Subject: Managers Newsletter
We attended the preconstruction conference for installtion by
contract of the new signal light system to be installed at Ballard
and Highway 78 this week. General contractor for the installtion
is Mike Hunter Inc. , Hutchins Texas. The highway department
engineer in charge of the project is Mr. Bradley K. Smith who
may be reached during office hours at 542-2345 or at all other
times in case of need: 238-0844.
Preliminary wiring has been completed by the Santa Fe Railway
' Company and Texas Power and Light Company will furnish primary
electric power for operating the signal system. The cost of
the electricity and the maintenance and operation of the signal
light system will be borne by the Texas Department of Highway
and Public Transportation. Target date for beginning construction
will be Monday May 16. Construction is expected to take ap-
proximately 30 days from that date.
When the new signal lights are initially installed, they will
be covered with burlap. When they are ready to turn on, or
place in service, they will be regulated to operate as flashing
red lights for 7 days , after which they will be put on full
signal light operation. The existing flashing red light will
be removed only after it is clear that the new signal light
system will function reliably for a long period of time.
Again, if you have questions or need assistance concerning this
project call me or Bradley K. Smith at either his office: 542-2345,
or his home: 238-0844.
With reference to the signal light system to be installed at
Kirby and Highway 78, there will be approximately 4 months per-
iod of time for the Highway Department Engineers to design the
system, after which there will be approximately 1 year required
for approval by the Austin Highway Commission and the purchase
and delivery of material for the system. While we do not believe
the delay at Kirby and Highway 78 will be as lengthy as it has
been for Ballard and 78, there will be a several months delay
between the time of need and the time of Installation of the
full traffic signal system.
Meanwhile, the Texas Highway Department is scheduled to begin
installtion of a temporary four-way flashing red light system
at Kirby and 78 next Monday, May 9.
Once again, it was necessary to operate two sanition crews on
Monday in order to collect the heavy deposits of family trash
and brush. Apparently, citizens feel like spring clean-up is
already underway. The solid waste study committee, composed
of council members Cleo Adams and Don Hughes, received a 30
minute presentation from T. I. D. I . concerning the feasibility
of contract trash collection. The discussion which followed
involved examination of various options open to the city
in the near future. It is possible that tie committee will wish
to discuss this matter with you during the discussion-period Tuesday
evening.
Construction was begun this week on the installation of the new
water main and service lines in Memorial Street, beginning at
Valentine. First, we retained the services of a Contractor
to install a wet tapping seelve and valve, in order that we
could start the water main without closing off service to all
the customers in that neighborhood. A new fire hydrant was
installed at the intersection of Valentine and Memorial to re-
place the inoperable hydrant which has been there for many years,
but which we were only recently advised had been inoperable.
The old hydrant will be rebuilt and installed at another loca-
tion.
Complaints have been received by this office from neighbors
who are inconvenierced by the construction work and we antici-
pate this will continue until the work is complete. Traffic
inconvenience is a necessary evil during construction,of this
kind, but we plan as best we can to avoid more than a brief
inconvenience for water customers during the transition from
the old main to the new water main.
We are activating the weedy lot program again and will be
sending out letters this coming week to property owners who
have weedy lots or lots that have much brush to be picked up.
We will appreciate the backing and support of the City Council
Members in case citizens call and complain that the City Admin-
istration is requiring them to cut the brush small enough so
that our men can lift it and put it on the brush truck. The
custom remains that people cut a large tree limb off a pecan
tree or other shade tree and let it fall where they cut it.
Our men cannot lift some of the limbs which are 20 to 30 feet
long and up to 6 inches in diameter. If people want the brush
hauled away, they simply must cut it so that our men can lift
a piece of it.
A three to four month search for additional steel cable for the
park driveway and parking lot by Texas Power and Light Company
failed to turn up any cable. However, Pat Minihan advised me
that Rockwell International had some smaller cable which we
could purchase as surplus property. This was done and that
cable will be doubled and installed as we can arrange for the
crew to make installation.
The downtown spring weed killing program is also underway, and
is being conducted by Mr. Ed Franklin. Mr. Franklin is also
gearing up to begin the annual campaign against fire ants.
Copies of the draft of proposed subdivision regulations are in-
cluded in your packet. You may choose not to discuss these
at the Tuesday night meeting because of the long agenda. In
addition copies of the proposed Planning and Zoning Commission
guidelines are enclosed for your review and comment. Please
let me know if you see anything that needs to be changed or
amended. We hope to have a joint meeting involving the
Planning and Zoning Commission, The Board of Adjustment, Mr. J. T.
Dunkitn and the City Council on May 26 at 7:00 P. M. Please
advise if you have a conflict with this date.

AGENDA BRIEF
May 10, 1983.
Under old business, item no. three (3) , the Council will consider voting on
the ordinance Rezoning the acreage in Glen Knoll Mobile Home Park which was
originally voted upon on Friday, April 8th. After that meeting, legal counsel
advised the Mayor that the City Council would need to vote on the rezoning
matter with an ordinance on the table. The ordinance was prepared and sub-
mitted to the Council for action on April 12th, but was tabled until the
meeting of May 10th.
Under new business, item no four (4) , five (5) , and six (6) involve related
public hearings on the annexation of three parcels of land near Oaks Addition I.
Item no. four (4) involves annexation of 4.689 acres to be developed as a
shopping village, while item no. five (5) involves annexation of a 1 acre
parcel to be developed as a Day Care Center. Item no. six (6) involves a
sub-division to be developed similar to Oaks Addition I.
Item no. seven (7) involves the formal public hearing by the Council for
rezoning tracts 1 & 2 of the S. B. Shelby Survey Abstract 829, from Public
to R - Retail . This is the School property located at Birmingham and
Highway 78 which was recently sold to Mr. Gary Roddy. Planning and Zoning
Commission has recommended that it be rezoned to R- Retail .
Items no. eight (8) and nine (9) involve formal acceptance by the City Council
of completed first installments for Trails Additon and Rush Creek Addition.
If the City Council accepts these sub-division installments as complete,
certificates of occupancy can be issued for buildings which have been
completed in those sub-divisions. Further, the one year maintanence period
under which the developer is responsible maintaining and repairing the public
faculties which have been installed begins.
Item no. ten (10) involves a request for a variance to the Sub-Division
Ordinance to allow building permits to be issued prior to completion of
streets in Westwind Meadows II. This covers approximately ten (10) lots
which were specifically approved and recommended by Planning and Zoning
Commission, albeit by a split vote at its most recent meeting. Several lots
have been sold and one lot was lost, because the developer was not ready
to build and the buyer could not afford to wait. This variance, it granted,
would allow building permits to be issued for building on those ten lots,
but certificate of occupancy would be with held until the entire first
installment of the sub-division has been accepted by the City Council .
Item eleven (11 ) involves a request by Mr. William Chapman to the City to
abandonment a short section of the alley running north-south west of Jackson
and North of Callaway. Mr. Chapman need that section of alley for additional
parking space for his restaurant. Action was taken by the City Council at
his request several years ago, but was not completed. If the alley is abandon-
ed by the City Council , a utility easement will be retained so the City can
service the utilities which presently are located within the alley.

Items twelve (12) , thirteen (13) and fourteen (14 r involve the adoption of
building, mechanical , and plumbing code published by the Building Officials
Conference of America. These codes are enforced in the majority of the
Metroplex Cities and Towns. By the adoption of these codes, the City of Wylie
would be "in line with" the other cities. Planning and Zoning Commission has
recommended adoption of the Uniform Building Code.
Item fifteen (15) involves Council approval of a request by Control Management
Group, Insurance Risk Management Consultants, to audit the City's Insurance
program. No charge will be made for the audit, but if the consultants recom-
mend changes which save the City money, their fee will be taken as a percentage
of the money saved.
Item sixteen (16) involves acceptence by Council of the dedication of a long,
narrow strip of land north of Westwind Meadows I , dedicated by Melvin St.John
to the City for use as park property.
Item seventeen (17) involves possible discussion of a draft of the new proposed
Sub-Division Regulations, but no action is anticipated by the Council . Prior
to adoption, it is anticipated that the City Council , The Planning and Zoning
Commission, and the local developers will be given copies of the proposed
regulations for review and comment. After everyone is satisfied with the
proposed regulations, then, and only then, will be Council be asked to
adopt them as an ordinance.
Item eighteen (18) involves adoption of a tax ordinance by the City Council
levying a two percent (2%) gross receipt tax on all Bingo Games conducted
in Wylie under the Texas Bingo Enabling Act.
Item ninteen (19) involves adoption of an ordinance establishing speed
limits for new FM 3412, extending east from FM 1378 to Ballard and south
on Ballard to Highway 78. This ordinance was prepared in co-operation
with the Texas Department of Highways and Public Transportation.
Item twenty (20) involves Council approval to purchase the remaining three (3)
sets of portable bleachers for Wylie Community Park which were originally
authorized under the Park Improvements Program. Hopefully, Southern Bleacher
Company will furnish these bleachers at the same price for which they furnished
the orginial three sets of bleachers.
Item twenty-one (21 ) involves authority by Council to purchase some custom
made decals for police patrol cars. These decals will be used in addition
to the recently purchased logo decals earlier authorized by Council .
Item twenty-three (23) involves an executive session in which a discussion
concerning approval of the appointment of a City Secretary will be conducted.
In addition discussion will be held concerning appointment or re-appointment
of two members of the Planning and Zoning Commission expires on May 15th.
All decisions concerning these appointments will be made in Public Session .

The Wylie City Council met in special session at 6:00 p.m. on April 8, 1983
in the Council Chambers at City Hall . Mayor Squires presided. A quorum was
present and notice of the meeting had been posted for the time and manner
required by law. Those in attendance were the Mayor, Mayor Pro-Tem William
Martin, Council members Geline Dodd, Reta Allen, Harold Eavenson, and Percy
Simmons, City Secretary Sarah Connelly, City Manager Lee Vickers, Larry
Jackson, counselor for City, P & Z members Ab Harrison, Mike McAnally,
and Bryant Barry, Councilmen-elect Don Hughes and Cleo Adams, Vicki Martin,
school board member;Scottie Austin, Cathy McAnally, Richard Parker, Randall
Gaston, Al Kittner, Harry Tibbals, Jerry Davis, Harold Spence, Melvin St. John,
Ed Collins, Robert O'Donnell , atty. ; R. 0. Martin, and Rich Connelly of the
Dallas Morning News.
Mayor Squires called meeting to order and recognized councilmen-elect Don
Hughes and Cleo Adams, who were in attendance.
Mayor opened the Public Hearing on 36.39 acres in Richard D. Newman Survey.
Mr. Robert O'Donnell , representing the developers, stated that his clients
felt that putting in a mobile home park would be an appropriate use of the
land south of Martinez and Alanis Lanes, as it was bound by a sewer treatment
plant and landfill . Mr. O'Donnell advised Council that a plat showing
the 200 ft. buffer zone had been filed with the City Manager, who advised � .
that it had been filed with the City.
Mr. Richard Parker, Mr. Jerry Davis, Mrs. Vicki Martin, and Mr. Bryant Barry
addressed the Council in opposition of the zoning. Stating it would not
be to the best interest of the City of Wylie, or its citizens to zone this
property Mobile Home District. Mrs. Martin stated the school board was
concerned at the overcrowding of the schools.
Mayor drew the public hearing to a close, and returned the matter to the
Council for discussion.
Councilman Eavenson made statement that any commitment made outside of the
Council Chambers or inside when Council was not in session, was not an
official act. And he submitted that the Council give thought to this if
such commitments had been made.
Mr. Larry Jackson, counselor for the City, advised that the 200 ft. buffer
zone was zoned as temporary agriculture, and the only use of this land at
this time must fall under our zoning ordinance zoning for agriculture.
This buffer zone would have to be permanently zoned before any other use
could be made of it.
Mr. O'Donnell advised Council that the developers were aware that they
must submit a site plan to the Planning & Zoning Commission and to the
City Council before the issuing of building permits. City Manager Vickers
also acknowledged that the site plan must come before P&Z and the Council .

Councilman Simmons moved that the 36.39 acre out of 43.401 acre tract of
land in the Richard D. Newman Survey, located south of Martinez and Alanis
Lanes be permanently zoned Mobile Home District, sect ided by Councilwoman
; Allen. Three in favor, Councilman Simmons, Councilwomen Allen and Dodd.
Two in opposition, Councilmen Eavenson and Martin.
' Councilman Simmons ammended his motion to state also that there was an
ordinance on the books, and that as long as it was there they were to
comply with it and were not to ask for any variance. If strict compliance
to the ordinance was not adhered to then the development was to be
halted. Motion was seconded by Councilwoman Allen. Three were in favor
of the amendment, Councilman Simmons, Councilwomen Allen and Dodd.
Two abstaining, Councilmen Martin and Eavenson.

12, 1983 in the Council Chambers at City Hall . Mayor Squires presided.
A quorum was present and notice of the meeting had been posted for the
time and manner required by law. Those in attendance were the Mayor,
Mayor Pro-Tem William Martin, Council members Harold Eavenson, Geline
Dodd, Reta Allen and Percy Simmons, City Manager Lee Vickers, City
Secretary Sarah Connelly, Chief-of-Police Royce Abbott, Planning
and Zoning members Bryant Barry, Mike McAnally and numerous citizens.
Mayor Squires called meeting to order and gave the invocation.
APPROVAL OF PREVIOUS MINUTES AND ACCOUNTS PAYABLE.
Councilwoman Dodd made motion to approve accounts payable, seconded by
Councilman Eavenson, all in favor. Mayor Squires requested that the
approval of P & Z minutes from March 24, 1983 be withheld pending
amendment from P & Z Commission. Mayor Pro-Tem Martin made motion to
approve previous minutes, with the exclusion of P&Z minutes of March
24, 1983. Councilman Eavenson seconded, all in favor.
EMERGENCY AGENDA ITEM: ADOPT AN ORDINANCE AMENDING ORDINANCE #81-5 WHICH
RELATES TO THE SAME 36.39 ACRE TRACT OF LAND (LOCATED SOUTH OF ALANIS
AND MARTINEZ LANES) WHICH WAS VOTED UPON FOR MH (MOBILE HOME DISTRICT)
ZONING ON FRIDAY APRIL 8, 1983.
Mayor Pro Tem Martin requested a caucus with the Council before acting
on this item. Mayor Squires stated he did not feel that the Council
could neet in a caucus. Mayor Pro Tem Martin made request again,
seconded by Councilman Eavenson. Mayor granted caucus and asked that
Council Chambers be cleared.
After Council caucus, Mayor reopened meeting into session, and
continued on with discussion of agenda. In reference to open meetings
law 62-52-17 VACS Section 3 Article F does authorize items to be
added to agenda under emergency or emergent public necessity which shall
be expressed in the notice of to be sufficient. Councilman Simmons stated
that the Council had agreed to handle this issue and not carry over to new
Council and in his opinion this was an emergency. Mayor stated that he
did not feel this was an emergency item constituting emergent public
necessity. Mayor Pro-Tem Martin stated unless proven different by legal
counsel he did not feel it was an emergency item. Councilman Eavenson
stated he was not sure if it was or not. Mayor asked Ms. CaMille
Elliott, legal counsel for the City, for definition. She stated that
the reasons given were not a matter of emergency since it was only
a prefernece and that it should have been complied with according to
regular posting of agendas. Councilman Simmons requested that in view
of attorney's opinion that item be removed from agenda. Seconded by
Councilwoman Dodd, all in favor.

Mayor opened public hearing. There being no comments or questions on
this matter, Mayor closed public hearing and returned to Council .
Mayor Pro-Tem Akin made motion to allow change in zoning, seconded by
Councilman Martin, all in favor.
REVIEW PROPOSED PLAT FOR 14ACRES LOCATED ON EAST SIDE OF FM544 SOUTHEAST
OF WYLIE, RESIDENTIAL DEVELOPMENT IN ETJ.
After discussion on this development in the City of Wylie's ETJ, motion
was made by Councilman Simmons for Council to go along with P & Z
recommendations and that this issue and future developments be handled
in a work session and a procedure be set up with Planning & Zoning
and City Council on what is expected on developments outside of city.
Seconded by Mayor Pro-Tem Akin, four in favor, Councilman Hughes
abstained.
APPROVE AND ACDEPT DRAINAGE EASEMENT NEEDED FOR KINSINGTON MANOR ESTATES
Developers agreed that they would be responsible for the initial cost
of easement. Mayor Pro-Tem Akin made motion to approve easement,
Councilman Adams seconded, four in favor, Councilman Simmons abstained.
APPROVE PAVING PLANS FOR PIRATE DRIVE
Mayor Pro-Tem Akin made motion to table this item pending results of
instructions given to City Manager by Council . Councilman Simmons
seconded the motion, four in favor, Councilman Adams abstained.
Departmental reports were reviewed.
Council set up a work session for .Saturday April 16, 1983 at 8:30 a.m.
in the Council Chambers without agenda items.

The Wylie City Council met in called session at 6:00 P.M. on April 25, 1983,
at City Hall in Council Chambers. A quorum was present and notice of the
meeting had been posted for the time and in the manner required by state
law. Those in attendance were Mayor Squires, Mayor Pro-Tem John Akin,
Councilmen William Martin, Cleo Adams, Don Hughes, and Percy Simmons.
City Manager Lee Vickers, City Secretary Sarah Connelly, Mike McAnally,
Cathy McAnally, Tim Hemmingway, Don Kreymer, Bill Kreymer, Paul Hayes,
City Attorney CaMille Elliott.
Mayor Squires called meeting to order. Mayor Pro-Tem Akin gave the
invocation.
CONSIDER REQUEST BY MELVIN DELANEY FOR PERMISSION TO REPLACE A SMALL
WATER LINE WITH A LARGER, NEW WATER LINE TO SERVE PORPERTY ALONG
ALANIS LANE. Mr. Delaney requested permission to install larger (2"or3")
water lines. Mayor Pro-Tem Akin questioned the status of current lines and
was opposed to adding customers outside of City. Mayor asked Delaney
about annexing into City. After detailed discussion on the subject
Mayor Pro-Tem Akin made motion to table until City can investigate
past situation and report to Council . Councilman Simmons seconded,
four for, one abstained, Cleo Adams.
CONSIDER APPOINTMENT OR REAPPOINTMENT OF TWO MEMBERS OF PLANNING
AND ZONING COMMISSION. Councilman Martin made motion to table appointment
and reappointment of two Planning & Zoning members until 5-10-83
meeting, Councilman Adams seconded, all in favor.
CONSIDER APPORVAL OF REPLAT OF FIVE LOTS ON WEST SIDE OF SOUTH SECOND
STREET SOUTH OF PARK STREET(PRELIMINARY PLAT) City Manager read minutes
of Planning and Zoning April 19, 1983 meeting in regards to this item.
Stipulations that (1) drainage easements be carried out as in Trails
Addition; (2) water line be installed so that this plat and Trails use
same line; (3) street easement where 50 ft. would be extracted. Mayor
stated that in a discussion with the two developers that they would
construct street in undeveloped area, city to participate in 1/3 cost
construction of bridge. City needs approval from property owners for
paving street on south Second Street (four houses) . Administration
was instructed that before this comes back to City Council for final
plat approval that the issue of the road be totally resolved in
writing exactly what next step is and who is committed to what partici-
pation and what recommended recourse there is to the City. This includes
the entire section of Second Street. Councilman Simmons made motion that
section between Park and Stone be marked "No Parking" on east side.
Motion died lack of second. Mayor also stated that prior to final plat
approval that Council would like to know the dollar figure that would be
required of the City. Councilman Simmons made motion to accept preliminary
plat as recommended by Planning & Zoning with stipulations and final
plat show utilities in such a manner as to allow ultimate expansion of
this road to 36 feet. Councilman Hughes seconded, all in favor.

ROAD - After discussion on this item Mayor Pro-Tem Akin made motion to
approve. Councilman Hughes seconded. Three (3) for, two (2) abstaining,
Councilmen Adams and Simmons.
DISCUSS SOLID WASTE COLLECTION PROBLEMS - It was the consensus of Council
to have a study conducted by Refuse committee on avenues available to
the City.
CONDUCT EXECUTIVE SESSION FOR PERSONNEL MATTERS WITH LEGAL COUNSEL TO
CLARIFY A PERSONNEL POLICY. Mayor entertained a motion to go into
executive session in accordance with the terms of Article 62-52-17
V.A.C.S. Section 2 (g) to discuss personnel polity with legal counsel .
Mayor Pro-Tem Akin made motion, seconded by Councilman Hughes, all in favor.
Mayor reopened into public session.

The Wylie Planning & Zoning Commission met in regualr session at 7:00 p.m.
on April 28, 1983 in Council Chambers at City Hall . A quorum was present
and notice of the meeting had been posted for the time and in the manner
required by state law. Those in attendance were Chairman Joe Fulgham,
John Seeley, Bryant Barry, Ab Harrison, Mike McAnally, Judy Brewster, Ken
Mauk, City Manager Lee Vickers, City Secretary Sarah Connelly, Don Kreymer,
Mayor Robert Squires, Randy Gaston, Melvin St. John, Sam Self, I .W. Santry.
Chairman Fulgham called meeting to order. There were corrections to be made
to previous minutes. March 24, 1983 minutes were amended as follows:
Item #3- McAnally made motion seconded by Bryant Barry, all in favor.
Also that future agenda items include "permanent" zoning for recently
annexed Birmingham Trust Land, two-hundred-foot strip of land not to be
included as a part of Glen Knoll Mobile Home Park, and any other land
that might be in same catagory. Also that correct procedures be done to
get this done correctly.
Item #5- That City Administration pass rules of procedure on to City
Council for approval .
April 19, 1983 minutes amended as follows:
Record to show that Bryant Barry was absent.
Item #6- Vote to be corrected to five in favor, one against, Mike McAnally.

Consider rezoning of Tracts #1 & 2, S. B. Shelby Survey, Abst. 820- Wylie
Independent School District- Corner of Birmingham & Highway 78.
Mr. Don Whitt requested that this property be rezoned from Public to
R-Retail . These two tracts contain 2.5177 acres of land and developer
plans to construct office buildings. Mike McAnally made motion to rezone
tracts #1 &2, Abst. 820, S.B. Shelby Survey, which contains 2.5177 acres
from public to R-Retail , this is also known as Birmingham & 78 (from
Sonic to Birmingham) Ken Mauk seconded, Five in favor, two abstaining,
Judy Brewster and Bryant Barry.
Review Final Plat for Don Kreymer-on west side of South Second at Park
Developer Don Kreymer requested that this item be removed from agenda
at approximately 10:00 a.m. on April 28, 1983.
CONSIDER APPROVAL OF HOME CONSTRUCTION IN WESTWIND MEADOWS II PRIOR TO
COMPLETION OF STREETS AND ALLEYS.
Melvin St. John and Sam Self would like to start construction before completion
of streets and alleys. All utilities are in except storm sewers. Traffic
during construction will be channeled down alleys. Developer is asking
for construction apporval of approximately 8 to 10 houses. John Seeley
asked what kind of hardship would be encountered if unapproved. St. John
stated it would be about 6 to 8 weeks delay due to completion of streets.

Bryant Barry asked City Manager in view of facts since ordinances were
" worked out, what is his recommendation on this. City Manager stated
ordinance calls for completion block by block and take out building
permits without asking for a variance on ordinance, and Council could
accept and approve a section of sub-division at a time. Mike McAnally
stated he felt sub-division should be complete before building permits be
issued. Streets need to set for 28 days before traffic is on them.
Fire protection could be a problem if Planning and Zoning approve this
request. St. John stated that no certificate of occupancy would be
issued until completion. Bryant Barry was concerned about fire and
also curing of concrete for 28 days. I .W. Santry stated higher strength
cement would be up to standards and this could speed up construction.
Ab Harrison made motion to Q-a`t�T construction prior to completion of
streets and storm sewer on Lots 20,21, Blk. 3; Lot 29-30-31-27-28, Blk. 1;
Lot 10-11, Blk.8; Lot 4, Blk. 5. Judy Brewster seconded. Four in favor
one against, Mike McAnally, one abstaining, Bryant Barry, who stated his
reasons as (1) precedent set with Kinsington Manor which was done in
Barry's absence, (2) because we are not enforcing the ordinances. Barry
would like to ask City Council to take into consideration when considering
this ordinance, this particular ordinance, fire code problem and curing
of concrete.
Mayor addressed the Commission on range of responsibility of Board
of Adjustment and Planning and Zoning. Mayor has retained service of
J. T. Dunkin to answer these questions brought up by Planning & Zoning.
Mr. Dunkin can meet with the boards on May 26, 1983. Mayor stressed to
Planning & Zoning that City Council looks to their recommendations very
seriously.
Mike McAnally aware that these items were not on the agenda, asked Mr.
St. John about strip of property that he was going to deed to City as
a park. St. John stated he had deeded this strip to City, it is
approximately 50 x 1300 feet, donated 20 feet alley between Valentine
and Willow Way.
McAnally also asked about 6-plex apartment building. Mr. St. John stated
he had had problems with this unit, and hoped to have it completed soon.

The Wylie Planning & Zoning Commission met in a special called session at

and in the manner required by law. Those in attendance were Chairman Joe

Mike McAnally made request and asked it to be part of minutes, that the
Mayor of the City provide definitions as to where powers between Board of
Adjustment and Planning & Zoning Commission stop.
Consider temporary building permit for classrooms for WISD. Mike McAnally
made motion to table this item until further information is received. John
Seeley seconded. All in favor.
Consider amended site plan for Doctor's Building at new Wylie Hospital .
After much discussion on this agenda item, Mike McAnally made motion to
approve amended site plan subject to approval by fire marshal and inspection
of physical site location by City inspector and that building clear all
existing utilities. John Seeley seconded, all in favor.
Consider petition for annexation - Oaks Addition. Harold Spence presented
petition for annexation of Oaks Retail , tract containing 4.689 acres, situated
east of Impression Center. Mike McAnally made motion to recommend annexation
of Oaks Retail . Judy Brewster seconded, all in favor.
Consider petition for annexation of Oaks III. Harold Spence developer of
Oaks III petitioned for annexation, tract of land containing one acre. John
Seeley made motion to recommend annexation of Oaks III, Mike McAnally seconded,
all in favor.
Consider annexation of Oaks IV. Harold Spence, developer, petitioned annexa-
tion of two tracts of land, one containing 8 acres and one containing 10.49
acres, to be known as Oaks IV. Mike McAnally made motion to recommend
annexation, seconded by Ken Mauk, all in favor.
Consider approval of home construction on Windsor in Kinsington Manor Estates
prior to completion of water line boring under Cottonbelt Railroad (No
certificate of completion will be issued. ) After much discussion on the time
involved in obtaining permit from railroad to do boring, John Seeley made
motion to allow home construction in Phase I with stipulation that no certi-
ficate of occupance be issued until all utilities are complete. Mike McAnally
seconded. Five in favor, one against, Mike McAnally.
Consider approval of replat of five lots on the west side of South Second at
Park. After lenghthy discussion in regards to this replat, Mike McAnally
made motion to approve perliminary plat and that final plat be submitted
to Planning & Zoning after approval of City engineer for April 28, 1983 meeting.

late in attending meeting.
1 . Public Hearing to rezone from SF to retail for office use,
lot 3, block 6 Keller Addition, 404 S. Jackson:
Only responses to the rezoning were written responses both were
in favor of rezoning. After discussion on the request, Mike
McAnally made motion to recommend rezoning to City Council .
Al Harrison seconded, all in favor.
2. Preliminary plat for Creekside Estates:
On motion by Bryant Barry, seconded by John Seeley, it was voted
unanimously to recommend that the preliminary plat for Creekside
Estates be accepted and approved with the stipulation that, al-
though the Commission feels the street should be paved with con-
crete, such a requirement would not be economically feasible;
however, when and if the property is annexed to the City of Wylie,
property owners will be assessed the cost of concrete pavement.
Further, that the fire protection and water utilities improvements
comply with the City of Wylie regulations.
3. Discussion of the current Zoning Ordinance:
Mike McAnally made motion, seconded by Bryant Barry, all in favor.

5. Proposed Rules of Procedure:
Next, the Commission discussed the proposed rules of procedure,
reaching concensus agreements on various rules, Bryant Barry made
notes for revisions and passed them to City Manager for processing.
On motion by Mike McAnally, seconded by Albert Harrison, it was
voted unanimously to adopt the rules as revised.
6. Posting and Mailing Agendas:
It was also agreed that future agendas would be posted and mailed
to members on Fridays prior to the regular meetings ( 4th Thursdays) .
6. Plat Review Committee:
Bryant Barry moved, with a second. by Mike McAnally, to select John
Seeley as spokesman for the two-member plat review committee.
Motion passed unanimously. Bryant Barry moved, with a second by
Judy Brewster, to select Mike McAnally to serve on the plat review
committee. Motion passed unanimously.
On motion by Mike McAnally, seconded by Bryant Barry, it was voted

The Wylie Board of Adjustment met in regular session at 7:00 p.m. on
April 26, 1983 at the Tower Suite of First State Bank Building. A quorum
was present and notice of the meeting had been posted for the time and
in the manner required by state law. Those in attendance were Chairman
Richard Hampton, Kent Crane, Bill LeCocq, Nancy Conkle, Anna Starnes,
and Art Harris,City Manger Lee Vickers, City Secretary Sarah Connelly,
Robert Squires, Mike McAnally, Kevin St. John, Richard Parker, and Don
Whitt. Bill James was absent.
Chairman Hampton called the meeting to order.
SPECIAL USE PERMIT FOR TEMPORARY CLASSROOMS AT WYLIE HIGH SCHOOL
Portable classrooms are to be located at rear of high school . WISD
will be asking for referendum vote on Bond issue . Due to large enrollment
for high school next year additional classrooms are needed. Thses class-
rooms can be moved from one location to another. Board members were
concerned about heating, air-conditioning and placement of utility lines.
Mr. Whitt explained each of these concerns to the Board. If the buildings
are to be moved WISD will come back to the city for approval . Adjacent
property owners were notified. Out of 32 property owners notified three
responded, two for, one against(WISD should build new school ) . Anna
Starnes made motion to issue permit for one (1) year. Bill LeCocq
seconded, all in favor.
SPECIAL USE PERMIT FOR WYLIE HOSPITAL FOR TEMPORARY DOCTOR OFFICE BUILDING
AT NEW HOSPITAL Due to Dr. Ted Trimble not being able to finish his office
building by opening date the American Health Care Management saw need
to set up temporary office building. Planning and Zoning approved amended
site plan, City Council approved foundation construction. Bill LeCocq made
notion to issue permit for one (1) year. Anna Starnes seconded, all in favor.
SPECIAL USE PERMIT FOR DAY CARE CENTER AT 803 MARDI GRAS Three citizens were
present in opposition to this item, Robert Squires, Valentine St. resident;
LaVelle Randolph, Mardi Gras resident; Sarah Connelly. Mr. Bill LeCocq
stated that operation of a business was in violation of deed restrictions on
Mardi Gras. There was great concern about the traffic already generated
in that area. Chairman Hampton asked minutes to reflect that they were not
trying to deny free enterprise. Kent Crane made motion to deny request,
seconded by Anna Starnes, all members in favor of denying request.
Twenty-six property owners were notified, eight responded, three for,
four against, one abstained.
VARIANCE REQUEST TO ZONING ORDINANCE ON FRONT BUILDING LINE REQUIREMENTS
FOR 400 S. JACKSON Richard Parker is going to construct office building
• at this location and requested front yard variance from 25 ft. to 231 ft.
Out of 10 property owners notified, five responded, four for and one against.
Bill LeCocq made motion to grant variance, Nancy Conkle seconded, all
in favor.

VARIANCE REQUEST TO ZONING ORDINANCE ON REAR BUILDING LINE REQUIREMENTS FOR
101 TANGLEWOOD CIRCLE - Kevin St. John owner of Loft 8, Blk. C, Rush
Creek Addition, requested rear yard variance due to this lot being very
shallow. Ordinance states rear set back is 25 ft, and 10 ft. for accessory
buildings. Mr. Kent Crane recommended that Planning and Zoning be on the
outlook for shallow lots in future subdivisions. The Board was advised that
City Council and Planning and Zoning don't look at size and shape of lots,
as much as they do to roads, utilities, etc. Kent Crane made motion to
approve variance, Nancy Conkle seconded, all in favor.
All Board members need page 30 of Zoning Ordinance #81-5, which was left
out of their copies.
The Board also requested that the Zoning Board of Adjustment Guidelines
be put on the Boards next agenda for approval .

MINUTES - April 19, 1983

The Wylie Park and Recreation Board met at 7:00 P.M. , on April 19,
1983 in the Tower Suite at First State Bank with Chairman Pat Minihan
presiding. There was a quorum present. Those present were: Lowell
Brewster, Retha Tibbals, Don Whitt, Al Draper, Stuart Wallace, Ken
Swayze, City Manager Lee Vickers , and Carolyn Jones. Mr. Richard
Parker and Duane Helmberger were absent.
Wylie Community Park Status: Mr. Lee Vickers reported the work was
almost complete on the head walls at the park entrance, with only
clean up on the ditch area and moving of some dirt and the job
would be completed. Mr. Vickers also requested that the gate being
made for the Park entrance be located on the north side of the bridge
going into the park.
Mr. Lee Vickers reported that we need an additional 1900 feet of cable
to complete the fencing around the Park. Texas Power & Light is
looking for some cable for us at reasonable charge.
Mr. Lee Vickers also reported that due to lack of funds, the hand
blowers for the restrooms at the park had not been ordered until
recently. As soon as they are delivered they will be installed
in the restrooms.
The Wylie Lions Club will be purchasing and installing another water
fountain at the Park. Chairman Minihan said that John Morgan told
him that Percy Simmons would be pouring the concrete slab for the
fountain and doing most of the installation.
Mr. Lee Vickers also reported that the Park is almost ready for a
final inspection from the Texas Park Board. One more major project
is to get the Park sign made and installed at the entrance. The
Board agreed that Mr. Vickers should go ahead and order this sign
and have it installed. Mr. Vickers would like to have the final
inspection before we have the Park Dedication. It is expected that
the Texas Park Board would go ahead with the inspection as long
as we show purchase orders for the other three bleacher pads and
they would not have to be installed at the time of inspecion.
The Board agreed that some type of walk way or drive way be installed
from the parking lot to the concession stand in order for the delivery
trucks to service the facilities prior to games or activites. Mr. Lee
Vickers said that Mr. W. A. Allen had come out of retirement and
would be working on this road again this year as he had done in the
past. Mr. Allen will be mixing a solution similar to a lime base
with the dirt and then roll and pack it down. This was done last
year and the trucks did not seem to have any trouble getting in or
out during the rainy weather.
The Board agreed that a sign was needed for the water fountain in
Akin Pavillon. This fountain was donated to the Park by the Kiwanis
Club.
The ramp for Akin Pavillon is to be made of concrete with rough
finish for traction for wheel

Akin Pavillon cost approximately $12,000.00. J. W. Akin donated part
of this and Ken Swayze and his sons did the work. The building has
more value to the Park and City than what the building cost.
Mr. Stuart Wallace inquired as to how much land the Park now consist
of since the Hunt Land exchange has been completed. Mr. Vickers
reported that the park still consist of approximately 41 acres.
Mr. Stuart Wallace than made the suggestion that the creek line
have some type of marking or fence row in order that all the
citizens visiting the Park would know the boundry lines.
PARK BOARD TERMS: Mrs. Retha Tibbals, Mr. Ken Swayze, and Mr.
Pat Minihan terms will be up in June of this year.
Mr. Al Draper, Mr. Duane Helmberger, and Mr. Richard Parker will
be serving on the board through June, 1984.
Mr. Don Whitt, Mr. Stuart Wallace, and Mr. Lowell Brewster will
be serving on the board until June, 1985.
Chairman Minihan stated that while we all have the option of being
relieved as the terms expire, I wish you would consider remaining
on the board if possible until all phases are completed.
Bill Coker, Randall Gaston, and Thomas J. Mayes have volunteered
to serve on the Park Board as needed. Chairman Minihan asked the
board if they would like to add these three or put their names on
a waiting list as replacements terms are completed. This was
presented for the members to think about until the next meeting.
Summer Schedules: Mr. Roy Taylor is in charge of the baseball
schedules for this summer.
Soccer fields on Highway 78 are being used for this Spring season,
but will be moved to the Park fields for fall soccer. Chairman
Minihan requested that W. S. A. go ahead and paint the soccer goals
which were made by Mr. Ellis and have them ready for fall season.
Mr. Stuart Wallace said that W. S. A. had the paint and would see
that these goals were painted.
This grass is coming up and is in much better shape this year
compared to last year. Baseball fields have been maintained and
are in very good condition.
We need to get the trash bins out and set around the ball fields,
since the games will be starting within the next few weeks.
Some of the Board members say we still have a few problems with
motor bikes. riding through the grounds area and not on the drive-
way and parking lot. There is not as much of this since the post
and cables have been installed but there is still a few people
riding around on the ball fields.
The Board requested that the gate be finished and put up in the
entrance to the Park and that the Wylie Police Department be in
charge of locking up the Park at night and unlocking the gate
in the mornings. The gate post will be 18" deep and will be set

in concrete and should keep the public out after hours.

Mr. Stuart Wallace wanted to know if the City has come up with a
policy in order to keep the fields from being scheduled with more
than one game at a time. The Board agreed that W. S. A. should
be in charge of scheduling games and keep some type of records.
Mr. Don Whitt suggested that the Board draw up arrangement for
use of the fields plus policies that state who will be in charge
of the Park and programs coming up. Mr. Lee Vickers
said that such a policy and arrangement had already been made and
Chairman Minihan requested he be given a copy of this at a later date.
PHASE II - FUTURE PROJECTS: Chairman Minihan said the Chamber of
Commerce is attempting to come up with a program and financing
to build a swimming pool which would be located in the Park Area.
Chairman Minihan said he would like to see some type of building
at the Park for Community use (Community Center). Mr. Stuart
Wallace ask what he was calling a Community Center. Chairman
Minihan said it would be for City meetings, different group
organizations to use, senior citizen programs, etc. The building
would be approximately the size of the Methodist Church fellowship
hall or the Catholic church new building.
Mrs. Retha Tibbals would like to see an auditorium facing the
High School , this building would be joined to a Community Center.
The board would also like to see some type of jogging path around
the park.
The Park Board would like to have capital improvement funds set
up in the 1984 City budget.
MEETING: The Board agreed that they should meet each month through
the remainder of this year. The Board will meet the third (3rd)
Tuesday night of each month at 7:00 P. M.
The next meeting Chairman Minihan will appoint committees to do
study and work on the remaining Park Phases.
There being no further business, Stuart Wallace made a motion to
adjourn, seconded by Lowell Brewster. All in favor.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE
ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS HERETOFORE AMENDED
(ORDINANCE NO. 81-5) , TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED
PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED: PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES
FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the Governing Body of the
City of Wylie, Texas, in compliance with the laws of the State of Texas
with reference to the granting of zoning changes under the zoning ordinance
and zoning map, have given requisite notices by publication and otherwise,
and after holding due hearings and affording a full and fair hearing to
all property owners generally, the said Governing Body is of the opinion
that said change of zoning which is on application of Kenneth Crawford
should be granted and the Comprehensive Zoning Ordinance of the City of
Wylie should be amended in the exercise of its legislative discretion:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of
Wylie, Texas be and the same is hereby amended by amending the Zoning
Map of the City of Wylie, to give the hereinafter described property a
new zoning district classification, to wit:
"R" RETAIL
Said property being described as follows:
Lot 3, Block 6, Keller First Addition; 404 South Jackson.
SECTION 2. That all ordinances of the City in conflict with the
provision of this ordinance be, and the same are hereby, repealed and
all other ordinances of the City not in conflict with the provisions
of this ordinance shall remain in full force and effect.
SECTION 3. That the above described property shall be used only in
the manner and for the purpose for in the Comprehensive Zoning Ordinance
of the City, as amended herein by the granting of the zoning classifi-
cation.
SECTION 4. That should any paragraph, sentence, subdivision, clause,
phrase or section of this ordinance be adjudged or held to be uncon-
stitutional , illegal or invalid, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof other
than the part so decided to be invalid, illegal or unconstitutional
and shall not affect the validity of the Comprehensive Zoning Ordinance
as a whole.
SECTION 5. That any person, firm or corporation violating any of
the provisions or terms of this ordinance shall be subject to the same
penalty as provided for in the Comprehensive Zoning Ordinance of the
City, as heretofore amended, and upon conviction shall be punished by
fine not to exceed the sum of two hundred dollars ($200.00) for each
offense, and that each day such violation shall continue to exist shall
constitute a separate offense.
SECTION 6. It is necessary to give the property described herein
the above mentioned zoning classification in order to permit its proper
development and in order to protect the public interest, comfort and
general welfare of the City. Therefore, this ordinance shall take effect
immediately from and after its passage and publication of its caption,
as the law in such cases provides.

OF THE UNIFORM PLUMBING CODE, 1982 ADDITION, REGULATING THE INSTALLATION
AND MAINTENANCE OF PLUMGING PIPES AND FIXTURES IN ALL BUILDINGS WITHIN
THE CITY OF WYLIE; REPEALING THE SOUTHERN STANDARD PLUMBING CODE AND ALL
OTHER ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE ISSUANCE OF
PERMITS AND COLLECTION OF FEES THEREFORE; CONTAINING A SEVERANCE CLAUSE;
PROVIDING FOR PENALTIES FOR VIOLATIONS; AND PROVIDING FOR AN EFFECTIVE
DATE THEREOF:
WHEREAS, the City Council of the City of Wylie, Texas, in order to
insure the public safety for its citizens and to conform to the Uniform
Building, Electrical , Mechanical and Plumbing Codes in use by most of
the cities within the North Central Texas area, and
WHEREAS, the Uniform Plumbing Code, 1982 Edition, with appropriate
appendices, is designed to provide a good plumbing system with minimum
regulations, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1. That certain documents, three copies of which are on
file in the office of the City Secretary and being marked and designated
as Uniform Plumbing Code, 1982 Edition, together with appendices A, B,
C, D, E, G, H, and I are hereby referred to, adopted and made a part of
this ordinance hereof as if fully set out within this ordinance.
SECTION 2. That the present City of Wylie ordinance which adopted
the Southern Standard Plumbing Code, together with other ordinances
which may be in conflict herewith, are hereby repealed and superseded.
SECTION 3. That the City Secretary shall certify to the adoption
of this ordinance and shall cause the caption hereof to be published one
time in the official newspaper of the City of Wylie.
SECTION 4. That if any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held to be unconstitutional ,
such decision shall not affect the validity of the remaining portions
of this ordinance.
SECTION 5. That persons, firm or corporations found to be in
violation of the terms of this ordinance shall be subject to a penalty
not to exceed two hundred dollars ($200.00), and that each day of
continuing violation shall be considered a separate violation.
SECTION 6. That this ordinance shall be declared to be in full
force and effect from and after 45 days after the adoption by the City
Council and the publication of the caption one time in the official
newspaper.

FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Wylie, Texas has recently
adopted the Uniform Building Code, 1982 Edition, and is desirous of
adopting the companion codes related thereto, and
WHEREAS, the City of Wylie presently has no mechanical code in
force, leaving a possible gap in the protection of public safety,
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1. That certain documents, three copies of which are on
file in the office of the City Secretary and being marked and designated
as "Uniform Mechanical Code", 1982 Edition, published by the International
Conference of Building Officials, including appendices A, B, C, and D,
for regulating the installation and maintenance of heating, ventilating,
cooling and refrigeration systems within the City limits of the City of
Wylie, on file in the office of the City Secretary, are hereby referred
to, adopted and made a part hereof as if fully set out in this ordinance.
SECTION 2. That all ordinances of the City of Wylie in conflict
herewith are hereby superseded and are null and void insofar as they
conflict with this ordinance.
SECTION 3. That the City Secretary shall certify to the adoption
of this ordinance and cause the title hereof to be published one time
in the official newspaper of the City of Wylie.
SECTION 4. That if any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held to be unconstitutional ,
such decision shall not affect the validity of the remaining portions of
this ordinance. The City Council hereby declares that it would have
passed this ordinance, and each section, subsection, clause or phrase
thereof, irrespective of the fact that any one or more sections, sub-
sections, sentences , clauses or phrases be declared unconstitutional .
SECTION 5. That any person, firm or corporation found guilty of
a violation of any portion of this ordinance shall be subject to a
penalty not to exceed two hundred dollars ($200.00), and each day that
the penalty shall continue.shall be considered a separate violation.
SECTION 6. That this ordinance shall take effect 45 days from
and after the publication of its caption in the official newspaper of
the City of Wylie, Texas.

AN ORDINANCE ABANDONING THE SHORT SECTION OF ALLEY RUNNING NORTH
AND SOUTH BETWEEN JACKSON AND BIRMINGHAM STREETS AND BETWEEN CALLOWAY
AND HIGHWAY 78; RESERVING THE ALLEY AS A UTILITY EASEMENT; AUTHORIZING
THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR SURFACE RIGHTS TO THE ALLEY;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1. That, in accordance with Article 1016, Vernon's Texas
Civil Statutes, the alley lying in a north-south direction between
Jackson and Birmingham Streets and Calloway and State Highway 78, be
and it is hereby abandoned, for purposes of public right-of-way use
as an alley.
SECTION 2. That the Mayor be, and he is hereby authorized, to
execute a quitclaim deed to the adjacent and abutting property owner or
owners of this alley for purposes of surface use only.
SECTION 3. That the City hereby retains jurisdiction of said alley
for purposes and uses necessary as a utility easement, thereby continuing
• the maintenance, repair and operation of public utilities within said
alley, both beneath ground level and in the air above the ground.
SECTION 4. That a certified copy of this ordinance be filed in
the office of City Secretary and in the office of County Clerk at the
Court House in McKinney, Texas.
SECTION 5. That the cost of preparation of any quitclaim deed
which may be executed by the Mayor, be paid for by the abutting property
owner or owners.

alteration, repair, moving, removal , demolition, conversion, occupancy,
equipment, use, height, area and maintenance of all buildings or
structures in the City of Wylie providing for issuance of permits and
collection of fees therefore; and each and all of the regulations,
provisions, conditions and terms of such "Uniform Building Code,"
1982 edition, and the "Uniform Building Code Standards," 1982 edition,
published by the International Conference of Building Officials, on
file in the office of the City Secretary are hereby referred to,
adopted and made a part hereof as if fully set out in this ordinance.
SECTION 2. That Ordinance No. 78-3 of the City of Wylie entitled:
An ordinance of the City of Wylie, Texas, regulating the erection,
construction, enlargement, alteration, repair, moving, removal , demolition,
conversion, occupancy, equipment, use, height, area and maintenance of all
buildings or structures in the City of Wylie, Texas; providing for the
issuance of permits and collection of fees therefore; repealing Ordinance
No. 78-3 of the City of Wylie, Texas and all other ordinances and parts
of the ordinances in conflict therewith; containing a severance clause;
providing penalties for violations; and an effective date. All other
ordinances of parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. That the City Secretary shall certify to the adoption
of this ordinance and cause the same to be published.
SECTION 4. That if any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held to be unconstitutional ,

WHEREAS, the City Zoning Commission and the Governing Body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to the
granting of zoning changes under the zoning ordinance and zoning map, have given
requisite notices by publication and otherwise, and after holding due hearings and
affording a full and fair hearing to all property owners generally, the said Governing
Body is of the opinion that said change of zoning which is on application of Melvin
St. John should be granted and the Comprehensive Zoning Ordinance of the City of
Wylie should be amended in the exercise of its legislative discretion:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Wylie,
Texas, be and the same is hereby amended by amending the Zoning Map of the City
of Wylie, to give the hereinafter described property a new zoning district classification,
to-wit:

this ordinance be, and the same are hereby, repealed and all other ordinances of the
City not in conflict with the provisions,-of this brain—an-de-shall remain in full force and
effect.
SECTION 3. That the-above described property shall be used only in the manner
and for the purposes provided for in the Comprehensive Zoning Ordinance of the City,
as amended herein by the granting of this zoning classification.

SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid,
the same shall not affect the validity of this ordinance as a whole 'or any part or
provision thereof other than the part so decided to be invalid, illegal or unconstitutional
and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole.
SECTION 5. That any person, firm or corporation violating any of the provisions
or terms of this ordinance shall be subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction
shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for
each offense, and that each day such violation shall continue to exist shall constitute
a separate offense.
SECTION 6. It is necessary to give the property described herein the above
mentioned zoning classification in order to permit its proper development and in order
to protect the public interest, comfort and general welfare of the City. Therefore,
this ordinance shall take effect immediately from and after its passage and publication
of its caption, as the law in such cases provides.

AN ORDINANCE IMPOSING A TWO PER CENT GROSS RECEIPTS TAX ON THE CONDUCT OF
BINGO GAMES WITHIN THE CITY LIMITS OF WYLIE; CONTAIN - A SAVINGS CLAUSE;
A PENALTY CLAUSE; AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1. There is hereby levied a two per cent (2%) tax on the
gross receipts of all bingo games conducted within the city limits of
Wylie, in accordance with the Texas Bingo Enabling Act, Section 3(a) .
SECTION 2. If any section, subsection, paragraph, sentence, phrase,
or clause of this Ordinance shall be declared invalid for any reason
whatsoever, such decision shall not affect the remaining portions of this
Ordinance which shall remain in full force and effect; and to this end
the provisions of this Ordinance are hereby declared to be severable.
SECTION 3. Any person who violates any provision of this Ordinance
shall be deemed guilty of a misdeameanor, and upon conviction therefore
shall be fined any sum not exceeding Two-Hundred ($200.00) Dollars.
Each day the violation continues shall be considered a separate offense.
SECTION 4. The caption of this ordinance shall be published one
(1) time in a newspaper having general circulation in the City of Wylie
and shall be effective immediately upon its passage and publication.

Wylie. We believe the speeds will correspond closely to the speeds at which
the normal and prudent driver will drive under the existing conditions.

the preparation of your speed zone ordinance. We will also furnish and install
the necessary signs at the proper locations upon receipt of the ordinance from

CIVIL STATUTES, UPON FARM ROAD HIGHWAY NO.
3412 OR PARTS THEREOF, WITHIN THE IN-
CORPORATE LIMITS OF THE CITY OF WYLIE
AS SET OUT IN THIS ORDINANCE; AND PROVIDING A
PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE
VIOLATION OF THIS ORDINANCE.
WHEREAS, Section 169(b) of Article 6701 d, Vernon's Texas Civil
Statutes, provides that whenever the governing body of the City shall determine
upon the basis of an engineering and traffic investigation that any prima facie
speed therein set forth is greater or less than is reasonable or safe under the
conditions found to exist at any intersection or other place or upon any part of
a street or highway within the City, taking into consideration the width and con-
dition of the pavement and other circumstances on such portion of said street or
highway, as well as the usual traffic thereon, said governing body may determine
and declare a reasonable and safe prima facie speed limit thereat or thereon by
the passage of an ordinance, which shall he effective when appropriate signs
giving notice thereof are erected at such intersection or other place or part of
the street or highway; NOW, THEREFORE, BE TT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE , TEXAS:
SECTION 1.
Upon the basis of an engineering and traffic investigation hereto-
fore made as authorized by the provisions of Section 169(b) of Article 6701 d,
Vernon's Texas Civil Statutes, the following prima facie speed limits hereafter
indicated for vehicles are hereby determined and declared to be reasonable and safe;
and such speed limits are hereby fixed at the rare of speed indicated for vehicles
traveling upon the named streets and highways, or parts thereof, described as
follows:

ORDINANCE # 82-13
AN ORDINANCE ABOLISHING ORDINANCE #82-7 AND REPLACING ORDINANCE #80-03, PRO-
VIDING FOR CONDITIONS UNDER WHICH SUBDIVISIONS MAY B DEVELOPED BY BLOCKS AND
PHASES; PROVIDING A SAVINGS CLAUSE: AND PROVIDING ANEFFECTIVE DATE.
WHEREAS, Ordinance #80-03 was found to be unreasonable and unworkable and was
previously abolished by the adoption of ordinance #82-7, and
WHEREAS, the City Council believes it to be in the best interest of the City of
Wylie that more flexible conditions be provided under which subdividers can
subdivide and develop land, selling lots within the subdivisions at appropriate
times, and certificates of occupancy, and
WHEREAS, it is believed that a provision for notification of the purchaser of
the property be stipulated in this ordinance to the effect that the purchaser
should be aware of the requirements of this ordinance, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1. That Ordinance #82-7 is hereby repealed and the following conditions
shall supersede all of the conditions in Ordinance #82-7 and in Ordinance #80-03.
SECTION 2. That a subdivider may file a preliminary plat showing the entire
subdivision, and the various phases by which the subdivision will be developed,
and that lots may be sold within the phase to be developed upon approval of the
final plat by the City Council .
SECTION 3. As each consecutive block is completed; that is , the proper utilities are
installed and approved by the City, the streets and alleys are paved and approved
by the City, building permits may be issued on a block by block basis, but no
certificate of occupancy shall be issued by the building official until the
phase is completed and accepted by the City.
SECTION 4. That the subdivider shall include in the conditions of sale for
each lot within the subdivision a notice to the purchaser that no certificate of
occupancy shall be issued for any residence constructed therein unless and until
the City has approved and accepted that phase of the subdivision.
SECTION 5. Should any court of competent jurisdiction declare any section,
clause, or sentence of this ordinance to be invalid, the remaining sections,
clauses, and sentences shall remain in full force and effect.
SECTION 6. That thisordinance shall take effect immediately upon its adoption.

Gentlemen:
We own lots 1, 2,, and 3, in Block 35 of Railroad Addition, bounded
on the east by Jackson Street, on the South by Calloway Street, and
on the northwest by State Highway 78. There is a small section of
public alley located in the center of these three lots, running
north and south between Jackson .and Birmingham for a distance of
slightly more than one hundred (100) feet.
We understand that State Law provides that a City Council may, if
desired, abandon a street or alley right-of-way which is not needed
for public use upon petition of the owner or owners of land adjacent
to that public right-of-way on each side of it.
Please consider this letter as my petition of the City to abandon
this small section of alley so that I may use it in my business.
It will be most helpful to me if you will authorize the Mayor to
execute a quitciatii --deed in my favor for this small section of
alley.
At present, the alley is used as part of the parking area for our

I do not see buying a quantity of the "Police" decal less than 25, as
envision using at least 3 and possibly 4 of these on each vehicle.
1 would recommend purchase of the reflective material , as the item would
then serve a dual purpose of identification and safety for the officer
whose vehicle is along the side of the roadway in the darkness of night.
