Council Present:Mayor John Mondy, Councilman Joel Scott, Councilwoman Reta Allen, Councilman Eric Hogue, Councilman Merrill Young, Councilman J.C. Worley and Councilman Chris Trout. Staff Present: Anthony Johnson, City Manager; Mindy Manson, Assistant City Manager; Brady Snellgrove, Finance Director; Chris Hoisted, City Engineer; Claude Thompson, Senior Planner and Barbara Salinas, City Secretary. Reverend Ray Richie, First Baptist Church, was present to offer the Invocation and Councilman Eric Hogue was asked to lead the Pledge of Allegiance. The Mayor recognized the following Star Students for their exemplification of the Character Trait"Respect"as part of the Wylie Independent School District's Character Education Program. Aaron Dallas Canaday, son of Len and Mary Canaday, second grader from Akin Elementary; Cameron Rice, son of Terry and Drew Rice, fourth grader from Birmingham Elementary; Allison Cleere, daughter of Kenneth and Denise Cleere, Kindergarten class of Dodd Elementary and Andrew Dahir, son of Tracy and Russell Dahir, fifth grader from the Wylie Intermediate School. Unable to attend but still recognized were Ethan Prater, son of Frank and Dorothea Prater,third grader from Hartman Elementary and Whitney Rowell, daughter of Barbara and Ronnie Rowell, seventh grader from the Wylie Junior High. Capital Improvement Projects Update—Chris Hoisted,City Engineer Mr. Chris Hoisted, City Engineer provided Council with an update on the status of bond projects. Mr. Holsted provided detailed information on projects completed and those remaining. There was some discussion regarding specific projects and the prioritization of future projects. At Council's request, Mr. Hoisted concluded with the following bid letting schedule for TxDot Projects. Bid letting for project involving FM544/FM1378/SH78 is May of 2001; Bid letting for project involving SH78/FM544 and Eubanks is June of 2001 and bid letting for project involving FM1378/FM544 and Brown is February 2002, adding that this is a County Bond Project that will require a city match. Mr. Hoisted futher explained that bid letting consists of advertising for bids only and that construction could start within two months after. There was no participation from those in attendance. A. Approval of the Minutes from the regular meeting of October 10 and October 24,2000. A motion was made by Councilman Trout to remove the approval of the October 10,2000 minutes from the table. Councilman Hogue seconded the motion. A vote was taken and the motion passed,7-0. 1. A Resolution of the City of Wylie authorizing intervention in Railroad Commission Gas Utilities Division Docket No. 9173 and coordination with other Cities to advocate maximum refunds of gas cost overcharges. Mr. Brady Snellgrove, Finance Director, addressed this item. Consider and Act upon a Final Plat for the First Baptist Church Addition, proposed by Brockette, Davis & Drake, Inc., for the First Baptist Church of Wylie, for the property generally located within the southwest corner of Marble and Second Streets, between Ballard Avenue and Second Street, and being all of a certain 5.0 acre tract situated in the James Truett Survey, Abstract No. 920,City of Wylie,Collin County,Texas. • Mr. Clause Thompson, Senior Planner, addressed this item. Mr. Thompson provided Council with a brief background on the Final Plat. He stated that at the October 17 regular meeting of the Planning & Zoning Commission,the Commission voted favorably to recommend this case. Representative from the Engineering firm of Brockette, Davis and Drake, 4144 North Central Expressway and Brother Al Draper, First Baptist Church of Wylie,were present for any questions or concerns by Council Councilman Worley made a motion to approve the Final Plat for the First Baptist Church Addition, proposed by Brockette,Davis&Drake,Inc.,for the First Baptist Church of Wylie,for the property generally located within the southwest corner of Marble and Second Streets, between Ballard Avenue and Second Street, and being all of a certain 5.0 acre tract situated in the James Truett Survey, Abstract No. 920, City of Wylie, Collin County, Texas. Councilwoman Allen seconded the motion. A vote was taken and the motion passed, 7-0. 3. Consider and act upon a Preliminary Plat for the Greenway Addition,proposed by Pate Engineers for Greenway Investment Company,for the property generally located at southeast corner of FM 544 and Westgate Way,and being all of a certain 27.49 acre tract out of the E.C.Davidson Survey, Abstract No. 267,City of Wylie,Collin County,Texas. Mr. Claude Thompson addressed this item providing a brief background of the request. He stated that at the October 17, 2000 Planning and Zoning Commission meeting, the Commission voted 4-1 to favorably recommend this case. Council questioned the concerns of the Planning and Zoning Commission, with regard to the 4-1 vote. Mr. Thompson stated that the major concern was for off-site drainage and where excess would drain/pool. He explained that this is still being engineered as the site is developed, however, it was the major concern. The applicant, Jay Marsh of Pate Engineering,was present to address any concerns of Council. Councilman Worley made a motion to approve the Preliminary Plat for the Greenway Addition, proposed by Pate Engineers for Greenway Investment Company, for the property generally located at southeast corner of FM 544 and Westgate Way, and being all of a certain 27.49 acre tract out of the E.C. Davidson Survey, Abstract No. 267, City of Wylie, Collin County, Texas. Councilman Hogue seconded the motion. A vote was taken and the motion passed, 7-0. 5. Hold a public hearing to consider and act upon approval of a Replat for Railroad Addition, 1s` Revision, proposed by Jackson and Associates Land Surveyors, Inc., for the property generally located at the southwest corner of Masters Avenue and Fifth Street,and being all of a certain 1.496 acre tract, situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County,Texas. Councilwoman Allen abstained from any discussion and vote on Item No. 5 and completed the proper affidavit for Conflict of Interest. Background Section 853.003, Title 8 of the Government Code, of the Texas Municipal Retirement System Act provides for employees to buy-back forfeited service under certain conditions. The term forfeited service means that in the past an employee has left municipal service and elected to withdraw his or her contributions from TMRS. Those conditions are: • The actuary must determine that all of the TMRS obligations of the City including the Buy- Back ordinance can be funded within the maximum contribution rate and amortization period. • The City must adopt the Buy-Back provision by passing an ordinance. • The employee must be an employee of the City and a member of TMRS on the day the ordinance is adopted. • The employee buying back forfeited service must have at least 24 consecutive months of service with the City since being reemployed. • The employee must pay back the amount of money he/she withdrew from TMRS plus a 5% per year penalty. The deposit of the amount previously withdrawn by the employee shall be credited to his or her individual account in the employee❑s savings fund of the System. The 5% per year penalty is forfeited by the employee and is credited to the City❑s municipality accumulation fund. Other Considerations N/A Financial Considerations There should be no immediate financial impact upon adoption of the proposed Buy-Back Ordinance. Financial impact will only occur for the City when and if an eligible employee elects to buy-back their forfeited service and makes a deposit to TMRS. WHEREAS, the actuary of the Texas Municipal Retirement System has determined that all obligations charged against the City's account in the municipality accumulation fund, including the obligations arising as a result of this ordinance, can be funded by the City within its maximum contribution rate and within its amortization period;and WHEREAS, the City Council has determined that adoption of this ordinance is in the best interest of the City, now therefore, WHEREAS, the City Council of the City of Wylie, Texas finds that it will be in the public interest for the City to have its employees participate in the Texas Municipal Retirement System as hereinafter provided; now therefore, BE IT ORDAINED by the City Council of Wylie, Texas: Section 1. Pursuant to Section 853.003 of Subtitle G of Title 8, V.T.C.A. Government code, as amended,the City of Wylie hereby elects to allow any member of the Texas Municipal Retirement System who is an employee of this City on the day of , who has terminated a previous membership in said System by withdrawal of deposits while absent from service, but who has ast least 24 months of credited service as an employee of this City since resuming membership to deposit with the System a lump sum the amount withdrawn, plus a withdrawal charge of five percent(5%) of such amount for each year from date of such withdrawal to date of redeposit and thereupon such member shall be allowed credit for all service to which the member had been entitled at date of termination of earlier membership, with like effect, as if all such service had been rendered as an employee of this City, whether so rendered or not. The City agrees to underwrite and hereby assumes to obligations arising out of the granting of all such credits and agrees that all such obligations and reserves required to provide such credits shall be charges to this City's account in the municipality accumulation fund. The five percent (5%) per annum withdrawal charge paid by the member shall be deposited to the credit of the City's account in said municipality accumulation fund;and the deposits of the amount previously withdrawn by the member shall be credited to his or her individual account in the employees savings fund of the System. (Zoning Case No. 2000-07) Background The applicant is requesting rezoning of a 5 acre tract in order to develop a portion of the property for light industrial uses. Specifically, the applicant proposes to construct a single story building of 12,000 square feet to house the operation of his precision sheet metal fabrication business. The applicant earlier submitted a request to rezone the property to straight Industrial District. However, that request has been converted to Planned Development District in order to restrict the potential for incompatible uses and conditions, which were considered unacceptable by both the applicant and staff. The properties to the immediate north, west and south are vacant and zoned for A (Agriculture) uses. The property to the east is zoned and developed for I (Industrial) uses. Public Comment Forms were mailed to seven (7) property owners within 200 feet of this request. No Public Comment Forms have been returned. Financial Considerations Rezoning application fee - Paid Other Considerations 1. The Comprehensive Plan recommends Business Center land use for the area. The Business Center category is intended to accommodate professional office and clean manufacturing and assembly light industrial uses. The proposed development plan and conditions are consistent with this recommendation of the Plan, and the conditions of the Planned Development District restrict the potential for incompatible development. 2. The applicant intends to develop approximately one(1) acre of the total 5-acre tract, as reflected on the Detailed Site Plan. The remainder of the property is largely occupied by floodplain of Muddy Creek and is not developable. The applicant purchased the 5 acres to satisfy the City requirement that Planned Development Districts be at least 5 acres in size. The adjustment to the floodplain proposed by this development complies with the approved floodplain requirements of the Federal Emergency Management Agency. 3. Additional right-of-way for the widening of Sanden Boulevard is to be dedicated by the earlier owner (Birmingham Land Trust), and the subject property will ultimately front on the improved Sanden. Until construction of the future roadway is completed, an access easement connects the subject property to Sanden. 4. The applicant is aware that a Final Plat for the property must be approved prior to obtaining a permit to begin construction. The Detailed Site Plan will serve as a Preliminary Plat. Marshall Survey, Abstract No. 594, City of Wylie, Collin County, Texas. (Zoning Case No. 2000-09) Background The applicant is requesting rezoning of a 45.192-acre tract to a Planned Development District in order to develop a master planned residential community. Specifically, the proposal is to create a total of 64 single-family residential lots, 32 of which will be a minimum of 10,000 square feet and 32 of which will be a minimum of 12,000 square feet. The concept also provides for a 17.0-acre public park and additional right-of-way for the expansion of Parker Road (F.M.2514). The properties to the west, north and east of the tract are sparsely developed in low-density large-tract single-family residences. The property to the south is undeveloped. The lands to the west and south are within the City of Parker and lands to the north across Parker Road are within the City of Lucas. Public Comment Forms were mailed to nine (9) property owners within 200 feet of this request. No Public Comment Forms have been returned. Financial Considerations Rezoning application fee - Paid Other Considerations 1. The Comprehensive Plan recommends low-density Country Residential development for this property. Country Residential is defined as allowing single-family detached houses on one-acre lots, served by streets with no curb and gutter or sidewalks to maintain the rural character. Smaller lots are permitted if gross densities do not exceed 0.75 dwelling units per acre. The proposed concept plan reflects a gross density of 1.4 dwelling units per acre, and is, therefore, not fully consistent with the recommendation of the Future Land Use Plan. 2. However, the tract is situated between the drainage systems of Muddy Creek and Turner Branch, and this isolated location buffers it from neighboring lower-density rural developments. The proposed density and development standards are consistent with the Suburban Residential recommendations of the Comprehensive Plan. 3. This proposal was filed prior to the adoption of the new residential districts and development conditions of the Zoning Ordinance and may legally comply with the requirements in place at that time. A 50 feet wide easement for access is also provided for future access to developable property to the west within the City of Parker. 8.
