Tonight' s workshop is so that the Council may become more
knowledgable of the problems with the Lake Ray Hubbard Mobile Home
Park. They are as follows:
1. Off-Site Water/Road
a. Brunson Claim -This claim has been turned over to our
general liability carrier (Fielding Reinsurance Ltd. ) and is being
addressed by an adjuster. Mrs. Brunson filed a claim against the
city and has not actually specified the amount. A figure of $3500
has been talked about. Mrs. Brunson hit a pile of dirt in the road
that she says was left there by Reed Construction, when installing
the water line. She is claiming leg and knee injuries and damage
to her ' 82 Firebird. No police report was filed, as we were
apparantly later notified of the accident. (See attached - Exhibit
I) .
b. Day-Star Sales (See attached - Exhibit II) This letter /,-0../N
states that they intend to file a lien on Lake Ray Hubbard Mobile % •
Home Park in the amount of $68, 242. 23 (supplies and materials for -x"'(`
water line) .
c. Petition from Collin County - (Exhibit III) County Road
381 was put in with County labor, however, the road was paid for by
adjacent property owners. Please see the letter, stating terms and
conditions of line installation. The contractor, Reed
Construction, slotted the road in numerous places with a backhoe
trencher, because of improper pads. Road 381 was also damaged
along the sides in many places, by the trenching. Last week,
members of the City staff met with Ruben Delgado, P. E. (assistant
Director of Public Works - Engineering, Collin County) and some of
his people, regarding this matter. The City staff promised our
immediate attention to the problem. A subsequent meeting was held
with John Reed and Ron Homeyer to discuss the problem. The county
people are to be here again tomorrow (May 5th) to discuss the issue
again and meet with Ron Homeyer.

d. Oversizing Difference - Encl .sed is a copy (Exhibit IV) of
the water line oversizing costs and our proposed reimbursement.
Apparently, there is some disagreeme, in the amount (See Finholt
letter of May 1, 1987 - Exhibit V) .
2. Off-Site Drainage/Sewer/On site
a. The drainage ditch problem, involves Mr. Allard, adjacent
property owner to Lake Ray Hubbard Mobile Home Park. The city j4•'.LLe{;,
staff feels that if the City accepts the mobile home park with the
drainage problem, which we believe has been caused by the park' s (
construction, consequently resulting in damage to Mr. Al lard' s ''1 �J `+F
property, we may be assuming liability. (See city letter datedr
April 27, 1987 to Mr. Jackson, City Attorney - Exhibit VI ) .
b. Sewer fees - Since the district (Cottonwood Creek Lift
Stat ion) has not been created, nor the fees set ; The staff feels,
along with our attorney that the city has the right to establish j ZA,..4„
the fees, no matter what budgetary figures were given to Mr. j ___
Finholt by Gus or myself, and hold them to it. _______
c. Interior water/sewer lines have not been accepted by the
City, nor a maintenance bond posted.
d. Staging of park opening - Mr. Finholt wants to open the
park in stages, so as to minimize our sewer problems. Any phasin r^
on the park would have to have been done in the planning stag ,,7 .+c .,i
(site plan, prior to construction) , rather than after construction ) ?'
An amended plat plan showing amended development would, as i
appears to me, have to be filed with P & Z, and then to the Counci
for the staged opening of the park. (Roy Fiares, Code Officer wi
be available for this one) . --------
Additionally,` Mr. Jackson was at City Hall, Friday, May 1, 1987,
and was briefed on these items, as well as visiting the site and
the road.

Article 18, Section 8 - Damage Suits of the Charter of the
City of Wylie states before the City shall be liable for any
claim for damages for the death or personal injuries of any
person or for damages to property, the complainant or his
authorized representative shall notify the City Secretary.
The notification shall be in writing and shall state
specifically how, when and where the death, injury or damage
occurred; the amount of loss claimed; and the identity of
any witnesses upon whom it is relied to establish the claim.
The notification shall be filed within forty-five (45) days
of the date of injury or damage or , in the case of death,
within forty-five (45) days of the date of death. The
failure to so notify the City within the time and manner
specified shall exonerate, excuse and exempt the City from
any liability whatsoever. No action at law shall be brought
against the City until at least sixty (60) days have elapsed
since the date of notification.

As per our telephone conversation of this date , I am sub-
mitting the following information to you regarding the
"Lake Ray Hubbard Mobil Home Estates , 0ff-Site Water Project" .
The line is currently owned by Mr . Roger Finholt of Big D
Construction Co . and was installed by Mr . John Reed of Reed
Contractors . We supplied the materials for construction .
As of this date there remains $68 , 242 . 23 of unpaid invoices
dating back to February of this year . Naturally we are con-
cerned about payment of these invoices . Anything that the
City of Wylie can do to assist us in this matter will be
appreciated . Possibly a joint check could be issued to Reed
Contractors and Day-Star Sales , Inc . We would then issue a
check to Mr . Reed for the balance after the cost of materials
has been taken out . After we receive payment we will issue
a full release of lien to Reed Contractors and the City of
Wylie .

Dear Mr. Santry:
On November 25, 1986, Commissioners Court issued Court
Order 86-980-11-25 authorizing the installation of a
waterline by the City of Wylie within the prescriptive
right-of-way of County Road 381 . We define the prescriptive
right-of-way to include the backslope of the ditches. (A
copy of the Court Order is attached) .
Please note that in the Court Order there are certain
conditions that must be complied with:
1 ) No damage will occur to county roads as a result
of the waterline installation; if roads are
damaged, they will be fixed to the satisfaction of
the Department of Public Works.
2) The Department of Public Works must be notified
prior to beginning any construction;
3 ) The lines should be installed in the backslope of
the ditch;

4 ) Drainage along the county road must not be
obstructed so as to damage the county road;
5) The County is not responsible or liable for any
damages caused by the installation.
None of the above conditions have been met . We feel
that the City of Wylie and the contractor are trying to
comply with the conditions and prevent any long-term damage
caused by the undermining of the road due to the excavation
of the waterline along the edge of the road surface. We
also feel that the City and contractor will repair both the
base and the surface to the satisfaction of the Department
of Public Works.
Please let us know of your plan on how the damage to
the road will be repaired so we may properly respond to
complaints by citizens who live on County Road 381 .

Currently , a development south east of Wylie in RocKwall County
needs a 12 inch water line . The City of Wylie has approved this
development , and we assume the county gave them the easemerrit for the
water line .
In the process the heavy equipment and the bacKhoe 's legs have left
holes in the pavement approximatly every 6 feet .
• We expect an increase in traffic from this development; therefore ,
the road should be completely repaved .
Collin County tax payers shouldn 't have to pay the bill for road
repair due to a RocKwall County development .

Dear Larry,
In follow-up to our conversation on Friday, I am enclosing a letter
from Roger Finholt regarding his development, Lake Ray Hubbard
Mobile Home Park.
There are several problems with the park, namely drainage and
providing for sewage. He also asked for the city to allow him to
"stage" the opening of his park, that is to allow him so many
spaces to be rented. For sake of illustration, I' ll use 35 spaces
for stage one and so forth.
Please examine the letters carefully from Mr. Finholt. I am
concerned about the city' s liability regarding the off-site
drainage. Mr. Finholt wants the city to approve and accept the
park, however, I believe that if the city does, we may create a
liability problem with the adjacent property owner.
Additionally, Mr. Finholt has stated that Gus made a verbal
commitment of $175. 00 charge per space for lift station fees on the
park. The cost of that line is approximately $1OO,OOO. With 225
spaces (lot) times $175.00, his costs would be $39, 375. 00.00. Our
latest calculations indicate the fee to be $425. 00 (approximately)
per lot. Furthermore, the lift station ordinance creating the
district has not been approved by the Council, nor the fees
established.
I also believe that the Council is not receptive to pumping the
holding tank on site. See also enclosed, letters from the
Department of Health.

Finally, what are the arrangements in regard to the landfill and
our meeting with the State?
Please call me, as I believe you need to review the materials in
this case as soon as possible.

Dear Sir:
In regards to our meeting and conversation of yesterday afternoon, after giving
this situation some further thought and discussing this at length with my
attorney, we have come to the conclusion that the drainage ditch has absolutely
nothing to do and should have nothing to do with holding up the opening of
this project. The city engineering department did in fact approve our construction
project and the drainage system as a good and sound system and it has in fact been
built; so consequently nothing the city does from now on will( change the drainage
or any responsibility for the drainage system. Moreover, I would like to point out
that the adjacent property owner decided to sue me and not include the City of
Wylie in the lawsuit.
To be quite frank about it, I feel like the City is trying to hold up my project
because of the sewer situation and as I previously stated to you at the meeting,
I cannot afford to allow this to happen. I have eight mobile homes that are
supposed to be moved in by the 30th of April. That was the reason I needed to
be put on the agenda for the meeting of the 28th and I have twenty more homes
to be moved in the month of May. I cannot afford to allow this situation to drag
on and on. As you are aware, I have always tried to and have worked very
closely with the City of Wylie on this project and have bent over backwards in
this endeavor. This situation must be brought to a head now as any further
delays will cause me to consider taking other legal action, which I would prefer
not to do.
I am going to push to get the entire project completed in the next two weeks and
the City of Wylie needs to tell me what I need to do with the drainage ditch so I
can appear before the City Council no later than the 12th of May for approval.
This means I must be on the agenda by the 5th of May. I need to have something
in writing from the city before May 5th in regards to both the drainage ditch and
the sewer situation. If a further meeting would help, I would be glad to come to
the city anytime you desire.
I understand from my conversations with the city and the adjacent land owner, Mr.
Allard, that the Allard lawsuit has been settled; and that any such matter is now
between me and Mr. Allard. Whether the city allows me to operate this park or not
should have nothing to do with the city having already approved the construction
project and the drainage plans. The city needs to make up its mind that pumping

sewerage will be necessary for a short period of time until the sewer system
is installed.
I am still agreeable to phasing the park in six stages as shown on the map I
submitted to you this past Tuesday. This way the city could control how much
sewerage they pumped although I would have to have an understanding that at
least one-half of the park would be released within the next three months.
What am I going to do about these eight mobile homes I have that are supposed
to be moved into the park by the end of this month? Are you going to allow me
to put these in the park on a temporary permit?
Please advise as soon as possible in view of the importance and urgency of this
situation.

Dear Sir:
On the 28th of April, I would appreciate your putting us on the City Council
agenda for approval by phases of Lake Ray Hubbard Mobile Home Estates.
Attached is a drawing showing the park broken down into six phases. We
request approval of Phase I at the City Council meeting on April 28th.
If the City, Engineering and Planning Department and the City Council will
approve this phased method for the park in some fashion, I will be agreeable
to limiting the number of mobile homes to be put into the park. I understand
we could put up 125 units in the park and the city could still pump sewerage
for this many especially if they are senior citizens. It is my understanding that
the sewer line will be available July 1, 1987 and this will prevent the city from
having to hire any additional pumping facilities and enable the water department
to use their own pumping truck.
By the 21st of this month, we intend on having all of the water and sewer com-
plete and accepted by the engineering department, the drainage completed (subject
to the easement being signed by my neighbor to the west) and Phase I completed
in its entirety.
Please advise if we can be put on the agenda for the 28th of April meeting.

We are in receipt of your letter dated February 2, 1987, requesting approval
for "honey wagoning" sewage from new subdivisions, businesses or residences on
a temporary basis until a more permanent sewage conveyance system is
constructed. Although the use of "honey wagons" is discouraged, this
Department will offer no objection under the following conditions:
•
1. The holding tanks are fenced with controlled access.
2. Two haul trucks are continuously available for the City.
3. Dual holding tanks are provided at each site, each tank sized for
24-hour storage.
4. Holding tanks shall have a high water alarm system with automatic
switch-over to the spare tank.
5. Once a tank alarm system has been enacted, the tank must immediately
be emptied by the City.

Dear Mr. Santry:
After further discussions with the staff of the Texas Water Commission, we
would like to add the following conditions to those of my March 20, 1987
letter in regard to the subject operation:
1. Sewage hauling must be performed by city-owned vehicles or by a
licensed private firm.
2. Sewage spills are prohibited. Accidental spills must be removed
and treated with granular chlorine disinfectant.
3. Only typical domestic sewage is allowed to be trucked-hauled.
4. Disposal of the trucked sewage at the City of Wylie Wastewater
i ' Treatment Plant can only take place during times when the treatment
facility is receiving low wastewater flows.
5. Stored sewage must be kept in an aerobic condition with the
dissolved oxygen maintained at 1.0 mg/l.
6. Sewage hauling is allowed to- serve only those areas which are 2,000
feet or more away from the nearest sewerage facility and that are
within the city limits. The maximum volume of wastewater to be
hauled shall not exceed 9,000 gallons per day.
7. Sewage hauling shall not be approved after March 20, 1988.

Dear Mr. Johnson:
As previously discussed with you, we need to resolve all our problems so we may
open our facility as soon as possible. In regards to our meeting on Monday night,
it is my understanding that the problems to be resolved are as follows:
OFFSITE WATER
1. The city seems to be worried about a proposed lien by Day Star Sales for
materials. To briefly explain this situation, our subcontractor, John Reed, in his
contract is paying Day Star Sales, the material supplier, out of the portion of
money that comes from the city for oversizing, so consequently, he cannot pay
Day Star Sales until the city pays their portion. I think this can be resolved by
a simple legal instrument between the city and myself.
2. There apparently is a problem with the county on an asphalt patch along some
of the route that John Reed installed the offsite water line on. We have met with
the county and we will have a conclusion on this next Tuesday.
3. I received second-hand information that some woman claims John Reed, the offsite
contractor, owes her $3,500 due to damage sustained on her car when she hit a mound
of dirt apparently when Reed was installing the water line. We would like to see the
police report on this. Our subcontractor has insurance to handle this sort of thing.
If there has been no police report on this, he will not consider any payment towards
this damage.
If my understanding is correct, the above items are all the problems concerning the
offsite water line. If there are any others, we want to know of them prior to our meeting
on Monday night.
ONSITE WATER
1. To my knowledge, the only problem with the onsite water line is we have a problem
with our subcontractor, D/FW Utility Co. He has failed to return to the site to check
out his water system and make adjustments to same, consequently, I have had to hire
another contractor to complete the work. We still owe D/FW Utility Co. his 10% retainage
which will not be paid until this matter has been settled. Again, we(feel like a simple
legal instrument between the city and myself will resolve this matter.
2. Due to the above item, I am going to have to furnish a one-year maintenance bond
myself. This is ready to be issued when the interior water and sewer system has been
accepted by the City.

SEWER IMPACT FEES
When I originally made the deal with the City of Wylie, I was told at that time and
this can be verified, that the impact fees were $100 per lot. I have 225 lots, so this
comes to $22,500. During a meeting I had with Gus Pappas, the ex-city manager,
approximately 6 weeks ago, he advised me that it was $175 per lot or $39, 375.00.
During a meeting I had with you and your city staff last week, you advised me that the
sewer impact fee was $225/lot or $50,625.00. During a conversation I had with you two
days ago, you advised me that the sewer impact fee was $422/lot or $94,950. Mr.
Johnson, we had in our budget the $22,500 and that is the amount we expect the city
to live with.
To my knowledge, the above two items are the only problems I have associated with the
interior water and sewer system. If there are any others, we want to know of them
prior to the meeting on Monday, May 4th.
PAYMENT BY CITY FOR OVERSIZING
Before I let the contract for the offsite water line, I questioned your city staff several
times (copies of letters attached) concerning approval of the amount the city would pay
before I let the contract. The total amount due by our calculations from the city was
$78,843.50. Mr. Santry now advises me that the city will only pay $58,766.01 . This is
a $20, 077.49 difference. I most certainly would not have started the water line unless
Mr. Santry had agreed to the $78,843.50. I am in the process of trying to bbtain a
breakdown from Mr. Santry on the $58,766.01 so we can have a conversation on this
before Monday night.
To my knowledge, this is the only problem regarding the payment by city for oversizing.
If there are any others, we want to know about them befbre the meeting on Monday.
OFFSITE SEWER
As you are aware, it is the city's responsibility to bring the sewer to my manhole as
previously agreed. According to yourself and your city staff, you are now contemplating
running the temporary line up FM 544 to an existing manhole and this, of course, is
sometime off as the city, to my knowledge, has done no engineering or anything whatso-
ever in this regard. Consequently, the city has to pump sewerage as they did at
Southfork until this line is installed. This seems to be the major problem with getting
the entire subdivision accepted and I assume will be rectified at the meeting.
To my knowledge, the above item is the only problem regarding offsite sewer. If
there are any others, we want to know about them prior to the meeting on Monday.
OFFSITE DRAINAGE
You have previously told me that you will not allow the park to open because of the
problem with the offsite drainage and that the city would have liability if you allowed
it to open because the adjacent property owner, H. B. Allard, has a lawsuit with me.
My attorney advises me that this is not the case but regardless, this should be
resolved by a simple instrument, hold harmless or whatever, between the city and
myself. As you are aware, the adjacent property owner is making unheard of demands
which neither the city nor I can comply with so this problem will have to take its
natural course but we are willing to sign any agreement to hold the city harmless or
whatever else is required.
Perhaps you are not aware, but I am very close to completing this facility. I have
the drainage channel completed with the exception of concrete rip-rap and seeding. We
are held up on this work until a slight grade change has been made in the channel so
we don't feel like this should hold up up on opening the park as we will be agreeable
to doing this work and feel the city should accept the facility without it being done

so we can open the facility immediately.
To my knowledge, the above are all the problems and differences on the entire
project. We must have all of the above problems resolved Monday night so we can
open the facility Tuesday therefore we request that the city attorney be present
along with my attorney so an agreement can be hammered out between them
immediately. Apparently your city attorney is not full-time and works for another
law firm so we are willing to pay his fee for his time so he may be present at the
Monday night meeting.
Please advise your thoughts on this matter as soon as possible.
