Zoning Case No. 2002-04. Executive Summary The applicants are requesting a change in zoning from the Single Family Residential (8.5/17) District to the Commercial Corridor(CC)District. The nine-platted lots are held in two ownerships as well as the public street and alley rights-of-way,and totals approximately 1.6 acres. The principal applicant(Teague)owns all of Lots 1 through 7 which front Ballard Avenue,and intends to use Lots 5, 6, 7,and half of Lot 4 for 'i new dental office. Ms. Manson stated that in 1995, the City of Wylie annexed a large area of land, generally located along F.M. 544 in the western portion of the City. However, due to a error in a legal description, 52.3 acres bounded by Muddy Creek on the west, F.M. 544 on the north and Sanden on the east was never officially annexed into the City as earlier believed. The property includes two businesses and agriculatural uses. Should the City Council approve the proposed annexation, the property will be zoned as BC(Business Center). The Mayor then opened the Public Hearing and asked that anyone wishing to speak either in favor or against said annexation request to please come forward and state their name and address for the record and limit their comments to three minutes. With no response,the Mayor then closed the Public Hearing. Ms. Manson announced that although an additional Public Hearing was also advertised for this evening, it could not be held due to action that had not been taken by the City of St, Paul. Staff was notified that the parcel of land referred to as the WISD Tract consisting of 48.643 acres of land and advertised for a Public Hearing for consideration of annexation had not been released by the City of St. Paul, therefore the City of Wylie could take no action. Ms. Mindy Manson, Assistant City Manager addressed this item, providing a brief background on the voluntary request for annexation and explained the procedures followed in accordance with state law. She stated that the request for voluntary annexation had been submitted by the owner of the above referenced property, William C. Collins, Jr. Two Public Hearings were conducted at the June 10 and June 11 Council meetings and should the City Council approve the proposed annexation, the property will be temporarily zoned as A(Agricultural)until permanent zoning is established. Councilman Hogue made a motion to approve the Ordinance annexing all of a certain 34.036 acre tract out of the A. Atterberry Survey, Collin County, Texas; and generally located west of F.M. 544. Consider and act upon approval of the revised Rita and Truett Smith Public Library's Internet Use Policy to meet CIPA(Children's Internet Protection Act)requirements. These changes are necessary for the Library to continue to receive ERATE funding. Minutes of July 9,2002 Wylie City Council Page 3 Ms. Mignon Morse,Library Director was present to address this item providing Council with a brief background on the intent of the proposed Policy. She stated that the American Library Association(ALA)announced that a Federal Court has ruled that CIPA(Children's Internet Protection Act)requirements for filtering in public libraries are unconstitutional and that under CIPA, libraries that are covered must review their existing Acceptable Use Policies to make sure that they conform to the Internet Safety Policy requirements of the Act. These sections have been specifically assigned to local decision-making. The following items listed below are the issues that the Library's Acceptable Use Policy must include to meet CIPA requirements with notations underneath each issue that refer to the Library's policy: Access by minors to inappropriate matter on the Internet and World Wide Web; The safety and security of minors when using electronic mail, chat rooms, and other forms of direct electronic communications; Unauthorized access, including so-called "hacking, ansl other unlawful activities by minors online;Unauthorized disclosure,use,and dissemination of personal information regarding minors;and Measures designed to restrict minors'access to materials harmful to minors. There was some discussion regarding current use and monitor of terminals. It was clarified that this was a rewrite of the existing policy in order to meet the guidelines for continued funding and that the concerns are focused on all internet access in public view. Ms. Morse stated that the library currently provides four terminals,all facing the circulation desk in clear view of thepublic She also stated that everyone under the age of 18 must have parents authorized signature in order to access the Internet. Councilman Young made a motion to approve the revised Rita and Truett Smith_Public Library's Internet Use Policy to meet CIPA(Children's Internet Protection Act)requirements. Background The Final Plat under consideration is for the Lake Trails of Bozman Farm Addition,includes 50.32 acres and will create 104 single-family residential lots and 4 common areas. The subject property is the initial development phase of the larger Planned Development(PD 2001,51),which consists of a mixed use development of Single Family Residential of varying densities, a Village Center with Multifamily Residential and Community Retail, a school site, and common open spaces. The Concept Plan approved by the City Council as part of the Planned Development(PD 2001-51) on December 11,2001 serves as an approved Preliminary Plat. The subject development will comply with all ofthe applicable requirements set forth in the conditions ofthe PD 2001-51. The PD is in the process ofbeing revised in order to add land to the Development plan,and the proposed revisions are a portion of the entry road(Collins Boulevard)for the current Plant under consideration. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipality unless it is disapproved within that time period" Financial Considerations Plat application f€eslnave been paid. The applicant isaware that development impact fees must be paid prior to issuance ofa'building permit on each lot. Other Considerations 1. The Final Plat substantially confonnato the approved Concept Plan ofthe Planned Development PD 2001-51 and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. Collins Boulevard will be constructed to provide access to the subject property. A portion of Collins is located outside of the subject Plat on property recently annexed into the City and scheduled to be incorporated into the Planned Development District. Proposed changes to the PD do not negatively affect the proposed Plat. Board/Commission Recommendation At the July 2, 2002, Planning and Zoning Commission meeting, the Commission voted 5-0 to recommend approval of this Final Plat. Staff Recommendation Approval. July 23, 2002 Issue Consider and act upon a Replat for the 78 Corner Addition,Lots 1R and 2R,Block A,being a Replat of the Walgreens-Wylie Addition, Lots 1 and 2,Block A,being all of a certain 6.076 acre tract of land as described in a deed to LSI Development,Inc. as recorded in Cabinet N,Page 378 of the Deed Records of Collin County, Texas, and a portion of that certain tract of land conveyed to Collin County as recorded in File No. 2001-0100218 of the Deed Records of Collin County,Texas,and being situated in the S. B. Shelby Survey, Abstract No. 820, City of Wylie, Collin County, Texas. Background The Final Plat for the Walgreens-Wylie Addition was approved by the City Council on June 26, 2001, and subsequently filed as a plat of record,creating a multi-tenant retail center totaling 5.422 acres but did not include the abandoned Kansas City Southern Railroad ROW. The subject Replat will add this 0.654 acre of railroad ROW land in order to provide access to State Highway 78. The Replat also renames the Walgreens-Wylie Addition to the 78 Corner Addition. This action will increase the size of Lot 1R (Walgreens retail store)from 1.793 acres to 1.861 acres and Lot 2R from 3.629 acres to 4.215 acres. When the Final Plat was approved and recorded,the zoning for this site was Industrial(I)District, and the earlier platting vested the development rights ofthe Industrial District.However the Official Zoning Map was revised by Council action on November 13,2001 changing the zoning to Commercial Corridor (CC) District. The replatting of this tract requires that all future development comply with the requirements of the Commercial Corridor District,as well as other revisions to the code approved since the initial platting. The Plat provides primary access from Cooper Drive, as well as an access easement from State Highway 78. This access easement also provided common access for future development of Lot 2. I July 23, 2002 Iccue Hold a public hearing and consider a recommendation to The City-Council regarding a change in zoning from Single.Family Residential(SF S.5/17)to-Corridor-Commercial(CC)District,being Lots 1, 2, 3,4, 5, 6, 7, 8, and 9B of Block 34 out ofthe Railroad Addition, City of Wylie, Collin County, Texas. Zoning Case No. 2002-04. Background The applicants are requesting a change in zoning from the Single Family Residential(8.5/17)District to the Commercial Corridor(CC)District. The nine platted lots are held in two ownerships as well as the public street and alley rights-of-way, and totals approximately 1.6 acres. The principal applicant (Teague) owns all of Lots 1 through 7 which front Ballard Avenue, and intends to use Lots 5, 6,7,and half of Lot 4 for a new dental office. There are no plans for the use of the remainder of Lot 4 and Lots 1 through 3,except that the applicant desires development on these lots to be compatible with the dental office. All of these lots are currently vacant, but have been previously occupied by single-family residences. The remaining Lots 8 and 9B are owned by the Birmingham Trust, and are occupied by a single single-family residence and detached garage. The property abutting Lot 9B to the northwest(Lots 9A and 10)is zoned Commercial Corridor(CC) District and is occupied by a minor automotive maintenance use. The property to the west across Jackson Street is zoned Commercial Corridor(CC)and occupied by a restaurant. Properties in the southwest corner of Jackson and Calloway are zoned Commercial Corridor(CC)and are occupied by professional offices. Properties to the south across Calloway Street are zoned for Commercial Corridor uses, and the lot on the east fronting Ballard is occupied by a single-family residence while the lots on the west fronting Jackson are vacant. Properties to the north are zoned Commercial Corridor and are occupied by a retail use. Properties to the east across Ballard are zoned Multi- Family Residential(MF)District and are occupied by single-family residences and apartments. Public Comment Forms were mailed to forty-three (43) property owners within 200 feet of this request. Three Comment Forms,representing fourteen ofthe notified parcels,have been returned,all favoring the requested rezoning. Financial Considerations Zoning Application Fee—Paid Other Considerations 1. The Comprehensive Plan recommends that the subject property be developed as Mixed Uses complimentary with the Historic Downtown District. The proposed change in zoning is consistent with this recommendation of the Plan, as the Commercial Corridor District allows a broad mix of various compatible land uses. 2. The subject lots, as well as abutting streets and alley,were created by the Railroad Addition,one of Wylie's original and oldest subdivisions, and the properties have been zoned and used for residential uses for a number of years. In December of 2001, with the adoption of the revised City-wide Zoning Map,the zoning on the property was changed from Single Family-3 (SF-3)to Single Family-8.5 Residential District, and the Zoning Ordinance does not permit nonresidential uses such as the proposed dental office within the SF-8.5 District. 3. The requested change in zoning will expand and reconfigure the Commercial Corridor District which fronts State Highway 78 and currently surrounds on three sides the residentially zoned subject property. The applicant originally requested rezoning of a portion ofthe subject property to the less intensive Neighborhood Services District in order to develop the proposed dental office,but staff interpreted the creation of such a limited and isolated district to be illegal"spot zoning" and recommended expansion of the contiguous Commercial Corridor District. The applicant subsequently gained ownership of a larger portion ofthe subject property,thereby better assuring control of compatible development on neighboring tracts. 4. Ballard Avenue has been improved,including underground storm water drainage. Calloway and Butler Streets are older asphalt paving with open ditch surface storm drains. The alley between Ballard and Jackson is unimproved, but contains public water and sewer services as well as private as and electric services. 5. The accompanying Conceptual Site Plan illustrates the proposed development for the dental office (including a tabulation ofhow the quality development points will be achieved),and this Site Plan shall be considered part of the development requirements for the subject property. The applicant has petitioned the City Council for abandonment of the unimproved alley between Ballard and Jackson Streets in order to utilize the area as the rear entry drive and parking as shown on the Plan. With the exception of the proposed use of this alley access as parking,the Plan satisfies all requirements of the current Zoning Ordinance. It is also likely that Butler Street will be abandoned between S.H. 78 and Ballard, as a result of the State's widening and improvement of S.H. 78. At their July 2, 2002 review, the Planning and Zoning Corpinission stipulated that landscape screening be added along Calloway Street to screen the office from the residential property to the south. 6. The existing lots must be replatted in order to create the future lot for the proposed dental office. Because the property has been zoned for residential purposes within the past five years,approval of this replatting will also require a public hearing. Board/Commission Recommendation At the July 2, 2002, Planning and Zoning Commission meeting, the Commission voted 5-0 to recommend approval of the zone change. A Concept Site Plan was approved by the Commission with the stipulation that landscape screening be added along Calloway Street. Staff Recommendation Approval. The request conforms to the recommendations-of theCompprehensive Plan and encourages the rational transition of the immediate area from the current vacant and residential to compatible nonresidential uses.
