08-15-2013 (Construction Code) Minutes Wylie Construction Code Board CITY OF WYLIE Minutes Wylie Construction Code Board Thursday August 15, 2013—7:00 pm Wylie Municipal Complex—Council Conference Room 300 Country Club Road, Building 100 CALL TO ORDER Chairman Bryan Rogers called the meeting to order and a quorum was present. Board members present with the Chairman were; Board Member Zachary Herrera, Board Member Sunil Verma, Board Member Robert Heath and Board Member Michael Grubbs. Staff present was Code Enforcement Officer Pat Mitchell, Secretary Ashley Vega and Interim Building Official Todd White. CITIZENS COMMENTS Chairman Rogers opened the Citizens Participation. With no one approaching the Commissioners, Chairman Rogers closed the Citizens Participation. 111 ELECTION OF CHAIR AND VICE CHAIR Board Member Herrera made a motion to nominate Board Member Rogers as Chair. Motion passed 5-0. I Board Member Herrera made a motion to nominate Board Member McClendon as Vice Chair. Motion passed 5-0. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the March 7, 2013, Regular Meeting. Board Action A motion was made by Board Member Herrera, and seconded by Board Member Verma. Motion passed 5-0. REGULAR AGENDA Regular Agenda 1. Consider, and act upon, a request for a variance to Section 22.243 of the City of Wylie Fence Ordinance from Shane Colley, a representative of the City of Wylie located at 2000 N Highway 78, seeking an appeal for a denied permit application due to the barbed wire. The request is to install extension arms and 3-strand barb wire at the top of the fence. This property is zoned Commercial Corridor. Staff Presentation Shane Colley, Construction Manager, City of Wylie, applicant, is requesting permission to have extension arms and 3-strand barb wire at the top of the fence at the Public Safety Building, located at 2000 N Highway 78. The purpose is to provide additional security for police officers entering and exiting the building; as well as protection for equipment and police vehicles. The front of the parking lot will remain open for citizens. The north entrance of the parking lot will have a gate and will not be fully accessible to the public. Board Action A motion was made by Board Member Verma, and seconded by Board Member Herrera, to approve the Fence variance. Motion carried 5-0. 2. Consider, and act upon, a request for a variance to Ordinance 2002-05. Section VD (1) of the Engineering Design Manual from the homeowner at 303 W. Brown, seeking an appeal for denied permit application of their driveway addition. Ordinance 2002-05 Section VD (1) regarding the driveway design standards for residential streets. It states that driveway approaches shall not occupy more than 70% of the frontage of the tract. It also states that based on a 30 mph design speed, the driveway spacing should be at least 80 feet. The request is to install a circular driveway. Its spacing should be at least 80 feet. The request is to install a circular driveway; the lot width appears to be only 60 feet. Staff Presentation Sam and Kathy Tullock, homeowners, 303 W Brown, the applicant, is requesting to approve their variance request to install a circular driveway. The applicant is requesting a circular driveway due to safety concerns, property being located on a curve, high traffic, road construction, telephone pole at the end of the driveway that creates blind spots of traffic and the need for extra parking. Todd White, Interim Building Official, stated the City Engineer does not oppose to the installation of this driveway due to the Brown Street construction. Board Action A motion was made by Board Member Herrera, and seconded by Board Member Verma to approve the variance request. Motion carried 5-0. 3. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 2709 Deerborn, Cimarron Estates #1, Block G, Lot 11, Wylie, Collin County, Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC Minutes August 15,2013 Wylie Construction Code Board Page 2 of 4 NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on March 1, 2013 Staff Presentation Ms. Mitchell stated that the property located at 2709 Deerborn, the back door was open and there was debris in and around the property. The property was secured. Liens were filed on this property and have been paid. The property is still vacant and secured. Board Action A motion was made by Board Member Verma, and seconded by Board Member Herrera to approve the emergency secure of 2709 Deerborn. Motion carried 5-0. 4. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 308 Lake Travis, Twin Lakes #3, Block K, Lot 5, Wylie, Collin County Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on March 18, 2013. Staff Presentation Ms. Mitchell stated that the property located at 308 Lake Travis, the fence was down and there was a large hole in the backyard filled with water. An emergency secure was performed at this property to put the fence back up and filled hole with dirt. Liens have been filed and have not been paid. Board Action A motion was made by Board Member Verma, and seconded by Board Member Grubbs to approve the emergency secure for 308 Lake Travis. Motion carried 5-0. 5. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 200 Shadybrook Dr., Southbrook #2, Block G, Lot 1, Wylie, Collin County Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on June 7, 2013. Staff Presentation Ms. Mitchell stated that the property located at 200 Shadybrook Dr was vacant and unsecure. In addition, the property had exposed electrical. The property was boarded up. Liens have not been paid. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 2717 Sutters Mill Way, Cimarron Estates#1, Block H, Lot 24, Wylie, Collin County Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on June 26, 2013. Staff Presentation Ms. Mitchell stated that the property located at 2717 Suffers Mill Way was vacant and the back door was open. The police were contacted. The back door was locked and a lien was filed for mowing. The Lien has not been paid. Board Action A motion was made by Board Member Verma, and seconded by Board Member Grubbs to approve the emergency secure for 2717 Sutlers Mill Way. Motion carried 5-0. 7. Authorizing the Chairman of the Construction Code Board to sign the final orders prepared by City staff as long as such final orders are consistent with the orders issued by the Construction Code Board on August 15, 2013. Board Action A motion was made by Board Member Herrera, and seconded by Board Member Verma to authorize the Chairman to sign the final orders. Motion carried 5-0.
