All matters listed under the Consent Agenda are considered to be routine by the City Council and will
be enacted by one motion. There will not be separate discussion of these items. If discussion is desired,
that item will be removed from the Consent Agenda and will be considered separately.
A. Approval of the Minutes from the Council Retreat on November 9, 2002 and the Regular City
Council Meeting on February 25,2003.
B. Consider and act upon authorizing the City Manager to execute and award a contract to Binkley
& Barfield, Inc., in the amount of$15,000 for engineering services related to the reconstruction
of approximately 3,000 linear feet of alley paving located south of Stoneybrook Drive.
C. Consider and act upon authorizing the City Manager to execute and award a contract to The
Hogan Corporation,in the amount of$12,000 for engineering services to establish the alignment
for the the future Twin Lakes Outfall Sewer.
D. Consider and act upon authorizing the City Manager to execute a contract with ROWAC,Inc.in
the amount of$60,300 for right-of-way acquisition services for the Alanis paving project.
E. Consider and act upon approval of an ordinance amending the Manuals for the Design of Storm
Drainage Systems,Water and Sanitary Sewer Lines and Thoroughfare Standards and Standard
Construction Details to add dimension for angled parking spaces and one-way drive aisles.
F. Consider and act upon the approval of an ordinance amending the Subdivision Regulations as
approved by the Wylie City Council on February 25,2003.

The meeting convened at 10:30 a.m. Those present were John Mondy, Joel Scott, Reta
Allen, Chris Trout, Eric Hogue and Merrill Young. Staff present were Biff Johnson and
Mindy Manson.
1. Residential Rental Property Inspections
The first item of discussion was the concept of inspecting residential rental property and
the issuance of Certificates of Occupancy each time the tenant changes. Biff Johnson
explained that the intent was to inspect for safety and health standards in order to curb
urban blight and enhance public safety.
The Council requested that example ordinances be brought forward, as well as the pros
and cons of implementing the code. The Council also requested that clear standards and
procedures be set. Biff Johnson indicated that this would be brought before the Council
before the first of the year.
2. Park Naming Policy
Staff updated Council regarding 3 new parks that have not been formally named and
asked if Council would like to establish a policy for naming the parks. Several different
criteria were discussed. Council directed staff to bring forward examples of other
policies from other communities.
3. Residential Density/Country Residential Districts
The Council discussed possible alternatives to the country residential areas as shown on
the Comprehensive Land Use Plan. Alternatives discussed included trade-offs of some
higher density for park and open space — have the open space be concentrated, rather in
the side and rear yards of the lots. Council requested that staff bring forward different
options that would not compromise the original intent of the Land Use Plan. The Council
also asked that staff identify the process that should be followed for public involvement.
4. Annexation
The City Manager asked the Council if they were willing to do involuntary annexation.
The general consensus was that, on occasion and depending on the circumstances,
involuntary annexation may be necessary. The Council was very concerned about the
"donut holes" within the City. The Council also discussed meeting with the City
Attorney to help identify annexation policies.
5. Website
The Council requested that their home addresses and phone numbers be removed from
the website, while keeping their e-mail addresses. A request was also made that new,
professional pictures of the Council need to be taken.
6. Collin County Bond Election
Chris Hoisted joined the meeting at this time to update the Council on the status of the
County Bond Election and the potential local projects. The Mayor talked about the
meetings with the transportation committee and the discussions that had occurred
regarding the amount of funding available to each community, and the associated local
matches.
7. General Discussion
The Mayor asked the Council if staff needed particular direction, or if there were specific
goals that needed to be focused on. There were no items identified.
Other general discussion included the need for a Facilities Plan which would identify the
needs, time frame, and funding mechanisms for future municipal facilities. Council also
requested a status on bond projects.

Mayor Mondy called the meeting to order at 6:00 p.m. with the following Council Members present,
Joel Scott, Reta Allen, Eric Hogue, Merrill Young, J.C. Worley, and Chris Trout.
The following Staff Members were also present, City Manager, Biff Johnson; Assistant City Manager,
Mindy Manson; Finance Director, Brady Snellgrove; City Engineer, Chris Hoisted; Planning Director,

Council Action
Councilman Worley requested that Item B —The resignation of Councilman Scott-be removed from the Consent
Agenda for further discussion. Councilman Trout asked for clarification on the open space under the power lines
in Item E—Preliminary Plat for Wyndham Meadows Addition. Planning Director, Mr. Thompson stated that the
area would be maintained by the homeowners association. Councilman Worley made a motion to approve the
Consent Agenda with Item B removed. Councilman Trout seconded the motion. A vote was taken and passed, 7-0.
Council Discussion
Councilman Worley expressed gratitude to Councilman Scott for his work on the Wylie City Council. Mayor
Mondy and the rest of the Council concurred and wished Councilman Scott well in his future endeavors.
Councilman Scott expressed appreciation to the Council.
Council Action
With no further discussion on Item B, Councilman Worley made a motion to accept the resignation of Councilman
Joel Scott. Councilman Young seconded the motion. A vote was taken and passed, 6-1, with Councilman Scott
abstaining.

1. Hold a Public Hearing to consider and act upon a change in zoning from Corridor Commercial
(CC) District to Multi-Family Residential (MF) District, generally located north of Centennial
Drive between Eubanks Lane and Spring Creck Parkway, being all of a 12.393 acre tract of land
described as Lot 1,Block B of the Woodlake Village Addition,City of Wylie,Collin County,Texas.
(Zoning Case 2002-14)
This item was tabled from the November 12, 2002 and the January 28, 2003 Council Meeting. Councilman
Hogue made a motion to untable, seconded by Councilman Young. A vote was taken and passed,7-0.
Staff Comments
Mr. Thompson addressed Council on this item. He stated that the tract of land that is proposed for zoning
change is approximately 2800 feet long and 180 feet deep. Mr. Thompson explained that the applicant has
provided additional information as requested by Council concerning an Environmental Assessment of the site
and a Conceptual Plan. He stated that the Environmental Assessment concluded that there was no negative
impact on the property if zoned for residential uses.

Developer Comments
Ben Medero, Arapaho East, Inc. addressed Council stating that the proposed development met the
requirements of the City. He stated that the development could be conformed to meet the desires of the
Council.
Council Discussion
Councilman Scott inquired if the proposed development would be 100%masonry. Mr. Medero stated it would
be 75- 100 %brick. Councilman Scott inquired if there would be a market for apartments being located so
close to a railroad track. He asked the applicant if a retaining wall would be provided to screen the railroad
and if the property owner would be liable for any accidents that should occur. Mr. Medero stated that a wall of
any kind could be built.
Councilman Scott asked for clarification on govern,nent subsidy as related to this project. Mr. Medero
explained that funding was similar to E4 or Fannie Mae funding.
Councilman Young asked if the railroad was a single or double track. City Engineer, Chris Holsted stated that
the track was currently single.
Councilman Trout questioned the possibility of realigning Cen:cnnial Drive to allow for the proposed property
to be adjacent to the Municipal Complex vs. the railroad a-acks. Staff stated that this is a possibility that could
be researched further if directed by Council.
Councilman Worley clarified that the parcel of land being proposed was currently zoned for Commercial
Corridor and that if approved, this parcel would be the only one in the surrounding area not zoned
Commercial Corridor. Mr. Thompson confirmed.
The Mayor clarified that if the proposed zone change was approved, it would be in opposition of the
Comprehensive Zoning Plan. Mr. Thompson confirmed.
With no further discussion,the Mayor opened and closed the public hearing with no citizens participating.
Council Action
Councilman Worley made a motion to deny the request for zoning change. Councilman Young seconded the
motion. A vote was taken and passed, 6-1,with Councilwoman Allen in opposition.
2. Hold a public hearing to consider and act upon adoption of the revised Subdivision Regulations.
Staff Comments
Mr. Thompson addressed Council on this item. He explained that the amendments to the Subdivision
Regulations were largely procedural with respect to submitting plans for subdivisions and the financial aspects
using escrow funds. He stated that subdivision platting would be required for proposals within the City's ETJ
(extra-territorial jurisdiction). He also stated that a site plan review would be required with the preliminary
plat.
Council Action
The Mayor opened and closed the public hearing with no citizens participating. Councilman Scott made a
motion to approve the revised Subdivision Regulations. The motion was seconded by Councilman Worley. A
vote was taken and passed,7-0.
3. Hold a public hearing to consider and act upon the annual review of the Standards of Care for
Youth Programs as adopted by Ordinance 2000-7.
Staff Comments
Mr. Bill Nelson,Parks&Recreation Superintendent, addressed Council on this item. He explained to Council
that an annual review of the Standards of Care was required by the state for recreational programs
administered by the City.Mr. Nelson told Council that the Standards of Care were the same as last year's with

no revisions. He specified that the Standards of Care required criminal background checks on all employees.
He also stated that monthly reports would be provided.
Council Discussion
The Mayor inquired if this document would apply to a YMCA administering a program in the City. Mr.
Johnson stated that it was specific to the Wylie Wave program.
Council Action
The Mayor opened and closed the public hearing with no citizens participating. Councilman Young made a
motion to approve the Standards of Care. Councilman Worley seconded the motion. A vote was taken and
passed,7-0.
4. Presentation of the annual report of Wylie Police Department Contact Data (Tier 1) for 2002, as
required by the Texas Racial Profiling Law(S.B.No. 1074).
Staff Comments
Lieutenant Davis, WPD, addressed Council on this item. He told Council that the Racial Profiling report was
compiled by criminologist Alex del Carmen, PhD. He stated that the report found the Wylie Police
Department to be in compliance with SB 1074 with no problem areas noted.Lt. Davis reported that the Wylie
Police Department was graded an A by the ACLU(American Civil Liberties Union).
Council Discussion
The Mayor inquired about the ad in The Wylie News informing citizens to register complaints with the Police
Department. Mr. Johnson stated that this was standard practice to register complaints first with the Police
Department followed by the City Manager,and Council if necessary.
Council Action
No Council action was required for this item.

Issue
Consider and act upon authorizing the City Manager to execute and award a contract to Binkley&
Barfield, Inc., in the amount of$15,000 for engineering services related to the reconstruction of
approximately 3,000 linear feet of alley paving located south of Stoneybrook Drive.
Background
The 1999 Bond identified alley improvements throughout the city, which included reconstruction
south of Stoneybrook Dr. and east of Willow Way in the Westwind Meadows subdivision located on
South Ballard. The existing alley pavement is approximately 4-inches thick and is rapidly
disintegrating due to the heavy trash trucks. City forces have replaced some of the worst sections of
paving, however, the entire alley south of Stoneybrook Dr. requires reconstruction. The proposal
includes design and bidding phase services.
Financial Considerations
A summary of the funding sources is shown below

Construction of the alley will be bid on a unit cost basis and staff will prioritize the sections of alley to

CITY OF WYLIE
ENGINEERING SERVICES AGREEMENT
This agreement is made and entered into by and between the City of Wylie, Texas, a municipal
corporation, hereinafter referred to as "CITY" and Binkley& Barfield, Inc., hereinafter referred
to as "ENGINEER". The terms of this Agreement shall be administered on behalf of the City
by its City Engineer or his designated representative.
WITNESSETH: The CITY hereby contracts for the services of ENGINEER to prepare
construction plans, specifications, details, and special provisions for: 3000 (+ -) linear feet of
alley reconstruction, south and north and parallel to Stoneybrook Street, located in the City of
Wylie, Collin County, Texas, hereinafter called the "PROJECT".
I. EMPLOYMENT OF THE ENGINEER
The City agrees to retain the Engineer, and the Engineer agrees to perform professional
engineering services in connection with the Project as set forth in the paragraphs
following; and the City agrees to pay, and the Engineer agrees to accept fees as specified
in the paragraphs following as full and final compensation for the work accomplished.
II. SCOPE OF SERVICES
The scope of the work is set forth in Exhibit A, attached to and made part of this
Contract. Deviations from the scope of work may be authorized from time to time by the
City by written authorization.
I. SCHEDULE OF WORK
The Engineer agrees to begin work immediately upon execution of this Contract and to
proceed diligently with said work to completion, as described in Exhibit B, attached
hereto. •
IV. COMPENSATION AND METHOD OF PAYMENT
Payment to the Engineer for services rendered will be made monthly based upon the
Engineer's monthly progress report and itemized and certified statements on an invoice
form that is acceptable to the City, detailed to show the names of employees, time
worked, actual work performed and actual rates. Monthly statements should include
authorized non-salary expenses with supporting itemized invoices and shall be submitted
to the City on or about the fifteenth(15) day of each month.
Compensation for the services of the Engineer will be as set forth in Exhibit C, attached
hereto.
The itemized and certified statements shall show the total amount earned to the date of
submission and the amount due and payable as of the date of the current statement. Final
payment of any money due shall be made to the Engineer after satisfactory completion of
all services and obligations covered in this contract, including acceptance of design by the
City, and submittal of as-built drawings.
V. INFORMATION TO BE PROVIDED BY THE CITY
The City agrees to furnish the information set forth in Exhibit D, attached to and made a
part of this Agreement,prior to the Engineer's beginning work.
VI. PROGRESS REPORTS
The Engineer shall submit monthly progress reports and attend monthly progress
meetings scheduled by the City. Each report shall outline work accomplished and special
problems or delays encountered on the Project during the previous report period, and the
planned work activities and special problems or delays anticipated for the next report
period.
VII. INSURANCE
The Engineer agrees to furnish, if requested by the City, a certificate reflecting Engineer's
Workman's Compensation and Employer's Liability Insurance for bodily injury and
property damage in amounts satisfactory to the City, and agrees that such coverages shall
be maintained during the term of this Contract. The Engineer shall be responsible for
determining that its subcontractors, where permitted, likewise carry and maintain
adequate insurance coverages.
VIII. LIABILITY
The Engineer will and does hereby agree to indemnify and hold harmless the City from
any and all damages, loss or liability of any kind whatsoever, by reason of injury to third
persons occasioned by any negligent act, error or omission of the Engineer, its agents,
employees for other person from whom the Engineer is legally liable, in rendering or
failing to render professional services with regard to the performance of this Agreement.
The Engineer will, at his cost and expense, defend and protect the City against any and all
such claims and demand arising out of negligent performance of the Engineer, its agents,
employees or other persons for whom the Engineer is legally liable, in connection with
work performed under this Agreement.
IX. INDEPENDENT CONTRACTOR
In the performance of work or services hereunder, the Engineer shall be deemed an
independent contractor, and any of its employees performing work required hereunder
shall be deemed solely employees of the Engineer, or its subcontractors where permitted.
X. SUBCONTRACTS
In fulfilling its duties pursuant to this Contract, the Engineer may subcontract to
individuals, corporations, organizations, governments or governmental subdivisions or
agencies, partnerships, associations or other legal entities. Such subcontracts will be
entered into only with written approval from the City.
XI. TRANSFER OF INTEREST
Neither the City nor the Engineer may assign or transfer their individual interests in the
Contract without the written consent of the other party. The City and the Engineer each
binds itself and its successors and assigns to the other party with respect to all covenants
of this Contract. Nothing herein is to be construed as creating a personal liability on the
part of any officer or agent of the City.

XII. AUDITS AND RECORDS
At any time during normal business hours and as often as the City may deem necessary,
the Engineer shall make available to representatives of the City for examination all of its
records with respect to all matters covered by the Contract and will permit representatives
of the City to audit, examine and make excerpts or transcripts from such records and to
make audits of all contracts, invoices, materials,payrolls, records of personnel, conditions
of employment and other data relating to all matters covered by this Contract, for a period
of one (1) year from the date of final settlement or for such other or longer period, if any,
as is required by applicable statute or lawful requirements.
XIII. EQUAL EMPLOYMENT OPPORTUNITY
The Engineer shall not discriminate against any employee or applicant for employment
because of race, color, religion, sex, or national origin. The Engineer shall take
affirmative action to ensure that applicants are employed, and that employees are treated
during employment, without regard to their race, color, religion, sex, or national origin.
Such action shall include, but not be limited to, the following: Employment, upgrading,
demotions or transfers, recruitment or recruitment advertising; layoffs or terminations;
selection for training, including apprenticeships; and participation in recreational
activities. The Engineer agrees to post in conspicuous places, available to employees and
applicants for employment, notices to be provided setting forth the provisions of this non-
discrimination clause. The Engineer will, in all solicitations or advertisements for
employees placed by or on behalf of the Engineer, state that all qualified applicants will
receive consideration for employment without regard to race, color, religion, sex or
national origin. The Engineer will cause the foregoing provisions to be inserted in all
subcontracts for any work covered by the Contract so that such provision will be binding
upon each subcontractor, excepting that the foregoing provisions shall not apply to
contracts or subcontracts for standard commercial supplies or raw materials. The
Engineer shall keep such records and submit such reports concerning the racial and ethnic
origin(s),of applicants for employment and employees as the law may require. The
Engineer agrees to comply with such rules, regulations, or guidelines as may be issued to
implement these requirements.
XIV. CONTRACT TERMINATION
Either party may terminate this Contract upon giving written notice to the other party at
least thirty (30) days prior to the date of termination. In the event of termination, the
Engineer shall deliver to the City all finished or unfinished documents, data, studies,
surveys, drawings, maps, models, reports, photographs, etc., prepared by the Engineer
under this Contract. The Engineer shall be entitled to receive just and equitable
compensation for any work satisfactorily performed in accordance with the provisions of
this agreement prior to termination.
XV. COST ESTIMATES
Cost estimates prepared by the Engineer represent its best judgement as a design
professional familiar with the construction industry. It is recognized, however, that the
Engineer has no control over the cost of labor, materials, or equipment, over the
Contractor's method of determining bid process, or over competitive bidding or market
conditions. Accordingly, the Engineer cannot and does not guarantee that bids will not
vary from estimates prepared by him.

XVI. OWNERSHIP OF DOCUMENTS
All documents, including original drawings, estimates, specifications, field notes and data
are and shall remain the property of the Engineer. The Engineer will provide a complete
set of 24"x 36" 3 mil reproducible Mylars of the completed drawings plus a 3-Y2" disk or
compact disk containing all construction plan sheets m a dwg format to the City at no
additional cost to the City.
XVII. SPECIAL PROVISION
This instrument contains the entire Agreement between the City and the Engineer, except
as additionally stated in Exhibits A and B.
XVIII. RIGHT-OF-ACCESS
The City will furnish right-of-access on the land for the Engineer to perform the required
surveys, or other necessary investigations. The Engineer will take reasonable precautions
to minimize damage to the land in the performance of such surveys and investigations.
The City will explain to landowners that some damage to vegetation may be unavoidable
when obtaining access to the site, and in performance of survey activities.
XIX. MAILING ADDRESSES
All notices and communications under this Contract to be mailed or delivered to the City
shall be sent to the address of the City as follows, unless and until the Engineer is
otherwise notified.

Basic Services:
The scope of services includes the civil engineering services reconstruction of 3000' (+ -) of alley
adjacent to Stoneybrook Street. The plans will be based on City aerial photographs and will not
include field surveys. The project will include bid documents (30 sets) and attendance at the bid
opening and pre-construction meetings. Plans will indicate alleys to be replaced, quantities, and
construction details. They will not have a profile grade. Plans will be on a 100-scale plan/plan
format.

Corporation, in the amount of$12,000 for engineering services to establish the alignment for the
future Twin Lakes Outfall Sewer.
Background
The City's Water and Sewer Master Plan identifies a 48-inch outfall sewer which would eliminate the
Twin Lakes lift station and convey sewer south to the new Muddy Creek Regional Wastewater
Treatment Plant. The proposed study will analyze three alternatives for the alignment taking into
consideration environmental concerns, existing and anticipated land uses and developments in the
area, and compatibility with other utilities or infrastructure. Cost projections will be prepared and a
preferred alignment will be identified which will enable the City to preserve the alignment corridor
and ensure future constructability of the sewer line as development occurs along the route.
Financial Considerations
$126,051 was included in the most recent wastewater impact fee update for the Twin Lakes Outfall
Sewer project and a portion of these funds will be used for the alignment study.

WORK ORDER NO.WYL-46
This will constitute authorization by the City of Wylie,Texas (Owner), for The Hogan Corporation,
Engineers-Planners-Consultants, Dallas, Texas (Engineer), to proceed with the following described
engineering services.
TWIN LAKES SANITARY SEWER ALIGNMENT STUDY
A. PROJECT DESCRIPTION
The Owner proposes to establish the alignment of the future Twin Lakes Outfall Sewer,
extending from the existing Twin Lakes Lift Station to the proposed NTMWD Muddy
Creek Regional Wastewater Treatment Plant. The Engineer will perform a study to
analyze the feasibility and cost-effectiveness of alternative alignments.
B. PRE-WORK CONFERENCE
The Engineer will meet with the Owner and other appropriate entities to discuss the City's
criteria, work program and schedule, procedures of communication, additional surveys,
assignments of personnel, and any other matters that may have a direct or indirect effect
upon the completion and results of this project.
C. SCOPE OF SERVICES
1. Create a digital base map of the study area from existing available digital files,
and/or digital map data furnished by the City. If the City elects to procure
surveying or aerial mapping services,coordinate with the City and their consultant
to establish the scope and criteria for the work.
2. Meet with City representatives to identify alternative corridors for the sewer,and
the appropriate factors that should be considered with each alignment, including
environmental concerns, existing and anticipated land uses and developments in
the area, and compatibility with other utilities or infrastructure. A maximum of
three alternatives will be analyzed.
3. Perform a field review of the selected alignment corridors, noting significant
physical features and obstacles. Locate the proposed routes on the study area
map, adjusting the recommended alignments as appropriate based on topography
and other observed features.

4. Prepare a construction cost projection for each alternative, and identify significant
Operation and Maintenance(O&M) variables for each alignment.
5. Prepare a brief letter report presenting the results of the study, including a
comparison of costs, and a discussion of the benefits and issues associated with
each alternative.
6. Submit a draft of the report to the City for review and comment. Meet with the
City to discuss their comments, and revise the report if/as needed. Submit ten
(10) copies of the final report.
D. BASIS OF COMPENSATION
1. Availability of Funds
The Owner agrees that funds, to the extent required, are currently available and
sufficient to complete all phases of the proposed engineering services authorized
under this Proposal. All invoices submitted by the Engineer and approved by the
Owner shall be paid within thirty (30) days of the invoice date. For any payments
not made within thirty (30) days, a charge will be made monthly in the amount of
one and one-half percent (1-1/2%) of the unpaid balance, beginning thirty(30) days
from the date of the statement.
2. Sanitary Sewer Alignment Study
a. Engineering
The Owner shall make payments to the Engineer for performing the
engineering services described in Section C on a monthly billing basis in
proportion to that part of the services proposed herein which has been
accomplished, as evidenced by monthly statements submitted by the
Engineer and approved by the Owner. Final payment shall be due upon
completion of these services.
The compensation for the engineering services performed shall be based on
a lump sum amount of$12,000.00.
b. Additional Services
If authorized in writing by the Owner, the Engineer shall furnish other
services or tasks in addition to the scope of services proposed herein. For
performing these special services, the Engineer shall be paid on a monthly

billing basis at a per diem rate of the personnel's Salary Cost times a
multiplier of 2.5, with the reimbursement of all direct non-labor and
subcontract expenses at the invoice cost plus 10 per cent for coordination
and handling.
G. TIME FOR COMPLETION
The study work to be performed, as authorized herein, is projected to be completed within
sixty(60)calendar days after receipt of digital map data or field survey information.

Background
The construction of Alanis Drive was identified as P1 in the 1999 Bond Program and included approximately
6,200 linear feet of 3-lane(1/2 of a 6-lane divided section)and the realignment of Alanis at SH 78 to intersect
with Sanden Blvd. The construction plans are approximately 80%complete and the right-of-way displays and
descriptions for the project have been finalized. Due to the time necessary for right-of-way acquisition, we
propose to use a third party for these services. ROWAC has acquired property for the City on various projects
including Kirby Street,Kirby/Stone connector,and the Rush Creek force main. Services they will provide for the
project include title research,acquisition and appraisals.

Dear Mr. Hoisted:
Thank you for considering ROWAC for the acquisition and appraisal related to the Alanis Paving Project.
We have inspected the project and understand the scope of professional services required and are
prepared to serve you as needed. Our staff is currently available to begin the project immediately. Our
review of this project indicates that there are 25 parcels;two of which are owned by the City of Wylie.
Following is list ofthe services we expect to perform in order to ensure the acquisition of the required right
of way in an efficient,professional manner.
ROWAC proposes to handle all aspects of the acquisition process. Therefore,this proposal is inclusive
of the foreseen services necessary to convey the necessary land rights to the City of Wylie. This project
will include the functions of title research, appraisal, acquisition, instrument generation,title clearing and
closing facilitation. For the purpose of this proposal,we will contract all necessary appraisal services on
an as needed basis withEvaluationAssociates who is very familiar with the appraisal ofpartial acquisitions.
Title Research
It is our understanding that the City will obtain title insurance on all of the parcels with the exception of
those that are simply corner clips and easements. ROWAC will coordinate obtaining title commitments
from a City of Wylie approved vendor such as Reunion Title in Wylie. Additionally, ROWAC will
coordinate the closing process with the property owners and the title company. On the parcels where title
insurance will not be obtained, ROWAC will obtain title abstracts; the cost of which is included in this
proposal. In each of these cases ROWAC will clear any title deficiencies noted as we have in the past.
Title clearing will be handled under Additional Services.
Acquisition
ROWAC proposes to perform the necessary functions needed to secure the required right of way land
rights by agreed compensation for the sum of$46,000 for the entire project. For the purpose of this
proposal, a parcel is defined as a contiguous tract of land owned by an individual ownership entity, i.e.

nuclear family,partnership or corporation. Fees associated with negotiating with additional interest holders
(tenants,attorneys,partners,other family members not authorized to convey title to the property,etc.)or
for the acquisition of additional tracts of land owned by the same entity will be billed under Additional
Services.
Basic Services required for this project will include ROWAC ordering all title commitments and abstracts,
ordering appraisals for various(8) parcels deemed necessary, soliciting donations from property owners
whose property will be enhanced*,making all contacts and negotiations withthe property owners,soliciting
signatures of owners ofrecord,and preparing the file for condemnation in the event it becomes necessary.
* Note that we believe that 15 of the affected parcels will be enhanced as a result of this project.
ROWACproposes to have our agents solicit donations from each of these 15 property owners during
the time that the appraisals are being prepared. This step will only be done if the City of Wylie
agrees that this project will benefit these 15 identified properties, and it will not slow down the
project.
Appraisal Services
Initially,we believed that we wanted appraisals for the following:
1. The floodplain parcels that are being bisected(4 parcels)
2. The two approximate one acre parcels being bisected and the long 6.1 acre Tibbals property
3. The Sellers property(large metal building)
4. The Foote and Frey property(40 acre SFR land)
However,the cost of the floodplain parcels is quite expensive compared to the land value. The cost would
be$5,000 for the first parcel and$2,700 for the additional three parcels as a group. Therefore, we are
recommending that we attempt to acquire these parcels with the land sales we have ready access even
though they are old sales and are considered stale. If we are not successful we can order the appraisals
as needed at a later date for the same price.
We do recommend ordering appraisals for the remaining five properties. This data will serve us well when
we are negotiating with the other owners who have properties with a similar highest and best use. The total
cost of the appraisal services being proposed is$14,300.
Additional Services
Additional services include communications and negotiations with third parties having other interests in the
same property which must be satisfied to convey unencumbered title,as specified by the City Attorney.
Such parties could include lienholders,taxing authorities,tenants and heirs. These services will be invoiced
on a time and materials basis at the hourly rate of$75 for Associates and $125 for Principals. It is not
possible to estimate the amount of title curative or additional services accurately. Other additional services

include those services not foreseen nor covered under Basic Services. Additional appraisal services,
county recording/copy fees,courier fees and excess mileage charges are also treated as additional services
and are billed at the actual expense.
Cost and Fees
ROWAC proposes to perform the services specified as Basic Services at a cost of$60,300 for the
project. This fee includes the appraisal of the five properties identified as being significantly impacted as
well as the cost of title abstracts for the ten parcels that will not be associated with title insurance due to
the lack of significant land tights being sought. The cost per parcel is just over$2,600 and there is the
potential that we may need additional appraisal services should property owners not be receptive to this
project.
For ROWAC's purposes,this proposal will suffice as a professional services agreement. Signing below
will signify that the scope of services outlined in this proposal is agreeable, and we will begin work
immediately. Should a more formal agreement be required,we can submit one for your consideration or
will be pleased to execute yours. The City of Wylie may cancel this contract or stop work on this project
at any time, for any reason. Fees and charges accrued to that point will be invoiced on the basis of
milestones or actual time spent working on the project to the date of termination.

Construction Details to add dimension for angled parking spaces and one-way drive aisles.
Background
New manuals for the design of storm drainage, water and sanitary sewer lines and
thoroughfares were adopted on January 22, 2002. The new manual defines the dimensions for
a 90° parking stall as 10-feet by 20-feet, however, the manual does not address the dimensions
for angled parking stalls. In general, angled parking stalls and one-way aisles are more
efficient, provide better circulation in large parking areas and reduce the average gross area
needed for parking per car. The proposed amendment defines angled parking dimensions as
9.5-feet wide by 18-feet deep with a 20-foot one-way drive aisle.

WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has
investigated and determined that it would be advantageous and beneficial to the citizens of the
City of Wylie, Texas ("Wylie") to amend Wylie Ordinance No. 2002-05 Engineering Manuals for
the Design of Storm Drainage Systems, Water and Sanitary Sewer Lines, and Thoroughfare
Standards and Standard Construction Details (hereinafter colectively referred to as the"Design
and Construction Standards"), revising Part 2 (Thoroughfare Design Standards) and the Standard
Construction Details.

Findings Incorporated. The findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2.
Amending Wylie Ordinance No. 2002-05, Design and Construction Standards, Part 2
(Thoroughfare Design Standards). The Design and Construction Standards, Part 2
(Thoroughfare Design Standards) is hereby amended to read as follows:

3) Each standard 90° off-street parking space shall contain not less than
200 square feet and measure not less than 10 feet by 20 feet, exclusive
of access drives and aisles, and shall be of usable shape and condition.
One-way angled parking shall contain not less than 171 square feet and
measure not less than 9.5 feet by 18 feet.
4) The width for two-way aisles shall be a minimum of 24-feet and a
maximum of 45-feet. The width for one-way aisles shall be a minimum
of 20-feet (24-feet if the aisle is also a fire lane).
SECTION 3.
Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are
hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending
prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution
from being commenced for any violation if occurring prior to the repeal of the ordinance. Any
remaining portions of said ordinances shall remain in full force and effect.
SECTION 4.
Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be
declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided
that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie
hereby declares that it would have passed this Ordinance, and each section, subsection, clause or
phrase thereof irrespective of the fact that any one or more sections, subsections, sentences,
clauses, and phrases be declared unconstitutional or invalid.
SECTION 5.
Effective Date. This Ordinance shall become effective from and after its passage and adoption.

Consider and act upon the approval of an ordinance amending the Subdivision Regulations as
approved by the Wylie City Council on February 25, 2003.
Background
On February 25, 2003, Council approved the amended Subdivision Regulations. The ordinance will
allow the amendments to be implemented. These Subdivision Regulations establish the procedure for
the preparation, submittal, review, acceptance and recording of plats for the subdivision of land. The
Regulations define and/or reference other applicable regulations for the design of building sites and
the infrastructure and services required by those lots.

33 AS PASSED AND APPROVED ON THE 29TH DAY OF JULY, 1993,
TOGETHER WITH ALL AMENDMENTS THERETO; PROVIDING FOR A
PENALTY FORNTHE VIOLLATION OF THIS ORDINANCE;PROVIDING
FOR REPEALING,SAVING AND SEVERABILITY CLAUSES;PROVIDING
FOR AN EFFECTIVE DATE OF THIS ORDINANCE AND PROVIDING FOR
THE PUBLIICATION OF THE CAPTIONS HEREOF.
WHEREAS,the City Council of the City of Wylie desires to develop and maintain a healthy,safe and
efficient community, including a quality living environment and viable economic opportunities; and
WHEREAS, the sound regulation of land subdivision has been demonstrated as necessary to
achieving such a community, and Section 212 of the Texas Local Government Code authorizes
municipalities to adopt and administer rules governing subdivisions of land within its jurisdiction in
order to promote the health, safety, morals and general welfare of the municipality; and
WHEREAS,the City Council has determined that it is advantageous and beneficial to the citizens of
the City of Wylie to amend in its entirety Wylie's Subdivision Regulations Ordinance No. 93-33,
passed and approved on July 29, 1993, together with ali amendments thereto; and
WHEREAS,the City has complied with all prerequisite notification and public hearings as required
by Texas Law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1
The findings set forth above are incorporated into the body of this Ordinance as if fully set
forth herein.
SECTION 2
That the Subdivision Regulations of the City of Wylie, Ordinance No. 93-33,together with all
amendments thereto, is hereby amended in its entirety.
SECTION 3
That this Ordinance shall become effective immediately from and after its adoption and
publication as required by the City Charter and by law.
