SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole *or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides. APPROVED: MAYOR ATTEST: CITY SECRETARY DATE: April 8, 1983 TO: City Council FROM: City Manager i SUBJECT: Manager's Newsletter The General Telephone Company Rate Case Steering Committee met in Austin yeterday, at which time strategy was discussed for the coming rate hearing before the Public Utility Commission. Breifly, the situation is this: A. General Telephone has ask for an annual rate increase totally approximately 85 million dollars per year. B. Our consultants, Touche Ross, and Company recommend a rate increase totally approximately 28 million dollars per year. C. It appears the staff of the Public Utility Commission will recommend a rate increase totally approximately 65 million dollars per year. D. None of the people present at the meeting have approved the request of General Telephone for optional metered service. We have one copy each of the testimony to be presented by Sam F. Rhodes and Pat A. Loconto, On behalf of the Cities in which both rate consultants reached similar conclusions totally approximately 28 million dollars annual increase. The Public Utility Commission hearing starts on April 18th and should last about one week. A pre-hearing conference is scheduled for April 15th. I do not propose to attend that hearing, since the Steering Committee is aware that the City of Wylie does not want any rate increase whatso- ever. Arguments against the experimental optional metered service include: a. The use of a telephone does notsigni icant1y increase the cost of operating a telephone system. b. There are too many variables involved in optional metered service, with the result that no one can argue effectively against higher rates. c. The large telephone users will probably be swamped by their employees calling home or checking on the children or other calls which would cost those employees additional toll fees if they call from their home telephones. Page 2 Manager's Newsletter d. General Telephone wants to eventually have meters on all telephones within their system. e. The overall idea is to increase telephone company revenues, at the expense of telephone customers. In addition to unanimous opposition to the optional metered service provision of the rate increase request there was firm opposition to the twenty dollar service call charges requested by General Telephone. The prevailing feeling was that the Company already has charges which are so high that they can qualify as "rip offs" of the customers. We will keep you advised of significant developments in this case, and expect a status report from Attorney Don Butler within the next few days. We have made arrangements for the new logo decals to be installed on all motor vehicles of the City Monday morning, provided the weather is dry. Public Works Department worked all week on the concrete headwalls at the entrance to the Park, and finished pouring the west headwall about 7:45 last evening. The forms will be removed on April 11th, and the concrete rubbed out to match the east headwall . Much dirt work will be done on the ditch above and below the Park entrance so that water will not stand in the culvert. We have agreed to conduct a Park and Recreation Board meeting on April 19th, to discuss plans for the coming year and to review the progress which has been made at the Park. The entrance gate needs to be installed and the steel cable need to be completed, together with a motor vehicle gate which should be installed near Akin Pavilion. Mr. Bill Donaho is to plow and harrow the four acrea soccer field area west of the creek in preparation for sprigging bermuda grass for the fall soccer season. Chairman Pat Minihan has also agreed that the southwest baseball field area maybe developed as a soccer field area for fall soccer. Meanwhile, soccer is being conducted on the Bill Switzer acreage east of the Dairy Queen. Much of the materials used for concrete headwall forms will be salvaged for use in construction of the equipment storage shed at the Municipal Service Center. Mr. W. A. Allen has ask for a few days off, which we approved. Page 3 Manager's Newsletter Mayor Bob Squires has indicated he will request J. W. Akin to replace Harold Eavenson on the personnel committee to assist in the selection of Director of Public Works. If this is done, Mr. Akin will serve with Councilman Percy Simmons for this function and with Mayor Pro-Tem William Martin in reviewing the proposed personnel regulations. Mayor Squires will probably outline other committee activity which needs to be done within the next few weeks, as well as recommendation to the council for one or more informal work secessions, at which there will be no formal agenda items demanding council action. Mr. Noble W. Walker, of Austin has applied for a building permit for a temporary building to be used as Doctors offices at the Wylie Hospital . The building would be installed at the southeast corner of the Hospital and is anticipated to be used for approximately three years, after which it will be removed from the site. We believe it is in order for the Planning and Zoning Commission to approve this change to the Hospital site plan at its meeting of April 28th, but meantime, the plat review committee of the Planning and Zoning Commission will meet with me on Monday and make a preliminary study and recommendation to the Planning and Zoning Commission. If the plat review committee approves the amendment to the site plan, we will issue a foundation permit, so the contractor (Mr. Walker) can procede with installation of the piers for the temporary building. Mr. Walker has proposed to use commercial grade masonite exterior siding on this temporary building which is designed to resemble stucco exterior walls. This appears to me to be a violation of the ordinance requirement for the 75% masonary in the exterior walls, but since this is a temporary building, we doubt that this could be enforced. If you have strong feelings concerning this, please call me and let me know your wishes. We have been advised by the State Department of Highways and Public Transportation that a flashing red signal light will be installed soon at the intersection of Highway 78 and the new FM 544. In addition, you are reminded that installation of the full signal light system at Ballard and Highway 78 is due to begin in April and be completed in May. LSV:cj AGENDA BRIEF APRIL 12, 1983 Item no. 3 involves installation of new members of the City Council who were elected on April 2nd. The current City Council canvassed the votes of the election at a special meeting on the afternoon of April 4th. Council members elect are Cleo Adams, J. W. Akin, and Don Hughes. Item no. 4 involves a public hearing on a request to rezone a single lot located at 404 S. Jackson from SF-2 to R (retail ) . This property backs up to property already zoned retail and is one lot away from a recently rezoned retail lot on the north side. No opposition has been evident in the public hearing held by the Planning and Zoning Commission. Item no. 5 involves a plat review for a 14 acre proposed development located in Collin County on the east side of FM 544, but with in the extra-territorial jurisdiction of the City of Wylie. The Plan- ning and Zoning Commission recently approved this plat and recom- mended that the Council approve it on condition that the property owners within the subdivision be made aware that if and when the City annexes the property, the property owners themselves will be required to pay for any public improvements within the subdivision. Item no. 6 is a legal formality by which the City Council will approve and accept a drainage easement which will be used to carry storm water away from Kinsington Manor Estates. When approved by Council , the easement will be excuted by the Mayor and City Secretary and will be recorded both here and at the County Courthouse. Item no. 7 involves approvement of the paving plan for Pirate Drive from Second Street west to South Ballard. This will be an extension of the present thirty-one foot wide concrete street which was paved several years ago. When completed, it will relieve heavy traffic on Stone Road during the morning rush hour and the after- noon rush hour. It will also facilitate parents who need to drop off or pick up children at Wylie High School and Wylie Middle School . Item no. 9 , Mayor Squires is expected to request the Council to participate in one or more informal work secession during the coming week, some of which will be in joint secession with the Planning and Zoning Commission. LSV:cj CALLED CITY COUNCIL MEETING MARCH 8, 1983 7:00 P.M. • The Wylie City Council met in called session at 7:00 p.m. on March 8, 1983 in Council Chambers at City Hall . Mayor Squires presided. A quorum was present and notice of the meeting had been posted for the time and manner required by law. Those in attendance were the Mayor, Mayor Pro Tem Martin, Council members Harold Eavenson, Percy Simmons, Reta Allen, and Geline Dodd, Police Chief Royce Abbott, City Secretary Gail Wallace, City Manager Lee Vickers, Carolyn Jones, Phyllis and Clyde Floyd, Sarah Connelly, Teresa Squires, Randall Gaston, Bob O'Donnell , Harry B. Carroll , Bill Elam, John Parfait, Bill Kreymer, Harold Spence, Dennis Kauffman, Cathy McAnally, Mike McAnally, David Engelmann, Gary Jennings, Joe Gandy and Tammy Corley from Lone Star Gas, Daniel Johnson, GTE; Robert Stuart and Wanda Ronstein, GTE; Rhonda Rathje, GTE; Dwight Scott, and various VOE students. Mayor Squires gave the invocation. Mayor requested Item 2 which consisted of approval of previous meetings and accounts payable be split into two items and voted on separately. In regard to previous minutes he advised that an item pertaining to rezoning for a mobile home park had not been acted upon by the City ' Council on the advise of the City Attorney. The City Attorney's opinion was based upon the fact that the Planning and Zoning Commission had not given the Council a recommendation for or against the rezoning due to a tie vote. Due to confusion regarding the issue, the Mayor advised he had agreed to allow the Developer to be placed on the agenda on an emergency basis to discuss the procedures for resolving the issue of rezoning. Mayor Pro Tem Martin made motion to approve previous minutes, seconded by Councilman Eavenson. There was one item of concern in the accounts payable in which the Chamber of Commerce had reimbursed the City for the expenses Cal Westerhof incurred during a trip to Austin. Mayor Pro Tem Martin made motion to accept accounts payable as is and if there should be a need for further discussion in regard to who is responsible for the trip that it be done at a later date. Councilman Eavenson made motion to accept Mayor Pro Tem Martin's motion, seconded by Councilman Simmons. Motion carried, all in favor. Public Hearing to Rezone 7.038 acres from agriculture to SF-2 and industrial . Mr. Dwight Scott representing Jesse Espinosa, stated that this request to rezone would not be a detriment to the community. Mayor Squires drew the Public Hearing to a close. No further discussion was made. Councilwoman Dodd made motion to approve rezoning as recommended by Planning and Zoning Commission. Councilwoman Allen seconded, motion carried all in favor. Public Hearing to rezone 3.974 acres from agriculture to industrial (the site of Century Ready Mix Plant. ) Mayor Squires opened the public. hearing. There was concern as to the noise factor. Mayor Squires assured that the cement plant would comply with state regulations. Mayor Squires closed the public hearing. Mayor Pro Tem Martin made motion to accept rezoning request as recommended by Planning and Zoning Commission.. Councilman Eavenson seconded, all in favor. I2 ; Consider final plat, phase 2, Kinsington Manor Estates. Mr. Don Kreymer, developer, requested that phases 2, 3, 4 and 5 be approved as had been Idone with the Planning and Zoning Commission. Mr. Kreymer was aware that the two (2) year completion clock starts with Council approval of plat. If there are any major changes in the plat they are to be brought .back before Planning and Zoning and then to Council . Councilman Eavenson made motion to approve plats 2, 3, 4, and 5 of Kinsington Manor Estates with the understanding that Mr. Kreymer was aware of necessary steps on any changes or alterations set up in the subdivision ordinance. Seconded by Mayor Pro Tem Martin. All in favor. Variance request to construct model home in Kinsington Manor Estates. Mr. Don Kreymer stated that the home would not be occupied as a dwelling but used as a sales office. Councilman Eavenson made motion to accept request for variance, seconded by Councilwoman Allen. Four in favor. Councilman Simmons abstained. General Telephone Company request for rate increase. Mayor Squires pointed out that there was no action for the Council to take on this request as this would be done by the Public Utility Commission in Austin. Mr. Robert Stuart, Mr. Daniel Johnson and Ms. Rhonda Rathje representing GTE were available for discussion. Adoption of Ordinance setting speed limits on West F.M. 544. After dis- cussion by City Manager Vickers, Councilman Eavenson made motion to adopt the ordinance, seconded by Councilwoman Allen, all in favor. Request to permit building duplexes on South Second Street prior to making street improvements. City Manager Vickers made recommendation that due to the fact there had never been any improvements to this property that this tract should be treated as new development and should be developed in accordance with subdivision regulations. The zoning ordinance requires approval of a site plan on developed streets complete with public utilities. Councilman Eavenson made motion that this tract should be replated and utilities and street improvements be installed to comply with ordinance. Councilwoman Allen seconded, all in favor. Consider ordinance establishing revised electrical permit fees. City Manager Vickers recommended that this be tabled until further infor- mation can be given to the Council for comparison with other cities. Electrical Board will make an official presentation to Council at next regular meeting. Consider invitation of bids for connecting emergency generator to Police Department. Mayor Pro Tem Martin made motion to consider invi- tation of bids for connection and that actual approval come back to Council , Councilman Simmons seconded, all in favor. Consider approval of appointment of Acting Director of Public Works. City Manager Vickers recommended Mr. Joseph Cerretani for the temporary position of Public Works Director. Councilman Allen made motion that Councilman Eavenson and Simmons along with City Manager Vickers inter- , view applicant and make recommendation back to Council . Councilwoman Dodd seconded, all in favor. Consider letter of resignation of City Secretary. Councilman Martin made motion that since letter had been submitted to Council that they ;II is \l accept letter of resignation from City Secretary Gail Wallace. Seconded by Councilwoman Allen. Four in favor, Councilman Simmons abstained. Consider appointment of Acting City Secretary. City Manager Vickers recommended appointment of Mrs. Sarah Connelly, who had previously served the City in this position. Councilman Eavenson made motion to accept this appointment, Mayor Pro Tem Martin seconded, all in favor. Departmental reports were accepted by Council . EMERGENCY AGENDA ITEM Discuss procedures for resolving issue regarding rezoning request for mobile home park zoning on acreage south of Alanis and Martinez Lane. City Attorney Elliott advised Council that it would be illegal for them to act upon Planning and Zoning Commission recommendations as it was presented to Council in a 3/3 vote. Councilman Eavenson made motion to table until next meeting. Councilman Simmons made request that a special Council meeting be called for Monday, March 14, 1983 at 7:00 p.m. in Council chambers in order for this Council presently seated to take action on this matter. Councilman Eavenson ammended his motion to include Councilman Simmons request and that the City have legal counsel available at that meeting. Councilman Simmons seconded, all in favor. Adjournment. The developers requested immediate disannexation. After discussion on this matter Councilman Martin made request for a caucus between Council and Mr. Jackson, seconded by Councilman Simmons. All in favor. Mayor Squires suggested a brief executive session to confer with legal counsel . On motion by Councilman Martin, seconded by Councilman Simmons, it was voted to go into executive session in accordance with Article 6252-17, Section 2e to discuss legal matters. . Box 428, • Wylie, Texas 75098 Re: Zoning Application of Melvin St. John Dear Mr. Vikers: We have reviewed the Notices and Minutes of the various meetings involved in the abovementioned Zoning Application in order to answer the following questions of the Council: Question: Has the City Council of the City of Wylie availed itself of the powers conferred by the Zoning Act (Articles 101A through 1011J Vernon's Ann. Civ. St. by appointing a Planning and Zoning Commission? We answer this question in the affirmative. Ordinance 79-26 provides for the creation of a Planning and Zoning Commission composed of seven (7) members. Question: Is the Zoning Appllication in question a zoning change or is it the first request for the establishment of boundaries of an original district with a permanent zoning classification? The St. John application is an application to establish for the first time an original boundary district with a permanent zoning classification. Therefore, the application is not for a change of zoning and Article 1011e has no application. The City's Compreshensive Zoning Ordinance Section 7-100 states that all territory hereinafter annexed to the City shall be temporarily classified in the "A" agricultural district until permanent zoning classifications are given the area by the City Council after public hearing. Our opinion here is based upon the holding in the case of Appolo Development, Inc. vs City of Garland 476 S. W. 2nd 365. Question: When the Zoning Application reaches the City Council for final adoption of an ordinance to grant the zoning change requested what vote will be required to adopt the ordinance? The ordinance can be adopted by a majority vote of the Council Members present and voting on the ordinance. The provisions of Article 1011e dealing with "changes" of zoning would not be applicable under any circumstance to require a three- fourths vote in order to adopt the ordinance. This opinion is based upon the Court's decision in the Appolo case. • Question: May the City Council take action on the zoning question prior to its receiving a report from the Planning and Zoning Commission and does the report have to be in the form of a recommendation? The City Council, having adopted and appointed a Planning and Zoning Commission pursuant to Article 1011f has brought itself within the provisions of the zoning statues. The City, therefore, must follow the process which includes a proper hearing before the Planning and Zoning Commission, a report from the Planning and Zoning Commission to the City Council and a proper hearing before the City Council By proper hearing is meant a hearing conducted after notice as is required by statute. Article 1011f (b) states that if a Zoning Commission is appointed, it shall recommend the boundaries of the various "original districts" — that such Commission shall make a preliminary report and hold public hearings before submitting its final report and the City Council shall not hold its public hearings or take action until it has received the final report of the Commission. It is our opinion that the report of the Planning and Zoning Commission need not be in the form of a recommendation. A report by the Commission of a tie vote on a Motion to recommend approval of the zoning, as was made by the Planning and Zoning Commission would have been enough to give the City Council authority to act. However, it appears from the record that the City Council did not hold its public hearing but merely sent the matter back to the Planning and Zoning Commission. It is our opinion that before the City Council can act on the Zoning application it must hold a public hearing after giving 15 days notice by publication, at which time the ordinance to approve the zoning may be passed by majority vote of the members of the City Council present and voting. The Electrical Board was called to order at 7:02 P.M. by Mr. Robert Roddy, to discuss permit costs. Members persent were, Mr. Robert Roddy, Mr. Glenn Housewright, Mr. Mickey Foster, Mr. Glenn Morrow, Mr. Charles McClaine. Mr. James Potter was absent from this meeting. Items discussed were to charge $1 .00 per 100 square feet of floor space for residential , this includes all new construction and all add ons. Minimum permit fee of $10.00 for any inspection, this covers 220 plugs, adding a receptacle or switch or ceiling fans. Commerical will be rated at $2.00 per 100 square feet for new construction, add ons or remodel . All signs either permenant or temporary are to be permitted and inspected and installed as per N. E. C. All persons performing electrical work in City will be registered with the - City. Any person taking out permits must be a master electrician registered in the City. Fees for masters are $50.00, and contractors Fee is $75.00. All contractors must have a masters license or a full time master in his employ. Preliminary plat for Creekside Estates: On motion by Bryant Barry, seconded by John Seeley, it was voted unanimously to recommend that the preliminary plat for Creekside Estates be accepted and approved with the stipulation that, al- though the Commission feels the street should be paved with con- crete, such a requirement would not be economically feasible; however, when and if the property is annexed to the City of Wylie, property owners will be assessed the cost of concrete pavement. Further, that the fire protection and water utilities improvements comply with the City of Wylie regulations. 3. Discussion of the current Zoning Ordinance: Mike McAnally recommended that a discussion session be included on a future agenda, to allow time for discussion of the current zoning ordinance, the comprehensive community plan, and the effects of the court decision, "Apollo Developers, Inc'. vs. City of Garland" on the current zoning ordinance. He also recommended that future agenda items include "permanent" "A" zoning for the recently annexed Birmingham Trust Land and the two-hundred-foot strip of land not to be included as a part of Glen Knoll Mobile Home Park. 4. CITY COUNCIL MINUTES SPECIAL MEETING APRIL 8, 1983 6:00 P.M. The Wylie City Council met in special session at 6:00 p.m. on April 8, 1983 in the Council Chambers at City Hall . Mayor Squires presided. A quorum was present and notice of the meeting had been posted for the time and manner required by law. Those in attendance were the Mayor, Mayor Pro-Tem William Martin, Council members Geline Dodd, Reta Allen, Harold Eavenson, and Percy Simmons, City Secretary Sarah Connelly, City Manager Lee Vickers, Larry Jackson, counselor for City, P & Z members Ab Harrison, Mike McAnally, and Bryant Barry, Councilmen-elect Don Hughes and Cleo Adams, Vicki Martin, school board member;Scottie Austin, Cathy McAnally, Richard Parker, Randall Gaston, Al Kittner, Harry Tibbals, Jerry Davis, Harold Spence, Melvin St. John, Ed Collins, Robert O'Donnell , atty. ; R. 0. Martin, and Rich Connelly of the Dallas Morning News. Mayor Squires called meeting to order and recognized councilmen-elect Don Hughes and Cleo Adams, who were in attendance. Mayor opened the Public Hearing on 36.39 acres in Richard D. Newman Survey. Mr. Robert O'Donnell , representing the developers, stated that his clients felt that putting in a mobile home park would be an appropriate use of the land south of Martinez and Alanis Lanes, as it was bound by a sewer treatment plant and landfill . Mr. O'Donnell advised Council that a plat showing the 200 ft. buffer zone had been filed with the City Manager, who advised that it had been filed with the City. Mr. Richard Parker, Mr. Jerry Davis, Mrs. Vicki Martin, and Mr. Bryant Barry addressed the Council in opposition of the zoning. Stating it would not be to the best interest of the City of Wylie, or its citizens to zone this property Mobile Home District. Mrs. Martin stated the school board was concerned at the overcrowding of the schools. Mayor drew the public hearing to a close, and returned the matter to the Council for discussion. Councilman Eavenson made statement that any commitment made outside of the Council Chambers or inside when Council was not in session, was not an official act. And he submitted that the Council give thought to this if such commitments had been made. Mr. Larry Jackson, counselor for the City, advised that the 200 ft. buffer zone was zoned as temporary agriculture, and the only use of this land at this time must fall under our zoning ordinance zoning for agriculture. This buffer zone would have to be permanently zoned before any other use could be made of it. Mr. O'Donnell advised Council that the developers were aware that they must submit a site plan to the Planning & Zoning Commission and to the City Council before the issuing of building permits. City Manager Vickers also acknowledged that the site plan must come before P&Z and the Council . Councilman Simmons moved that the 36.39 acre out of 43.401 acre tract of land in the Richard D. Newman Survey, located south of Martinez and Alanis Lanes be permanently zoned Mobile Home District, seconded by Councilwoman Allen. Three in favor, Councilman Simmons, Councilwomen Allen and Dodd. Two in opposition, Councilmen Eavenson and Martin. Councilman Simmons ammended his motion to state also that there was an ordinance on the books, and that as long as it was there they were to comply with it and were not to ask for any variance. If strict compliance to the ordinance was not adhered to then the development was to be halted. Motion was seconded by Councilwoman Allen. Three were in favor of the amendment, Councilman Simmons, Councilwomen Allen and Dodd.
