repealed to the extent of any such conflict or inconsistency and all other provisions of the
Wylie City Code not in conflict herewith shall remain in full force and effect.
SECTION 6
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance,
shall not be construed as abandoning any action now pending under or by virtue of such
ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any
penalty accruing or to accrue, nor as affecting any rights of the municipality under any
section or provision of any ordinances at the time of passage of this Ordinance.

Board Appointments
Issue
Discuss and Consider Appointments to the Ambulance Advisory Board, Construction Board, Library
Board, Parks and Recreation Board, Parks and Recreation Facilities Dev. Corp. Board, Planning and Zoning
Board and Zoning Board of Adjustments.
Background
The City Council has created boards, commissions and committees to help carry out the functions
and obligations of the city. The City Council has prescribed the purpose composition, function, duties,
accountability and tenure of each board, commission and committee. A description of each board or
commission and their members with expiring terms are listed as follows:
The Ambulance Advisory Board consists of three members who meet on an "as needed" basis and
advise Council on ambulance services. The members whose terms expire are Robert Fults and
Cathy Sukkar. Linda Hamar has agreed to serve until Presbyterian Healthcare is in operation. At
that time she recommended selecting the emergency room director. Kenneth Don Quisenberry,a
Wylie resident and paramedic for the City of Mesquite has also requested to serve on the board.
The Construction Code Board consists of seven members who meet on an "as needed" basis to
review building code requirements. Plumbing, contractor and electrical experience is helpful.
Currently the board only has four members. The members whose terms expire are Brian Chaney
and Roger Smith. Mr. Chaney has stated he does not want to serve any longer. There has been no
response from Mr. Smith. The applications that have been received at this time are Brent Bates (a
contractor), James A. Smith (currently serving on the Zoning Board of Adjustments), Jim Chaney
(a plumber and brother to Brian Chaney), Terry Moore and Mr. Tim McGlothin (second choice).
Library Board consists of seven members who meet on the 2nd Monday of every month and advise
Council on library services and programs. The members whose terms expire are Elizabeth Allen,
Cathy Bridges, Gerry Whitt and Jerri Smith. Jerri Smith has declined to serve. Elizabeth Allen, Gerry
Whitt and Cathy Bridges have stated they would like to serve again. We have received two new
applications, Dora Blue (second choice) and Leo E. Houck (first choice).
Parks and Recreation Board consists of seven members which meets on the 4th Monday of every
month and advises the Council on acquisitions, maintenance, operation and use of parks,
playgrounds, and open spaces. The members whose terms expire are Jerry Hougen, Janet Lamb,
Tena Sorrelis and Terry Ayre. Janet Lamb has declined to serve. The applications received to date
are Tena Sorrelis, Terry Ayre, Jerry Hougen, Dora Blue (first choice), Bodie Coker, Tim McGlothin
(first choice), Matthew Conte (second choice), Richard Eckman (second choice - currently serving
on P&Z), Ronald Potts (second choice), Jimmy Tanner and Lynn Witter.
Parks and Recreation Facilities Dev. Corp. consists of seven members which meets on an "as
needed" basis. The purpose of the Corp. is to authorize the expenditure of 4B Sales tax funds for
projects approved by the City Council. This board consists of four members from Council, one
member from the Park Board, one member from the Library Board and one citizen. Currently the
board is comprised of four Councilmembers, two members from the Park Board and one member
from the Library. The members whose terms expire are John Mondy, Jerri Smith, Jim Swartz and
Steve Wright. There will be two members that are vacating their appointment, Steve Wright and Jerri
Smith. In the past the representative from the Library and Park Board have been the chairperson.
The Library Board will not meet until July 8, 1996 to select a new chairperson.
Planning and Zoning Board consists of seven members that meets the 1st and 3rd Monday of every
month to review rezoning applications, subdivision plats and site plats and advises Council regarding
comprehensive planning issues. The members whose terms expire are Richard Eckman, Tim Owen,
Bart Peddicord and Cecilia Wood. All members are willing to reserve. The new applications received
are Denise Mays (second choice), Matthew Conte (first choice), Tim McGlothin (third choice), Dora
Blue (fourth choice), Ronald Potts (first choice) and Brent Bates (second choice).
Zoning Board of Adjustments consists of five members and two alternates who meet on a "as
needed" basis to consider applications for variances to zoning ordinance regulations. The board
hears appeals regarding determinations of the Zoning Administrator, and considers action concerning
non-conforming uses. The members whose terms expire are Marilyn Herrera, Jeff Payne and
alternates Robin Messer and Emily Hartwig. Jeff Payne is moving and will no longer be able to
serve. Marilyn Herrera and Emily Hartwig have stated they would like to serve again. There are two
new application Denise Mays (third choice) and Ken Ryburn (second choice).
Financial Considerations
The board, commission and committee members are not compensated by the city as stated in the
City Charter under Article 8, Section 3 B. These members are strictly volunteers from the community.
Legal Considerations
Under Article 8 of the City Charter, the City Council has the right to create, establish or appoint
boards, commissions and committees as it deems necessary to carry out the functions and obligations of
