Regular Hearing
1. Consider, and act upon, a request for a variance to section 22.243 of the City of Wylie
Fence Ordinance from Shane Colley a representative of the City of Wylie located at 2000
N. Highway 78, seeking an appeal for a denied permit application due to the barbed wire.
Section 22.243 states that in no event shall barbed wire be permitted, except on arms in
industrial zoning districts. The request is to install extension arms and 3-strand barb wire
at the top of the fence. This property is zoned Commercial Corridor.
2. Consider, and act upon, a request for a variance to Ordinance 2002-05. Section VD (1)
of the Engineering Design Manual from the homeowner at 303 W. Brown, seeking an
appeal for denied permit application of their driveway addition. Ordinance 2002-05
Section VD (1) regarding the driveway design standards for residential streets. It states
that driveway approaches shall not occupy more than 70% of the frontage of the tract. It
also states that based on a 30 mph design speed, the driveway spacing should be at least
80 feet. The request is to install a circular driveway. It spacing should be at least 80 feet.
The request is to install a circular driveway; the lot width appears to be only 60 feet.

Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the
Emergency Secure conducted on March 1, 2013
2. Hold a public hearing, consider, and act upon providing evidence, seeking a
determination that a building(s) located at or near 308 Lake Travis, Twin Lakes #3, Block
K, Lot 5, Wylie, Collin County Texas was in violation of standards set out in Ordinance
#2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14

CALL TO ORDER
Chairman Brian Huddleston called the meeting to order and that a quorum was present.
Board members present with the Chairman were Board Member Billy McClendon, Board
Member Zachary Herrera, Board Member Sunil Verma and Board Member Michael
Grubbs.
Staff present was Code Enforcement Officer Pat Mitchell, Secretary Leisa Price and
Interim Building Official Todd White.
CITIZENS COMMENTS
Chairman Huddleston opened the Citizens Participation. With no one approaching the
Commissioners, Chairman Huddleston closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the November 20, 2012,
Regular Meeting.
Board Action
A motion was made by Board Member McClendon, and seconded by Board Member
Verma. Motion passed 5-0.
REGULAR AGENDA
Regular Agenda
1. Consider, and act upon, a request for a Sign Appeal Hearing from B & B Theatres
located at 711 Woodbridge Parkway. Seeking an appeal for (4) sign permits denied
on March 26, 2012. B & B Theatre is requesting a variance of the City of Wylie Sign
Ordinance Section 22-447(1)c 1-2. The request is to install (1) 160 sq ft sign, (1) 93
sq ft sign, (1) 96 sq ft sign, and (1) 144 sq ft sign. Total signage requested in 493 sq
ft. Per the sign ordinance only 360 sq ft of signage would be permitted. The request
is to allow the additional 133 sq ft of signage to be installed on the building.

Dennis McIntire, B&B Theaters, the applicant, gave a presentation showing where all
four signs will be located. The sign ordinance requires 360 square feet and the
variance is for 493 square feet. This is a 4.4 percent of mass of the total front
building. The building is 45 feet tall. The signs will all be reversed illuminated halo
lights, which will not shine on property across the street.
Board Action
A motion was made by Board Member Herrera, and seconded by Board Member
Verma, to approve the sign variance. Motion carried 5-0.
2. Consider, and act upon, a request for a Sign Appeal Hearing from Wylie Outdoor
Power located at 303 E Marble. Seeking an appeal for (1) sign permit denied on
January 11, 2013. Wylie Outdoor Power is requesting a variance of the City of Wylie
Sign Ordinance Section 22-447(1)c 1. The request is to install 320 sq ft of combined
signage on the Hwy 78 side of the building which is not the building frontage.
Staff Presentation
Michael McMeans, Wylie Outdoor Power, the applicant, is requesting logo branding
for the building. Logo branding is a requirement by the franchise. The letters for the
sign will be surface mounted and non-illuminated. The Highway 78 side of the
building is the main source for advertisement and is not accessible to the building.
Mr. Sam Satterwhite with the Wylie Economic Development Corporation, spoke in
favor of the request.
Board Action
A motion was made by Board Member Grubbs, and seconded by Board Member
Herrera to approve the sign request. Motion carried 5-0.
3. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 2717 Lake Terrace, Pheasant Creek Phase 2, Block A, Lot 30, Wylie,
Rockwall County, Texas was in violation of standards set out in Ordinance #2008-49
DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the
City of Wylie, Texas; and seeking an order of approval of the Emergency Secure
conducted on July 25, 2012.
Staff Presentation
Ms. Mitchell stated that the garage door was found to be opened at 2717 Lake Terrace.
The water heater was stolen and there were high grass and weeds. Liens have been filed
on this property and have not been paid. The property is still vacant and secured.

Collin County Texas was in violation of standards set out in Ordinance #2008-49
DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the
City of Wylie, Texas; and seeking an order of approval of the Emergency Secure
conducted on July 26, 2012.
Staff Presentation
Ms. Mitchell stated that the property located at 1407 Sheppard Lane, the rear of the house
had been entered and the house was vacant. An emergency secure was done on the back
door. All liens have been paid.
Board Action
A motion was made by Board Member Verma, and seconded by Board Member Grubbs to
approve the emergency secure for 1407 Sheppard Lane. Motion carried 5-0.
5. Hold a public hearing, to provide evidence, seeking a determination that a building(s)
located at or near 816 Forest Edge Ln, Quail Hollow Estates #1, Block OOE, Lot 9,
Wylie, Collin County Texas was in violation of standards set out in Ordinance #2008-
49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the
City of Wylie, Texas; seeking an order of approval of the Emergency Secure conducted
on September 14, 2012.
Staff Presentation
Ms. Mitchell stated that the property located at 816 Forest Edge Lane was vacant and
unsecure. In addition to being unsecure the property was not maintained. The swimming
pool was also treated for mosquitos. All liens have been paid

A motion was made by Board Member Verma, and seconded by Board Member
McClendon to approve the emergency secure for 816 Forest Edge Lane. Motion carried 5-
0.
6. Authorizing the Chairman of the Construction Code Board to sign the final orders
prepared by City staff as long as such final orders are consistent with the orders
issued by the Construction Code Board on March 7, 2013.

A motion was made by Board Member Herrera, and seconded by Board Member Verma
to authorize the Chairman to sign the final orders. Motion carried 5-0.

Discussion
The applicant is requesting that extension arms and 3 strand barbed wire be allowed at the Public Safety
Building located at 2000 N. Highway 78 Wylie TX 75098.
The applicant feels it is necessary to provide security to the vehicles and equipment that are stationed at this
location and to provide security for officers as they transport prisoners to and from jail.
City of Wylie Fence Ordinance section 22.243 states that In no event shall barbed wire be permitted, except on

ISec. 22-243. - Barbed wire.
In no event shall barbed wire be permitted, except on arms in industrial zoning districts.

ISec. 22-244. - Inspection of new fences.
When any fence for which a permit has been issued under this article is completed, it must be
inspected.The building official's office shall be notified upon completion of the fence.The building official
will issue a card of acceptance if the fence complies with the provisions of this article, or reject the fence if
it does not so comply.

ISec. 22-245. - Maintenance.
All fences constructed under the provisions of this article shall be maintained so as to comply with
the requirements of this article at all times.

ISec. 22-246. - Appeals from decisions under this article.
Any appeal from an interpretation of the building official of the provisions of this article shall be

ISec. 22-247. - Enclosures for swimming pools.
(a)
Required. Every swimming pool, or excavation designed or intended to ultimately become a
swimming pool,while under construction as well as after completion, shall be continuously
protected by an enclosure surrounding the pool or excavated area in such a manner as to make
such pool or excavated area reasonably inaccessible to small children or animals.
(b)
Exceptions to subsection (a)of this section. Exceptions to subsection(a)of this section are as
follows:
(1)
Subsection (a)of this section shall not apply to bodies of water other than swimming
pools which are owned or controlled by the federal, state or county government, or any
agency, subdivision or department thereof; or bodies of water located in natural
drainageways

Discussion
The request is to install a circular driveway. It appears that the lot width is only 60' therefore there is not an
opportunity to install a second driveway approach.
Ordinance 2002-05 Section V D (1). It states that driveway approaches shall not occupy more than 70% of the
frontage of the tract. No more than two driveway approaches shall be permitted on any parcel of property on
each street. It also states that based on a 30 mph design speed, the driveway spacing should be at least 80 feet
The City of Wylie Engineer has reviewed the plans and does not oppose the circular drive due to the Brown
Street Road Construction Project.

D. DRIVEWAY SPACING AND LOCATION IN RELATION TO OTHER DRIVES
(1) Residential
Driveway approaches on a tract of land devoted to one use shall not occupy more
than 70% of the frontage abutting the roadway. No more than two driveway
approaches shall be permitted on any parcel of property on each street.
(2) Commercial and Industrial
The spacing and location of driveways shall be related to both existing adjacent
driveways and those shown on approved development plans. The spacing between
driveways shall depend upon the design speed of the street as shown Table 7.
Driveways shall not be permitted in the transition area of a deceleration lane or a right
turn lane.

E. DRIVEWAY SPACING IN RELATION TO A CROSS STREET
(1) 90 Degree Intersection - Drive to Road
a) Driveways that intersect at 90 degrees to a residential or "secondary street" shall be
located a minimum of the drive radius from a residential street's end of curb radius.
b) A driveway that Intersects at 90 degrees to a residential or secondary street shall be
located a minimum of thirty (30) feet from a secondary or major street's end of curb
radius. (see Detail (a), page 19)
