WYLIE CITY COUNCIL AGENDA ITEM NO. iek_ February 8, 2000 Issue Consider and act upon approval of a Resolution ordering a Joint Election with the Wylie Independent School District and the Collin County Community College District on May 6, 2000. Background Terms of offices currently held by the Mayor, Place 2, Place 4 and Place 6 are subject to re-election. The resolution proposed will call the joint election with the Wylie Independent School District and the Collin County Community College District on May 6, 2000. The resolution stipulates the polling places where qualified voters can cast ballots for the election. It also outlines the early voting by personal appearance locations. Early voting will take place at the Municipal Complex beginning April 19, 2000 through May 2, 2000 from 8:00 a.m. to 5:00 p.m. There will be an extended hour voting on Thursday, April 27, 2000 from 8:00 a.m. to 7:00 p.m. and on Saturday, April 29, 2000 from 8:00 a.m. to 5:00 p.m. The Collin County Election contract details the duties and responsibilities of both the contracting officer and the City. The first day to file for office is February 21, 2000. The last day to file is March 22, 2000 before 5:00 p.m. Candidate packets are currently available in the City Secretary's office. In 1995 the State Legislature passed a bill that enables municipalities to cancel the election if all of the candidates are running unopposed or there are no propositions on the ballot. If at the end of the filing deadline, all candidates are unopposed, a certification will be delivered to the Council declaring the candidates are unopposed. On receipt of the certification, the Council by ordinance may declare each unopposed candidate elected to the office. If a declaration is made, the election is not held. A copy of the ordinance shall be posted on election day at each polling place that would have been used in the election. A certificate of election shall be issued to each candidate in the same manner as provided for a candidate elected at the election. Financial Consideration Five thousand dollars ($5,000) has been budgeted for the city's share in the joint elections. Details on the cost sharing is provided within the contract with the County Elections Administration and included as an attachment. Other Consideration The Texas Election Law, Chapter 3 gives direction in ordering the election. The resolution, if approved, will meet statutory requirements for ordering the municipal election under Article 5, Sections 1-7 of the Home Rule Charter. Section 2.051, Subchapter C of the Texas Election Law applies to the ruling on an unopposed candidate. Other Consideration -continued In May of 1998, the qualified voters of the City of Wylie voted to amend Article III, Section 1(A) (Number, Selection and Term) of Wylie's Home Rule Charter to increase the term of office that the mayor and councilmen shall serve from two (2) years to three (3) years. On January 12, 1999, the City Council amended Ordinance No. 85-3 and Wylie's Home Rule Charter to increase the term of office that the mayor and councilmen shall serve from two (2) to three (3) years. Ordinance No. 85-3 and Article III, Section 1(A) (Number, Selection and Term) of Wylie's Home Rule Charter are hereby amended to read as follows: "The mayor and councilmen shall be elected by the qualified voters of the qualified voters of the city at large, each of whom, unless sooner removed by the provisions of tins Charter,shall serve for a term of three years. Each councilmen shall occupy a position on the city council, such positions being numbered l through 6, consecutively.' The method of election and transition to three (3) year terms under the place system are set out as follows: The 1999 General Election provided the transition for Place 5 only to convert to a three year term. Places 2, 4, 6 and the Mayor are up for re-election in 2000. Place 6 and the Mayor will have a two- year term and Places 2 and 4 will have a three-year term. Beginning in 2001, each Place, including the Mayor, will be re-elected with three-year terms. Staff Recommendation Staff recommends approval of the resolution. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, COLLIN COUNTY,TEXAS,ORDERING A JOINT ELECTION TO BE HELD ON MAY 6, 2000, FOR THE PURPOSE OF ELECTING THREE (3) MEMBERS, (PLACE 2, 4, AND 6), AND THE MAYOR TO THE CITY COUNCIL; THE MAYOR AND PLACE 6 WILL HOLD OFFICE FOR A PERIOD OF TWO YEARS AND PLACE 4 AND PLACE 6 WILL HOLD OFFICE FOR A PERIOD OF THREE YEARS; DESIGNATING LOCATION OF POLLING PLACE; ORDERING NOTICES OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN CONNECTION WITH SUCH ELECTION. John Mondy, Mayor ATTEST: Barbara Salinas, City Secretary THE STATE OF TEXAS CONTRACT FOR COUNTY OF COLLIN § CITY - SCHOOL WYLIE ELECTION SERVICES BY THE TERMS OF THIS CONTRACT made and entered into by and between the CITY OF WYLIE, hereinafter referred to as the "CITY," and the BOARD OF TRUSTEES OF THE WYLIE INDEPENDENT SCHOOL DISTRICT, hereinafter referred to as the"SCHOOL DISTRICT,"and SHARON ROWE, the Elections Administrator of Collin County, Texas, hereinafter referred to as "Contracting Officer," pursuant to the authority of Section 31.091, of the Texas Election Code, agree to the following particulars in regard to coordination, supervision and running of the City and School District's May 6, 2000, Joint General Election. THIS AGREEMENT is entered into in consideration of the mutual covenants and promises hereinafter set out_ IT IS AGREED AS FOLLOWS: I. DUTIES AND SERVICES OF CONTRACTING OFFICER. The Contracting Officer shall be responsible for performing the following duties and shall furnish the following services and equipment: A. The Contracting Officer shall arrange for appointment, notification (including writ of election), training and compensation of all presiding judges, alternate judges,the judge of the Central Counting Station and judge of the Early Voting:Lalloting Board. a. The Contracting Officer shall be responsible for notification of each Election day and Early Voting presiding judge and alternate judge.of his or her appointment. The recommendations of the City and the School District will be the accepted guidelines for the number of clerks secured to work in each polling place. The presiding election judge of each polling place, however,will use his/her discretion to determine when additional manpower is needed during peak voting hours. The Contracting Officer will determine the number of clerks to work in the Central Counting Station and the number of clerks to work on the balloting board. Election judges shall be secured by the Contracting Officer with the approval of the City and the School District. b. Election judges shall attend the Contracting Officer's school of instruction(Elections Seminar)to be held Thursday, May 4, 2000, in the City of Plano Council Chambers, at 6:00 P.M, c. Election judges shall be responsible for picking up from and returning election supplies to the county election's warehouse located in Plano. Compensation for this pickup and delivery of supplies will be $25.00. d. The Contracting Officer shall compensate each election judge and worker. Each judge and worker shall receive$6.00 per hour for services rendered. B. The Contracting Officer shall procure, prepare, and distribute ballots, frames(ballot pages),election kits and election supplies. a. The Contracting Officer shall secure election kits which include the legal documentation required to hold an election and all supplies including locks, pens, magic markers, etc. b. The Contracting Officer shall secure all tables, chairs, duplication ballots, and legal documentation required to run the central counting station. c. The Contracting Officer shall provide all lists of registered voters required for use on election day and for the early voting period required by law. The election day list of registered voters shall be arranged ire alphabetical order by polling place, in lieu of alphabetic by each precinct in each polling place. d. The Contracting Officer shall procure and arrange for the distribution of all election equipment and supplies required to hold an election. 1. Equipment includes the rental of voting and demonstrator machines, ballot boxes, transfer cases, voting signs, directional poles and tote boxes. 2 2. Supplies include punch card ballots, sample ballots,early voting mail ballots, demonstrator ballots, pens,tape,markers, etc. C. The Contracting Officer, Sharon Rowe, shall be appointed the Chief Deputy Early Voting Clerk by the City and the School District. a. The Contracting Officer shall supervise and conduct Early Voting by mail and in person and shall secure personnel to serve as Early Voting Deputies. b. Early Voting by personal appearance for the City and School District's May 6, 2000, joint General Election shall be conducted on weekdays beginning Wednesday, April 19, 2000, and continuing through Tuesday,May 2, 2000,between the hours of 8:00 A.M. and 5:00 P.M. On Thursday, April 27, 2000, early voting shall be conducted between the hours of 8:00 A.M. and 7:00 P.M. Early voting shall also be conducted on Saturday, April 29, 2000,between the hours of 8:00 A.M. and 5:00 P.M. c. All personal appearance voting shall be conducted during the hours detailed above at the following locations: Collin County SubCourthouse Main Early Voting Location 920 E. Park, Suite 120 Plano,Texas 75074 Wylie Municipal Building 2000 N. Hwy 78 Wylie,Texas 75098 3 d. All applications for an Early Voting mail ballot shall be received and processed by the Collin County Elections Administration Office, 920 E. Park Blvd., Suite 120, Plano, Texas 75074. 1. Application for mail ballots erroneously mailed to the City or School District shall immediately be faxed to the Contracting Officer for timely processing. The original application shall then be forwarded to the Contracting Officer for proper retention. 2. All Federal Post Card Applicants(FPCA)will be sent a mail ballot. No postage is required. e. All Early Voting ballots(those cast by mail and those cash:by personal appearance) shall be prepared for count by the Early Voting Ballot Board in accordance with Section 87.000 of the Texas Election Code. The presiding judge of this Board shall be Rose Generalovich. The Board shall meet for preparation of the early voting ballots on Wednesday, May 3, 2000, at 9:00 A.M. They will recess and continue the preparation process and begin tabulation after the mail is received on Saturday,May 6, 2000, at 3:00 P.M. D. The Contracting Officer shall arrange for the use of all Election Day polling places. The City and School District shall assume the responsibility of remitting the cost of all employee services required to provide access, provide security or provide custodial services for the polling locations. E. The Contracting Officer shall be responsible for establishing and operating the Central Counting Station to receive and tabulate the voted ballots in accordance with Section 127.000 of the Election Code and of this agreement. Counting Station Manager and Central Count Judge shall be Sharon Rowe. The Tabulation Supervisor and Tabulation Operator shall be provided by the Collin County Elections Administration Office and paid as a contract expense. a. The tabulation supervisor shall prepare,test and run the :ounty's tabulation system in accordance with statutory requirements and county policies, under the auspices of the Contracting Officer. 4 b. The Public Logic and Accuracy Test of the electronic voting system shall be conducted on Thursday, May 4, 2000, at 2:00 P.M., by the Contracting Officer. c. Election night reports will be available to the City and School District at the Central Counting Station on election night. d. The Contracting Officer shall prepare the unofficial canvass report after all precincts have been counted, and will provide a copy of the unofficial canvass to the City and School District as soon as pos,ible after all returns have been tallied. e. The Contracting Officer shall be appointed the custodian of the voted ballots and shall retain all election material for a period of 60 days. 1. Pending no litigation and as prescribed by law, the voted and unused ballots shall be shredded 60 days after the election. 2. The City and School District can obtain the list of registered voters from the Elections Administration Office after this 60-day retention period. Pending no litigation and if the City or School District does not request the lists, the Contracting Officer shall destroy them 90 days after the election. f_ The Contracting Officer shall conduct a manual count as prescribed by Section 127.201 of the Texas Election Code and submit a written report to the City and School District in a timely manner. The Secretary of State may waive this requirement. If applicable, a written report shall he submitted to the Secretary of State as required by Section 127.2(11(C)of the aforementioned code. 5 H. Duties and Services of the City and School District. The City and School District shall assume the following responsibilities: A. The City and School District shall prepare the election orders, resolutions, notices,justice department submissions, official canvass and other pertinent documents for adoption by the appropriate office or body. a. The Contracting Officer shall publish and post the Notice of the Public Logic and Accuracy Test of the electronic voting system and one press release. The Contracting Officer shall also prepare a certification of tabulation and an unofficial "canvass report" that will assist the City and School District with the official canvass. b. The City and School District assumes the responsibility of posting all notices and likewise promoting the schedules for Early Voting and Election Day. B. The City and School District shall procure and provide the Contracting Officer with the ballot layout and Spanish interpretation. a. The City and School District shall deliver to the Contracting Officer as soon as possible, but no later than Friday,March 17, 2000, the official wording for the City and School District's May 6, 2000, Joint General Election. b. The City and School District shall approve the "blue line" ballot format prior to the final printing. C. The City and School District shall post the publication of election notice by the proper methods with the proper media_ D. The City and School District shall prepare and submit to the U. S. Department of Justice under the Federal Voting Rights Act of 1965, any required submissions on voting changes. E. The City and School District shall compensate the Contracting Officer for any additional cost incurred in the process of miming this election or for a re-count this election may require. 6 F. The City and School District shall pay the Contracting Officer 90%of the estimated cost to run the said election prior to March 13, 2000. The Contracting Officer shall place the funds in a "contract fund" as prescribed by Section 31.098 of the Texas Election Code. The City and School District shall pay the cost of conducting said election, less partial payment, including the 10%administrative fee, pursuant to the Texa3 Election Code, Section 31.100, within 30 days from the date of final billing. The reasonable and necessary expense of holding said joint election will be shared by three entities(City of Wylie, Wylie Independent School District and Collin County Community College District) entering into the joint agreement and the proportionate share of expenses shall be reimbursed to the Contracting Officer. lam. Nothing contained in this contract shall authorize or permit a change in the officer with whom or the place at which any document or record relating to the City and School District's May 6, 2000, Joint General Election is to be filed or the place nt which any function is to be carried out, or any nontransferable functions specified under Section 31.096 of the Texas Election Code. B. Upon request,the Contracting Officer will provide copies of all invoices and other charges received in the process of running said election for the City and School District. 7 C. If the City and/or School District cancel their election pursuant to Section 2.053 of the Texas Election Code, the Contracting Officer shall be paid a contract preparation fee of S75. An entity canceling an election will not be liable for any further costs incurred by the Contracting Officer in conducting the May 6, 2000, Joint General Election. All actual shared costs incurred in the conduct of the election will be divided by the actual number of entities contracting with the Contracting Officer and holding a May 6, 2000, Joint General Election. The findings sets forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Ordinance No. 85-3 and Wylie's Home Rule Charter Article III, Section 1(A). Ordinance No. 85-3 and Article III, Section 1(A) (Number, Selection and Term) of Wylie's Home Rule Charter are hereby amended to read as follows: ARTICLE 3 Section 1: Number, Selection and Term A. The mayor and councilmen shall be elected by the qualified voters of the qualified voters of the city at large, each of whom, unless sooner removed by the provisions of this Charter, shall serve for a term of three years. Each councilmen shall occupy a position on the city council, such positions being numbered 1 through 6, consecutively. Ordinance No. 99-1 Page 2 SECTION 3: Method of Election Under the Place System. All ordinances in conflict herewith are repealed to the extent they are in conflict. Any remaining portions of said ordinances shall remain in full force and effect. Ordinance No. 99-1 Page 3 SECTION 5. Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase there of irrespective of the fact that any one or more sections, subsections, sentence, clauses, and phrases be declared unconstitutional or invalid. SECTION 6: Effective Date. This Ordinance shall become effective from and after its adoption and publication as required by the City Charter and by law. February 8, 2000 Issue Consider and act upon approving a contract for election services between the City of Wylie and the Collin County Elections Administration for the May 6, 2000 Municipal Election. Background For the last four years the Collin County Elections Administration has been contracted to conduct the Municipal Elections. Collin County has detailed the responsibilities of all entities within the contract and staff has reviewed and found that with the exception of cost, it is as the previous years. City staff has been pleased with the professionalism and timely manner of the services provided by the Elections Administrator and staff. By conducting jointly with other entities we are able to conduct a cost effective election by sharing expenses. Financial Consideration The total contract cost for the 1999 election was $4,487.39. The cost of last years election was higher than the previous years due to the fact that the WISD was able to cancel their election under Section 2.051 of the Election Law(unopposed candidates) and the Collin County Community College District did not hold an election in 1999. The proposed contract states that the estimated contract expense for the 2000 election will be $2,182.63. There is a provision in the contract that will allow the City to cancel their election pursuant to Section 2.053 of the Texas Election Code, with the City only paying a$75.00 preparation fee. $5,000 has been budgeted for this years Joint Election. Other Consideration Article 2, Section 1(c) of the Home Rule Charter allows the Council to cooperate with the government of any County for any lawful purpose for the advancement of the interests of its inhabitants. During the 1999 Legislative Session, Senate Bill 35 was introduced by Senator Shapiro. The bill related to certain processes and procedures to promote the consolidation of elections. Though Senate Bill 35 was not successful, many cities are moving to consolidation by contracting their elections with one or more entities. This office will continue to monitoring legislation that may have a direct effect on our election process. Staff Recommendation Staff recommends approval of the contract. February 8, 2000 Issue: Hold a public hearing to Consider and Act Upon a request from Cascade Companies. L.L.C., for approval of a zone change from MF (Multi-Family); and B-1 (Business)to PD (Planned Development) for a master planned single family neighborhood for the property generally located along the east side of FM 1378 just north of the Newport Harbor Development and being all of a certain 50.576 acre tract out of the James McUlmury Survey, Abstract No. 629, and the WM. Burnett Survey, Abstract No. 56, City of Wylie, Collin County, Texas. Background: The conceptual plan under consideration is for the proposed Cascades Addition. The applicant is requesting rezoning on 50.576 acres in order to develop the property with a master planned single family residential community. The property to the northwest is vacant and zoned for MF (Multi-Family) uses. The property to the north is not within the City of Wylie proper. The property to the south is zoned SF- 3 (Single Family Residential)and developed accordingly with single family homes. The property to the west is zoned PD(Planned Development)for a master planned single family development. The property to the east is not within the City of Wylie proper. Public Comment Forms were mailed to sixty-four (64) property owners within 200 feet of this request. Two (2) Public Comment Forms in opposition and three (3)Public Comment Forms in support have been returned. The opposition represents 1.01% of the property within 200 feet of this request. Other Considerations: • The Comprehensive Plan recommends Country Residential (1 acre single family) uses for the property. The proposed land use is consistent with the Comprehensive Plan only in terms of the single family residential aspect. Specifically, the applicant is proposing a density of 2.75 dwelling units per acre(minimum lot size of 8,500 sq. ft.). The applicant is also proposing a cascading pond parkland dedication encompassing 4.4 acres (2.43 acres of useable area outside of the pond). Although the Comprehensive Plan recommends 1 acre lots for this property, staff is of the opinion that the elimination of the multi-family zoning significantly reduces the allowable density of the area. Specifically,the property is currently zoned for multi-family uses and, therefore, could be developed (by right) at a density of fifteen (15) dwelling units per acre. • The applicant is filing this PD in order to ensure a quality development and request an amendment to the Comprehensive Plan. Specifically, ponds will provide drainage improvements to the area and serve as an aesthetic amenity to the development. • The applicant is proposing a divided and landscaped entry way to FM 1378. • The applicant is aware that a development plan, preliminary plat and final plat must be approved prior to the issuance of building permits. Financial Considerations: Rezoning application fee in the amount of$400.00 - Paid Commission Recommendation: At the February 2, 2000, Planning and Zoning Commission meeting, the Commission voted by 3-2 to recommend approval of this case. Commissioner George was absent, Commissioner Schmader abstained, and Commissioner's Hogue and Wood voted nay. Specific concerns identified by the Commissioners voting nay were as follows: 1. Traffic along FM 1378; 2. Drainage; 3. Conflict with the Comprehensive Land Use Plan; 4. No off-street parking provided for the park dedication; 5. Proposed gravel jogging path; 6. Water pressure; and 7. Ingress/Egress Staff Recommendation: Approval due to the fact that the proposed density and development standards significantly reduce the overall density permitted by right. General Concept (the Cascades will be developed around a series of cascading constant level ponds providing a 4.4 acre park. The detention area for holding water before it is released downstream will be above the constant level ponds and is determined by volume, not square footage. The area outside of the ponds is 2.43 acres. It is the developer's desire to dedicate this entire area as a park to the City of Wylie. y specifications. The ponds and offsite The ponds will be engineered to the City of Wylie's sp drainage improvements are expected to provide the detention and release necessary to resolve the drainage problem that has occurred for the existing subdivision adjacent to the south. Normally, the water in each pond will cascade into the next lower pond, and then be pumped up to the highest pond and recirculated. This plan provides additional capacity to accommodate the 100 year flood. The additional water will be released slowly and diverted to the east to avoid inundation of the subdivision"downstream". A jogging trail will be developed which will lead to and around the pond park. Both the park and the jogging trail will be landscaped and provide an attractive and pleasing amenity to the home owners in the neighborhood. 2. Property Overview Ole Cascades is planned as a 154 lot single family subdivision on approximately 56 acres of land fronting the east side of FM 1378 (Country Club Rd.), in Wylie, Texas. The site borders the north boundary of the Newport Harbor addition. The site topography is level with FM 1378 for the western portion of the property but begins a gentle sloper thhe�tely 1,000 feet east of FM 1378. There are continuing problems during heavy rain run off fo Newport Harbor addition to the south of this property. This sensitive environmental area within the project site will be enriched and maintained and will become part of the native landscape of the project while at the same time mitigate the drainage problem occurring during high water levels. The site is currently zoned Multi-Family by the City of Wylie with a density of 15 units per acre. The proposed development is designed to accommodate 154 lots on 56 acres with a density of 2.75 single family lots per acre. No lot is less than 8,500 square feet. Due to the curvature of the streets and the cul de sacs,the lots vary in width and depth,however,minimum standards will be developed. 3. General Development Guidelines 1. Front wall- All wall construction materials facing FM 1378 shall be natural stone,brick, wrought iron or a combination of each. Added screening may be accomplished by plant material and landscaping. No wood fencing shall be used facing FM 1378 by the development,however, homeowners will be allowed to use wood fencing along FM 1378 on their lots. 2. Entry feature- The entry feature shall be of the same construction materials as the front wall, and shall be lighted. The entry shall have a split double lane on either side of a plant median approximately twelve feet wide at the widest point, and heavily landscaped. 3. JokeineNature Path -The jogging path will be five feet wide within a fifteen foot landscaped area between some of the lots. (See Jogging Trail Detail). The surface material for the path will be crushed rock built up between metal grass guards. The areas on either side of the five foot path will be landscaped with a 3" caliper live oak or equivalent tree planted every 40 feet along the trail. The running path will have the effect of winding in and out of the trees. Various stations along the path will be established for stretching, exercising or resting. The path to the ponds will provide an interesting and natural area for both joggers and strollers to make their way to the ponds and will be lighted with low level lights no higher than 4 feet. The path will open up at the pond area, and circle around the ponds to form a loop. Maintenance will be provided by the Home Owners Association. 4. Ponds - The cascading ponds will be the central focus of the development. This 4.4 acre area will not only be the main theme of the development around which the marketing will be based, but provides a most needed solution to an area drainage problem which has existed for years. Rather, than an open detention pit, this area will be engineered to not only provide for detention and release of water run oft but also become a scenic park. This area will have a series of constant level ponds, stepped to provide a cascading effect from one pond to the next. The water will be recirculated via a pumping system from the lowest point back to the highest point to begin its cycle over. The pond area will be extensively landscaped with a minimum of 3"caliper live oak or equivalent tree planted every 40 feet. along the perimeter of the pond area. 5. Waiver of City Assessed Park Fees- The developers respectfully request the City grant a waiver of all park fees and accept the dedication of the 4.4 acre pond as a public park maintained by the City of Wylie. The land surface area not included in the ponds is 2.43 acres which satisfies the donation requirement of 1.5 acres per 100 dwelling units(Ord.99-6). 6.Maintenance- Streets,park, and utilities will be publicly maintained. Jogging path will be privately maintained by a home owners association. 4. Single Family Residential Regulations The lots shall generally conform to the City of Wylie SF-2 zoning classification except as noted below: 11.3 Area regulations. (1). Size of yards 1. Front yard. There shall be a front yard having a depth of not less than 25 feet as measured from the front property line. 2. Side yard There shall be a side yard on each side of the lot having a width of not less than 7 feet in width. A side yard adjacent to a side street shall not be less than 20 feet. 3. Rear yard. There shall be a rear yard, a depth of not less than 25 feet. (2). Size of Lot: 1. Lot area. No building shall be constructed on any lot of less than 8,500 square feet. 2. Lot width. The minimum width as measured at the front building line of the lot shall not be less than 60 feet. 3. Lot depth. The minimum depth of the lot shall be no less than 100 feet. C. February 8, 2000 Issue Consider and act upon approval of a resolution authorizing the City Manager to execute an Interlocal Cooperation Agreement with Collin County, Texas for Road Improvements in accordance with Court Order No. 97-576-08-25 (copy attached). Background This Interlocal Cooperation Agreement replaces an existing agreement signed by the City on May 14, 1996. The Agreement will allow Collin County to continue participation in road and bridge maintenance/improvement projects within the corporate limits of Wylie. The county may assist with general maintenance activities such as the grading, rocking, asphalt level up, sealcoating, installation of culverts, cleaning of drainage ditches, mowing or brush cutting, emergency repairs to bridges, and oiling for dust control. Major improvements such as the construction or reconstruction of roads will only be considered if the road is on the Collin County Thoroughfare Plan (copy attached). All requests for work in the City of Wylie must be submitted to the Collin County Director of Public Services&Operations by April 1st of the year prior to the year improvements are desired to be made. Emergency requests will be evaluated by the Commissioners' Court, and authorization for work can only be given by the Commissioners' Court. Contracts for Joint Payment of Road Construction and Improvements (a) In this section: (1) "Highway project" means the acquisition, design, construction, improvement, or beautification of a state or local highway, turnpike, or road project. (2) "Transportation corporation" means a corporation created under Chapter 431, Transportation Code. (b) A local government may contract with another local government, a state agency, or a . transportation corporation to pay jointly all or part of the costs of a highway project, including the cost of an easement or interest in land required for or beneficial to the project. (c) A local government and a transportation corporation, in accordance with a contract executed under this section, may: (1) jointly undertake a highway project; (2) acquire an easement, land, or an interest in land, in or outside a right-of-way of a highway project, as necessary for or beneficial to a highway project; or (3) adjust utilities for the project. (d) If a contract under this section provides for payments over a term of years, a local government may levy ad valorem taxes in an amount necessary to make the payments required by the contract as they become due. Contracting Authority; Terms {a) A local government may contract or agree with another local government to perform governmental functions and services in accordance with this chapter. (b) A party to an interlocal contract may contract with a: (1) state agency, as that term is defined by Section 771.002; or (2) similar agency of a state that borders this state. (c) An interlocal contract may be to: (1) study the feasibility of the performance of a governmental function or service by an interlocal contract; or (2) provide a governmental function or service that each party to the contract is authorized to perform individually. (d) An interlocal contract must: (1) be authorized by the governing body of each party to the contract; (2) state the purpose, terms, rights, and duties of the contracting parties; and (3) specify that each party paying for the performance of governmental functions or services must make those payments from current revenues available to the paying party. (e) An interlocal contractual payment must be in an amount that fairly compensates the performing party for the services or functions performed under the contract. (f) An interlocal contract may be renewed annually. Consideration for this Agreement consists of the mutual covenants contained herein, as well as any monetary consideration which may be stated herein. This agreement is as follows, to-wit: I . As requested by the political subdivision named herein, Collin County, Texas, acting by and through its duly authorized agents and employees, agrees to provide said political subdivision with the following described governmental functions and/or services: ROAD MAINTENANCE IN ACCORDANCE WITH COURT ORDER NO. 90-589-07-30 (COPY ATTACHED) . II . As consideration for the above-described governmental functions and/or services, said political subdivision agrees to pay to Collin County, Texas, in accordance with the advance cost estimate submitted to them for work they have requested in the amount and upon the following terms and- __ conditions : : 1) PAYMENT IN FULL UPON COMPLETION OF WORK AND RECEIPT OF BILL FOR SAME. 2) . ( February 8, 2000 Issue Consider and act upon authorizing the City Manager to execute and award an emergency construction contract to Four D Construction in the amount of$180,864.83 to replace the potable water line and wastewater line in the alley between Third Street and Fourth Street between Butler Street and Park Street. Background The potable water line and wastewater line in the alley between Third Street and Fourth Street between Butler Street and Park Street have reached the end of their economic feasible lives. The replacement of both lines has been previously approved by Council as projects in the 1999 Bond Program. The potable water line, identified as Water Main Improvement Project W 1 in the 1999 Bond Program, is an old, cast iron main that has deteriorated to the point that water quality is adversely affected. Residents served by the line have complained about reddish discolored water received at their taps. The Public Works Department has flushed the line on a regular basis to remove any discoloration and sediment; however, the line is in need of replacement. The contractor for the proposed project will abandon the existing water line in place and install approximately 1,300 feet of new eight inch water line in the alley including new water meters, fire hydrants, and all related appurtenances. Residents will continue to receive water service from the existing line until the new line is successfully installed, tested, and disinfected in compliance with Texas Natural Resource Conservation Commission (TNRCC) regulations and City of Wylie Standard Construction Details. The wastewater line, identified as Sewer Main Improvement Project S4 in the 1999 Bond Program, has deteriorated beyond repair and has been identified as a source of inflow and infiltration into the sewer system. The proposed project includes replacement of approximately 1,300 feet of eight inch wastewater line in the alley and reconnecting the affected residents. Replacing the wastewater line at this time eliminates the need to disturb the newly replaced water line at a future date (the water line is located above the wastewater line). The City's consultant, The Hogan Corporation, accelerated the preparation of construction plans in order to expedite receipt of bids for the needed line replacements. The typical process for the advertising, review and award of contracts takes approximately six weeks. Efforts to improve the water quality in the project area should take place as soon as possible. The Texas Local Government Code sets out the competitive bidding requirements for municipalities. The Code provides for an exemption to the requirements in order for a municipality to make an expenditure for a"procurement necessary to preserve or protect the public health and safety of the municipality's residents". Background-continued By authorizing the City Manager to execute the proposed emergency construction contract, the City Council will make it possible to improve the quality of water delivered to affected residents and to improve the condition of the City's wastewater collection system. Financial Considerations This project can be funded from the FY99 Waterworks and Sewer System Revenue Bonds approved by the voters in May 1999. Funds are available to pay for these two projects (W1 and S2) from the $1,380,000 of revenue bonds sold in September of 1999. Other Considerations Texas Local government Code, Chapter 252.022 General Exemptions, grants municipalities the authority to by-pass the competitive bidding process in the name of preserving or protecting the public health and safety.
