I have been instructed to acquire the necessary R. O. W.
dedications for the installation of the above referenced
project . I have made initial contact with the propertv
owners alonq the route with out beinq rejected outright, but
thev are not willinq to siqn over the necessary R. O. W.
because they are afraid that they will be charged for the
improvements. I need the council to give me a direction in
which to negotiate with these property owners. I would like
to remind vou of the importance of the timing of this
project because it directly affects the New Municipal
Complex. Please place this item on the next council agenda.

Dear Sir:
It is our intention to proceed and complete the project at the earliest possible
date. Our lender on the project is concerned due to the various problems and
would like for us to spell out what the problems are and how we are going to
resolve them with the city. During our workshop meeting with the mayor and city
council , my understanding is that the following items must be done before the
city council will vote to allow the acceptance of the project. I am listing
the items according to the memorandum that you supplied the city council at the
meeting.
1. Brunson Claim - My attorney has worked out a hold harmless agreement with
the city's attorney regarding this matter which hopefully will satisfy you, the
mayor and the city council .
2. Daystar Sales - Again, my attorney and the city attorney have worked out
a hold harmless agreement which hopefully will satisfy you and the city council .
3. Petition from Collin County - Last week we met with the county maintenance
supervisor concerning problems with the road. We have come to an agreement with
them concerning repairing. It is my understanding that if the county is satisfied,
the city will be satisfied so we will proceed satisfying the county.
4. Oversize Differences - After the city council meeting, I talked to your acting
city engineer, Ron Homeyer, concerning this problem. He agreed that in addition
to the $58,766.01 that I was due for the oversize across the front of the mobile
home park. He was to give me a final figure but he has not done so. He may be
waiting for you as city manager to verify the new amount. Would you please check
into this and advise.
5. Onsite Drainage Ditch - Again, my attorney has agreed to a hold harmless
agreement with the city attorney concerning this item and hopefully this will
satisfy the major and the city council .

6. Sewer Fees - During our workshop session with yourself and the city council ,
we discussed running the offsite sewer line approximately two miles on Hwy. 544 in
lieu of going through the Allard tract. We are agreeable to this change but due
to the increased sewer fee cost, we would like to install this system 100%
ourselves. We understand that we would have to satisfy the City of Wylie inspectors
on the installation of this line.
7. Sewer Pumping - We are agreeable to pumping sewer until the sewer line we are
going to install down Hwy. 544 is operational at no cost to the city.
8. Interior Water & Sewer Lines - We realize that these have not been accepted
by the city but we are very close to having this system complete. When we
start back to work, we should have this ready within a week.
9. Maintenance Bond for Interior Water & Sewer - I am going to put up this bond
myself but we have to have the water/sewer lines accepted before the bonding
company will issue the bond as it has to have a date on it.
10. Staging of Park Opening - As stated at the workshop session, this was
strictly my idea as I was hoping to get the park opened as soon as possible.
Please disregard this item. It is now our intention to complete the project 100%,
obtain city acceptance and open same.
To my knowledge, the above are all the items in contention. If you agree, I
would appreciate it if you would sign in the space provided and return a copy to
me. What my lender is trying to find out is if to date these are the only
problems to resolve and if we complete them in a workmanship manner, the city will
agree to accept the facility and allow us to open. Perhaps you would like to
write a separate letter concerning these item . Whichever you prefer will ,be fine
with us.

RE: Eubanks Lane Re-paving and Sewer Line down SH78 and
Eubanks
Attached you will find the work sheets for cost and shared
as well as the engineering that was necessary to put the
City in the position to begin to solve the dilemma created
by these two situations.
For your background information, you will recall that
currently there are two businesses producing sewage in this
location that are served by our pumper trailer. They are
Steaks Over Texas and the pizza/baithouse location. Both of
these businesses have been informed that they would be
expected to participate in the cost of a sewer line
installation. To this point, they have agreed that they are
ready to do so. In addition, Eubanks Lane is an unpaved
narrow street which has some property within the city limits
and some without along its length. At the end of the street
is an industrial park that is being developed by one Baron
Cook. Mr . Cook has approached the Council about getting
that street paved using our method of reconstruction. The
Council formally agreed with the project and Mr. Cook
offered to pay more than his fair share in order to get the
project going.
The engineering, surveying, cost analysis and all other
calculations have been completed and are now ready for
presentation to the Council so that they may approve one of
the various methods and instruct the staff to then proceed
along the lines of their decision.
Regarding the street paving, the job done with a 2 inch
overlay will run $90,000.00, with the City' s share being
$57,000 .00 and the adjacent property owners on each side
having a share of $16,500.00 each. If this street were
placed without the asphalt overlay, that would yield a cost
savings of some $23,000.00 which would reduce both the
City' s cost and the share by a significant amount of
slightly less than one-third (see enclosure) . You should
recall that Mr. Cook had offered to pay more than his fair
share and since that is the case, I would suggest that Mr.
Cook pay a portion of the City' s cost. That portion should
be determined by the Council since there is no specific
logic to recommend an amount . Further, the Council should
be aware that among the various participants is the Eubanks
family who are notorious for being non-participaters. Thus,
the Council should be forewarned that they should expect not
only a fight but also no financial contribution from this
group. Those facts are particularly important when you see
from the study how large their frontage is and that we do
not have the full width dedication that is really needed to

do the street project properly. In addition, they are not
within the city limits. While it will be a considerable
battle, I would recommend that if we do not receive willing
cooperation from the Eubanks family, that because the
project is so basically important to the community, we
should prepare for a fight and move to annex the property
and condemn the easement necessary. It is my belief that
you will find all other parties willing to participate
without significant hassle.
Regarding the sewer line, the total cost of that project is
$86,880.08. The cost breakdown analysis is included in the
packet. As you can see on the breakdown, we have analyzed
the cost distribution using three separate methods. The
first method being the very standard front foot method. The
second method is by gross acres served and the third method
is a pro-rated method based upon line input and location
along the line. We would recommend that the cost be
allocated to the various principals based upon the third
method. Our reason for doing that is that that method we
believe to be most inherently fair and logical . For
example, under the acreage method, each acre pays the same
whether it sits immediately adjacent to the existing line or
is a half mile away. That seems unfair. Under the front
method, some properties that have limited acreage have huge
front footage or vice versa and therefore are penalized
under that method. It is the third method that takes as
many of those factors as possible into consideration and
allocates the cost accordingly. Thus, the staff would
recommend that the Council decide upon that method of cost
allocation and they instruct the staff to send letters
obtaining committments to the various property owners
indicating the third method of allocation. In addition, the
staff would recommend that if certain parties choose not to
participate, particularly Steaks Over Texas and the
baithouse, they should be warned that non-participation will
release the City from the committment to continue to pick up
their sewage and they should find alternate methods for
taking care of that problem. The new City Hall could be
served by only a line down Eubanks or by a small temporary
pump station over to the Windham area. So the City is not
in the position where such an expenditure can be made by the
property owners to be mandatory on our part.
Because of the complexity of this problem, I am forwarding
this information to you immediately so that you may have
time to adequately review the material and ask any questions
which you may have. Since the timeliness of the project is
of some importance, I have tentatively placed this item on
the agenda for April 28th hoping that will allow adequate
time for the Council to feel comfortable about their
decision. Should you require additional information, please
do not hesitate to contact my office.

our old unusable equipment. There was one (1) item that
failed to get on the list at that time.
I would like to, with Councils permission add a 1972 Dodge

dispose of it also.

Re: Disposition of Unused Property
Dear Gus:
You have asked me for an opinion concerning the method of disposing of several
pieces of old equipment belonging to the city that the city no longer needs. You stated
that this is not a significant amount which would justify public auction, but that the
city did need to dispose of it in some way.
Have the City Council make a motion which would be reflected in the minutes
making a determination as to what the current market value is for the property to be
disposed of. They should make this determination even if the value that they set is
some negligible amount. You could then dispose of the property at private sale for an
amount not less than the amount established by the City Council so long as the purchaser
is someone not associated with the city.
If the property has no value at all or a value so small that it would be uneconomical
to even attempt to try to sell the property, then have the City Council make that
determination and the property could be sold for $1.00, given to another city who might
be able to use the property or junked.
Since you have not specifically listed what items of property you are talking
about, on retrospect I should advise you that if the property involved concerns weapons,
liquor, or any matter that the Police Department has acquired as evidence or which
has been impounded by the city and is considered abandoned property, then we would
need to take a different approach.
