Hold a Public Hearing to consider and act upon a change in zoning for a Special Use Permit (SUP) for Minor Vehicular (Boat) Repair within a Neighborhood Services (NS) District, located at 650 Country Club Road (F.M. 1378), being all of that certain 1.00 acre tract as described in a deed to Ronald J. Johnson, recorded in County Clerk's File No. 02-0077388, Deed Records of Collin County, Texas (DRCCT), and being part of a certain called 14.497 acre tract of land conveyed to Novid Properties, Inc., recorded in County Clerk's File No. 96-0076788, and being situated in the Charles Atterbury Survey, Abstract No. 22, City of Wylie, Collin County, Texas. (Zoning Case 2003-05) Executive Summary The applicant is requesting a Special Use Permit*(SUP)to operate a Minor Vehicle Repair(boats only)in a vacant retail building. The subject property was previously occupied by the Walker/Roper Fence Company,and is one acre in size. The building is approximately 4,560 sq.ft.faced with masonry on the street front and metal on the sides,as well as associated concrete parking and fenced open space which is partially paved and partially gravel.Plans are to utilize the building for minor repairs of boats and any boat parking and short-term storage will be behind the screen fence. The property has never been plated into an official lot of record.The applicant is aware that the property must be platted prior to issuance of Certificate of Occupancy. At the June 3,2003 Planning and Zoning meeting,the Commission voted 4-0 to recommend approval of the proposed zoning change with some stipulations. 2. Hold a Public Hearing to consider and act upon a change in zoning from Agriculture (A) and Townhouse (TH) to Planned Development (PD) District for Residential Uses, generally located west of Westgate Way and north of F.M. 544, being all of a certain 53.6 acre tract of land being comprised of parcels of land deeded to Wylie Realty Investments, L.L.C., recorded in Volume 5042, Page 2944 and in Volume 5007, Page 2266, and Tract 1 deeded to L.M.B. Partnership, Ltd. recorded in Volume 5159, Page 3104 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the E.C. Davidson Survey, Abstract No. 266, City of Wylie, Collin County, Texas. (Zoning Case 2003-06) Executive Summary The applicant is requesting rezoning of the subject property in order to permit development of a single-family detached residential neighborhood. The proposal is intended to continue the residential patterns established by the Westgate neighborhood to the north and the townhouse and apartment developments to the east, and to better address the property's adverse adjacency to the active railroad corridor. The Proposed Planned Development District includes a total of 53.6 acres of land, and is currently being consolidated under single ownership. At the June 3, 2003 Planning and Zoning Commission meeting,the Commission voted 4-0 to recommend approval of the proposed zoning change with some stipulations. 3. Consider and act upon appointments to the Construction Code Board, Library Board, Parks and Recreation Board, Parks and Recreation Facilities Development Corporation Board, Planning and Zoning Commission, Zoning Board of Adjustments and the Wylie Economic Development Corporation for those whose terms expire in July of 2003. Executive Summary Article 8,Section 1A of the City Charter authorizes the City Council to appoint members to serve on boards,commissions and committees to help carry out the functions and obligations of the City.The City Council has prescribed the purpose,composition,function,duties,accountability and the tenure of each board,commission and committee. 4. Consider and act upon approval of a Park and Park Facilities Naming Policy and a Park Memorial Policy Board. Executive Summary Currently,the City has no formal policy for the naming of City Parks or the facilities such as fields and pavilions contained within the parks. The park locations generally take on the names of the subdivisions in which they are located. The Park and Recreation Board recommend the adoption of a more formal policy to facilitate the process for existing and future parks and park facilities. 5. Consider and act upon a bid for the installation of an irrigation system in the Meadows of Birmingham Park. Executive Summary Competitive sealed bids have been solicited for the installation of an automatic irrigation system in the Meadows of Birmingham Park. The scope of the contract will provide for all materials,labor and equipment necessary to install the irrigation system on the 7.8 acre site.The bid invitation includes an alternate bid that would add bubblers to irrigate up to 48 trees in the park. 6. Consider and act upon a bid for the construction of concrete sidewalks in the Meadows of Birmingham Park. Executive Summary Competitive sealed bids have been solicited for the construction of concrete sidewalks in the Meadows of Birmingham Park.The scope of the contract will provide for all materials,labor and equipment necessary to construct 2,250 linear feet of 8 foot wide sidewalk in the park. 7. Consider and act upon a Resolution modifying the boundary between the City of Wylie and the Wylie Northeast Water Supply. Executive Summary Both the City of Wylie and the Wylie Northeast Water Supply have established areas of jurisdiction for the provision of water service that were established several years ago.The jurisdictional boundaries are identified through the Certificates of Convenience and Necessity(CCN)which are filed with the State.A portion of the WNE jurisdiction falls within the Birmingham Farms Subdivision with a randomly straight line due to the development of that subdivision.Staff has met with representatives of WNE in order to establish a logical split between the jurisdictions that made sense in terms of both service delivery and development process. 8. Consider and act upon the approval of a Resolution suspending the effective date of TXU Gas Distribution's requested rate changes. Executive Summary TXU Gas Distribution, a division of TXU Gas Company, filed a Statement of Intent to change gas rates in all municipalities within the TXU Gas Distribution System.With this filing,the company plans to consolidate the Pipeline and Distribution systems under a single set of rates.As with past rate filings,the City of Wylie has joined with area cities in a coalition in order to consolidate representation on rate cases,and cost. Approval of Resolution #2003-12®suspends the effective date of the proposed new rates,and consolidates the city with joint participation and authorizes intervention on behalf of the cities at the Railroad Commission. MINUTES Wylie City Council Tuesday, June 10, 2003 — 6:00 p.m. Wylie Municipal Complex—Council Chambers 2000 State Highway 78 North Mayor Mondy called the meeting to order at 6:00 p.m. with the following Council members present; Mayor Pro Tern Eric Hogue, Councilman Chris Trout, Councilman Merrill Young, Councilman J. C. Worley, Councilwoman Reta Allen, and Councilman Randal Shinn. The following staff members were present; City Manager, Biff Johnson; Assistant City Manager, Mindy Manson; Finance Director Brady Snellgrove; City Engineer, Chris Holsted; Public Information Officer, Mark Witter; City Secretary, Carole Ehrlich, Administrative Assistant, Aimee Nemer, and Planning Director, Claude Thompson. Consider and act upon the award of a contract for the construction of the Stoneybrook Alleys to Santos Construction in the amount of$287,482.30. C. Consider and act upon the award of a contract for the construction of the Newport Harbor Pump Station Additions to Cooper General Contractors in the amount of$112,600. Councilman Shinn asked that the following correction be made to Page 5, paragraph 2, of the May 27, 2003 minutes. The minutes should reflect that Councilman Shinn commented that he believed the City had the right to control the types of trees that were planted to eliminate any sewer or water line problems but if the homeowner choose not to plant a tree on his property, the homeowner had that right as well. With the above correction, Mayor Pro Tern Hogue made a motion, seconded by Councilwoman Allen to approve the consent agenda. A vote was taken and passed 7-0. Minutes—June 10,2003 Wylie City Council Page 1 1. Consider and adopt Ordinance#2003-11 establishing the Wylie Animal Shelter Advisory Board. Staff Comments Chief Butters addressed the Council stating that Chapter 823.005 of the Health and Safety Code require that the governing body of a municipality in which an animal shelter is located, appoint an advisory committee. The advisory committee must be composed of at least one licensed veterinarian, one county or municipal official, one person whose duties include the daily operation of an animal shelter, and one representative from an animal welfare organization. The advisory committee must also meet at least three times per year. Council Discussion Councilman Trout and Young were concerned about the requirement that a licensed veterinarian serve on the board. There was a question as to whether or not a licensed veterinarian was located in the City of Wylie. There was also some concern as to the terms of office for the board members. Ms. Manson stated that a state requirement would supercede the home rule charter and if there was not a licensed veterinarian located in the City limits that a licensed veterinarian from an outlying area could be used. Mr. Johnson stated that once the board was established by the council, the terms and any other concerns could be addressed by Council and staff. Council Action Councilman Trout made a motion, seconded by Councilman Worley to approve Ordinance #2003-11 establishing the Wylie Animal Shelter Advisory Board with the ordinance corrected to clearly define the veterinarian residence requirements and the board member terms. A vote was taken and passed 7-0. 2. Hold a Public Hearing to consider and act upon a change in zoning from Agricultural (A) to Planned Development (PD) District for Village Center Mixed Residential and Nonresidential Uses, generally located east of County Road 389 (Forrest Ross Road) and south of Skyview Drive and north of Kansas City Southern Railroad, being all of that certain 94.16 acre tract as described in a deed to Arapaho East, Inc. recorded in Vol. 5108, Page 1984, and being all of that certain 49.247 acre tract as described in a deed to Arapaho East, Inc. recorded in Vol. 4242, Page 1505, Deed Records of Collin County, Texas, except for those certain called 16.48 and 5.5 acre tracts conveyed to Kansas City Southern Railroad in October 1998, and being in total a 121.11 acre tract of land situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. (Zoning Case 2003-03) Staff Comments Mr. Claude Thompson addressed the Council stating that the applicant is requesting rezoning of the subject property in order to permit a master planned multi-use community, comprising of single family residential neighborhoods of varied densities and building types, retail uses and public open spaces. The proposal is intended to create a viable Village Center concept as defined by the Comprehensive Plan and through coordinated planning and design, better address several development constraints of the property and take advantage of its Lake Lavon adjacency. Public comment forms were mailed to (12)property owners within 200 feet of the proposed area and no property owners responded to the proposed zone change. At the May 20, 2003 Planning and Zoning Commission Minutes—June l0,2003 Wylie City Council Page 2 meeting, the Commission voted 3-2 to recommend approval of the proposed zoning change with stipulations that future Development Plans reflect more natural amenities and the interior properties reflect stronger relationship to the lake. The Park Board has reviewed the PD concept of utilizing Federal lands as open space and the Board recommended against the City of Wylie leasing such lands (as Corps lands can be used for low impact, passive recreation only) and not connecting the residences to these lands with trails. The Board further recommended against the planned dedication of lands near the retail center and recommends funds in lieu of land. Consultant/Developer Allen Bussell of Greg Edwards Engineering Services representing Arapaho East Inc. addressed the Council stating that he was proposing a Village Center neighborhood concept with 4 lanes of Park Boulevard, tree-lined streets with wide walk-able sidewalks connecting neighbor to neighbor. The lots would be smaller around the Village Center to larger lots extending further out from the Center. There would be a trail system connecting families to the park and neighborhood services. Infrastructure would be provided for water, sewer, and streets including Park Boulevard (Arterial) and Skyview (Arterial), with accessibility to Lake Lavon. Mr. Bussell opened the floor for questions. Council Discussion Councilman Trout inquired about the construction of trails. Mr. Bussell commented that they planned to keep the landscape as natural as possible. Councilman Trout asked if the development would have any amenity centers. Mr. Bussell stated that there would not be any amenity centers per say other than the Village Retail Center, but there would be open space with trails. Councilman Trout stated that developers typically request Planned Development zoning when the proposed development does not meet the City's established zoning. He stated that developers who request this zoning usually offer additional amenities to the community in lieu of meeting requirements. Mr. Bussell stated that the proposed plan does address open space with trails and the Village Retail Center. Mayor Mondy asked if there was a terrain limitation requiring the smaller lot size. Mr. Bussell stated that the reason for the small lots around the Village Retail Center were because it was a strange shaped property. Councilman Worley commented that he had concerns with the 1,000 square foot home size and the 15 foot front yard on the 4,000 square foot lots. Public Comments Mayor Mondy opened the public hearing. There was no one present to address the council. Mayor Mondy closed the pubic hearing. Council Action A motion was made by Councilman Young, seconded by Mayor Pro Tern Hogue to deny the Zoning change from (A)Agriculture to(PD) Planned Development. A vote was taken and passed 7-0. 3. Hold a Public Hearing to consider and act upon a change in zoning from Downtown Historic District (DTH) to Planned Development (PD) District for Mixed Uses including Indoor Commercial Amusements, located at 110 E. Oak Street, being Lot 7A, Block 18 of the Railroad Addition, City of Wylie, Collin County, Texas. (Zoning Case 2003-04) Minutes—June 10,2003 Wylie City Council Page 3 Staff Comments The applicant is requesting a Planned Development District (PD) in order to install and operate an Indoor Commercial Amusement(game room) within a building currently being used for retail sales, mail boxes and snack shop. The parcel is 0.055 acres (2,395 sq. ft.)and is totally covered by the building, with the only available parking on the public street. Plans are to utilize the eastern portion of the building as an entertainment center for video games and billiards. The subject property was originally created as part of the Railroad Addition, one of the oldest subdivisions in Wylie. There are currently broadly mixed configurations and uses in the vicinity,a number of which do not conform to current development codes. The subject building has apparently been in continuous use and not lost its vested rights as a Legally Nonconforming Structure therefore allowing the continued use without being renovated to current development codes. At the May 20, 2003 Planning and Zoning Commission meeting, the Commission voted 3-2 to recommend denial of the proposed zoning change. The Commission discussed approval with a stipulation to limit the number of games restricted to adults-only play, but failed to reach an acceptable number also agreeable to the applicant and voted to recommend denial. Staff concurs to denial. Due to the denial by P &Z, approval by the City Council will require a three-fourths (3/4)affirmative vote. Zoning Applicant Comments Norine Swanson, Owner of Purple Rain addressed the council. Ms. Swanson stated that she felt that the requirement for buildings in the Historical District have a certain front design had not been followed on the building in question leaving the building out of code. Ms. Swanson also stated that the parking area in front of her business had a total of seven parking spaces that belonged to her business and that she was only requesting one additional space. Ms. Swanson had addressed other issues pertaining to the zoning application process. Mayor Mondy requested that these issues be addressed with staff. Public Comments Bob Heath, owner of property located at 101, 102A, 106, and 108 Ballard Street addressed the Council. He stated that he had a concern with the type of adult machines that would be provided by Purple Rain. He also had concerns with parking areas utilized by other business owners and parking behind the buildings late in the evenings. Dick Sharman, 101 North Ballard addressed the Council. Mr. Sharman was opposed to the zoning change. He stated that the proposed machines would erode the concept of the downtown area and take away from the historical look and feel of the current business atmosphere. With there being no further public comments, Mayor Mondy closed the Public Hearing. Council Discussion Mayor Mondy commented that he would be in opposition to the zoning change and would be more open to family oriented businesses. Council Action Mayor Pro Tem Hogue made a motion, seconded by Councilwoman Allen to deny the Zoning change from Downtown Historic District(DHD)to Planned Development(PD). Consider and act upon acceptance of the Comprehensive Annual Financial Report after presentation by the audit firm of Pattillo,Brown&Hill Staff Comments Mr. Ron Hutchison addressed the Council. Mr. Hutchison presented the Comprehensive Annual Financial Report (CAFR) for the fiscal year which ended September 30, 2002, including the Independent Auditors' Report from the outside audit firm, Pattillo, Brown&Hill. He introduced Mr. Jim Curry from the audit firm to briefly discuss some of the year's highlights and answer questions the City Council may have regarding the report. Consultant/Auditor Comments Mr. Curry thanked the council for the opportunity to address the CAFR for Fiscal Year 2002-2003. Mr. Curry stated that the financial statements were the responsibility of the City of Wylie, Texas' management. The responsibility of Pattillo, Brown &Hill, was to express an opinion based on the financial statements provided. He stated that the audit was conducted in accordance with auditing standards generally accepted in the United States of America and the standards applicable to financial audits contained in Government Auditing Standards, issued by the Comptroller General of the United States. In the opinion of Pattillo, Brown&Hill,the financial position of the City of Wylie, Texas,as of September 30, 2002 and the results of its operations and the cash flows of its proprietary fund types for the year then ended conforms to the excellence required to qualify for the Certificate of Achievement for the fourteenth consecutive year and will so submit to GFOA for their consideration. Council Discussion Mayor Mondy addressed the Home Rule Charter in reference to the hiring of the City Engineer by the City Council. He asked if the Home Rule Charter stated that the City Manager, City Attorney, Municipal Judge, and the City Engineer were positions hired by the City Council,then should the City Engineer be mention on page 4, paragraph 3 of the CAFR or should the Home Rule Charter be amended. Council Young commented that the Home Rule Charter stated that the City Council, in consultation with the City Manager shall appoint a competent, duly qualified, registered and practicing professional engineer in the State of Texas who shall serve as city engineer. Mayor Mondy requested a breakdown on the 915 jobs reported under WEDC during the development of Premier Business Park reported on page 5, paragraph 1. The mayor requested a breakdown on the number of new or retained jobs. Council Action A motion was made by Councilman Trout, seconded by Councilman Young to accept the 2002-2003 Comprehensive Annual Financial Report. B June 24, 2003 Issue Consider and act upon a Final Plat for the Birmingham Farms Phase 14A and including a Replat of Lots 15-23,Block J,Birmingham Farms Phase 2A,being a certain 46.395 acre tract of land generally located south of the proposed Park Boulevard extension and east of Country Club Road(F.M. 1378), and including all of Lots 15-23, Block J of Birmingham Farms Phase 2A, as recorded in Cabinet N, Page 887 of the Plat Records of Collin County, Texas (PRCCT), and being situated in the Mercer Phalen Survey, Abstract No. 695, the D.W. Williams Survey, Abstract No. 1021, and the Charles Atterbury Survey, Abstract No. 22, City of Wylie, Collin County, Texas. Background The Final Plat under consideration is for the Birmingham Farms Phase 14A Addition, including the vacation and replat of Lots 15-23,Block J on Birmingham Farms Phase 2A. The property includes 46.395 acres and will create 138 single-family residential lots and 4 common areas/open spaces to be owned and maintained by the Homeowners Association. Lots 15-23,Block J of Birmingham Farms Phase 2A are being replatted as part of Phase 14A in order to extend Pickwick Lane north to Bessemer Drive to improve neighborhood access and traffic flow. None of the lots affected by the replat have been sold or built upon and are currently in the single ownership of the developer. The subject property is phase 1 of the larger Birmingham Farms Planned Development (PD 2002-40), which conforms to the Single Family 8.5/17 District requirements except that the minimum lot width is 65 feet and no alleys are required. Phase 2 is also on the current agenda as Birmingham Farms Phase 14B for Council consideration. The Development Plan approved by the City Council as part of the original Planned Development (PD 2002-40) on September 24, 2002 serves as an approved Preliminary Plat. The subject development will comply with all of the applicable requirements set forth in the conditions of the PD 2002-40. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that"the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. C June 24, 2003 Issue Consider and act upon a Final Plat for the Birmingham Farms Phase 14B,being a certain 34.488 acre tract of land generally located south of the proposed Park Boulevard extension and east of Country Club Road (F.M. 1378), and being situated in the Mercer Phalen Survey, Abstract No. 695 and the D.W. Williams Survey, Abstract No. 1021, City of Wylie, Collin County, Texas. Background The Final Plat under consideration is for the Birmingham Farms Phase 14B Addition. The property includes 34.488 acres and will create 114 single-family residential lots and 3 common areas/open spaces to be owned and maintained by the Homeowners Association. The subject property is phase 2 of the larger Birmingham Farms Planned Development(PD 2002-40),which conforms to the Single Family 8.5/17 District requirements except that the minimum lot width is 65 feet and no alleys will be required. Phase 1 is also on the current agenda as Birmingham Farms Phase 14A for Council consideration. Johnson, recorded in County Clerk's File No. 02-0077388, Deed Records of Collin County, Texas(DRCCT), and being part of a certain called 14.497 acre tract of land conveyed to Novid Properties, Inc., recorded in County Clerk's File No. 96-0076788, and being situated in the Charles Atterbury Survey, Abstract No. 22, City of Wylie, Collin County, Texas. (Zoning Case 2003-05) Background The applicant is requesting a Special Use Permit (SUP) in order to operate a Minor Vehicle Repair(boats only) in a vacant retail building. The subject property was previously occupied by the Walker/Roper Fence Company, and is one (1) acre in size. It is developed with a building of approximately 4,560 square feet, faced with masonry on the street front and metal on the sides(two large overhead doors face south), as well as associated concrete parking and fenced open space which is partially paved and partially gravel. Plans are to utilize the building for minor repairs of boats and any boat parking and short-term storage will be behind the screen fence. The subject property has never been platted into an official lot of record. The applicant is aware that the property must be platted prior to issuance of a Certificate of Occupancy. Neither the previous nor current Zoning Ordinances define a specific district for boat repair, and Minor Automotive Repair is the closest specified use to that anticipated by the applicant's operations. The property was rezoned from Business-2(B-2)to Neighborhood Services(NS)in November of 2001 with the adoption of the City-wide revisions to the Zoning Ordinance and Map. Minor Automotive Repair uses were allowed by right within the previous B-2 District, but are allowed within the current NS District only with an approved Special Use Permit (SUP). The Zoning Ordinance provides consideration of a Special Use Permit (SUP) as a means of establishing special conditions for allowing certain uses in a manner which is more compatible and consistent with the character of adjacent properties than that use may be normally. The Planning and Zoning Commission and City Council shall evaluate a request for an SUP to determine its probable effect on adjacent properties and the community as a whole, and may impose any reasonable conditions for the granting of an SUP. Failure at any time to comply fully with the approved Conditions of the SUP will result in the cancellation of the Certificate of Occupancy. The property to the north is zoned Agriculture(A)with a Special Use Permit(SUP)for the Transportation Center of the Wylie Independent School District. Properties to the east and south are zoned for Neighborhood Services (NS), are undeveloped and owned by the applicant of the subject property. Properties to the west, across Country Club Road, are not platted but are sparsely developed in rural single- family residential uses and the City of Wylie Fire Station. Financial Considerations Zoning Application Fee has been paid. Other Considerations 1. The currently-adopted Comprehensive Plan recommends Country Residential uses for the subject property,which is defined as single-family residential and appropriate support uses on lots of one(1)acre and larger. However,the Planning and Zoning Commission is in the process of considering revisions to the Plan, and are considering recommending that the area be developed for commercial uses in conformity to the current zoning. The proposed Special Use Permit will retain the current retail base zoning, and conforms to this proposed recommendation of the Plan. 2. The existing building and site development were constructed in accordance with previous code regulations, and do not comply with some requirements of the current Zoning Ordinance, specifically including only partial masonry building facade, parking space size and landscaping. Section 9 of the Zoning Ordinance provides that such structures which were made nonconforming by changes in City requirements may continue to operate but shall not be encouraged and shall be brought into compliance if and when that structure is vacated without utilities for a period of six months. City records indicate that City water has not yet been terminated and the property remains technically in use. Therefore, full compliance with the current regulations can not be required, but some degree of compliance may be negotiated as a condition of granting the requested SUP. 3. Boat repair is not a specifically-listed use within the Zoning Ordinance. Section 5.6 of the Ordinance provides that additional and unlisted uses may be permitted when the new use is similar to other uses listed in a zoning district. As defined by the applicant, the proposed use is closest to Minor Automotive Repair than to other listed uses such as Major Auto Repair, Truck or Heavy Equipment Repair or Industrial Assembly/Manufacturing. Minor Automotive Repair is allowed within the Neighborhood Service District when all activity and operations are conducted within an enclosed structure and when service bays do not face public rights-of-way. The existing development and proposed operations comply fully with these special regulations. Although the applicant anticipates the repair of boats only, it is considered that any similar minor vehicle repair likewise complies with the intent of the Ordinance and this Special Use Permit is not limited to boat repairs but will permit any such minor vehicle repairs. 4. The applicant originally proposed no conditions for this Special Use Permit, as the existing construction is generally in compliance with the standard regulations of the Zoning Ordinance. However, the Planning and Zoning Commission formulated Special Conditions as a stipulation for their recommendation of approval of this SUP, and these conditions are attached. The conditions reiterate requirements of the Zoning Ordinance for Automotive Repair(that all operations be conducted within enclosed structures and all storage be screened, limiting the size of vehicles to 6,000 pounds, and no bays opening to the street), as well as other conditions stipulated by the Commission(masonry wainscot in the building's south side, screening of the dumpster and compliance with current landscape regulations). Approval of the SUP will allow the operation of any similarly defined Minor Vehicle Repair on the property. 5. Public Comment Forms were mailed to nine (9) property owners within 200 feet of this request. No Comment Forms have been returned at the time of posting. Board/Commission Recommendation At the June 3, 2003 Planning and Zoning Commission meeting, the Commission voted 4-0 to recommend approval of the proposed zoning change with the following stipulations: • Masonry enclosure for dumpster to match the building masonry. • Landscaping to meet the current code. • 4 foot high wainscot of brick with accent to match existing building façade on the south side of the building. Staff Recommendation Approval. The existing development complies sufficiently with current code requirements and is compatible with current and anticipated neighboring uses. Openings for service bays shall not face the public right-of-way. 5. Noise from bells or loudspeakers shall not be audible beyond the property line. 6. A masonry wainscot, four (4) feet in height of brick and with a top layer accent to match the front building façade, shall be installed and maintained along the south wall building. Other characteristics of the building which do not conform fully to the requirements of the current Zoning Ordinance, except for any condition which shall be deemed a danger to the health and safety of the public, may be maintained in compliance with Section 9.5 of the Zoning Ordinance. Davidson Survey, Abstract No. 266, City of Wylie, Collin County, Texas. (Zoning Case 2003-06) Background The applicant is requesting rezoning of the subject property in order to permit development of a single-family detached residential neighborhood. The proposal is intended to continue the residential patterns established by the Westgate neighborhood to the north and the townhouse and apartment developments to the east, and to better address the property's adverse adjacency to the active railroad corridor. The proposed Planned Development District includes a total of 53.6 acres of land, and is currently being consolidated under single ownership. The eastern 15.5 acre portion adjacent to Westgate Way is zoned for Townhouse residential (TH) uses, and the western 38.1 acres is zoned Agriculture (A) District which is generally a holding District until appropriate urban land uses are proposed. The property is undeveloped. The property abutting the proposed Planned Development District to the north is zoned Agriculture(A)and is undeveloped. The railroad corridor of the Dallas Area Rapid Transit (DART), previously owned by the Kansas City Southern Railroad, serves as the southern boundary of the tract. Properties to the east, across Westgate Way, are zoned for Townhouse (TH) Residences, and are largely undeveloped except for the Fleming Street entry of the currently-developing Westgate Hollow zero-lot line residential neighborhood(PD 90-22). Properties to the west are within the floodplain of Muddy Creek and are largely undevelopable. The Development Plan for the Planned Development District provides a monumental divided entry street approximately mid-way along the Westgate Way frontage as the primary access to the subdivision and envisions the extension of Fleming Street westwardly as a local street as a secondary entry. Along the Westgate frontage is a 25 feet wide landscape perimeter to be owned and maintained by the Homeowners Association. The Plan allocates the western floodplain as public park land, and provides a linear park along the south boundary as a buffer from activity on the railroad corridor as well as pedestrian connection between Westgate Way and the floodplain corridor. No alleys are provided throughout the subdivision. The Development Plan is to serve as the preliminary plat. The Conditions of the Planned Development District establish the maximum possible number of single-family detached residential lots and dwellings at 200 and a maximum density of 3.75 dwelling units per acre. The PD Conditions provide a minimum lot size of 7,000 square feet and minimum dwelling size of 1,600 square feet, and propose modification of the lot width and side yard setbacks. The PD proposes a modification of the standard architectural regulations of the Zoning Ordinance, largely a reduction of the masonry requirement, but will comply fully with the Land Design and Street Requirements of the Ordinance. Financial Considerations Zoning Application Fee has been paid. Other Considerations 1. The Comprehensive Plan recommends that the entirety of the subject property be developed in Country Residential uses, with single-family dwellings on lots of an acre or larger. The Planning and Zoning Commission is in the process of considering potential revisions to the Comprehensive Plan, but has recommended this same low-density residential for the area. The requested rezoning to smaller residential lots is not consistent with these recommendations of either the adopted or draft revision of the Comprehensive Plan. However, if developed as recommended by the Comprehensive Plan (15.5 acres of townhouses at 14 dwellings per acre and 38.1 acres of Country Residential acre lots), the subject 53.6 acres could yield a total of 255 lots or 27.5%more dwellings than the 200 maximum proposed by the Planned Development District. Additionally, the higher-density townhouses allowed by the current zoning are more appropriately bounded by smaller lots such as proposed by the PD than by the acre lots recommended by the Plan. 2. The stated purpose of a Planned Development District is to allow flexibility from the rigid requirements of the Zoning Ordinance in order to allow innovation in the use and design of land or to overcome constraints to standard development imposed by a site. The recent revisions to the Zoning Ordinance were specifically designed to provide such flexibility and thereby avoid the need for PDs. Neither the configuration or character of the site nor the proposed Conditions of Development appear to justify rezoning as a Planned Development District rather than compliance with the standard regulations of the Ordinance. However, the applicant contends that the market for the larger residential lots required by the Zoning Ordinance(currently, the smallest lot allowed is 8,500 square feet)is limited, and argues that the smaller lots and higher-density proposed by the PD are compatible with the existing densities of the immediate Westgate area and is a proper transition from the higher densities to the east to lower densities west of the creek/floodplain. Furthermore, the eastern third of the subject property is already zoned to allow Townhouse residences at a potential density of 14.5 dwellings per acre rather than the PD's established maximum of 3.75 d.u./ac. The coordinated PD can, therefore, achieve both the City's goal of lower density and the market goal for smaller lots better than literal compliance to the Zoning Ordinance and Comprehensive Plan. 3. The PD Conditions require that fences be made of masonry, wood or architectural metal, with no chain link, and establish a maximum height for fences at 7 feet. All rear fences adjacent to the floodplain open space shall be wrought iron. The PD Conditions require the screening of yard accessories such as clotheslines maintenance equipment, dog houses and refuse containers. 5. The Subdivision Regulations require alleys within all residential developments. The proposed Conditions of the Planned Development District waives this alley requirement. The normal functions of alleys will be accommodated by other measures(drainage to the street, front-of-lot utility easements and the stipulation that 25 percent of garages accessed by side entries). However, alleys are not appropriate when lots back onto floodplain/open space or the railroad corridor or major thoroughfares such as those which bound the subject tract on three sides, leaving only the four interior streets suited for alleys.. 6. Council actions should include some direction for the disposition of open spaces and park land proposed by the PD. The PD proposes to dedicate approximately 6.5 acres of land as public park, compared to the 3 acres (at 1.5 acres per 100 lots) required by Wylie's park dedication regulations. However, over 4 acres identified on the Development Plan as park dedication is within the floodplain and not eligible for dedication, and nearly 2 acres is a narrow linear strip along the railroad boundary, or a total of 6 acres which is not appropriate for the required dedication. However, the Park Board recommends that funds in lieu of land will be required to equate to the dedication requirement. The floodplain may still be dedicated as floodplain/drainage/open space but not be counted for park dedication, and that the 2-acre linear park and trail be owned and maintained by the Homeowner's Association or deleted. The Board recommended that s 20 foot wide access route be dedicated to allow access to the western floodplain, and this access can be dedicated and maintained as public park. The proposed Development Plan of the PD does not reflect these recommendations of the Park Board. 7. Public Comment Forms were mailed to twenty-three(23)property owners within 200 feet ofthis request. One Comment Form was returned at the time of posting, expressing a neutral position toward the proposed rezoning (DART offers information concerning traffic on the railroad corridor). Board/Commission Recommendation At the June 3, 2003 Planning and Zoning Commission meeting, the Commission voted 4-0 to recommend approval of the proposed zoning change with the following stipulations: • Install wrought iron fences to rear of lots adjacent to open space on west side. • All Houses backing onto Westgate Way will be one-story and have 100% masonry; all other houses must be at least 75% masonry. • Add larger lots along the west side with a minimum of 74 foot wide fronts. • Trail access is to be at least 20 feet wide in the northwest corner. These recommendations are incorporated into the Conditions and Development Plan of the PD. At the June 3, 2003 meeting, the Park and Recreation Board recommended that no land be dedicated for public park purposes, but rather fees in lieu of land(at the required$500 per lot)be provided. The 4.5 acres to the northwest may be dedicated and maintained as open space and drainage, and the 2-acre linear trail corridor along the south should be owned and maintained by the private Homeowners Association. The applicant has rejected these recommendations and the Development Plan of the Planned Development District envisions these areas as public park lands. Staff Recommendation Approval. Although the proposed PD does not directly comply with the recommendations of the Comprehensive Plan for larger lots, it indirectly complies with the philosophy of the Plan by limiting the potential density of dwellings to less than would be allowed by the current zoning and Plan. The densities established by the PD also conform to existing development patterns in the immediate vicinity. The Departments of Planning, Engineering, Development Services, Public Works and Fire concur with this recommendation. Background Article 8, Section 1A of the City Charter authorizes the City Council to appoint members to serve on boards,commissions and committees to help carry out the functions and obligations of the City. The City Council has prescribed the purpose,composition, function,duties, accountability and the tenure of each board,commission and committee. The City Secretary's Office began an active campaign to solicit for Board and Commission applications by utilizing the Wylie News, Citizen's Newsletter, all municipal facilities and current board and commission members. We also utilized the City's Website by offering application submittal on-line. For the seventh year an interview panel,consisting of three council members,was used to conduct interviews of all applicants.All applicants were personally contacted to schedule an informal meeting with the Council Interview Panel. Current members were also given an opportunity to visit with Council through the interview process.Council members Merrill Young,Randal Shinn,and Mayor Pro Tern Eric Hogue volunteered to serve on the interview panel and conducted 37 interviews. The applicants consisted of thirty-three new applicants and fourteen current members seeking reappointment. The Panel met with applicants on Thursday, May 29,Monday,June 2, and Thursday,June 5, 2003. The Council feels that the entire process is helpful to them in making appointments and offered an opportunity to understand some of the visions the applicants have for the community. Financial Consideration The board, commission and committee members are not compensated by the city as stated in the City Charter under Article 8, Section 3 C. Other Consideration Under Article 8 of the City Charter, the City Council has the right to create, establish or appoint boards, commissions and committees, as it deems necessary to carry out the functions and obligations of the city. VVYLIE CITY COUNCIL AGENDA ITEM NO. 4 June 24, 2003 Issue Consider and act upon approval of a Park and Park Facilities Naming Policy and a Park Memorial Policy Board. Background Currently, the City has no formal policy for the naming of City parks or the facilities such as fields and pavilions contained within the parks. The park locations generally take on the names of the subdivisions in which they are located. The Park and Recreation Board recommends the adoption of a more formal policy to facilitate the process for existing and future parks and park facilities. Likewise, the City has no formal policy outlining the procedures for acceptance and placement of memorials within the City parks. The Park Department has received requests in the past and has worked with citizens to accommodate the installation of trees and benches as memorial items in the several city parks. Again, the Park and Recreation Board recommends the adoption of a more formal policy to facilitate this process for future requests. Staff reviewed similar policies of surrounding municipalities and provided the Park and Recreation Board members with draft policies for their review and comment. At the most recent meeting of the Park and Recreation Board on June 2, 2003, the Board unanimously adopted both of the attached policies. The Park Superintendent, or designee, shall have the responsibility for administering the City of Wylie Parks and Recreation Department Memorial Dedication Policy. 2. Under the guidance of the Park Superintendent, Wylie citizens may request the installation of memorial items including but not limited to: trees, landscaping, granite markers, benches, tables, pavilions, playground equipment, and other park-related items. 3. All requests for the installation of memorial items must be accompanied with a complete written description of the item, such as the item dimensions, material of construction, caliper size, mounting requirements, the desired location, the desired time for installation, etc. The Park Superintendent reserves the authority to limit the number, size, type, brand, variety, species, color, location, and date of installation of all memorial items. 4. Prior to installation, all costs associated with the purchase, acquisition, shipping, transportation, mounting, placement, and/or installation of the item shall be paid by the individual requesting the installation of the memorial item. 5. No memorial items shall be installed without the approval of the Park Superintendent. 6. Memorials shall be installed by the Park and Recreation Department employees and/or a Parks and Recreation Department designated contractor only. 7. The Park and Recreation Department assumes no responsibility for any damage, breakage, or vandalism occurring to the item either before, during, or after installation, nor does the Department guarantee the item's maintenance, upkeep, life span, or duration of usefulness. The park and recreation board ("board"), will be responsible for recommending a name for municipal parks and park facilities. 2. The board shall be responsible for research, study and recommendation of a proposed name to the city council. Rationale for the recommended name shall be given in writing and accompany the recommendation. 3. The recommended name will be forwarded to the city council for its consideration and approval. 4. Municipal parks and park facilities shall be named immediately prior to or during development, generally not later than 60 days after acquisition or commencement of construction or at the earliest possible date. 5. A park name or park facility name may be changed no more frequently than once every ten years. II. GUIDELINES FOR NAMING MUNICIPAL PARKS AND PARK FACILITIES 1. Names of municipal parks and facilities should be familiar to the majority of citizens, easy to recall, unique and lasting. 2. The following guidelines are listed in order of importance. Background Both the City of Wylie and the Wylie Northeast Water Supply (WNE) have established areas of jurisdiction for the provision of water service that were established several years ago. The jurisdictional boundaries are identified through the Certificates of Convenience and Necessity (CCN) which are file with the State. A portion of the WNE jurisdiction falls within the Birmingham Farms Subdivision. As development has occurred in this area, it become apparent that the boundary was a more or less randomly drawn straight line running east-west through the subdivision. Staff has met with representatives of WNE in order to establish a logical split between the jurisdictions that made sense in terms of both service delivery and the development process. The resulting map was mutually agreed upon, subject to approval by the City Council and the WNE Board. Background TXU Gas Distribution, a division of TXU Gas Company, filed a Statement of Intent to change gas rates in all municipalities within the TXU Gas Distribution System. With this filing, the company plans to consolidate the Pipeline and Distribution systems under a single set of rates. As with past rate filings, the City of Wylie has joined with area cities in a coalition in order to consolidate representation on rate cases, as well as to take advantage of the expertise of the staff of the larger municipalities and the attorney representing the coalition. Approval of the resolution suspends the effective date of the proposed new rates, commits the city to joint cooperation and participation, and authorizes intervention of the behalf of the cities at the Railroad Commission. Other Considerations The Gas Utility Regulatory Act grants local regulatory authorities the right to suspend the effective date of proposed rate changes and authorities the right to intervene in rate proceedings filed at the Railroad Commission. Financial Consideration It is not anticipated that there will be any costs to the city.
